Client Testimonials I reached out to you during the most stressful time of life for both my loved ones and myself - horror had occurred to my dear loving mother. My mom had fractured her hip and due to her frail health and advanced age required risky hip replacement surgery. Many issues legal and otherwise arose which I could not personally resolve. You not only resolved each and every one, but you continue to do so now, over 4 years later. You always display extreme sincerity, compassion and friendship, using your vast experience and confidence in your ability, to continually bring satisfaction, positive results and a tremendous sense of relief and comfort to my loved ones and myself. You have gone out of your way to visit Mom on multiple occasions in her Nursing house and we love you for it. As an attorney, friend, and a great man, I could not possibly hope to know anyone more phenomenal. The three greatest men I have ever known are my dear departed father, my dear departed father-in-law and Ely Rosenzveig. – Jeff D.

I hired Ely to assist with my parents estate planning and it was a wise decision. He is a true expert in navigating through complex elder care law and procedures. His guidance was invaluable and his communication excellent. I would strongly recommend his services.

Two of Family Services of Westchester, Inc.’s (FSW’s) programs serving older adults, RideConnect and My Second Home, recently celebrated the contributions of their volunteers during Volunteer Appreciation Week at an event in Mt. Kisco. The RideConnect program provides rides and transportation referrals for older adults, the disabled and home health care workers in Westchester County. The program relies on volunteers who make it possible for these individuals to remain mobile and independent in their home communities. “Without our volunteers, residents throughout Westchester would have a very difficult time getting to doctor’s appointments, running errands, visiting with family members, attending religious services or going to the library,” said Karen Ganis, Director of RideConnect. “Our volunteers also help home health workers get to their clients which is truly a life saver.” RideConnect currently has over 60 volunteers. In the first three months of 2015 alone, the program provided nearly 2,500 rides and referrals. In 2014, the program provided over 12,000 rides and referrals. My Second Home, FSW’s award-winning adult day program in Mt. Kisco, also relies on volunteers to work with the program participants, most of whom have some type of cognitive impairment such as Alzheimer’s Disease. More than 20 volunteers currently support the My Second Home staff. In order to convey the important role of volunteers in both of these programs, it is helpful to hear directly from those who volunteer and those who benefit from the volunteer services. Patricia Jordan has been volunteering with RideConnect since 2012. "When I started volunteering with RideConnect three years ago,

my main objective was to help older people maintain their independence and remain in their own homes -- and how better to do that than to help them to remain active participants within the communities of which they are a part? What I didn't realize was how enriching the experience would be. I have met dozens of wonderful people who are so grateful for the help we at RideConnect are able to provide. What they don't realize is how grateful I am to them for allowing me to hear their stories, laugh with them and be even a small part of their lives. I've learned so much from these men and women!" Mary P., a RideConnect client who lives in Yorktown, echoes these sentiments. “I am so appreciative of the volunteers who give their time to drive me and others. What is most important to me is that I am now able to visit my husband at the NY Veterans Home in Montrose. I wish you could see his happy smile when he sees me. Essential doctor appointments are another great service. I thank you from the bottom of my heart for all of your good deeds." David Bubser, a volunteer who has been working for more than two years with adults who have concerns about their cognitive functioning in the Evening Edition program at My Second Home says, “Volunteering is a mutually satisfying situation – great for the taker and even greater for the giver.” Both the RideConnect and My Second Home programs are in need of additional volunteers. To learn more about these opportunities, please contact Karen Ganis at 914-864-0955 or KGanis@fsw.org regarding RideConnect or Margaret DeRose, 914241-0770 or MDerose@fsw.org regarding My Second Home.

Father’s Day is right around the corner. Boomers & Beyond can’t think of a better day for honoring the great men in our lives and acknowledging all of the ways they shaped and influenced us. in the Garden Part 3
Boomers & Beyond - Westchester June, 2015
Now that you've finally planned your garden to perfection, it's time to think about how much time and effort you want to put into it. While avid gardeners may want to spend all day with their sprouts, a low-maintenance plot can be fulfilling to both greenthumbs and novices alike - especially if you're looking to enjoy the other amenities available at a senior living community in your spare time. The first step is to find perennials that are hardier and more self-sufficient than other, more delicate flowers. Ferns and native wildflowers are particularly well-suited for this approach. If you choose to plant some shrubs, make sure they have enough room to fully grow - the publication recommends giving each plant eight feet of space. Scatter some woodchips between the sprouts and then layer the areas with mulch. The news source states that mulch can also be used as a way to prevent weed growth around trees. Once the shrubs have started to flourish, gardeners should plant bulbs that flower in the spring or fall to bring a nice pop of color in their plot!
Happy Gardening!

Wartburg hosts LeadingAge NY’s Leadership Academy Graduation PAGE 8
June, 2015
LeadingAge New York, the state’s premier association of aging services organizations, graduated 21 fellows from its prestigious, year-long Leadership Academy during a April 15 ceremony held at Wartburg, an award-winning senior services provider located in Mount Vernon, NY. The academy program provides a challenging learning environment – including assigned readings, discussions (called study circles), site visits and other activities – that enhances the leadership capacity of senior care professionals so they are better equipped to serve the aging-services field. The fellows, from across the state, visited Wartburg’s 34-acre campus to observe innovative programs in aging, an activity which is part of the Academy’s rigorous yearlong curriculum. To maximize their experience, Wartburg hosted a panel led by senior Wartburg staff, to discuss the various areas of senior care. The expert panel included Janet Palazzolo, Vice President of Residential Services and Corporate Compliance, Dorothea Bell, Executive
Vice President of Human Resources, Rev. Carol Fryer, Director of Pastoral Care, Paulette Watson, Director of Nursing, and Paula Ress, Administrator. “I am so pleased that Wartburg hosted the final leg of their year-long fellowship journey. This highly-regarded Academy will facilitate the development and growth of the next generation of senior living leaders in our state.” said David J. Gentner, President and CEO of Wartburg. “Wartburg was the perfect place to conclude our Leadership Academy series. Wartburg’s staff embody the values and mission of the organization, which is rich in history and service to others. The environment created an opportunity for the fellows to consider how best to balance the commitments of work and personal life, enhancing both.” said Diane Darbyshire, Senior Policy Analyst for LeadingAge and Leadership Academy Coach. LeadingAge NY represents not-for-profit, missiondriven and public continuing care providers, including nursing homes, senior housing, adult care facilities,
continuing care retirement communities, assisted living and community service providers. Founded in 1961, its 600 members employ 150,000 professionals serving more than 500,000 New Yorkers annually.
Wartburg Wartburg is an award-winning provider of comprehensive senior services, including independent living, assisted living, Alzheimer’s/dementia care, skilled nursing, rehabilitation and hospice care. Its 34-acre campus in Mount Vernon serves seniors and their families in Westchester and the New York Metro area. Wartburg’s nursing home has been recognized by U. S. News & World Report as one of the “Best Nursing Homes in New York State” in 2015, for the fifth consecutive year. Over the past few years, Wartburg has launched an ambitious building expansion program, including the Friedrichs Residence, with 61 independent living apartments, and a state-of-the-art rehabilitation and adult day services center, both opened in 2013.

Perfect Father’s Day gift ideas for your Baby Boomer dad Boomers & Beyond - Westchester June, 2015
PAGE 9
On the road again Older adults have time to travel. Send your Dad on a trip to his hometown. Better yet, go with him, or send the grandchildren. You might be able to use your own hotel points for lodging and airline points for travel. If your parent lives in a major city, a subway or bus card is a great gift. Why not send your dad on a tour to someplace he’s always dreamed of seeing? Didn’t he pack you and your siblings up in the Chevy and drive to the Grand Canyon? Tech savvy BlackBerry, iPhone and Android all offer gift certificates for apps. Maybe Dad is dying to play retro “Frogger” or the hot new “Angry Birds,” both available as apps. Of course, that’s when he’s not playing chess at the dining room table with his pal, that Walter Matthau-lookalike. Make sure Dad has good anti-virus and security software. Check with your own computer experts for the right system. Enhance the gift by overseeing the installation and cleaning up Dad’s system. Make it a malware free Father’s Day!
With people living longer these days and more and more baby boomers hitting retirement age, the infamous Father’s Day blue striped tie probably isn’t the right gift for your still quite active father.
Bring back memories Digitize family pictures and put them on Dad’s computer. Help him set up email and social networking with family members.
Sixty is the new 40, and 80 might as well be the new 60. That’s why Boomers & Beyond thinks Father’s Day gifts should be consumables, which can be eaten, used, spent, sipped or enjoyed. No dust catchers for later generations to sort, no hideous Necktie, or lame coffee mugs.
Here are some Father’s Day gifts for your baby boomer dad:
For the sportsman If your dad plays golf, what better gift than tee-times? Many public clubs offer gift certificates. Even if you are a duffer, why not line up a tee-time or two with dear old dad? If he belongs to a private club, consider purchasing cart rentals or other extras that don’t come with membership. For the avid spectator sportsman, check out special sports packages. Most cable companies offer individual games or game packages. If your dad can’t afford such premium sports channels, wouldn’t that be a great gift?

Great Father’s Day activities for dads and grandfathers PAGE 10

When we honor the dads and grandfathers in our lives on Father’s Day, let’s do more than hand over a gift at the dinner table. These great Father’s Day activity ideas will help get the guys and the kids doing something really memorable together.
Home improvement: Working together on a home-improvement project can be a fun — and productive — way to spend the weekend. Replant the garden, paint a room, or do whatever else needs doing. Kids love to lend a hand, and dads and grandpas can teach them a thing or two along the way.
Get outdoors: The beautiful weather may have the kids itching to get outside. So head out for the afternoon. We have tips for making the most of it. Consider hiking, fishing, kayaking and camping.
Go to a ballgame: It’s the perfect weekend for fathers and grandfathers to take the kids to the ballpark. And you don’t have to empty the wallet for major-league tickets. Consider local minor-league and college teams that provide all the thrills without all the expense.
Grill it up: Guys of every generation love to gather around the backyard grill, whether they are doing the cooking or having something char-grilled in their honor. Make it a family affair by getting the kids involved in the preparation and decoration.

Elder and Adult Family Mediation: A Solution for Family Conflict Boomers & Beyond - Westchester April, June,2015 2015
I met a neighbor of mine the other day who told me about the problem she is having with her sisters. Her mother is quite elderly and still living alone in her large home. My neighbor feels that this living arrangement is unsafe for her mother and the large house is a financial drain on the mother and the daughters. My neighbor is 78, her mother is 100, and her sisters are all in ) dis) their mid-late 70’s. These agreements among siblings are common and although these ages are certainly higher than the norm, those who are facing this situation at late stages in life are not as rare as one might think. People are living longer and, frequently, widowed seniors are re- marrying at later ages, creating complicated situation for the aging blended family. Many of us can remember our grandparents being cared for by nuclear and extended families. Unfortunately circumstances have changed. Many adult children no longer live close to home and many are working outside the home, making it more difficult to care for parents at home. Regardless of the reasons and circumstances, siblings often do not agree on the choices for the care of their parents. Frequent issues are safety, including suitable living arrangements and the ability to drive, finances, kind of care needed, and who will assume responsibility for the care. One option for resolving these differences that is becoming more popular is mediation. When the siblings can no longer discuss the problems or reach decisions, the participation of a neutral, third party can get the conversation * %$ is ) a &(% )) *that* going. Mediation process allows all the participants to arrive at their own solutions, resulting in a necessary plan of action.

Do you ever have difficulty hearing or understanding speech in restaurants? At parties or family gatherings? Do you feel that people are mumbling all the time? Is the volume on your television creeping up? Is telephone conversation sometimes difficult to understand? If you answered yes to any of these questions, there is a strong possibility that you may have some degree of hearing loss. It has been shown that if a hearing loss is present, a person has to struggle to hear speech. Undue stress is put on that individual. This stress can have a negative effect on a persons quality of life. It can cause that person to avoid many social situations. This, in turn, can cause that person to become more isolated. Over the past 15 years Westchester Audiology and Hearing Aid Specialist, P.C. has been helping people hear and communicate better by providing superior healthcare to their patients.

At B & M Capital Inc., we advise on the various financial benefits of selling or taking a loan against your life insurance policy either through a life settlement or an advanced benefit loan. When we speak to individuals or professionals at seminars and conferences, they are amazed to learn how old the life settlement industry, about 100 years, and how many financial institution own or invest in this type of business. Yet, the greatest misconception in educating potential clients and professionals is, who are the people that qualify for a life settlement or advanced benefit loan? The answer to all of them is anyone who has obtained the age of 65 or older. They must be of retirement age, not necessary retired. They can still be actively working; actually, some of these people are still active members in the work force.
The point that I am trying to get across is, today’s seniors are very different than what society shows us or what we perceive in our minds. Seniors, who are looking for other financial sources to find income or raise fund do not have to be hospitalized, terminally ill or destitute. There are many seniors who take advantage of our services that are in generally good health and financially sound. Here are some reasons why seniors take advantage of our services:
1. They are outliving their retirement funds due to the advancement in medicine, change in life style,
and the cost of living in the Northeast. Most seniors that live in the tri state area, enjoy being close to the greatest City in the world and do not want to leave. They have made friends, families, memories, and built a life that is unique to the Northeast. I know this to be true because; this is what I was told by my own parents, who were not born in this region.
2. Seniors are still very shrewd investors. Once I explain to seniors
how much value their life insurance contract could be possibly worth. They are quick to act. First we start with basic underwriting requirements and we submit the necessary paperwork. No cost to my client, a potential offer is then offered by a top-tier financial company. In a three to four week span, my clients are amazed on how easy and financially rewarding this type of transaction can be.
B & M Capital is a structured settlement company specializing in the purchasing of life insurance, annuities, structured settlements and offering Advanced Benefit Loans.

ATTORNEYS AT LAW Many Years of Experience Protecting the Legal Interests of the Elderly & Special Needs Populations
Why should I spend money hiring attorneys to do asset protection planning for me and my loved ones? Currently, the monthly cost for nursing home care in New York ranges between $10,000-$15,000, and properly certified home health attendants (nurse aides) can cost as much or more for round- the-clock home care. Statistically, it is likely that most people will need either or both of these care options as they grow older. It is critical that you plan appropriately to best minimize the strain that elder care costs may have on your estate, and to help put you in the best position possible to qualify for benefits that are largely covered by the government, under Medicare or Medicaid. Our firm has attorneys with extensive experience in developing tax-effective action plans for our clients that help protect their assets from government imposition. We have also been very successful in negotiating the complex bureaucratic minefield in which Medicaid is now mired. We have achieved remarkable results for our clients on a host of Medicaid related issues, from obtaining Medicaid approvals for coverage of home care and institutional care benefits, to very accommodative resolutions of Medicaid spousal recovery claims, where the office of Medicaid aggressively pursues the non-institutionalized (i.e., or “community”) spouse for Medicaid benefits provided.
Why should I have a lawyer prepare my will? If you die without a Will, the law, not you, determines how your assets are divided and to whom they are given. A poorly drafted Will may result in a sizeable chunk of your assets not ending up where you want them to go. We are an experienced law firm that can expertly craft your will to address your long-term care, tax, estate planning, and asset protection planning issues. It is in your best interest that planning be done properly so as to minimize the tax burden on your estate. Our experience and skill in the fields of Trusts, Wills, and Estates enables our firm to uniquely tailor estate planning to your individual needs. We will review your entire estate and draft a personalized plan that will best direct the disposition of your assets after death, whether through your Will, or by means of testamentary substitutes (trusts, joint-asset ownership with right of survivorship, or by beneficiary designation in life insurance policies, annuities, or individual retirement accounts).
My father is having difficulty caring for himself. I am afraid he will no longer be able to live on his own. I am worried about finding the money to pay for his care, whether he stays at home or moves to an assisted living facility or nursing home. What do I do? Your concerns are certainly daunting, and heart-rending. Our firm offers you a caring hand, an open ear, and uncompromising professional competence, and commitment. We will help find for you solutions that best suit your needs, using the latest tax, trust, and other asset protection strategies available under the law.
