In the wake of George Floyd’s horrific death, there has been an outcry to change police departments across the country. In Minneapolis, the city where Floyd was killed at the hands of police, the Hennepin County Court proposed a court order that requires the Minneapolis Police Department to enact immediate structural changes. Some of the changes include that any police officer regardless of rank or tenure is required to intervene, either physically or verbally, if they observe another officer using any unauthorized use of force. Some cities like New York City and Minneapolis are pushing to divert a portion of police funding to social services. Supporters of this idea argue that reallocating the funds to services that benefit the people and marginalized groups will heal the community. The Pensacola Police Department is also evolving. After Tymar Crawford was shot and killed by Pensacola Police Detective Daniel Siemen in July 2019, the grand jury recommended PPD officers receive immediate retraining in the areas including use of force, use of deadly force and tasers. Mayor Grover Robinson announced in January that the City increased the PPD training budget for the 2020 fiscal year by 75 percent, which puts the budget at $250,000. In addition to those changes, the City of Pensacola hired law enforcement expert Cedric Alexander, who has more than 40 years of experience as an officer, in January to consult and train the PPD. Alexander served as Chief of Police for DeKalb County, a large metropolitan county with more than 700,000 citizens, a federal security director with the U.S. Department of Homeland Security and was appointed to the Board of the Emerald Coast Utilities Authorities by Gov. Ron DeSantis. The City is using Alexander to instruct implicit and explicit bias training as well as leadership training. Although COVID-19 disrupted this training, Robinson stated that 95 percent of the of-
ficers went through the training by mid March. Business Climate inquired Alexander on the purpose of the training. Alexander explained that there are two types of bias: implicit and explicit. Implicit bias is stereotypes or attitudes that affect one’s actions unconsciously. Explicit bias is stereotypes or attitudes one is conscious of. “We can see explicit bias, but it’s the implicit bias that we all want to be aware of. The training gives us an idea where [the bias] comes from and how it evolves within us and our society and how to recognize it,” Alexander explained. “So when we recognize it, we can determine what to do to help ourselves and others.” Alexander puts an emphasis on making the class a safe environment so that the officers feel they can confront their personal biases without judgement. Alexander said that making participants feel guilty about their biases prevents them from unlearning their behavior. “People learn when they are able to have their own personal process around their implicit biases. That helps them to be conscious of it,” Alexander said. “When we can recognize our biases and talk with others and ourselves, it allows us to be aware of our biases and challenge our biases without fear.” Unfortunately, there isn’t a way to measure if this implicit and explicit bias training is effective. However, Alexander explained that this training isn’t
just a one-and-done course. After the officers have completed the training and some time has passed, Alexander then calls them back in to review the course. This review determines if the officers have retained the information and are able to apply it in their work. “We have to make sure that we find time to bring our officers back because you cannot do one time, check the box training,” Alexander said. “It has to be ongoing in order for it to be effective.” The leadership training Alexander instructs is focused on establishing the ideal attitude of a leader. “What I’ve learned over the years as a leader of multiple agencies from local, state, and federal government is that my attitude and what I role model within those organizations is more important than anything you could imagine,” Alexander said. The training covers the importance of the language the officers use when speaking to those they are in command of and the community the officers serve. Alexander also teaches them to examine their attitudes toward people, places and things. The course encourages officers to express challenges they’ve faced as leaders, share advice and provide support. This open dialogue helps the officers improve as leaders. “The Pensacola Police Department has been very receptive to the training. I truly believe they take it seriously,” Alexander said. “They understand the importance of great leadership training in order to provide and function in a way that will benefit their depart-
ment and this overall community here in Pensacola.” Alexander is also in the process of reexamining the way the PPD recruits officers. He believes that police departments across the country should do the same. The issue with the way the police force currently advertises is that they focus on the violent, adrenaline fueled aspects of the job. Alexander believes that police advertisement needs to be centered on the most predominant element of being an officer: building relationships.

Yes, that does happen in police work. But 80 percent of the time the work you do is building relationships and meeting with people,” Alexander said. “Policing is about building relationships with the communities we serve.” Redirecting police force advertisements to showcase the nonviolent, compassionate work officers are expected to do will hopefully decrease the
interest of violent, hot tempered people. However, that’s only half the battle. Alexander said that the police force needs to think critically about the people they hire. “We want men and women to come into our police department with a moral compass. You can’t be like those four officers in Minneapolis,” Alexander said. “One officer put his knee in a man’s neck and grounded it into the ground with no compassion. Cavalier in his actions. Utilizing techniques they were not even trained to use on a man who was under control. You have to have officers who are compassionate toward other human beings— who respect humanity.” Alexander explained that once the right type of officer has been hired, they have to have good supervision that models the expectation of them as professional public safety officers. After Crawford was killed, the Pensacola chapter of Dream Defenders, a statewide organization, asked that the city implement a civilian oversight board. Alexander stated that he is in support of creating that board, but he would first like to host meetings with the community and leaders about the details. Robinson agreed to form a citizen advisory committee, which is similar to the board the Dream Defenders requested. Robinson appointed Hale Morrissette, Regional Organizer of the Dream Defenders, to the board on June 6. Robinson confirmed on June 8 that he and Alexander are in the process of developing the citizen advisory committee.

In compliance with guidance issued by the Centers for Disease Control and Prevention (CDC) and national and local authorities regarding the spread of the novel coronavirus (COVID-19), the Court has determined that, effective immediately, the United States Courthouse and the Winston E. Arnow Federal Building, located in the Pensacola Division of the Court, must be temporarily closed to the public and will remain closed to the public until further notice. Staff in the Pensacola Division Clerk’s Office will remain available by telephone, but the public intake counter will not be accessible to the public. Those without access to the Court’s electronic filing system must submit non-emergency filings by mail. If an individual needs to file an emergency filing in paper, filers must contact the Clerk’s Office to notify the Court and make arrangements to submit the filing. The Pensacola Division grand jury proceeding scheduled for Tuesday, July 21, 2020, will be rescheduled. The Court finds that the ends-of-justice are served by suspending the 30-day statutory speedy trial time period set forth in 18 U.S.C. § 3161(b), resetting the 30-day period to begin anew on the date this Court permits grand juries in the Pensacola Division to resume meeting, and excluding the period of time between the date on which a Defendant is arrested and the date on which this Court first permits grand juries in the Pensacola Division to resume meeting, for all Speedy Trial Act purposes. This action is necessary to avoid a miscarriage of justice and also to avoid unnecessary risk to grand jurors, the Defendant, witnesses, counsel, Court staff, and the public. Good cause exists for a finding of excludable time under the Speedy Trial Act, 18 U.S.C. § 3161(h)(7), because the ends of justice in granting such suspensions and continuances outweigh the best interest of the public and the defendant in a speedy indictment and speedy trial. This action is not based on congestion of the Court’s calendar, lack of diligent preparation on the part of the attorney(s) for the government, or failure on the part
of the attorney(s) for the government to obtain available witnesses. All Pensacola and Panama City Division Central Violations Bureau (CVB) initial appearances scheduled for July15, 2020, will be rescheduled. All initial appearances, detention hearings, and arraignments for the Pensacola and Panama City Divisions from July 13, 2020 through July 24, 2020, will be held before Magistrate Judge Martin A. Fitzpatrick. Initial appearances, detention hearings, and arraignments for Pensacola and Panama City Division in-custody defendants may be conducted via video teleconference or in-person, as directed by Magistrate Judge Fitzpatrick. The court will presume that a defendant consents to conducting proceedings via video teleconference unless a defendant timely objects. See Fed. R. Crim. P. 5(f) and 10(c). Any male defendant arrested from July 13, 2020 through July 24, 2020, pursuant to federal law in Pensacola or Panama City Divisions of the Northern District of Florida, will be transported by the arresting agency to the Federal Detention Center in Tallahassee, Florida. Any female defendant arrested from July 13, 2020, through July 24, 2020, pursuant to federal law in Pensacola or Panama City Divisions of the Northern District of Florida will be transported by the arresting agency to United States Courthouse in the Tallahassee Division for her initial appearance, detention hearing, and arraignment. Initial appearances, detention hearings, and arraignments for defendants who are not in custody will be scheduled on a case-by-case basis as directed by Magistrate Judge Fitzpatrick. The Court recognizes that Court operations during the COVID-19 pandemic continue to evolve and will issue additional Administrative Orders as necessary based on recommendations from other federal and state government and health officials. WEST FLORIDA PUBLIC LIBRARIES RECEIVES CENSUS GRANT West Florida Public Libraries received a grant from the American Library Association to purchase two laptops which are now located in the lobby of the Pensacola Library, located at 239 N. Spring St., for patrons to come in and fill out their Census forms. American Library Association provided 59 libraries with a Library Census Equity Grant, $2,000 to bolster their service to hard-to-count communities and help achieve a complete count in the 2020 Census. On Tuesday, July 14 from 11 a.m. - 1 p.m., all West Florida Public Libraries locations are encouraging families to participate in the 2020 Census by giving away Census tote bags and notebooks. The giveaways will be distributed during the Feeding the Gulf Coast food program for youth. Giveaways are available until they run out. Masks will also be available as part of Escambia County’s Mask Up, Escambia! public health campaign. The results of the 2020 Census will help determine how hundreds of billions of dollars in federal funding flow into communities including Escambia County and the City of Pensacola
every year for the next decade. That funding shapes many different aspects of every community throughout the U.S., from highway planning and public transit to educational programs and housing assistance. Escambia County’s current response rate is 59.9%, which is 20.1% lower than the goal of an 80% response rate. Florida’s response rate is currently 59%. ESCAMBIA COUNTY FIRE RESCUE URGES RESIDENTS TO ‘LOOK BEFORE YOU LOCK’ Escambia County Fire Rescue urges citizens to never leave children alone in cars and to be extra cautious during these warm summer months. According to the National Safety Council, there have been over 800 child deaths due to vehicular heatstroke with 2018 being the deadliest year on record with 53 child fatalities. Of the 800 fatalities recorded, 24% of those were in employer parking lots while the parent or guardian went to work. The causes of the tragedies are simply being in too big of a hurry and forgetting. In Escambia County, there was one 2-year-old and a pet fatality in 2019. So far in 2020, Escambia County first responders have gone on nine calls for to help with children being left in cars. Fortunately there have been no injuries or fatalities. Florida ranks 2nd in the U.S. for vehicular heatstroke. “It is crucial that the public be aware to look before they lock,” said Ray Melton, Escambia County fire and life safety specialist. “These tragedies are avoidable if citizens are mindful of vehicle and child safety. We have very hot summers here in Florida and fire crews have already responded to many calls
for children locked in vehicles.” Leaving your child in the car for only a “few minutes” may seem harmless, but the situation can escalate quickly. “On a cloudy day when the temperature is 85 degrees outside, the inside temperature of a car will get to 104 degrees in just 10 minutes,” added Melton. “Children have smaller bodies and their core temperature can rapidly reach 104 degrees or greater. When the body’s core temperature reaches 104 degrees, the body begins to shut down. Although people assume it would never happen to them, even leaving you child in the car for a ‘few minutes’ can be dangerous.” Studies have shown that cracking the windows do NOT provide proper ventilation of heat and only circulates it. “To put it simply, you are turning an oven into a convection oven only circulating dangerous heat,” Melton said. Escambia County Fire Rescue encourages citizens to help protect children by never leaving your child alone in the car. Together, we can prevent misfortune by remembering to, “Look Before You Lock!”
CITY COMMUNITY CENTERS, PROGRAMS TO CLOSE TO THE PUBLIC The City of Pensacola is closing all community resource centers and programs to the public until further notice, due to an increase in COVID-19 cases in Escambia County and city staff. Community resource centers will close effective today, Friday, July 10 at the conclusion of any ongoing programming for the day. Exceptions:

ESCAMBIA COUNTY DROP-OFF RECYCLING SITES CLOSED EFFECTIVE MONDAY, JULY 13 UNTIL FURTHER NOTICE Escambia County is closing all drop-off recycling sites effective Monday, July 13 until further notice. With the loss of labor crews from Escambia County Corrections, the county will not have manpower to manage illegal dumping at the sites. There have been multiple complaints about illegal dumping from

ESCAMBIA COUNTY CORRECTIONS SUSPENDS ROAD CREW SERVICES UNTIL FURTHER NOTICE Escambia County Corrections received its first positive test result at the work annex, formerly known as the road prison, today, July 9. As a precaution, the medical recommendation is to suspend road crew operations that provide services throughout the county. These services include, but are not limited to, grounds keeping throughout the county and support to the landfill, animal services, code enforcement and fleet maintenance. “The action to suspend operations of the road crews is taken to protect the inmates, the correctional officers, other county employees that supervise inmate details, as well as the citizens that are in and around some of the operations where we provide services,” Escambia County Corrections Chief Rich Powell said. “The inmate population will remain under observation for a period of 14 days to identify if any other inmates have become infected or present any medical concerns. Fortunately,

In an effort to help slow the spread of COVID-19, the City of Pensacola is making 20,000 masks available to the public free of charge at several city community centers beginning Monday, July 13. The locations, days and times of mask distribution are as follows: • Sanders Beach-Corinne Jones Resource Center, 913 S. I St.: MondayFriday from 10 a.m. to noon • Cobb Resource Center, 601 E. Mallory St.: Monday-Friday from 1-3 p.m. • Gull Point Resource Center, 7000 Spanish Trail: Monday-Thursday from 4-6 p.m. These community resource centers were chosen based on their geographic location.
Masks are available on a first come, first served basis for regular users and neighbors of the resource centers, along with the general public. Masks are not available to business owners to distribute to their employees. Each household will receive one machine-washable mask per person, with a limit of five masks per family. LAWSUIT CHALLENGES DESANTIS PICK FOR SUPREME COURT DARA KAM NEWS SERVICE OF FLORIDA STAFF TALLAHASSEE — A Democratic state representative on Monday filed a lawsuit challenging one of Gov. Ron DeSantis’ latest appointments to the Florida Supreme Court, arguing that Palm Beach County Circuit Judge Renatha Francis is unqualified for the post. DeSantis in May announced that he was appointing Francis and Miami attorney John Couriel to replace former justices Barbara Lagoa and Robert Luck, who left the Supreme Court after being named by President Donald Trump to the Atlanta-based 11th U.S. Circuit Court of Appeals. Couriel has joined the Supreme Court, but Francis is ineligible to serve as a justice until Sept. 24, when she will mark her 10th year as a member of The Florida Bar. “The plain and unambiguous language of the Florida Constitution requires that an individual satisfy that requirement prior to being eligible for appointment,” Monday’s lawsuit, filed by Rep. Geraldine Thompson, D-Windermere, said. Francis was born in Jamaica and is slated to become the first non-Cuban person of Caribbean heritage to serve on the Supreme Court, DeSantis said when he announced the appointments on May 26. She also would be the first Black justice since Peggy Quince retired early last year and would be the only woman on the court. The lawsuit alleges that the Florida Supreme Court Judicial Nominating Commission “exceeded the limits of its
authority” by including Francis’ name on a list of nine nominees sent to DeSantis in January. The 32 initial applicants for the two posts included several black or Caribbean-American applicants, and all but Francis had been members of the Bar for the requisite decade at the time they applied, Thompson’s attorneys wrote in the lawsuit filed at the Supreme Court. Under the Supreme Court’s rules, the nominating commission cannot recommend appointees to the governor “unless the commission finds that the nominee meets all constitutional and statutory requirements” to serve as a justice. “There is nothing in the Florida Constitution or the JNC (judicial nominating commission) rules which provide the JNC with authority to nominate an individual for potential appointment to the Supreme Court where that individual may become eligible for that position on some future date,” William Ponall and Lisabeth Fryer, who represent Thompson, wrote. The lawsuit noted that, under the Florida Constitution, DeSantis was obligated to make the appointments 60 days after the nominating commission certified a slate of nominees on Jan. 23. But the governor said he did not make the appointments by the March 23 deadline because of the coronavirus pandemic. In late March, DeSantis said he would make the appointment by May 1, a deadline he also missed. The JNC “clearly lacked the authority to certify an individual for consideration where that individual could not meet the constitutional requirements to be a jus-

Marco Rubio, R-Fla., said Monday that Congress is close to figuring out a relief package aimed at small businesses, while he pointed to “negative news” about the coronavirus pandemic affecting travel to areas moving toward reopening. Rubio, during an appearance on CNBC’s “Squawk Box,” also anecdotally attributed the increase in COVID-19 cases to a natural desire of people to interact with others. “I don’t think there’s any evidence that restaurants or Disney World, which is an outdoor setting, or beaches or parks, are the cause of this surge,” Rubio said. “I think the surge is coming from people behaving like people. And that’s what makes a virus like this so problematic. It asks us not to do what comes natural to us, and that is interact with other human beings. And this is going to be a challenge we’re going to face for the foreseeable future.” Rubio
said tourism is being affected in parts of Florida that have not seen as big of a surge in cases as other regions that are hot spots. “I was talking to a hotel owner in Northwest Florida this weekend,” Rubio said. “They were packed during the Fourth of July. And then suddenly, you know, they lost 30 percent of their reservations going into the new week because people are watching on the news about Florida and so forth, even though this county itself has not been impacted.” As for additional federal relief, Rubio said Congress is targeting small businesses. “I think we’re 90 percent of the way there in terms of putting together some ideas about how to help some truly small businesses, under 300 employees or less, microtargeted not just for payroll but for the costs of paying for some of these adaptive technologies that they have to come up with in order to comply with local regulations,” he said.
APPEAL PURSUED IN STATEWIDE BEACH CLOSURE CASE NEWS SERVICE OF FLORIDA STAFF Blasting Gov. Ron DeSantis’ handling of the COVID-19 pandemic, a Northwest Florida attorney on Monday argued that an appeals court should clear the way for a lawsuit that, in part, seeks to require beaches to be closed statewide. Attorney Daniel Uhlfelder filed a 25page brief asking the 1st District Court of Appeal to overturn a Leon County circuit judge’s decision to dismiss the lawsuit against DeSantis. Uhlfelder filed the lawsuit in March, arguing that DeSantis should be required to close beaches statewide and issue a “safer at home” order to prevent spread of the virus. But Circuit Judge Kevin Carroll dismissed the case in April, saying the separation-of-powers clause of the
Florida Constitution prevents him from requiring DeSantis to take such steps. Uhlfelder filed a notice of appeal in April and an initial brief Monday at the Tallahassee-based 1st District Court of Appeal. He disputed that the separation of powers should lead to dismissal of the case. “In fact, the separation of powers mandates judicial intervention to protect the health and welfare of Florida’s citizens from DeSantis’ constitutional abdication of his sworn duties,” the brief said. “The preservation of Floridians’ lives is dependent on the judiciary protecting them, because it is clear DeSantis has no interest in protecting their lives during this deadly global pandemic where Florida has now quickly become the epicenter.”

The Agency for Health Care Administration sent an alert Monday announcing that it was “waiving service authorization requirements” hospitals were required to obtain prior to transferring patients out of their facilities. The change was made to “facilitate prompt hospital discharges and to ensure adequate inpatient hospital capacity in response to COVID-19,” according to the announcement. The move came nearly a week after Dawn White, vice president of government and community relations for Baptist Health South Florida, asked the state to consider changing the policy, saying doing so could expedite transfers from hospitals to long-term care facilities by at least two or three days.
