by Morgan Cole While the pandemic has wreaked havoc on virtually every facet of society since its onset early last year, the impact it has had on our social lives is diff icult to overstate. It’s hard to believe, but after more than a year, there are finally events on the local calendar again. With the promise for more later this month and into the summer, there’s a reason to believe summer 2021—though obviously not what any of us would call “normal” in the prepandemic sense—will be a hopeful time with plenty of reason and opportunity to get out and hit the town. We’ve gathered a slew of chill summer activities for those looking to get out and, you know, do stuff again. From new bar openings and summer concerts to drive-in movies and farmers markets, here’s a round-up of some of our favorite local happenings making a comeback just in time for summer. Dive in!

Performing & Visual Arts Downtown Pensacola Gallery Night

Pensacola’s infamous Gallery Night will officially return July 16! Gallery Night will once again host its monthly art centric event on the third Friday of every month from 5–10 pm in downtown Pensacola. Grab a drink and hit Palafox street as the galleries, boutiques, restaurants and bars open their doors to the night air and welcome visitors and locals for an evening of lively music, fantastic art and tasty cuisine. Check-out the latest Gallery 1060 art show at the First City Art Center in downtown Pensacola. The Summation Weekly FOURTH OF JULY FESTIVITIES RETURN TO BLUE WAHOOS STADIUM This Independence Day will be a day of family, food, and fun at Blue Wahoos Stadium! The 2021 Fourth of July Community Celebration will begin with a Blue Wahoos home game and end with the annual Sertoma Club fireworks show and Symphony Sparks & Stars, presented by Peter J. Mougey with Levin Papantonio Rafferty at the Hunter Amphitheater in Community Maritime Park. The festivities will begin when the Blue Wahoos take on the Biloxi Shuckers at 4:05 PM on Sunday, July 4. Stadium gates for the baseball game will open at 3:05 PM. A ticket is required to attend the baseball game, and fans may visit BlueWahoos.com to purchase their tickets. Following the game, fans are welcome to stay for the firework show and symphony at no extra cost. The symphony will perform in the amphitheater in Community Maritime Park and their performance will be livestreamed on the videoboard at Blue Wahoos Stadium. The annual Sertoma Club firework show will begin at 9:00 PM in downtown Pensacola. Gates at the stadium for the postgame symphony and fireworks event will open to the public at 7:30 PM or 30 minutes after the conclusion of the baseball game (if the game ends after 7:00 PM). Admission is free. Fans may sit in the seating bowl or on the field at Blue Wahoos Stadium to enjoy the symphony and fireworks. Concessions will be open and available for purchase. Fans sitting on the field are encouraged to bring a blanket to sit on. Outside food and beverages and chairs

Community will not be permitted. Strollers, carts, and wagons are not allowed on the field. General admission for the fireworks and symphony is free, however fans may purchase admission to VIP dinner events in the Hancock Whitney Club or the Coors Light Party Deck at Blue Wahoos Stadium. Both areas will offer guests an exclusive meal and access to a private cash bar. The Hancock Whitney Club event will include a premier gourmet dinner buffet prepared by Executive Chef Travis Wilson. The menu will feature roasted pork shank with watermelon BBQ sauce, southwest rubbed chicken with white BBQ sauce, southern green beans, blackened crawfish pasta, loaded baked potato salad, composed salad, and classic All-American favorites including grilled hot dogs and an ice cream bar with assorted toppings. Tickets to this exclusive event are limited and are $50 per person. The right field Coors Light Party Deck will also be available to fans, offering tremendous ballparks views of the symphony and fireworks and an AllAmerican buffet dinner including BBQ chicken, pulled pork, coleslaw, baked beans, potato salad, and dessert. Tickets to the Coors Light Party Deck are $35. The postgame dinner event is a separate event from the Blue Wahoos game. Fans with tickets to a party deck or the Hancock Whitney Club for the Blue Wahoos game are welcome to stay at the ballpark to enjoy the symphony and fireworks, but must purchase an additional ticket to participate in the postgame dinner event in those areas. BRUCE BEACH REVITALIZATION PROJECT UPDATE The City of Pensacola is continuing to solicit public input on the Bruce Beach Revitalization Project, which is a catalytic project of the Pensacola Waterfront Framework Plan supporting the city’s goal of creating a more connected public waterfront in Pensacola. The public is invited to complete an online survey by Friday, July 2 to share their thoughts and feedback on the project. The survey can be accessed here. The City of Pensacola hosted a virtual presentation and in-person open house on June 22 and June 23 to provide opportunities for the public to learn more about the project and share feedback. The community’s thoughts, opinions and suggestions are highly valued and will inform design and engineering decisions for this and future phases. Draft concepts for the project that were displayed during the virtual presentation and in-person open house are available at the City of Pensacola’s website. At the meetings, the engineering and design team provided an update on

how the design has progressed since the last public meeting held in February 2020, shared additional details on the phasing and construction schedule and presented a strategy for incorporating African American history and heritage into the project. The Bruce Beach Revitalization Project was initiated as a catalytic project of the Pensacola Waterfront Framework Plan, with the goal of creating a new recreational and educational destination as part of a more connected public realm along the city’s waterfront. Key project priorities are: • Connect people to the water • Restore and enhance local ecology • Mark and commemorate African American history and heritage at the site • Design for educational activities, both indoors and outdoors • Create a cultural and educational destination at the Bay’s edge The project is currently being designed by the planning and engineering firm HDR, with consistency review from SCAPE and with continued public input.

BIKE PENSACOLA CELEBRATES COMING SAFETY IMPROVEMENTS ON NORTH PACE BLVD. After formal letters from the City of Pensacola, Escambia County and Bike Pensacola requesting safety improvements to N. Pace Blvd, the Florida Department of Transportation (FDOT) has announced that traffic lanes on the corridor will be narrowed as part of an upcoming resurfacing project (SR 292 (North Pace Boulevard) from Barrancas Avenue to Massachusetts Avenue). This lane narrowing will help to slow the high vehicle speeds in the area, which are a tremendous threat to the safety of the many nearby residents who walk, bicycle and utilize wheelchairs to move along and across the roadway. In a letter from FDOT District Secretary Phillip Gainer to Escambia County Commission Chairman Robert Bender, FDOT pledged to reduce the width of the center two way left turn lanes and inside travel lanes to 10 feet, and the outside lanes to 11 feet. The current travel lane

widths are 12 feet. Sec. Gainer also pledged to commission an engineering study to see if the request to reduce speed limit from 40 mph to 35 mph is supported. Bike Pensacola supports the reduction in speed limit, as well as additional physical improvements such as elevated pedestrian crosswalks and center islands—proven ways of slowing vehicle speeds and saving lives. Pace Blvd. is one of the highest injury crash corridors in the Pensacola-area, with over 1253 crashes including 679 injuries, and 13 fatalities in just the last 5 years. The area also has some of the lowest rates of automobile ownership in the area, resulting in heavy bicycle and pedestrian traffic. Bike Pensacola works to create a community that is safer and more pleasant for walking and bicycling. Our vision is for Pensacola to be America’s most joyful place to bike.

CITY SEEKS INPUT FROM RESIDENTS FOR ANNUAL SATISFACTION SURVEY The City of Pensacola is conducting its annual resident satisfaction survey and is encouraging all city residents to participate and let their voices be heard. City residents are asked to complete the survey online at uwf.edu/HaasResidentSurvey or by phone at 850-4952666 by Friday, July 23. Residents should have also received a postcard in the mail prompting them to complete the survey. The survey asks residents about their satisfaction with a variety of city services and facilities, including street lights, sidewalks, neighborhood safety and more, also prompting participants to rank their top priorities for the City of Pensacola. The survey also asks residents whether they would recommend living in the City of Pensacola to family and friends, which is designed to measure customer experience and loyalty. “Feedback from our residents is incredibly important to us, and I encourage all of you to take the time to complete this survey as we continue to work toward improving our city,” Mayor Grover

JUDGE WEIGHS CONSTITUTIONALITY OF SOCIAL MEDIA LAW DARA KAM NEWS SERVICE OF FLORIDA TALLAHASSEE — A federal judge on Monday appeared skeptical about a new Florida law aimed at punishing socialmedia companies that strip users from their platforms or flag users’ content. Online-industry groups NetChoice and the Computer & Communications Industry Association this month filed a lawsuit challenging the law, pushed by Gov. Ron DeSantis after Twitter and Facebook blocked former President Donald Trump from their platforms after his supporters rampaged at the U.S. Capital on Jan. 6. Arguing that the law would violate social-media companies’ First Amendment rights and harm their efforts to moderate content, the industry groups have asked U.S. District Judge Robert Hinkle to block the law from going into effect Thursday as scheduled. Hinkle peppered lawyers with questions and swiped at the law during a 2 ½-hour hearing Monday. “I won’t put you on the spot and ask you if you’ve ever dealt with a statute that was more poorly drafted,” the judge asked lawyers representing DeSantis’ administration. The controversial law seeks to prevent large social-media platforms from banning political candidates from their sites and to require companies to publish — and apply consistently — standards about issues such as banning users or blocking their content. The new law “is a sweeping attack on core First Amendment rights” of private companies “whose businesses revolve around hosting and presenting speech,” Brian Willen, an attorney who represents the plaintiffs, told Hinkle during the hearing. “Every day these companies are called on to make complex and often subjective value judgments about what content they want to host and how they want to present

that content to the world. The act directly suppresses protected editorial speech … and subjects them to draconian penalties,” Willen argued. “It lets the state investigate and punish private companies whenever it thinks their editorial speech is unfair or inconsistent when measured across some nebulous standard.” But Brian Barnes, an attorney with the Cooper & Kirk PLLC firm who represents the state, said First Amendment speech protections don’t apply to the social-media behemoths. He pointed to a U.S. Supreme Court decision in a case known as Rumsfeld v. Forum for Academic and Institutional Rights that Barnes said “definitely disproves this categorical First Amendment right to engage in, they call it editorial judgment but I guess I would characterize it as silencing particular voices that the First Amendment always protects.” Social-media platforms don’t enjoy the same First Amendment rights as news publications, Barnes argued. “The question the court has to focus on is not are these social media platforms engaging in something that looks like the editorial judgment of a newspaper. The question is, are they producing a speech product of their own, separate and distinct,” he told Hinkle. “I think that a newspaper and editing a newspaper is fundamentally different from the kind of conduct that is being regulated on the part of social-media platforms.” But Willen said the state doesn’t have the authority to dictate private businesses’ decisions about user content. “These are not cases where there are clear, right and wrong answers. And that’s exactly why the First Amendment reserves these judgments for private parties, not for the government. The state simply cannot be the arbiter of the consistency, accuracy, the fairness of private editorial judgments. The power Florida now seeks, is manifestly unconstitutional,” he said.

SURFSIDE CONDO COLLAPSE COULD LEAD TO LEGISLATION JIM TURNER NEWS SERVICE OF FLORIDA TALLAHASSEE — State and federal legislation could be proposed to address construction or engineering issues after the deadly condominiumbuilding collapse in Surfside, where crews continued to search the rubble Monday. Addressing reporters, Gov. Ron DeSantis and U.S. Rep. Debbie Wasserman Schultz, D-Fla., said they await information from forensic investigations that are proceeding alongside search-and-rescue operations at the Champlain Towers South, which collapsed early Thursday. “I think the people of Florida want to understand, how could this happen?” DeSantis said. “And then, what can we do to make sure it doesn’t happen again? So, we’ll be working on that for the long term.” The National Institute of Standards and Technology, an agency of the U.S. Department of Commerce, joined in structural reviews being conducted by Surfside and Miami-Dade County. DeSantis said the federal agency’s involvement is somewhat unique, as it has typically investigated damage from such things as the Sept. 11, 2001 terrorist attacks and Hurricane Maria in Puerto Rico. “They’ve never done just a straight building collapse that wasn’t involved with either hazards or terrorism,” DeSantis said. “And so, this is going to be something that’s important. It is something that is going to be very thorough and is something that is not going to happen in a day or two. This is going to take a long time.” Wasserman Schultz said the findings can have long-term implications “for how we change federal oversight and

federal law related to building construction and the kind of code- enforcement decisions that will have to be made on the ground.” Wasserman Schultz said the review will range from potential foundational defects in the pool area to other structural issues at the 12-story oceanfront complex and hopefully help answer if the conditions were unique to the Champlain Towers South. “You know we have structures like this all the way up the coastline, all the way up the coastline of the United States,” Wasserman Schultz said. “And what NIST (the National Institute of Standards and Technology) will be able to help do is, they’re a fact finding, not a fault-finding agency, and a long-term investigation of theirs would give us a chance — for me as a member of Congress — to be able to adopt changes in federal law that will help them make sure that when structures are built, that something like this could never happen again.” The death toll at midday Monday had reached 10, with 151people unaccounted for. DeSantis expressed support for the “outpouring” of millions of dollars in charitable donations in the wake of the collapse. But Attorney General Ashley Moody on Monday also issued a consumer alert warning of potential charity scams. “Anytime tragedy strikes, scam artists may try to prey on the goodwill of others by posing as representatives of a legitimate charity or espousing a fictional charity in order to solicit funds online, in person or over the phone,” Moody’s office said in a news release. As of Monday morning, no fraud complaints had been filed, Moody’s office said.

The state law targets large companies, applying to platforms that have annual gross revenues of more than $100 million or have at least 100 million monthly individual “participants” globally, such as Twitter, Facebook and YouTube. Under the law, companies that remove political candidates from platforms could face fines of $250,000 a day for statewide candidates and $25,000 a day for other candidates. Plaintiffs’ attorney Peter Karanjia urged Hinkle to block the law, arguing that it would wreak havoc for companies and users if allowed to go into effect this week. “Compliance is not just a flick a switch on and off. You need a lot of lead time to do that,” Karanjia said. The law imposes “extraordinary burdens of justifications and moderation decisions,” Karanjia argued, adding, “That doesn’t just happen magically.” DeSantis, a Trump political ally, has boasted that Florida’s “trailblazer” law, approved by the Republican-controlled Florida Legislature this spring, will keep “woke” Silicon Valley executives and their employees from “suppressing ideas that are either inconvenient to the narrative or which they personally disagree with.” But Hinkle on Monday poked at holes in the law. “It just seems to me that you can only make sense out of this statute if you know what the Legislature must have meant, not what it said. And I think that’s a hard argument in Florida, where the court says, just read the words,” the judge said. For example, Hinkle asked Barnes about part of the law saying that companies can’t use “post-prioritization” to put candidates’ posts “ahead of, below, or in a more or less prominent position than others in a newsfeed, a feed, a view, or in search results.” “We read that language to basically mandate chronological presentation,” Barnes told Hinkle.

DESANTIS GETS BILL TO SHIELD COLLEGES FROM LAWSUITS NEWS SERVICE OF FLORIDA STAFF A wide-ranging higher education bill that would shield colleges and universities from lawsuits related to closing campuses during the COVID-19 pandemic was formally sent Monday to Gov. Ron DeSantis. Lawmakers approved the measure during the 2021 legislative session after class-action lawsuits were filed to try to recover money that students paid with the expectation of on-campus learning in 2020. Campuses closed down in March 2020 to try to prevent the spread of COVID19, with students forced to learn online. The bill (HB 1261) also would create several new tuition and fee waivers at state universities, including a “buyone-get-one-free” waiver for students taking upper-level courses in fields such as science, math and engineering. The state university system’s Board of Governors last week approved a list of

Hinkle also questioned the practicality of the law. “What the state of Florida apparently believes is we’ll just have a completely different internet or social media in Florida than everywhere else. They’ll have to provide a different platform in Florida,” he said. But Barnes said platforms “already do provide or comply with state-specific regulations.” Hinkle did not issue a decision on the plaintiffs’ request for a preliminary injunction but said he expects to release a ruling before Thursday. The judge also asked about part of the law that creates an exemption for theme parks that meet certain criteria. “There’s nothing in the record that indicates that any entity that operates a theme park has a social media platform of the sort that we’re really focused on,” Barnes said. The theme-park provision is “severable” from the rest of the law, meaning that Hinkle could strike down that provision while keeping other portions of the statute intact. “You’ve got an equal protection problem,” Hinkle said. “How do I know whether the right answer is to strike the exception or to strike the rest of the statute? You’ve got to make it equal somehow.” Lawmakers “had to know, had to know that this was a major constitutional issue,” the judge added. “And yet, even in the face of this major constitutional issue, they did not vote to make Disney, Universal, and ABC subject to this law. And you want me to infer that they would be willing to put Disney and Universal Studios under this law, even though nobody voted to do it,” he said.

The bill also would create what’s called the “Free Seat Program” at state universities to provide online courses at no cost to “nontraditional students” who have been out of college for five years and members of the military. That program would be capped at 1,000 recipients each year. Another tuition waiver included in the bill is aimed at attracting high-performing students from other states to Florida universities. The so-called “grandparent tuition waiver” would give cheaper in-state tuition rates to nonresident students who have grandparents residing in Florida, if those students score in the 89th percentile or higher on the ACT or SAT exams. The “grandparent” waiver would be capped at 350 recipients annually. The measures were among 87 bills sent to DeSantis on Monday.

TELEHEALTH COULD SUFFER AS ORDER EXPIRES

MASKS ARE OFF, BUT LEGAL WRANGLING CONTINUES

TALLAHASSEE — Florida health-care providers are going back in time. The growing emergence of telehealth, or telemedicine, as a way to deliver health care has been a silver lining during the COVID-19 pandemic. But after Gov. Ron DeSantis let an executive order declaring a publichealth emergency expire Saturday, many regulatory flexibilities that health-care providers received during the pandemic, including flexibilities related to telehealth, also expired. As of Saturday, telephones no longer are an acceptable platform for delivering telehealth services to non-Medicare patients in Florida. Physicians also cannot use telehealth to prescribe controlled substances to existing patients for treating chronic non-malignant pain. Also, physicians cannot use telehealth to recertify medical-marijuana patients. But those aren’t the only health-care flexibilities that were offered during the pandemic that have expired or are set to expire. During the pandemic, Department of Health Secretary Scott Rivkees waived a state law that requires doctors and nurses to be licensed in Florida to work in the state. That gave the green light to out-of-state providers to come to Florida and help prevent potential staffing shortages. The Agency for Health Care Administration has issued a notice that, effective Thursday, it will limit the frequency and duration of Medicaid behavioralhealth services and that, effective July 15, it will reinstate prior-authorization requirements for behavioral-health services. Also effective Thursday, Medicaid is reinstating preadmission-screening and resident-review requirements for nursing-home placements. DeSantis issued an executive order March 9, 2020, declaring a state of emergency because of the pandemic. The executive order was renewed several times before DeSantis let it quietly expire this weekend. When the order expired, so did the subsequent orders issued by agency secretaries, such as Rivkees. Knowing the waivers wouldn’t last forever, physician organizations sought to make permanent some of the temporary changes that Rivkees authorized, such as using telehealth for the recertification of medical-marijuana patients. But in the end, they came up short. “I was absolutely thrilled because it made sense,” medical marijuana lobbyist Ron Watson said of Rivkees authorizing the use of telehealth to recertify medical-marijuna patients. Watson estimated that as many as 400,000 patients who were certified before the start of the pandemic could have benefited from the telehealth provision. But Watson could not get lawmakers to include the permanent change in telehealth legislation during this spring’s session. “Drinks to go made it into permanency but telehealth didn’t,” Watson said, referring to a new law that authorizes restaurants to sell alcohol with to-go food orders. “We can get support for (alcohol) but not for medicine.” Physician groups also wanted to amend the state’s telehealth laws to make

other changes. Chief among the proposals was seeking to require commercial health-insurance plans and managedcare offerings to pay the same amounts to providers regardless of how care is delivered to patients. Florida Medical Association President Michael Patete told The News Service of Florida in a statement that the state’s largest physicians’ organization will continue its push next session to make the changes permanent. Patete said the organization wants to increase telehealth access by “ensuring insurance companies are required to reimburse telehealth services at the same rate as in-person visits.” The issue of “payment parity” pits physicians and other providers against insurers and managed-care plans. The Republican-controlled Legislature, which is loath to pass mandates on insurance and managed-care companies, approved a telehealth law in 2019 that didn’t require payment parity. That means the payment policy is set by the insurer. The state’s largest health insurer, Florida Blue, issued a news release in March 2020 noting that during the pandemic, its “network of primary care doctors and specialists will be able to treat patients virtually at their normal office visit rates.” The company did not respond as of Monday afternoon to a question about whether the policy still was in place. Meanwhile, the federal Centers for Medicare & Medicaid Services in March 2020 increased the types of services that could be provided via telehealth in government-sponsored health programs and said Medicare would reimburse the same amount for services whether they were provided through telehealth or in person. The state Agency for Health Care Administration said payment parity exists in what is known as the “fee for service” portion of Florida’s Medicaid program. But reimbursements are set by managed-care plans and can vary in the larger portion of the Medicaid program in which beneficiaries enroll in managed care. Along with seeking parity in reimbursements, physicians also advocated during the 2021 legislative session for deductibles, coinsurance and copayments to be the same regardless of whether care is delivered via telehealth or in-person. While the efforts fell short, physician Lisa A. Gwynn said parity is essential if physicians are going to continue using telemedicine. Gwynn, who has practiced medicine in Southeast Florida for 25 years, is the medical director for the University of Miami Miller School of Medicine’s pediatric mobile clinic. She said the clinic has embraced telehealth during the pandemic, in part to help limit the numbers of children and parents in the waiting room to ensure that the sickest children can continue to be seen face to face. But with the elimination of the executive order, Gwynn worries that insurers might not be as willing to reimburse for the care. “There’s a lot of gray area and a lot of uncertainty. But at the end of the day it’s the managed-care and the insurance companies that are going to be controlling this,” she said, adding, “it will fall by the wayside if we are not being reimbursed for it.”

TALLAHASSEE — Gov. Ron DeSantis in early May blocked cities and counties from requiring people to wear masks to prevent the spread of COVID-19. But that hasn’t stopped legal battles over mask mandates. Attorneys for Alachua County last week asked the 1st District Court of Appeal to reconsider a decision in a case about the constitutionality of a mask requirement that the county imposed in 2020. A panel of the appeals court on June 11 overturned a decision by an Alachua County circuit judge, who rejected a challenge to the requirement. Meanwhile, a challenge to a mask mandate imposed last year by Palm Beach County is pending at the Florida Supreme Court. Justices have not announced whether they will take up the case. In the filing Thursday at the 1st District Court of Appeal, attorneys for Alachua County argued that the panel’s ruling this month should be reconsidered because the case is moot. Along with DeSantis in early May blocking local mask mandates, the Legislature passed a measure (SB 2006) that places sharp restrictions on local emergency orders. That measure will take effect Thursday. Alachua County is asking for a rehearing before the three-judge panel or a hearing by the full Tallahassee-based court. “(Shortly) before the panel’s opinions were issued, the Legislature dealt with the issue raised in this appeal. Since the issue has been dealt with legislatively, the panel should grant rehearing and dismiss the appeal as moot because ‘constitutional questions will be decided by a court only when it is necessary to the disposition of the case,’” the motion for rehearing said, partially quoting from a court precedent. The Legislature on Monday formally sent the “Home Sweet Home Act” (HB 663) to the governor’s office. Focused on “cottage” food products, the measure would increase how much money residents can make from selling food out of their homes. It would raise an annual gross sales cap from $50,000 to $250,000 on foods sold by mail, the internet or through delivery without having to conform to state permitting requirements. It also would “preempt” local regulations, giving control to the state. House sponsor Michelle Salzman, R-Pensacola,

GUNS AT CHURCH BILL TEED UP NEWS SERVICE OF FLORIDA STAFF Gov. Ron DeSantis on Monday formally received a bill that would let people with concealed-weapons licenses carry guns at churches or other religious institutions that share properties with schools. Lawmakers passed the measure (HB 259) this spring after it was debated repeatedly in recent years. Florida law generally allows people to carry concealed weapons at churches, synagogues, mosques and other religious institutions, but it bars being

across Florida to approve such mandates to try to curb COVID-19. Justin Green, who operates a nursery business, challenged the requirement and then went to the appeals court after Circuit Judge Donna Keim refused to grant a temporary injunction in May 2020. The appeals-court panel, in a 2-1 decision, said Keim did not properly consider Green’s privacy rights before she rejected a temporary injunction. The panel majority stopped short of declaring the Alachua County requirement unconstitutional but sent the case back to the lower court. The majority also said the issue was not moot, pointing to the possibility that Alachua County could try to impose a mask requirement in the future. “Because of the nature of the various emergency orders that we have seen and the county’s continued commitment to public mask wearing, we are not convinced that this is the last that we will see of this issue,” Judge Adam Tanenbaum, who was joined in the majority opinion by Judge Robert Long, wrote in a footnote. But Judge Joseph Lewis, in a dissenting opinion, argued the case was moot because DeSantis’ executive order last month prevented Alachua County from requiring masks. “The effect of the majority’s disposition could lead to the trial court’s constitutional analysis of a non-existent order,” Lewis wrote. “The trial court could not grant appellant’s (Green’s) requested relief of an injunction enjoining the county from enforcing the mask mandate contained in its emergency order because that order is no longer in effect, and so there is no enforcement to be enjoined.” Local mask mandates drew a series of legal challenges across the state last year, with the Alachua County and Palm Beach County cases drawing conflicting appellate-court decisions. A panel of the 4th District Court of Appeal in January backed a circuit judge’s refusal to block the Palm Beach County mandate, spurring plaintiffs to go to the Supreme Court.

SEEKING HEARING OFFICER for Escambia County School District

Sections 120.569 and 1006.07, Florida Statutes, permit the School Board of Escambia County, Florida, to appoint hearing officers to preside over student expulsion hearings. Applicants must be members in good standing of the Florida Bar and possess an independence of mental attitude and an earnest desire to act as a positive force in fulfilling their responsibilities to the School Board. In addition, the appointee shall possess a professional or practical background in criminal or family law, education, or social work such that he or she possesses the skills and qualities desired in a hearing officer handling disciplinary matters. The appointee must be able to satisfy the time commitments for effective participation as a hearing officer and should not be involved in litigation against the School District or the School Board of Escambia County, Florida.
