LGBT+ ELDERS SHARE THEIR STORIES

lthough queer and transgender people have been present in f ilms since the inception of cinema back in the 19th century, the way their stories and lives have been represented on screen has often been subject to gatekeeping.
As a result of stigmatization and historic prejudice against the LGBT+ community, early cinema censored and created codes like Hollywood’s own Hays Code, which forbade explicit depictions of homosexuality on film for over three decades. It wasn’t until the early 1970s to 1990s that the era of “New Queer Cinema” flourished and independent filmmakers began creating sincere and genuine LGBT+ representation. Now major streaming platforms like Netflix have categories for “Gay & Lesbian” movies and television, and locally, the Stamped LGBTQ Film Festival has been showcasing queer short films in Pensacola since 2012. Despite this thriving era of film, one population continues to be underrepresented: the elderly LGBT+ community. The Council on Aging of West Florida set out to change this with their new documentary Someone Waits For Me.
The documentary follows five senior LGBT+ people in Northwest Florida and shares their individual stories and experiences through in-depth interviews and subversive and artistic recreated scenes. The Council on Aging received funding for the documentary from a Sunday’s Child grant in 2020 and partnered with Appleyard Agency to produce the film. Someone Waits For Me is set to premiere on the weekend of November 12 at Pensacola Little Theatre and will be available to stream online after it makes its rounds in the festival circuit. Josh Newby, Council on Aging of West Florida marketing communications director, served as the director of the documentary and explained that he hopes the film will spark a community-wide conversation about LGBT+ elders. “We wanted to highlight this population that is very much overlooked in both the media landscape and in the conversation about LGBT+ issues,” Newby explained. “There is this notion that seniors are taken care of through social security, Medicare or their children. That is simply not the case. They are very much an invisible and vulnerable part of the population that our From top left to right:

culture doesn’t focus on because we place such an emphasis on ability and beauty. I want this film to start a conversation around elders, who have unique challenges based on their age and physical capabilities, but also have the intersected challenges of their sexuality in a very conservative part of the country.” This invisibility of the senior population is something that the Council on Aging wanted to capture in the documentary as they work to support and advocate for elders in Escambia and Santa Rosa counties. Rather than telling the stories of these individuals, they have given them a platform to share their own stories. “It’s the young people that go to the rallies. It’s the young people that march in the streets. It’s the young people that make the most noise. So, it’s their stories that are told. It’s not the elder who has been homebound for years and feels lonely and forgotten. That story never gets told, because frankly, no one even knows that person exists,” Newby said. “But we know that person exists, because we serve that person. At Council on Aging, we go to their door every day and serve meals or clean their home and make their lives better. If we can shed a spotlight on their stories, then maybe more people will care, and it’ll enable this community to live a richer life.” The lives and stories of LGBT+ elders are diverse, individual and cover a wide span of history. From growing up in a less tolerant time and living through violence against LGBT+ people to witnessing society change at their fingertips with the Gay Liberation Movement of the late 1960s and marriage equality in 2015. The documentary follows the narrative stories of Rick and Bill, a gay couple, Pat and Carla, a lesbian couple, and Miriam, a single lesbian. While their narra-
tives sometimes overlap, they often contradict one another and cover topics such as religious intolerance, coming out, class privilege, loneliness, marriage, being a part of the queer community and the importance of queer spaces. “Everyone we interviewed had such unique experiences and different perspectives on issues like prejudice, living in conservative areas and whether or not seniors should come out or remain closeted,” Newby explained. “Rick and Bill are big advocates of coming out and being true to yourself no matter how old you are, whereas Miriam took the opposite stance. Rick and Bill have been together for over 30 years, and they waited to get married until the Supreme Court legalized same sex marriage for the entire country, while Pat and Carla were the opposite and went to New York to get married. There wasn’t this monolithic gay experience.” Each interview in the film is separated into three mini-films within the documentary. Part of showcasing these diverse experiences includes weaving in elements of fantasy, magical realism and dream spaces to illustrate the stories being narrated in background of the film. As the filming took place in the midst of COVID-19 lockdowns and restrictions, where they couldn’t film the couples on a date or out on the town, Newby explained that they relied on these artistic and abstract scenes to create a nontraditional documentary. For Miriam, who is Puerto Rican and grew up in New York with a Catholic upbringing, her interview grapples with her experiences of being unaccepted at her Catholic school but finding refuge in the queer underground clubs

in Brooklyn. As she narrates her experiences, you can see a young girl walking through a church, clutching a cross necklace, as club music suddenly starts booming through the walls and drag queens appear in full-glam garb dancing in the church. For Pat and Carla, who met at a dive bar and told stories about lesbian bars, feminist poetry and the importance of having intimate queer spaces where they can feel safe and be themselves, the scene literally transforms on the screen from a dive bar to a luscious lesbian bar. “We couldn’t go back in time to these clubs in Brooklyn that changed over to gay bars at a certain hour of night or this dive bar where Pat and Carla met. We had to recreate those spaces, infusing them with the sentiments, desires and sort of forbidden, taboo culture that was so prevalent back then. These scenes really emphasize how these characters were feeling and the emotions that were evoked as they told their stories,” Newby said. The first screening of the film will premiere in Pensacola on the weekend of November 12 at Pensacola Little Theatre. Someone Waits For Me will also be available to stream online after it finishes its rounds in the film festival circuit. ESRBA: If you could meet any fictional Lawyer, who would you choose and why? Annalise Keating from the tv show How to Get Away with Murder. The confidence and the respect she commands is very captivating. ESRBA: How was Studying for the Bar? That was a challenging 3 months. I believe I was able to successfully get through that
process with the support of amazing professors, family, and friends. I was working for the first half of bar prep which made everything twice as hard. Working while studying for the bar meant I had to make a schedule and stick to it. ESRBA: Why choose the legal field? My interest in the field of law comes from my mom who is a part of the legal field back home in Jamaica. I was always that child who was excited to go to work with mom every chance I got. So, in a sense, I grew up seeing the importance of the legal system in our day-to-day lives and the positive impact it has. Also having a law degree provides endless possibilities and puts me in a position to provide assistance and counsel to others through my services which is very important. ESRBA: Have you decided on an area of practice? I am trying not to limit myself this early in my career. There are so many areas of law I am yet to be exposed to and I am currently keeping an open mind.

COMMUNITY PARTNERS ANNOUNCE THE RETURN OF “VAX & DASH” Community Health Northwest Florida, in partnership with Escambia County District 3 Commissioner Lumon May and Studer Family Children’s Hospital, announces “Vax & Dash -- Drive-thru Trunk-or-Treat Edition,” to take place Saturday, Oct. 30, from 5-6:30 p.m. at the Brownsville Community Center, 3200 W. DeSoto St. The event will feature Pfizer COVID-19 vaccinations available inside the Community Center and a drive-thru trunk-or-treat-style candy distribution in the main parking lot for children and families. “We enjoy working with our community partners to get the word out about public health and access to vaccines. Eligible persons who wish to participate in COVID-19 vaccination may park in the Community Center side parking lot and walk in at their convenience during the 5-6:30 p.m. vaccine clinic hours. All individuals ages 12 and older are encouraged to get their COVID vaccine at this special event. Drive-thru Trunk-or-Treat will take place in the main parking lot across from the front doors of the Community Center. Volunteers will be on-hand to direct traffic, instructing drivers to enter the main parking lot and drive slowly, stopping
briefly at each Trunk-or-Treat vehicle. JUDGE OK’S ONLINE MEDICAL MARIJUANA ORDERING DARA KAM NEWS SERVICE OF FLORIDA TALLAHASSEE — Leafly and similar sites will be able to resume contracting with Florida medical-marijuana operators to allow patients to order products online, under a ruling issued Monday by an administrative law judge. Florida health off icials this year stopped medical-marijuana operators from using Leafly and other third-party sites to process patient orders, saying the arrangements violated a state law banning operators from contracting for services “directly related to the cultivation, processing and dispensing” of cannabis. But Seattle-based Leafly Holdings argued that it is not engaging in activity related to the dispensing of cannabis products because the company does not accept payment for or distribute cannabis products to patients. The company filed a petition asking an administrative law judge to find that the Florida Department of Health employed an “unadopted and invalid rule” to conclude that the online services violated the law. Judge Suzanne Van Wyk didn’t go as far Monday as Leafly requested, but she found that the ban on the use of the third-party sites amounted to an unadopted rule and ordered the state agency to “immediately discontinue reliance on its policy … regarding online ordering of medical marijuana through third-party websites.” Until February, many of the state’s
medical marijuana operators relied on Leafly and another well-known e-commerce cannabis company — I Heart Jane — to help provide online shopping services for Florida patients. But many — if not all — operators canceled contracts with the e-commerce companies after receiving a Feb. 1 memo from the Department of Health threatening to impose $5,000 fines on those who continued to rely on the services. The memo said the services were prohibited under a 2017 law that set up a structure for the Florida cannabis industry. The law requires medical marijuana operators to control all aspects of the business from seed to sale — including cultivation, processing and dispensing of products — rather than allowing companies to handle individual components of the trade. “Contracting with Leafly.com, or any other third-party website, for services directly related to dispensing is a violation of this provision,” then-Department of Health Chief of Staff Courtney Coppola wrote in the February memo. Health off icials argued that the February memo reflected the agency’s application of the law to a particular set of facts and was not a rule. “The department has no duty to promulgate what is clear from the statutory language,” Department of Health general counsel Louise Wilhite-St. Laurent said during a September hearing in the case. The February memo “is a simple reiteration of the law,” she said. But Van Wyk disagreed.
The memo “does not merely reiterate the statute, but places a construction on the statute that is not readily apparent on its face. The statute does not address third-party websites or online ordering,” she wrote in Monday’s 25-page order. “The letter constitutes the department’s interpretation that online ordering is a service directly related to dispensation of medical marijuana; thus the letter implements the statute and prescribes policy. The letter has the direct and consistent effect of prohibiting the practice of MMTCs contracting with third-party websites for online ordering of medical marijuana,” she added, using an acronym for medical marijuana treatment centers, the state’s name for marijuana operators. Seann Frazier, a lawyer who represents Leafly, asked Van Wyk to determine whether the agency’s policy amounted to an invalid rule, which, under administrative law, is different from an unadopted rule. But Van Wyk said she lacked the authority to determine if the unadopted rule was valid or not. “Practically speaking, the department may simply discontinue reliance on the agency statement, rather than choosing to adopt the statement as a rule. In that case, a ruling on the validity of the statement as a rule would be advisory in nature,” she wrote. Leafly and similar sites allow patients to shop online, compare prices and view product availability at dispensaries. Patients can order products and be notified when their orders are completed, but customers
have to pick up and pay for items in person at dispensaries. MMTCs pay the e-commerce companies for marketing, advertising and ordering services on a subscription basis. Prior to the February memo, Leafly contracted with 277 medical marijuana retail locations throughout the state. After the letter, some of those dispensaries canceled their subscriptions and all have stopped doing online ordering, Leafly COO Ross Moulton said during last month’s hearing. Moulton estimated the loss to Leafly from the canceled contracts was at least $300,000. In Monday’s ruling, Van Wyk also rejected the state’s arguments that Leafly lacked standing to sue the health department because the company could not show the exact amount of economic harm it incurred after the letter was issued. Leafly “has sustained cancelation of real contracts,” she wrote. The administrative law judge also rejected the state’s contention that Leafly lacked standing to challenge the health department’s action because the company is not regulated by the state agency. Van Wyk acknowledged that the department does not directly regulate Leafly, the petitioner in the case. But the Feb. 1 letter “had the collateral effect of regulating the activities petitioner can engage in as a thirdparty operator of an online website and application-based resource for cannabis information,” she wrote.
PHONE PASSCODE POSES QUESTION FOR JUSTICES JIM SAUNDERS NEWS SERVICE OF FLORIDA TALLAHASSEE — When police responded in 2018 to a call about a shattered window at a home in Orange County, they found a black Samsung smartphone near the broken window. A woman in the home identified the phone as belonging to an ex-boyfriend, Johnathan David Garcia, who was later charged with crimes including aggravated stalking. But more than three years after the shattered window, the Florida Supreme Court is poised to hear arguments in the case and consider a decidedly 21st Century question: Should authorities be able to force Garcia to give them his passcode to the phone? Attorney General Ashley Moody’s office appealed to the Supreme Court last year after the 5th District Court of Appeal ruled that requiring Garcia to turn over the passcode would violate his constitutional right against being forced to provide self-incriminating information. The 5th District Court of Appeal decision conflicted with an earlier ruling by the 2nd District Court of Appeal in an unrelated case, teeing the issue up for the Supreme Court to resolve the dispute.
The case has drawn briefs from civilliberties and defense-attorney groups, who contend that Garcia’s rights under the U.S. Constitution’s 5th Amendment would be threatened if he is required to provide the passcode. But Moody’s office in a March brief warned of trouble for law enforcement if the Supreme Court sides with Garcia in an era when seemingly everybody has a cell phone. Police obtained a warrant to search Garcia’s phone but could not do so without a passcode. “Modern encryption has shifted the balance between criminals and law enforcement in favor of crime by allowing criminals to hide evidence in areas the state physically cannot access,” the brief said. “The Fifth Amendment should not be interpreted to now allow criminals to use it as a shield in ways never understood by the Framers.” But attorneys for Garcia in a June brief argued the case is about “which vision of the right against compelled self-incrimination prevails: those of the Founders who erred on the side of personal liberty or those who defend governmental powers to extract testimony.” “The state advocates gutting the Fifth Amendment for the sake of convenience,” Garcia’s attorneys wrote. “Compelling defendants to tell the government

their passcodes is a convenient way for the state to claw into the endless stores of personal information on a person’s smartphone. This unchecked power to sift through an unlimited digital record of the intricate details of a person’s life encourages the government to cast a wide net for its agents to fish for evidence of wrongdoing.” The Supreme Court is scheduled to hear arguments Nov. 3. Justice Jamie Grosshans was part of a panel of the 5th District Court of Appeal that ruled in Garcia’s favor in August 2020, about a month before she was appointed to the Supreme Court. Among the issues in the case is whether requiring Garcia to provide the passcode would be what is known as “testimonial” communication that would violate his rights against selfincrimination. An Orange County circuit judge issued an order for Garcia to turn over the passcode, but the order was overturned by the appeals court. “We agree with Garcia that the order under review requires that he utilize the contents of his mind and disclose specific information regarding the passcode that will likely lead to incriminating information that the state will then use against him at trial,” the appeals
court opinion said. “We therefore conclude that the compelled disclosure of his passcode is testimonial and is protected by the Fifth Amendment.” In the June brief, Garcia’s attorneys raised similar arguments. “If Garcia knows the passcode and can comply with the order, his testimony would confirm the state’s otherwise unproven assertion that he owns the phone and controlled it at the time of the incident,” the brief said. “The state will use that inference to tie Garcia to any incriminating data on the smartphone. The state is also relying on the ‘truthtelling’ element of the compelled testimony to prove Garcia’s knowledge of the passcode, and thus his prior possession and ownership of the smartphone.” But Moody’s office in the March brief disputed that requiring Garcia to give the passcode would amount to testimony. “At bottom, the state asks respondent (Garcia) not for testimony, but for access to a device it has a warrant to search,” the attorney general’s brief said. “Because the compelled act is not functionally different than requiring a defendant to unlock the door to a home or turn over the key to a lockbox, no testimony is involved. For that reason alone, respondent cannot refuse to disclose his passcode.”

JUDGE SET TO DECIDE ON SCHOOL MASK RULE RYAN DAILEY NEWS SERVICE OF FLORIDA TALLAHASSEE — An administrative law judge will have up to two weeks to issue a decision after a hearing ended Friday in a challenge by six school boards to a state Department of Health rule designed to prevent student mask requirements. The challenge was filed by school boards in Alachua, Broward, Duval, Miami-Dade, Orange and Leon counties, which are among eight boards facing state financial penalties after adopting policies that required students to wear masks to try to prevent the spread of COVID-19. The state’s crackdown on the school boards relied on the Sept. 22 emergency rule, which said decisions to opt out of mask requirements are at the “sole discretion” of parents or guardians. It replaced an Aug. 6 version of the rule that called for parents to be able to opt out of mask mandates but did not expressly prevent school districts from requiring doctors’ notes for exemptions. During a two-day hearing that started Thursday, Judge Brian Newman heard testimony from witnesses called by attorneys on both sides. Aileen Marty, an infectious-disease specialist and professor at Florida International University, testified for the school boards about the efficacy of masks in fighting the spread of COVID-19. “There’s no ifs, ands or buts about it, masks are a highly effective way of reducing transmission from a respiratory virus, and particularly one that is spread by aerosol as is the SARS-CoV-2 virus,” Marty said. The emergency rule is designed to carry out a July 30 executive order by Gov. Ron DeSantis that sought to prevent
mask requirements. It also came after some districts only allowed students to be exempt from mask mandates if they had documented medical reasons. Marty took aim at allowing parents to opt their children out of wearing masks in schools. “Under the circumstances that we were under, with the type of viral load we have, it is much better to have a mask mandate without a parental opt-out,” Marty said, adding that it is “much safer for the child” to leave decisions about opting out of mask requirements to medical professionals. The Sept. 22 rule also sought to give parents control over whether asymptomatic students go to school after being exposed to COVID-19, effectively preventing required quarantining of such students. Jacob Oliva, a senior chancellor for the state Department of Education, defended the rule during testimony Friday. He pointed to results from standardized tests given to students last school year in making the case against quarantining asymptomatic students. “When we analyzed those results, we saw a learning loss in every subject area that we tested for. It was most significant in the area of mathematics,” Oliva said. “And when we were able to break down the data and look at where students were learning, whether it was in-person … or a remote hybrid option, there was clear evidence in the 94 percent of students we tested statewide that the students that came to school and learned in-person in front of their teachers, learning loss was half of what it was for the distance-learning students.” Newman gave attorneys until next Friday to file proposed final orders laying out how they would like the judge to rule. He will have until Nov. 5 to issue an order.
GAS PRICES AT HIGHEST LEVEL SINCE 2014 NEWS SERVICE OF FLORIDA STAFF Florida gasoline prices went up 13 cents during the past week and are the highest they have been since October 2014, according to the AAA auto club. AAA said the average price for a gallon of regular unleaded gas was $3.31 on Sunday, up from about $3.18 a week earlier. Mark Jenkins, a AAA spokesman, said higher crude oil prices, driven by global demand and lack of production, have caused the spike. “What we pay at the pump is directly tied to the price of oil,” Jenkins said. “When oil prices increase, that makes the cost of producing gasoline that
much more expensive. Oil prices have surged recently, all due to concerns that the global supply of crude is not enough to meet demand.” Jenkins said higher gas prices are expected to continue the rest of the year, as oil is used for heating and electricity in parts of the country in the winter. The most-expensive gas in Florida is in the West Palm Beach, Fort Lauderdale and Port St. Lucie markets, while the cheapest gas can be found in the Pensacola, Jacksonville, Panama City and Punta Gorda markets. “Last year, we saw demand plummet because of the (COVID-19) pandemic,” Jenkins said. “People weren’t traveling as much, so there was an excess in oil supply. So, the U.S. and many other countries cut back on production levels. Now, we are starting to see that demand come back. Unfortunately, oil production has lagged behind.”
PROSECUTOR SEEKS TO CLEAR ‘GROVELAND FOUR’ NEWS SERVICE OF FLORIDA STAFF State Attorney William Gladson, whose circuit includes Lake County, filed a motion Monday to toss out convictions and indictments against African-American men known as the “Groveland Four” in one of the mostnotorious cases from Florida’s Jim Crow era. Gladson wrote that “even a casual review of the records” indicates Ernest Thomas, Samuel Shepherd, Charles Greenlee and Walter Irvin were deprived of fundamental due process. “The evidence strongly suggests that a sheriff, a judge, and prosecutor all but guaranteed guilty verdicts in this case,” Gladson wrote. “These officials, disguised as keepers of the peace and masquerading as ministers of justice, disregarded their oaths, and set in motion a series of events that forever destroyed these men, their families, and a community … I have not witnessed a more complete breakdown of the criminal justice system.” The investigation was referred to Gladson by the Florida Department of Law Enforcement, which in December 2018 was directed by former Attorney General

Thomas was killed by a posse in Madison County after the rape accusation. The three other men were beaten to coerce confessions before they were convicted by an all-white jury. Greenlee, at 16, was given a life sentence. Shepherd and Irvin, both U.S. Army veterans, were sentenced to death. Shepherd and Irvin were later shot, with Lake County Sheriff Willis McCall claiming the two handcuffed men tried to flee while being transported to a new trial that had been ordered by the U.S. Supreme Court due to adverse pretrial publicity. Shepherd died, preventing a retrial. Irvin survived but was retried and convicted. Then-Gov. Leroy Collins commuted Irvin’s sentence to life in prison. Irvin was paroled in 1968 and died a year later. Greenlee, released from prison in the early 1960s, died in 2012. The motion seeks to vacate the convictions of Greenlee and Irvin and dismiss the indictments against Thomas and Shepherd. The motion will go before Lake County Circuit Court Administrative Judge Heidi Davis.
