There are over two million people in prison in the United States, and while there is no scientific formula to figure out how many are actually innocent, it is believed to be anywhere from 2% to 10%. Even on the low end, that equates to tens of thousands of innocent men and women who have been wrongfully convicted. Hiring an investigator can be key to advancing a winning defense. Unfortunately, any kind of disconnect or delay in utilizing the services of an investigator can compromise that defense. Keep the following in mind.

First, Don’t Delay

Surveillance videos may be lost over time, potential witnesses move and memories fade. These are just three of the numerous reasons why an investigator should join the defense team as early as possible.

The investigator can then analyze the case as it develops, gathering information long before witnesses become tainted by rethinking what they may have witnessed. This normally happens after witnesses get together to discuss their stories and the facts get conflated. An experienced investigator will often memorialize witness accounts before an overzealous prosecution team taints their story and/or recollection. It’s not all that unusual for the prosecutor to manipulate naïve witnesses to modify their recollection of the relevant events.

Second, Choose Wisely and Make Sure They Are Licensed

In the past, a good majority of private licensed investigators had retired from a law enforcement career, however more recently there’s been a large increase in private investigators without that background. A good investigator must be an excellent listener, and be responsive, confident, persistent, trustworthy and creative. A critical thinker with a professional demeanor and strong problem-solving skills is ideal. Have they received advanced training or specialized certification in the industry?
