Toxic Timeline: How Beverly Hills’ Arsenic Soil Became Everyone’s Problem By Victoria Talbot 9315 Civic Center Way has been a sleepy address for decades. Owned by the Beverly Hills Land Company, the 5acre site became a railroad right-of-way from 1926-1998, though the railroad had ceased to operate decades earlier. Now, riddled with contamination from arsenic, parcels 12 & 13 are under the microscope as the City and its residents try to unravel the events that led to the removal of 196 trees and subsequent potential release of fugitive toxic dust in a residential and commercial central area of Beverly Hills. Here is a timeline of the events: 1998 – Union Pacific Rail-
road (UPRR) returns the land to the Beverly Hills Land Company (BHLC) 11/2/2000 – BHLC and “transportation planners” meet with residents allegedly to discuss alleviating traffic on Santa Monica Blvd. Beverly Hills North HOA President Victor Bardack accuses then-BHLC president Gene St. John of a “veiled attempt to make friends of the residents and make them more receptive to what the developer wants to do.” St. John receives support from Beverly Hills’ then-City Manger Mark Scott. 6/2003 – A report by Lindmark Consultants that the property has toxic arsenic (see ‘TOXIC SOIL’ page 30)

The posting reflects the City's transparency ordinance, to allow the public to comment on the resulting negotiations. The MOU for BHFA will be voted on at the City Council Formal Session, 7 p.m. Tuesday, Dec. 15. The public can view the proposal on the City’s website at www.beverlyhills.org/bhfamou. The MOU contains the following: "Effective the pay period including October 6, 2015, employees will receive a base salary increase of two percent

By Victoria Talbot City staff and team members of One Beverly Hills made up the majority of attendees at a “scoping” meeting Monday evening for community members to comment on the City’s initial study into environmental impacts of the project. Comments would then influence the Supplemental Environmental Impact Report (SEIR) that will recommend future impact mitigations. Held on the second night of Hanukkah, during the year’s busiest holiday season, the public comment period for this phase of the project began Nov. 30 and ends Dec. 30. Public comments are essential to direct staff to issues that will affect residents and the community.
The initial study provided by City staff included noise, traffics, greenhouse gas emissions, water, and a standard checklist of environmental impacts. Community members, such as families with students at El Rodeo School, residents in the area immediately adjacent to the property or those who must reach destinations such as Beverly Hills High School or Century City, will likely have the most direct impact from the construction and the project. Designed by Pritzker prize-winning architect Richard Meier, the original plan called for two residential towers with 235 residential units. The final EIR was approved in April 2008. By Laura Coleman Terrorism hit close to home this past week when several Beverly Hills High School parents voiced concern with having BHHS students travel to Europe to participate in the London New Year’s Day Parade. Last night (after press time), the Board of Education was slated to discuss what, if any, action to take in the face of those concerns. “As I see it, parents are free to decide if they want to allow their kids to go,” said Board President Howard Goldstein. BHHS Principal Dave Jackson said he planned to make a similar recommendation to the board.
Approximately 80 BHHS students plan to travel along with parent chaperones and instructors to London to participate in the parade. According to Goldstein, the $3,150 per person trip price is being paid for by individual parents. The contract between the Beverly Hills High School Marching Band and Performance Travel Ltd. states that no refunds of deposits will be made unless there is a warning from the U.S. State Department. There is currently an alert in place. Goldstein said that due to Board Bylaw 6153, the district is prohibited from funding any student expenses that occur out of state.
Celebrations, Song and Santa Come To Beverly Gardens Park On Sunday By Laura Coleman For one hour on Sunday afternoon, the voices of Beverly Hills children will fill the air at Beverly Gardens Park for a very special “Holiday Concert in the Park.” The hour-long concert, which begins at 1:30 p.m. in front of the iconic Beverly Hills sign at the Beverly Gardens Lily Pond, is being presented by the Friends of Beverly Gardens Park. The concert will feature the Beverly Hills High School Madrigals, the Bever-
ly Vista Middle School Choir, and the BHUSD 4th & 5th Grade Honor Choir. There will also be a special appearance by Santa with refreshments courtesy of Urth Caffe and Beverly Hills High School Culinary students. Spearheaded by the efforts of Steve Gordon, the Friends of Beverly Gardens Park works to restore the City’s centuryold 1.9-mile garden treasure. Mohamed Hadid’s Name Added To 901 Strada Vecchia Criminal Prosecution By Matt Lopez Celebrity megamansion developer Mohamed Hadid is finally going to have to answer for the alleged illegal work done at 901 Strada Vecchia in BelAir. Residents fighting against overdevelopment in Bel-Air and West L.A. scored a major victory Tuesday when an L.A. Superior Court judge gave L.A. City Attorney Mike Feuer permission to add Hadid’s name as a defendant to the criminal misdemeanor prosecution of the site.
In April, LADBS inspectors cracked down on the property, ruling all unapproved construction, which they said included features like retaining walls, concrete decks and an underground theater, were to be removed. The nearly 30,000 square foot property is listed as owned by 901 STRADA LLC, with James T. Zelloe, a Virginia attorney, listed as executive. Rob Wilcox, a spokesman from Feuer’s office, told The Courier that adding Hadid’s name to the criminal (see ‘901 STRADA VECCHIA’ page 12)

Beverly Hills Could Begin Charging Electric Vehicle Fees By Matt Lopez The Beverly Hills Traffic & Parking Commission at its meeting last week broached the subject of fees for its electric vehicle (EV) charging stations. With 35 EV charging stations that satisfy up to 58 vehicles at one time, the City has enjoyed a healthy EV program, but Vice Chair Jake Manaster noted that “with that success, comes abuse.” Commissioner Andy Licht agreed. “Enforcement, to me, is the key,” Licht said. “There’s never any empty parking spaces. People park in these spots all day. I came here at 8:20 a.m. and couldn’t get an EV spot [in the Crescent lot] and I guarantee those same cars are still there.” Licht said the charge for overparking needs to be significant. “It almost needs to rise to the price of a ticket.” Licht said. The EV program started in 2011 when the City received grant funds to
install charging stations throughout Beverly Hills. The City was required to provide free use of the charging stations through January 2014, but has extended that to the present day. Now, because of what the City believes is abuse of the parking spaces, a fee structure is being discussed. The proposed pricing structure would be a combination of kilowatts used plus time parked in the EV charging space, with the approximate cost per kilowatt being between 20 and 25 cents. City staff agreed to go back and continue working on program policies, including time restrictions and bringing forward usage statistics, at a later date before going to the City Council for review. “The mission of the [electric vehicle] network needs to be decided,” Manaster said. “That is not clear at this point.”

By Laura Coleman HPV is perhaps one of the most unsexy diagnoses a person can get; and yet, it is a sexually transmitted disease that causes cancer. On Monday, Dr. Beth Karlan, director of CedarsSinai Women’s Cancer Program, told the few dozen attendees at an intimate “friend-raising” cancer-awareness luncheon that HPV has a chance to go the route of Polio-–that is, as long as people opt to have their children vaccinated. Today, Karlan said 25 percent of boys and 50 percent of women under 26 get the vaccination. She is optimistic that the population can develop a herd immunity that will prevent people from spreading the cancer-causing infection. “Your genes are the blueprint, but you can redecorate,” she said. “Genetic changes help us live better, longer, lives.”
BHUSD Welcomes New Board Of Education President Goldstein, Vice President Spitz By Laura Coleman Howard Goldstein took the helm of the Beverly Hills Unified School District Board of Education at Tuesday evening’s “organizational meeting” with Mel Spitz becoming the board’s new VP. The two votes–both unanimous–came after Spitz, who last served on the board in 1979, and Isabel Hacker were sworn in to begin their four-year terms. Spitz, who now begins his 10th year of service on the board, pledged to take “all practical measures possible” to prevent Metro from building a tunnel underneath Beverly Hills High School
at Tuesday’s meeting. The room was packed with local leaders, including Mayor Julian Gold, City Councilwoman Lili Bosse and City Treasurer Eliot Finkel. In addition to residents and school officials, also in attendance were several commissioners, PTA leaders, and former board presidents and City mayors. “The change of attitude on this board is discernible,” Goldstein said in his closing remarks at the new board’s first meeting. Boardmember Noah Margo was also sworn in to begin his second term.

Waldorf Astoria Beverly Hills Names French Hotelier Luc Delafosse As Incoming GM By Laura Coleman Beverly Hills’ newest five-star hotelier Luc Delafosse is hard at work in his role as general manager for the Waldorf Astoria Beverly Hills–although the hotel isn’t expected to open until early 2017. Just a few months into his new role, The Courier caught up with the native Parisian to discuss everything from selecting the ideal China pattern to ensuring that guests have the best experience possible. “A key point in our service entails building a friendship with our guests so they feel a sense of home when they’re with us,” Delafosse said. “This means understanding and anticipating their needs, and making recommendations that will enrich their time at the Waldorf Astoria Beverly Hills.” Located adjacent to The Beverly Hilton on the corner of Wilshire and Santa Monica Boulevards in Beverly Hills, the 12-story, 170-room luxury hotel will be the brand's first new build property on the West Coast and will join the legendary Waldorf Astoria portfolio of 25 landmark destinations. case was important “to hold those we believe are responsible for these violations accountable.” According to a presentation from Los Angeles Department of Building and Safety in June, the site had been issued 10 orders to comply since March 11, just after Hadid took ownership of the property. The title changed hands five times since he purchased the property in January 2011. Victor De la Cruz, an attorney for Joseph Horacek, the homeowner living below 901 Strada Vecchia who has led the charge to uncover all the illegal work done by the property, said he felt justice had been served by Hadid’s name being added to the case.
“Mr. Hadid, as he is known to do, had been able to successfully hide behind a limited liability company. Questionable property transfers occurred and Mr. Hadid even claimed that he was just a simple designer on 901 Strada Vecchia.” De la Cruz told The Courier. “Anyone familiar with the project knew this was a farce, but the City Attorney was initially having trouble ‘piercing the corporate veil’. Ultimately, the games could only take Mr. Hadid so far, and it appears enough evidence has been amassed to clearly demonstrate that he was, in fact, a key player and criminally liable at a personal level.” Hadid’s attorney Ben Reznik did not return a request for comment before The Courier’s Thursday deadline. The case will return to court on Dec. 14 to set a trial date.

I’m not good with anything relating to stocks and bonds nor do I understand what happens on Wall Street following the ringing of the bell by some smiling and giddy people. I am aware of the housing mortgages catastrophic collapse and the devastation to iconic Wall Street institutions, but do not understand the intricate details. (My wife and I decided to enter the mercurial world of high finances when we succumbed to the enticing penny stock offers. We thought, how much can we lose–after all–it’s only a penny? Don’t ask.) Director Adam McKay and his cowriter, Charles Randolph, have accomplished the unimaginable. I actually en-
joyed watching The Big Short starring Christian Bale, Ryan Gosling, Brad Pitt and the incredible acting chameleon, Steve Carrell, who seems to conquer every role regardless of the challenge. All

BHWC’s ‘Comfort Care’ Program Helps Families Who’ve Suffered Loss Members of the Beverly Hills Women’s Club gathered recently to prepare Bereavement Support bags for families that have suffered the loss of a child. The club launched its new Philanthropy Council with a presentation from representatives of UCLA Mattel Children’s Hospital (MCH) about the needs of families that endure the death of a child. For this Comfort Care Program members prepared 120 tote bags for parents, and backpacks for siblings. “I thought the need was compelling and this was something we could do and an easy connection, said a program organizer and club VP Tricia
Dunn Grey “When a child dies it leaves a tragic void in the family. The project is helping meet a caring and loving need. It’s important for these families to know that somebody cares about them.” The parent tote bags were filled with MCH bereavement literature, and items like tissues and M&Ms. The sibling backpacks featured stuffed animals supplied by the club. “This project has received tremendous support; and really resonated with members,” Grey says. BHWC’s new Philanthropy Council, plans to focus on causes involving women and children and continue its work with MCH.

New CHLA 3D Low Radiation Full Body Imaging System Helps Children With Spinal Conditions Children’s Hospital Los Angeles (CHLA) has announced the availability of the EOS Imaging System, the first technology capable of providing head-to-toe images of patients in both 2D and 3D while using up to 90 percent less radiation than X-rays. “This new state-of-the-art technology will be of great benefit to the pediatric patients we treat, especially those with spinal conditions like scoliosis that require frequent imaging,” says David L. Skaggs, MD, MMM, CHLA chief of orthpaedic surgery and director of spine surgery. Frontal and profile radiographs are acquired in a single step as the patient stands or sits in the EOS machine. If a fullbody radiograph of the entire body is unnecessary, the EOS scan can be targeted to a single anatomical area such as the vertebral column or the leg. The image is acquired by way of a simultaneous body scan using two very fine X-ray beams, with a whole-body scan taking less than 20 seconds to complete. The two resulting low-dose digital images are processed by

EOS’s proprietary software to generate a 3D composite image of a patient’s entire skeleton (or part of the body, such as the spine or lower limbs). “EOS promotes a safer and more precise approach to pediatric care. Not only will patients be exposed to a significantly reduced dose of radiation, but the full body 3D imaging capabilities of EOS will allow our team of specialists to make more accurate diagnoses and more informed treatment and surgical plans,” Skaggs says.
Zayden Rainey, 5, has severe scoliosis, and endured multiple surgeries for his condition, making him apprehensive about docor visits. After having a magnetic “Magec” rod surgery, visits are much easier. To reduce the number of surgeries needed to treat curvature of the spine, the rod is surgically implanted in the patient’s back. The Magec rod system allows the spine to be lengthened by using a non-invasive magnetic device on the patient’s back. Once Zayden has a Magec rod lengthening, which takes less than two minutes, he gets his spine X-rayed by CHLA’s new low-dose radiation EOS imaging system. “I want to be careful for him so the can live a healthy life,” says Aracely Rainey of her son who gets four X-rays a year and will continue to need frequent imaging until his early 20s when he’s fully-grown. The EOS system was developed from Nobel Prize-winning technology and has been shown to be appropriate for a range of musculoskeletal conditions, including those involving the hips, knees and spine.

S P O RT S Lucy Meyer Leads UNICEF, Special Olympics In Efforts To Accept Children By Laura Coleman The Special Olympics and UNICEF took a collaborative step forward this week toward making the world a better place, thanks largely to the efforts of Special Olympics gold medal swimmer Lucy Meyer. This beautiful, blonde-haired, blueeyed 16-year-old girl from Bel-Air, now a freshman at Hamilton High School, would have had a very different life had fate not dealt her a cruel blow at birth; deprived of oxygen for the first five minutes of her life, Lucy developed cerebral palsy and a prognosis that she would never even be able to swallow on her own. Today, she is the first national spokeperson in a new partnership between UNICEF and the Special Olympics to raise awareness and funds in support of children with disabilities. UNICEF estimates that 7 percent of children worldwide have a moderate to severe disability. “I really want to help children with disabilities all over the world be accepted and included,” Lucy said at Friday’s UNICEF/Special Olympics luncheon, which was held at the SLS Hotel Beverly Hills. Over the next two years, Lucy will travel in her role as the official spokesperson for the Special Olympics - U.S. Fund for UNICEF Partnership. Lucy is no stranger to advocating on behalf of children with special needs – she has met with President Barack Obama and multiple state sentators; she has spoken before the United Nations
and on Capitol Hill; this year she spoke at over 20 schools to 10,000 students about accepting kids with disabilities. “Lucy is a game-changer,” expressed Caryl Stern, president and CEO of the U.S. Fund for UNICEF. “She is relentles [and] fearless.”

Special Olympics Chairman Timothy Shriver underscored the importance of believing in all children. “Young people will be the change if we empower them,” he said. Friends are the real teachers. Indeed, Shriver said, Lucy’s “fearless willingness” to “stand in front of other human beings and say, ‘Here I am,’ [is something] most of us can’t do.” “That kind of energy unlocks all of us to be just a tiny bit better,” he added. Normans Boys Basketball Team Hosts Annual Beverly Hills Tournament By Matt Lopez The Beverly Hills High boys basketball team is hosting its annual Beverly Hills Tournament this week, a yearly gathering of some of Southern California’s top varsity boys basketball teams. Beverly Hills is certainly among them, ranked 197th in the state by MaxPreps.com, but the Normans fell to Taft 48-39 Wednesday in the quarterfinals of the tournament. Wednesday’s loss to Taft will be a tough one for the Normans to swallow BHHS led 28-14 at one point early in the third quarter, with a chance to put Taft away and advance to the tournament semifinals. Taft responded with a 20-6 run to eventually tie the game at 34 before moving ahead for good. The Normans were led by Denzel Holt with 13 points and Amir Hajirasooli added eight. The Normans played the game without junior forward Ron Artest III, who sat for disciplinary reasons. Prior to that, BHHS had opened tournament play Monday with a 45-27
win over Hamilton. Taft and El Camino Real have already advanced to Friday’s semifinals, and tournament play continues throughout the week leading up to Saturday’s tournament final. The Normans will host Loyola Friday at 5 p.m. in Beverly Hills Tournament. Girls soccer Montana Logan’s goal wasn’t enough for Beverly Hills’ girls varsity soccer team in a 2-1 loss to Chadwick on Wednesday. Dani Elitzur assisted on Logan’s goal. Mettle Sarafian had five saves and Maddy Tirella had four in the loss. On Dec. 7, the Normans tied 1-1 with San Pedro, thanks to a goal from Lauren Stein. Paraffin had four saves in that loss. The Normans (3-3-1) got their most recent win last Saturday with a 3-1 triumph over Western. Sophomore Lauren Aviram scored twice in the victory, and Montana Logan added a goal. The building was a cause célèbre. From $30 bakelite bracelets to $100,000 Art Deco diamond rings, there was a treasure for everyone.
Founded by an Englishman who opened the original Antiquarius on Kings Road in London, the West Hollywood Antiquarius Building opened in 1981. The concept for the site was to provide a common space for antique dealers to display their wares, as an upscale aesthetic version of the common street flea market. Along with the shops came what was arguably the first Northern Italian restaurant on the Westside of Los Angeles, opened by Silvio De Mori, the much beloved Pane Caldo. Many an Angeleno has fond memories of browsing the many shops, and capping off the experience with a lovely lunch or dinner on the patio of Pane Caldo, sipping wine and nibbling on bruschetta. As an upscale version of Portobello Road in Los Angeles, the Antiquarius Building was hot in Hollywood. In fact,
it was so hot, that the building was destroyed by fire in 2008. Now, finally rebuilt and open for business, the Antiquarius has reclaimed its former glory. Several of the previous dealers have returned to the building, including Baldazzi and Iacobellis, Elegant Past, Excalibur, Ineke Peskin, Mourad Kambourian and R. Zach. D., Chairman of the Board of Pacific Heart Institute. Brad Burlingame, ‘Visit West Hollywood’ CEO, Dead At 62 By Matt Lopez Brad Burlingame, the head of Visit West Hollywood and a key member of Beverly Hills’ annual Sept. 11 memorial ceremony, died Tuesday at age 62 after a battle with pancreatic cancer. Burlingame served for 18 years as the head of West Hollywood’s visitor and tourism bureau, helping transform the city into a top travel destination for people around the world. While an enthusiastic champion for all things West Hollywood, Burlingame suffered severe loss in the Sept. 11 terrorist attacks with the death of his brother Charles “Chic” Burlingame III, who piloted American Airlines Flight 77, which crashed into the Pentagon after being hijacked by terrorists. To honor his brother, and all whose lives were lost in the 9/11 attacks, Burlingame has been an annual part of Beverly Hills’ Sept. 11 ceremonies to help ring the City’s memorial

Since Chic’s death, according to Wehoville, Brad carried a small leather pouch that contained a small piece of metal wreckage from the plane everywhere he went. “We are very sad to hear of Brad’s passing. It was an honor to the City that the brother of one of the 9-11 victims was an enthusiastic supporter of our annual 9-11 remembrance,” said Beverly Hills Mayor Julian Gold. “His passing is a loss to everyone who knew him.” Brad is survived by wife Diane McDavitt and his daughters Lora and Marta.

Dr. Esther Rose Lowy Ph.D., MBA, a long-time resident of Beverly Hills and founding dean of Touro College L.A., not only raised eight accomplished children with her beloved husband Rudolph, but she extended her maternal warmth, care, concern, and encouragement to every student, professor, and staff member, who came through the doors of TCLA. By establishing and sustaining TCLA and teaching and counseling countless students in her 10 years as dean, Dr. Lowy’s light continues to shine in TCLA. Dr. Lowy had taught math at UCLA and had earned her MBA at the UCLA Anderson School of Management after earning her doctorate from New York University’s Courant Institute of Mathematical Sciences at a time when less than 4% of Americans receiving doctorates in mathematics were women.

the lecture began. One morning, he felt ill and therefore opted to shirk his normal duty. “I thought he was faking it,” Lee recalled of that one morning in 1950 when she very aptly let Gordon know what she was thinking. But fate was not about to let the two of them go their separate ways. “We were constantly thrown together at socials,” recalled Lee, who was president of her sorority. Coincidentally, Gordon was president of his fraternity. One day, April 18, 1950, to be precise, Gordon took Lee on their very first date, an intrafraterity dance at the Hollywood Palladium. It became clear to both of them after that night that they would be a couple. After they were married, they lived briefly in Beverlywood before in 1964 moving into Beverly Hills so that their three sons could attend the schools. Lee readily immersed herself in the boys’ lives, becoming Hawthorne PTA president for two years before becoming the PTA Council president where she worked closely with then Beverly Hills High School Superintendent Ken Peters. Three years after moving into the City, Gordon opened his own advertising agency in Beverly Hills, Gordon Gelfond Associates, taking an office on Wilshire Boulevard. Until he fully retired three years ago, Gordon and his team had an array of clients across the southland, including The Beverly Hills Hotel. A founding board member and former vice chair of the Bank of Beverly Hills, Gordon also represented some 23 banks throughout his tenure. He still remembers one slogan his agency created for er communities, including the Holy Trinity Church in San Pedro, Bishop Montgomery Catholic High School in Torrance and USC. “I love it here,” he said, highlighting the strong sense of community that has permeated
the First Beverly Bank on Rodeo Drive years ago: “The only place to save money on Rodeo Drive.” Following an unsuccessful bid to join the Board of Education in 1966, Gordon was later appointed deputy treasurer for the City, a position that he held from 1972 to 1988. “I literally just signed checks...once a week,” he described of his role. He has been immensely more valuable, however, as a founding member and president of the Concern Foundation, a Wilshire Boulevard Temple trustee (where Lee taught religion), Beverly Hills Chamber of Commerce president, and a longtime Rotary Club member. In tandem with their youngest son’s bar mitzvah, Lee began quite unexpectedly to craft a career for herself as a chocolatier. Indeed, she was so successful that Newsweek once dubbed her “the avantgarde chocolatier of Beverly Hills.” It all happened quite unexpectedly. The rabbi’s wife helped Lee make mints for her son’s Bar Mitzvah, which Lee then stored in the family’s freezer. Around the same time, the Gelfonds attended the wedding for a daughter of a friend of theirs who had, at each table, a beautiful chocolate basket filled with goodies. Lee decided she needed those baskets for her son’s Bar Mitzvah. As it turned out, the one shop in town that sold chocolate baskets would not sell them to Lee unfilled. Undeterred, Lee went to the farmer’s market and approached the window insulating the woman who dipped chocolates to sell; on a note, which Lee held up to the glass, she had written: “If I paid you, would you come to my house and teach me how to make them?” Ultimately, her “labor of
love” which sparked friends and friends of friends to create the candy-filled chocolate baskets for their events turned into a full-fledged business. For 28 years, she had a store on Robertson and Gregory in what used to be the City’s old firehouse. Ironically, Lee is allergic to chocolate. Gordon, however, is not. In fact, there was a time decades ago that Gordon actually worked as a chocolate taster when he was employed by for Welch’s Candy on Beverly Boulevard. Originally born in Chicago in 1929, Gordon moved to L.A. with his parents after a bomb that was set off in their apartment building as part of a labor union strike, left the family spending part of the winter keeping the windows covered using rugs since all the glass had shattered. Lee, who was born in Omaha, in a time where gypsies from Romania would put secret markings on the fences of homes to alert other gypsies if the people inside were friendly or not, moved out here when she was 11, the very same year that pear harbor was bombed and the U.S. entered the war. Once here, Lee’s mother, who back in Omaha had owned a dress shop with Lee’s father, became an assistant buyer at bullocks-wilshire. In fact, Beverly Hills has pretty much always been a part of the Gelfonds’ lives even before they moved here to raise their family. Gordon still recalls being a teenager and spending Friday and Saturday nights at the Beverly Hills bowling alley setting up pins with his friends and then bowling with the money they had made. “It was a small town,” he observed. “Beverly Hills means everything.”

The Wallis Partners With ASCAP, DreamWorks For Foundation’s Musical Theatre Workshop The Wallis Annenberg Center for the Performing Arts has announced a new partnership with the American Society of Composers, Authors and Publishers (ASCAP) and DreamWorks Studios to present the annual ASCAP Foundation Musical Theatre Workshop. Now in its 23rd year under the leadership of Artistic Director Stephen Schwartz, the workshop—giving selected composers and lyricists the opportunity to present selections from original musical works in progress for professional critique—will take place at The Wallis Feb. 16-18, with submissions now being accepted. ith its innovative chef, regional Italian cuisine that delights all the senses, a new happy hour and a second-floor banquet room, DOMA restaurant is a holiday haven; and is quickly becoming the place to go for “modern Italian food with global influences.” For holiday parties and gatherings DOMA offers two sophisticated settings. The second-stor y loft—with views of Beverly Hills and three Frenchdoor windows—can accommodate groups of 30-100 (equipped with a projector it’s also perfect for meetings.) The private wine room is an intimate space for 15-40 guests; and the three event menus can easily be customized to include favorite dishes. Chef Dustin Trani is working on his five-course special Christmas and New Year’s menus. He promises stars of the popular dinner menu like the Mascarpone Agnolotti, pillows of filled pasta with roasted sage and a veal reduction (a favorite of Bravo’s Top Chef’s Tom Colicchio); the Veal Tenderloin with smoked fig compote, braised fennel and semolina polenta cake, and the classic Marsala Braised Veal Osso Buco with Fregola risotto. Specialty cocktails and great deals on “bites” make up the new happy hour from 4-8 p.m. Monday-Friday. “The Peppers” ($5), also on the lunch and dinner menu, are one of the most popu-

Together, Trani and Perencevic, who also owns the landmark Dan Tana’s in West Hollywood, have created an upscale, sophisticated Italian restaurant in the heart of Beverly Hills whose name means “home” in Croatian. Trani brings three generations of Italian cooking experience to the restaurant. He grew up in his family’s 90-yearold San P e d r o restaur a n t , star ting at age 5 and with a full shift at age 11. Trani went to The heirloom tomato pizza c u l i n a r y with mozzarella and arugula. school, worked for Contessa Premium Foods, and then went to Thailand to study at the Oriental Hotel in Bangkok. The 135-year-old hotel was the first in the Mandarin Oriental Hotel chain. He studied the art of pasta making in Belbo, in northern Italy; and has the delicate touch to create his handmade, hand-cut linguini. “Some chefs put other things in, but our pasta is
pure—just egg yoke and flour. “It’s the most difficult way to make pasta,” Trani says, “but you get the best result.” A stickler for quality and consistency, it took Trani seven months to perfect his pizza recipe for Beverly Hills, “dealing with the amount of yeast in the air and the quality of the water,” says Trani. The dough gets a 24-hour proof. He also insists on house-made ingredients like the mozzarella, prepared every two days. “We use it on our pizza and in other dishes and it makes all the difference,” Trani says. Covering the details goes into the composition of every dish and even the garnishes, like Thai basil, are not mere decoration, but contribute to the dish. With his traditional heritage mixed with his many culinary influences from around the world, Trani creates composed dishes with a mix of textures, salty and sweet components, to appeal to all the senses. Currently diners are loving and requesting appetizers including the King Salmon Carpaccio, paper-thin slices of fish that look like stained glass, with chilis and coconut cream; and the Fried Local Calamari, that gets a dry dusting and comes with a Thai aiolil. “It has a richness,” says Trani, “it’s bright and spicy.”

The report says that there are no trees at the site and no residents, when it is actually heavily wooded and residential immediately to the south and just beyond the park on the north of Santa Monica Boulevard, among other inaccuracies. 9/21/2006 – DTSA files a remedial investigation of the elevated arsenic and maps the soil’s hot spots 8/2007 – DTSA continues to investigate, sample and measure the soil for remediation planning 2007-2014 – most activity is annual maintenance. plan is placed at the public library or is available online for review. 6/12/2015 – The Courier publishes “Community Open House to Discuss Clean Up of Toxic Railroad Land” to provide background and inform the public of the meeting. 6/17/2015 – Public meeting is a testament to the high level of interest in the property. In attendance is Deputy City Manager/Director of Capital Assets David Lightener and Bruce Howard, attorney for Lyn Konheim and the Beverly Hills Land Company. The DTSC recommends remediation that would remove 3500 cubic yards of soil to render the property safe for redevelopment. Project Manager Tedd Yargeau explains the toxic contamination and procedures for ensuring the public health. 6/19/2015 – The Courier publishes “Residents Get Toxic Over Cleanup And Proposed Redevelopment” 7/17/2015 – Notice that the public comments period has been extended for an extra 30 days until August 17 is mailed, due to the high level of public interest. 8/6/2015 – Residents organize around a petition and letter to City Hall protesting the proposed remediation that will clear the way for redevelopment of a parcel zoned for transportation, not commercial/retail/residential. 8/16/2015 – Resident Lionel Ephram sends an email to Yargeau detailing each instance where the Community Profile is wrong, including a statement that there are no residences within four miles of the site and that there will be no visual impact from mitigation (no trees would have meant no impact, vs. cutting down the trees). The entire CEQA report and RAW plan are invalidated. 11/5/2015 – Email from David Lightener to Tedd
Yargeau asks if the City can stage Santa Monica Boulevard reconstruction at the site and if they can remove trees and plant new ones. 11/17/15 – Lightener emails Yargeau to ask if he has reviewed the “conceptual layout of the trees to be planted on Parcel 13 to compare with hot spots. The owner (Konheim) is anxious to start planting.” 11/18/2015 – Yargeau responds that the area is contaminated. “Given the locations and likely volume of impacted soil generated we would need to treat this as an interim remedy which would need the 30day public notification as before. We would need to go through the CEQA process again and likely another public meeting given the level of community interest.” As for using the lot to store construction equipment, Yargeau responded, “We believe that Union Pacific should be taking the lead on the arsenic impacted soil as they are the responsible party and should be notified of the proposed planting and construction. Sorry for the bad news…” Yargeau reports that he had a phone conversation with Konheim attorney Howard Bruce about the trees and told him the same thing. Yargeau says he was told the trees were to be trimmed, not removed. Removal was not approved. 11/20/2015 – Director of Community Services Steve Zoet sends a letter to City Manager Mahdi Aluzri informing him that the Konheim’s arborist and the City’s arborist have been in touch, following “recent incident of limb failures, with at least one incident resulting in vehicular damage,” wrote Zoet. Only one police report exists. In the letter, Zoet calls eucalyptus trees “a nuisance” that should be removed because “of their propensity to self-shed
large limbs without warning.” Of the 196 trees, he says Beverly Hills Urban Forest Manager Ken Pfalzgraf has identified 28 trees, “which he is recommending for removal,” and the remaining trees are to be trimmed. He adds, “Mr. Konheim has the right to remove the trees on his property and intends to do so in the near future… Mr. Konheim has offered to incur the costs of removing the trees within the City rightof-way that Mr. Pfalzgraf has deemed unsafe. He has further offered to provide and plant approximately 50 … trees.” Zoet goes on to say that this process will not result in soil disturbance and “thus no concerns on the part of DTSC regarding the tree removal process.” 11/21-11/22/2015 – A team removes all the trees on the property, having obtained a permit from the City to close one lane of Santa Monica Boulevard to do so. 11/25/2015 – DTSC sends a Cease and Desist letter to BHLC and refers the matter to their legal department. 11/26/2015 City Manager Mahdi Aluzri states in an email, “We should have done a better job confirming that the owner had obtained the proper approval before any permits were issued.” 11/27/2015 – The Courier publishes “City Hall Makes Toxic Mistake” article. 12/2/2015 – Lyn Konheim releases statement through Sugarman Communications, stating, “My environmental attorney and the City both spoke extensively with DTSC… We tailored the project to specifically address what we and the City understood to be DTSC’s parameters.” 12/3/2015 – City press release states, “State Toxic Substance Control Agency Says Civic Center Drive is Safe.” The
BEVERLY HILLS press release stated that the Farmers’ Market would commence. The Courier, on a conference call with DTSC project manager Tedd Yargeau, Supervisor Sayaren Amir and PIO Sandy Nax, discussed impact of the clear-cutting on the soil with a Santa Ana wind predicted for the weekend and the adjacent Farmers’ Market. They learned that the fence was partially down and partially replaced with new fence poles. Supervisor Amir Sayaren abruptly terminates the conversation to phone the Beverly Hills City Attorney and the BHLC attorney, “to explain interim steps that needed to be taken immediately,” including dust suppression with OSHA-licensed HAZWOPER contractors under the oversight of the DTSC. 12/4/2015 – The Courier publishes “Toxic Tree Cutting Mistake Raises Dust in Beverly Hills” article. At 7 a.m. BHLC environmental consultants onsite to oversee repair and replacement of the fence and spraying of water or a dust-suppressing compound (soil-sement) on the lots City authorizes Rincon consultants to take surface soil samples. At 8:30 a.m. DTSC authorizes work, and contractors lay soil suppressant later in the day. 12/4-12/5/2015 – Work completed on fence and soil suppressant 12/6/2015 – Farmers’ Market opens Next Steps: “Any additional work besides routine site maintenance” will require a new RAW plan, CEQA document, 30-day public comment period and for the DTSC to be informed, said Yargeau. The legal immplications for the City and BHLC are unknown, if any.
Beverly Hills Toxic Wrap-Up, Next Steps For Parcels 12 & 13 By Victoria Talbot The City of Beverly Hills granted a permit for the partial closure of Santa Monica Boulevard so that Beverly Hills Land Company (BHLC) and Lyn Konheim could “trim” trees on Lots 12 & 13 - but left the property naked of trees and the contaminated soil exposed to wind. The property has received interim mitigation from the application of dust-suppressing compounds on the property. The chain of events that resulted in the mitigation measures is detailed in The Toxic Timeline. BHLC and the City of Beverly Hills acted at the12th hour to contain the toxic soil following a conversation with DTSC. That followed a discussion that took place between The Courier, DTSC Project Manager Tedd Yargeau, his Supervisor
Sayareh Amir, and Public Information Officer Sandy Nax. It was then the DTSC learned that BHLC’s workers had not just trimmed trees, they had removed them all, except for a thin line along the south edge of the property that is part of a 20-foot right-of-way for the City of Beverly Hills. The Courier asked DTSC if there was any danger to the public from blowing dust during the weekend, with Santa Ana winds predicted and without the trees to shield the dust. DTSC also learned that the fence was partially down, and new poles had been sunk. “Following our call we immediately (Thursday, Dec. 3) contacted the City of Beverly Hills attorneys to explain the situation and the site owner, Beverly Hills Land Company (BHLC), to explain interim steps that needed to be taken immediately,” wrote Yargeau.
On Friday, he “had several conversations with the attorney for BHLC, in addition to their environmental consultant.” Work began late Friday and continued through Saturday to spray a dust-suppressing compound on the lots and repair or replace the fence. The property was sealed by Sunday’s Farmers’ Market. “Prior to any additional work taking place there needs to be a new cleanup plan, CEQA document and 30-day public comment period,” said Yargeau. “Regarding the agreement between DTSC and Union Pacific RR, while BHLC is not a signatory to that agreement, if they (BHLC) do something that jeopardizes human health and the environment, then DTSC could take enforcement actions against BHLC to protect public health. . . BHLC’s attorney has been in contact with our attorney and
they are requesting the cease and desist letter gets rescinded,” he said. Public Information Officer Therese Kosterman had this to say: “Only Union Pacific Railroad is a party to a Voluntary Cleanup Agreement (VCA) with DTSC. Beverly Hills Land Co., to the best of the City’s understanding, is not a party to that VCA or any other formal agreement with DTSC. While the City expects that all property owners will avoid actions that could result in a public nuisance, it is currently unaware of a particular DTSC “stipulation” that Beverly Hills Land Co. violated. The City did retain two consultants to conduct soil and air sampling to investigate whether there was a potential risk to human health posed by the tree removal process and will report those results when they are
available.” The future of the project may rest in the legal entanglements resulting from this treecutting judging from the City’s official comments. If there are any legal implications for Konheim it is unknown at this time.“Beverly Hills Land Company was under the impression that maintenance such as brush clearing and weed control was not necessarily a reportable activity to DTSC,” wrote Yargeau. Both Deputy City Manager David Lightner and BHLC attorney Bruce Howard attended the June Public Meeting when the DTSC discussed the toxicity and the proposed mitigations. “BHLC felt that they had approval to remove the eucalyptus trees under this same premise,” he said. What about all the other trees?

Those bids timely received shall be opened and publicly read aloud. A “NON-MANDATORY” Pre-Bid Conference and walk will be held at Beverly Vista School at 200 S Elm Dr, Beverly Hills, CA 90212. The conference will commence at 10:00 AM on Tuesday, December 22, 2015. Late arrivals will not be allowed entrance. All attendees will be escorted through the school site by a District Representative. All potential CONTRACTORS planning to submit a bid for the project ARE ENCOURAGED to attend the pre-bid conference and job walk to become familiar with the conditions of the jobsite and the project requirements; as well as to have the opportunity to request additional information. Prospective bidders may not visit the Project Site without making arrangements through the Facilities and Planning Department. In accordance with the provisions of California Business and Professions Code Section 7028.15 and Public Contract Code Section 3300, the DISTRICT requires that the bidder possess a valid State Contractor's License at the time the bid is submitted. Any bidder not so licensed at the time of the bid opening will be rejected as nonresponsive. This project is consisting of the following document: C-100 Courtyard Drainage Corrections Each Contractor is responsible for the performance and completion of all items in the Scope of Work. The Contractors shall coordinate all work and shall cooperate with the other prime contractors and the Construction Manager as necessary to ensure progress and timely completion of the Work. Each bid shall be accompanied by a bid security in the form of cash, a certified or cashier's check or bid bond in an amount not less than ten percent (10%) of the total bid price, payable to the DISTRICT. Each Bidder is required to furnish and maintain proof of Commercial General Liability Insurance, Comprehensive Automobile Liability Insurance, and Workers’ Compensation Insurance. The DISTRICT reserves the right to reject any or all bids or to waive any irregularities or informalities in any bids or in the bidding process. The DISTRICT has obtained from the California Department of Industrial Relations the general prevailing rate of per diem wages in the locality in which this work is to be performed for each craft or type of worker needed for the Project. Such rates are as follows: Craft, Classification, or Type: Use Applicable Prevailing Wage Rate The general prevailing rate of per diem wages is based upon a working day of eight (8) hours. The rate for holiday and overtime work shall be at least time and onehalf. It shall be mandatory upon the successful bidder to whom the contract is awarded, and upon any subcontractor listed, to pay not less than the said specified rates to all workers employed by them for the Project. No bidder may withdraw any bid for a period of Sixty (60) calendar days after the date set for the opening of bids. Pursuant to Section 22300 of the Public Contract Code, the Agreement will contain provisions permitting the successful bidder to substitute securities for any monies withheld by the DISTRICT to ensure performance under the Agreement or permitting payment of retentions earned directly into escrow. Award of Contract: The District shall award the Contract for the Project to the lowest responsible bidder as determined from the base bid alone by the District. The District reserves the right to reject any or all bids or to waive any irregularities or informalities in any bid or in the bidding process. Bid protests, if any, must comply with the requirements set forth in the information for Bidders in order to be timely and considered by the District. The last day to submit questions shall be December 29, 2015. All questions must be submitted in accordance with the procedures set forth in the Information for Bidders. Frustration over City Hall’s ambivalent regard for the public interest seems to have reached a boiling point.
