Understanding Workers’ Comp Benefits

W

hen you are injured on the job, Florida law provides for both lost wages and medical benefits. Whether you are eligible for a particular benefit will depend on a variety of factors. This column is intended to give a general overview of some of the available benefits. MEDICAL CARE: The Workers’ Compensation law requires the employer and their insurance carrier to provide medical care, so long as the need for the care is caused by the accident, is reasonable and medically necessary. The law also requires that the Major Contributing Cause of the need for the treatment be the industrial accident. TEMPORARY LOST WAGES: The law provides for the payment of lost wages if your authorized treating doctor says that you cannot work because of the injuries from the accident. The law also provides for the payment of lost wages if you have work restrictions which prevent you from going back to work, provided you have not reached your point of maximum recovery known as Maximum Medical Improvement.

as a former Workers’ Compensation Judge in Fort Pierce.

PERMANENT IMPAIRMENT BENEFITS: If your doctor decides that you have a Permanent Impairment Rating because of your injury, you will be entitled to Impairment Benefits. The number of weeks of benefits that you receive will be determined by the rating your doctor gives you. PERMANENT TOTAL DISABILITY BENEFITS: If your injury is severe and you cannot find work within a fifty-mile radius of your home, you may be entitled to ongoing benefits in this category. PAIN AND SUFFERING: Workers’ Compensation does not include payment for pain and suffering. This is the trade- off for a no- fault system which allows you to receive medical and lost wage benefits, even if your negligence caused or contributed to the occurrence of the accident. In my next column, I will provide more information about the receipt of medical care under the Workers’ Compensation law. Termite Swarming Season is Coming! Be Proactive!

s spring weather makes its way into March, termite mating season is around the corner, with winged termites taking flight. Warm temperatures and heavy rain triggers termite swarming behavior, infestations and new nests. New nests mean more termites and more destruction to any wood they may find including doors, baseboards, wood studs in the walls, fascia and soffit wood, and most importantly the wood rafters and beams supporting your roof. HELP! This Probate Is Taking Forever!!!

A

fter a loved one dies, their money and property must be distributed to the right people, either according to their Will or the “intestacy” laws. While most people want the settlement process to be done ASAP, probate can take between 18 and 24 months. Yes, you heard that right! There are many reasons why the probate process takes so long. Here are five of the most common: 1. Managing probate required paperwork can be a monumental undertaking with structured timelines and court-imposed deadlines. 2. Estates with numerous or complicated accounts or property simply take longer to probate, as there are more items to be accounted for and valued. 3. Most probate courts are dealing with high caseloads and limited staff. 4. Heirs, beneficiaries, or those who thought they’d be beneficiaries, can object to and challenge the Will’s instructions and legal requirements. While Florida law dictates a 3-month time period during which they must object, Will challenges can ultimately add years to the probate process. Some of the most common challenges include assertions that the Will-maker lacked the legal or mental ability to make a will, he or she was delusional, or that he or she was subject to undue influence or the victim of fraud. 5. The deceased person’s creditors must be notified of the deceased person’s passing and the probating of their estate so they have time to submit any legal claims for debts. orking in the mortgage field is a challenging profession. I deal with new situations every day. Every loan is different, just as every Angel Almendarez client is different. One thing, however, remains the same. From the first time homebuyer to the retiree looking at reverse mortgages, the buyer never seems to get enough information before they sign on the bottom line. Consider the first time homebuyer. How do you justify accumulating hundreds of thousands of dollars worth of debt with no insight into what the long term affects will be? Where Do Non-Profits Come From?

s the Director of a national non-profit organization, and Chief Operating Officer of Treasure Coast Communications & Marketing Inc, the question “How do I start a Non-Profit (501(c)3)?” comes up often. I respond to it by asking where or what perspective is the Non-Profit coming from? My response often causes the questioner to pause, and I can see the confusion starting to build. Starting a non-profit and understanding where the concept originates are two completely different things. Most people think that the root question for a person starting a non-profit is whether they want to generate revenue from their business, or how much business savvy they have acquired to leverage the launch of their concept. I would offer to you that the answer is neither of those things. My first question to a client seeking to establish a 501(c)3 would be – what are your dreams for your non-profit, or what do you believe the purpose of your non-profit would be? Over the 20 years that I have been in the non-profit arena, the clients that have a clear dream and purpose are the ones who have had the best rates of success. Those with a clear purpose and direction for their budding organizations have literally run circles around many MBAs and traditionally trained business majors. Not that those with a strong academic foundation cannot succeed as well, however a non-profit is not as much about revenue and rates of return as those with this type of foundation may think. I have worked with many clients who launched their non-

profits with only a fundamental understanding of accounting and the associated economics, but their passion for the mission of the nonprofit fueled their start-ups to a rapid ascension in their chosen arenas. Many of these clients would be considered “Dreamers” by traditional business standards; however, in my experience, if you do not have a dream or purpose for your organization, getting one should be your priority. n all levels of your initial registration and filing documents, you will be asked to explain the purpose of your organization multiple times. You will have to provide this information to incorporate your 501(c)3 in your state and to submit your application on the federal level you will be asked again. The IRS goes as far as requesting you chose a number code that identifies the purpose your non-profit is being created for. You will need to be able to explain the hows and whys of your organization’s mission and doing so successfully is best achieved if you have a real connection to and understanding of where the mission came from internally. By that I mean, what experiences or observations have been the catalyst for the drive you have to lead an organization with an outward-facing goal? For example, the horrible experience of a young girl who witnesses domestic violence in her household could be a powerful motivator for her to start a non-profit focused on helping young people who have experienced similar exposure. I provided consultation to a client who immigrated from the Caribbean and struggled academically due to his thick Caribbean accent. This client went on to excel in high school and college because of a speech therapist they were provided access to in 7th grade. That experience was the origin of the non-profit he launched to help students with similar challenges. These types of individuals and experiences are truly where nonprofits come from. If the title of this article caught your attention, you now have an answer to the question about the origins of non-profits. The next question is do you have an experience or life observation

“Is there a situation, circumstance, or subset of the population you would like to impact in a positive way?” that you would like to make the mission of an organization? Is there a situation, circumstance, or subset of the population you would like to impact in a positive way? If there is, then perhaps you are one of the “Dreamers” that have traditionally gone unnoticed. There are non-profits that exist to aid people, animals, organizations, domestic issues, global issues, the environment, the health field, and the list goes on. The world of 501(c)3s includes small non-profits that have local impact and extends all the way to large non-profits that have an impact globally. The purpose and mission affecting you personally may fall anywhere within this spectrum. Whether or not there is a motivation to start an organization that will change or improve a situation is a personal decision people must make. That does not change the answer to the question that is the title of this article. Where do non-profits come from? Non-profits come from people like you.

f you’ve ever experienced restless, painful, or itchy legs, you might have varicose veins. This condition is very common. Did you know more than 30 million Americans have varicose veins? Unfortunately, however, less than 10% of people seek treatment. I would like to provide some education on the condition to you. Varicose veins happen when the valves in leg veins no longer function, resulting in pooling blood in the legs. People often assume these blue, red, or flesh-colored veins are just a cosmetic nuisance or confuse them with spider veins. Some people also write them off as just a sign of getting older. The truth is that varicose veins may be related to a more serious medical condition called chronic venous insufficiency (CVI). Allowing CVI to continue to get worse can have some serious implications. In addition to causing leg pain and swelling, CVI can result in leg restlessness, skin damage, and even ulcers and open wounds in the leg. The longer the condition develops, the more likely it is for these symptoms to occur. Therefore it is better to treat varicose veins as soon as possible.

When we carry a hurt for a long time, we eventually find our identity in that hurt and become a victim. We may try to escape our pain by using drugs or alcohol. Or we may try to control all those around us with anger. The list goes on and on. We mourn over our past mistakes, and we even mourn over our loss of control. In the end God leads us to His comfort, if we just trust in Him. (Matthew Chapter 5) “Happy are those who mourn, for they shall be comforted”. • We mourn our past mistakes • We mourn our loss of control • We discover God’s pathway to comfort As long as we don’t get stuck in the mourning process, mourning can serve as the pathway to comfort and to the help and hope God has ready for us. God’s promise is “To all who mourn He will give beauty for ashes, joy instead of mourning, praise instead of despair. For the Lord has planted them like strong and graceful oaks for his own glory.” (Isaiah 61:3) I hope that we all realize there is HOPE no matter what the circumstances in God. Are walking on eggshells waiting for them to crack. Look around at all you are carrying. You are stronger than you think. It is time to make a change. Do you know what you want in life? Do you know what makes you happy? What are your goals? With all that you have been through, have you forgotten who you are and where you are going? Did you ever know in the first place? All I am saying is you have to have a direction to go and if you do not know who you are, the true you… you will never get there. What they have said does not define you. You define you. You create your own story. What are you telling yourself? I made a decision to turn on the light and off the sound, and so can you. It’s time for change.
