When you watch the news, go on social media or talk to a neighbor, it’s almost impossible to not mention COVID-19. It’s affected us all in so many ways whether your job shut down, your loved one got sick or you simply miss a warm hug. Many of us have been blessed with good health, full bellies and a warm bed. Others have not. As of April 29, 2 million people have applied for unemployment in Florida. But before all of this, families and individuals were struggling to get food on their plates, pay their bills and care for their health. These vulnerable populations and the nonprofits who serve them have been hit harder than ever before. FamiliesFirst Network of Lakeview, Inc. (FFN) and Gulf Coast Kids House (GCKH) explained that during times of financial crisis, there is an increase in child abuse and domestic violence, but because of social distancing, fewer people will be able to witness or report the abuse. “We know from a long history of watching trends that when children are isolated from the community and families are under stress, child abuse rates go up,” Jenn Petion, M.A., A.P.R., FFN Director of Administration and External Affairs, said. “Right now, the number of calls to the child abuse hotline are down, but we are preparing for the fact that once children are visible and the economic impact starts to really take hold, we are likely to see a prolonged increase of child abuse rates.” Based out of the Baptist Healthcare Lakeview Center, FFN works closely with families, law enforcement, the judicial system, the Florida Department of Children and Families and other organizations. FFN is the lead agency for child welfare services. “During the BP oil spill, we saw a dramatic increase in child abuse, but it showed up about a month to three months later because people are dealing with the crisis right then,” Stacey Kostevicki, GCKH Executive Director, said. “I think one of our biggest concerns with this is that not only does stress increase physical abuse but access increases sexual abuse as well. We expect to see an increase in both physical and sexual child abuse within the next couple of months.”
GCKH is a child advocacy center for the Pensacola and Escambia County area. This center focuses on the intervention, investigation and prosecution of child abuse cases. Children within the foster care system are also facing challenges due to COVID-19 related restrictions. FFN explained that since the Supreme Court has suspended all court cases until the end of May, foster children’s transition to permanent homes and the reunifications of families have been postponed. “Normally, we have 20 to 30 adoptions finalizing a month, and we have reunifications happening every month,” Petion said. “Right now, we really are restricted on our ability to get kids through the legal system to permanency.” However, FFN said that most of the services parents need to complete to be reunified with their children, such as substance abuse treatment and counseling, are still available through telemedicine. GCKH said that children and families are able to continue their counseling online as well. FFN and GCKH are in need of help from the community. child abuse to 1-800-96ABUSE. Waterfront Rescue Mission and Manna Food Pantry are two nonprofits that serve anyone in need, including the homeless and low income individuals and families. Waterfront has had to stop its recovery program, a 12 month program to help recovering drug addicts, and limit its space to 50 people due to COVID-19. The President of Waterfront Devin Simmons said that on a typical day, the Pensacola location has 100 or more people coming in need of resources. “The one thing that's great about our location is that it's big. The bad thing is there are a lot of people densely compacted with a high health risk in one location,” Simmons explained. “It’s almost like the worst petri dish you can create because it's a bunch of high risk individuals that we may or may not know anything about their background or susceptibility.” Before the governor’s stay home order, Simmons said that he and his staff had to ask all guests who were using the space for shelter to stay with family or friends. For those who didn’t have anywhere to go, Waterfront worked with partner agencies to get them rental money for local motels. “I hate to make it sound like we were trying not to have anybody. That’s not the goal,” Simmons said. “If one person gets sick in a building with no walls, everybody is going to get sick.” However, people at the Hope House, a shelter used for the last six months of the recovery program, are able to stay where they are.
Manna has had to shut down its three food pantries located in Pensacola, Milton and Jay due to COVID-19. Normally, a person in need is able to make an appointment and visit the pantry the very next day, but now, Manna is distributing to its partners only. Manna has a lengthy list of programs and organizations it supports, such as the School Resource Officer Food Program in partnership with the Pensacola Police Department and Escambia County Sheriff’s Office, clients of Gulf Coast Kids’ House and Santa Rosa Kids’ House, Community Health Northwest Florida and Salvation Army. “The output is actually greater despite the fact that we’ve closed our pantries. It’s greater than what it would typically be for March and April,” Kerri Smayda, Manna Development Director, said. “A lot of folks we serve are primarily low income, so those folks were struggling to begin with, and this crisis is certainly an added burden for them.” Even though Manna’s food output has increased by double, Manna’s volunteer workforce has decreased by 87 percent. Manna went from having between 85 to 100 volunteers to 11. “That has certainly required us to make adjustments in the way that we pack food bags and distribute them,” Smayda said. “Those 11 volunteers are making it happen, and we are very fortunate that there are folks like them to help us.” Waterfront has also had to adapt to functioning with a smaller staff. All eight of its stores have had to close, so Simmons said that everyone is either furloughed or their pay, including his, has been suspended. Waterfront has furloughed 248 employees out of 320. This reduction in staff has affected the donations Waterfront is able to accept at this time. “We want our stores to open jobs and opportunities for people, but we can’t do it if people leave it at our stores and the items get ruined,”
Simmons explained. So, if you have items you would like to donate to Waterfront, hold onto them until Waterfront stores reopen. Simmons said that the community can help Waterfront by donating on its website waterfrontmission.org and donating food, shampoo, soap, toothbrushes and toothpaste to Opening Doors website openingdoorsnwfl.org. Since food donations could potentially be compromised by the virus, Manna is accepting only monetary donations at this time. Manna is in dire need of donations since events like its National Association of Letter Carriers Stamp Out Hunger Food Drive, which brought in more than 80,000 pounds of food last year, have been postponed. You can donate to the Manna Cares Campaign fundraiser at www. mannahelps.org. For the clients at Council on Aging of West Florida, many of them have been affected mentally and emotionally. “For decades, we have been preaching the importance of close, personal, social interaction, and now, we are having to find new ways to deliver that,” Josh Newby, Marketing Communications Director of Council on Aging, said. “We hear from clients who are lonely, who miss their grandkids, who miss their friends, and it’s exacting a very harsh mental toll on them.” Newby said that Council on Aging is in need of volunteers for its Meals on Wheels program and donations to purchase roughly $25,000 in shelf-stable meals. FLORIDA’S CHIEF JUSTICE ISSUES NEW PANDEMIC ORDERS LAUNCHING A REMOTE CIVIL JURY TRIAL PILOT PROGRAM, SETTING NEW HEALTH SAFETY MEASURES, & AMENDING PRIOR EMERGENCY ORDERS TALLAHASSEE – Florida’s Chief Justice Charles Canady issued an order late on May 21, 2020, creating a new pilot program for civil jury trials to be held using remote technology. It will explore ways to let one of the most central parts of the state justice system – jury trials – begin again using health-related distancing during the coronavirus pandemic. All jury trials in Florida have been halted, and a backlog has developed, since March 13, 2020. This occurred because of the danger of spreading coronavirus in the close quarters used in standard jury procedures. Florida has relied on an in-person jury system for 175 years since it achieved statehood in 1845. Jury trials are required by both the federal and state constitutions in certain instances. Under the pilot program, the statewide COVID-19 Workgroup will develop requirements and will select up to five Florida trial circuits to participate in the pilot. At this point, trials will only be civil, noncriminal cases and all parties must consent to participate in the pilot. In other actions last night, Canady also took the following measures:
• Issued a separate new order establishing health & safety precautions to be used in Phase 2 of the expansion of court operations. These precautions are based on a report issued by a statewide advisory COVID-19 Workgroup. • Amended an earlier order called SCAO20-23 that provides comprehensive emergency procedures for use in courts in the pandemic. The amendments incorporate the new Phase 2 safety procedures contained in the COVID-19 Workgroup report. Phase 2 is the time when limited in-person contact will be authorized in courts and court proceedings, but protective measures still will be required. It will be followed by Phase 3, when in-person contact is more broadly authorized, and Phase 4, when coronavirus no longer presents a significant risk. Transition to Phase 2 in the Florida state courts will occur when each trial and appeals court has: • Met five benchmark criteria: (a) no COVID-19 cases in the courthouse within 14 days or the use of deep cleaning if such cases have occurred;

THE FLORIDA BAR’S 2020 ANNUAL CONVENTION GOES VIRTUAL The 2020 Annual Bar Convention will be a virtual only affair this year due to the COVID-19 pandemic. “A considerable amount of time was spent looking at every conceivable option for Annual Convention including postponing or canceling the convention all together,” President John Stewart said May 8. “In the end, it was determined that the Annual Convention will be held exclusively as a virtual or remote event. There will be no in-person events for the 2020 Florida Bar Annual Convention.” Originally slated for June 17–20 in Orlando, the 70th Annual Convention is being re-tooled so that section and committee meetings, CLE seminars, and certain other events can be held virtually or remotely the week of June 15–19. Stewart said the decision to hold a virtual convention was difficult in many ways, but was easy when measured against the necessity of protecting the health and safety of Florida lawyers and Bar staff. “In the end, I am optimistic that this will allow us to showcase that The Florida Bar continues to be a leader in the nation and can and will continue important and necessary business utilizing available technologies,” Stewart said. “As is the theme for this year’s convention, we will be Looking Back but Moving Forward.” A detailed schedule with confirmed functions to be held via electronic methods will be distributed in the coming weeks.
“We expect there will be many exciting features to this event,” Stewart said. The Bar’s hotel contract for the Annual Convention is being cancelled under the force majeure, impossibility, and cancellation clauses and the Hilton Orlando Bonnet Creek & Waldorf Astoria will cancel all hotel rooms in the Annual Convention room block and send cancellation notices to those who had already made reservations. Bar staff is working with committee and section chairs and other Bar leaders to develop a schedule using teleconferencing, video conferencing, or other virtual meeting options. The convention week will also include CLE seminars, including President’s Showcase events, and the General Assembly with the installation of President-elect Dori Foster-Morales. Stewart also praised the commitment of section and committee leaders. “I recognize you are all volunteers, yet you have met your obligations head-on despite dealing with unprecedented personal and professional challenges,” Stewart said. “I am grateful for each of you.” Stewart said the Bar will continue to explore ways to help its members as the COVID-19 crisis persists, with particular focus on practical ways to support Florida lawyers in thier daily lives and practices. “We are all in this together; and, together we can recover and restore our legal system and law practices to normal operations as soon as possible,” Stewart said.

COUNTY RECEIVES OFFICIAL LETTER APPROVING SHORT-TERM VACATION RENTAL PLAN
PENSACOLA SPORTS EXTENDS THE VIRTUAL FISHING TOURNAMENT TO A FOUR-WEEK LONG EVENT
Escambia County received the official letter from Secretary Beshears with the Florida Department of Business and Professional Regulation approving the short-term vacation rental plan that was submitted Friday, May 15. The letters from and to the Secretary as well as the plan are attached to this news release. This plan went into effect immediately today and will be reviewed weekly. The county will continue to monitor the Department’s Emergency Information Page, www.myfloridalicense. com/emergency, for additional information and guidance related to vacation rentals or other businesses regulated by the Department during the ongoing “Safe. Pensacola Sports announced today its Reel it in America, Fishing for a Cause, will continue under a new format. The new four-week long Virtual Fishing Tournament will run from May 22 - June 21, giving anglers a chance to catch the biggest fish over two of the most popular fishing weekends - Memorial Day weekend and Father’s Day weekend. “Over the last four weeks, Reel it in America gave anglers of all ages the opportunity to compete,” said Ray Palmer, President and CEO of Pensacola Sports. “We are excited to continue that and invite more anglers to join the new four-week long tournament.” Registration for Reel it in America is broken up into five categories: • Group A: Entry fee: $20, photo verification required- Speckled Trout, Redfish, Largemouth Bass, Flounder, Crappie, Panfish (Bream, Bluegill & Sunfish), Fresh Water Catfish, Pompano. • Group B: Entry fee: $30, photo verification required- King Mackerel, Spanish Mackerel, Bluefish, Striped Bass, Permit, Tarpon, Snook, Jack Crevalle. • Group C: Entry fee: $40, photo verification required- Red Snapper, Grouper, Amber Jack, Trigger Fish, Cobia, Bonito, Lionfish. • Group D: Entry fee: $200, photo verification required- Shark, Yellow Fin Tuna, Black Fin Tuna, Mahi Mahi, Wahoo.

Part of each entry fee will go towards prizes for the top winners. Plus, Pensacola Sports will donate part of each entry fee to Disabled American Veterans, which are helping veterans affected by COVID-19. All anglers must live along the Gulf Coast (Florida, Alabama, Mississippi, Louisiana, Texas) and the east coast of Florida and follow local, state and federal laws. It is up to the angler to abide by said laws. Anglers must use a rod and reel to catch the fish. Electric reels are allowable. Escambia County and the City of Pensacola are encouraging all residents to complete the 2020 Census to ensure everyone in the community is accurately counted. SUPPORT DOWNTOWN BUSINESSES DURING 'SUNDAY STROLLS' IN MAY AND JUNE A section of Palafox Street in downtown Pensacola will be closed to vehicle traffic for "Sunday Strolls" every Sunday in May and June to promote safe outdoor retail and restaurant activities to support local businesses. Palafox Street from Garden Street to Main Street will be closed to vehicle traffic from 10 a.m. to 9 p.m. every Sunday through June beginning Sunday, May 24. Closing the street to vehicular traffic will provide additional space for downtown visitors to more easily practice social distancing while supporting local businesses. Businesses and individuals must adhere to the following rules and guidelines: • Only businesses with an existing License to Use from the City of Pensacola may use the space in front of their business for outdoor seating or retail expansion. Businesses that do not have an LTU are not allowed to put furniture or other items in the sidewalk in front of their business.
• Businesses with existing LTUs are asked to please review their approved LTU plans and ensure they remain in compliance with the rules included in their LTUs. • Businesses may not place furniture or other items in the street. • Businesses must remain in compliance with any applicable Americans with Disabilities Act laws. All areas must remain ADA accessible. • Do not gather in groups larger than 10 people. • Maintain at least 6 feet of distance between yourself and others whenever possible. Residents are encouraged to come support local restaurants and businesses as they enter economic recovery, but everyone should continue to follow guidelines from the Centers for Disease Control and Prevention to help prevent the spread of COVID-19. Individuals who are sick or who are at a higher risk for severe illness from COVID-19 are encouraged to stay home.

ESCAMBIA COUNTY COMMISSION VOTES TO AMEND BEACH EXECUTIVE ORDER The Escambia County Board of County Commissioners voted Thursday, May 21, to amend Executive Order 20-6, creating Executive Order 20-8 regarding Escambia County public beaches. Effective Thursday, May 21 a noon, Escambia County public beaches are now fully open to the public. Camping on the beach is not allowed per county ordinance 74-36 and consistent with the “Leave No Trace” protections for nesting sea turtles. Other Escambia County parks, including public access points on Perdido Key remain closed from sunset to sunrise. Beach goers are still asked to limit groups to 10 people or fewer and to adhere to CDC social distancing measures by keeping a 6-foot distance between others who are not in their im-
mediate household. Pavilions and beach bathroom facilities have reopened. The area around and under the fishing pier is open. Dog parks have already been reopened and permitted in designated areas. "I want to reiterate that the three public accesses on Perdido Key are closed at sunset; they’re sunup to sundown," Commissioner Underhill said. "That is a critical part of our habitat conservation plan and our commitment and responsibilities to our Federal Government. The change that we’re making with regard to sundown to sunup [with Emergency Order 20-6] does not change anything about the policies and procedures at the three county-owned public accesses on Perdido Key."

JOBLESS RATE LEAPS TO 12.9 PERCENT JIM TURNER NEWS SERVICE OF FLORIDA TALLAHASSEE — More than threequarters of a million Floridians joined the ranks of the unemployed as the coronavirus pandemic fully took hold in April, pushing the state’s jobless rate to 12.9 percent, according to state figures released Friday. The rate was up from a revised 4.4 percent mark in March, when the virus began causing businesses to shut down or scale back. The Department of Economic Opportunity estimate for April showed 1.218 million Floridians qualified as unemployed from a statewide workforce of 9.44 million. That was up from 457,000 people unemployed in March. The overall labor force also fell by nearly 9 percent last month. The April unemployment rate surpasses Florida’s peak during the recession a decade ago. Gov. Ron DeSantis said he knew the figures were going to be “significant,” while expressing hope that the economy will quickly rebound as businesses have started to reopen and expand services under the first phase of his recovery efforts. “If we can get people back to work, get some confidence back in the communities, you'll start to see, hopefully, a lot of these jobs be recovered,” DeSantis said Friday while at Ed Austin Park in Jacksonville. “Just look at the theme parks, that’s over 100,000 jobs … from the theme parks,” he continued. “I think Univer-
sal has submitted a plan to reopen, and it was endorsed by Orange County. So, I'm going to be reviewing that. We met with the vice president (Vice President Mike Pence), we had Disney, SeaWorld, all those others (together on Wednesday). So, there's definitely a path to get a lot of those people back to work, and that's what we have to do." Florida’s monthly estimate came with a reduction in the labor force of 893,000 people, from about 10.3 million in March to 9.4 million in April, accounting for people out of work and not seeking employment. “Reasons that a person would be considered out of the labor force (not unemployed) include: not wanting a job, not being able and available for work, and not looking for a job within the previous four weeks either due to discouragement over job prospects or due to other reasons,” Department of Economic Opportunity spokeswoman Tiffany Vause said in an email. The number of employed people dropped during the same time by 1.65 million, from 9.87 million to 8.22 million. The state data show more than 1 million private-sector jobs disappeared between March and April. A state website said Friday that about 2.1 million jobless claims have been filed since March 15, of which 1.74 million are considered “unique.” The department is expected to release May unemployment numbers on June 19. Ron DeSantis on Friday said he is lifting coronavirus-related restrictions on youth activities, including summer camps and athletic events, because he trusts parents and local governments will make the right decisions for kids. “We trust parents to use common sense. We trust our local officials. We trust the doctors that work with the folks day to day on a local basis in a way that is safe,” DeSantis said at a news conference in Jacksonville. The governor said the state will allow local governments to figure out restrictions on youth activities, but DeSantis said he does not think imposing too many rules is wise. “When you do that and you overcook it, you end up getting less compliance with it because people just throw up their hands and say that some of this is ridiculous,” the governor said. Lifting restrictions on youth activities is the latest push by DeSantis to have Floridians return to some sense of normalcy after weeks of the state being shut down due to the coronavirus pandemic. DeSantis is including youth activities in the early reopening process, in part because he said he is encouraged to see young people have not been as impacted by the virus. “This virus has a disproportionate impact on the elderly. We in the state of Florida have observed zero fatalities under the age of 25 throughout the entire course of the pandemic,” the governor said Friday. The governor, a father of three young children, said he is not comfortable having his kids participate in youth activities. “I wouldn’t want my kids involved in things right now,” he said. “But if for some reason I didn’t think it was safe and my wife didn’t, then obviously we wouldn’t (lift restrictions).” Helen Aguirre Ferre, a spokeswoman for the governor, later clarified that DeSantis does not want his kids out and about because of their ages — the oldest is 3 years old — not because the activities would pose risks to their health. “Most youth activities are for older children, T-Ball, for example begins at 4-5 years of age. However, other parents should be able to make that choice for themselves,” Ferre said in an email Friday. In Florida, service-producing jobs accounted for the biggest month-to-month drop, with 1 million positions eliminated between March and April, a 12.6 percent reduction for the industry. Leisure and hospitality jobs saw 479,000 workers displaced, a 39.6 percent decrease for the industry.

The area around Punta Gorda recorded a 15.6 percent jobless rate, up from 4.9 percent. The Miami to West Palm Beach region, the area hardest hit by the coronavirus had a 13.2 percent jobless rate. To meet the definition of the syndrome, patients must be under 21 and have a fever, laboratory evidence of inflammation, have a clinically severe illness requiring hospitalization and must test positive for a novel coronavirus infection, or have been exposed to it within the four weeks before the symptoms' onset. The federal Centers for Disease Control and Prevention published information May 15 on its website after noting the emergence of the illness in New York. As of Friday, New York health officials said they were investigating 161 reported MIS-C cases. There have been three deaths.

FEDERAL JUDGE CLEARS WAY FOR FELONS TO VOTE DARA KAM NEWS SERVICE OF FLORIDA TALLAHASSEE — Opening the door for hundreds of thousands of convicted felons to be added to Florida’s voting rolls, a federal judge on Sunday struck down major parts of a state law requiring felons to pay court-ordered “legal financial obligations” to be eligible to vote. U.S. District Judge Robert Hinkle’s highly anticipated ruling also laid out a procedure for state elections officials to determine whether felons seeking to vote have outstanding legal financial obligations and are unable to pay court-ordered debts. Hinkle’s decision came less than a month after an eight-day trial in the lawsuit, filed by voting- and civilrights groups who alleged that linking voting rights and finances amounts to an unconstitutional “poll tax.” The record “shows that the minerun of felons affected by the pay-tovote requirement are genuinely unable to pay,” Hinkle wrote in Sunday’s 125page decision. The law, approved by Republicans in a party-line vote last year, required felons who have completed their time behind bars to pay fees, fines, costs and restitution affiliated with their convictions to be eligible to cast ballots. The law — fiercely defended by Gov. Ron DeSantis and his administration — was aimed at carrying out a 2018 constitutional amendment that restored voting rights to felons “who have completed all terms of their sentences, including parole and probation,” excluding murderers and individuals convicted of felony sexual offenses. More than three-quarters of the 1 million Floridians who have been convicted of felonies and completed their time in jail or prison have outstanding legal financial obligations, or LFOS, and more than 80 percent are unable to pay the court-ordered debts, according to an analysis conducted by University of Florida political science professor Daniel Smith for the plaintiffs. “I find as a fact that the overwhelming majority of felons who have not paid their LFOs in full, but who are

The state has not identified the prisoner or the correctional facility where he or she was housed. The Florida Department of Health said in a report that seven of the other inmates who died from complications of COVID-19 were housed at Blackwater River Correctional Facility, while three were inmates at Sumter Correctional Institution. People sometimes have to pay to obtain the records. “The state has shown a staggering inability to administer the pay-to-vote system and, in an effort to reduce the administrative difficulties, has largely abandoned the only legitimate rationale for the pay-to-vote system’s existence,” the judge wrote. Voting-rights advocates hailed Hinkle’s decision. “Our democracy requires that every eligible voter have equitable access to the ballot box. Instead of embracing this founding principle, the Florida Legislature and Gov. DeSantis enacted a modern day poll tax to keep people from accessing this fundamental right,” American Civil Liberties Union of Florida Legal Director Daniel Tilley said in a prepared statement. “It should alarm Floridians that there are people occupying the highest echelons of political power in our state who fought to keep Florida tied to its racist past and bar people from voting. We are pleased the court saw right through that and rejected this blatantly discriminatory voter suppression scheme.” Many felons do not know, and some have no way to find out, the amount of LFOs included in a judgment, Hinkle wrote. Few people will know that they must obtain copies of their judgments to ascertain how much they owe, Hinkle added. “Most will start with the internet

Hinkle pointed to research by a professor and graduate students who tried to obtain information on 153 randomly selected felons. The group found “there were inconsistencies in the available information for all but three of the 153 individuals,” Hinkle wrote. “Even if a felon manages to obtain a copy of a judgment, the felon will not always be able to determine which financial obligations are subject to the pay-to-vote requirement,” he added. “The takeaway: determining the amount of a felon’s LFOs is sometimes easy, sometimes hard, sometimes impossible.” Hinkle also faulted a procedure released by the state in the days leading up to the trial. The plan instructs state elections workers to credit all payments felons have made — including fees to collections agencies or other third parties — toward the total amount assessed at the time of sentencing. If the payments equal or surpass the amount assessed at sentencing, the voter is considered eligible, according to the new procedure, which Hinkle dubbed the “everydollar” approach in Sunday’s order. “The state’s principal justification for the pay-to-vote system is that a felon should be required to satisfy the felon’s entire criminal sentence before being allowed to vote — that the felon should be required to pay the felon’s entire debt to society. But the everydollar method gravely undermines this debt-to-society rationale. Under the every-dollar approach, most felons are no longer required to satisfy the criminal sentence,” Hinkle scolded. The ability to vote for three felons who committed the same crime and drew the same sentence would depend on whether they have money or not, Hinkle explained. “This result is bizarre, not rational,” he wrote. are small, Hinkle wrote, but the U.S. Supreme Court “has made clear that when the issue is paying to vote, even $1.50 is too much.” The judge also criticized the state for crafting the policy in an attempt to “shore up the state’s flagging position in this litigation.” Hinkle’s order also found that felons cannot be required to pay courtordered fees and costs, which he decided are unconstitutional “taxes.” The judge’s order creates a form for people to seek an “advisory opinion” from the Florida Division of Elections to determine whether they have outstanding financial obligations, a process suggested by the state during the trial. Hinkle’s form also allows people to assert that they are unable to pay the court-ordered costs. Under his order, people can register to vote and vote within 21 days of submitting a request for an advisory opinion, “unless and until the Division of Elections provides an advisory opinion that includes the requested statement of the amount that must be paid together with an explanation of how the amount was calculated.” Hinkle had signaled earlier that he would rule against the state in the case. In a preliminary injunction issued in October, Hinkle ruled that it is unconstitutional to deny the right to vote to felons who are “genuinely unable to pay” court-ordered financial obligations. A three-judge panel of the 11th U.S. Circuit Court of Appeals in February upheld Hinkle’s ruling, finding that requiring all felons to pay financial obligations violates equal protection rights guaranteed under the 14th Amendment because it “punishes those who cannot pay more harshly than those who can.” After the appeals-court ruling, Hinkle granted class certification in the lawsuit, meaning that hundreds of thousands of convicted felons could have their voting rights restored when the case is concluded.
