Editors Note: The following story is based on the report just issued by the public interest research organization “ProPublica” written by Olga Pierce and Jeff Larson and carried nationwide, but was buried by the Los Angeles Times. This year, unlike in decades past, California formed a citizen’s commission to redraw the district lines throughout the state. These lines will dictate who lives in what district and who represents those districts. Reelection for incumbents can become a likely occurrence or virtually impossible. Last week, ProPublica uncovered a scandal in the citizenrun redistricting commission. Its report revealed how the Democratic Party rigged the process, destroyed the commission’s independence and pulled the strings behind the scenes to

Paul Diamond told City News Service that he “bit off a piece of meat slightly larger than I could swallow, choked a bit” then stood up. “My son pressed a bit too high, sternum, rather than underneath,” said Diamond, a Sher-

Rose Bowl Celebrations Come To Beverly Hills Though the City will not have a float during this year’s Tournament of Roses Parade, other ways to celebrate Beverly Hills’ style will be taking place at various businesses in town. The 98th annual Rose Bowl game will feature Big Ten Conference champions the Wisconsin Badgers and Pac-12 Conference champs, the Oregon Ducks, scheduled to play at Pasadena’s Rose Bowl Jan. 2. The Badgers finished this year’s collegiate football season with 11-2 overall record, ranked No. 10 and are marking their second consecutive Rose
Bowl appearance. The Ducks also finished 11-2, ranked No. 5 and are marking their sixth year (nonconsecutive) return. Lawry’s The Prime Rib hosted players from each team for its 56th annual Beef Bowl this week. Team players, their coaches, Tournament of Roses Officials, Royal Rose Queen Drew Washington and her Royal Court were all served an honorary pre-game feast featuring Lawry’s signature dinner of beef prime rib, spinning bowl salad, mashed potatoes,
creamed corn and Yorkshire pudding. “We are delighted to welcome the (coaches and their teams),” said Richard N. Frank, chairman of Lawry’s Restaurants, Inc. “We’re pleased to honor them for the outstanding gridiron season they have accomplished and we wish them all the best in their contest on New Year’s Day.” The Beverly Hills Conference & Visitors Bureau is hosting its Rose Bowl Spirit Campaign, geared towards Ducks (see ‘TOURNAMENT OF ROSES,’ page 18)
By Krystal Leach de Amante BHFD Fire Capt. and Paramedic Coordinator Dean Viana helped saved the life of Jimmy Ruffin Jr., son of Mowtown Celebrity Jimmy Ruffin, during a holiday celebration on Dec. 17 at the local residence of “Spark of Love Toy Drive” philanthropist Victorino Noval. Viana was attending the celebration with his family as invited guests for his efforts with the toy drive when Ruffin suddenly dropped to the floor in full cardiac arrest. No stranger to medical emergencies, Viana immediately sprung into action, checking for pulse and respiration. After deter-
mining Ruffin had no signs of vitality, Viana quickly began applying CPR (cardiopulmonary resuscitation) for four to five minutes until paramedics arrived. He helped revive the singer and transport him to Cedars-Sinai’s emergency room. “Four days later when I returned to the hospital to check on his condition, the doctors were just removing the breathing tube from his mouth,” he recalled. “He just looked up at me, opened his eyes and said ‘thank you.’” Viana said during his 37 year combined fire and para(see ‘HERO,’ page 18)

When shoppers visit stores like Target, Ralphs, Pavilions, Vons, Office Depot and Staples, they can designate a small monetary (1 to 4 percent depending on the store) contribution to either school. “The contributions support our PTA General Fund, which will later be distributed to help
offset out of pocket costs for things like the chess club and horticulture classes throughout the year,” said Horace Mann PTA President Howard Goldstein. Goldstein said that one of his school’s more popular fundraising initiatives is the Box Top$ for Education program, where individuals can collect box tops found on everyday household items of participating products, (Avery, Cheerios, Kleenex, Ziploc, etc.) cut them out and turn them into Horace Mann’s main office. Library To Begin Annual Jim J’s Jukebox Series The Beverly Hills Public Library will be holding the 14th season of Jim J’s Jukebox on Jan. 25, March 14 and May 9 in 2012. During the series, Jeff Jimirro will share facts, behind-the-scenes anecdotes and music from his collection. Jimirro was the founding president of The Disney Channel and Walt Disney Home video and is currently the chairman of the Board of National Lampoon.

Translating that as the ambiance and staff creating a comfortable mood and an inviting feeling. Add to that: good food. Fresh, and of quality. Simple and special tastes that become palatefavorites that we want to order again. Consistency’s a must. A nice waiter who gets to know you (nice is the operative word), who remains politely helpful, and serves on silent cat feet. t Yuki’s table, we reminisced about a New Year’s weekend when our longtime friend, internationally social, phoned and asked us to attend “the last party.” We were bewildered, of course. Our heiress friend, whom we’ll call Madame X, was the best host-

efore the investiture, we asked Madame X’s family if it were proper to bring a gift. “Wine,” they said. “The nuns love wine.” We arranged for the hotel concierge to include a case of California’s Chateau St. Jean chardonnay in the van that was delivering us to the monastery. Weeks afterward, we asked the family after our friend, who is now Sister X. She had written her daughter to pack and send the set of 48 Baccarat glasses. Which she did. Only to receive a written missive from the now Sister X. “No, dummy, not the water glasses. The wine glasses!”

nother New Year’s recollection. A prominent author and critic invited us to lunch on the first of January at the Ivy at the Shore. A boozy conversationalist without peer and a peripatetic traveler, good food was his passion. A meal with him was not to be missed. While discussing his current bestselling work, he fussed a bit. We sensed he had something to tell us, but was holding back.

CONNIE MARTINSON Talks Books Talk about an incongruous friendship, Jay R. Tunney writes about it in The Prizefighter And The Playwright: Gene Tunney And Bernard Shaw (Firefly $35). Jay, the son of Gene and
Jay R. Tunney
Polly Tunney and brother of former California Sen. John Tunney, has often written for The Annual Of Bernard Shaw Studies and serves as VP of the International Shaw Studies. He and his wife Kelly were in town from their Connecticut home for a booksigning reception in the Holmby Hills’ home of Juli Hutner. Jay’s mother was 100 years old as he wrote this book. She would say: “Let’s talk about Brioni. It was a beautiful time and I’m the only one left…the only one who can remember.” Brioni is an island off Italy where the Tunneys and the Shaws were together. The photo on the book’s cover of the two
men is the only existing one from that time. Gene was given a pair of boxing gloves for his 10th birthday. Along with his love of reading, it was the beginning of a career that would bring him to the pinnacle of the boxing world. He would defeat Jack Dempsey with the notorious “long count” and again the following year. In London, George Bernard Shaw was so enamored by the pugilistic art that he w r o t e Cashel B y r o n ’s Profession, a b o o k w h i c h was an inspiration to Gene to fight his way out of the family poverty. In educating himself, Tunney was not the favorite of the crowd. Studs Terkel remembers him as an intellectual who the sports writers took whacks at. He studied books on medicine, Shaw’s play Saint Joan, etc. Shaw, on the other hand, was taken with films he saw of Tunney in the ring. Tunney had friends in the upper strata in New York City who invited him to their dinner
parties where he met the heiress Polly Lauder. His friend Bernard Gimbel told of waiting while Tunney finished reading Somerset Maugham’s Of Human Bondage in order to escort him to the Chicago ring for his fight with Dempsey. He retired undefeated. Jay writes of his father at this point in time when he had achieved his goal of wealth – he had $2 million in the bank. He had married the woman of his dreams but wanted to contribute to society and be accepted by those he emulated–Walpole, Wilder, and Prof. Billy Phelps. He was friends with Thornton Wilder with whom he was to travel in Europe as a celebrity wherever he went (from the Prince of Wales to Ernest Hemingway) but a letter from Shaw inviting Tunney to the Riviera was lost. Finally as Polly and Gene left their wedding ceremony in Rome, he had a card in his pocket inviting him to lunch at Shaw’s home when they were in London. When asked if he was intimidated, Tunney replied that the only thing that mattered was character. He felt that of all the authors he had read, he knew Shaw best. Lunch with Charlotte and Shaw was relaxed and easy, so much so they invited the Shaws to join them on the island of Brioni. On Brioni, Gene and Polly stayed in her mother’s villa while the Shaws stayed in the Brioni
Hotel. Every morning Gene would pick up Shaw for their daily walk and talk. No photographers, no crowds and no cigarettes. Both men loathed the odor of cigarettes and pipe smoke. The men shared their stories of Hollywood and William Randolph Hearst’s San Simeon. Jay Tunney has written interesting evaluations of what each

After the war he became a successful business man. On July 27, 1948 Gene walked up the gravel drive in Ayot St. Lawrence to greet George Bernard Shaw the day after his 92nd birthday. man saw in the other. One evening Polly became violently ill, the local doctor moved into the villa protesting he had no medicine to help her. He advised Gene to pray. The Shaws were set to leave the island but Charlotte, who was fond of Polly, insisted that they stay. That week two famous doctors from Germany happened to come to Brioni for a vacation. No sooner were they off the boat than they were taken to Polly’s home where they operated on her on the kitchen table. Jay has entitled this chapter “Polly’s Miracle”. The book is a wonderful
Jay told me of growing up with pictures of Bernard Shaw around the house. According to his mother, G.B.S. was Gene’s spiritual father and closer to him than anyone else was ever again. Coast Retail The catchy slogan “think global, act local” is assuming a whole new meaning for retailers. As national candidates take to speeches on the presidential campaign trail, local officials are taking action on big issues and changing the way retailers do business. San Francisco, San Jose and Santa Monica are among several cities that have put ordinances in place to expunge plastic bags, and the list has grown to now reach 70 or more other cities, including Beverly Hills, Huntington Beach and Pasadena, that are contemplating doing the same. Efforts to make the single-use plastic bag ban effective statewide, though, have met resistance in the California Senate, which rejected a bill last year to
become the first state in the nation with such a ban. West Hollywood’s passage of a ban on fur apparel products — the only one of its kind in the nation — is a more striking example of a local government on the West Coast diving into a contentious debate that extends beyond its borders. ew Year’s weekend way-back-when, after we relocated from Manhattan to continue as the West Coast’s roving editor for Town & Country magazine, friends from the East arrived. Heiress Lilly Fallah Lawrence with her insurance tycoon husband Bunty; her father Reza Fallah, the ambassador at large for Iran's oil industry; several publishing couples from Hearst, and a few politicos. A majority voted for “something different” for our New Year’s Eve repast, preferring a cozy place away from the din and fray of the usual midnight madness.

acking our skull, we wondered (nervously) if they were “up” to a shabby spot in Venice named Casablanca that served excellent Moroccan cuisine. We had dined there with pals from the Moroccan Embassy in Los Angeles, notably Adeslam Jaidi and Princess Lalla Nehza, the young sister of King Hassan II, who had asked for Lilly Fallah's hand in marriage, wooing her with major jewelry. She declined.
They introduced us to the
tantalizing North African forktender stews with their gently spicy flavors. Would these cosmopolitan New Yorkers,
who luxuriated at four-star restaurants on caviar and the venerated Dom (Perignon), go for it? Yes.

We remember Claude fondly, and his food was favored by our local artists and food mavens. Ed Ruscha, Billy Al Bengston, Ed Moses, Robert Graham, Sam Francis – it became a hangout for the art crowd. Struggling artists exhibited their work, and admittedly a lover of art, Claude opened an art gallery across the street, plunking a giant, restaurant-sized pink refrigerator in the middle of the gallery. A traditionalist with his cooking, Claude was an avant-guardist with his personal taste.

tute in Los Angeles told ProPublica. “By the numbers, Republicans should have held at least the same number of seats, but they lost.” Members of the California delegation gathered at the Democratic Party offices on March 16 to confer regarding redistricting. In an email uncovered by ProPublica, Alexis Marks, the House Aide, recounted how the committee was “working behind the scenes” to get information out regarding the potential hiring of republicans as the “line drawer” and “(Voting Rights Act) Attorney.” “I’ll keep you in the loop, but do not broadcast,” She warned. Marks also reminded the Democrats that they should never say anything about redistricting at the meetings, no speculation, no predictions, “NOTHING——anything can come back to haunt you.” California Democrats then consulted with Democratic mapmaker Mark Gersh. According to ProPublica, “Officially, Gersh works with the Foundation for the Future, a nonprofit whose declared goal is ‘to help Democrats get organized for the fight of the decade; the fight that will determine Democratic fortunes in your state and in Washington,
D.C. for years to come: Redistricting!’ “The foundation is well funded for this fight. Its supporters include longtime supporters of the Democratic Party: the American Federation of State, County and Municipal Employees as well as the American Association for Justice (previously known as the Association of Trial Lawyers of America). The foundation was launched in 2006 when Nancy Pelosi’s office worked with both groups to start it.” The commission was created in accordance with the Voters First Act, passed November 2008. In November 2010, the California State Auditor randomly selected the first eight members of the first Citizens Redistricting Commission and the rest of the 36 commissioners were chosen through an application process. Of the first eight members, three were registered democrat, three republican and two were either decline to state or registered with a different party. When defining the goal of the redistricting commission, ProPublica stated “according to civics textbooks, the aim of redistricting is to group ‘communities of interest’ so that residents in a city, neighborhood or ethnic group wield political power by voting together. “The commission took an expansive view of this concept, ultimately defining a ‘commu-
nity of interest’ as anything from a neighborhood to workers on the same commute, or even areas sharing ‘intense beach recreation.’ This gave savvy players an opening to draw up maps that benefited one party or incumbent and then find — or concoct — ‘communities of interest’ that justified them. Democrats set out to do exactly that.” The Citizens Redistricting Commission, who collectively had very little expertise on California’s political geography, decided to remain uninformed on any of California’s party data. According to ProPublica, “The law creating the commission barred it from considering incumbents’ address, and instructed it not to draw districts for partisan reasons. The commissioners decided to go further, agreeing not to even look at data that would tell them how prospective maps affected the fortunes of Democrats or Republicans. This left the commissioners effectively blind to the sort of influence the Democrats were planning.” The commission instead relied on public testimony to draw communities of interest. In the end, it all came down to a lack of time and a lack of money. Research by ProPublica stated the budget for the entire map drawing undertaking was just over $1 million and ultimately the money did run out.
The move of commission meetings to Sacramento made it difficult for the average person to participate. “Only those with resources and time could participate… In July, it made public a ‘draft final.’ Voters had two weeks to submit comments before it became final. Most of those comments came from insiders who had been closely watching the Sacramento Meetings,” the ProPublica article noted. A statement from current Citizens Redistricting Commission Chair Stan Forbes describes the commissioners attempt to remain impartial. "Of course partisan political interests tried to influence the commission's independent process, but that goes with the territory, and the commission had its eyes wide open and was very aware of that possibility,” Forbes said in a press release. “The important point is that the Commissioners were not unduly influenced by that. “We drew district maps that were fair and representative. In fact the California Supreme Court unanimously, by a 7-0 vote, dismissed litigation against the maps finding that the commission followed the Constitution, Federal Voting Rights Act and the Voters First Act. “If the Democrats successfully gamed the system then why are there two Congressional districts in the Los Angeles
area where Democratic incumbents are having to run against each other? One of the matchups includes two of the most influential and powerful Democratic Congressmen in the nation, Howard Berman and Brad Sherman. There has never been a more transparent or open redistricting process in California history. The commission drew districts that were based on the totality of the wide and varied testimony, not just listening to one group or maybe the last person we heard." Since ProPublica published its article last week, California Republican Party Chairman Tom Del Beccaro called for an “immediate and thorough investigation by Congressional and State Authorities.” “The ProPublica report vindicates my repeated contention that the redistricting process was hijacked,” Del Beccaro said in a press release. “That report, however, is just the tip of the iceberg. “The corruption of the process went far beyond what was disclosed in that report. No fair-minded person can now say the process or the result was fair. LA SEINE Kosher Restaurant By Merv Hecht Only in America! Well, maybe something like it exists in Israel, or New York City, but it would be hard to beat the quality of the kosher food at La Seine in Beverly Hills. I don’t know why it was such a surprise, but it was. One surprise is the sushi bar. Who knew sushi was kosher? They have my favorites of course, tuna and yellowtail, at $6-$8 for an order of regular sushi or a roll, for $14-$15 for sashimi. The specialty rolls trend toward the spicy, which I like; and my favorite is the Marilyn Moon Roll, a delicious mélange of spicy crab, tuna carpaccio and garlic sesame oil. Of course any combination of hot spicy peppers and garlic is almost always my favorite. Then too, my sister’s name used to be Marilyn. A second surprise is that some of the dishes really taste as if they had cream in them. Of course, since this is a kosher meat restaurant they don’t. But the chef is so creative that you don’t miss the daily at all. Taste the soups and the crème brulee and you can hardly believe there is no cream used. And what about that vanilla bean (soy) ice cream? The third surprise (Okay, perhaps only for me since I’m from a small Midwestern town) is the quality of the meat. When I think of kosher meat I think of my grandmother’s brisket. While the menu has pasta, fish, chicken and lamb, the far-and-away favorite here is the steak. The steaks come as a 10-ounce flatiron for $28, to a 32- ounce cote de boeuf at $64, and a bone-in or boneless ribeye. The bone-in ribeye is 20-ounce for $42, which seemed more than I needed, so the last time I was there I chose the 8-ounce boneless ribeye at $28. I wouldn’t say it’s the best steak I
ever had, but there was nothing wrong with it; and it was as good as 90 percent of the steaks I get around town. It was cooked medium rare and nicely presented with wild mushrooms and béarnaise sauce on the side (all at extra charges). I certainly couldn’t tell it was kosher. The only telltale sign of it being a kosher restaurant was the clientele, which included a number of elderly men out with their families, all dressed in traditional Jewish clothing. As they say, “a good time was had by all.” In fact, one of the nice features of this restaurant is that it draws a well-behaved family crowd clearly enjoying the dining. There was an almost adequate wine list, but the wine service was very helpful, and the prices very reasonable. I saw a number of customers enjoying cocktails, and these seemed to be much more creative than the wine list. One aspect of the restaurant often mentioned in reviews is the beauty of the interior. The wood, stone and leather elements, the brick walls, the two fireplaces, all combine to make it feel homey and inviting. The owner, a typical French businessman, is right there watching over things, and, unlike the stereotypical Frenchman he too is warm and inviting, friendly and eager to converse. And the Executive Chef Alex Reznik was one of the Top Chefs on season #7 of Bravo Channel’s popular show. What more can be said? This is a first-class kosher restaurant with highquality French-style food, great steaks, a complete menu, excellent cocktails and even a sushi bar. I read somewhere there is live entertainment later in the evenings. At dinner, all I could think of was “only in Beverly Hills.”

The Fear Of Making New Friends–A New Phobia By Roger Lefkon A research study has revealed a person’s brain capacity can only accommodate 150 relationships, which is a drop in the bucket compared to the number of friends you can accumulate on Facebook. The latter doesn’t distinguish between mere acquaintances, genuine longterm friendships and frenemies (i.e. those people who pretend to be a friend, but are actually your enemy). Included in this unique class of humanity are insurance salesmen, politicians, telemarketers, blackjack dealers and idea thieves at work in the workplace. My mother, who was quite adept at dishing out sage advice, always told me to keep my friends close and my frenemies closer. Through the years my quota of friends, going back to my kindergarten pals and including a lifetime of people I have bonded with, has reached its cerebral limit. The challenge I face, therefore, is to selectively eliminate existing friends to make room for new ones, something I am fearful of doing. I like to refer to this process as the “big goodbye.” Discarding old friends can be a painful experience, like getting rid of old comic books, terminally ill goldfish, the ransom note from my kidnappers and my first molar, which was rejected by the Tooth Fairy as having no resale value. I have a bunch of new individuals whom I would like to become friends with if only I could discard a like number I no longer want nor need, and just keep my true friends, you know who I mean, the ones who will only stab you in the front. This practice is not as easy as it sounds since there is a tendency to keep an old friend out of guilt or, in the case of my significant other, because she knows too much. To accomplish this downsizing, I have placed several of my friends, who are no longer relevant, on Craig’s List where the listings are free and there are no commissions to pay. The only problem with this strategy is that Craig’s List buyers are notorious for being unreliable and, after meeting my soon-tobe-former friends, might decide to return some of them. So be certain your agreement always contains a no-return friends clause. I have also tried using eBay where folks go to buy and sell used and outdated stuff. If an unwanted person can be easily packaged and shipped, eBay may be the way to go. So if you have any pint-size disposable friends, pack them in bubble wrap and send them on their merry way. It’s important not to lose sight of the fact friends, like animal crackers, come in all shapes and sizes. What if you find yourself
with available storage space for new friends and cannot find anyone who qualifies? What I do in those circumstances is push the envelope and, using the Internet and digital technology, create my own virtual friends. They are simulated be-
ings who share my likes and dislikes, attitude and demeanor and passion for junk food, selfhypnosis, collecting marbles from friends who have lost them, and experimenting with new sex toys. In other words an ideal companion, someone who will always be there for me and if it doesn’t work out I simply click the delete button and start all over. When all is said and done,

if I am unable to jettison my nonessential friends I sometimes donate them to Goodwill and take a healthy tax write off or, if I am looking for value in kind, I might try to dispose of them at a swap meet. Who knows I might get lucky and dance away with a worn out stripper pole (strippers are extra) or come away with a recent photo of Bernie Madoff lecturing fellow inmates on the fine art of short selling, or maybe connect with a rare set of reversible holiday lights, red and green for Christmas and blue and white for Hanukkah. If I cannot sell, trade or barter my unwanted friends simply giving them away is always an option and would certainly be preferable to taking a page out of The Sopranos play book and using them as landfill. The First Grader, Now On DVD, Celebrates The Power Of Education, Foundation Helps Awards Bid This week, resident and producer Richard Harding saw his film The First Grader released on DVD. The fact-based drama tells the story of octogenarian Kimani Ng’ange’a Maruge, who decides to get the education he was denied, by enrolling in a public elementary school after the Kenyan government decided to provide education for all. Olivier Litondo, who plays Maruge was recently named “Best Actor” by the Black Film Critics Circle. The movie deftly illustrates the obstacles Maruge faced—from the country’s education department, teachers at the school and parents afraid he was taking precious resources better spent on a child—to achieve his goal. Naomie Harris (set to be the next Bond girl and best known as Tia Dalma in Pirates of the Jane Caribbean: At World's End) plays Obinchu, the school principal who champions Maruge’s cause. Her enthusiastic performance equally matches Litondo’s quiet dignity, strength and unflinching determination Screenwriter Ann Peacock’s script (The Chronicles of Narnia: The Lion, The Witch and The Wardrobe) keeps the film shifting, through crosscuts and flashbacks, between Maruge’s memories of his life as a young father and warrior in the Mau Mau rebellion against British colonialism and his quest to read. “This is a gem of a film with the universal message about the power and importance of education,” Harding said. “The First Grader has
truly inspired and touched all those who have seen it.” Illustrating that power, the film shows an empowered 84-year-old Maruge teaching his fellow students—endearingly played by children from the Rift Valley School in Kenya were the film was shot. He inspires them to revere their country’s history (Kenya became an independent nation in the 1963) and is even responsible for a small revolution when the school’s beloved teacher and principal is transferred from the school by an education department bureaucrat. A heartbreaking look at the history of Kenya under British oppression, the film is a poignant lesson, and at the end of the film, viewers realize why reading the letter that inspired Maruge's journey is so important to him. Much like it’s main character, the film has taken a dramatic journey. Premiered at last year’s Telluride Film Festival, The First Grader went on to finish second to The King’s Speech in voting for the audience award at the Toronto International Festival, and was honored with similar recognition at smaller festivals. But the film was not a success at the box office, grossing just over $300,000 and Harding and his producing partner Sam Feuer blamed distributor National Geographic Entertainment for “poor marketing and advertising,” Harding says. least 18 months away. Jim Falk Lexus representative attorney Mitch Dawson said the project would need to go through the Architectural Commission approval process. In addition, Lexus will need to provide working drawings for approval by the Building and Safety Department. The Building and Safety Department will need to approve the plans and will continue to inspect as the project proceeds. Dawson estimated the approval process taking between four and six months and construction time is estimated at approximately one year. “(It’s a) time consuming process but the most rigorous part was obtaining approval from the Planning Commission and City Council,” Dawson said. “Now the builder has to dig in and do the work plans.” Planning Commission Chair Dan Yukelson said the time during the Lexus expansion discussion allowed the commission the opportunity to study the project and gather input from the stakeholders to ensure significant mistakes weren’t made. “Much of the time required to review and approve a major project like Lexus is driven by the applicant itself,” Yukelson said. “In this case, Lexus initially asked for a much larger project that would have required a General Plan Amendment - just after we had updated our City's General Plan. Only after careful study, we were able to strike the appropriate balance for the project. Lexus got most of what it wanted and the City and neighborhood got most of what it wanted. It was a ‘win, win’

result for all stakeholders.” This process, however, is not unusual for people looking to build in the City. “This is what every project is required to do,” Dawson said. “First projects obtain approval, then do the work plans. This is the normal course of events and (we will) proceed accordingly subject to constant inspection.” Vice Mayor Willie Brien said he was glad that the City was able to come to a resolution with Jim Falk Lexus. Was the length of the process too long? Brien said that depends on “how you look at it.” “We do need to look at the process, to reduce the amount of time people can get decisions on their project in the City,” Brien said. “At the end of the day, the key thing is the result of the process. In this case, it’s keeping Jim Falk Lexus present and dealing with some concerns the residents had. I think that’s a good result.” Dawson said he is hoping the Architectural Commission will be able to approve the project in one meeting in either late January or early February. The Architectural Commission previewed the project a few months ago and gave Jim Falk Lexus direction on how to proceed. “Since we’ve had a project preview and (will) bring in everything they want, (I am) hoping to get it done in the first formal hearing,” Dawson said. “I leave that up to the good sense and expertise of the Architectural Commission.” Regardless of how long the process takes, the dealership expansion has been approved. But what will happen to Jim Falk Lexus during the construction process?
Dawson said that the dealership currently has 13 bays on Robertson near Charleville and is making arrangements for additional bays. He also said the dealership will find a temporary showroom and expects to stay in Beverly Hills during construction. If Falk cannot find a temporary location in Beverly Hills, the city will lose sales tax on its business. Brien said business attraction and retention is important, especially in the southeast portion of the City. But, it’s a twoway street. “Businesses and developers need to come in with well thought out designs and ask for realistic projects up front in terms of both size and scope,” Brien said. “I think we as City Council members need to step up and take a more active role in the process for these projects from the beginning and give clear direction throughout. Other commissions will do a better job with their deliberations by knowing the direction of the council and Land owners, developers and business owners will have a better idea of what they need to do to get projects through the council.” Although it may be time consuming now, Brien said a streamlining process is being worked on. The City Council has formed a committee to improve the permit process for residents and businesses alike “We have to do a better job,” Brien said. “We have a great City… people want to be in Beverly Hills. Our job is to select and push the businesses we want in the City. That’s where the council needs to step up, give direction and move the process along faster. Things should not take years and years to get done.”

WHAT HAPPENS WHEN YOU’RE PROVEN RIGHT ABOUT SOMETHING REALLY BAD? This weekend brings the New Year – 2012. What will it portend? For Beverly Hills, some huge issues confront us. First and foremost is our economy. Last week we hailed the unanimous approval of the Falk Lexus remodeling proposal. We wrote that, this time at least, the City Council looked at our future as a City and voted for a strong future, despite the usual gripes from neighbors. Right now, a council “task force” is working to rearrange City commissions, combine certain approvals and supposedly bring some sense to a senseless procession of approvals, regulations and process. Will it help? We hope so. We suspect it will be much more like rearranging the deck chairs on the Titanic. Your seat might be better, but you’re still going to sink. We hope that Vice Mayor Willie Brien, who heads the task force, achieves real improvement, not cosmetics. The only way we will know that, however, is if City staff is reduced, red tape eliminated, and delays are caused by real issues and not some bureaucrat’s pet regulation. Firm timelines would go a long way, too. The underlying truth about doing business in Beverly Hills is that it is very, very hard. We still have a tortuous obstacle course for the simplest approvals through City Hall. We Americans can look at a nation held captive by its bureaucrats like India or Egypt and snicker – “Oh, look at them. They have to bribe their way through and it’s still impossible.” Well, at least there they can bribe someone to get things done. As we report today, the Falk folks still have months of red tape and approvals to struggle through. Why? We really don’t know. The main answer we get is: “We have regulations.” Well, if we can impose regulations we can remove regulations, right? Wrong. Our City is held hostage by our own rules and regulations, administered by our army of $168,000-a-year bureaucrats who hold up everything. It’s not their fault, though. Our City Councils have built up this mess over the decades. Statewide, California faces a much worse obstacle course–more like an impassible minefield. California is in the death grip of public employee unions. We are led by a union-backed governor who has never told the unions “no.” In fact, it was Gov. Jerry Brown who gave public employees the right to unionize. They were not underpaid or overworked at the time. They were not exploited. They has secure jobs, good pay and excellent retirement benefits. He did it 100 per-
cent so that the Democrats could fill their treasury with taxpayer money funneled through the union. California taxpayers pay the union dues of public employees, just like Beverly Hills pays 100 percent of all employee retirement pay. That arrangement directly caused California to become a one-party state with no way out under current circumstances. Did you ever see Disney’s The Lion King? (Of course you did.) Remember what happened when the evil usurper brother took over as king of that lush, green prosperous valley? Prosperity vanished and the thugs ruled. Look at our state. Tell us at The Courier that the same thing has not happened under union/Democrat rule? We have been right about this. Everything bad we predicted has come to pass, and now – as exposed by the “ProPublica” reports carried nationwide and in today’s edition of The Courier – the Democrats gamed our system, defeated the will of the people on voter districts, and now will be able to strangle our state even more than today. To analogize to another great movie, Star Wars, the Empire has invaded the good guys’ home planet and shot it all up. Who will rescue us? Us? Not hardly. We’re the ones who let this happen in the first place. Nationwide, it’s more the same. We wrote before that “Every vote for a Democrat puts one more nail in the coffins of your grandchildren.” We are right about that statement and being right means we are right that things will get worse. Please think about Just exactly what happens when we finally run out of borrowed money? No amount of taxation can possibly fund the multi-trillion-dollar deficits of Barack Obama and the California Democrats. What is fair? Tax “the rich” even more? The “rich” don’t have anywhere near that much money. The top ONE PERCENT (only 1 percent) of California taxpayers already pay FIFTY PERCENT (that’s 50 percent) of all state income taxes. So, what do the Democrats want? More taxes on “the rich.” What will they use it for? To give more money to their union backers and the recipients of government welfare. The “really bad” is happening now. So, for 2012, we hope we are not right about the really bad stuff happening, but we know that we are right and that’s too bad. At least we have the consolation that when the bad really hits, we in Beverly Hills will be the last to feel it. Happy New Year.
HAPPY NEW YEAR, PLEASE Tomorrow night is New Years Eve. At the stroke of midnight 2011 creeps decrepit and unmourned into history and a spritely tot–2012–begins a new life. Because the earth revolves, it does not begin everywhere the same moment, but arbitrarily begins at Greenwich, in England and slowly moves westward until it meets us. Rather confusing, isn’t it? In New York, while it is 9 p.m. here, crowds will throng Times Square to watch the great while ball descend. We in the west will wait patiently for midnight to arrive here. Then we shall spontaneously kiss our beloved others and blow little horns and, voila, it will be 2012. Why is it such a peak moment? It is because we share a desperate hope the new year will be better than the past one, which was wretched for humanity. Many of us will earnestly make some new resolutions, and perhaps some of us may actually keep them. The important word here is “hope.” For what do we hope? We don’t ask for much. We just hope for peace and prosperity, that’s all. Imagine that! A year in which no nation will war against any other nation; no tribes will try to wipe out their neighbors; no males will degrade, abuse, and kill females at will; and in our cities there will be no need for police because nobody is robbing or assaulting anybody. We hope for universal prosperity: every soul on earth will have gainful and meaningful employment, sufficient funds to feed, clothe, house and enjoy leisure time for themselves. Am I asking for Utopia? Yes! If we give up our dreams they will never have a chance to come true. So what do I wish for you in the new year? I wish you not to mothball your own dreams, and share mine. Together we can make them come true: if not in 2012, then in the lifetime of our children, or our children’s children. Don’t give up on Utopia! Happy New Year!
