TH E R IS E OF COWORK ING SPAC E S IN PEN SACOL A by Dakota Parks The COVID-19 pandemic has impacted nearly every facet of our lives, including a revisioning of the future landscape of commercial office spaces. According to a recent study conducted by Upwork, one in four Americans will work remotely in 2021 and by 2025, an estimated 36.2 million Americans will work remote, which is an 87 percent increase from prepandemic levels. While some remote workers enjoy the flexibility to work from the kitchen counter, save money on childcare and choose their own hours with the addition of a mid-day siesta or trip to the gym, others miss the socialization and daily routine that often comes with working in a traditional office space. As workers adjust to the new normal, commercial real estate has witnessed an uptick in co-op offices, or coworking spaces, where a diverse group of remote workers, freelancers and independent professionals work together in a shared, communal setting on either a membership basis or hourly rental. Whether you’re looking to rent a desk or book a conference room, coworking spaces give entrepreneurs a place to bring prospective clients and often serve as a safety net for business start-ups with little or no overhead cost to establish a home office. Many coworking spaces, in turn, act as business incubators by providing the workspace, facilitating networking and some even providing mentoring and management training. Many workers thrive in these collaborative spaces, where you can choose to work alone or share a long communal table with people from diverse industries. Prior to the pandemic, coworking spaces were the fastest-growing type of office space in commercial real estate. While they currently comprise less than five percent of the market, they’re expected to make up 30 percent by 2030, according to the real estate company JLL. Business Climate has gathered some of Pensacola’s best coworking spaces and production studios open to new membership and rental opportunities for business professionals, artists, producers and videographers alike. DESANTIS SIGNS BILLS TO CURB FOREIGN INFLUENCE JIM TURNER NEWS SERVICE OF FLORIDA TALLAHASSEE — Gov. Ron DeSantis on Monday signed into law a pair of bills designed to curb the influence of foreign governments on state agencies and higher-education institutions, as he particularly targeted China. The laws were crafted during the 2021 legislative session in response to highprofile Florida cases involving medical and academic researchers. “There is no single entity that exercises a more pervasive, nefarious influence across a wide range of American industries and institutions than the Communist Party of China,” DeSantis said while behind a podium proclaiming “Stop CCP Influence” at the Florida National Guard Robert A. Ballard Armory in Miami. As support has grown in the scientific community to explore the possibility that COVID-19 emerged from the Wuhan Institute of Virology in China, DeSantis also used the Miami appearance to allege that the lab was the source of the pandemic. “It’s pretty clear that this was a virus that almost assuredly leaked out of this lab in Wuhan,” DeSantis said. “This is a lab where these scientists were working very closely with the Communist Party of China.” China has repeatedly denied the lab was responsible for leaking the virus. Former President Donald Trump, a DeSantis political ally, has long charged that the lab was the source of the virus, and President Joe Biden last month called for further investigation based on U.S. intelligence. Other possible explanations are that the virus was spread through wild animals such as bats. “While two elements in the (intelligence community) lean toward the former scenario (zoonotic) and one leans more toward the latter (the lab leak) — each with low or moderate confidence — the majority of elements do not believe there is sufficient information to assess one to be more likely than the other,” Amanda Schoch, assistant director of national intelligence for strategic communications, said in a May 27 statement. The bills that DeSantis signed Monday were unanimously approved by lawmakers during the legislative session that ended April 30. One of the bills, dubbed the “Combating Corporate Espionage in Florida Act” (HB 1523), will take effect Oct. 1 and

‘JOB GROWTH’ FUND READY FOR PROPOSALS NEWS SERVICE OF FLORIDA STAFF With a fresh $50 million available for next fiscal year, the state jobs agency has opened the application process for a program that provides infrastructure and workforce incentives to attract businesses to Florida. The Department of Economic Opportunity on Monday tweeted that it is accepting project proposals for the Job Growth Grant Fund. “The grants will assist communities in funding workforce training and public infrastructure projects to support growth and employment in Florida,” the department tweeted. The

will lead to people facing second-degree felony charges for “trafficking in trade secrets.” If people are found to have trafficked in trade secrets to benefit a foreign government, the penalty would be increased to a first-degree felony. The other bill (HB 7017), which will go into effect July 1, creates new reporting requirements for entities seeking grants or contracts from the state. Under the measure, such entities as state agencies and universities will be required to report receiving gifts or grants “from any foreign source” valued at $50,000 or more. People and entities seeking grants or contracts from the state of more than $100,000 will be required to disclose contracts, donations or grants linking them to China, Russia, Iran, North Korea, Cuba, Venezuela and Syria. State universities and other entities with research budgets of $10 million or more also will have to create an “international travel approval and monitoring program” under the measure. House Speaker Chris Sprowls, RPalm Harbor, pointed to inappropriate ties to Chinese entities that led to the resignation of top officials at Tampa’s Moffitt Cancer Center in 2019 as an example of the impact on Florida taxpayers. Moffitt receives state tax dollars. “It is used to go into our research institutions and to steal from Florida taxpayers, to steal our hard-working intellectual property to bring it back to China, so that they can use that against American researchers, that they can use that against American businesses and beat America on the world stage,” Sprowls said. “And that’s what today is all about.” Sprowls also referred to the U.S. Department of Justice in February indicting former University of Florida professor and researcher Lin Yang, a 43-year-old Chinese national accused of fraudulently obtaining $1.75 million in grant money from the National Institutes of Health. Investigators said Yang was awarded grant money to develop “an imaging informatics tool for muscles known as ‘Muscleminer’” and worked on the project from 2014 to 2019. But Yang simultaneously had launched a business in China, and according to the Department of Justice, “promoted his business in China by relating that its products were the result of years of research supported by millions of dollars of U.S. government funding.”

program was included in a $100 billion budget that Gov. Ron DeSantis signed last week for the fiscal year that will start July 1. In all, more than $74 million is available for the program, with lawmakers putting $50 million into the budget and DeSantis also able to tap $24.4 million left unspent from 2019. Last year, DeSantis vetoed $20 million set aside for the fund as he nixed $1 billion from the budget amid uncertainty about economic fallout from the COVID-19 pandemic. The fund was created in 2017 after a battle between lawmakers and then-Gov. Rick Scott about business incentives. Scott distributed almost all of the $170 million he got for the fund before leaving office in January 2019.

JUDGE SET TO HEAR ARGUMENTS IN CRUISE SHIP FIGHT JIM SAUNDERS NEWS SERVICE OF FLORIDA TALLAHASSEE — A federal judge will hear arguments Thursday in Florida’s bid to block federal restrictions on cruise ships during the COVID-19 pandemic, while U.S. Department of Justice attorneys point to a return to cruising by mid-summer. U.S. District Judge Steven Merryday will hold a hearing in Tampa on Florida’s request for a preliminary injunction against restrictions imposed by the federal Centers for Disease Control and Prevention. The hearing will come after the two sides reached an impasse in mediation aimed at settling the dispute. The hearing also will come after the industry giant Royal Caribbean announced Friday that it plans to begin sailing from Florida ports in July and August. Florida Attorney General Ashley Moody, backed by DeSantis, filed the lawsuit in April challenging restrictions imposed by the CDC that idled the industry after outbreaks aboard ships early in the pandemic in 2020. The lawsuit focuses heavily on a “conditional sailing order” that the CDC initially issued in October with a phased approach to resuming cruise-ship operations. But U.S. Department of Justice attorneys filed a brief Monday that said, in part, recent developments “further undermine” the state’s arguments that an injunction is needed. Those developments include the CDC approving simulated voyages that involve testing cruise-ship operators’ ability to mitigate risks of the virus. “Cruising is on track to resume by mid-summer, and Florida cannot establish an irreparable injury that would occur in the absence of an injunction,” the brief said. “Plaintiff’s original motion was premised on the misconception that an ‘industry’ was ‘shut down’ indefinitely. That was never a valid characterization of the CSO (conditional sailing order), and it is demonstrably not the case now.” The federal restrictions have become tangled with decisions this spring by DeSantis and state lawmakers to ban businesses — including cruise ships — from requiring what are known as vaccine “passports” that would show people have been vaccinated against COVID-19. Opposing the federal restrictions also

IMMIGRATION FIGHT TO BE HEARD IN SEPTEMBER NEWS SERVICE OF FLORIDA STAFF A federal appeals court will hear arguments in September in Florida Attorney General Ashley Moody’s challenge to immigration-enforcement moves by the Biden administration. The 11th U.S. Circuit Court of Appeals has scheduled arguments the week of Sept. 20 in Miami, according to court documents. Moody went to the appeals court last month after U.S. District Judge Charlene Edwards Honeywell turned down the state’s request for a preliminary injunction. Moody asked the Atlantabased appeals court for “expedited” consideration, arguing that the Biden administration is not properly carrying out immigration laws and threaten-

has become a high-profile political issue for DeSantis, whose office blasted the CDC last week after the impasse was reached in the settlement talks. “Unfortunately, the CDC has opted to continue its ridiculous and unlawful regulations that target a single industry by imposing vaccine requirements — something no other business or industry must do,” a news release from DeSantis’ office said. Royal Caribbean announced Friday that it plans to launch cruises from Miami on July 2 and from Fort Lauderdale on July 3. “Guests are strongly recommended to set sail fully vaccinated, if they are eligible,” the company said in a news release. “Those who are unvaccinated or unable to verify vaccination will be required to undergo testing and follow other protocols, which will be announced at a later date.” The news release also said “Royal Caribbean is continuing discussions with the U.S. Centers for Disease Control and Prevention and multiple state, local and port authorities in the U.S. and with various destination communities regarding the various requirements for the upcoming sailings.” The state’s lawsuit contends that the CDC exceeded its authority with the restrictions and that the conditional sailing order is “arbitrary and capricious.” Also, it alleges that the CDC has violated the Administrative Procedure Act, which deals with how agencies impose regulations and carry out laws. Department of Justice lawyers have countered by saying the federal government has long had authority to regulate ships to prevent the spread of communicable diseases. During the hearing Thursday, Merryday also likely will take up arguments about a law signed last month by President Joe Biden that is known as the “Alaska Tourism Restoration Act.” The law provides temporary standards for cruise ships going to Alaska. In the brief filed Monday, Department of Justice attorneys reiterated arguments that the law ratified the conditional sailing order issued by the CDC. The brief argued that with the ratification, Congress “not only confirmed that the CDC had the statutory authority to issue the order, but also extinguished” Florida’s claims under the Administrative Procedure Act.

ing public safety. The appeals court on Thursday issued an order granting expedited consideration, though that still requires a process for a series of briefs to be filed before the hearing. The lawsuit focuses on memos issued Jan. 20 and Feb. 18 by the U.S. Department of Homeland Security and U.S. Immigration and Customs Enforcement about immigration enforcement, with Moody contending that the directives violate immigration laws and what is known as the Administrative Procedure Act. But in rejecting the proposed preliminary injunction, Honeywell on May 18 ruled that the memos were “interim policies” that were not final actions by the federal agencies and, as a result, were not subject to judicial review. She also wrote that the memos prioritize immigrationenforcement decisions, such as focusing on cases involving national security, border security and public safety.
