Wills, probate and inheritance
When someone dies, you will need to get the legal right to deal with their property, money and possessions, this is often referred to as their ‘estate’.
If someone has a Will, there will be one or more named executors who have to apply for a Grant of Probate. This means they can manage the estate and share out the property, money and possessions to the people named in the Will.
If there is no Will, a family member, civil partner or spouse can apply for Letters of Administration, which will give the same legal right as a Grant of Probate. If you need to apply for either of these, you can apply yourself or use a solicitor to do this.
