The City of Beverly Hills uses an “Every other Friday off” policy for almost all of its employees except public safety. Of the approximately 400 city employees, nearly 360 participate in the so-called “9/80” plan which means that any city staffer who works 80 hours in nine days can have the next day off with pay. In practical terms, that means arriving about 30 minutes early each day and leaving about 20 minutes later than posted (see ‘9/80,’ page 12)
MTA ‘Final EIR’ Favors BHHS Board Member Expresses His Tunnel, Constellation Station Discontent With City Liaisons Exclusive to The Courier The final environmental impact report of the Metropolitan Transit Authority strongly favors the proposed route under Beverly Hills High School and 78 Beverly Hills homes according to a summary document obtained exclusively by The Beverly Hills Courier. The document, entitled “Westside Subway Extension Final EIS/EIR – Century City Station Analysis” presents three different
station locations, two on Santa Monica Boulevard and one at Constellation and Avenue of the Stars. The Constellation station location is the focal point of controversy within Beverly Hills as that location calls for the tunnel under Beverly Hills High School. The two locations on Santa Monica Boulevard include the original MTA location at Avenue of the Stars and the second loca(see ‘MTA,’ page 12)

BHUSD Adds Washington D.C. Power Player To Protect BHHS From The Westside Subway Tunnel By The Courier Staff The Beverly Hills Unified School District Board of Education (BHUSD) has retained another national legal powerhouse, the Washington D.C. firm Venable, as its lobbyist in the nation’s capital in the battle with the Metropolitan Transit Authority (MTA) about the proposed tunnel under Beverly Hills High School. Heading the Venable effort is James Burnley who served as the U.S. Secretary of Transportation from 1987 to 1989 under President Ronald Reagan and is one of the nation’s foremost authorities on transportation law and policy. He also served as deputy Secretary of Transportation from 1983 to 1987 and was general counsel of the department in 1983. Venable has agreed to extend a substantial fee reduction for its services according to District sources.
Venable joins Alston & Bird and Hill, Farrer & Burrill as special counsel to the district. To date, MTA has failed to provide seismic and other data to the BHUSD although it has made such information available to other interested parties. The Beverly Hills City Council to date has refused to take issue with the MTA over the proposed tunnel under BHHS. The Council liaison committee of Mayor Barry Brucker and Vice Mayor Willie Brien have instead advocated a quiet approach of persuasion and offers of expedited staging approvals for subway construction through Beverly Hills. Despite these efforts, MTA continues to move towards the BHHS tunnel route. The City Council, however, just approved retention of a lobbying firm to enhance its persuasion efforts with the MTA. The BHUSD Board of Edu-
cation has made clear its intention to contest the MTA in court and in the halls of Congress if it decides to pursue the BHHS tunnel route in the 70 percent federally-funded project. No subway tunnel has ever been built below a public school in California. The District’s engineering experts have told the District that a tunnel under BHHS will likely kill any new construction. The City Council has not taken an official position opposing the BHHS tunnel route. Both the BHUSD and the city support the Westside Subway Extension to Santa Monica but the BHUSD may withdraw that support if it means jeopardizing the BHHS campus. The tunnel route is favored by Century City developers with close ties to L.A. Mayor Antonio Villaraigosa who has the largest representation on the MTA board.

National Veterans Park Rose Garden Nears Official Opening By Tricia Arend The Los Angeles-based Veterans Park Conservancy (VPC) is getting ready to draw more than just hummingbirds, butterflies and native wildlife to its newly renovated Women’s Rose Garden in the boundaries of the West L.A.’s Veterans National Park. After two years of renovations, the garden, one of several renova-
tion plans for the 16 acre parkland, is preparing for its official opening for veterans and their families. Nearing completion, the Women’s Rose Garden, established in 1941, features a wishing well from 1945 for casting wishes for peace and tables and chairs for veterans to play games upon. Jeffrey Hubbard’s Lawyer Subpoenas BHUSD By Marla Schevker A motion to sever the case of former Beverly Hills Unified School District (BHUSD) Director of Planning and Facilities Karen Christiansen and former BHUSD Superintendent Jeffrey Hubbard was granted by Judge Stephen Marcus last Friday.
At the hearing, Judge Marcus granted the motion for the ruling saying there were no common counts and there would be no common evidence. At the hearing, Hubbard’s lawyer Salvatore Ciulla mentioned to Judge Marcus that he
had filed a subpoena with the BHUSD, alleging he did not receive the documents nor receive any response. According to the objections, filed by Quinn Emanuel attorneys on April 14, Ciulla requested e-mails between Hub(see ‘HUBBARD,’ page 17)
Assembly Health Committee Approves AB 52 The Assembly Health Committee has approved Assembly Bill 52 on a vote of 12-7. The measure, authored by Assembly members Mike Feuer of Los Angeles and Jared Huffman ofSan Rafael, would protect consumers and businesses by empowering state regulators to reject excessive health insurance rate increases. Introduced in December,
AB 52 would require health plans and insurers to seek approval from state regulators prior to raising health care premiums, copayments, deductibles or other out of pocket costs. It would build upon newly-implemented federal and state laws improving the health insurance rate filing and review process. In 2010, Feuer and then-
Sacramento Assemblymember Dave Jones jointly introduced a far-reaching plan to establish a permanent rate review and approval process after a similar proposed rate increase by Anthem Blue Cross. That measure was ultimately defeated in the Senate. AB 52 will next be heard in the Assembly Appropriations Committee.

urther downtown is the Geffen Contemporary’s successful exhibition of graffiti (Art in the Streets), the first show from MoCA’s new director Jeffrey Deitch. Reading New York Times Guy Trebay’s profile last weekend, we noted that Jeffrey has a background in finance, having earned an MBA at Harvard. Acclaimed political writer and now New York Times’ LA bureau chief Adam Nagourney reports on the controversy surrounding Jeffrey’s graffiti exhibition that “conveys legitimacy to what some people see as vandalism … walk a block away and that scrawling will land you in jail.” In New York, meanwhile, Theodora Richards, gorgeous daughter of Keith Richards and model Patti Hansen, was nailed for scrawling graffiti on a convent wall and penalized with community service during her court appearance.

On a recent visit to Ireland, Kate sported a stone colored Burberry trench coat that subsequently sold out across the United Kingdom by the day’s end. Similarly a black velvet coat by Libelula (another favored designer) sold out within hours and the company had to create a waitlist for the hundreds of disappointed buyers. MODERN DAY INVENTORS — Former Beverly Hills residents Sam Friedman andAlex Israel have developed a phone application available for free on their Web site that provides real-time parking data for off-street parking.
Phone App Finds Parking Spots For You Finding a parking spot in Los Angeles’ overcrowded garages has never been easier, thanks to two former Beverly Hills residents. Alex Israel, 27, and Sam Friedman, 26, developed the idea to create a program for drivers to find parking in an area they are heading after experiencing the aggravation of searching endlessly for parking spots at their Los Angeles destinations, such as near Beverly Hills’ Golden Triangle. “It was birthed out of frustration of not being able to find a parking spot,” Friedman said. “So we said let’s solve this.” The progress began by walking around cities such as Beverly Hills looking for signs identifying the location of garages. Three years later, Friedman and Israel have managed to create a database of parking information across North America, Canada and Europe complete with locations of parking garages, rates, hours of operation and availability, all of which can be ac-
cessed by downloading their free Parking In Motion (PIM) application. The application recently became available for download just last month, and a significant number of users have already accessed it to aid in their personal parking dilemmas, the duo said. “We’re saving the world one parking spot at a time,” Israel stated. PIM offers real-time parking data for off-street parking through GPS and smart phone applications. Their 15-person company, based in Santa Monica, is hoping to expand on the application by adding the ability to pay for parking from one’s phone and reserve a spot in the future at all lots in their database. “PIM is not going to make parking more available, but will help you find parking,” Friedman explained. The time to sign up is not after the earthquake happens or as the fire is racing down the canyon. The time to sign up is now.” Mottice-Muller advises residents to add their contact information to the database to be alerted to potentially dangerous situations if they are at work, out shopping or at any location away from their residence. Individuals can also sign up to volunteer during emergencies, and those who are interested will be notified and asked to help out by passing out water and supplies, serving food or helping with medical needs, she said. Contact information provided to the City is kept confidential. All information sent from the Emergency Mass Notification System will begin with an automated message and will come from the City’s Disaster Hotline, caller-ID number (310) 550-4680. Emergency notifications sent out in the past have included announcements of lost children, crimes in progress and fire evacuations, but other alerts could include water, sewer and gas main breakages, contamination issues, unexpected road closures, earthquake evacuations, hazmat situations and notifications of protests or marches, MotticeMuller stated. Board member Steven Fenton said he believes a preschool within the BHUSD would give new families another reason to move within Beverly Hills and send their children to public school. He said he believes if a child starts early in the BHUSD, they are likely to stay through high school. “Our school district needs a preschool and it should be built in the south part of our City,” Fenton said. “When young families are considering a move to Beverly Hills, they're usually thinking the south part of our town. In order to be competitive with Westwood, Beverlywood and Beverly Hills Post office for these families, we need to stack the deck and offer them something they can't get anywhere else. A world class pre school and a world class elementary school just blocks away from their new home.”

Fenton said he believes the difficulty comes from Brucker’s inability to put his personal grievances aside. “At the end of the day, I think he's having trouble getting past a number of things,” Fenton said. “First, the last two school board elections. His hand picked successor and best friend lost her election to Lisa. Another candidate heavily backed by Barry lost her election to Brian. “Second, when Barry was a school board member he voted to hire and promote Jeff Hubbard to Superintendent. Karen
Christensen was brought into the district on Barry's watch as well.” “Third, Barry vehemently supported opportunity permits while opposing legacy permits for the grandchildren of longtime Beverly Hills residents." Board member Myra Lurie said Brucker was an advocate for the BHUSD during the last JPA negotiations and the next JPA has yet to be negotiated with the City. “I don’t think this is the time to start insulting people or acting in a disrespectful manner,” Lurie said during the discussion. “It might be received as insulting and offensive.” Fenton said he believes new City faces on the committee might “kick start” the relationship, which he believes is suffering. He suggested writing

The program started as a well-intentioned plan to reduce commuter traffic on the theory that the same work could be accomplished by the number of hours. In practice it leads to the need for more staffing so
that City Hall can function each day and that in turn requires higher staff costs and higher pension obligations. Used to its maximum, the policy means 26 paid days off per staff member per year. That alone is the equivalent of over five weeks paid vacation – all for just checking in a little earlier (or maybe shortening lunch) and leaving a little later. Make that arrive at 8:30 a.m. and leave at 6:20 p.m. and you’re there. This is in addition to na-
tional and state paid holidays (14), the minimum of two to four weeks of paid vacation (10 – 20 days), and each City employee under the plan can have as many as fifty paid days off per year, or ten weeks paid vacation, or more. That is onefourth of the entire work calendar. The City Council must address our anticipated $5 million “deficit” and is proposing “furlough days” – days off without pay. Last year, that led to some protests by city workers.
No councilmember has addressed the 9/80 policy and its impact on city services or staffing levels. The City will begin it’s public review of the 2011/2012 FY budget process next week with the first of three public study sessions. noise and vibration and “Why Operate Under Private Property.” Another page shows the various routes between Beverly Hills and Westwood. The route marked “direct connector” which avoids the BHHS tunnel would appear to be the best route but is not supported by the narrative portion. The report states that the final decision will be made by
the MTA board in “Summer/Fall 2011” with the final report due in Fall 2011. The Courier asked MTA Spokesman Dave Sotero if any final documents had been produced and he pointed to the MTA website as having all of the up-to-date information. He also said the newest information was from the community input meetings last month. The Beverly Hills Unified School District is contesting the proposed route under BHHS.
Super Producer Roger Gimble Dead At 86
Prolific producer Roger Gimble died from pneumonia Tuesday at Cedars-Sinai Medical Center with his wife of 34 years, actress Jennifer Warren and son Barney at his side. He was 86. Born in Philadelphia, he attended Yale and after serving in the Air Force, eventually joined NBC, becoming a producer of The Tonight Show with Jack Paar. Moving to Hollywood, his 500 productions won 18 Emmys. A private family service and interment will be held on Sunday. He is also survived by sons Sam and Mark, daughter Liza and two grandchildren. In lieu of flowers, family suggests donations to Doctors Without Borders.

St. John’s Angels Of The ER Recognized By American Hospital Association St. John’s Health Center’s Angels of the ER program was one of only four hospital volunteer programs in the U.S. honored by the American Hospital Association’s (AHA) 2011 Hospital Awards for Volunteer Excellence (HAVE). The AHA HAVE Awards, now their 28th year, highlight the efforts of volunteer programs and the impact their contributions have on patients, hospitals, health systems and communities they serve. “Winning this prestigious award is such an amazing honor for our volunteers, St. John“s and the Sisters of Charity of Leavenworth Health System,” said Grenda Pearlman, director of Volunteer Services at St. John’s. “I have always known that our Angels of the ER program was special; that’s what prompted me to nominate it for the AHA HAVE Award. I am blessed to be a part of this program.” Angels of the ER was created almost 10 years ago after ER Medical Director Russ Kino, M.D., became aware that extended wait times and other issues in the Saint John’s ER were impacting patient satisfaction. A volunteer group called the Irene Dunne Guild formed the Angels to provide comfort and support to patients awaiting treatment. As liaisons between patients and medical staff, the Angels offer a friendly smile, a sympathetic touch and a listening ear. Sensitive to the emo-

Just yesterday, one of the ER nurses stopped me in the hall to tell me how much the Angels are needed and appreciated. Landmark 5,000th Liver Transplant Performed At UCLA The Dumont-UCLA Transplant Center, one of the nation’s leaders in solid organ transplantation, performed its 5,000th liver transplant last year, making it only the second program in the world to reach this milestone. The operating room team was lead by Dr. Ronald W. Busuttil, distinguished professor and executive chairman of the department of surgery at the UCLA’s David Geffen School of Medicine, and chief of the division of liver and pancreas transplantation. The patient was a Los Angeles-area man in his late 50s. Busuttil, an internationally known liver surgeon who also serves as the director of the Dumont-UCLA Transplant Center and the Dumont-UCLA Liver Cancer Center, noted that a team-based, multidisciplinary approach provides the highest level of care for patients. As a result, his team includes more than 100 surgeons, physicians, nurses and other professionals. “These 5,000 liver transplants reflect the work of our incredibly dedicated team here at UCLA and also underscore the importance of organ donation for the many thousands of patients who await the gift of life,” Busuttil said. “I could not be more proud of what we have accomplished together thus far—saving lives. That’s what it’s all about.”
This year alone the program’s surgeons have performed more than 200 liver transplants. Nearly 600 patients are on the UCLA waiting list. The UCLA liver transplant program, one of the first five in the nation, was established in 1984 by Dr. Busuttil, who has directed the program from its inception. Since that time, the Dumont-UCLA Transplant Center has become one of the largest and most respected programs in the world in the areas of research, education and patient care. Housed in the Pfleger Liver Institute, the Dumont-UCLA Transplant Center combines innovative surgical technique, advances in immunosuppressive drugs and multidisciplinary clinical care to save the lives of thousands of adults and children with end-stage liver disease. The program has trained more than 250 transplant surgeons and physicians, many of whom currently lead top centers in the US and abroad. NCI Awards $1.7 Million To CHLA Cancer Specialist Fatih Uckun, MD, PhD, head of Translational Research in Leukemia and Lymphoma at the Children’s Center for Cancer and Blood Diseases at Children’s Hospital Los Angeles (CHLA), and a research professor of Pediatrics at USC’s Keck School of Medicine, has been awarded $1.7 million from the National Cancer Institute (NCI) to support development of a new strategy to overcome the resistance of cancer cells to radiation therapy. In spite of promising advances in some forms of cancer, especially childhood leukemia, the overall progress in cancer therapy has remained modest because of the resistance of cancer cells to contemporary radiation and chemotherapy regimens. A team of researchers led by Dr. Uckun, an investigator at The Saban Research Institute and a member of the Developmental Therapeutics Program of the USC Norris Comprehensive Cancer Center, recently discovered that radiation-resistant cancer cells can be made radiation-sensitive by specifically inactivating a molecular target made up of three important signaling

proteins, namely polo-like kinase 1 (PLK1), spleen tyrosine kinase (SYK) and STAT3 transcription factor. The group’s translational research shows that rationally designed inhibitors of this molecular target markedly improve the potency of radiation therapy in animal models of radiation-resistant cancer. With an earlier $2.5 million dollar grant from NCI and the support of the National Cancer Institute Alliance for Nanotechnology in Cancer, Dr. Uckun (see ‘CANCER,’ page 15)

Both the ophthalmology and oncology practices will provide a complete range of subspecialties to deliver comprehensive diagnostic and treatment services. and his team have been developing nanoparticle formulations of these inhibitors as promising drug candidates against cancer. The goal of this new grant is to allow Dr. Uckun to further optimize the clinical potential of his innovative strategy as part of a multidisciplinary effort to overcome radiation resistance of cancer cells. In addition, Dr. Uckun and colleagues will try to identify so-called “biomarkers” that will help clinicians predict which patients would be most likely to benefit from this new strategy. “Our long-term goal is to develop biomarker-guided, personalized radiation therapy regimens that are both more effective and have fewer side effects,” said Dr. Uckun. The main therapeutic target for this five-year research project will be the most aggressive and radiation-resistant forms of childhood leukemia and will include detailed efficacy and safety studies to evaluate clinical potential of the lead experimental anti-cancer drug candidate.

arrangements with the Department of Veterans Affairs (VA) to revitalize Los Angeles National Veterans Park’s 16 acres of parkland, located at the north east corner of Wilshire and San Vicente Boulevards, said Gary Maier, president of the VPC board. “It makes the community and veterans feel proud,” he said. “It if wasn’t for our private organization with this vision to do these things, it wouldn’t have happened.” Following the installation of a plaza area and pilaster and wrought iron fence at the property’s border, the VPC turned to the renovation of the Women’s Rose Garden, a $1.4 million project which commenced in 2009. “The garden was neglected and in total disarray,” Maier said. “The federal government had no money to rebuild. It’s a big project.” Only a few original ele-
ments still exist in the current rose garden, including the adobe walls surrounding the garden, which were built by American Indians in the 1890s, and the star fountain, 1945 wishing well and fichus trees. Minor additions, such as security lighting, still need to be added, but the completion of the Women’s Rose Garden is on time, Maier said, adding the official opening will be decided upon by the VA. The rose garden was built in conjunction with the support of the VA, who will be responsible for maintaining the garden, Young said. Within the next eight to 10 weeks the VA Hospital is expected to transfer certain therapeutic programs, such as tai chi, to the first and second floors of a building adjacent to the garden so patients can enjoy their programs outdoors in a soothing environment, she added.

Prince said the One Campaign is an urgency campaign, which will fundraise for employee salaries only. The One Campaign starts on May 1 and coincides with the BHUSD Teacher Appreciation Week. The BHEA assisted the BHEF in compiling an envelope that will not only go out to every student at every school but throughout the community explaining what the One Campaign is and why people should donate. K-8 students are required to bring back the envelope signed whether their parents donate or not. That way if the One Campaign falls up short, the parents will know why pro-
grams have disappeared, Prince said. The One Campaign is not a replacement for BHEF and PTA fundraising, said Prince. It is an emergency campaign to raise additional funds and gather the community together to save something important. Prior to its official launch, the One Campaign raised just short of $60,000 from donors at the Apple Ball. Those donations save at least one position in the BHUSD and does not include donations from other organizations who have promised to donate like the Beverly Hills Fire Department, PTA Council, individual PTAs or BHEA.

She immediately felt compelled to help the organization’s singular mission in developing countries around the world. Long involved in charitable causes and passionate about sharing the gift of music, Kolesnikova began working on her Oksana & Friends music collection CD to support Smile Train’s work. Kolesnikova, who tours internationally and currently performs five days a week at City venues, has recorded seven CDs that include collaborations with other international musical artists. Los Angeles Jewish Film Festival Returns For Week Of Feature, Doc Screenings
An opening night gala featuring a screening of An Article of Hope, a documentary about Israeli Air Force Colonel Ilan Ramon and the six other astronauts who perished aboard the Space Shuttle Columbia, will kick of the sixth annual Los Angeles Jewish Film Festival on Thursday, May 5. The evening will begin with arrivals at 7 p.m. with screenwriter/director Antwone Fisher, actress Mare Winningham, actor, Charlie Shlatter, screenwriter Warren Lewis (Black Rain) and comedian Steven Allan Green set to attend. The film will screen at 8 p.m. at the Writer’s Guild Theater, 135 S. Dohney Dr., followed by a desert VIP reception. Director Dan Cohen will also take part in a Q&A along with top space expert Peter Diamandis, founder and chairman of XPrize and the International Space University. whose actions and reactions soothe his every outburst. She is wonderful and is the perfect foil for her husband, Mel. The special Simon humor continues when Mel loses his job. He slowly starts to descend into a state of mini-lunacy. The brilliant repartee between Mel and Edna gets an unwelcomed respite as his three sisters, Carole Ita White, Annie Korzen and Deedee Rescher along with his successful brother Harry (Ron Orbach) arrive to bring him understanding, a bit of compassion and money. All are terrific, but there is a void when Mel and Edna are not on stage together. When they leave, Mel and Edna are left to bring the play to its hilarious conclusion. Aside from Alexander “the great” and Gina Hecht, special mention must be given to Glenn Casale whose direction is sure handed and deserving of praise. 3-1/2 bagels out of 4

A 1925 Rolls Royce, one of the jewels of the collection, and a 1939 Bugatti Type 57C by Vanvooren, originally owned by the Prince of Persia Mohammed Reza Pahlavi, were included among the 135 cars donated.

the tutelage of his wicked Uncle Warnock in a sludge factory. The children were enthralled to hear the tale and to understand how the author came up with his story. INTERIM ORDINANCE OF THE CITY OF BEVERLY HILLS PROHIBITING HIGH IMPACT CONVENIENCE STORES UNLESS SPECIFICALLY APPROVED BY THE CITY, AND DECLARING THE URGENCY THEREOF. THE CITY COUNCIL OF THE CITY OF BEVERLY HILLS HEREBY ORDAINS AS FOLLOWS: Section 1. On April 5, 2011, the Director of C o m m u n i t y Development recommended that the City Council study the City’s regulations regarding
the operation and development of convenience stores. Section 2. The Director has reported that prohibiting high impact convenience stores, as defined below, is necessary to protect against an immediate threat to the public health, safety or welfare and to avoid a conflict with any future potential regulation. The Director has also recommended that the interim ordinance include discretionary review in order to allow certain convenience stores to be approved during the interim ordinance period if the Planning Commission, after reviewing the specific project, can make the findings set forth in Section 8 below, thus concluding that the convenience store will not adversely affect the public health, safety or welfare. Section 3. The impacts of high impact convenience stores, which primarily serve commuters, differ from the impacts of neighborhood convenience stores, which primarily serve local residents and pedestrians. Without regulation, high customer turnover and the vehicle-focused nature of high impact convenience stores will likely result in increased localized traffic, parking problems, and unwanted commercial intrusions into established residential neighborhoods. Associated impacts may include commercial parking on residential streets, increased litter, and excessive noise that would deteriorate the quality of life for those in the immediate vicinity. In addition, high impact convenience stores would not promote the City’s brand and for the reasons discussed above would harm neighborhood character. Section 4. Section 65858 of the California Government Code authorizes the adoption of an interim ordinance as an urgency measure to prohibit any usage of land that may be in conflict with zoning proposals being considered or studied by a legislative body, Planning Commission, or Planning Department. Section 5. In light of the findings stated in Section 3, the Council has directed staff to prepare an interim ordinance to prohibit high impact convenience stores, allowing them only pursuant to a convenience store conditional use permit. Section 6. Pursuant to Government Code Section 65858, the City Council finds and determines that the immediate preservation of the public health, safety, and welfare requires the adoption of this interim Ordinance. As described in Section 3, high impact convenience stores pose a significant threat to the health, safety and wel-
fare of the community. Without regulation, the high customer turnover and the vehicle-focused nature of high impact convenience stores will likely result in increased localized traffic, parking problems, and unwanted commercial intrusions into established residential neighborhoods. Associated impacts may include commercial parking on residential streets, increased litter, and excessive noise that would deteriorate the quality of life for those in the immediate vicinity. The City Council finds that allowing the unregulated development of high impact convenience stores during the City’s consideration of how to properly regulate such stores would result in the negative impacts described above, would erode the existing character of the City’s neighborhoods and would frustrate the purpose of any regulations ultimately adopted. To ensure that the development of convenience stores during this period of study is consistent with the goals and objectives of protecting the City’s character, the City Council finds it necessary to adopt this Interim Ordinance to both respect property rights and protect the public health, safety and general welfare. Absent the passage of this interim Ordinance, inconsistent development of high impact convenience stores poses a current and immediate threat to the public health, safety, or general welfare, and approval of additional entitlements for any development inconsistent with the provisions of this Ordinance would frustrate the City’s ability to protect the public health, safety, and welfare. Therefore, this Ordinance is necessary for the immediate preservation of the public peace, health, safety and welfare and its urgency is hereby declared. Section 7. The City Council hereby finds that it can be seen with certainty that there is no possibility that the adoption and implementation of this Ordinance may have a significant effect on the environment. This Ordinance does not authorize construction and, in fact, imposes greater restrictions on certain development in order to protect the public health, safety and general welfare. This Ordinance is therefore exempt from the environmental review requirements of the California Environmental Quality Act (CEQA) pursuant to Section 15061(b)(3) of Title 14 of the California Code of Regulations. Further, this Ordinance is exempt from CEQA on the separate and independent ground that it is an action of a regulatory
BEVERLY HILLS agency (the City) for protection of the environment because it will protect residential neighborhoods and commercial uses from impacts associated with intensification of commercial uses, and thereby qualifies as a Class 8 exemption pursuant to Section 15308 of Title 14 of the California Code of Regulations. Section 8. No lot, premises, building, or portion thereof in the City of Beverly Hills shall be used for any “high impact convenience store” as that term is defined in Section 9 of this Ordinance, unless the City issues a convenience store conditional use permit. The City shall process an application for a convenience store conditional use permit in the same manner that it would process an application for a conditional use permit pursuant to Article 38 of Chapter 3 of Title 10 of the Beverly Hills Municipal Code. The City may impose any conditions on a convenience store conditional use permit that are necessary to preserve the public health, welfare or safety, or to mitigate any potential adverse impacts resulting from the establishment of a high impact convenience store. The City shall not approve a convenience store conditional use permit unless it makes each of the following findings: 1. The proposed use is compatible with the surrounding area and uses; 2. The proposed use will have adequate buffering between the use and residential areas, schools, parks, and other locations where children gather; 3. The proposed use will not create an adverse traffic impact or a traffic safety hazard to pedestrians or to vehicles, including, but not limited to, an adverse impact on traffic circulation or parking; 4. The proposed use will not create excessive noise, unpleasant odors, noxious fumes, excessive lighting, increased litter, or substantial interference with neighboring properties or uses due to the activities associated with the proposed use or its hours of operation; 5. The proposed use will not create an overconcentration of convenience stores in the area. Section 9. For the purposes of this Ordinance, “high impact convenience store” shall be defined as follows: “High Impact Convenience Store: Any retail store with the following characteristics: (1) more than half the square footage is dedicated to the sale of general food and drink products not intended for home preparation and consumption, tobacco, magazines, and toiletries, (2) the store is open to customers before 7:00 a.m. or after 9:00 p.m., Monday through Friday or before 9:00 am or after 9:00 pm
on Saturday or Sunday, and (3) meets one of the following – is served by on site surface parking or located within three hundred feet of a residential zone.” This Section 10. Ordinance, being an Interim Ordinance adopted as an urgency measure for the immediate protection of the public safety, health, and general welfare, containing a declaration of the facts constituting the urgency, and passed by a minimum four-fifths (4/5) vote of the City Council, shall take effect immediately upon its adoption, and remain valid for forty-five (45) days, unless extended in accordance with Government Code Section 65858. Section 11. Severability. If any section, subsection, subdivision, sentence, clause, phrase, or portion of this Ordinance or the application thereof to any person or place, is for any reason held to be invalid or unconstitutional by the final decision of any court of competent jurisdiction, the remainder of this Ordinance shall be and remain in full force and effect. To the extent that the discretionary process to approve a convenience store conditional use permit, or any part thereof, is determined to be invalid, the prohibition against high impact convenience stores shall remain valid. Section 12. The City Clerk shall cause this Ordinance to be published at least once in a newspaper of general circulation published and circulated in the City within fifteen (15) days after its passage in accordance with Section 36933 of the Government Code, shall certify to the adoption of this Ordinance and shall cause this Ordinance and his certification, together with proof of publication, to be entered in the Book of Ordinances of the Council of this City.
