Client Testimonials

I reached out to you during the most stressful time of life for both my loved ones and myself - horror had occurred to my dear loving mother. My mom had fractured her hip and due to her frail health and advanced age required risky hip replacement surgery. Many issues legal and otherwise arose which I could not personally resolve. You not only resolved each and every one, but you continue to do so now, over 4 years later.

You always display extreme sincerity, compassion and friendship, using your vast experience and confidence in your ability, to continually bring satisfaction, positive results and a tremendous sense of relief and comfort to my loved ones and myself.

You have gone out of your way to visit Mom on multiple occasions in her Nursing house and we love you for it. As an attorney, friend, and a great man, I could not possibly hope to know anyone more phenomenal. The three greatest men I have ever known are my dear departed father, my dear departed father-in-law and Ely Rosenzveig. – Jeff D.

I hired Ely to assist with my parents estate planning and it was a wise decision. He is a true expert in navigating through complex elder care law and procedures. His guidance was invaluable and his communication excellent. I would strongly recommend his services. – Tom C.

Get Ready for Grandparents Day 2017 – September 10

Every day can be Grandparents Day.

The official commemorative day is the Sunday after Labor Day. These resources can help with ideas on how to recognize, honor, and celebrate your granparents. Share Your Unique Story.

The age-old tradition of passing down stories and family experience is a great way to help young people get connected to the important history that precedes them. Coordinate a family project where young family members interview grandparents and older relatives. They could write down the stories they learned, draw pictures, make collages, or compose poems, songs or skits on their conversations with older adults. Share the final product with the entire family. Additional Resource: www.storiesbetweenus.com

Family Tree.

Bring children and older relatives together to document family history and ties. Talk about the need to continue learning about and documenting the family’s legacy. Explore how family members’ lives have changed from generation to generation. Compare current living conditions with those of your ancestors. How do today’s opportunities and challenges differ from the past? Visit PBS to make your own family tree: pbs.org/americanfamily/tree/

Preserve History for the Future.

Consider making a family time capsule. Together, you can decide what to place in your time capsule, such as favorite photos, tickets from a memorable show, newspaper clippings, and a list of popular songs from current day. Then, you can look forward to opening it in the future to see how your lives have changed. Not all time capsules have to be buried! Check out this website for ideas: http://farmersalmanac.com/home-garden/2011/10/17/making-afamily-time-capsule/

Cook Together.

Nothing brings family together like grandmother’s home-cooked comfort food. You and your grandchildren can pick your favorite recipes and get to work in the kitchen making a meal together. Create a family recipe book!

Plant a Tree.

Place the legacy of your grand relationship into the life of an ever growing tree, by planting one together. Learn how with this step-by-step guide http://tree-planting.com

Grandparents Day has both an official flower and song. The official flower is the forget-me-not, and the song is Johnny Prill’s “A Song for Grandma and Grandpa.” Both were chosen by the National Grandparents Day Council. Source:grandparentsday.org

Boomers & Beyond - Westchester

World Alzheimer's Month is the international campaign every September to raise awareness and challenge the stigma that surrounds dementia. World Alzheimer's Month was launched in 2012. World Alzheimer's Day is on 21 September each year.

2 out of every 3 people globally believe there is little or no understanding of dementia in their countries. The impact of World Alzheimer's Month is growing, but the stigmatisation and misinformation that surrounds dementia remains a global problem that requires global action. September 2017 will mark the 6th global World Alzheimer's Month, and will utilize the theme of 'Remember me' to highlight the importance of early detection and diagnosis of dementia.

In honor of World Alzheimer's Month, you can make a commitment to making a difference!

Somers Manor Rehabilitation & Nursing Center Earns 2017 Silver National Quality Award

Somers Manor Rehabilitation & Nursing Center has been recognized as a 2017 Silver – Achievement in Quality Award recipient by the American Health Care Association and National Center for Assisted Living (AHCA/NCAL). The award is the second of three distinctions possible through the AHCA/NCAL National Quality Award Program, which was established in 1996 and spotlights providers across the nation that have demonstrated their commitment to improving quality of care for residents and patients in long term and postacute care centers and communities. “We are honored to be recognized for what we’ve accomplished on our journey to improve the quality of care,” said Christine M. Maher, Administrator of Somers Manor. “The rigors of the application process for the Silver award has helped Somers Manor achieve better outcomes as an organization.” Based on the core values and criteria of the Baldrige Performance Excellence Program, which is also the foundation of the metric-based AHCA/NCAL Quality Initiative, AHCA/NCAL’s National Quality Award Program challenges member providers to achieve performance excellence through three progressive levels— Bronze, Silver, and Gold. At the Silver level, members develop and demonstrate effective approaches that help improve performance and health care outcomes.

September, 2017

“I am honored to recognize this year’s Silver award recipients for their dedication to delivering quality care,” said Alana Wolfe, Chair of the AHCA/NCAL National Quality Award Board of Overseers. “I applaud Somers Manor Rehabilitation & Nursing Center’s ability to effectively apply the Baldrige criteria to improve quality performance.” As a recipient of this year’s Silver award, Somers Manor can now advance in developing approaches that meet the criteria required for the Gold – Excellence in Quality Award. The awards will be presented to honorees during AHCA/NCAL’s 68th Annual Convention & Expo in Las Vegas, Nevada, October 15-18, 2017. More information on the program can be found on the Quality Award website.

Scams against Seniors PAGE 12

September, 2017

Seniors are often vulnerable to con artists who call them and try all sorts of tricks to steal their money. Never – never, ever – give anyone your personal information, such as your credit card number unless you initiated the call, perhaps to your bank or to a catalog company. The best way to protect yourself: hang up the phone. But if you suspect you received a fraudulent call, notify the county’s Department of Consumer Protection right away at (914) 995-2167. People who lead senior groups should be aware of Westchester County’s Senior Crime Busters initiative and request a presentation for their group about how to prevent scams and other important issues. Speakers who will come to your group include members of the county’s public safety and consumer protection departments as well as from the offices of the attorney general and the county district attorney. To reach Senior Crime Busters, call (914) 995-2190. Here is a partial listing of some scams against seniors that are currently making the rounds in Westchester.

Boomers & Beyond - Westchester

Health Care/Medicare/Health Insurance Fraud Every U.S. citizen or permanent resident over age 65 qualifies for Medicare, so there is rarely any need for anyone to research what private health insurance company older people have. In these types of scams, perpetrators pose as Medicare representatives and trick seniors into providing personal information to them. Scam artists use the personal information they collect to set up false identities (ID Theft) and to also bill Medicare for fake treatments and services that are never provided. The Pigeon Drop The con artist tells the individual that he/she has found a large sum of money and is willing to split it, if the Senior will make a “good faith”

payment to the con artist by withdrawing funds from his/her bank account. Often, a second con artist is involved, posing as a lawyer, banker, or some other trustworthy stranger.

The Relative or Grandchild Scam The con artist gets the victim to wire or send money on the pretext that the senior’s child, or grandchild or another relative is in jail or in the hospital and needs the money.

The Medical Alert Scam This scam seems to work through robo-calls where con artists tell seniors that they have been “approved” for medical alert equipment at no charge. They identify the business as “Senior Medical Alert” or “Senior Medical Advisors.” The con artists will then ask the seniors for their credit card numbers and use it to bill them every month for “monitoring services” they never receive. They also use scare tactics to induce consumers to respond to the offer warning of a “significant rise” in the number of senior citizens who delayed and as a result suffered death or serious life-threatening injuries.

Electric Service Companies Con Edison continues to deliver electricity to homes and apartments but because of deregulation, other socalled “energy service companies” can provide the power. Be wary of callers who quickly try to get you to switch providers.

Magazine Sales and Lottery Scams Magazine sales are offered with the proceeds going to fake charities. Lottery “Winners” can collect winning lottery amounts by first sending a finder’s fee. In addition, the Department of Consumer Protection describes other scams you should know about, particularly foreclosure scams, moving company scams and phishing scams.

Monthly Tips for Seniors 5 Autumn Safety Tips for Seniors

As autumn leaves start to fall and the air turns crisp, older adults face seasonal challenges to their health. The cold and flu season is just getting started, and there are other cold-weather threats to a senior’s health and safety that can be minimized by following a few basic guidelines. Get the flu vaccine. Seniors are especially at risk for complications from the flu, such as pneumonia, bronchitis and ear infections. The flu can also make any chronic health problems worse. There are two types of flu shots specially designed for seniors. Ask your health care provider which one would be best for you.

Be wary of tripping hazards. People generally experience stiffer joints in colder weather. Not only might it be a bit harder to move around, but it gets dark out early, the ground is often wet and fallen leaves create slipping hazards. Make sure leaves are cleared from sidewalks and driveways on your property and that all walkways are illuminated to reduce your chances of a fall.

Stay warm. As you get older, your risk of suffering hypothermia goes up. Dress in layered, loose-fitting clothing. Dress warmly and wear a hat when going outside. Keep your indoor temperature at a minimum of 68 degrees Fahrenheit.

Protect your skin. Indoor air becomes arid thanks to household heating systems. With age, our skin gets thinner and more prone to dryness and tears that can lead to infections. Stay hydrated by drinking plenty of fluids and eating soup. Using a humidifier indoors can go a long way toward putting some much-needed moisture back into the air. Also, make sure to help keep your skin from drying out with lotion or cream.

Eliminate fire risks. Check that electrical appliances like electrical blankets are in good condition without fraying cords. Space heaters are common sources of fires. Make sure they’re placed far away from flammable surfaces. Autumn is an excellent time to check the batteries in your smoke and carbon monoxide detectors. Also, be sure to have working fire extinguishers in the kitchen and near any fireplaces. Source:www.medicalalertsystem

ATTORNEYS AT LAW Many Years of Experience Protecting the Legal Interests of the Elderly & Special Needs Populations

Why should I spend money hiring attorneys to do asset protection planning for me and my loved ones?

Currently, the monthly cost for nursing home care in New York ranges between $10,000-$15,000, and properly certified home health attendants (nurse aides) can cost as much or more for round- the-clock home care. Statistically, it is likely that most people will need either or both of these care options as they grow older. It is critical that you plan appropriately to best minimize the strain that elder care costs may have on your estate, and to help put you in the best position possible to qualify for benefits that are largely covered by the government, under Medicare or Medicaid.

Our firm has attorneys with extensive experience in developing tax-effective action plans for our clients that help protect their assets from government imposition. We have also been very successful in negotiating the complex bureaucratic minefield in which Medicaid is now mired. We have achieved remarkable results for our clients on a host of Medicaid related issues, from obtaining Medicaid approvals for coverage of home care and institutional care benefits, to very accommodative resolutions of Medicaid spousal recovery claims, where the office of Medicaid aggressively pursues the non-institutionalized (i.e., or “community”) spouse for Medicaid benefits provided.

Why should I have a lawyer prepare my will?

If you die without a Will, the law, not you, determines how your assets are divided and to whom they are given. A poorly drafted Will may result in a sizeable chunk of your assets not ending up where you want them to go. We are an experienced law firm that can expertly craft your will to address your long-term care, tax, estate planning, and asset protection planning issues. It is in your best interest that planning be done properly so as to minimize the tax burden on your estate.

Our experience and skill in the fields of Trusts, Wills, and Estates enables our firm to uniquely tailor estate planning to your individual needs. We will review your entire estate and draft a personalized plan that will best direct the disposition of your assets after death, whether through your Will, or by means of testamentary substitutes (trusts, joint-asset ownership with right of survivorship, or by beneficiary designation in life insurance policies, annuities, or individual retirement accounts).

My father is having difficulty caring for himself. I am afraid he will no longer be able to live on his own. I am worried about finding the money to pay for his care, whether he stays at home or moves to an assisted living facility or nursing home. What do I do?

Your concerns are certainly daunting, and heart-rending. Our firm offers you a caring hand, an open ear, and uncompromising professional competence, and commitment. We will help find for you solutions that best suit your needs, using the latest tax, trust, and other asset protection strategies available under the law. The law firm of Ely J. Rosenzveig & Associates, P.C. practices in all aspects of elder law, including trust and estate planning, administration, and litigation, tax counsel, asset protection and special needs planning, Medicaid, Medicare, and Social Security disability benefits, guardianships, long term care planning, spousal recovery claims, and Medicaid lien resolutions.

Learning a new skill can slow cognitive aging

Active aging involves more than moving your body. You also need to move your brain. “When you exercise, you engage your muscles to help improve overall health,” says Dr. Ipsit Vahia, director of geriatric outpatient services for Harvard-affiliated McLean Hospital. “The same concept applies to the brain. You need to exercise it with new challenges to keep it healthy.” A fun way to do this is to sharpen your No. 2 pencils and go back to school. “New brain cell growth can happen even late into adulthood,” says Dr. Vahia. “The process of learning and acquiring new information and experiences, like through structured classes, can stimulate that process.” “The focus is not to earn a degree, or even take multiple classes, but to focus on a class to keep mental activity thriving,” says Dr. Vahia. It does not have to be a traditional academic course either, he adds. “It can be about learning new skills, like speaking a foreign language, learning how to paint, or to play a musical instrument. You can even study how to improve current ones like fixing a car or becoming more computer-savvy.” On a personal level, classes also keep your social skills sharp as well as boost self-confidence. “It is easy to become more socially isolated as people grow older,” says Dr. Vahia. “A class makes you interact and communicate with other people on a regular basis through group participation, conversations, and discussions.”

Time to enroll

Before you sign up for your first class, here are some guidelines to consider:

• Choose a subject you enjoy or are curious about. Astronomy? Civil War history? English literature? “Your choices are no longer dictated by the requirements to get a good grade and complete a degree, so you are free to pursue topics that spark your interest,” says Dr. Vahia. “What are you interested in now, or wish you had explored at an earlier time?”

• Not interested in traditional subject classes? Focus on one with a self-improvement angle, like public speaking or creative writing. • Begin with a weekly class, so you can ease into the environment and not feel overwhelmed.

• If you do not feel ready for a classroom setting, take an online class. “But make sure it offers some level of interaction with classmates through discussion boards,” says Dr. Vahia. • If your class does not meet your expectations, do not give up. Try a different type of class, format, or even instructor. Source:www.health.harvard.edu
