THE C . ROGER VINSON AMERICAN INN OF COURT by Elizabeth M. Timothy, Chief United States Magistrate Judge Northern District of Florida
I
can say with certainty that one of the highlights of my career has been the honor of serving as President of the Pensacola American Inn of Court for the past two years.1 It was a tumultuous time during my tenure, when the world seemed to have turned upside down overnight.
Lawyers’ familiar routines, such as attending depositions and hearings, engaging in mediation, and trying cases in person, abruptly stopped. Seemingly without warning, state and federal courts around the country were faced with major problems in need of speedy resolution in order to ensure that justice continued to be served. At the same time, leaders of Inns around the country were faced with a daunting question: how to persevere, much less prosper, during a pandemic, knowing that the main benefit of Inn membership is in-person interaction, education, and socialization. Before explaining how the Pensacola Inn fared, I will provide a historical background of the larger American Inns of Court concept— and why 2021 was such a monumental year for the Pensacola Inn. The American Inns of Court (AIC) idea began in the late 1970s, spurred by then-Chief Justice Warren Burger’s vision of adapting the traditional English model of legal apprenticeship to the needs of the American legal system. Justice Burger’s vision ultimately led to the establishment of the first American Inn of Court in Utah just over forty years ago, in 1980. By 1983, additional American Inns formed in the District of Columbia and three other states. In 1983, as Inns were forming around the country, Chief Justice Burger created a committee of the United States’ Judicial Conference to explore whether the American Inn concept was of value to the administration of justice in the United States and, if so, whether a national organization should be founded. He envisioned that a national organization could promote, establish, and assist American Inns while promoting the Inns’ core goals—legal excellence, civility, professionalism, and ethics. The committee later reported an enthusiastic “yes” to the Judicial Conference and proposed the creation of the AIC Foundation. The Conference agreed and thus endorsed the American Inns concept and the formation of a national structure. The AIC Foundation was established in 1985. The AIC movement has grown faster than any other organization of legal professionals. Today, there are nearly 400 chartered American Inns in forty-eight states, the District of Columbia, Guam, and Tokyo and nearly 30,000 active members nationwide. The essence of the AIC movement has been, and is, a recurring focus on honing the skills, civility, and professionalism that epitomize effective advocacy. To state it more formally: The Mission of the AIC, and its individual chapters such as ours here in Pensacola, is to advance
the rule of law by achieving the highest level of, and fostering excellence in, professionalism—through example, education, and mentoring. As is often said, the law is a noble profession, but that can remain true only if attorneys uphold their ethical obligations and advocate in a manner that befits their profession. This theme is common among all Inns. There are those who criticize Inns, claiming our professionalism efforts fail to reach the target audience. In other words, they say, we are “preaching to the choir.” However, as former Florida Bar President Hank Coxe once responded, “It is okay to preach to the choir … as long as our efforts result in expanding the size of the choir.” And I’m proud to say that we have accomplished this in Pensacola. The Pensacola American Inn of Court (PAIC) began thirty years ago, in 1991, when eight judges and sixteen attorneys met to formally organize an AIC Chapter in Pensacola. These “inaugural” judges and lawyers may fairly be described as the “who’s who” of the Pensacola legal community at the time.2 Since 1991, 600 local attorneys and judges have participated, and the PAIC’s current roster consists of about sixty-five active members. It could be larger, but it is limited to that size by design. Eight judges still participate each year, and each judge is assigned to lead a team. The teams, which are also referred to as “pupillage groups,” vary slightly in size, but each team is comprised of “Masters”—attorneys with more than fifteen years of experience, “Barristers”—attorneys with at least five years of experience, and “Juniors”—attorneys with less than five years of experience. The team designs are, in effect, an American adaptation of the pupillage system that is basic to the English Inns of Court. That is, they are designed to bridge the gap between formal law school education and legal practice by offering continuing education in the Common Law tradition, throughout all stages of an attorney’s career. The PAIC’s active year generally follows the school year, from about September to May. Its members meet once a month to hear a team’s educational presentation. Each team presents once over the course of the term, and the presentations are followed by a social and dinner. The PAIC also holds an end-of-year party in June. Our Inn was able to continue this tradition during the pandemic by offering a “hybrid” presentation format, providing members the option to attend each presentation in person at the federal courthouse, in a socially-distanced space, or remotely by Zoom. The post-presentation socials and end-
of-year party were held in outdoor spaces. Remarkably, the PAIC’s attendance numbers were the same, if not better, than in years prior, and the new venue for the socials turned out to be preferred over the former, indoor space. So, all in all, the year was a success, despite the pandemic. It would not have been possible, however, were it not for the assistance of federal court staff—including Shane Shao (IT) and law clerks Allison Hunnicutt and Shannon Morris. Likewise, the PAIC board was of invaluable assistance, and I am grateful to each of them (Jeremy Branning, Ron Johnson, Judge David Langham, and Dave McGee) for their support, encouragement, and tireless assistance. Turning now to the end-of-year party, held in June 2021. We gathered at the Hancock Whitney Club at the Blue Wahoos stadium, where we were treated to fantastic views and fabulous meals. The party was more formal than the usual PAIC end-ofyear party, but such was only fitting, as the party was held in honor of our Inn’s thirty-year anniversary. As I mentioned at the event, our Inn most definitely could not have survived and thrived for three decades were it not for the time and energy expended by so many dedicated and longstanding lawyer and judge members—each of whom has participated on a volunteer basis, often donating substantial time and even money without seeking any recognition whatsoever. Awards were presented to past-presidents and attorneys with fifteen or more years of membership.3 I then presented awards—replicas of the original PAIC Charter— to two of the inaugural members
in attendance, Ed Moore and Don Partington. I read the Charter’s introduction: Inasmuch as Roy M. Kinsey and H. Edward Moore and Donald H. Partington have made due and proper application to the American Inns of Court Foundation for a charter to organize, establish and carry on activities as a participating American Inn of the American Inns of Court Foundation... the American Inns of Court Foundation... does hereby grant American Inns of Court Foundation Charter No. 148 to the above-named applicants... [said chapter] to be known as the Pensacola American Inn of Court in Pensacola, Florida. As those recognitions drew to a close, some in the audience began to notice that the back of the venue was filling with young people, obviously including elementary-school-aged children and older. It was a standingroom only crowd. It was then that I turned my attention to the Honorable C. Roger Vinson, who was sitting just a few feet in front of me with his wife, Ellen. I announced that Judge Vinson, too, was a charter member and had served as the PAIC’s first President, and I presented a replica of the Charter to him as well. I then asked Judge Vinson to bear with me while I shared more information about our founding president’s impressive background. In summary, I noted the following: Judge Vinson graduated from the United States Naval Academy in 1962 and then served for six years as a Naval Avia-

tor. He obtained his law degree from Vanderbilt, where he served on the law review and was a Patrick Wilson Merit Scholar. He practiced law with Beggs & Lane in Pensacola for about twelve years, until he was appointed to the United States District Court for the Northern District of Florida by President Reagan in 1983. He has served continuously since that time, including seven years as Chief Judge. Judge Vinson also served on the Foreign Intelligence Surveillance Court, the United States Judicial Conference’s Advisory Committee on Civil Rules, the Judicial Conference’s Committee on Bankruptcy Administration, the Eleventh Circuit’s Pattern Jury Instruction Committee, and the Eleventh Circuit’s Judicial Council and its Executive Committee. He was President of the Eleventh Circuit District Judges Association and the Northwest Florida Federal Bar Association, among many other such positions. Next, I announced that, considering Judge Vinson’s amazing career— and his instrumental role in forming the PAIC, it was not surprising that the board and membership had voted, unanimously, to rename the Pensacola American Inn of Court to the C. Roger Vinson American Inn of Court. The moment we had all been waiting for—well, everyone except Judge Vinson—had finally arrived! Remarkably, Judge Vinson had no

Continued from Page 1 idea this honor was about to be bestowed, as we somehow managed to keep the name change a secret from him. I presented a mounted, ceremonial charter to Judge Vinson, bearing his name, at which point it became obvious that the standing-room only crowd gathered for the occasion was Judge Vinson’s extended and proud family, dozens of them. It was heartwarming to see them there, to say the least. And I couldn’t help but notice the look exchanged between Judge Vinson and Ellen, which made clear that—much to his delight—Judge Vinson knew Ellen had played a role in the surprise. After receiving the new Charter and learning of the renaming, Judge Vinson addressed the
crowd. He humbly insisted that credit for the Inn’s founding belonged to others, including Ed Moore, Don Partington, and Roy Kinsey, among others, in that regard. He reiterated the mission of the Inn, the Inn’s goal of professionalism, and the undeniable value of mentoring. He noted that attorneys are always mentoring, for better or worse, pointing out that even the most rudimentary of legal interactions can shape perceptions in the community and among our peers. His comments were moving, and it was clear his heart was touched by the decision to rename our Inn in his honor. It is a moment I will never forget. As the evening concluded, Judge Vinson remained seated at the President’s table, posing for photographs
with the parade of proud grandchildren, other family members, and numerous well-wishers. Congratulations, Judge Vinson, on this welldeserved recognition. I have now passed the “presidential gavel” to Judge Stephen A. Pitre, who will serve as president of the C. Roger Vinson American Inn of Court, for the 2021–2022 and 2022– 2023 terms. Judge Pitre kicked off the new year with a social in September 2021, during which he provided an inspirational message and welcome. Our teams are formed, and our monthly educational programs began in October—and so the tradition continues. I have no doubt that Judge Pitre will lead our Inn with honor and determination, as the Inn

embarks on its fourth decade and does so under a new name. In conclusion, I take a moment to reflect on the discussions surrounding the decision to rename our Inn in honor of Judge Vinson. Much was said. The most poignant references were to Judge Vinson’s commitment to this Inn and his exemplification of patience, honor, manners, and professionalism. Judge Vinson is the epitome of that for which the Inn stands and strives to instill in its members. I am grateful that efforts to rename the Inn reached fruition under my watch and on the occasion of the Inn’s thirtieth anniversary. Judge Vinson is a colleague, mentor, and friend, who welldeserves this honor.

The City of Pensacola is continuing to work diligently with the Federal Emergency Management Agency to acquire the necessary approvals and funding in order to complete remaining repairs from Hurricane Sally damage. All remaining FEMA-funded projects related to Hurricane Sally damage in the City of Pensacola are expected to be completed by Summer 2022, except for Wayside Park. The public’s patience is appreciated as the city works through the FEMA process required to move forward with repairs to City of Pensacola parks, boardwalks, waterfront areas and other public amenities that were damaged by Hurricane Sally.

On Oct. 22, 2021, West Florida Public Libraries donated winter hats to National Youth Advocate Program (NYAP), an organization advocating for the rights of children, youth and families serving Escambia County and the surrounding area. “National Youth Advocate Program always has a primary mission to find community members willing to open their home to one of the hundreds of local children in foster care. Our secondary mission is to engage a community that is supportive of children and foster families who need to know they’re not alone,” said NYAP Program Supervisor Jamilyn Ruckman. “We are thankful to West Florida Public Libraries for taking an interest in these children and joining us in this mission.” Library Manager Kim Ball was on
The City of Pensacola’s Parks and Recreation Department will be planting approximately 300 trees from December 2021 through February 2022, with a goal of replacing the trees lost in city parks during Hurricane Sally and helping to replenish Pensacola’s tree canopy for future generations. The planting will take place as part of the City of Pensacola Tree Refurbishment Plan, which kicked off on Arbor Day 2021 by planting two trees in Parker Circle Park. “After the devastating loss of several hundred trees during Hurricane Sally, I’m very excited to see this plan moving forward to replace trees that were lost or severely damaged in the storm,” Mayor Grover Robinson said. “Trees are such a vital part of Pensacola’s beautiful landscape, and it’s imperative that we continue planting trees that can be enjoyed by our citizens for generations to come.” In an effort to make the Tree Refurbishment Plan as successful as possible, the city has hired Geosyntec Consultants to test soil samples at each of the following parks and determine the right tree and location based on wind tolerance, soil conditions, drought tolerance, and other factors. The city will then select trees that best match the existing land-
As COVID-19 hospitalizations continue to decline, Escambia County will discontinue the COVID-19 dashboard featuring daily hospitalization updates and weekly death totals effective Saturday, Nov. 6. The last day Escambia County will track local hospitalizations and death totals will be Friday, Nov. 5. The Escambia County COVID-19 webpage will continue to be updated and includes a comprehensive list of testing sites, vaccination locations, prevention tips, resources and news releases. “We will continue to monitor the COVID-19 situation with our healthcare partners,” said Escambia County Public Safety Director Eric Gilmore. “As long as the hospitalizations remain under 50, we are going to discontinue the COVID19 dashboard after Friday, Nov. 5.” If you believe you may have been exposed to COVID-19, please contact the FDOH Call Center (866-779-6121) or FDOH-Escambia’s number (850-5956500) prior to traveling to any physician’s office, emergency department, hospital, or urgent care center, to ensure proper protective measures are taken to prevent further risk of spread to others. If possible, also review your signs, symptoms and travel history with your physician over the phone. Your physician will evaluate you for other possible causes of respiratory illness and also contact the county health department
to access COVID-19 testing. If you are without health insurance or a health care provider, please contact your county health department so the health department can coordinate your medical evaluation and testing. Most people with confirmed COVID19 infection reportedly have mild to moderate respiratory illness and can be managed at home in coordination with their health care provider and local health department. Persons with severe illness may be hospitalized. For updates and additional information, visit the Florida Department of Health in Escambia County. Escambia County Public Safety is responsible for keeping citizens safe from emergencies and both man-made and natural disasters. SPORTS BETTING COMES UNDER COURT SCRUTINY DARA KAM NEWS SERVICE OF FLORIDA TALLAHASSEE — A Washington, D.C.based judge harshly chastised lawyers for the Biden administration Friday for failing to be prepared to answer questions about whether a deal that gives the Seminole Tribe of Florida control over sports betting in the state violates federal law. U.S. District Judge Dabney Friedrich gave the U.S. Department of Justice until Tuesday to explain whether a sportsbetting provision in the deal between the Seminoles and the state is in keeping with the Indian Gaming Regulatory Act, or IGRA, which lays out the framework for tribal gambling. Friedrich spent the first 30 minutes of a two-hour hearing wrangling with Rebecca Ross, a lawyer with the Justice Department’s Indian Resources Section, about the government’s unwillingness to take a position on the issue at the crux of a lawsuit filed by two Florida pari-mutuel operators that oppose the deal. “It’s hard not to sit here and think that the government’s whole litigation strategy here is to delay this court from ruling,” Friedrich, who was appointed by former President Donald Trump, said near the end of the hearing. The sports-betting provision was included in an agreement, known as a compact, signed by Gov. Ron DeSantis and tribal Chairman Marcellus Osceola, Jr. this spring and approved by the Legislature during a May special session. Under the 30-year deal, the Seminoles agreed to pay the state at least $2.5 billion over the first five years in exchange for having control over sports betting throughout Florida and being allowed to add craps and roulette to the tribe’s casino operations. The “hub-and-spoke” sports-betting plan is designed to allow gamblers throughout the state to place bets online, with the bets run through computer servers on tribal property. The state’s tourism-marketing arm is finalizing a contract for a recently announced partnership with the international publication that will lead to Visit Florida covering a portion of production costs for 2022 guides that will feature restaurants in Orlando, Miami and Tampa. Visit Florida spokeswoman Leslie Pearsall called it “a great opportunity to elevate Florida’s culinary scene and bring a positive economic impact

Lawyers for Haaland, who is represented by the Justice Department, argued that the case should be dismissed because the plaintiffs lack “standing” to challenge the secretary’s actions. Ross told Friedrich that “the court should not proceed to reach the merits of any claims” and that the government wasn’t prepared to go beyond the issue of standing. That drew a rebuke from the judge. “Ms. Ross, I’m confounded by the government’s position,” she said. Friday’s hearing — which was scheduled to address a number of motions, including the government’s motion to dismiss and the plaintiffs’ motion for summary judgment — came just four days after the Seminoles launched online sports betting statewide. Friedrich repeatedly asked Ross whether the government believed that online betting taking place outside of tribal casinos was occurring on tribal lands. “We don’t have an answer to that question for you today,” Ross said during one exchange. In another exchange, Ross said that the “gaming that’s contemplated is occurring entirely on Indian lands.” “Stop right there. Help me understand. I’m having a hard time following that position. Attorney Hamish Hume, who represents the plaintiffs, argued that the federal law is “focused on gaming on Indian lands.” “IGRA cannot be used to try and create some sort of loophole” to offer games off tribal lands, Hume said. “That is not the purpose of IGRA. And what has happened is that there is now millions of people all over the state of Florida right now who are not anywhere near Indian lands who are able to place bets through their sports app on their phone or on their laptop that would be illegal, and in fact not just illegal but now a felony, if conducted by my clients (the pari-mutuels) or anyone else,” he added. SENATE MOVES FORWARD ON MAP PROPOSALS NEWS SERVICE OF FLORIDA STAFF Senate staff proposals for redrawing congressional and legislative districts for the next decade could be available this week, while it appears increasingly unlikely that public workshops will be held to take input on proposed maps. Senate Reapportionment Chairman Ray Rodrigues, R-Estero, wrote Monday to members of the Senate that he wants initial proposals to be available by Wednesday “to ensure ample time for review.” Rodrigues also asked lawmakers to be respectful of the proposals and mindful of analysis provided by organizations “whose goals could be motivated by improper partisan intent.” Senate redistricting subcommittees will meet next week. “I recognize publishing staff-drawn maps several days in advance of the select subcommittee meetings will likely result in self-appointed redistricting experts from all political persuasions immediately flocking to the media seeking to push their own narrative about our staff work product,” Rodrigues wrote. “As we know from

The judge appeared skeptical of the government’s arguments that the plaintiffs lacked standing to challenge the compact. “Haven’t they at least plausibly alleged injury here?” the judge asked. But Ross said the pari-mutuel operators couldn’t show that their customers would spend money elsewhere once sports betting becomes available. The injury “had to be concrete, it had to be particularized and it had to be either actual or imminent” to establish standing, Ross argued, again irritating the judge. “How can you possibly take the position that not a single person would prefer to use the online gaming system than go to a casino?” Friedrich asked. “That would be conjecture,” Ross said. Friday’s hearing also included brief arguments in a second lawsuit filed by two prominent South Florida businessmen and the group No Casinos. They allege that the federal government’s approval of the compact “adversely impacts plaintiffs’ properties and neighborhoods by, among other things, increasing neighborhood traffic, increasing neighborhood congestion, increasing criminal activity, reducing open spaces and reducing their property values.”

However, the preclearance requirement is no longer in effect after a 2013 U.S. Supreme Court ruling. The Senate Select Subcommittee on Congressional Reapportionment is slated to meet Nov. 16, and the Senate Select Subcommittee on Legislative Reapportionment is scheduled to meet Nov. 17. Redistricting will be a major issue during the 2022 legislative session, which will start Jan. 11.
