PENSACON IS A GO!
by Jesse Gann | Photos by Guy Stevens Pensacon: Pensacola Comic Con was founded in 2013 and unites self-proclaimed comic book nerds, film buffs and TV connoisseurs all under one roof at the Pensacola Bay Center for three full days. From capes, costumes and furries to autographs and fan memorabilia, the convention offers a little of something for everyone. Although the comic con is usually held in February, it was rescheduled due to COVID-19 and will now be held Friday, May 21, through Sunday, May 23. With a variety of guest celebrities and city-wide events scheduled to take place at seven different locations across downtown Pensacola, Pensacon will be taking over the streets. “I always like to tell people, if there is anything you like in pop culture—if you like movies, TV, games, animation, reading, art—we have something that you are going to like,” Pensacon Marketing and Media Director, Julio Diaz said. “People normally think it’s science fiction, but it’s not just science fiction.” There will be a guest for every genre at this year’s convention. One of Pensacon’s most anticipated guests this year is Kaylee Hottle, known for
her role as Jia in Godzilla vs. Kong, the latest movie in the franchise. Her character is known for her relationship with Kong in the movie, and Pensacon will be her first comic con appearance. Hottle, who is a deaf actress, has gained a massive following for her role teaching Kong sign language in the movie. Other featured guests will include Michael Cudlitz, who plays Abraham in The Walking Dead’s, George Wendt, who plays Norm from Cheers, and
Emily Swallow, who played The Armorer in Disney’s The Mandalorian. There will be guests from classic films and new releases, including the last two living stars from the original Planet of the Apes, Lou Wagner and Linda Harrison. Harry Waters Jr. and Jeffrey Weissman from Back to the Future will also be featured guests. Pensacon has a guest for everyone to enjoy no matter the age, demographic or genre. “Of course in addition to our celebrities, we also have upwards of 25 artists and authors that will be here as guests encompassing everything from comic book and fantasy artists, to New York Times bestselling authors,” Diaz said.

Some of this year’s featured visual artists will include Guy Gilchrist, who is known for his illustrations of the Muppets comic strip; Michael Golden, the co-creator of the X-men’s Rogue character, Spartan X and Bucky O’Hare; and Matt Frank, an illustrator for the Godzilla comic book series. In the world of professional wrestling, Dr. Britt Baker, who recently competed in the AEW Women’s World Championship Eliminator Tournament in February, will be making her debut appearance at Pensacon. Alongside this year’s guest appearances, a series of discussion panels will be held. Here, fans will have the opportunity to participate in live Q & A sessions with their favorite celebrity-guests in a more relaxed and moderated setting. Another big attraction this year is going to be the Court of De Luna event space. It is Pensacola’s newest 25,000 square foot event space and winery. The Court of De Luna will host Pensacon’s costume contest and 80s-themed party on Saturday night. Pensacon is also working with numerous downtown bars and restaurants to host annual themed parties. The massive vendor hall at the Bay Center will be available as a space to purchase memorabilia such as comics, collectibles and original art that can’t be found anywhere else. It will also be the main hub where you’ll be able to meet celebrity guests, grab a picture or get an autograph. Other event spaces this year include the Pensacola Little Theatre, the Rex Theatre, the Voices of Pensacola, the University of West Florida Historic Trust Bowden Building and the Museum Plaza Stage,

which will each be hosting events throughout the weekend. The Pensacon team is already planning for Pensacon 2022, which will be taking place in February. On the last day of the convention, Pensacon will be announcing a few of the guests to expect next year. If guests are not comfortable with attending the convention in May, tickets will be available to roll over to Pensacon 2022. “Safety of our guests is always important to us and has never been more important than it is this year. We wouldn’t be moving forward with the event if we didn’t believe we could do it safely,” Diaz said. “It’s a very full weekend, and there is a lot for families to do. We’re here for the families, kids and for everyone to have a great time.” Masks will be required throughout the convention grounds, hand sanitizer will be available at all venues and social distancing measures will be put in place. There will also be designated eating and drinking areas. Tickets are still available for those wanting to attend Pensacon this year. A threeday pass is $80, while single day passes are $35 for Friday, $45 for Saturday and $40 for Sunday. VIP passes are $155 and include early admission to the Pensacola Bay Center, preferred seating at panel venues, front-of-line privileges for celebrity autographs and photo ops, an exclusive 2021 t-shirt, space-available parking and other perks. FDOH: WATER QUALITY HEALTH ADVISORY ISSUED FOR PERDIDO BAY Pensacola, Fla. – Effective immediately, the Florida Department of Health in Escambia County is issuing a health advisory for Perdido Bay South of the Bayou Marcus Creek, Escambia County, Florida. The Emerald Coast Utilities Authority (ECUA) reports a rupture within the grounds of the Bayou Marcus Water Reclamation Facility that resulted in the release of untreated sewage into the above affected area. The sewage release is ongoing, FDOH-Escambia advises against any water-related activities due to the potential for high bacteria levels. FDOH-Escambia will continue to collaborate with ECUA to monitor the

PENSACOLA FERRY SERVICE SUSPENDED Due to unforeseen circumstances, Pensacola Bay Cruises made the difficult decision today, Friday, May 14, to suspend ferry service until further notice. Pensacola Bay Cruises apologizes for any inconvenience this may have caused, and they have already begun the process of refunding tickets that were purchased. “We are working diligently with federal entities for their approval and hope to begin ferry service as soon as possible,” said Joe Asebedo, general manager of Pensacola Bay Cruises. LAWMAKERS JETTISON CONTROVERSIAL PART OF GAMBLING DEAL DARA KAM NEWS SERVICE OF FLORIDA TALLAHASSEE — Lawmakers drew closer Monday to approving a proposed 30-year gambling deal with the Seminole Tribe of Florida after leaders agreed to strip a controversial provision that could have opened the state to online gaming under the control of the tribe. The online gambling provision was included in an agreement, known as a “compact,” reached by Gov. Ron DeSantis and Seminole Tribe of Florida Chairman Marcellus Osceola Jr. late last month. Under the proposed compact, the Seminoles would pay the state at least $2.5 billion over five years in exchange for being able to operate sports betting in the state, along with getting perks such as offering roulette and craps at tribal casinos. The deal also would have required the state to “engage in good faith negotiations” within three years “to consider an amendment to authorize the tribe to offer all types of covered games online or via mobile devices to players physically located in the state.” But Republican House leaders balked at the online betting provision, potentially jeopardizing DeSantis’ chance at nailing down approval of the deal with the Seminoles. Similar efforts to reach gambling agreements have proven to be elusive, after a federal judge sided with the tribe and wiped out a 2010 compact amid a dispute about card games offered at pari-mutuel facilities. To ensure swift passage of the new compact, House Speaker Chris Sprowls and Senate President Wilton Simpson on Monday announced that DeSantis and the tribe had agreed to remove the provision requiring the state to negotiate with the tribe about online gambling. “In my discussions with our mem-
bers, I realized many shared the same concern as I — that some language in the compact could be construed to lead to the backdoor expansion of online gaming,” Sprowls, R-Palm Harbor, wrote Monday in a memo to the House, adding that “even the mere possibility of this was unacceptable.” Amid scrutiny from gambling opponents and conservative lawmakers, the tribe last week sent a letter to DeSantis and the Republican legislative leaders, emphasizing that the provision would not necessarily lead to online gaming operated by the Seminoles. Online wagering already takes place but has not been legalized or taxed by the state. “The question that has been asked is whether the tribe would have a remedy if the state failed to negotiate such an amendment or to negotiate in good faith. The simple answer is that the tribe would not have a remedy,” Osceola wrote Wednesday to DeSantis, Sprowls and Simpson in a letter obtained by The News Service of Florida. The provision in the compact “is simply an agreement to continue discussions about online gaming, but there is no enforcement mechanism if the state fails to engage in such discussions,” Osceola wrote. The Seminoles would not be able to seek enforcement of the provision from the U.S. Department of the Interior, which oversees tribal compacts, Osceola said. Florida lawmakers began meeting Monday afternoon for a special session focused on ratifying the tribal compact and several other pieces of gambling legislation, such as a measure that would create a statewide gaming commission appointed by the governor. A Senate committee approved the removal of the online wagering provision from the compact on Monday. Jim Allen, CEO of Seminole Gaming
and chairman of Hard Rock International, pitched House and Senate panels Monday about the benefits of the proposed compact. The tribe in 2019 halted annual payments of about $350 million to the state, following a legal dispute over controversial “designated player” games offered at many pari-mutuel card rooms throughout Florida. Under the deal struck by DeSantis and Osceola, the tribe would pay at least $2.5 billion in the first five years of a 30-year agreement, which could net the state “in excess of $20 billion” over the next three decades, Allen told lawmakers Monday. The compact, which requires legislative approval, would enable the Seminoles to serve as a hub for online sports betting, with pari-mutuel operators contracting with the tribe. Pari-mutuels would get to keep 60 percent of sportsbetting revenue, with 40 percent going to the Seminoles. The tribe would pay the state up to 14 percent on the net winnings. Online sports betting is not affected by removing the provision that could have led to legalizing other online wagering. But opponents of the proposed compact maintain that the sports betting authorization violates a 2018 constitutional amendment, known as Amendment 3, which required statewide voter approval of future expansions of gambling. Rep. Sam Garrison, a Fleming Island Republican who is co-sponsoring legislation to ratify the compact, told a House panel Monday that the sports betting provision could be problematic. “There’s a legitimate question and legal question as to whether or not the sports gaming, with the hub-and-spoke model as contemplated in the compact, triggers Amendment 3,” Garrison, a lawyer, said. “It’s an open legal ques-
tion. Period.” Addressing lawmakers Monday, Allen acknowledged that the sports betting provision in the compact is likely to face legal challenges. “Very candidly, it does not matter,” Allen said, “because the state of Florida is not taking a risk.” Allen argued that the tribe and its lawyers believe the sports betting provision will stand up in court. “We understand that even if we are wrong, we are resuming our revenue share on the land-based casinos, that this year alone would be in excess of $400 million that the state is not receiving today,” he said. “So if the concern is sports betting and we’re wrong, the state is still at least $4 billion ahead of the game between now and 2030. And that’s our point in a nutshell. We’re taking that risk.” But John Sowkinski, president of the group No Casinos and chair of the political committee that backed the constitutional amendment, urged lawmakers to reject the proposal. Amendment 3 allows the state and tribes to negotiate compacts “for the conduct of casino gambling on tribal lands,” but Sowinski maintained that the language only applies to games taking place on tribal property, not on cell phones throughout Florida. “Those words matter. They matter not just to folks in Washington D.C. in the Department of Interior who are going to be reading them, but they also matter to the voters of Florida. That has a meaning in Florida law, above and beyond its meaning in federal law,” Sowinski said. Sowinski rejected the notion that the constitutional amendment would allow people to place sports wagers on cell phones anywhere in the state, as long as the servers are located on tribal lands. “That dog don’t hunt,” he said.
UPDATED: TOURISM IMPROVES IN EARLY 2021—BUT STILL STRUGGLES JIM TURNER NEWS SERVICE OF FLORIDA TALLAHASSEE — Florida’s tourism industry saw improvement during the first three months of 2021, but the number of visitors was still down 14 percent from a year earlier as the state continued to grapple with the COVID-19 pandemic. Travel-industry officials can envision bluer economic skies ahead as businesses scale back mask requirements and other social-distancing rules imposed to combat the virus that has killed more than 36,000 Floridians. Florida drew 26.16 million visitors from Jan. 1 to March 31, down from 30.4 million tourists during the first quarter of 2020, according to numbers posted late Friday by the state tourism-marketing agency Visit Florida. The pandemic began hammering the state’s economy in March 2020, amid a period that includes tourist draws such as spring break and baseball spring training. The number of tourists fell to 9.92 million in the second quarter of 2020, a 69.4 percent drop from the prior year, before increasing to 20.33 million in the third quarter and 19.096 million for the fourth quarter. The new estimates by Visit Florida included a revision of the overall numbers for 2020 that indicates the pandemic was worse on the leisure and hospitality industry than previously projected. The agency in March estimated Florida had 86.714 million visitors in 2020. With the revision, Florida’s 2020 total was set at 79.75 million, a 39.3 percent drop from 2019. The 2020 figures were the lowest in a decade for a state that relies heavily on tourism to fuel its economy. Until the pandemic, Florida posted nine consecutive years of increased tourism numbers, topped by 131.4 million travelers in 2019. The new numbers come as the state and federal governments battle in court over the idled cruise-ship industry and as major Orlando theme parks and other businesses have changed mask-wearing rules.
Disney, which has increased the number of visitors allowed into its parks, and Universal now allow visitors to remove masks when in outdoor common areas, such as Main Street U.S.A. of the Magic Kingdom, and pool decks. “If anybody’s been in Florida in the middle of summer with a mask on, that could be quite daunting,” Disney CEO Bob Chapek said during the company’s quarterly earnings call with investors on Thursday. “So, we think that’s going to make for an even more pleasant experience.” The business changes follow Gov. Ron DeSantis’ recent suspension of all localgovernment coronavirus emergency orders. Also, the federal Centers for Disease Control and Prevention has issued guidance that fully vaccinated people do not necessarily need to wear masks outdoors and indoors. Just over one-third of Floridians are fully vaccinated. SeaWorld Orlando responded by saying face coverings will no longer be required for fully vaccinated guests at its properties, while adding that guests won’t be required to provide proof of vaccination. With the changes, Disney’s Chapek said he anticipates “an immediate increase in the number of folks that we’re able to admit into our parks through our reservation systems that we recently implemented.” The state’s 2021 first quarter numbers were bolstered by 25.56 million travelers from other parts of the United States, which has been the primary target of Visit Florida marketing since last summer. The domestic traveler number was 5.3 percent below the first quarter of 2020. Visit Florida first targeted East Coast regions easily drivable to Florida and this year started expanding its marketing efforts to California, Oregon and Washington. A budget approved April 30 by state lawmakers would provide $50 million to Visit Florida for the fiscal year that will start July 1 — the same as in the current year — and pump an additional $25 million into the agency from federal
stimulus money to “conduct activities that support and fund Florida’s tourism industry and its recovery from COVID-19 through promotion and marketing activities, services, functions, and programs.” The budget has not gone to Gov. Ron DeSantis. Meanwhile, Canadian travel for the first quarter was down 97.2 percent, with Florida attracting 34,000 Canadians during the period, and international tourism was down 74.4 percent. The state drew an estimated 564,000 overseas visitors the first three months of the year, with many nations still imposing border-screening and other travel restrictions due to COVID-19. Visit Florida President and CEO Dana Young said in a statement Monday that the overall first-quarter numbers indicate a “better recovery than expected.” “Visit Florida’s efforts have been crucial for the gains we have achieved in our economic recovery, and the state’s increased investment in Visit Florida this coming fiscal year will ensure we can continue delivering results for every sector of our tourism industry,” Young said. DeSantis has repeatedly argued the
state’s economy could be doing better if the CDC would allow cruise ships to start operating without requirements for passengers and crew. The state has filed a lawsuit against the federal government over cruise-ship restrictions. DeSantis has also signed into law a measure (SB 2006) that bans governments and businesses from requiring COVID-19 vaccination “passports.” Norwegian Cruise Line CEO Frank Del Rio recently told investors that the world’s third largest cruise line could restart operations outside of Florida waters, as it plans to require proof of vaccinations for all passengers and crew through at least Oct. 31. DeSantis on Thursday dismissed Miami-headquartered Norwegian Cruise Line, which operates out of Port Canaveral, Port Miami and Tampa, as “not one of the big ones.” Carnival, hoping to restart operations out of Miami on July 4, has not announced a vaccination requirement for its ships. Royal Caribbean on its website said that all guests 18 and older, along with all crew, will be required to submit proof of vaccination no later than boarding day.

DUKE ENERGY BATTLES BREAKUP PROPOSAL JIM SAUNDERS NEWS SERVICE OF FLORIDA STAFF TALLAHASSEE — Duke Energy pushed back Monday against a hedge fund’s call for Duke to make changes that could include breaking off its Florida subsidiary into a standalone utility. Elliott Investment Management, in a detailed letter released publicly, backed splitting the North Carolina-based Duke into three companies, with one operating in Florida, one in the Carolinas and one in Indiana, Ohio and Kentucky. Elliott, a major investor in Duke, argued in the letter that the company’s “current ownership of utility businesses across three separate geographies has delivered few benefits for stakeholders and has left its Florida and Midwest utilities undermanaged and undervalued.” “To be clear, Duke’s underlying utilities are strong,” the letter said. “Yet despite their strength, and given the company’s numerous investment and operational missteps, investors have lost confidence in the company’s current multi-jurisdictional, noncontiguous utility model. To regain investors’ trust, the company’s current management and board must simplify its footprint to a more manageable and logical service territory, refocusing on its core Carolinas utilities and recommitting to operational and investment excellence.” But Duke released a response disputing Elliott’s arguments and saying Duke’s “business is stronger and more impactful as a consolidated, standalone entity that remains as one.” “This ‘shrink-the company’ strategy that underlies all of Elliott’s proposals runs counter to the strategic direction of the entire industry at a time when scale is needed to efficiently finance the company’s unprecedented capital investment and growth opportunities,” Duke said in the response. Duke Energy Florida is the secondlargest utility in Florida, with more than 1.9 million customers, trailing only Florida Power & Light. It was created after Duke merged with Progress Energy in a deal that was completed in 2012. In its response Monday, Duke said it had received a series of proposed changes from Elliott since July 2020. It
said the Duke Board of Directors “has reviewed their proposals in depth and determined that they are not in the best interests of the company, its shareholders and other stakeholders.” Elliott called Monday for appointing new independent directors who would lead a review of splitting Duke into three regional companies. It also compared Duke’s Florida operation with FPL and other utilities. “As a standalone entity, Duke Energy Florida would have a management team solely dedicated to that business,” the letter said. “With that level of focus, Duke Energy Florida could accelerate critical infrastructure investment and rate base growth to increase system reliability and accelerate renewables build-out, while also managing the impact on customer bills through cost reductions. More focused peers such as FPL have successfully operated under such a structure within the state, as have others across the nation, creating clear lines-of-sight to value creation. With improved operational focus, a path to industry-leading rate base growth and single-state exposure to perhaps the strongest regulatory jurisdiction in the country, we are confident that a standalone Duke Energy Florida could achieve the highest valuation of any regulated utility.” In its response, Duke noted that the Florida Public Service Commission on May 4 approved a three-year baserate settlement for Duke Energy Florida. Duke said Florida’s “constructive regulatory framework and significant potential in renewables and clean energy make Florida a central element of Duke Energy’s business and investment plans.” It also contended that creating three companies would lead to increased costs. “Standing up smaller, independent utilities would require considerable new costs and would reverse a decade of cost cutting efforts by integrating corporate functions of predecessor companies,” the Duke response said. “These unavoidable new costs would put pressure on utility rates without any tangible benefit to customers and would be highly unlikely to be recoverable from customers, impacting the credit and growth rate of the smaller utilities.”

COURT REFUSES TO SEND GUN CASE TO JUSTICES NEWS SERVICE OF FLORIDA STAFF An appeals court Monday refused to send to the Florida Supreme Court key issues in a case about a 2011 state law that threatens tough penalties if city and county officials approve gunrelated regulations. Attorneys for local governments filed a motion last month requesting that the 1st District Court of Appeal send the issues to the Supreme Court — a move known as certifying “questions of great public importance.” But the Tallahassee-based appeals court denied the motion Monday. As is common, the court did not explain its reasons. A panel of the appeals court on April 9 upheld the constitutionality of the 2011 law, which was challenged by 30 cities, three counties and more than 70 local officials. Florida since 1987 has barred cities and counties from passing regulations that are stricter than state firearms laws, and the penalties in the 2011 law were
designed to strengthen that “preemption.” The law, for example, could lead to local officials facing $5,000 fines and potential removal from office for passing gun regulations. The challenge has contended the threatened penalties infringe on types of immunity that help shield public officials from lawsuits over their decision-making and actions. Local governments and officials filed three lawsuits challenging the 2011 law after the February 2018 mass shooting at Marjory Stoneman Douglas High School in Parkland that killed 17 people. The lawsuits, which were ultimately consolidated in Leon County circuit court, included cities and counties from various parts of the state, such as Tallahassee, Gainesville, Orlando, St. Petersburg, Fort Lauderdale and Miami Beach. The local governments and officials did not challenge the underlying 1987 preemption law but contended the penalties in the 2011 law were unconstitutional.
MENTAL HEALTH CARE LAGS IN PANDEMIC NEWS SERVICE OF FLORIDA STAFF Although utilization rates for some health-care treatments have rebounded to pre-pandemic levels, a new federal report shows that mental-health services have had the slowest rebound in Medicaid and the Children’s Health Insurance Program. According to the federal Centers for Medicare & Medicaid Services, 26 million fewer mentalhealth services were provided between March 2020 and October 2020, when compared to a similar time frame in 2019. The analysis of the Medicaid and CHIP programs shows that during the first eight months of the pandemic, 14
