Client Testimonials I reached out to you during the most stressful time of life for both my loved ones and myself - horror had occurred to my dear loving mother. My mom had fractured her hip and due to her frail health and advanced age required risky hip replacement surgery. Many issues legal and otherwise arose which I could not personally resolve. You not only resolved each and every one, but you continue to do so now, over 4 years later. You always display extreme sincerity, compassion and friendship, using your vast experience and confidence in your ability, to continually bring satisfaction, positive results and a tremendous sense of relief and comfort to my loved ones and myself. You have gone out of your way to visit Mom on multiple occasions in her Nursing house and we love you for it. As an attorney, friend, and a great man, I could not possibly hope to know anyone more phenomenal. The three greatest men I have ever known are my dear departed father, my dear departed father-in-law and Ely Rosenzveig. – Jeff D.

I hired Ely to assist with my parents estate planning and it was a wise decision. He is a true expert in navigating through complex elder care law and procedures. His guidance was invaluable and his communication excellent. I would strongly recommend his services.

Myrna Merchant gives guidance to caregivers
“The Art of Caregiving,” a conference to address the emotional and physical challenges that caregivers face in caring for loved ones of all ages, did take place Thursday, Nov. 19, at New Rochelle Public Library, 1 Lawton Street. “Caregivers face enormous responsibilities,” Astorino said. “It is demanding work, but certainly rewarding. I want all caregivers to know that they are not alone in this journey, and that the county has various programs and events such as these to help support them along the way.” The event’s guest speakers was Alvin and Gwen Clayton, restaurateurs, caregivers and active community leaders. Participants also had access to free, one-on-one consultations with elder law attorneys, geriatric social workers and geriatric care managers. Westchester’s Telehealth Intervention Programs for Seniors (TIPS) was also be featured. Through TIPS, seniors can have

their vital signs monitored – including blood pressure, pulse, blood oxygen level and weight – and also make sure they are receiving all of the social services for which they may be eligible. Separately throughout the year, Westchester County offers two caregiver programs as part of its award-winning Livable Communities initiative. One is the “Caregiver Coaching” program, where volunteers are trained to provide one-on-one support to assist caregivers in making more informed decisions. The other is “Care Circles of Westchester: Step Forward and Give Back,” where a group of volunteers pitch in to assist an individual with the basic needs of daily living that cannot be met with public funds – such as walking the dog or simply providing companionship. Both programs will be discussed at the conference. Visit www.westchestergov.com/seniors to learn more.

The most festive time of the year is finally upon us: The Holidays! For some, this time of the year is all about gift-giving. Gifts come in many forms. The one the staff at Boomers & Beyond cherishes most every year is enjoying Holiday meals with our family and friends. After all, nothing brings a family together like a good meal. Keep in mind, this time of year can be difficult for elderly loved ones who might be living alone. They might find the holidays especially hard without the grandchildren running around the house with twinkling tree lights or a glowing menorah brightening the season. If you have an elderly loved one in your life, try to drop off holiday treats regularly, or share a home cooked meal together. You can even give the senior(s) in your life a gift and it doesn’t have to be expensive. These gifts can be as simple as a gift card to the grocery store, a new book, a magazine subscription, or a fruit basket. You could also give them a “coupon” book redeemable for helping them with chores around their house. The Holidays are a time for selfless giving and making sure you are grateful for what you have. Among other things, we are thankful to have all of you as readers. Our family would like to take this opportunity to wish yours a Happy Holiday and a Happy New Year! 8 signs your aging parent can’t live alone
1. Mom or Dad has always been a great housekeeper, but the house just doesn’t look like it used to: Ask your parent if help is needed with the clutter, but do it in a nonchalant way that could prompt a conversation indicating assistance is needed here. Keep a keen eye to discern if the clutter and filth is getting worse with each visit - it’s often a key sign.
Westchester 914-362-0899 New York 718-733-2222 Connecticut 203-914-9668
2. The checking account balance is wrong and bills are going unpaid: If the mail, with bills included, is piling up, there is a good chance that the bills are not getting paid. You may also discover that your parent’s checking account ledger balance is wrong or in arrears. These are also signs that your parent is having memory issues or difficulty with simple math cognition.
3. Your parent is losing a lot of weight: If the cupboard is bare and your parent’s frame is shrinking, living alone might become problematic. You may want to bring groceries or hire a service that offers prepared meal delivery. Otherwise, you may have to think about putting them somewhere that helps them eat regular, healthy meals.
4. They have forgotten the basics of hygiene: If you notice that your parent is wearing the same clothing day in and day out or that their hair or skin appears dirty on a fairly regular basis, they may have lost the motivation, ability and/or forethought to look after them self.
5. There are signs of forgetfulness in the home: All too often there are stories of older people who accidentally burned their houses down because they left a pot on the stove for hours and fell asleep or have flooded the home when they forgot to turn off the tap. Or, perhaps more subtly, the milk is in the pantry and the bread is in the refrigerator.
6. Your parent regularly misses appointments and other important items: Forgetfulness, absentmindedness and memory issues may also show up when it comes to keeping certain appointments, recognizing key dates, or, even more importantly, maintaining medication dosages on schedule.
7. Behaving Srangely: Between aging, mental degradation and the side effects from medication, your parent has lost their personalities and behavior has taken an odd turn for the worse. If you see signs of paranoia, fear, strange phone calls and conversations and nervousness, it’s a sign that living assistance is in order.
8. They exhibit signs of depression: A loss of interest in caring for one’s self as well as a lack of participation in socialization and in once-loved hobbies can mean that your parent needs treatment or should reside in an environment where they can be around other people.

5 anti-aging New Year’s resolutions PAGE 8
January, 2016
Boomers & Beyond - Westchester
The New Year means new starts, and that typically involves making New Year's resolutions. While the old-faithful standbys still exist, adults over the age of 65 can greatly benefit from making healthy resolutions – especially those that help prevent illness and injury.
Here are five New Year's resolutions that will keep you feeling young and vibrant.
Participate in cognitive health activities Mental health is an important aspect of health that we tend to overlook as we extol the benefits of staying physically fit. Keep your mind engaged and stimulated through a language class, book club or by playing brain games and trivia on the computer.
Exercise or start a new physical activity Older adults are increasingly looking to classes such as yoga and tai chi to not only increase physical health, but to meet people and widen their social circles. Other activities like local walking clubs can be found at many senior organizations and community centers. Eat more fresh foods Processed foods are easy to throw together for a meal, but they come with a host of health issues and concerns, and frankly, they're not worth the hassle.
Make a promise to eat more fresh, healthy fruits and vegetables and you'll see a noticeable difference in the way you look and feel – and it takes very little work on your end.
Make your home safer According to the Centers for Disease Control, one in three adults over the age of 65 falls each year. Tips like moving cords out of walkways, having good lighting near beds and taping down edges of carpet and rugs can help tremendously to decrease the number and severity of falls.
Schedule regular checkups Unfortunately, with age comes an increased risk of illness and other complications such as high blood pressure, osteoporosis and other medical conditions. Making sure that you schedule a regular annual checkup can help in early detection and prevention.

Concept:CARE ® provides specialized care that stands out from the rest
When Concept:CARE®’s president Carol Greenberg talks to clients, they often use the word unique to describe the respected home healthcare operation. “Everyone in the Concept:CARE® family finds gratification in how they assist each individual client…and that in itself is unique. We don’t just go the extra mile. We go the extra three miles.” That is obvious in everything Concept:CARE®, located in White Plains, does. Greenberg’s caring staff passionately treats its patients while working with their family to decide what is actually needed for that client to remain safely and comfortably in their own surroundings. Concept:CARE®’s operational and caregiving staff are some of the most highly regarded in the home healthcare industry. All direct caregivers who provide hands on services are insured, licensed and bonded. Potential Concept:CARE® team members go through a vigorous vetting and interview process. “We ask that our potential employee have a minimum of one year documented experience and provide 4 references to be kept on file.”
“We have high standards for the staff to meet,” said Greenberg, who has 50 years of healthcare administration experience. “Our staff treats patients like they are their own loved ones. We really get to know them.” Concept:CARE® is available 24 hours a day, 365 days per year. Clients and their families have access to registered nurses, client care coordinators and administrators. Together, Greenberg said, Concept:CARE® welcomes a patient and their family to be a part of the healthcare team. Concept:CARE®’s services are diverse and can assist in the discussion of: • Care/Case Management • Therapeutic Interventions • Nursing Facilities • Elder-Care/Long Term Housing: Senior Housing, Assisted Living • State Contract Affiliations: Office for the Aging, NYS Department of Health & Office of the Developmentally Disabled • Medicare, Medicaid, Third Party Insurance

• Long Term Care Insurance • Community Resource • Adult Day Care Programs Among other things, Concept:CARE® prides itself on the fact that specialized services are provided at competitive rates. Case management and initial nursing evaluations are services provided to Concept:CARE® client’s free of charge. Even if your needs are not within Concept:CARE®’s scope of practice, they will gladly assist you in finding other options at no charge, using its network of respected resources in the field. Yes, that certainly is unique, but there are so many other positive words you can use to describe Concept:CARE®. “We get so many compliments from patients and their families,” Greenberg said. “That is extremely gratifying. We take so much pride in providing collaborative healthcare to all of our patients. Everyone loves what they do at Concept:CARE® and this enables us to provide specialized and unique healthcare to all of our clients and their families.”

December and the holiday season is a favorite time of year for many people. Yet it can also cause stress as you try to find the perfect gift to get for your loved ones. For any of you that have travelers on your list, here are some suggestions that I think any traveler will love. Wishing you all a very happy holiday season!
Travel Notebook by Story Supply Co - $9.95 Even though we live in a digital age, I still love taking notes on paper. A nice notebook is an essential for me so I can take some notes about my travel observations. It also comes in handy for jotting down what exactly my dinner was so that when I am looking back through my pictures, I remember exactly which kind of pasta and what exact sauce I had that third night in Rome. Story Supply Co carries great pocket notebooks, and as a bonus, when you buy a pack, they donate a supply kit to a child. http://www.storysupplyco.com/collections/notebooks/products/ pocket-staple-notebook Bullet Pencil by Metal Shop - from $37.50 You’ll also need something to write all of your observations in your notebook with. Metal Shop is a local merchant that creates these cool bullet pencils. A pencil is great so you can erase any mistakes, and this one not only is a great writing instrument but it’s almost a better conversation starter. http://metalshopct.com/collections/bullet-pencils
Portable Battery Charger - $21.90 Of course, even though I still love writing with a pencil and paper, I love my iPhone and all of it’s handy apps. What I don’t always love is relying on the battery to last - there is nothing more disappointing than needing your phone to snap a picture of your travels only to find out that the battery is about to die. Instead of trying to find a handy electric outlet to plug in at, having a portable battery charger will let you recharge while you continue with your day. This model by Innogie is almost the same size as an iPhone so it won’t take up much room in your travel bag (or pocket!) http://www.amazon.com/Innogie-6600mah-External-Battery-Smartphones/dp/B00WU4NQT6/ref=sr_1_3?s=electronics&ie=UTF8&qid=1 448130632&sr=1-3&keywords=portable+charger
Travel Humidifier - $27.99 I find that, especially in the winter months, hotel rooms can have extremely dry air, which is incredibly uncomfortable. For those travelers who also suffer from this, Satechi makes a mini travel humidifier. It attaches to a bottle of water and is powered by usb for instant mist. http://www.amazon.com/gp/product/B00J3AX6PO/ref=pd_lpo_sbs_dp_ pa_2?pf_rd_p=1944687462&pf_rd_s=lpo-top-stripe-1&pf_rd_t=201&pf rd_i=B00CUQBD12&pf_rd_m=ATVPDKIKX0DER&pf_rd_r=1HB76 B7QJSMWC583A4DG
Universal USB Power Charger - $22.99 Most people have more than one electronic device that they travel with, and almost all can be powered by usb. It can sometimes be a challenge to find enough outlets in a hotel room, especially if you are traveling internationally. This charger by Moon Monkey has 6 usb ports so that you can charge your cell phones, tablet and portable battery charger at the same time and even have a port left over to run your travel humidifier. The other thing I love about this model is that it has interchangable plugs so that this one device will work in just about any country in the world. http://www.amazon.com/Moon-Monkey-Motorola-More--goodTravelling/dp/B00HVURUO6/ref=sr_1_1?s=electronics&ie=UTF8&qid =1448130524&sr=1-1&keywords=moon+monkey+usb+charger Noise Canceling Headphones - $299.95 Air travel is something that a lot of people dread but is a necessary part of a lot of travel plans. There are precautions that you can take to make it better, one of which is picking a seat location that you will be most comfortable in. Despite that, you don’t have any control of the people who sit around you and the noise that they may cause. However, you can be prepared for this by having a nice pair of noise-canceling headphones. I personally like this pair by Bose the best to block out the noises around me. https://www.bose.com/products/headphones/ over_ear_headphones/quietcomfort-25-acoustic-noisecancelling-headphones-apple-devices.html#v=qc25_black Pashmina Wrap You can’t go wrong with a classic pashmina wrap. Wear it as an accessory to dress up your traveling outfit and then once on the plane, you can use it as a blanket to sleep with. This one from Nordstrom comes in a variety of colors to suit just about anyone. http://shop.nordstrom.com/s/nordstrom-woolcashmere-wrap/4020371?origin=keywordsearchpersonalizedsort&contextualcategoryid= 0&fashionColor=Purple+Vintner&resultback=0
December’s tip: Are you traveling with gifts this
holiday season? Although you are allowed to travel with wrapped presents, if the TSA needs to check the gift for any reason, they will unwrap it to do so. It's much better if you are able to travel with unwrapped gifts and do the wrapping when you get to your destination.

Phelps Memorial Hospital Center achieves NICHE “Exemplar” status for its efforts to improve care for older adult patients
Phelps Memorial Hospital Center announces it has achieved "Exemplar" status for its NICHE (Nurses Improving Care for Healthsystem Elders) program. NICHE is designed to help nurses provide specialized care to patients age 65 and older. The "Exemplar" status recognizes Phelps’ ongoing, high-level dedication to providing the highest quality, most appropriate care to older adults. Phelps is one of only 10 hospitals in New York State to achieve this status. The highest of four possible program levels, the Exemplar status was attained following a rigorous evaluation of the hospital’s current NICHE program and its future goals for the program. The requirements include implementing the NICHE Geriatric Resource Nurse (GRN) model and evidence-based protocols on all applicable hospital units, including specialty units; applying aging-sensitive policies; incorporating input from patients, families and other healthcare providers in the development and execution of NICHE initiatives; and assuming regional and national leadership roles.
“The NICHE designation and the ‘Exemplar’ status signal our resolve to provide high-quality, patient-centered care for older adults,” said Cheryl Burke, MS, MBA, RN-BC, WCC, NICHE coordinator at Phelps. “Through our participation in the NICHE program, we are able to offer approaches that promote better outcomes, positive experiences, and improved care for our older patients. This leads to greater satisfaction rates for our patients, their families and our staff.”

Do you ever have difficulty hearing or understanding speech in restaurants? At parties or family gatherings? Do you feel that people are mumbling all the time? Is the volume on your television creeping up? Is telephone conversation sometimes difficult to understand? If you answered yes to any of these questions, there is a strong possibility that you may have some degree of hearing loss. It has been shown that if a hearing loss is present, a person has to struggle to hear speech. Undue stress is put on that individual. This stress can have a negative effect on a persons quality of life. It can cause that person to avoid many social situations. This, in turn, can cause that person to become more isolated. Over the past 15 years Westchester Audiology and Hearing Aid Specialist, P.C. has been helping people hear and communicate better by providing superior healthcare to their patients.

Astorino announces 2015 Senior Hall of Fame Inductees
provided
“The Senior Hall of Fame is a Westchester tradition that recognizes seniors who have generously given their time and talent to improve their home communities and the county at large,” Astorino said. “Their leadership has enhanced our quality of life, and we are fortunate to call them our friends and neighbors.” “This is especially true for this year's top honoree, Mayor Delfino,” Astorino added. “As a public servant for more than 30 years, he accomplished much for the people of Westchester County – including the revitalization of downtown White Plains. But more than that, he would never shy away from personally helping anyone. He showed respect and concern for all, and we are so pleased to recognize him with this award.” Four seniors will also receive Special Recognition this year: Mr. Thomas Basher, Tarrytown; Ms. Jo Falcone, White Plains; Mr. John Howard, Mount Vernon; and Ms. Pearl Quarles, New Rochelle. Three seniors in the “Class of 2015” are 90 years old or older, and their ranks also include one married couple. The Senior Hall of Fame is sponsored and presented by the
Westchester County Department of Seniors Programs and Services (DSPS); the Westchester County Department of Parks, Recreation and Conservation; and the Westchester Public/Private Partnership for Aging Services. United Hebrew of New Rochelle has also joined as sponsor. DSPS Commissioner Mae Carpenter said the achievements of the Hall of Fame honorees show the importance of people giving back to their communities and to each other. “The honorees show that age is never a deterrent to being a vital member of our society,” she said. “In fact, it’s an advantage because of the life experiences they bring with them. Their generous contributions have helped to make Westchester one of the most senior-friendly places in the world.” The Senior Hall of Fame began in 1983, which was also the 300th anniversary of Westchester County's founding. Its purpose was to showcase how seniors contributed to building the county, and more than 1,100 seniors have since been inducted. For more information, please visit www3.westchestergov.com

Currently, the monthly cost for nursing home care in New York ranges between $10,000-$15,000, and properly certified home health attendants (nurse aides) can cost as much or more for round- the-clock home care. Statistically, it is likely that most people will need either or both of these care options as they grow older. It is critical that you plan appropriately to best minimize the strain that elder care costs may have on your estate, and to help put you in the best position possible to qualify for benefits that are largely covered by the government, under Medicare or Medicaid. Our firm has attorneys with extensive experience in developing tax-effective action plans for our clients that help protect their assets from government imposition. We have also been very successful in negotiating the complex bureaucratic minefield in which Medicaid is now mired. We have achieved remarkable results for our clients on a host of Medicaid related issues, from obtaining Medicaid approvals for coverage of home care and institutional care benefits, to very accommodative resolutions of Medicaid spousal recovery claims, where the office of Medicaid aggressively pursues the non-institutionalized (i.e., or “community”) spouse for Medicaid benefits provided.
Why should I have a lawyer prepare my will? If you die without a Will, the law, not you, determines how your assets are divided and to whom they are given. A poorly drafted Will may result in a sizeable chunk of your assets not ending up where you want them to go. We are an experienced law firm that can expertly craft your will to address your long-term care, tax, estate planning, and asset protection planning issues. It is in your best interest that planning be done properly so as to minimize the tax burden on your estate. Our experience and skill in the fields of Trusts, Wills, and Estates enables our firm to uniquely tailor estate planning to your individual needs. We will review your entire estate and draft a personalized plan that will best direct the disposition of your assets after death, whether through your Will, or by means of testamentary substitutes (trusts, joint-asset ownership with right of survivorship, or by beneficiary designation in life insurance policies, annuities, or individual retirement accounts).
My father is having difficulty caring for himself. I am afraid he will no longer be able to live on his own. I am worried about finding the money to pay for his care, whether he stays at home or moves to an assisted living facility or nursing home. What do I do? Your concerns are certainly daunting, and heart-rending. Our firm offers you a caring hand, an open ear, and uncompromising professional competence, and commitment. We will help find for you solutions that best suit your needs, using the latest tax, trust, and other asset protection strategies available under the law.
