PENSACOLA LOSES EVENTBASED REVENUE DUE TO COVI D- 19 by Gina Castro
COVID-19 has caused far more than a surplus of health concerns. Government ordered closures of nonessential businesses across the U.S. has not only negatively affected the average employee’s pockets but also the U.S. economy, which could cause the potential collapse of said economy. Nearly 22 million Americans have applied for unemployment since the COVID-19 pandemic began. Goldman Sachs, the investment firm, estimates that unemployment claims could skyrocket to 37 million by the end of May. In compliance with CDC regulations and Florida Gov. Ron DeSantis’ 30-day lockdown, dozens of Escambia County and Pensacola events have been canceled. These event cancelations directly impact the number of tourists coming to the area, which affects the amount of revenue local businesses can collect which then impacts the jobs and hours available for employees. According to Visit Pensacola’s website, tourism in Pensacola pays $427 million in wages and employs 24,081 people. Tourism is also directly responsible for 17 percent of Escambia County jobs. Business Climate reached out to several major events in the area to help gage the economic impact of COVID-19 in the local area. Spring break leading into summer marks Pensacola’s largest tourist season. Spring festivities such as Ciclovía, Vegfest and the Gulf Coast Science Festival were set to occur March 28. These annual events along with the weekly Palafox Market were expected to bring dozens of locals and other visitors to downtown. Rand Hicks, chairman of Ciclovía Pensacola, said that he and his team were expecting this year’s Ciclovía to pull more revenue in and have more guests than the past few years have. “Last year, the five-hour Ciclovía event generated $362,538, and in the three
years from 2017–2019, Ciclovía brought well over $1,000,000 in added expenditures to Pensacola,” Hicks said. “We were anticipating an even larger and more diverse crowd this year, and we thought we’d exceed $500,000.” Hicks explained that the number of visitors each year has steadily increased. According to the figures gathered by Majority Opinion Research, a marketing research firm, the 2017 Ciclovía had more than 10,000 attendees, and in 2019, the number jumped up to 15,000. In 2019, there were also more than 60 vendors at the event. Autism Pensacola, a nonprofit, had to cancel its Steps for Autism event, which plays a major role in the organization's awareness campaign and fundraising. Cate Merrill, President and CEO of Autism Pensacola, explained that teams of people compete against each other to fundraise the most money during the weeks leading up to the March 21 event. “We raised some money, but we certainly aren’t anywhere near our goal,” Merrill said. “With all of this going on, the teams fell off. Even though the event doesn’t raise the money, we didn’t see a lot of action happening with the teams. We haven’t made an announcement about how teams can still fundraise because now is a challenging time to ask for money.” Merrill said that the Au-
tism Pensacola staff is applying for grants in order to supplement the monies they were unable to raise. Several events that were anticipated to occur in April and May have been canceled or postponed to a date later in the summer. The Pensacola Little Theatre’s Cabaret: Shaken Not Stirred was initially set for April 4, but it has been rescheduled to June 6. Bridget Middelton, Executive Director of Fiesta Pensacola, confirmed that Pensacola Crawfish Festival, which was set for May 8–10, has been postponed to June 12–14. You can see Fiesta Pensacola’s complete list of its rescheduled events at fiestapensacola.org. Palafox Market and Gallery Night, a monthly downtown event, have been canceled until further notice. Palafox Market showcases dozens of artists and merchants each Saturday. Palafox Market didn’t respond to Business Climate’s inquiries. “Not being able to host our events due to COVID-19 is no doubt having a major impact on local business, not just brick-and-mortar but the vendors who help us make the event happen and the dozens of micro businesses like artists who rely on Gallery Night to reach the public,” Gallery Night Director Sydney Robinson said. “Before this health event, Gallery Night was gearing up for a busy and bigger-than-ever season including a 5k race and other engaging activities.” Each month, Gallery Night brings approximately 50 artist vendors, 40 plus merchants, a handful of food trucks and visitors from all over the panhandle. “Our events draw thousands of visitors. These
visitors engage with downtown businesses during Gallery Night where they might otherwise not visit at all,” Robinson said. Pensacola Beach Pride Weekend, a major tourist attraction that occurs each Memorial Day Weekend, has also been canceled. The Majority Opinion Research estimates that the 2019 Pensacola Beach Pride Weekend attendees spent $20,496,322 in Escambia County, and the percentage of attendees who came to Pensacola specifically for this event spent $17,381,969 in Escambia County. Another major tourist event, Foo Foo Festival has been canceled due to COVID-19 despite the fact that its annual event date is months away. The festival is set to resume Nov. 4–15, 2021. “Our board voted unanimously to suspend the Foo Foo Festival this year in light of the pandemic,” David Bear, trustee emeritus for Art, Culture and Entertainment, Inc. said. “The timing for committing financially for 2020 is now and we felt it would be irresponsible to begin our process during this uncertain and precarious time. We look forward to getting back to business as usual next year.” Haas Center, the University of West Florida’s center for market research, conducted a report on the 2019 Foo Foo Festival. The report found that the festival attracted approximately 69,349 unduplicated attendees. The total estimated spending for all visitors was $7,800,820. The report also found that the Foo Foo Festival visitors helped support 110 jobs, $9.4 million in sales and approximately $2.6 million in personal income.

CANADY: RESUMPTION OF JURY TRIALS LIKELY TO BE LIMITED AND REGIONAL by Jim Ash Florida businesses may be coming back to life in the wake of the COVID-19 pandemic, but Chief Justice Charles Canady says it’s too early to predict when Florida courts will be fully operational. “I extended the prohibition on jury trial proceedings through early July,” Justice Canady said. “But I can’t tell you that in early July, we will go back to jury trials.” Addressing a May 15 video conference meeting of The Florida Bar Board of Governors, the chief justice acknowledged that the inability to hold jury trials is creating a backlog of cases that will have to be addressed. “I recognize that a lot of things can’t get decided until we have jury trials” the chief justice said. “Even things that aren’t going to actually go to trial won’t get determined until there is an immediate prospect of a jury trial…that’s just the way our system works.” Canady said he is expecting additional recommendations from the Workgroup on the Continuity of Court Operations and Proceedings During and After COVID-19. “We are intensely focused on this issue,” he said. The chief justice cautioned that any reopening will likely be temporary and regional. “It’s possible that initially we will go back
to jury trials in some parts of the state but not in other parts of the state,” he said. “Additionally, I would expect that when we start back, it will be on a limited basis, because, as we’re feeling our way, we won’t be able to go back to 100 percent.” Justice Canady said he wants to make sure that the courts are fully prepared for any possible resurgence of the pandemic after the initial rate of infection levels off. “There’s likely going to be a recurrence, possibly a more intense recurrence of this virus, and we’ve got to be prepared for that eventuality,” he said. “Now, I don’t know exactly what’s going to happen, and how that’s going to come, and how that’s going to be manifested, but we have to be vigilant as we go forward.” The state budget is also feeling the effects of the pandemic, Justice Canady warned. Filing fee revenues that pay for most court operations have fallen off dramatically, but they are climbing again and there should be enough reserves in a state trust fund to last the fiscal year, he said. “It’s not an immediate crisis for us,” he said, adding that the governor could authorize loans if necessary. However, Florida’s court clerks, who rely on fines and fees, are on the brink of fur-

loughing workers, the chief justice said. “Of course, there’s so much of the work that we do that we can’t do without the work of our clerks, so that is a matter of urgent concern for our branch and we’re going to be expressing our concern,” he said. On a brighter note, Canady said Florida law students will be able to take the Bar exam later this year at venues in Orlando and Tampa. “We looked at that, with the Board of Bar Examiners, and we decided that we could do it safely based on the advice of the public health authorities.” The chief justice said all participants will be required to take precautions. “There is going to be extraordinary physi-

cal distancing as well as the use of personal protective equipment by all of the participants,” he said. “With those measures we feel that we can do it safely. We’re going forward with that plan based on the circumstances that now exist.” Canady said Florida’s legal community deserves to be praised for the way it has responded to the health crisis. “I am very pleased with the work that our courts have been doing through the use of remote technology. A great deal of the work of our branch is now being carried on in that way,” Canady said. “All of us have reason to be proud of the legal profession, and we’re going to soldier on, we’re going to get beyond this, we just don’t know when."

THE FLORIDA BAR’S 2020 ANNUAL CONVENTION GOES VIRTUAL The 2020 Annual Bar Convention will be a virtual only affair this year due to the COVID-19 pandemic. “A considerable amount of time was spent looking at every conceivable option for Annual Convention including postponing or canceling the convention all together,” President John Stewart said May 8. “In the end, it was determined that the Annual Convention will be held exclusively as a virtual or remote event. There will be no in-person events for the 2020 Florida Bar Annual Convention.” Originally slated for June 17–20 in Orlando, the 70th Annual Convention is being re-tooled so that section and committee meetings, CLE seminars, and certain other events can be held virtually or remotely the week of June 15–19. Stewart said the decision to hold a virtual convention was difficult in many ways, but was easy when measured against the necessity of protecting the health and safety of Florida lawyers and Bar staff. “In the end, I am optimistic that this will allow us to showcase that The Florida Bar continues to be a leader in the nation and can and will continue important and necessary business utilizing available technologies,” Stewart said. “As is the theme for this year’s convention, we will be Looking Back but Moving Forward.” A detailed schedule with confirmed functions to be held via electronic methods will be distributed in the coming weeks.
“We expect there will be many exciting features to this event,” Stewart said. The Bar’s hotel contract for the Annual Convention is being cancelled under the force majeure, impossibility, and cancellation clauses and the Hilton Orlando Bonnet Creek & Waldorf Astoria will cancel all hotel rooms in the Annual Convention room block and send cancellation notices to those who had already made reservations. Bar staff is working with committee and section chairs and other Bar leaders to develop a schedule using teleconferencing, video conferencing, or other virtual meeting options. The convention week will also include CLE seminars, including President’s Showcase events, and the General Assembly with the installation of President-elect Dori Foster-Morales. Stewart also praised the commitment of section and committee leaders. “I recognize you are all volunteers, yet you have met your obligations head-on despite dealing with unprecedented personal and professional challenges,” Stewart said. “I am grateful for each of you.” Stewart said the Bar will continue to explore ways to help its members as the COVID-19 crisis persists, with particular focus on practical ways to support Florida lawyers in thier daily lives and practices. “We are all in this together; and, together we can recover and restore our legal system and law practices to normal operations as soon as possible,” Stewart said.

GULF ISLANDS NATIONAL SEASHORE IS CONTINUING TO INCREASE RECREATIONAL ACCESS TO AREAS OF THE PARK The Fort Pickens Area is set to reopen, along with other Florida areas, with modified operations. Gulf Breeze, Fla. – Following guidance from the White House, Centers for Disease Control and Prevention (CDC), and state and local public health authorities, Gulf Islands National Seashore is increasing recreational access at the Florida areas. The National Park Service (NPS) is working servicewide with federal, state, and local public health authorities to closely monitor the COVID-19 pandemic and using a phased approach to increase access on a parkby-park basis. Beginning on Saturday, May 16, Gulf Islands National Seashore will initiate Phase Two access at: • The Fort Pickens Area °° Regular operating hours °° Restrooms will be limited to Langdon Beach and the restrooms outside of the Discovery Center °° Lifeguards will be on duty at Langdon Beach • The Perdido Key Area °° Regular operating hours resume °° Lifeguards will be on duty at Johnson Beach • Santa Rosa Area, including Highway 399 °° Opal Beach restrooms at clusters C

COUNTY DISCUSSES TINY HOMES AT THE COMMITTEE OF THE WHOLE MEETING Escambia County Board of County Commissioners discussed moving forward with construction standards and land use for tiny homes at today's Committee of the Whole Meeting. The next discussion will take place at an upcoming planning board meeting. The date has not been determined yet. "It is exciting that the board is discussing the tiny home option because it would offer an affordable living option for Escambia County residents," said Chairman Steven Barry. If Appendix Q is adopted, which is within the upcoming 7th edition of the Florida Building Code Residential (FBCR) effective December 31, 2020, it would provide some relief from more stringent requirements found in the FBCR such as ceiling heights, individual room areas, stair requirements, etc. To be considered a tiny house the floor area could not be over 400 square feet. A larger home would need to meet normal building code standards. Tiny houses cannot be recreational vehicles such as travel/camping trailers, motor homes, private motor coaches, fifthwheel trailers or park models. All the provisions and regulations

COUNTY DISCUSSES PLANS FOR OLF-8 AT COMMITTEE OF THE WHOLE MEETING The Escambia County Board of Commissioners discussed the OLF-8 Master Plan Kickoff during the Committee of the Whole meeting Thursday, May 14. DPZ CoDesign, the firm selected by the commission in August 2019 to create the master plan, gave a presentation on how they plan to solicit and incorporate public opinion into their plans, engage widely with citizens and stakeholders in the planning and design process and how long the planning process will take. Marina Khoury, DPZ CoDesign lead the presentation, which also included speakers Chips Kirschenfeld, Deputy Escambia County Administrator and Director of Natural Resources, Terri Berry, Escambia County Environmental Project Coordinator and Travis Peterson, Impact Campaigns. The presentation highlighted three major phases, each with six key points: Phase 1, Assessment & Analysis, Phase 2, Scenario Planning and Phase 3, Implementation Strategy. View the presentation here. The OLF-8 property is a former naval training airfield adjacent to Navy Federal Credit Union's main campus in Beulah. Escambia County acquired the 640-acre property in a land swap with the Navy on April 1, 2019. The OLF8 Master Plan will focus on creating jobs, incorporating green space and enhancing the quality of life for citizens of Escambia County. "This is a large parcel," Marina Khoury, DPZ CoDesign said. "We have a real opportunity to do something really special." DPZ CoDesign stated their design
process would be based heavily around public and stakeholder input, particularly through digital platforms, and estimated the process would take approximately nine months. NOLF Site 8 was originally constructed in 1940 as an auxiliary airfield for Pensacola NAS. At approximately 635 acres, Site 8, along with NOLFs Spencer and Pace, was one of the oldest NOLFs still in use until the land transfer with Escambia County in April 2019. Site 8 was initially used as a fixed wing training field. The field had undergone several changes and was temporarily closed in the mid to late 1950s. In 1964, the NOLF was brought back into service as an NOLF to support NAS Whiting Field’s rotary-pilot training mission. The NOLF was used as a primary tactical training asset by TRAWING 5. The field provided facilities to support training in rotary tactics, confined area landings, platform landings, external loads missions, hot refueling and was tentatively studied to support night vision training.

GYMS TO REOPEN, RESTAURANT SEATING TO EXPAND JIM TURNER NEWS SERVICE OF FLORIDA TALLAHASSEE — Gyms and fitness centers can start to reopen Monday and restaurants can seat more customers, as Gov. Ron DeSantis continued Friday to take “small steps” with his economic recovery plans amid the coronavirus pandemic. DeSantis said restaurants on Monday can expand their indoor seating to accommodate 50 percent occupancy, after being limited to 25 percent occupancy since May 4. Retail stores also will be able to go to 50 percent occupancy — moves Democrats cautioned need to come with more available testing for the virus. Gyms and fitness centers will be allowed to get back to business after being shut down to prevent the spread of COVID-19, the deadly respiratory disease caused by the coronavirus. DeSantis urged people to take precautions as they work out. “If you're inside, make sure you're doing the social distance and then sanitize the machines and surfaces after use,” DeSantis said during a news conference at Ascension St. Vincent's Riverside Hospital Clinic in Jacksonville. “I mean, that should be happening anyways. I mean, if you're sweating on the dip bar, clean the dip bar when you're done doing dips.” Also as part of DeSantis’ announcement Friday, local governments can
reopen libraries and museums with limited capacity, and they can work with amusement-park operators and shortterm rental owners to submit reopening plans to the state. The closure of theme parks in midMarch has been a major hit to Florida’s economy and tax revenues. “They should identify the date certain that they believe that they could resume safe operations,” DeSantis said. “They have to provide how they're going to do it, how they're going to accommodate the guests, how they're going to protect the staff, and then they need to have an endorsement from the relevant official in their locality.” Movie theaters and bars, meanwhile, will remain closed. DeSantis said he’s working on plans to open summer youth programs and schools, saying the virus tends to attack people who have underlying health conditions or who aren’t in good physical condition. He said Wednesday that plans were being devised for youth sports programs. “I would say the experience in Florida has been very, very low risk for minors, which I think is a really, really good thing,” DeSantis said. “And I've said many times, I would have no problem with my kids playing with other kids or doing that, because I just view them as a low-risk environment. I think there's a whole bunch of other risks that are more significant that parents happily accept every single day.”
COUNCIL APPROVES GUIDELINES ON HEALTH RATIONING NEWS SERVICE OF FLORIDA STAFF The Florida Developmental Disabilities Council on Friday voted to adopt a set of ethical guidelines for the potential rationing of health care during a pandemic. The only dissenting vote on the council came from the organization Disability Rights Florida. The guidelines were developed by the Florida Bioethics Network. Democrat Spyros Theodore Chialtas opened a campaign account this week to run against Rep. Clay Yarborough, R-Jacksonville, in Duval County’s House District 12, according to the state Division of Elections website. Yarborough had raised $106,000

Friday’s announcement was an additional part of a first phase of economic reopening that began May 4. That phase expanded at the start of this week to include allowing barber shops and salons to reopen and to include Palm Beach County, which had been initially left out. On Thursday, DeSantis included Miami-Dade and Broward counties in the reopening efforts. Palm Beach, MiamiDade and Broward have the largest numbers of COVID-19 cases in the state. While many Florida businesses started to reduce services and close their doors in mid-March, the state has been on a semi-lockdown since DeSantis issued stay-at-home orders for people and “non-essential” businesses on April 1. Democratic lawmakers warned Friday that plunging into more reopening without adequate COVID-19 testing being available would use Floridians as economic “guinea pigs.” “I think we're sort of shooting in the dark here,” said Sen. Gary Farmer, DFort Lauderdale, while at the Old Capitol on Friday. “Because without testing, without much more significant testing of more Floridians, it's going to be hard for us to make a determination that we're doing this safely and effectively.” DeSantis said the state will continue to monitor and prepare for any outbreaks or resurgences of the virus. But while research on a vaccine continues, he said, “everyone should recognize that you will never get to a point where you can just say it's gone.”
JUVENILES, FACILITY WORKERS TEST POSITIVE NEWS SERVICE OF FLORIDA STAFF The number of youths in the state juvenile-justice system who have tested positive for COVID-19 has jumped to 12, with half of the cases at the Okeechobee Youth Development Center, the Florida Department of Juvenile Justice said Friday. The number of infected youths was up from seven during a count Tuesday. Also, the number of infected workers increased from 25 on Tuesday to 29 on Friday. Youth Academy has six staff members and four youths who have tested positive, while the Broward Regional Juvenile Detention Center has had nine infected workers. The department said all youths and staff members at the Okeechobee facility are being tested for COVID-19. “All employees as well as parents/guardians of youth at the program have been notified,” the news release said. “Increased cleaning and sanitization protocols will continue at the program.” The Okeechobee facility is a behavioral- and mental-health treatment program for males age 13 to 21 who are considered high risk, according to the website of TrueCore Behavioral Solutions, a contractor that operates the program.

As of Thursday, the Florida Department of Health reported the state had 43,210 cases of the coronavirus and 1,875 deaths, including 808 new cases and 48 deaths added since Wednesday. Democratic legislators argued Friday they’re ready to go back to work in a special session to address problems in the unemployment system and the economic impacts of the virus on the state’s budget, as they’re seeing reports that the budget shortfall could reach as much as $10 billion. But they contend DeSantis and his business allies are rushing the phased reopening. “Clearly, we do need to begin to look at opening,” Sen. Perry Thurston, DFort Lauderdale, said. “But we don't need to do it too soon, because we’re just got to make it more difficult. This experiment that the governor is harping upon, this experiment is going to utilize the people of Florida as the subject like guinea pigs.” Sen.
