and acoustic musicians for events and concerts as well,” Bowers said. On Saturday, September 11, the Pensacola Vintage Collective will host an outdoor vintage market at Easy Going Gallery featuring racks of vintage clothing and accessories. There will also be bins of records to shop through inside the gallery. Easy Going Gallery is located at 701 North V Street. GULF WINDS DONATES $15,000 WORTH OF SUPPLIES FOR HURRICANE IDA RELIEF Gulf Winds Credit Union stands with our neighbors to the west in the aftermath of Hurricane Ida. Guided by the credit union philosophy of People Helping People, Gulf Winds provided $15,000 worth of supplies to the New Orleans community and our friends at OnPath Federal Credit Union. These items included 12 generators, 90 gallons of fuel, tarps, water, nonperishable food and other relief supplies that might be needed by those impacted by the storm. Team members Johan Boelig, Stephen Brown, Rex Burt, Jonathan Dubuc, Berry Ellis, Josh Hornsby and Daniel Malone banded together to ensure relief supplies made it safely to New Orleans. “Being a part of the Credit Union movement means so much to me personally,” said Jonathan Dubuc, VP of Strategic Management. “The mission of People Helping People is something that I try to live out on a day-to-day basis, and when the opportunity presented itself to put this mission to action, I was honored to be part of it. Being in a position to provide families in need with critical items meant the world to me.” The Gulf Winds volunteers took two vehicles and rented a moving truck to carry supplies for the three-and-a-halfhour trip. PENSACOLA BEACH EXPERIENCING LIFEGUARD SHORTAGE WITH SCHOOL IN-SESSION As students have returned to the classroom, so have many of the Pensacola Beach lifeguards, leaving Pensacola Beach with limited lifeguards between the months of September and May. Visitors of Pensacola Beach are encouraged to stay near the lifeguards while on the beach, especially in the areas that are most populated. “We plan to staff Casino Beach seven days a week from 9:30 a.m. through 6:30 p.m.,” said Pensacola Beach Water Safety Chief Dave Greenwood. “All sections of the beach are open, and I would not advise anyone to avoid any particular area. Just remember that the safest area to swim is with a lifeguard present.” Lifeguard shortages during the school

year are not uncommon at Pensacola Beach. Many of the Pensacola Beach lifeguards are either in high school, college or recently graduated. Once school is out of session, staffing on Pensacola Beach increases. “Staffing will increase again in May, once the school session has completed,” said Greenwood. As of Labor Day, Pensacola Beach lifeguards are no longer patrolling beaches owned by the Gulf Islands National Seashore, including Opal Beach in the Santa Rosa area, Langdon Beach in the Fort Pickens area and Johnson Beach in the Perdido Beach area. Swimmers are encouraged to swim at their own risk in those areas.

CAITLIN CERAME SELECTED AS NEW TRANSPORTATION PLANNER Caitlin Cerame has been selected as the new Transportation Planner for the City of Pensacola. In this role, Cerame will be responsible for developing and overseeing the City’s Complete Streets Program, which includes transportation planning for bicycles and pedestrians, street safety, lighting, urban design and more. Cerame joins the city from the Emerald Coast Regional Council, where she most recently served as a Planner III, responsible for bicycle and pedestrian planning assistance to three Transportation Planning Organizations in Northwest Florida. Her first day with the City of Pensacola is Tuesday, Sept. 7. Cerame said what interested her in the city’s Transportation Planner position was the opportunity to work on multimodal transportation and find ways to make the city a safer place for all users, whether it’s motorists, bicyclists or pedestrians. “I’m really excited to serve at the city,” Cerame said. “I’ve lived in the city for the past six and a half years, so it’s really a privilege to be selected for this role. I’m looking forward to building on the momentum the City of Pensacola has already started with multi-modal transportation.” Cerame has a master’s degree in urban and regional planning and a bachelor’s

degree in political science from the University of Florida, and she also holds the designation of American Institute of Certified Planners from the American Planning Association. She has several years of transportation planning experience in local government from both the Emerald Coast Regional Council and St. Johns County, where she has held a range of planner and program coordinator roles. Cerame also serves as a Director on the Florida Bicycle Association Board, a member of the Association of Pedestrian and Bicycle Professionals, and a certified League Cycling Instructor through the League of American Bicyclists. As the city’s Transportation Planner, Cerame will work under the direction of the City Engineer in the Public Works and Facilities Department to help plan and implement a wide range of programs to support multi-modal transportation in Pensacola. “Planning for all modes of transportation is so important for any city to thrive, and I’m excited to have Ciatlin’s planning expertise here at the City of Pensacola,” said Mayor Grover Robinson. “I look forward to having her on our team to help improve bicycle and pedestrian safety and provide new transportation opportunities throughout the city.”

JUDGE ISSUES INJUNCTION AGAINST PROTEST LAW DARA KAM NEWS SERVICE OF FLORIDA TALLAHASSEE — Calling it unconstitutionally “vague and overbroad,” Chief U.S. District Judge Mark Walker on Thursday blocked a controversial state law that enhances penalties and creates new crimes in protests that turn violent. Gov. Ron DeSantis championed the measure after nationwide protests focused on racial justice following the death last year of George Floyd, a Black man who was killed by a Minneapolis police officer. The Dream Defenders, the Florida State Conference of the NAACP and other organizations alleged in a lawsuit that the law, approved by Republican legislators and signed by DeSantis this spring, is unconstitutionally vague, has a “chilling” effect on First Amendment rights and gives police too much power. In a 90-page order Thursday, Walker, who has frequently clashed with the DeSantis administration and the GOP-controlled Legislature, granted the plaintiffs’ request for a preliminary injunction blocking DeSantis and three sheriffs from enforcing the law. Walker’s ruling went into effect immediately. The sheriffs had been named as defendants. “Though plaintiffs claim that they and their members fear that it (the law) will be used against them based on the color of their skin or the messages that they express, its vagueness permits those in power to weaponize its enforcement against any group who wishes to express any message that the government disapproves of,” Walker wrote. “Thus, while there may be some Floridians who welcome the chilling effect that this law has on the plaintiffs in this case, depending on who is in power, next time it could be their ox being gored.”

The case focuses in large part on a section of the law that creates a new definition of “riot.” Walker found that the definition “both fails to put Floridians of ordinary intelligence on notice of what acts it criminalizes and encourages arbitrary and discriminatory enforcement, making this provision vague to the point of unconstitutionality.” DeSantis made the “Combating Public Disorder” law one of his chief priorities for the legislative session that ended in April. The importance of the legislation, strongly endorsed by House Speaker Chris Sprowls and Senate President Wilton Simpson, was illustrated by the measure’s designation as “HB 1.” The governor, a Harvard Law School graduate, on Thursday told reporters he anticipates Walker’s ruling will be overturned by the Atlanta-based 11th U.S. Circuit Court of Appeals. “I guarantee you we will win that on appeal,” DeSantis said, adding, “just like we won almost anything out of Tallahassee on appeal, that’s just kind of the way the cookie crumbles.” But the plaintiffs lauded Walker’s decision, saying in a prepared statement that the ruling will “greatly contribute to the safety of Black organizers” and others affected by the “unjust law.” The law “effectively criminalizes our constitutional right to peacefully protest and puts anyone — particularly Black people demonstrating against police violence — at risk of unlawful arrest, injury, and even death. This targeting of protesters is shameful and directly contradicts our Constitution,” the statement said. Walker’s lengthy ruling shot down arguments made by DeSantis’ lawyers, who maintained in a June 2 motion that the lawsuit is based on “unfounded, misleading,

and conclusory allegations of constitutional violations.” In addition to DeSantis, the lawsuit named as defendants the sheriffs in Jacksonville and Broward and Leon counties, where the plaintiffs organize protests. Much of Walker’s decision centered on the new definition of riot, which the chief judge last month ordered lawyers to diagram grammatically. “A person commits a riot if he or she willfully participates in a violent public disturbance involving an assembly of three or more persons, acting with a common intent to assist each other in violent and disorderly conduct, resulting in: (a) Injury to another person; (b) Damage to property; or (c) Imminent danger of injury to another person or damage to property,” the law says. The law makes it a third-degree felony for anyone “found guilty of a riot, or inciting or encouraging a riot.” People arrested for violations of the anti-rioting provision must be held without bail until their first appearance before a judge. The definition of riot “through its ambiguity, chills speech and eviscerates that essential breathing space,” Walker wrote Thursday. “The law is overbroad. Accordingly, I conclude that plaintiffs have established a substantial likelihood of success on the merits as to their overbreadth claim,” he added. Plaintiffs argued that the law puts peaceful protesters at risk of being arrested for the actions of counter-protesters or attendees who turn violent. Walker agreed. “If this court does not enjoin the statute’s enforcement, the lawless actions of a few rogue individuals could effectively criminalize the protected speech of hundreds, if not thousands, of law-abiding Floridians,” he wrote. The chief judge also made clear that his

decision does not stop DeSantis and the three sheriffs from quelling unrest. “An injunction preventing the defendants from using the new definition of ‘riot’ does not prevent them from suppressing riots; rather they merely cannot employ the new definition of a riot, and must rely instead on the common-law definition, as they have in the past,” Walker wrote, adding that the defendants “may still protect private property and public safety using the numerous tools at their disposal.” In the introduction to his 90-page ruling, Walker laid out a brief history of civil-rights leaders’ desegregation efforts in the late 1950s and early 1960s. In 1956, two Florida A&M University students, Wilhelmina Jakes and Carrie Patterson, were arrested for “inciting a riot” after they sat in the “whites-only” section of a city bus in Tallahassee, Walker noted. Five years later, nine clergy members were arrested for their involvement in trying to force a restaurant to serve Black customers, the judge said. Florida’s anti-riot laws at the time “were used to suppress activities threatening the state’s Jim Crow status quo,” he wrote. The judge returned to the history lesson in his conclusion to Thursday’s decision. “Though what’s past is prologue, this court need not give it any power beyond providing context for the case before it now. A critical part of that context … is that following Ms. Jakes’, Ms. Patterson’s, and the 1961 Freedom Riders’ arrests under Florida’s anti-riot laws, the rule of law ultimately prevailed,” Walker wrote. “And so too, with this court, the rule of law prevails.” — News Service staff writer Jim Turner contributed to this report.

DESANTIS PLEDGES TO FIGHT FEDERAL, LOCAL VACCINATION MANDATES JIM TURNER NEWS SERVICE OF FLORIDA TALLAHASSEE — Gov. Ron DeSantis said Monday that Florida will fight local and federal COVID-19 vaccination mandates for public and private workers, warning that such requirements will have a “huge impact” on public safety. Appearing in Alachua County with two Republican state Cabinet members and individuals espousing anti-vaccination theories, DeSantis said that vaccination requirements would force “into destitution” first responders who worked for more than a year protecting people amid the coronavirus pandemic. “These mandates are overreaches and they will be very destructive for a lot of really, really good people,” DeSantis said during Monday’s event at the Clark Plantation in Newberry. The event focused on a vaccination requirement adopted by the Gainesville city commission as well as directives issued by President Joe Biden requiring vaccinations for some public and private employees. DeSantis suggested he could combat the local vaccination requirements through a new state law that gives him the power to invalidate local emergency measures adopted in response to public health disasters. The law includes fines of up to $5,000 per violation. Under DeSantis’ leadership, the state has used the law to contest “vaccine passport” requirements for cruise ship passengers and to fight local school districts’ mask requirements for students. “We’re going to be helping out here with

the government issue, with our authority that we have, but then also with the Biden mandate,” DeSantis added. “You know, it’s beyond just the mandate. What they’ve been doing throughout all of COVID, they go back and find some statute from decades ago, they find some obscure regulation, and then they take that as a pretext to be able to do ridiculous, unforeseen expansions of government power.” DeSantis, who said people shouldn’t be “coerced” into taking the vaccination, was joined by several city and county workers who alleged that the COVID-19 vaccine “changes your RNA” and complained that they were being forced into a “fate that will be far worse than contracting and recovering from” the virus. The federal Centers for Disease Control and Prevention disputes such claims. DeSantis, who last week brushed off speculation he’s setting up the groundwork for a 2024 White House run as “nonsense,” also was flanked by Attorney General Ashley Moody and Chief Financial Officer Jimmy Patronis at Monday’s event, which was announced by the governor’s office but had overtones of a campaign rally. including police and firefighters — have filed a lawsuit alleging the vaccination mandate violates the state’s prohibition against so-called vaccine passports. Moody filed a brief Monday in support of Gainesville workers challenging the mandate. “We’ve seen a lot of egregious examples where politicians across our country thought they had a lot more power than they actually did, locking people in their homes, keeping them from participating in religious ceremonies and worship. Unacceptable,” Moody said Monday. “They did not have the power. Courts agreed with that. And now you have city officials saying they’re going to fire employees if they don’t take a vaccine. It is unlawful. It is directly contradicting Florida law.” But Leon County Administrator Vincent Long pushed back Monday afternoon, saying “political rhetoric continues to dangerously exacerbate the fear and confusion” surrounding vaccinations. “In a public health emergency, clarity of information remains critical,” Long said in a prepared statement. “This is why it is necessary that I clarify that vaccinations as a condition of employment in Leon County is legal and will remain in effect. We will continue to act responsibly to ensure our operational readiness to respond to the needs of our community and to keep our employees safe.” According to the Florida Department of Health, the virus has claimed the lives of nearly 49,000 Floridians since March 2020, with 2,448 deaths added last week. Miami Beach Mayor Dan Gelber, whose city is requiring vaccinations against

COVID-19 for all new employees, also questioned DeSantis’ stand. “What state is he governor of? Because Florida is currently leading the nation in average daily COVID deaths and his response is to spread vaccine conspiracies to guarantee we keep our #1 ranking. God save us,” Gelber tweeted. On Friday, Biden expressed disappointment in DeSantis and other Republican governors who have criticized White House directives requiring COVID-19 vaccinations and tests for large numbers of public and private workers, including certain education workers. “Look, I am so disappointed that particularly some Republican governors have been so cavalier with the health of these kids, so cavalier with the health of their communities,” Biden said. “We’re playing for real here. This isn’t a game.” Biden’s plan, in part, will require vaccinations for workers at health facilities that are part of the Medicare and Medicaid programs, executive branch workers and contractors doing business with the federal government. Biden also is directing the Department of Labor’s Occupational Safety and Health Administration to develop a rule requiring vaccinations or weekly tests for people at all employers with 100 or more workers. But Patronis said Monday the vaccination requirements are being issued by “the same people that brought us Obamacare.” “So, let’s recognize this is nothing more than big government health care part 2.0,” he added.

TALLAHASSEE — Florida universities on Monday heralded their advancement in a national ranking of public universities, but none celebrated harder than the University of Florida after cracking the top five on U.S. News & World Report’s “Best Colleges” for the first time. The Florida school landed in fifth place, in a three-way tie with the University of California, Santa Barbara and the University of North Carolina at Chapel Hill. The annual grades lend prestige to schools that achieve top placement. Appearing at UF Monday morning, Gov. Ron DeSantis called it an “historic day” and said the university’s rise is good for the state. “I am just proud of our state. I think we are doing a lot of stuff, across the board, well. A lot of people obviously want to come here, but to have a top five university really makes a difference,” DeSantis, flanked by state and university leaders, told reporters during a press conference Monday. The school has risen nine spots on the chart since 2017, an ascension that has been “generations in the making,” University President Kent Fuchs said during Monday’s event. “This remarkable milestone was achieved because of the shared commitment of the state of Florida and the University of Florida community, and the focused efforts of many who came before our time,” Fuchs said. University of Florida student Roshawn Reid said the ranking bolsters the value of his and other students’ degrees. “For students, I can tell you this means a lot. Our educational experience will be enhanced, our degrees will be even more valuable, it will open even more doors for us when we graduate and begin our job searches and it will create even greater opportunities for us throughout our careers,” Reid said during the university’s Monday press conference. Florida State University, which in 2019 celebrated a jump to 18th in the annual ranking of public universities, held steady in 2022 after falling to No. 19 last year. FSU President Richard McCullough, who took the helm in August, said in a video address Monday that remaining in the top 20 public universities is “a reflection of FSU’s academic excellence and our ongoing commitment to student success.” Other Florida universities that ranked farther down on the annual list

touted the rate at which the schools are advancing. The rankings are based on numerous factors, such as graduation rates, student retention, graduates’ debt and student-faculty ratio. With a rank of 46, the University of South Florida billed itself as “America’s fastest-rising” university. The school has risen 48 spots on the U.S. News chart over the past decade. “USF is proud to maintain its momentum as the fastest-rising university in America, public or private, over the last decade and a top 50 university,” USF Interim President Rhea Law said in a prepared statement Monday. Continuing the trend of Florida schools climbing the ranks, the University of Central Florida clocked in at 67th among public universities. In a news release, UCF said its jump of 10 places puts it in a special group as “one of only three universities to improve its national ranking each of the last six years.” Florida A&M University saw a marked increase in rank among public universities after assuming 2022’s No. 104 spot, which is the highest of the state’s historically Black colleges and universities. “Moving up 13 places is a testament to our focus on student success and the dedication of our faculty, staff and students to the tenets of our strategic plan, FAMU Rising,” FAMU President Larry Robinson said in a statement. Several Florida universities also received high marks in a category of rankings that recognizes schools that offer “social mobility” to students. U.S. News gauges universities’ success in “enrolling and graduating large proportions of disadvantaged students” who receive need-based financial assistance to determine social-mobility rankings, according to its website. Fort Lauderdale-based Keiser University, a private school, ranked fifth in the nation for universities promoting social mobility, with Florida International University coming in at No. 6 and Florida A&M University at No. 13. “Keiser University is dedicated to providing access and opportunity to a diverse population of students and we’re pleased to include this goal in our commitment to student success,” University Chancellor Arthur Keiser said in a statement. Syd Kitson, chairman of the State University System Board of Governors, said that Florida universities benefit from each others’ success. “The 12 universities have really come together as a system. They make each other better working together, and that is exactly what they are doing,” Kitson said.

PLAN CALLS FOR LIMITED ANNUAL HARVEST OF GOLIATH GROUPER NEWS SERVICE OF FLORIDA STAFF Three decades after being placed on a list prohibiting the harvest and possession of goliath grouper, the Florida Fish and Wildlife Conservation commission is considering a plan to allow a limited number of the fish to be harvested in state waters. The commission on Oct. 6 will consider a proposal to allow up to 200 fishing permits a year for goliath grouper. “Currently, access to the goliath resource is provided through catch-andrelease fishing and diving ecotourism opportunities, but requests to reopen harvest have increased in recent years as the population rebuilds,” Jessica McCawley, director of the commission’s Division of Marine Fisheries Management, advised commissioners in a memo in advance of next month’s meeting. Under the proposal, applicants for the “limited, highly regulated harvest” starting in 2023 would have to pay $10 to enter a lottery from which names would be drawn for $500 fishing permits. The harvest would run annually from March 1 through May 31 in state waters outside of Southeast Florida, from Palm Beach County south through

the Atlantic coast of Monroe County. The fish are an ecotourist draw for dive operators in that region. Never listed as endangered, goliath grouper were removed from National Oceanic and Atmospheric Administration’s species of special concern list in 2006 and had their listing improved from “critically endangered” to “vulnerable” in 2018 by the independent International Union for the Conservation of Nature. Goliath grouper, which can grow to 800 pounds and more than 8 feet in length, had been harvested in state waters since the late 1800s. The largest goliath grouper caught in Florida waters was a 680-pound fish caught off Fernandina Beach in 1961. Aside from overfishing, the species is susceptible to large-scale mortality events such as cold temperatures and red tide blooms. “This proposal will allow users additional access opportunities, protect areas of heavy dive ecotourism, and provide researchers with needed biological data while allowing the population to continue to rebuild,” McCawley wrote. “This approach would allow FWC to continue to manage this fishery for a diversity of values and recognize goliath’s important role in the ecosystem.”

TALLAHASSEE — Saying plaintiffs have offered a “parade of horribles,” attorneys for the state want a federal judge to toss out a challenge to a new law that requires conducting surveys on Florida college and university campuses about “intellectual freedom and viewpoint diversity.” In a 34-page motion filed last week, the state fired back at arguments by faculty members, students and groups that the law (HB 233), passed in April by the Republican-controlled Legislature, violates free-speech rights and is ideologically driven. The motion said the plaintiffs’ allegations of a “violation of their free associational rights premised upon a parade of horribles arising from the provisions requiring colleges and universities to conduct surveys to measure intellectual freedom and viewpoint diversity on their campuses are… unshackled from the text of HB 233.” “Without knowing the content of any survey, how it will be administered, or how the results may be utilized in the future, plaintiffs foretell future injuries resulting from a hypothetical chain of contingencies that find no footing in the language of the statute they are challenging,” the motion said. “Of course, this is not how the constitutionality of a statute is determined.” Also, the motion disputed assertions that the law could lead to regulating speech of faculty members. “Quite simply, HB 233 does not dictate the subject matter of any syllabi or curriculum, nor cast a pall over any classroom,” the state’s attorneys wrote. “Instead HB 233 fosters the free exchange of ideas that is the hallmark of First Amendment protection.” The United Faculty of Florida union, the nonprofit group March for Our Lives Action Fund, four professors, a university lecturer and four students filed the lawsuit, which names as defendants Education Commissioner Richard Corcoran and members of the state university system’s Board of Governors and the State Board of Education. Chief U.S. District Judge Mark Walker, who is based in Tallahassee, is handling the case. Under the law, state universities and colleges will be required to conduct annual surveys. The law directs the Board of Governors and State Board of Education to each “select or create an objective, nonpartisan, and statisti-

cally valid survey to be used by each institution which considers the extent to which competing ideas and perspectives are presented and members of the college community, including students, faculty, and staff, feel free to express their beliefs and viewpoints on campus and in the classroom.” The law, which went into effect July 1, also said schools may not “shield” students and faculty members from “ideas and opinions that they may find uncomfortable, unwelcome, disagreeable or offensive.” The lawsuit argues, in part, that the measure was approved by Gov. Ron DeSantis and Republican lawmakers “to target and chill certain viewpoints with which its proponents disagree.” “While it may purport to protect and advance intellectual freedom and viewpoint diversity on Florida’s public college and university campuses, its reality — and its intention — is the exact opposite,” the lawsuit said. “Without regard for the First Amendment, the law permits the state to collect the private political beliefs of students and compels faculty both to espouse and promote views they do not share and carefully consider whether and how to discuss views that they do.” Also, it contends that the surveys could lead to negative consequences if state leaders don’t like the results. “It was passed with the intent to suppress liberal and progressive views and associations on Florida’s public post-secondary campuses by creating a hostile environment for those views on virtually every level, up to and including sanctioning vindictive litigation and targeting them for harassment and budget cuts,” the lawsuit said. But the motion to dismiss said free speech will be bolstered by the part of the law that seeks to prevent attempts to “shield” people from ideas or opinions. “HB 233 does not compel any one — including plaintiffs — to utter or publish a single word,” said the state’s attorneys from the GrayRobinson law firm. “But it does prevent the government from taking action to silence First Amendment-protected expressions that others may find uncomfortable, unwelcome, disagreeable or offensive. The state may certainly choose to protect the freedom of expression through legislative efforts aligned with constitutional rights, understanding that leaders and issues may change but freedom of expression is perpetually essential and worthy of codification.”
