Beverly Hills Finally Files Federal Lawsuit Over Subway Giving into election year pressure from the Beverly Hills Courier and school families, the City of Beverly Hills late last Friday finally filed suit against the Federal Transportation Administration, challenging the Westside Subway Extension funding. The lawsuit claims the FTA violated the National Environ-

Planning Commission Flushes Idea Of Open Air Bathroom Near The Beverly Hills Hotel By Matt Lopez Citing concerns of visitors and guests at The Beverly Hills Hotel nearby, the Planning Commission turned away a request for construction of an open air bathroom space at 904 Hartford Way at its meeting last Thursday. The applicant came to the commission seeking approvals on a Hillside R-1 permit and Tree Removal Permit to allow for the removal of two protect-
ed trees. Among the items included in the proposed project was a 14-foot tall open-air pool house accessory structure which would include a bathroom and entertainment space. The structure would be 38-feet, 11-inches from the front property line of Hartford Way and 20-feet, 11-inches from the Glen Way street side property line. Immediately east, across
Glen Way, sits The Beverly Hills Hotel and the commission had concerns about the sights, and sounds hotel guests might experience from the open air bathroom. Planning Commission Chair Craig Corman and Vice Chair Brian Rosenstein said they visited the hotel and observed the proposed structure from both the bungalows and second floor hotel rooms 344, (see ‘PLANNING,’ page 12)
Witch’s House Among Three More Official Local Landmarks By Matt Lopez Three more historic Beverly Hills properties have officially been designated as Local Landmarks. The Witch’s House, 516 N. Walden Dr.; the Hilton Office Building, 9990 Santa Monica Blvd; and Waverly mansion, 9401 Sunset Blvd., were approved by a 5-0 City Council

13-Year-Old UNICEF Ambassador With Cerebral Palsy Starts Fundraising Campaign By Laura Coleman Thirteen-year-old UNICEF ambassador Lucy Meyer is at it again, this time trying to raise $50,000 to help children with disabilities in developing countries. Overweight Teens For Cravings Study UCLA researchers are seeking overweight adolescents, ages 13-19, for a study about the impact of food cravings on their ability to lose weight. Researchers are studying food cravings in teenagers to see if there is a specific gene associated with food addiction. A better understanding of the genetics of food cravings and related eating habits may lead to ways to help people more effectively lose weight. “Obesity is a major public health issue in the U.S. and many diseases including hypertension, diabetes, high cholesterol, and non-alcoholic fatty liver could be prevented if we had better strategies to decrease obesity rates,” said study researcher Dr. Joanna Yeh, pediatric gastroenterology fellow, in the Department of Pediatrics, Mattel Children’s Hospital UCLA. Building A Father-Son Relationship, Helping Kids Survive A Move Q: Dr. Fran, my wife complains I am not involved with our 9-year-old son. I work long hours and travel several times a year for business. I love our son very much but am not accustomed to playing games. How can I connect more with my child? Adam R. A: Dear Adam, it’s great you’re reaching out. You will need to find activities that both you and your son enjoy such as spectator or active sports, wrestling, or sharing a hot fudge sundae. Begin by reading the different types of attachment below and identify yourself. • Healthy Attachment Dad is interested and well-engaged with his son. When Dad gazes at his son his eyes beam adoringly. • Detached Father - Father is not there. Either Dad and Mom have archaic assigned roles that Dad is the breadwinner while Mom is the primary custodial parent, or Dad’s personality is limited by an inability to emotionally connect. • Unavailable Father - Dad is there, but focused on other things. He is not readily available to warmly respond consistently to his son’s needs. • Sports Dad - Father is intensely into sports and can only relate to his son on an athletic level, both as spectator and ac-
tive participant. • Disciplinarian Father This dad has entered into a usually unspoken agreement that Mom is the nurturer while Dad is positioned in the family as the disciplinarian. This family dynamic causes serious problems in the kids when they go through adolescence. From birth to 12 months of age, the primary psychological goal for every boy (and girl) is bonding or developing a strong, secure, healthy attachment to Mommy. Daddy takes a backseat to Mommy during this first important phase of developing trust and security within the newborn infant. The following crucial goals including Self-Declaration (I am “me”—not you), self-feeding, self-soothing, toilet-training, delayed gratification, frustration tolerance, language and motor skills and sexual identification—all must be practiced and established by every child by age 4 years. Little boys are facilitated in both potty training and sexual/gender identification by showering/bathing with Daddy, wrestling, tossing a ball backand-forth, and playing running, chase and tag games. If Daddy is absent or unavailable, a warm empathic and fun uncle, grandfather, or Mom’s buddy can step into this

Also key is that sons are carefully observing their fathers with laser-sharp radar. Dads need to know they are the model for how and what their sons will become. Try taking your boy out to dinner one night—just Dad and son. The key, Adam, is for you to be present and available in your growing son’s life on a consistent basis. Continuity is crucial to imprint your child’s identity. Q: Dr. Fran, my husband and I bought a fixer-upper home last year, remodeled, and are planning to sell it. This will be our second move in the last 18 months. I am worried about how my young children ages 4, 6 and 8 years old will handle the change. What can I do to help them through the move? Myra L. A: Dear Myra, a child’s sense of security, continuity and
confidence—all necessary ingredients for building solid selfesteem—is often affected by frequent moves. During this time, encourage your child to directly express all powerful feelings to you, including sadness, excitement, fear and anger. Encourage friendships with children who will treat your son or daughter kindly. Any transition or change in a child’s life can cause separation anxiety. As much as there may be a positive effect of excitement for the child, there is usually anxiety and worry attached to saying goodbye to the familiar and hello to the unknown. If at all possible, keep your child in the same school. It is especially difficult for a child to handle too many changes all at once. Common symptoms of separation anxiety include sleep disruption, changes in eating patterns, increased clinginess, and accelerated worries about being alone and isolated. Parents should make a book of “our old house and our new house” to help comfort and calm your child’s fears about
moving often. Let him know the house changed, but the people in our family always stay together. Let your child draw pictures to include, and choose the special place where his book sits. This gives him a little bit of control over a situation in which he has none. As with any life change, talk things through out loud with warm empathy and tell your child you understand that change is hard for everyone— kids and grown-ups. City Attorney Larry Wiener, however, said the City had the right to terminate litigation if costs rose too high. “I support the idea of view restoration and voted in favor of it and that is in fact where the focus here should have been,” Mirisch said. “The code enforcement element of this may pit neighbor against neighbor in a way that could be avoided...what I have a problem with is that instead of trying to tighten up view restoration to make sure it works, we have a code enforcement hedge ordinance with a definition of hedge that by any reasonable standards defies common sense.”
BEVERLY HILLS Under the newly-approved definition, a standard tree can now be considered a hedge and any two plants within eight feet of each other are also considered a hedge. Once a plant is considered a hedge by the City, it will forever be considered a hedge. Any hedge that violates code three times in two years will be removed. City Planner Michele McGrath noted that the definition only applies to areas between two adjacent properties where the view could be obstructed. Councilmember Lili Bosse said the amendment was a long time coming. “We have all been waiting for this moment for a long time...this shows we have a passionate, caring residential community that cares about how they live,” Bosse said. “I agree it’s not perfect, but I also think that we owe it to each other to show that when the community comes out and has an issue that we try and find a way to compromise and make something work.”

SCHOOL FUNDING: Funding local public schools is the responsibility of the State of California. In 1971, the California Supreme Court decision in Serrano v. Priest held that public schools must spend the same amount of money per pupil statewide. Today, public K-12 schools are funded by a combination of state money, a share of local property taxes, and specific grants. The Courier (including student representatives) asked: What is your view about funding our public schools? Responses: All candidates said pretty much the same thing -- the City must continue to fund the JPA and provide as much financial support for the School District as it can. Because of the lack of differences between them, we do not report the individual statements.

PAY/PENSIONS: In Beverly Hills, the City government pays all of it -- employees pay nothing. Public safety employees recently agreed to pay 1% after five more years. Nonpublic safety employees continue to pay nothing towards their retirements. Anticipated pensions for each Beverly Hills City employee who retires after twenty years of service range from approximately $2 million to as much at $4.5 million based on life expectancy. City Treasurer Eliot Finkel has pronounced the current system "unsustainable." The Courier asked, what is your view about current city pay and pensions? If you would change them, how would you do so? Willie Brien: "Our employees need to start contributing to the employee component of retirement pensions. We've done this with police, fire and current council policy will be to do the same with other bargaining units. We begin negotiations later this year, that's current policy. As council changes, policy can change, but if this council remains intact that would be our direction." Said the unfunded pension liability is an issue but that the "surplus" was real and

should not be combined with the unfunded liability (don't have exact quote here). Katherine Cohan: We cannot just make the employees suddenly pay into their pensions. I have interviewed with the police department and noticed that the officers are upset. They feel that after all these years that they have been employed, they never had to pay into their pensions and now that the cost of living has gone up, they have to contribute to their pensions. They are simply not happy. We need to come up with a "formula" so that we can keep our current contract employees happy and that it would be fair and sustainable for the Beverly Hills residents. It takes 18 months and lots of funds to train each new qualified officer. The funds expended to train new officers could potentially be more than to keep the ones we have now. We have officers that have experience that would take years to learn. We want the most qualified, thus we have to pay a little more. Some of our employees drive 30-40 miles to get to work. One officer noted that he would just apply to the police department in his community if Beverly Hills continues making him contribute to
his own pension. Nancy Krasne: The pension problem must be solved. It will bankrupt us. Right now, we are spending a growing portion of our budget for "unfunded" pension liabilities. That just means we owe more money than we've put away. That won't work and the trends are in the wrong direction. We have to have the courage to plan for 5-10 years out, not just the year we run for election. John Mirisch: The current system is unsustainable. It's another case of local government treating the people like an ATM machine. I've worked statewide on pension reform. The California League of Cities has an excellent proposal. We need to try to implement that model. We just cannot afford to get so far behind like we are now. That's one reason I voted against the current budget. I have a young son in public school here. I'm third generation Beverly Hills. My job, as I see it, is to make decisions that mean we have police, fire, paramedics, parks, good streets and a successful city in the future, not just today. With our major collective bargaining agreements coming up in this next council term, we must have city councilmembers who

see the facts as they are and make responsible financial decisions. We've not done that and this is why we are in trouble. Of course I support our public employees, but fair is fair. What they have today is not fair. The taxpayers need a voice, too. But just speaking from a practical point of view, we need to make sure we have the money in the future. We have to change the current system. Brian Rosenstein: I think everyone knows that public employee pay and pensions are killing governments everywhere -- other countries, the states, counties and cities here. With the money that comes into Beverly Hills, there is no reason for us to fall behind. But no matter how much money we come up with, the costs for pensions go up faster. We have to change that. Reality is reality. I'm very close to our public safety employees. No one believes in them more than I do, but we have to be able to pay for things and the way it's going now, that won't happen after awhile. As the only candidate running who has been President of the School Board and Mayor, they know I have always been a clear and strong advocate for the children of our community. I made sure that no one on our City Council broke the contract with our District for JPA funding.

WHAT REALLY HAPPENED: The JPA was negotiated during Barry Brucker's terms as mayor. Brien was vice mayor and voted to reduce the contract by $1.9 million from the previous agreement. He cited "budget reasons." The reduced funding granted to the school JPA represents a portion of the $10 million "surplus" he has taken credit for in this campaign. Effective from July 1, 2012 to June 30, 2016, the Joint Powers Agreement between the City Council and the BHUSD was negotiated in closed session by School Board President Brian Goldberg, Board Vice President Jake Manaster, Councilwoman Lili Bosse and Vice Mayor Willie Brien. The new contract, which gives the BHUSD $9.825 million a year for four years as opposed to the previous $10.3 million, represents a $1.9 million reduction for the Beverly Hills Unified School District over the life of the contract from the previous contract.
WHAT REALLY HAPPENED: After the Newtown, Connecticut massacre, the entire public safety and school administration of the City and Beverly Hills Unified School District met immediately and formulated plans to enhance school safety. The task force included Beverly Hills Police Sergeants Max Subin and Joe Chirillo, BHUSD Supt. Gary Woods, City Manager Jeff Kolin, and Board of Education members Jake Manaster and Brian Goldberg.

NOTHING EVER HAPPENS SMALL IN BEVERLY HILLS The Beverly Hills Courier is absolutely committed to protecting, promoting and defending the City of Beverly Hills. We make no apologies – none – for our unequivocal support for our own City. We also think it is a hoot that the stumbling giant Los Angeles Times printed a screed against The Courier. In our business, a daily NEVER acknowledges the existence of a WEEKLY – no matter what. Well, looks like we are on their radar screen. Could it be that our Beverly Hills Courier (as we “fawn” all over Los Angeles Angeles County Supervisor Mike Antonovich – who stood shoulder-to-shoulder with Beverly Hills) helped stop their vaunted “Measure J,” the sales tax scam that would have dried up ALL county transportation money in perpetuity? Talk about a sore loser. “Courier to Times: We won. We won. We won. You didn’t.” ‘nuf said. For our City Council race to get one inch of space in the “Los Angeles” Times is telling. Now they’ve tried to weigh in twice! What? They don’t have enough going on with their own mayoral race. Listen to their candidates. Every one of the L.A. mayoral candidates admits our giant neighbor to the north/south/east/west is in trouble. Their #1 fix: cut employee pay and benefits. Sound familiar? It should. Every government jurisdiction in the United States is saying the same thing. A big difference here is that we have mayor who has NOT reduced any of that but claims he has. The City’s employee contracts prove that is not correct – the tiny “reduction” (if it really exists) is five years out and then only pennies. By then, CPI raises and new health benefits will more than offset anything now on the books. Our public employee unions are putting money up to keep up Mayor Brien. Why? Guess. The West Hollywood Beverly Hills Democratic Club is putting up money (where did they get it?) to keep up Mayor Brien – and Brian Rosenstein sometimes and Nancy Krasne sometimes – but mainly Mayor Brien. After all, he’s the true “regional” candidate. What is really interesting is how the Willie Brien camp has now called in every marker it has to attack The Courier and insult the publisher (me) personally! The Courier is not running for office but maybe they think we are on the ballot. Is this healthy? Probably. Is it enjoyable? No. Not at all. But our nation was founded on vigorous political debate. When it turns personal, that’s not what any of us likes. We note that every attack on The Courier is a personal insult. To us, that simply means they have no facts. If they had facts, they would use them. The Courier has the facts and we use them. They use insults, so there you go. We believe Beverly Hills voters are mainly interested in facts, not insults. Our City certainly tends to vote that way. Insults, personal attacks, smear campaigns are not welcome here (or at least there is no evidence up to now).
The Courier trusts in the people of Beverly Hills. And we trust our readers enough to publish our sources, document our articles, and even write, “Don’t take our word for it – read/check/verify for yourselves.” Our position remains unchanged: to The Courier, the major campaign issues are: protecting Beverly Hills High School from the Metro subway tunnels of the Westside Subway Extension; imposing fiscal sanity on Beverly Hills City finances by rewriting our public employee pay, pension and benefits to a rational sustainable level; bringing transparency to our City government; and dealing with water rates in an honest manner. We have no quarrel “personally” with anyone. We believe in facts, sources, documentation and urge everyone else to do the same. We are irrepressibly proud of Beverly Hills and we do not care who know its – certainly not the Los Angeles Times (the #2 ranked newspaper in Beverly Hills). The Courier remains #1 by a wide margin. America, America, God shed His grace on thee; and crown thy good with brotherhood from sea to shining sea.” It comes as a shock when our learned astronomers inform ordinary earthlings like me that we are far from alone in our orbit around the sun. For most of my life I have been comfortable with the belief that circling around our sun are great spheres such as Mercury, Venus, then Earth, Mars, Jupiter. Saturn, Uranus, Neptune and Pluto. There may be more. Weaving their way among the above are other bodies, some of which plunged into Earth and left the round scars of their burned-out presence. It seems we have had a scare recently by another heavenly body. Further study by astronomers revealed there are actually thousands of such wandering masses circling around us, some of which are drawn into earth’s magnetic field and burned out without threatening our populated areas. However, we may not always be so lucky. In the meantime let us “gather ye rosebuds while we may” and continue to enjoy Earth’s salubrious climate while we may through our instruments, our poets and even in persons while we just plain folks thank our Creator, try hard to live in peace with all our fellow men and women, and marvel at just being alive.
LETTERS TO THE EDITOR We now know that Dr. Brien can’t keep his numbers correct, he misguided us having us believe that he has made us “money,” when in fact the City doesn’t have enough funds or reserves to cover existing debts – especially it’s long-term obligations. He also seems to do anything for a picture with the L.A. mayor, including failing to deflect the subway which is planned for under BHHS. Now the Teachers’ Association adds its nonresident partisan opinions to this man who fails to recognize the subway safety issues for our high school among others failures well-written previously. But, that is not all. Dr. Brien is unresponsive and non-caring as regards the residents of Beverly Hills. For example, he has never responded to any of my emails relating to graffiti on residential walls, badly damaged and cracked streets, dog owners parading their dogs without a leash, Segways on sidewalks, traffic jams due to tourist busses, and armored vehicles parking wherever they wish. Why does Dr. Brien always join Dr. Gold in his vote? Is it because they think alike or is it because their campaigns were managed by the same person, someone with deep connections to the City’s associations? Finally, I strongly suggest that all the associations, most of whose members do not live in the City, not endorse any candidate as it may look as if they are primarily concerned with their own issues instead of those of the City. Pablo Nankin, M.D. ****** Blaming Beverly Hills for “gumming up the rails” ignored relevant facts. The “Santa Monica Boulevard route” was touted by Metro for years before Century City developers lavished their political dollars to suddenly switch the route to their properties and under Beverly Hills’ only high school, using faulty seismology as an excuse. Otherwise, why would Los Angeles grant entitlements for a new high-rise building on the exact Santa Monica site where the subway station had been planned before developers got their way? You blame Beverly Hills for defending students and teachers from potential construction accidents which have occurred globally. Instead blame Sup. (Zev) Yaroslavsky who imperiously told us: “If you disagree with us [Metro], sue us.” Metro has an alternative only one block away. Not very far to stretch that gum. This letter was sent in response to an editorial of the Los Angeles Times urging Beverly Hills to accept subway tunnels underneath BHHS. ****** Beverly Hills has “election fever”...not a disease, not contagious...but beware. Our residents have lost their voices and become victims of a virus “lobbyist influence” and the highly contagious bacteria of “recurring cronyism.” The time has come for the voters, the residents, our community...it does not belong to the MTA, to the money brokers of L.A. and Century City, nor the City Hall insiders who envision Beverly Hills as another “mall city.” Let “no subway tunnel under BHHS” be our resolve. We must not accept “half-hearted leadership” from any of our elected officials and must demand they go to the mat to protect the integrity and essence of our wonderful community. We voters can cure “election fever” by electing focused and insightful leadership with seasoned experience. Gloria Seiff ****** There are six reasons to change the City Council majority. (1) We deserve representation from a majority which is aligned with representing the community and less interested in regional and outside concerns; (2) We deserve representation from a majority which will stand shoulder to shoulder with our community and school families and fight MTA’s proposed tunneling under our one and only high school; (3) We deserve representation from a majority which will explore all options before resorting to tremendous water/utilities rate increases; (4) We deserve representation from a majority which will advocate for real transparency, beginning with preserving e-mail for a period of no less than two years; (5) We deserve representation from a majority which will seriously tackle the financial challenges facing our community beginning with pension reform; (6) We deserve representation from a majority which will listen to the voice of residents and not spend millions on such projects as outlandish community centers nobody wanted or needed.
