By Victoria Talbot At the request of Beverly Hills Mayor Julian Gold, Vice Mayor John Mirisch and Councilmember Lili Bosse, the City is revisiting the rules governing outside employment for executive employees. “I am dismayed by things that have occurred,” said Councilmember Nancy Krasne. “I would have put this on the agenda, too. We cannot have department heads put in a position of conflict of interest.” “One example that has received recent attention involved the Police Chief consulting for a business that, subsequent to engaging the Police Chief, provided security services to the Beverly Hills Unified School District. Other
examples include scuba diving instruction; teaching, including online course instruction to graduate students at local universities; and real estate broker,” wrote City Attorney Larry Wiener in the staff report for the agenda item. The current City ordinance follows California state law, Government Code Section 1126, permitting outside employment with approval by a supervisor. The City’s municipal code 2-5-212 states that outside employment approval shall be granted “by the employees department head and the director of human services,” annually. By Laura Coleman Roughly six months ago, a State of California Seismic Mitigation Program (SSMP) report identified 14 buildings of the Beverly Hills Unified School District that are seismically unsafe. Multiple experts have since told the BHUSD Board of Education that in the event of an earthquake above 3.5 on the Richter scale, depending on its epicenter, those 14 buildings are at risk of major structural damage including collapse. In that case, serious injury and even death can be expected. How and when to fund required repairs or replacement of buildings is now the question before the Board. Next Tuesday, the Board will vote whether to exercise the authority granted it by the voters to sell the remaining unsold $190 million of Measure E bonds. The 2008 vote author-
ized a total sale of $334 million of the bonds to fund the repair, reconstruction or replacement of seismically-impaired school buildings. The sale of the remaining unsold bonds is controversial because the BHUSD board in 2008 issued statements assuring Beverly Hills taxpayers that the rate they would pay on the bonds would not increase. If sold now, the tax rate will increase substantially although the actual dollar amount may or may not be significant depending upon the property and the taxpayer. The original tax rate projections assumed periodic sales of additional bonds over time as property values increased and generated additional revenue from the same rate. This Ordinance has been assessed in accordance with the authority and criteria contained in the California Environmental Quality Act (CEQA), the State CEQA Guidelines, and the environmental regulations of the City. The adoption and implementation of the Ordinance is eligible for a class 5 categorical exemption for minor changes in land use limitations and will not have a significant environmental impact. By Laura Coleman As of Wednesday morning, motorists driving into and from Beverly Hills on Wilshire Boulevard are no longer allowed to drive on five miles of concrete curbside lanes newly designated for Metro Rapid buses weekdays from 7-9 a.m. and 4-7 p.m. City spokesperson Therese Kosterman said Metro did not include Beverly Hills when the busonly lane was initially proposed. “The reason given at the time is that it was applying for a grant with a deadline that did not allow enough time to coordinate with Beverly Hills,” she said. At a press conference outside the La Brea Tar Pits at the Page Museum held Tuesday morning to announce the opening of Phase Two of Metro’s Wilshire Bus Rapid Transit (BRT) Project, Los Angeles Mayor and Metro Board Chair Eric Garcetti said motorists who don't abide the “Bus Only” signs now lining Wilshire would be warned for the first two weeks; after that, he said, peak-hour curb lane transgressors will be ticketed. RECOGNIZING EVERYONE WHO HAS SERVED–A Veteran’s Memorial that will form a base for the Henri Alfred Jacquemart Hunters and Hounds sculpture. Erected circa 1925, the sculpture serves as a memorial to the son of a Beverly Hills resident killed in the Battle of Chateau Thierry in 1917. The new base will feature five plaques representing every branch of the military and is designed by Beverly Gardens Park restoration landscape architect Mia Lehrer and Associates. City Designates Two New Landmarks – Kronish House and ‘Celluloid’ By Victoria Talbot On Tuesday, the Beverly Hills City Council gave final approval for landmark status to the 1954 Kronish House - the very home that prompted the City to create the Cultural Heritage Commission. In addition, the City also landmarked for inclusion in the Local Register of Historic Properties the monument entitled Celluloid by sculpture Merrell Gage, located at the confluence of Olympic Boulevard, South Beverly Drive and Beverwil Drive. The Kronish House, built in 1954 by world-renowned Master Architect Richard Neutra for Herbert Kronish and his family sat desolate and abandoned for a decade. On the brink of demolition, the Courier shone a light on its impending demise, prompting City residents and members of the preservation-

Beverly Hills City Council OK’s Smart Bikes, Pilot Bike Share Program By Victoria Talbot The Beverly Hills City Council voted Tuesday to implement a pilot bicycle-sharing program comprising 50 smart cycles. The City gave direction to expedite an agreement for the purchase of equipment, including smart bicycles, docking stations and information and sales kiosks. The concept was first introduced to City Council on Feb. 3, when Fehr & Peers Transportation Consultants were consulted to prepare feasibility studies and evaluate the City for ridership forecasts, infrastructure, sponsorship options, appropriate kiosk locations and bike racks. Then-Vice Mayor Gold requested that staff look into affordable; perhaps disposable bike helmets that could be purchased inexpensively near the kiosk location, as part of responsible
risk abatement. Tuesday, Councilmember Dr. Willie Brien requested that the bike share equipment request be expedited to accommodate extensive wait times. Bike sharing is an innovative public-private bicycle service that is currently in operation from Beijing to Paris. Notably, Bike-sharing is also available in Washington D.C. and New York City. The program invites potential users to join by signing up online with a smart phone app or computer, or at a kiosk or store location to buy a membership – if even for a day. Using a key or key card, the member can then unlock any bike at any station, use it for whatever time desired, and drop it back at the most convenient station. (see ‘PILOT BIKE SHARE’ page 18)
USC Competition To Create TV Show With Female Engineer Invites Applicants By Laura Coleman The first major television show with a female engineer lead character may soon be a reality thanks to the efforts of the USC Viterbi School of Engineering which has partnered with the National Academy of Engineering, along with Lee Zlotoff, the creator of MacGyver, to launch a global crowdsourcing competition to identify and develop to encourage women to envision themselves in this strong scientific role. “The idea is to change the popular culture about the role of engineering in
general and to dispel the idea that women should not enter into that field,” said Dean of the Viterbi School of Engineering Yannis C. Yortsos. “Our goal is to break down stereotypes and change perceptions.” Five winners will be awarded $5,000 each and paired with a successful Hollywood TV producer to take the concept to the next level. By Matt Lopez After months of claiming no illegal work was being done at the notorious Bel-Air megamansion 901 Strada Vecchia, Los Angeles Building and Safety officials reversed course this week and hammered the site over a multitude of new code violations. Los Angeles Department of Building & Safety Chief Inspector Luke Zamperini confirmed to The Courier that LADBS officials found additional code violations at the site during a walkthrough of the property Monday. An inspection of the site on Monday produced a list of 18 different types of unpermitted work that had been
done in violation of a previous stopwork order. That list included everything from the installation of new concrete decking, an accessory pool deck structure, new retaining walls, new stairways, electrical wiring, new heating and air ducts and much more. The inspection also uncovered 12 unapproved changes to the approved floor plan. 901 Strada Vecchia and its celebrity developer Mohamed Hadid have drawn the ire of Bel-Air residents for months after neighbor Joe Horacek, who lives below the property, worked tirelessly over the last year to get the (see ‘901 STRADA VECCHIA’ page 18)
BHPD Responds To Sgt. Brian Weir Lawsuits In Whitney Houston Case (CITY NEWS SERVICE) – A Beverly Hills police lieutenant who's the subject of two lawsuits alleging he wrongfully removed a sheet covering Whitney Houston's body says he rolled back part of the covering to examine whether the singer's skin peeled from being submerged in the hot water of her hotel bathtub. In a sworn declaration, Lt. Terry Nutall also denied saying “Damn, she's still looking good, huh?” as alleged in the lawsuits filed against him by a colleague, Sgt. Brian Weir. In his first lawsuit against the city in March 2014, Weir said he suffered a backlash within the department for reporting Nutall's alleged actions the night Houston was found dead at The
Beverly Hilton on Feb. 11, 2012. In the second complaint brought in December, he claims he suffered additional retaliation, including a denial of promotions. Houston was found submerged in a bathtub in her hotel room on the eve of the Grammy Awards. The coroner's office concluded the 48-yearold entertainer drowned accidentally, with heart disease and cocaine use listed as contributing factors. Weir's original suit alleges that Nutall knelt beside and leaned over Houston, removed the sheet covering her body and made remarks "to the effect and substance that (Houston) looked attractive for a woman (of) her age and current state." ur long-ago memory bank surfaces with collegiate Candice, a University of Penn student, dining with mom Frances Bergen, a Powers model, at 21 in New York. Seated nearby, we observed these two knockouts arriving. Heads swiveled as 21’s main dining room rocked, with one table of business gents raising whiskey glasses to two “glamorous” ladies.

day came when we interviewed Candice at Oscar’s, a Brit joint in West Hollywood, about her first fascinating memoir, Knock Wood, describing growing up in Hollywood with brother Chris and dad Edgar Bergen, the world’s most famous ventriloquist who gave us the wisecracking dummy Charlie McCarthy.

Last month, Beverly Hills hosted 450 real estate agents, brokers and owners from 26 countries for Christie’s International Real Estate conference.
The five-day conference examined the luxury lifestyle and branding that Christie’s represents in venues throughout the world. Christie’s has 135 offices
in 46 countries, and the global branding of Beverly Hills is synonymous with luxury. Attendees included Christie’s CEO Dan Conn; Dirk Boll, managing director of Christie’s Europe; Hugh Edmeades, auctioneer; and Tash Perrin, senior VP of Trusts, Estates and Wealth Management. Day One of the conference featured a tour, hosted by Hilton & Hyland of some of the Golden Triangle’s more luxurious homes, who paired with luxury car dealership O’Gara Beverly Hills to provide personalized luxury automotive accessories. Jeff Hyland, co-founder of Hilton & Hyland, is also the founding member of Christie’s International Real Estate, Inc. and an advisory board member. Crohn’s & Colitis Foundation To Honor Linda Howard, Lindsay Sloane And Mary Ann Mobley The Greater Los Angeles/Orange County Chapter of the Crohn’s & Colitis Foundation of America (CCFA) will hold its eighth annual Women of Distinction Luncheon, beginning at 11:45 a.m. (11 a.m. check in) on Thursday, May 14 at The Beverly Hilton. Recognizing successful career women who have demonstrated a commitment to philanthropy, this year’s event will honor Linda Howard, wedding planner and event consultant; Lindsay Sloane, senior VP of television at TriStar Productions; and the late Mary Ann Mobley, film, television and Broadway actress, philanthropist and former CCFA national spokesperson and board member. In spite of being diagnosed with Crohn’s disease in her 20s, Mobley went on to become a Golden Globe winner. St. John’s Doctor Pioneers Device, Procedure For Atrial Fibrillation Patients Shephal Doshi, M.D., director of cardio-electrophysiology at Providence St. John’s Health Center, became the first electrophysiologist in the nation to perform the WATCHMAN device implant following the FDA’s recent approval of the product. “This is another exciting milestone in cardiovascular services at St. John’s, further strengthening our reputation as a leader in this field,” said Marcel Loh, chief executive. Two patients, one who waited seven years, underwent the procedure. The WATCHMAN is designed for patients suffering from atrial fibrillation who are prescribed blood-thinner medications to guard against stroke and blood clots. A minimally invasive procedure, the tiny device is implanted via a thin tube into the left atrial appendage, the major source of blood clots in patients with afib. It is a self-expanding device with a metal frame that blocks the atrial appendage so should blood clots form, they can’t travel to other parts of the body and
cause a stroke. For more than eight years, Doshi has performed the procedure on hundreds of St. John’s patients during the clinical trials, and in 14 countries around the globe. More than 5 Dr. Shephal Doshi million Americans suffer an increased risk of stroke because of a-fib and at St. John’s alone, 200 are awaiting the WATCHMAN. “It’s common for patients on bloodthinning medications to be debilitated by fear of falling and suffering uncontrollable bleeding,” says Doshi. “Implantation of this device gets people active again, improving their overall health and wellness.“ Dr. Doshi is a member of a training team that will instruct Providence physicians and cardiologists across the nation on how to implant the WATCHMAN.

Common Air Pollutants Linked To Impairment Researchers at the Institute for the Developing Mind at Children’s Hospital Los Angeles (CHLA) and colleagues at Columbia University’s Center for Children’s Environmental Health have discovered a strong relationship between prenatal PAH exposure and disturbances in parts of the brain that support information processing and behavioral control. The study was published online by JAMA Psychiatry. Neurotoxic PAH (polycyclic aromatic hydrocarbons) are ubiquitous in the environment, the home and in the workplace. Emissions from motor vehicles, oil and coal burning for home heating or power generation, wildfires and agricultural burning, hazardous waste sites, tobacco smoke and charred foods are all sources of exposure. PAH readily crosses the placenta and affects an unborn child’s brain; earlier animal studies showed that prenatal exposure impaired the development of behavior, learning and memory. Scientists led by Bradley S. Peterson, M.D., director of the Institute for the Developing Mind at CHLA’s Saban Research, along with Virginia Rauh, ScD, and Frederica Perera, DrPH, Ph.D., from Columbia University’s Mailman School of Public Health, conducted a study of minority youth to test the effects on brain structure of PAH exposure during the final trimester of pregnancy. They used magnetic resonance imaging (MRI) to measure the brains of 40 children from a cohort of more than 600 mother-baby

pairs from minority communities in New York City. The Columbia researchers had previously reported that exposure to airborne PAH during gestation in this cohort was associated with multiple neurodevelopmental disturbances, including development delay by age 3, reduced verbal IQ at age 5, and symptoms of anxiety and depression at age 7. “This is the largest MRI study to date of how early life exposure to air pollutants, specifically PAH, effects the developing mind,” said Peterson, who is also a professor of pediatrics and psychiatry at USC’s Keck School of Medicine. “Our findings suggest that PAH are contributors to ADHD and other behavioral problems because of the pollutants’ disruptive effects on early brain development.” The study showed reductions in nearly the entire white matter surface of the brain’s left hemisphere—loss associated with slower processing of information during intelligence testing and more severe behavioral problems, including ADHD and aggression. Postnatal PAH exposure —measured at age 5—was found to contribute to additional disturbances in development of white matter in the dorsal prefrontal region of the brain, which is associated with concentration, reasoning, judgment, and problem-solving ability

On Coloring As Therapy, Peer Pressure Q. Dear Dr. Fran: My 9 year-old’s therapist wants him to color during therapy sessions. Is this wasting time and my hard-earned money? Sam Z. A. Dear Sam: Art therapy is an extremely respected form of psychotherapy and analysis. I utilize crayons and paper, large and small, by having children, families, and even adult couples draw and color as a tool to dig deep and get inside the minds of each individual patient. For instance, if it is a couple or family drawing, the way a person uses the space and whether they go into the boundaries lines of the other person’s territory on the paper may indicate control in the relationship. Also, specific color choices reveal psychological information to the therapist. For example, the color black indicates depression and deep sadness. Excessive use of the color red may indicate anger and rage (ie: fire). Clouds and raindrops might show sadness with tears. Bright, sunny yellow, pink, and green often reflect joy and a happy state of mind. Beware parents: Do not make the mistake of telling your kids to stop using black and red crayons. This will not erase internal emotional states. But rather, know that art is a viable pathway into understanding better what your child feeling on the inside.

parallels that of bullying in that it begins with a more aggressive child asserting pressure upon a more passive/submissive child to do something they don’t want to under pressure usually of threat. For example, the assertion may be “Everyone is trading toys...c’mon you have to give up your treasured toy in exchange for something else.” The big hidden secret that the leaders of peer-pressure force keep, is that at home and within their families they are over-controlled by one or both parents. They are angry so they go to school and expel their aggressive impulses by acting out the repetitive dynamic with their peers. For the victims, parents need to empower their kids to say no and hold strong even when they are the only ones doing so. They should also teach their kids to tell a teacher and get help. Virtually all schools today have a zero tolerance for bullying. Peer pressure can be a bit more subtle and hard for teachers and school staff to monitor. Most acts of peer pressure (as well as bullying) occur during non-supervised time including lunch, recess, and gym/PE. Schools need to step up teacher rotation during these less structured times to create a safer more secure environment for all children to thrive.

The Grove Dr. “The Art of David Labkovski” exhibit launches with a reception at 2 p.m., which will include a talk by Labkovski’s great-niece, local artist Leora Raikin. “This year as Yom HaShoah approaches, we have been given the extraordinary opportunity to share the creative work of Labkovski, who, for the greater part of his life, brought paint to canvas, charcoal to paper, to remember and remind us of lives lost, communities shattered, and survival and courage in facing the impossible,” said Samara Hutman, LAMOTH executive director . Labkovski, who was born in Vilna, in 1906, painted and sketched scenes of Jewish life in Vilna, the “Jerusalem of Lithuania,” before the Nazi occupation. In 1932 he moved to Moscow, where he worked as a designer at the Moscow State Yiddish Theater, and then went to study painting at the Leningrad Art Academy in 1935. After eight years in a Soviet labor camp in Siberia, Labkovski returned to Vilna to discover that the Jewish community there had been completely destroyed by the Nazi occupation. From 1946 to 1958, he remained in Vilna,
where he painted images of pre-war life. He opted to paint and sketch a realistic version of what he remembered; squalor, poverty, exaggerated facial expressions and sorrow are all present in his work. He also created images of the death and destruction he witnessed in the Soviet labor camp and painted and sketched scenes of the Nazi occupation as described to him by the Jewish survivors. In 1958, Labkovski and his wife moved to the artist colony of Safed in Israel. There he completed his “Shalom Aleichem and His Heroes” series of paintings which was exhibited and printed to coincide with the 100th anniversary of Shalom Aleichem. In 1970, Labkovski started painting images of Jerusalem and Safed, and later pictures of fruit, flowers and forests. In 1988, a collection of his work was established at the David Labkovski Museum of Jewish Art near Tel Aviv. Labkovski died in 1991. “During his lifetime, Labkovski spoke of his hopes to see his work displayed at museums dedicated to sharing the narrative of the difficult history of the Holocaust,” Hutman said. “Through the generosity of Labkovski’s Los Angeles family, we are privileged to have the Barbara Barishman collection of the work of David Labkovski on loan to LAMOTH.” For information, call 323-651-3704 and visit www.lamoth.org.

Emily Nason Dies At Age 79 By John L. Seitz Services will be held Sunday at 2 p.m. at Hillside Memorial Park for Emily Mayer Nason, the wife of Fred Nason, Jr., scion of one of Beverly Hills’ most historically prominent families. Emily Nason, who died after a long illness Wednesday at age 79, was born Sept. 28, 1935 in Cleveland. After moving to Los Angeles at age 13 and attending John Marshall High School, she began working with the Nathan Rosenblatt Construction Company in the early 1970s and continued there until retiring in 2000. She married Fred Nason, Jr. on Valentine’s Day 2001 after a 19 year courtship. She

loved to sing and dance was a longtime active member of The Thalians and the ARCS. Besides her husband, she is survived by her brother Leon Mayer; daughter Trisha Singlehurst; and three stepchildren Christian Nason, Stacie Nason-Henry, and Richard Nason.
Annenberg Executive Director Leonard Aube Dies By Matt Lopez Annenberg Foundation Executive Director Leonard Aube died this week after a battle with cancer. Wallis Annenberg made the announcement in e-mail sent out Thursday to community members. As Executive Director since 2003, Aube led the Annenberg Foundation as it gave more than $2 billion to more than 2,500 non-profits around the world. Aube played a central role in the creation of LA n Sync and Alchemy, while spearheading major projects
for trustees. “Leonard was a crucial partner to me,” Annenberg said. “His joy in serving was inspiring; his boundless energy and enthusiasm were a wonder to behold.” Prior to joining the Annenberg Foundation, Aube had a successful stint with the California Science Center. Aube is survived by wife Robin, daughter Kaitlann and son Kyle. Annenberg Managing Director Cindy Kennard has been named executive director.

Attorneys for the city have denied any wrongdoing on Nutall's part. They have filed court papers seeking to dismiss Weir's original complaint, and Nutall's sworn declaration is included within the documents. Nutall, who was a sergeant at the time, acknowledges he lifted part of the covering on the singer's body, but says he limited it to the portion closest to her ankles. “It was reported to me that the skin on Ms. Houston's legs and wrists had peeled back while the paramedics carried her body from the bathroom to the living area of her hotel room,” Nutall says in his declaration. “This raised questions as to why Ms. Houston would voluntarily place herself in and remain in water that was so scaldingly hot that it would begin to peel her skin away.” Nutall says he was doing his job in examining Houston's lower body. “To investigate the circumstances surrounding her death were part of my duties as a detective sergeant, particularly since I was the only detective sergeant on the scene,” Nutall says. Weir's lawyer, Christopher Brizzolara, said Weir was present at the scene because he was on patrol and was called to assist the first two officers to arrive. He claimed Nutall, then a forgery detective, had no business being there. Nutall says that after he looked at Houston's ankles, he saw that blood was soaking the part of the sheet covering the part of her body near her head. He says the paramedics present had put the sheet on Houston and he asked one of them if she was bleeding about the face. “One of the paramedics rolled the sheet from the top of Ms. Houston's head to below her chin,” Nutall says in the declaration. “At that point I observed that fresh blood was streaming from Ms. Houston's nose. One of the paramedics commented that it was likely due to water filling her lungs and forcing blood through her nostrils.” The paramedics then put the sheet back over Houston's face, according to Nutall. “I never removed the sheet from any area other than the portion closest to Ms. Houston's legs/ankles,” Nutall states. “I did not touch or move the body at any time.” Nutall says Weir never said anything

to him “regarding the partial lifting of the sheet.” He says he found out about Weir's allegations when he heard the sergeant might be filing a lawsuit. Nutall says: “At no point in time did I make any comments about Ms. Houston's body.” Nutall also says there was no reason for paramedics to put the sheet on Houston's body because it was within a private hotel room and out of public view. Beverly Hills Police Chief Dave Snowden and retired Detective Bureau Cmdr. Joseph Chirillo also filed declarations in support of Nutall. “I did not believe there was any problem with Sgt. Nutall lifting the sheet,” said Chirillo, who retired in 2013 after 30 years with the department. “There was no misconduct or violation of procedure.” Snowden says in court papers that Weir never said anything to him about Nutall's actions and that he did not know anything about the sergeant's allegations until more than 1-1/2 years after Houston's death. In his second lawsuit, Weir alleges that three months after filing his first case, he was denied a promotion to a police dog-handling position, a job within the criminal intelligence unit and the chance to work prostitution sting operations, all of which would have brought him more overtime pay and other compensation. He claims he also has been placed “under increased and unwarranted scrutiny and supervision” and been subjected to “additional harassing, disparaging and retaliatory comments and other communications by the command staff of the department.” Brizzolara said it is unlawful to disturb or move a decedent's body without the coroner's permission. He said taking the sheet from Houston's body was just as wrong as it would have been to take off a piece of clothing had she been attired at the time of her death. Weir was on a fast ascent within the department's promotional ladder before he reported Nutall's alleged misconduct, Brizzolara said. Nutall's alleged actions violated state or federal statutes that forbid disturbing or moving the body of a decedent without permission of the coroner and also presented potential DNA contamination issues, the original lawsuit states.

The Beverly Hills High School boys tennis team topped the most recently released CIF Southern Section Division I poll released on March 30. The Normans are 9-0 on the heels of a 12-6 victory over Palos Verdes Peninsula on March 24. Peninsula is currently ranked No. 7 in Division I. Peninsula was without singles stars Connor Hance and Daunte Harris, who are both among the top ranked juniors singles players in the nation. Beverly Hills begins Ocean League play next week. Boys golf On April 2, Beverly Hills picked up a 204-218 win over Redondo in a Bay League match at Alondra Park in Torrance. In late March, several local golfers competed in the L.A. City Junior Golf Championships. In the first two rounds, Beverly Hills’ Nicholas Choi shot a total 148 to tie for 33rd place. James Dohm tied for 57th with a 154 and Justin Hong shot a 160 to tie for 90th.
Choi reached the final round, where his total hit 221 to tie for 23rd place. Track and field For the second straight week, Amanda Block narrowly missed out on a BHHS school record in the pole vault on April 4 at the UCLA Legends Meet. Her leap of 11-0 was good for second place at the meet. In boys sprinting, Raehaan Poonja took fourth place in the 100-meter dash in 11.17 seconds. Paysinger to Miami Spencer Paysinger, son of former Beverly Hills High football coach Donald Paysinger, signed a contract this week with the Miami Dolphins. Paysinger most recently played with the New York Giants, winning a Super Bowl with the team in 2011. He started 10 games for the Giants in 2013, with 65 tackles and a sack. “Every linebacker that plays in the NFL wants to be a starter at some point,” Paysinger told the Miami Herald. “For me, it was about having an opportunity.”

Indeed in September, city officials finally stepped in and revoked the project's permits while issuing a stop-work order, but according to neighbors, LADBS flatly ignored continuing construction work. Monday’s LADBS findings gave validity to months of outcry from those residents who claimed that construction was continuing at the site in violation of the stop-work order, right under the nose of LADBS officials who did nothing to stop it. Some of those residents have told The Courier that workers on the site have threatened them as they tried to investigate the ongoing construc-
tion. As recently as February 12, LADBS insisted no illegal construction was being done at the site. In a February 12 e-mail to city officials, residents and other stakeholders, LADBS Chief Inspector Jeff Napier said: “My staff checks this site almost everyday and sometimes twice a day to ensure that there is no ongoing construction. The builder has a few maintenance workers at the site to monitor the slopes, and maintenance the property daily, in order to maintain and control brush clearance and basic cleaning, as well as watering and protecting the structure from the weather.” Napier continued: “I will assure everyone that construction is not moving forward...” Napier tone echoed a similar e-mail four months earlier,

In a September 30 e-mail, Napier said: “My inspector is fully capable of determining whether or not work is taking place and as I stated in my last response there is no continuing construction taking place.” Again in late October, Zamperini told The Courier that the project was visited nearly
daily by city inspectors, and that only site maintenance and weatherproofing were being done. He said the crews on the site were “maintaining the property… it is a maintenance crew, not a construction crew.” Zamperini’s story changed Thursday. After months of LADBS insisting no work had been done, Zamperini claimed that while inspectors had been able to view portions of the site previously, Monday was “the first time department managers have been allowed on the site.” “They tried to do the work in secret,” Zamperini said. “If we have active permits, an inspector can walk in, but it’s still a private property and they have to allow us to enter. They did that on Monday.” Zamperini added that previously “there were areas inspectors could not get to because of slope being covered with tarps.” In complete contrast to the city’s claims, Ben Reznik, an attorney for 901 Strada Vecchia, claims the LADBS knew about and was OK with whatever work had been ongoing at the site. “There have been 250 inspections during construction, daily inspections in the last several months,” Reznik said. The project was fined $336 and has until April 22 to come into compliance with LADBS’ latest findings. What that essentially means, Zamperini said, is that all the unapproved con-

Advertising on the units and kiosks are an additional potential income stream. The concept began in Europe in 1965 and has slowly evolved until, in the mid-2000s the program model was not only viable but duplicable. The main concept is to provide free or affordable access to bikes for short-distance trips in urban areas as a viable alternative to busses and cars. The bikes free up traffic congestion and reduce emissions, while providing an opportunity for pleasant sightseeing. Regionally, Santa Monica has taken the lead on a bikeshare program as the first city in the county to take it on. Originally scheduled to open in June, the program has modified their projects to late fall using a CycleHop as the vendor. However, at this date, pointed out Mayor Gold, there is no comprehensive plan for the rollout. “I am in favor of a bike sharing program,” said the Mayor, who had the only “nay” vote for the expedited cycles. “I am opposed to the acceleration of the funding for three reasons. The consultant’s report has not been received and will not be available until June. That report should tell us how many bikes and where they should go. Second, neither Los Ange-

The property owner has ignored approximately 10 Orders to Comply already, each one of which has stated that violations may trigger criminal misdemeanor charges, including jail time. At what point does the city protect adjacent homeowners and put an end to this once and for all?”

CycleHop has confirmed that it will take six months to manufacture the smart bikes and four months for the kiosks. Smart bikes with mini-computers and GPS systems are $5,950 apiece and kiosks are $14,730. Santa Monica has authorized a citywide system and awarded $10.4 million and an 8-year contract to CycleHop to build an initial offering of 500 smart bikes, 1,000 racks and 75 locations. The “Smart Bike” technology allows for flexible stations and station designs. The City is seeking corporate sponsorship to supplement anticipated user fees and provide additional support for the program. By contrast, Beverly Hills is starting with 50 bikes and currently plans two kiosks. Councilmember Brien’s request to expedite will hopefully have the impact of syncing the Santa Monica program rollout with Beverly Hills, extending the area each city’s riders can travel and drop off a bike at a compatible kiosk. Thus, a tourist staying in a hotel in Santa Monica can spend the day in Beverly Hills, shop, have dinner and drop off the bike at a convenient kiosk before taking a bus back to the hotel.

Talks Books Elliot Ackerman’s Green On Blue (Simon & Schuster $25) is a novel about the war in Afghanistan where the author served five tours of duty and was awarded the Silver Star, Bronze Star for Valor, and the Purple Heart. Thus he is someone who has personally undergone trial by the fire he brilliantly writes about. Elliot’s mother, Joanne Leedom Ackerman, was a successful writer here with a book many still remember The Path To The River. As for the title, “green” is military shorthand for Afghan soldiers and “blue” is U.S. military The novel opens in Eastern Afghanistan where two brothers (Ali and Aziz) move to the city to earn a living, be it begging or guarding a store, just to survive as their parents have been killed by militants. When U.S. forces arrive, the militants return to strike back with gunfights and bombs in the streets and bazaars. Aziz was at Madrassa when he heard the bombs and ran to find Ali, who had been taken to an overrun hospital after losing a leg and his male organs. A man named Taqbir offers to pay the hospital bills and keep Ali alive if Aziz will join the special Lashkar forces. Azis is flown to Shkin to keep his end of the bargain. He arrives to the order of Commander Sabir and is issued helmets, night-vision goggles, body armor, etc. He becomes a good soldier, keeping his eyes open to what is going on, especially with an American officer (Mr. Jack), who plays both sides of the militants against each other. Aziz learns to be cruel and threatening. When asked: “you’ve taken sides with Atal?” He answers: “I’ve chosen only to survive.” The question becomes to support the Gazans or the Gomals, only to find that Mr. Jack is paying them both. Aziz takes action for himself and Commander Sabir, who offers him a command. He turns this down and returns to check on his brother Ali. education in Israel, his philanthropic endeavors helped build the U.S. Holocaust Museum in Washington D.C. and CedarsSinai medical center. “I am a simple guy,” Webb asserts. “What I can do to help, I help.” Born in Lodz, Poland on Mar. 2, 1917, one of seven children (including five sisters) in a country where Jews were prohibited from even applying for a job in a factory, Max grew up driven by a desire to help ensure his family’s survival. “It was not easy for Jewish people to make a living,” he said of his early childhood where there was no electricity nor indoor plumbing. At seven years old, Max started peddling vegetables before school to help feed his siblings and parents. “When you’re looking for survival and you’re looking to eat something...you do everything in your power to help the family. I managed the best that I could.” After Max witnessed the

Of course, as legendary as the film is, The Beverly Wilshire’s legend extends far beyond. It began before Pretty Woman screenwriter J.F. Lawton ever put pen to paper on a script. In fact, the hotel’s legacy dates back before Lawton was even born. The Beverly Wilshire, managed by Four Seasons Hotels and Resorts, is on the U.S. National Register of Historic Places. It was constructed in 1928 on the site of the old Beverly Hills Speedway by Walter G. McCarty. The hotel itself was built with special Tuscan stone
and Carrera marble in Italian Renaissance style. As time evolved, so did The Beverly Wilshire. In 1940, it was renovated with a ballroom to accommodate the big bands of that era, and not long after, an Olympic-sized swimming pool was constructed along with championship tennis courts. The hotel has housed many famous visitors, some of whom, such as Elvis Presley, Warren Beatty and John Lennon, lived at the hotel for extended periods of time. Others who have stopped through include President Barack Obama, Michael Douglas, Elton John, Dustin Hoffman, Al Pacino, Walter Matthau and Farrah Fawcett. “The Beverly Wilshire Hotel serves as a gorgeous backdrop to Rodeo Drive and has been a beacon of elegance and style for more than 80 years,” said Mayor Julian Gold. “I am grateful to the hotel’s management for being a generous partner in the business community for our holiday programs and throughout the year."
German Nazis who occupied his hometown in 1939 burn synagogues, kill people walking on the street simply for being Jewish and murder scores of innocent young children and newborn babies inside a primarily Jewish hospital, he made a promise to his mother and God that for as long as he was alive, he would be a tireless champion for the Jewish people. “I remember everything like it would be today,” Max said. In 1943, when Max arrived at Auschwitz-Birkenau from one of the cattle wagons used to transport people to the Nazi extermination camp in Poland, he remembered going before the “physician” Josef Mengele and not knowing the future for any of the hundreds of thousands of people awaiting direction along the railroad tracks. Max recalled Mengele: “With one finger he selected; ‘You go here’ or ‘You, go here.’ We didn’t know the results of the selection.” It was only after one group was loaded onto trucks along
with the dead people who hadn’t survived the journey that Max knew he had survived the selection process. “When I came in 1943, many of us didn’t know there was a crematorium,” he said. “This was the problem, how to kill the people.” Max, whose miraculous story of survival included the notorious Death March of 1944 where only 1,100 out of 60,000 lived, was one of only three members of his immediate family to live through the Holocaust. After Max was liberated on May 8, 1945, together with Nathan Shapell whom he’d met while at Auschwitz-Birkenau, they along with Nathan’s brother went to Munchberg, Germany where they established a textile production factory that eventually employed some 400 people. “We decided, we’re not going to take anything from anyone,” he said. In 1946, he married his first wife Sala Shapell and they had two daughters, Helen and Rose. Today he counts four

After his first wife of 45 years passed away, Max married Anna Hitter in 1993, whom he remained married to until her death four years ago. In 1951 Max travelled briefly with his family to New York, taking up residence in Coney Island for 10 weeks in order to ensure that he was able to secure the special Visa afforded to refugees before it expired. The following year, the family moved to Los Angeles, taking up residence near Dorsey High School in a twobedroom apartment close to the Shapell brothers’ families. “We decided, textile was not our business here,” he recounted. Making sure there was enough money set aside that they could buy a liquor store if their next venture failed, the three men started developing real estate in 1952, with Max working some 18-19 hours a day. Together with Shapell brothers Max founded S&S

Among a litany of accolades that have punctuated Max’s life, he still remembers fondly when he was honored by the Westwood Shriners in 1979. “It was the talk of the town,” he said of the ceremony at The Beverly Hilton, which included his personal stipulations that the food be kosher, the event over by 10 p.m. and no naked lady would jump out of a box or cake. A favorite Beverly Hills story, Max said, was when he swore in Jimmy Delshad as mayor in 2007. Max recalled: “‘Jimmy,’ I said, ‘where else can you have a Persian mayor being sworn in by a Holocaust survivor?’ Anything can happen in America.” “I believe in miracles and I believe in God,” Max said. “My life is miracles.”

are permitted outside employment, including executive employees, whose median cash salary is $200,000 per year and total compensation, including health benefits, pension and other payments, is $275,000 per year. For the City’s police chief, the total compensation is $428,300. The City ordinance is concerned with employment that would both divert the employees’ attention from their work for the City and result in potential conflicts of interest. In addition to these permissions, executive employees must also file a Form 700 in compliance with the California Fair Political Practices Commission, disclosing all outside sources of income and gifts. These forms are not filed until April 1 of the following year. The staff report says, “There can be a substantial time lag between the time that employment commences and the time of filing of the annual Form 700. Therefore, the City Council may wish to be notified whenever an executive employee is authorized to engage in outside employment.” The City Attorney’s office said it selected 13 cities to compare Beverly Hills’ ordinance, including Newport Beach, Mammoth Lakes, Montclair, Malibu, Poway, Duarte, Claremont, Apple Valley, Irwindale, Sunnyvale, the East Bay Municipal Utility District, Alhambra and Rancho Cucamonga. Two others, La Mesa and West Hollywood, do not have ordinances. No reason was given as to why these cities were selected. All of the cities listed that have ordinances coincidentally, allow employees outside employment. However, it is not clear if that was the criteria

advised by its experts that additional funds are needed now, especially in light of the California SSMP report and the potential to obtain state matching funds for some of the project. Calculations provided by the district’s bond consultants estimate that, if the remaining authorized bonds are sold now, a Beverly Hills homeowner on average would pay just over a dollar a day more in added property taxes. An immediate sale of the $190 million of bonds is strongly supported by the district’s independent citizens’ Finance Committee. “Delaying the process may cost the district and the community money,” said Finance Committee Chair Bob Sternshine. “If you don’t do something, it will never get done,” said Beverly Vista parent Woody Clark. In 1989, he watched part of the Oakland Bay Bridge disappear 40 feet before him
used to select this diverse grouping. It is also not clear if Wiener’s law firm represented these cities. Malibu enumerates that “City equipment may not be used to further the purpose of outside work. This includes but is not limited to vehicles, computers and copying machines. Telephone calls relating to outside work shall not be initiated or accepted from a city telephone or personal cell phone.” Rancho Cucamonga’s ordinance says that in making a determination, the department shall consider, “the use of city time, facilities, equipment and supplies, or the badge, uniform, prestige or influence of the employee’s city office or employment.” In fact, several of the cities refer to a city’s “prestige,” badges and uniforms. Employees are also prohibited from the receipt or acceptance of money or gain in the performance of an act, which that employee is required or expected to deliver in the course of regularly discharging the duties of their office. Following a discussion led by Mayor Gold, the council determined that the threshold for which employees would be impacted would remain with the executive level employees, including supervisors and department heads, and certain exempt employees such as supervisors, managers, and professionals involved in management, business operations, legal affairs and other management-level exempt positions, totaling more than 100 employees. Exempt employees could also be included, such as supervisors, managers, and professionals involved in management, business operations, legal affairs and other management-level exempt positions. “This should affect department heads and above,” said
Bosse, ”to provide more checks and balances. What we have before us is not working.” The council examined which employees should be considered and then became distracted, discussing what constituted outside employment, spending 15 minutes on whether that included honorariums for speaking engagements and umpires for Little League. “I am concerned that we do not create a ‘blanket rule’ that will force people to break the rules,” said Councilmember Brien. Brien was worried about employees that may be offered honorariums, which is common in the medical community. By definition, an honorarium is payment made in recognition of acts or professional services for which custom or propriety forbid remuneration and preclude obligation or liability to provide the services; not real employment. Bosse also referred to the fact that “we didn’t even know about it,” referring to Chief Snowden’s contract with Evidence Based Inc, the firm that was subsequently hired by the Beverly Hills Unified School District for campus security and intentionally employed several of Snowden’s retired officers. In Chief Snowden’s case, City code was not followed. The Courier issued its California Public Records Act demand to the City for copies of Chief Snowden’s “Request for Approval of Outside Employment” forms. The documents obtained by The Courier revealed that, purportedly on May 7, 2013, then-City Manager Jeff Kolin signed his approval for Snowden to consult for a year with EBI, but it was without the required concurrent approval of Human Resources. The company employed retired Beverly Hills police offi-
cers to staff all five Beverly Hills public schools with armed guards for almost a year before it dissolved. A number had just retired and were also collecting their pensions. Snowden collected his consulting fee throughout. His EBI pay was not disclosed to the Beverly Hills Unified School District or to the City Council. Councilmember Krasne expressed concern that employees were not performing full disclosure on their Form 700, and suggested a sign off for every department head, with City Council and the city manager. Finally, councilmembers discussed consequences of policy violations. Chief Assistant City Attorney Lolly Enriquez was both unprepared and unclear about how violations were dealt with, she said, but that with “misdemeanor violations its $1,000 or year in jail.” The City of Sunnyvale was clear. “Employees who engage in outside employment in violation of any provision of this policy shall be subject to disciplinary action up to and including termination of employment.” The City Council made it clear that it was not sufficient that such employees receive approvals solely from the City Manager, as was the case under former City Manager Jeff Kolin. In fact, the City Council has directed staff to craft a new ordinance to prevent a conflict of interest or the appearance of a conflict of interest, by requiring executive employees to receive approval from all five City Council members, in addition to the city manager and human resources approvals. A revamped ordinance proposal will come to study session to be fine-tuned, said Mayor Julian Gold.

while driving from San Francisco when the Loma Prieta earthquake struck. Clark, who stepped down as chairman of the school district’s Citizen’s Oversight Committee last week after six years of serving on the volunteer group tasked with ensuring the proper expenditures of measure E, advocates that the board immediately sell all remaining unsold bonds to the maximum amount authorized. Further adding urgency to the decision is the risk that approximately $30 million in matching SSMP funds may disappear if the district doesn’t access them soon, said Boardmember Lewis Hall. The board has also received expert reports that even the remaining $190 million in unsold Measure E bonds will be insufficient to complete necessary seismic and rehabilitation needs throughout the school district. Hall emphasized that starting construction now is crucial, given the uncertainty of precisely when a potentially devastating earth-
quake may strike. The total estimated cost, based on the detailed reports, has now grown to approximately $450 million for all five District schools. “The problem with the 2008 bond is that we looked at a number and tried to work backward,” explained Board President Howard Goldstein. “Now, we have a plan and know, this is what needs to be done; this is the cost, this his how much we need.” The 2008 Board never commissioned a detailed inspection of school facilities or cost estimates for the needed work. The current board has caused the detailed inspections and costing to be performed. To obtain the additional funds, even assuming full sale of Measure E bonds, the board expects to ask voters to approve additional bonding authority in June 2016. Goldstein estimated that the entire school building project would be complete by the end of 2018 if voters, when asked, approve the additional bonding authority.
How to proceed splits the current board. The 2008 school board that sponsored the bond measure was comprised of current Boardmember Brian Goldberg, plus Myra Demeter, Myra Lurie, Nooshin Meshkaty and Steven Fenton. To promote the measure the community was told that the $334 million could be raised without property owners seeing their property tax rates increase. “Property Taxes Will Not Rise” was the catch-phrase of the day that appeared on mailers and was touted at meetings. Both Goldberg and Boardmember Noah Margo insist that it’s crucial to return to the community to ask for an entirely new bond in June 2016 to replace Measure E. Hall and Korbatov advocate selling all authorized bonds now and seeking an additional $140 million in bond authority next year. Margo, who said that he didn’t believe the schools are in structural peril despite the state of California’s conclusions, estimated that a replace-
ment bond would delay the district’s school-building process by about six months. So far, the district has sold $117 million of the bonds with another $34 million that can be sold without a tax rate increase. Just three weeks ago, the District finally began to see its bond money at work at Horace Mann School. Construction of a three-story brand new school building (the first level will be parking) is visible from Arnaz and Charleville. “This is going to be the linchpin of our school building program,” Goldstein said. He noted that when the new school building and soccer field are completed next spring, the community will be “only too happy to say yes to continue the process” of revitalizing Beverly Hills schools. The community is urged to attend Tuesday's Board of Education meeting, which begins at 7 p.m. at Beverly Hills High School's Jon Cherney Lecture Hall.

The Wallis Annenberg Center for the Performing Arts takes its place in Los Angeles County's architectural heritage landscape on May 7 at the L.A. Conservancy 2015 Preservation Awards. The conservancy has announced the winners for its 34th annual awards luncheon, to be held May 7 at downtown’s Millenium Biltmore Hotel. The event brings community leaders in business, historic preservation, city government and development together to celebrate the City's deep historical roots. The Wallis is being honored for the re-purposed adaptation of the Beverly Hills Post Office, now the centerpiece for a performing arts complex. The building that sustained service to the community continues its to be utilized in the public arena and to perform for the benefit of the community as a testament to creative reinvention. LETTERS TO THE EDITOR “It is no use saying, ‘We are doing our best.’ You have got to succeed in doing what is necessary.” – Winston Churchill On Tuesday (April 14), at 7 p.m. the Board of Education meets at the high school STC building. You need to tell the board what you want it to do with the Measure E bond that was voter approved in Nov. 2008. Do you want this board majority to delay construction so voters can inform this board what they told the previous board in 2008? The public has already spoken. They said they want modernized schools and want to make our buildings safe. What has changed? Our buildings are older, more worn down and less able to deliver education for the 21st century. Or should they sell the bonds to capacity now and continue moving forward with improving the schools? Going for another bond election in June 2016 or even later (2018 or 2020) delays construction for years or maybe forever. It adds at least $5 million annually to the construction bill in cost escalation and inflation. Stopping now will kill momentum and abandon $30-40 million in state matching seismic mitigation funds. A failed election in 2016 or later will create further monetary losses with no solution and thousands of students left in portables. If the Board of Education goes to capacity on the bond, some might not see this as the most “politically correct” approach. But isn’t the board tasked to make the best decisions for our students and community, even if these decisions are difficult? In 2013 the board went to capacity on the bond sales to build Horace Mann School. Construction is on budget and on time. Why would anyone complain if the board’s actions benefit our students and potentially increase property values? Your tax rate will go up nominally for seven years and then go back down. This amount is equivalent to 4-percent of your entire bill. Let your school board know what you want it to do. Do you really need an election that will waste money, time, and opportunity and delay safe and modern schools for our students and public? Write now and/or come to the meeting this Tuesday and voice your opinion. Do it before it’s too late! Lisa Korbatov and Lewis Hall, Members of the BHUSD Board of Education ****** Beverly Hills policymakers and police officials may argue that red light cameras improve safety, but does the program actually achieve that objective? BHPD figures show that collision injuries in 2014 were 6-percent higher than the past five year average. Bicyclists fared worst: 21percent more riders were injured last year than on average. Aren’t we making progress in reducing the harm from collisions? No. The five pedestrians who reported being injured every month last year matches exactly our five year monthly average. The problem in a word is “enforcement” or lack thereof. For every red-light installation, there is a score of unpatrolled intersections where a driver can run the red or plow through a crosswalk with impunity. And how low a priority have we put on enforcement? During the past five years, total traffic citations have declined by half. Few cops worked the beat; positions were vacant; and officers took leave. Yet during that period, our automated cameras documented a remarkably consistent record of light-running (1,400 citations were issued every month on average). Indeed the benefit of the red light program is that it provides a useful yardstick for our broader enforcement effort. The drop by half in total officer-issued citations over five years coincides with the tenure of former City Manager Jeff Kolin. Looking beyond the citations, crash injuries increased by 6-percent for auto passengers and a whopping 40-percent for bike riders between the year before he arrived (2009) and his departure in January. He nearly eviscerated BHPD’s traffic division. Our City should be working hard to reverse that negative trend. But City Hall is not taking the steps necessary. Look around: faded pavement markings have made ghosts of our crosswalks; transportation officials dither instead of installing high-visibility "continental" style crosswalks that are shown to be safer; and no official suggests any inclination to address problem intersections shown by crash injury figures to be dangerous to drivers, riders and walkers alike. Additional red light cameras won’t make our streets any more safe. And they won’t even generate the kind of revenues that program critics like to decry. Mark Elliot, Beverly Hills ****** To me the question is not how many residents per employee a city has, but what those residents get from the city employees. I've lived in Los Angeles and in Beverly Hills, and the city services-from police and fire to library and trash collection- are much better and much friendlier in Beverly Hills. As for the ratio of residents to employees in similarly-sized West Hollywood, that might be an artifact of WeHo's contracting out its police services to the Los Angeles County Sheriff’s Department and its trash collection to a private company. And for the salaries, they do seem high, but over the years I've learned that the adage “you get what you pay for” is, unfortunately, generally true. Daniel Fink, Beverly Hills ****** Would you give up a trip to the hair salon if you thought it could save a life? How about 10, 20, or 50 lives? That is the question that members of the Beverly Hills Southwest Homeowners Association must ask themselves. Attending last week’s meeting reveals that most residents are unwilling to sacrifice their oil subsidies to do right by the children of Beverly Hills. After all, there is no “proof” that the oil extraction at BHHS is toxic. As as a survivor of acute-cell lymphoblastic leukemia, what a startling statement about our “community!!” Sadly, the cut and color cannot be sacrificed.
