NEW WAY OF WORKING AT SELLAFIELD

A new era for the Sellafield supply chain has arrived with the signing of the Design Services Alliance (DSA) contract and announcement of supply chain companies to deliver it through the AXIOM and Progressive Alliance joint ventures.

new procurement approach at Sellafield, the Over Arching Acquisition Strategy (OAAS), supports the commitment by PBO Nuclear Management Partners (NMP) to accelerate the decommissioning of the high-risk, high-hazard facilities at Europe’s largest nuclear facility. The launch of the DSA, the first contract to be let in this way, marks a significant milestone for Sellafield and the nuclear industry in the UK. Through the OAAS, the DSA contracts see Sellafield establish true alliance-style framework agreements with their suppliers as they undertake the important task of cleaning up and decommissioning the complex nuclear site. The expectation is that by working collaboratively with major contractors like those who form the DSA, Sellafield Ltd will be able to deliver greater quality more efficiently – while assuring industry-leading safety performance. Explaining that the previous procurement process wasted too much time, sacrificed retention of knowledge and relationship, and consequently increased total cost, John Sidney, Head of Supply Chain Strategy for Sellafield Commercial says: “The OAAS will drive value for money and alleviate the concern of small, local suppliers that fear being frozen out of large, 4

long-term contracts. It will develop longterm, collaborative relationships to enable delivery of programmes and projects ahead of schedule and under budget.”

Through the use of longer-term contracts, up to 15 years, the DSA will provide the supply chain with planning opportunities for staff development and encourage investments in local infrastructure and resources. Director of Commercial for Sellafield Ltd, Keith Case explains: “We are changing the way we acquire goods and services. Effective supply chain engagement through long-term, collaborative alliances through the OAAS is key to delivering and exceeding commitments made in our performance plan. The security offered by the length and value of the contract will encourage partnership working between us, as customer, and AXIOM and Progressive Alliance, as our suppliers, alongside stability and certainty for the supply chain.”

Six arrangements worth up to £9 billion are planned under the OAAS. Tenders are currently under assessment for the Infrastructure Services Alliance (ISA), focused on supply of utilities, maintenance of infrastructure and asset management. Valued at £1 billion, contract award is expected during October 2012. The Decommissioning Technical Programme Partner (DTPP) will launch with an industry day in Autumn 2012, followed by the Major Projects Delivery and the Production Operation Asset Care Partner (OTPP) competitions into 2013. The DSA framework, potentially worth up to £1.5 billion over 15 years, provides Sellafield with access to the full range of multi-disciplined engineering services – civil and structural, mechanical, control and instrumentation, and process – for the development and refurbishment of new and existing facilities and for decommissioning at the West Cumbria site. The contract is structured across four capability areas, including mechanical handling; process plant; control, electrical and instrumentation (CE&I); and civil, structural and architectural (CS&A) systems. It will deliver design, engineering and safety case assessments to a range of different project types.

The two companies have agreed how Rolls-Royce, the global power systems company, will support the delivery of AREVA’s EPRTM reactor in the UK and internationally. This builds on the significant progress made since their initial agreement in March 2011. Rolls-Royce will manufacture complex components and provide engineering and technical services for the first of two EPRsTM to

be built at Hinkley Point, Somerset, where AREVA is providing the nuclear steam system. The deal was announced as the UK and France launched a new co-operation agreement on civil nuclear development. Rolls-Royce has broad nuclear experience, a strong track record and an extensive nuclear certified supply chain. Oldbury Shuts Down After Four Decades of Safe Generation

Croft Welcomes Cautious Change in NDA Strategy Towards Self-Shielded Boxes

The world’s oldest operating nuclear power station, Oldbury near Bristol, finally stopped producing electricity on 29 February, after 44 years of safe generation.

With decommissioning being ramped up and increasing onus being placed on cost-efficiency as well as safety, Croft Associates, one of the UK’s leading designers of containers for the safe transportation and storage of radioactive waste, has welcomed the broadening attitude towards the management of radioactive waste.

Since it opened in 1967, Oldbury’s twin reactors have generated 137.5 TWh of electricity – enough to power one million homes for over 20 years. Site director, Dr Phil Sprague of Magnox Ltd said: “This fantastic record is one that all the staff both past and present can be rightly proud. Today marks a safe and dignified end to the generation of electricity at Oldbury.” Preparations are underway to start the decommissioning process, meanwhile the continued future for nuclear in Gloucestershire looks optimistic with Oldbury named as a potential site for a new reactor.

Luc Oursel, CEO AREVA, said: “Since our original commitment in March, we have widened and deepened the scope of our cooperation. Today’s agreement indicates how far we have travelled. We look forward to working with RollsRoyce across a range of opportunities.”

In December the Nuclear Decommissioning Authority (NDA) issued its draft Integrated Waste Management Strategy Development Programme which articulates the work required to develop a comprehensive NDA Integrated Waste Management Strategy which includes the use of disposable robust selfshielding containers. Croft currently supplies both Sellafield and Dounreay with standard packaging designs and bespoke solutions that help the sites ensure that radioactive materials and waste are safely packaged, contained and, where necessary, transported. Croft has designed and is setting up to produce robust containers made from ductile cast iron.

GIANT TRANSPORTER BRINGS INCREASED EFFICIENCY AT BRADWELL A new cross-site transporter has arrived at Bradwell, making it easier to carry out heavy lifting movements on the site.

he new machine, delivered from Holland in November 2011, is the largest of its kind in Europe. Manufactured by Terberg DTS, it is a unique design built on a Terberg FM 2850 chassis fitted with a Fassi F1500AXP.24 truck-mounted crane. Body modifications such as positioning of axles and components were made to suit the specific ground-loading requirements of Bradwell’s operations. The transporter arrived just in time to handle the latest batch delivery of ductile cast iron containers (DCICs), whose unloading requires the utmost precision. It can lift 30 tonnes at 3.5 metres and 10.3 tonnes at 11.3 metres; it can carry a 20-foot container on its load-bed as well as the DCICs, which are specifically

positioned and locked in place to ensure correct axle loadings.

Owning the machine on-site means greatly increased speed in response and far less reliance on off-site contractors. This together with its multi-role capability and manoeuvrability (avoiding the need to adapt the infrastructure) will mean much more flexibility and cost efficiency for Bradwell as accelerated decommissioning continues.

Management of Ageing: A Framework for Nuclear Chemical Facilities

Horizon Completes Purchase of NDA Land at Oldbury-on-Severn

A research report has recently been published on the management of ageing at nuclear chemical facilities. Prepared by TWI Limited, the report focuses on the skills required by individuals and organisations and the processes needed to implement effective management of ageing of all assets in nuclear chemical facilities.

Horizon has announced that it has completed the purchase of land which is key to the development of its proposed new nuclear power station near Oldbury-on-Severn in South Gloucestershire.

Ageing occurs to all items in nuclear chemical facilities and as a result, the ageing of all assets should be considered and managed effectively. Special attention should be given to those items that are critical to safety and production within a plant, specifically those with serious consequences attached if ageing is not managed effectively. The report is intended as a useful resource for anyone involved in assessment of ageing at nuclear chemical facilities. The report is not an official guidance document, but there is a large amount of practical information included on all aspects of ageing management.

In addition to their ongoing recruitment, the Office for Nuclear Regulation (ONR) has been given the go-ahead to recruit for 80 nuclear safety inspectors over the next two years, to give the resources they need to regulate the nuclear industry and its increasing activities. The first phase of this year’s campaign to recruit 40 safety inspectors has gone live, with advertising across a number of specialist trade publications and online. Prospective candidates can view vacancies via ONR’s recruitment website (http://www. youprotectpeople.co.uk/) and will be able to see more detail about the additional roles on offer. Nuclear inspectors are expected to be capable of undertaking a variety of roles: • Inspecting sites; • Assessing technical safety cases; • Investigating incidents;

The land is being purchased by Horizon Nuclear Power Oldbury Limited from the Nuclear Decommissioning Authority (NDA), under terms agreed in the 2009 land auction. Horizon is working towards a total development of around 6GW of secure, affordable low-carbon energy across its two sites – Oldbury and Wylfa on Anglesey in North Wales - which could mean thousands of jobs for UK workers. Horizon Chief Operating Officer Alan Raymant commented: “Completion of our land purchase at Oldbury is another important step for our project and means that we can look forward to developing a strong and successful project in South Gloucestershire.”

Harwell Land Delicensed Some six hectares of land at Harwell, the UK’s first nuclear site, have been delicensed by the Office for Nuclear Regulation (ONR) at the beginning of this year (January 2012), marking a significant achievement within the decommissioning programme at the site. The Harwell site is being decommissioned and restored by Babcock-owned site licence company RSRL. Extensive surveying and sampling work was carried out to demonstrate that this latest tranche of land was suitable for delicensing. The closure programme at Harwell focuses on progressive hazard reduction by processing radioactive waste, decommissioning facilities and remediating land. This includes making radioactive waste passively safe, decommissioning redundant nuclear facilities, remediating contaminated land and groundwater, demolishing redundant buildings, and delicensing the site. This is an important milestone in the programme, and means that 20% of the Harwell site has now been successfully cleaned up and restored.

DARCHEM ENGINEERING UNVEIL A global growth in nuclear power offers a great opportunity for North East Engineering, said a former business minister on a visit to the region.

ord Hutton was visiting Darchem Engineering, based at Stillington, Stockton on Tees in his role as chairman of the Nuclear Industry Association along with Keith Parker, Chief Executive of the Nuclear Industry Association. During his visit, Lord Hutton who was business minister in the Labour government, opened Darchem Engineering’s new Nuclear Exhibition Centre which will enable Darchem to showcase its work to potential customers. Increased popularity for nuclear power has seen Darchem increase its presence in the nuclear sector in the past 18 months, having originally specialised in fire protection and insulation systems for nuclear facilities for several decades.

As work in the nuclear market decreased in the last 25 years Darchem diversified into other markets such as the Aerospace, Oil and Gas, Naval and Marine and Automotive sectors. Darchem has worked continuously in the nuclear field supplying to countries such as China, Korea and several European countries, both on nuclear new builds and plant life extension projects. Darchem’s resurgence in the nuclear market comes as 61 reactors are

being built worldwide including eight new nuclear power stations in the UK. Lord Hutton said: “People who are going to manufacture these reactors will be looking for companies that have the experience, expertise and skills and Darchem has all of this with experience going back to Sizewell B. We need skilled engineering jobs and companies like Darchem are very well placed to benefit and bring jobs to the region. This is a great opportunity.”

NUCLEAR EXHIBITION CENTRE Graham Payne, Managing Director of Darchem, said: “The new exhibition centre gives us the ability to show our customers the full range and capability that we have here at Darchem and our full fabrication and insulation capabilities in the nuclear market. It demonstrates our pedigree of nuclear work in the last 40 years, not only on civil contracts but military contracts too.” Earlier this month Darchem announced that it had won a multi-million pound contract in the nuclear sector, which would create 20 jobs taking employee numbers at the Stillington factory to 650, an increase of 100 since the middle of last year. Darchem recently announced plans to build an £8 million facility in Stillington, creating 100 jobs specifically to service the growing nuclear sector.

At Capula we have recognised this and are progressing a recruitment and training programme that is expected to see the number of SQEP control and IT engineers with nuclear experience double by the end of this year and continue to grow to more than 250 by the end of 2013. UNIQUE HANDLING SOLUTION HELPS NUCLEAR DECOMMISSIONING PROCESS AT DUNGENESS

decommissioned under the management of Magnox Limited, which operates the Magnox Dissolution (MXD) plant. One facility to be cleared was a pair of splitter vaults that contained around 30 tonnes of fuel element lugs. These are fin-shaped outer casings of spent fuel elements that had been placed in the vaults after they had been removed from the fuel element outer casing - a process carried out for a number of years but not recently. A number of small metallic objects with high dose rates, such as springs and thermocouples, had also been placed in the vaults. Magnox Limited wanted to retrieve all the items and sort them for processing and secure storage.

device would be suitable, nothing was available off-the-shelf. The contractor approached load handling specialist Penny Hydraulics to discuss its requirement. Penny Hydraulics proposed a vertical wall-mounted hoist to handle the load through almost five metres vertically. A compact hydraulic crane was mounted onto a special frame. This can handle up to 25kg at a reach of over seven metres to access any item inside the vault but has to fold down to enter from the room above through a small opening. Once inside, the crane unfolds and uses either a special petal grab manufactured by Penny Hydraulics or a proprietary clamshell grab to capture a batch of lugs, which it then holds safely and securely. The crane folds down and rises from the vault back into the shielded chamber, where it places the lugs onto a sorting tray

The vaults are underground and their contents can only be accessed remotely. Although Magnox Limited and its main contractor recognised some form of remotely controlled mechanical handling

also manufactured by Penny Hydraulics. Working from outside the chamber nuclear technicians use gamma radiation monitors to determine whether each piece of debris should be classed as

low or intermediate level waste. Sorted items are then placed in containers for transfer to storage or processing areas. Penny Hydraulics’ project management team produced 3D designs and proof calculations whilst ensuring everything had the correct testing and safety certification. The equipment has been so reliable and successful that it is still in operation at the plant five years after installation. The MXD plant has saved an estimated £35 million during this period based on assessments for disposal, storage and packaging costs of the original volume prior to commencement of the dissolution process. Penny Hydraulics has recently been awarded contracts to provide similar solutions for handling waste items during decommissioning at Bradwell power station in Essex and at Sellafield in Cumbria. The design and manufacture of the equipment for these new projects will be managed by the company’s Nuclear Engineering Division.

aving absorbed the lessons of Fukushima, the UK power industry is still set fair for the ’nuclear renaissance’. This provides a massive opportunity to demonstrate a world-class UK construction industry in the nuclear sector through collaborative working. For construction it is the latest in a series of ever-more successful mega-programmes which started with Terminal 5 at Heathrow and the latest of which is the widely-hailed Olympic Park in East London, which has successfully delivered a programme of the same value as that envisaged for Hinkley Point C. Collaborative working is the key. Collective experience of old ways of working in the construction industry shows the major pitfalls of lump sum lowest price tendering, risk dumping, a dis-integrated designbid-build-operate process, and confrontational litigious cultures. For more than a decade now the construction industry has been embarked on a major industry-wide improvement programme, and progress to date has been solid, with safety up by 30%, client satisfaction by 20%, and environmental and social responsibility off the scale. The basis of the improvement has been a shift in UK construction towards collaborative ways of working, which has been recognised as world-leading by other industries around the world. To achieve success the UK nuclear sector needs the benefits on offer from these approaches, and there is plenty of evidence that clients are taking notice, both in the NDA estate, notably Magnox and Sellafield, and in the new build arena, where calls for improved productivity can only be met through collaborative working to provide the right conditions for lean and continuous improvement techniques.

The need for collaborative working starts within individual organisations, for example where the organisation is particularly large, geographically-spread, or multi-departmental or -functional. For example, client organisations may be an awkward mix of operational responsibilities, procurement, legal and commercial, programme management etc, each with apparently different drivers. Externally, collaborative working may take many forms, for example client-client collaboration, such as that promoted through the NDA estate, suppliersupplier JVs, such as those bidding for new build contracts, client-led integrated project teams, and supply chain integration. The future In March 2011 we took a party of 20 from the UK nuclear construction industry to Japan to study how the most efficient construction industry in the world was delivering nuclear new build. The timing was not fortuitous, the earthquake made our last two days ‘interesting’, but by then we had witnessed first-hand how a collaborative culture combined with the early involvement of as much of the supply chain as possible enables the project team to planplan-plan together to learn the process and then deliver right first time. It’s not just theory, we have seen the future – and it is a future in which the UK nuclear construction industry can be world best.

Case study Trawsfynnyd Strategic Integrated Alliance Edited highlights from a Constructing Excellence in Wales case study The decommissioning of the Magnox nuclear power station at Trawsfynydd in the Snowdonia National Park in North Wales featured the Trawsfynydd Strategic Integrated Framework (TSIF), a group of partners who would be able to deliver the decommissioning from “design to demolition”. Examples of collaborative working and framework agreements from other industries and sectors were pored over and pulled to pieces in a bid to find exactly what about them would and wouldn’t work at Trawsfynydd.

Collaborative procurement Collaborative procurement is “an effective way for more than one client, contractor, consultant or supplier to join together to procure works, services, materials or goods, share expertise, promote efficiency and deliver value for money savings in the delivery of a project (or series of projects) or service objectives.” No matter which type of collaborative working is being considered, we have identified three overriding principles. Without these, there may be good project management practices but it is not full collaborative working. These are: Common vision and leadership. Collaborative teams demonstrate an absolute focus on the end game, based on a clear understanding by all participants of what represents value for the client and end users. This will almost certainly be defined as some combination of whole life performance, predictability of delivery on cost and time, no surprises, and absolute cost and/or time reduction. Leadership in this context is about establishing this common vision and then constantly relating progress by the project to this vision to reinforce the team’s goal. Collaborative culture and behaviours. Collaborative behaviours include teamwork and joint problem solving, and participants demonstrate values such as trust, fairness, openness, no-blame, honesty and transparency. Collaborative processes and tools. Critical factors for success are as follows: early involvement, selection by value, common processes and tools, measurement of performance, long-term supply chain relationships, and modern commercial arrangements. 18

“There was a real need to try and change the method of working,” explained Sion Edwards, then head of sub-contract management at Magnox and now at Mott Macdonald. “Until 2004 we operated traditional procurement and contract management methods; that meant that there were lots of smaller contracts and lots of transactions. In addition we had a series of disputes with some of our suppliers that focused the mind that there must be a better way. “The philosophy for setting up the framework was to find out who has done it before and to talk to these people about their experiences. We wanted a framework that could deliver project certainty, increase competence and knowledge transfer, provide best value and foster innovation. We also wanted to drive costs down through the economy of scale,” explained Mr Edwards. “When we were named as preferred contractors we all sat down and talked about the way we wanted this to work,” said Don Mitchell, Project Delivery Manager for the TSIF partnership. “We set out exactly what we wanted to achieve in a Charter and even now, twoand-a-half years down the line it holds up as our collective vision.” At Trawsfynydd it took a while for the benefits to be clearly demonstrated and for the framework to really start delivering against the client’s aspirations. Obstacles to successful delivery included a yearly funding cycle and difficulty in persuading people to work in a non-adversarial, collaborative manner when they had become used to a climate of conflict and dispute - which frequently happened in traditional arrangements, especially when unforeseen circumstances occur. This type of work, which requires significant innovation and flexibility, is particularly demanding and calls for the cooperation of the whole team.

CHANGES TO OVERSEAS NUCLEAR TRANSPORT SYSTEMS

The world’s leading global transporter of nuclear materials is International Nuclear Services (INS), which has built an enviable safety record of over 40 years and five million miles of travel without an incident involving radioactive release.

INS is the majority shareholder in Pacific Nuclear Transport Ltd (PNTL), whose INF registered fleet has successfully transported over 2,000 casks of nuclear material, including irradiated fuel from European and Japanese plants; MOX fuel to Japan and Europe; and vitrified high-level waste to Japan and Europe. The company has offices in Warrington and West Cumbria, plus Germany, France and Japan to support its worldwide customers. A dedicated marine terminal at Barrow-in-Furness, PNTL home port since 1969, has direct rail links to Sellafield. INS offer complete nuclear material transport solutions, design of complex transport flasks (casks), and a full flask approvals and licensing service. Transport services include flask loading, land transport, inter-modal transfer to vessels, sea transport and back to land transport to final destination. The INS 2010-11 Annual Review features its business and operational performance as nuclear materials transport specialist and delivery manager of contracts for Sellafield fuel cycle services on behalf of the NDA. The company successfully undertook MOX fuel transportation from France to Japan; assumed management of NDA contracts relating to Dounreay commercial fuel cycle arrangements with overseas customers; and arranged the rapid deployment of £1m of UK nuclear industry safety equipment to Fukushima, to support recovery operations. The NDA recently issued a revised mission statement for INS and the company is undertaking an operational review, which may result in amendment to nuclear shipping projects in the future.

The fleet has undergone significant change over the last years, with INS successfully project managing the delivery of three new INF3 class ships, the Pacific Heron, Egret and Grebe. Constructed by Japan’s Mitsui Engineering and Shipbuilding Co Ltd the ships set new standards for maritime safety, reliability and environmental performance. The first was Pacific Heron completed in 2008, then Egret in 2010. Both are fitted with fixed naval guns and a range of physical protection systems that enable the transport of MOX fuel and plutonium dioxide between Europe and Japan. The third, Pacific Grebe, went into service in 2011, designed for shipping conditioned nuclear waste.

The oldest fleet vessel is Pacific Pintail, an INF3 class ship launched in 1987. After refurbishment at Ramsden Dock following transfer from PNTL into NDA ownership Pintail returns as Oceanic Pintail. She will operate from 2012 around Europe and North America, carrying nuclear cargoes including vitrified high level waste being repatriated to Sellafield’s European reprocessing customers. The Oceanic Pintail’s older sister ships in the PNTL fleet – the Pacific Crane, Swan, Teal and Sandpiper – are all out of service, the most recent decommissioning of Pacific Sandpiper now complete with 98% of materials recycled. Shipping projects for 2012 are likely to include making further deliveries of material in ISO containers to the United States as part of its Global Threat Reduction Initiative. Companies in the process of returning a portion of their nuclear materials to the US for storage in secure facilities are using INS for such shipments. Last autumn a shipment was undertaken by the Atlantic Osprey from France, the material subsequently transported from the US port to the Los Alamos repository. In addition, the INS programme of returning solid highly active waste (HAW) from the reprocessing of used nuclear fuel at Sellafield for the NDA’s Japanese customers also involves the specialised vessels. Pacific Grebe made its maiden operational voyage from Barrow-in-Furness late last summer, bound for Japan via the Panama Canal, and discharged a cargo of 76 canisters of HAW in three transport flasks. Current UK policy states that waste arising from contracts for reprocessing with overseas customers since 1976 is returned to the customer of origin. Will Watson, Sellafield Ltd’s Programme Manager for Vitrified Residue Returns, made this comment: “The decade-long programme of reprocessing returns reduces the amount of foreign-owned highly active waste in the UK, and is a milestone in the Sellafield mission to make the site cleaner, safer and more productive.” Words: Penny Lees

We don’t have the domestic capacity at the moment. We are seeing British firms teaming up with counterparts from Europe and beyond, bringing together complementary skills through partnerships or joint ventures, and we are actively encouraging this behaviour. But, whilst some Tier 1s are readily coming together, we have work to do to encourage and facilitate such relationships lower down the supply chain, and we are working with UBIFRANCE, the French agency for international business development, and the NIA to bring like-minded companies together. The UK has a long history of manufacturing and whilst many companies have been lost over the years, others remain. Industry stalwarts like Rolls-Royce have turned their attention to civil nuclear and are investing in new facilities. The Government is also keen to help British companies develop and has helped to fund the Nuclear Advanced Manufacturing Research Centre, which aims to encourage high-value manufacturing and to assess and guide potential new entrants through its Fit for Nuclear Programme. EDF Energy and other industry leaders are playing an active part in this programme. Another challenge posed by EDF Energy’s programme is the use of European codes and standards, such as RCC-M and RCC-E, in an industry used to working to British and American standards. This has been recognised by a number of organisations who are developing and delivering training and assistance programmes. But this is where Anglo-French partnerships can help, bringing together French companies who understand and work to these codes, coupled with a good understanding of delivering

But the opportunities don’t just stop there. Despite the direction taken by some countries following the Fukushima tragedy, global nuclear opportunities continue to emerge and stations will continue to be built around the world long after the UK’s current programme has been commissioned. There will always be a demand for nuclear manufacturing excellence. EDF Energy has now launched a National Supplier Database for its new nuclear business to capture details on those companies and to share the information with its Tier 1 contractors. ollaboration across the breadth of UK industry, from Tier 1 to Tier 4 companies with capability to become part of the nuclear sector, continues to be central to winning work. NuclearCONNECT highlights success in these routes to market. The involvement of fellow members of the supply chain helped Tata Steel Projects win a £4m contract from the Sellafield Ltd / ACKtiv Nuclear JV. Tata Project Manager Steve Temple explains: “Our collaborative working arrangement was one of the factors that secured the contract, which attracted stiff competition from highly experienced suppliers. Successful delivery will cement our position as a major cog within the nuclear industry.” The project, involving the design and manufacture of plant items to assist in the decommissioning of historical reprocessing structures, is for the wet bays in the Sellafield First Generation Magnox Storage Ponds. A dedicated project team from Tata’s West Cumbria plant is currently managing and delivering the contract with in-house mechanical, electrical and instrumentation control system design, fabrication, machining and testing of equipment; additional design delivered by North West Projects under a collaborative agreement and specialist fabrication and machining by TIS Cumbria.

The successful bidder for a major £58m contract “demonstrated a commitment to driving change and collaboration, that is essential to delivering effective, consistent performance and value for money at Sellafield”, according to a telling quote from Keith Case NMP’s Commercial Director for Sellafield Ltd.

The multi-million pound contract won by Cumbrian company Stobbarts Ltd delivers site-wide asset care services from 1 April for four years. Stobbarts, which already provide some of the services at the site under an old agreement, beat off competition from a host of multi-national companies. The work draws together a range of services including civil engineering mechanical and design services, plant and lifting equipment hire and provision of mobile crane and rigging services. Keith Case adds:“It is encouraging to see such a contract awarded to a local company and shows the experience and competitiveness present in our local supply chain - a great result for Sellafield Ltd, Stobbarts Ltd and West Cumbria.” Stobbarts has 15 years’ experience of the nuclear industry, already providing many services across Sellafield. The new contract complements key work programmes on the site and encourages closer collaboration.

The winning bid includes a commitment to recruit more apprentices and the firm will increase its yearly apprentice intake up to eight from the present four to six. John Stobbart, Stobbarts Managing Director, explains: “This is a tremendous opportunity for us to continue to grow by working collaboratively with Sellafield Ltd on a highly complex and varied contract. Back in 1987 I started the business with just a handful of lads and we have built up to more than 250 over the years. Securing this contract not only safeguards our existing workforce but enables us to provide further apprenticeship to train for the future.” Fort Vale Engineering Ltd took the networking route when it decided to develop into nuclear as demand fell from traditional markets for its precision manufacture and design of stainless steel valves and tank container fittings, alongside the design and supply of machined, fabricated and assembled components. Graham Blanchard, Senior Production Engineer and Project Manager, explained to NuclearCONNECT: “Fort Vale identified its breadth of services gave a one-stopshop USP, offering cost-effective industry solutions from design to manufacture and testing. We networked at exhibitions, conferences, supply chain and meet the buyer events, broadening our knowledge

of the nuclear programme and understanding business opportunities.” In 2010 Fort Vale won its first ‘nuclear work’, a design and manufacturing project for storage cans. Fort Vale is now part of a machining and fabrication framework agreement with the National Nuclear Laboratory, has completed work with Nuclear Engineering Services and supplied Sellafield and Springfields. Contracts include the design and manufacture of waste handling equipment, lifting beams, pressure vessels, and powder hoppers. “Going forward, Fort Vale continues to bid for new opportunities to expand its customer portfolio, and actively networks to ensure its experience and capability become more widely known.” Highlighting potential solutions to

he genesis of the NDA Estate National Supplier Conference, held in the former textile town of Bolton, near Manchester, went back to last summer when the NDA, working with the SLCs and their top Tier 2 contractors, came together to explore ways to expand opportunities for small and medium enterprises (SMEs). There was a general recognition of the importance of the SME community as well as an acknowledgement that our existing processes and strategies don’t make access easy, and in some cases, place unnecessary burdens on the lower levels of the supply chain. As befits all important discussions, a critical question was: “What are we trying to fix?” The challenge was: “Are we just trying to respond to an important Government Initiative supporting SMEs or are we really trying to do something new to support our industry and our businesses.”

The answer was a resounding: “We want to find ways to support SMEs, but whatever we do it needs to make business sense.” By bring forward initiatives, it also supports the wider Government agenda to increase the opportunity for SMEs to access and win public sector contracts.

However, the proportion of work awarded to SMEs had not been recorded, so NDA and the SLCs agreed to review the historical spend so that the impact of any interventions could be monitored.

Following agreement on the need to do some things differently, we invited representatives of the entire supply chain to jointly agree on interventions that would really make a difference. Various workshops ensued, which concluded four early wins: • Single estate-wide conference which should include an opportunity for Tier 2 clients to share their opportunities with the SME community • Simplification of NDA’s myriad of flow-down conditions • Introduction of a single estate-wide portal used not just by NDA and the SLCs, but, critically, the top Tier 2 contractors to openly advertise opportunities/awards and • Simplification and standardisation of Pre-Qualification Questions (PQQs), again used by NDA and the SLCs but with encouragement for its adoption by the top Tier 2 contractors. The national conference, ‘A Nuclear Decommissioning Supply Event’, by the industry for the industry, was attended by 450 people, and, feedback suggests that the day was extremely beneficial. One respondent wrote: “I would like to thank you and your team for one of the most informative and proactive events that I have ever attended.” With this level of support, discussions are already under way about a larger event later this year. The key to all such events, however important the topic, is to turn the public commitments into tangible action and progress. Bolton made the commitments and now we are engaged in delivering on our collective promises.

Progress on the other interventions remains on target, with the simplification of NDA’s flowdowns currently out for review with the SLCs, and planned to be implemented on or before 1 April 2012. Work on the single portal continues and it looks likely that, as part of this, we will be able to use HMG’s Contracts Finder, which will not only increase the focus on the NDA estate but also provide the supply chain with access to wider Government opportunities. Lastly the SLC group has almost completed its internal work on PQQ’s - these will be reviewed in late March, at which time the supply chain working group will be re-convened to drive forward the development and subsequent implementation. These interventions are estate-wide and aim to support the individual activities that the SLCs are also progressing for specific sites, programmes and projects. I would not be so arrogant to suggest that these activities are in themselves unique and or magic bullets. Working in our industry rates as one of the most rewarding but yet challenging, irrespective of whether you are a client or a contractor. What we do makes a difference internationally, nationally and locally at so many different levels. But we need a vibrant, dynamic and healthy supply chain to achieve this – at all levels. These current and future interventions all have a part to play but they require our collective support to deliver them. One of the most impressive aspects of our work to date has been the generous support by all levels of the

Government reviews Geological Waste Disposal time-scales, while the hosting consultation process reaches a critical decision into 2012.

he Government search for a UK community to volunteer to host a geological disposal facility (GDF) for the nation’s higher activity radioactive waste will reach an important crossroads during 2012. A decision ‘if’ to proceed with the Managing Radioactive Waste Safely (MRWS) process and review of the timetable to initial waste disposal will affect supply chain involvement and employment levels at any future repository. Local authorities across the country, invited to submit expressions of interest by Government, resulted in responses from only one area. Cumbria County Council and local councils Allerdale and Copeland Boroughs decided to take part in early discussions about the process on behalf of West Cumbria, because more than 80% of the country’s radioactive waste is currently already stored in the area on the Sellafield site. The three councils formed the West Cumbria MRWS Partnership, alongside representatives from a range of local public and private sector organisations. 28

Late last year the Partnership published a public consultation document which sets out its views on all the main issues and explains the stages in the search for a suitable site for a deep underground facility. Members of the general public, local businesses and organisations have been consulted to gather views on “whether West Cumbria should take part in the search for a suitable site for a repository”. The local supply chain was included in the awareness raising and feedback project with presentations to company leaders and staff, including one to members of Britain’s Energy Coast Business Cluster. The Partnership also commissioned Ipsos MORI to carry out a statistically representative opinion survey using a random telephone method. One thousand people in each area covered by the West Cumbria councils, together with people from across Cumbria, presented views to be taken into account when the Partnership considers whether or not there is ‘broad support’. After reviewing the feedback and comments from the public consultation, which closed on March 23, plus results from the phone poll, the Partnership will produce a report to the councils in summer 2012, setting out its final opinions. Taking this final report into account Cumbria County Council, and Allerdale

and Copeland Borough Councils, will each take a decision about whether or not to continue to the next stage with Government. This important decision is expected by autumn 2012. Following a decision to proceed at Stage 3, steps to implement geological disposal under the MRWS site assessment process would continue via the NDA. The Stage 4 ‘Desk-based studies in participating areas’ would include ongoing discussions and geological investigations to identify any potential site areas. This will take about two years, probably ending with two candidate sites identified for further detailed investigation. Next Stage 5, ‘Surface investigations on candidate sites’, would result in a decision on the preferred GDF site. This stage is expected to stretch over 10 years to around 2025. It will include work on obtaining planning permissions for site investigations; acquiring information on geological, hydro-geological and environmental conditions; developing site specific safety cases; and developing the concept into designs. Finally, for Stage 6, ‘Underground operations involving the construction phase’, many details are undecided but underground areas will be determined by the exact inventory for disposal, properties of the host rock and geometry of features within it.

Indicative dimensions for waste that the Committee on Radioactive Waste Management (CoRWM) thought likely to be disposed of in a GDF estimate the ‘footprint’ for an intermediate/ low-level waste disposal facility in the order of 1km², and for a high-level waste and spent fuel disposal facility (assuming spent fuel treated as waste), around 3km². The depth will be between 200 and 1000 metres, giving a vision of the scale of any GDF build. The Government also requested the NDA Radioactive Waste Management Directorate (RWMD) to review the programme for implementing geological disposal with a view to bringing the date for first waste emplacement forward from the planned 2040 date to 2029; and reducing the timescales for first emplacement of high level waste, currently 2075. The NDA December 2011 report entitled ‘Geological Disposal Review of options for accelerating implementation of the Geological Disposal programme’ identifies three options. Government announced a peer review of the report and a formal view from CoRWM alongside an NDA structured programme risk assessment to inform potential programme change. The 2008 MRWS White Paper made it clear that construction and operation

of a GDF would be a multi-billion pound project that will provide skilled employment for hundreds of people over many decades. The NDA ‘Geological Disposal- Manpower and Skills Data’ report in 2011 provides more detail on the levels and types of employment required in the siting, construction and operation of such a facility. The manpower numbers were produced using benchmarking against other similar worldwide programmes, including Sweden and Finland; through analysing typical underground construction activities and references from the construction industry. The highest employment rate during the £12 billion project will be generated during the construction and early operations stage, but initial work to investigate the potential geology at selected candidate site(s) will require an average of around 440 staff over the 10 years to completion of this stage. Once the geology is deemed suitable and following planning and other approvals, the construction of the surface and underground facilities up to the first waste disposal (about 15 years) will involve around 840 staff and the next 100

years of operation will provide work for 560. The 10-year closure phase will still sustain around 190 jobs. The study also shows that over 90% of the jobs will be for a period of more than four years and the majority require skilled personnel. The next analysis of manpower requirements is expected when specific GDF locations are identified but it is clear that jobs resulting from the facility and related community benefit projects will be substantial.

Helen has over 18 years’ experience working within the nuclear energy sector. Her particular areas of success consist of developing a radiological and environmental multi-disciplinary consultancy business, which grew from eight to 50 staff in two years. She also managed a circa £40m turnover business with 350 staff, leading and managing its complex emergency response capability, and engaging with government stakeholders that included members of Gold and Cobra committees. For five years prior to joining Redhall, Helen’s key strength was in transforming and growing business resources. This included restructuring and redirecting poor performing businesses into client and profit focused units. Helen was educated in Rochdale, before studying for her degree at Liverpool University. She is a now a Fellow of the Institute of Mechanical Engineers.

What is your greatest career achievement to date? It has been a very exciting and challenging time since I joined Redhall Group in November 2010 and the launch of Redhall Nuclear Limited in April 2011 is something I am very proud of. I am also extremely proud of the apprentice programme that we have in Redhall Nuclear. For a business of our size it is a testament to all those involved that we currently have 32 apprentices across the business.

What brought you into the industry/your position? When I was studying for my GCSEs I was thinking of becoming a pharmacist, but when a science teacher told me that girls didn’t do engineering, I decided to find out more about the subject and discovered that it combined my love of maths and working out how things worked. I went on to study Mechanical Engineering at the University of Liverpool before joining NNC as a Graduate Trainee. In 2010, I was approached about my current role with the Redhall Group and was excited by the challenge of taking three independently operating businesses and merging them to create a business that was greater than the sum of the initial parts.

What challenges do you think your new position will present? Having now amalgamated what was Jordan Nuclear Limited, Steels Engineering Services Limited and Chieftain Insulation Limited, one of our biggest challenges is the retention and attraction of suitably qualified and experienced personnel. We currently have over 400 people working in Redhall Nuclear Limited, but as our potential to deliver growth is escalating, we will be looking to increase these numbers significantly over the next few years. Keeping the great people we have and finding the right people to join Redhall Nuclear will be the biggest immediate challenge.

What is the best advice you’ve been given? The best piece of advice I have ever been given is that ‘as individuals we are capable of achieving whatever we put our minds to’. It is the notion that if you really try you can achieve whatever you want and it has given me confidence over the years that I can meet some of my greatest challenges head-on and succeed.

What developments do you expect to see in the next five years at ‘Redhall Nuclear’

What advice would you give to someone starting out in the industry?

As you would expect, we have a clearly defined business plan for the next five years. This is based on our commitment and drive to deliver for our existing customers, as well as forming mutually beneficial relationships with new customers and partners. In my eighteen-year career in the UK nuclear industry, this is the most exciting period I have experienced. We are not only continuing to drive forward and reduce the legacy of our past and current nuclear power generation, but here at Redhall Nuclear, we will be taking advantage of the partnerships we have developed for the nuclear new build market.

Simply to try and get a broad level of experience early on in your career (a good way of doing this is on an apprentice or graduate training programme) and not to be afraid to join in, there are some great activities undertaken by the Young Generation Network of the Nuclear Institute.

If you could change anything about the industry what would it be and why? Back in the early 90s when I joined the industry, people told me that nuclear power was not going to be part of any future energy mix and that I was joining a dead industry. If I could change anything it would be resource profile of our industry. I would like to see more people in their 30s and 40s in the industry. We have a real problem in that many people have left the industry over the last 25 years, either through retirement or by moving into other highly regulated industries and we are in danger of not being able to maximise on the opportunities now presenting themselves. The other thing I would like to change is the link often made by the media and public between nuclear energy and the nuclear deterrent. In the past this has in many ways hampered the advancement of nuclear energy.

What inspires you? It sounds daft but it is my two children. Like all children, they have an amazing thirst for knowledge and have the ability to always ask the why and what if questions, which as any parent knows are often difficult to answer.

What law/legislation would you like to see introduced? This is difficult, but as someone who does a significant amount of travel by road across the UK, I would like to see something which moves more freight off the roads. The number of large wagons on the roads seems to be increasing, and they do appear to drive far too close to other vehicles. Unfortunately, I have too often seen accidents or the aftermath of the accidents on our motorways.

Where do you see the UK nuclear industry in 10 years? Hopefully in 10 years’ time, the reactor build programme will be well under way. At the same time, the industry will be continuing to make good progress in managing the legacy of the previous power generation. I remember as a young graduate trainee filling in my pension application and outlining that I wanted to retire at 50. This is now extremely unlikely and I am really looking forward to Redhall Nuclear being a key part of the provision of nuclear energy here in the UK, for the next 10 years and beyond.

ntering the nuclear market can be challenging. The nature of the industry means that quality and technical requirements are extremely high. The UK has not built a new nuclear plant since the 1990s, so few have experience of the market’s stringent demands. However, manufacturers with experience in other demanding sectors such as aerospace or offshore are in a good position to move into nuclear. The Nuclear Advanced Manufacturing Research Centre, a collaborative initiative led by the Universities of Sheffield and Manchester, plus a consortium of industrial partners, has been established to help. The Nuclear AMRC aims to be the focal point for the civil nuclear manufacturing industry in the UK. It works with members to develop new manufacturing technologies to meet the needs of the next generation of nuclear power stations, help companies join the nuclear supply chain, and provide support in skills and quality. To help manufacturers measure their current operations against industry standards, the Nuclear AMRC has launched a free online assessment called Fit For Nuclear (F4N).

The programme helps engineering manufacturing companies measure their current operations against the standards required to supply the UK’s new nuclear power stations, and take the necessary steps to enter this global market. F4N is aimed primarily at ‘new to nuclear’ and ‘returning to nuclear’ companies but also existing nuclear companies keen to benchmark capabilities and develop continuous improvement programmes. F4N is delivered by the Nuclear AMRC in partnership with top-tier industrial partners. It covers key areas of business operation and performance. The results help identify any gaps that the company can address with the support of the Nuclear AMRC and partners. For companies meeting the nuclear industry high standards, F4N can provide direct routes into the supply chains of EDF Energy, Areva UK and other industry leaders. The initial diagnostic questionnaire is completed online, a self-assessment of the company’s performance in six key categories: Strategy and Leadership; Design and Project Management; People Excellence; Process Excellence; Safety; Quality. Each category has a statement of excellence followed by 10 assessment topics. Once completed, an automated report gives a score for each category and overall result, provided in the form of a spider diagram. Companies also provide information on financial results, products and services,

main customers and markets; to formulate initial analysis of satisfactory performance and potential demand for products. Next steps could involve a site visit to examine responses in detail with team members. Companies needing attention to meet industry standards will be supported to develop a tailored fitness programme to enhance operations, processes and capabilities; or referral to partner support organisations such as the Manufacturing Advisory Service. Since its July 2011 launch, over 60 companies have completed the online assessment with more under way. The following feedback illustrates the value of F4N support. Vector, with over 25 years’ experience in the oil and gas sector providing critical sealing devices with high fatigue resistance, anti-seismic properties and capabilities of operating in corrosive/ erosive environments, approached the Nuclear AMRC for advice on nuclear market entry, potentially within new build pipe circuitry, decommissioning and servicing sectors. The company completed the F4N online assessment and audit last year, finding the comprehensive documentation led to reflection on strengths and capabilities and focus on areas for improvement to align business with nuclear regulations and requirements.

JJ Churchill was first introduced to future nuclear opportunities through a presentation by Areva at an AMRC Forum meeting last year. They became an early SME member of the NIA. The company found the online assessment well-structured and a successful diagnostic tool. The 82% assessment level and NAMRC visit

The company has provided equipment for nuclear power and defence customers, but not prioritised the nuclear market.

The company achieved good Quality, Environmental and Health & Safety scores having ISO 9001,14001 and 18001 accreditation; Strategic and People Skills through Investors in People. However, the results highlighted that engineers constantly involved in design did not see themselves as primarily designing for manufacture and this has been formalised. SWMAS helped develop value stream management and AERL plan a follow up visit from NAMRC. FOR THE UK’S NUCLEAR INDUSTRY? Interview with Tom Anderson (Director, Blue Stream Consulting) by: Dr Rachel Parratt

he nuclear industry is likely to face increasing challenges to safe operations in the near future with the upgrading of reprocessing infrastructure, the ongoing decommissioning programme, and the design and build of new nuclear power plants. Not only do these activities present technological challenges, they also pose potential safety risks as new alliances between companies are formed, and an influx of workers enter the industry who may be unfamiliar with the importance of a positive safety culture for reliable and safe operations. We all have an idea of what makes something reliable, and generally think of this as something that is consistently good in quality, performance, and to be trusted. In nuclear engineering, the International Atomic Energy Association (IAEA) defines reliability as ‘the probability that a system or component will meet its minimum performance requirements when called upon to do so’.1

But what makes a workforce reliably safe? Some organisations seem to be able to operate in extremely trying conditions and yet remain effectively error-free. These High Reliability Organisations (HROs), where quick thinking to avoid errors, and fast response times to unexpected safety failures, are all part of daily operations, manage to stay safe and reliable even when operating at the ‘edge of the envelope’. HRO practice is exemplified by operations in US nuclear power stations and US nuclear-powered aircraft carriers. Personnel on nuclear aircraft carriers, for example, manage the simultaneous take-offs and landings of jets laden with munitions, on floating airfields that are only 333 metres long.

These ‘supercarriers’ are powered by two nuclear reactors, and are manned by around 3,000 crew – mostly under 21 years of age, one-third of whom rotate every 12 months. Despite these daily challenges, they still manage to operate virtually error-free. While the ‘HRO heritage’ has been founded in the United States, how HROs operate to maintain safety and reliability is of keen interest to UK nuclear regulators.

In the final report on the Japanese Fukushima Daiichi nuclear incident (11 March 2011), the Office of Nuclear Regulations (ONR) – the principal regulator for safety and security in the nuclear industry – highlighted the need for HRO approaches in the UK.2 This is supported by the Health and Safety Executive (HSE) Safety Assessment Principles (SAPs) that are used to guide regulatory decision-making in the nuclear permissioning process. These SAPs advise that ‘leaders at all levels should focus the organisation on achieving and sustaining high standards of safety and on delivering the characteristics of a High Reliability Organisation’.3 NuclearCONNECT

What are the characteristics of an HRO?

So, in an HRO, is it more than just good processes?

HROs have certain structural features; they are typically very complex systems that demand a large degree of redundancy (system back-ups, and more than one person to do a particular job), and have command and control regulations where members in the organisation have a high level of accountability.

While robust operational procedures, good processes and state-of-the-art technology are paramount to safe working practices in HROs, such as nuclear powered aircraft carriers, this is not the whole story. The essential ‘human factors’ element gives us an important clue as to how these organisations generate and maintain their positive safety culture, i.e. there is a strong emphasis on how people interact and work together.

HROs work under the assumption that their first error may be their last, and recognise that the cost of error can be potentially much greater than the value of any lessons learnt. Consequently, HROs have a strong focus on getting things right first time. Compliance is the norm, and since a strict adherence to procedures is expected, the processes that people follow are designed to be meaningful. While HROs have strict hierarchies, and high expectations of compliance, they are also exemplified as having a high degree of trust. Trust is an important component in the development of a safety culture, and ‘safety leadership’ directly influences safety performance, i.e. the more a leader promotes trust from his or her workers, the more a worker reciprocates by increasing their commitment to safety. In HROs, this is demonstrated by flexible, decentralised decision-making at times of crisis, where personnel with the greatest level of expertise, regardless of ‘rank’, are empowered to make on-the-spot decisions.

Resilient performance is a result of the way in which HROs attend to their business. Individuals share ‘organisational mindfulness’, and have a shared and valued understanding of what is important; this allows them to anticipate and manage unexpected events, if and when they arise. Mindfulness is a way of operating that does not rely on technology, system back-ups, or more than one person to do a particular job. This means that HRO performance is not confined to nuclear aircraft carriers and nuclear power station operations, but can be seen in a range of work places, such as chemical plants and healthcare emergency departments.

Does mindfulness offer the UK nuclear industry a way forward? When we act in a mindful manner, it generates the resilient performance seen in HROs. Mindfulness encourages us to respond to near misses, heightens our focus on potential failures, and increases our ‘situational awareness’. These factors enable us to anticipate and act on weak signs of failure that can be isolated while still minor, and make continuous adjustments to prevent small errors accumulating and escalating into larger events. Mindfulness gives us a foundation on which to build self-sustaining safety cultures. It can guide thinking and behaviour across all levels, from leaders who chart organisational direction, to senior engineers who determine the technology to be used, through to craft personnel and general workers operating at the workface. Operating in an HRO-like manner is expected for nuclear licensees, and the ONR has specific objectives relating to the building and embedding of safety cultures at nuclear sites. However, an HRO focus should not only reside with licensees, it should be engrained in the ‘DNA’ of any company or alliance working in the nuclear industry.

The Bribery Act 2010 came into force in July 2011 and created one of the strictest anti-corruption criminal regimes in the world. The Act has caused concern within the nuclear industry, particularly over what corporate hospitality can be provided to clients. This article provides an overview of the bribery offences and seeks to clarify some of the myths surrounding the Act. The offences The “General” offences Giving a bribe: Offering a financial or other advantage where it is intended to induce the recipient to perform his/her functions improperly, or reward him/her for improper performance. Receiving a bribe: Requesting or receiving a financial or other advantage with the intention that the recipient will perform his/her functions improperly. Bribing a foreign public official: Offering a financial or other advantage to a foreign public official with the intention of influencing him in his official capacity in order to obtain business or an advantage in the conduct of business.

The “Corporate” offence: A commercial organisation will commit an offence if a person “associated” with it (i.e. anyone performing services on its behalf e.g. employee, agent, sales representative etc.) commits any of the general offences intending to obtain business or an advantage in the conduct of business for the organisation. However, it is a defence for the organisation to show that it had in place “adequate procedures” designed to prevent persons associated with it from committing acts of bribery.

A typical scenario The diagram above is a typical bribery scenario that would be caught by the Act: There are several offences being committed here: 1 A offers B an advantage, intending it to induce improper performance of B’s functions. A is therefore providing a bribe. 2 B is accepting the advantage with the intention to improperly perform his functions as a result of it. B is therefore guilty of accepting a bribe. 3 If C’s anti-bribery policies in respect of B are found to be inadequate, C may be guilty of the corporate offence. Under the Act, the maximum prison sentence for an individual convicted of any of the offences is 10 years. The fines for individuals and organisations are unlimited.

HOSPITALITY, ANXIETY AND CRIMINALITY Corporate hospitality in the nuclear industry The issue of corporate hospitality has caused concern for the nuclear industry. However, the following practical points should be borne in mind: 1 The Ministry of Justice has published two documents, a Quick Start Guide and Guidance on Adequate Procedures, which, while not changing the law contained in the Act, provide an explanation as to what is intended to be criminalised, and what is not. 2 It is clear that the mere provision and/or receipt of corporate gifts and hospitality by itself is not outlawed by the Act. Gifts and hospitality that are reasonable, proportionate and intended for purposes, such as improving the organisation’s image, presenting products and services and establishing cordial relations with clients or potential clients, are perfectly permissible. 3 The assessment of what is “reasonable and proportionate” can take into account the norms and practices of the nuclear industry. However, any argument that “this is the way the nuclear industry has always done it” will not constitute a successful defence if intended impropriety can be identified. 4 The critical ingredient that must be present to take a gift or offer of hospitality into a criminal realm is for it to be accompanied by an intention to induce impropriety on the part of its recipient. Such an intention (or the lack of it) can only be gleaned from all the circumstances of the particular case, such as the express or implied purpose, timing and value of the gift and/or hospitality provided. 5 In order to minimise the risk of committing either a general offence or the corporate offence, businesses in the nuclear industry must carry out an analysis of the bribery risks that they face and put in place policies and procedures designed to deal with those risks. In particular, nuclear industry businesses should create and implement transparent policies and procedures governing the giving and receiving of gifts and hospitality including, for example dual sign offs and records of gifts/hospitality over a specified value. The law surrounding the procurement of contracts by public sector bodies is complicated and often difficult to apply. Although the public procurement rules only place direct legal obligations on organisations in the public sector, private sector bodies dealing commercially with public sector organisations will need to be aware of the broader legal framework within which they are operating. This is particularly relevant in the nuclear sector.

How does the legislation affect me if I am not a public body? The PCRs apply to public bodies which are named in the legislation (known as contracting authorities). The PCRs will also apply to any body which is established to meet needs in the general interest,

requirement that certain contracts be put out to tender by public bodies. The second part of the article then examines in detail the Nuclear Decommissioning Authority’s (“NDA”) Parent Body Organisation (“PBO”) competition process in light of the recent competition for Dounreay Site Restoration Limited (“DSRL”).

Procurement law - dispelling a few myths The rules on public procurement are dense, highly technical and hard to follow for the uninitiated. This article is intended to provide an introduction to public procurement law from a supplier’s perspective including the legal background, when a supplier to the nuclear industry should expect the legislation to apply and how the rules may affect its bidding strategy.

A competition must be conducted using one of the procedures set out in the PCRs, namely the open, restricted, negotiated or competitive dialogue procedure. The choice of procedure will be determined by the scale and purpose of the procurement and will impact on: (a) the duration of the competition;

Whilst the PCRs do not place obligations on private sector bidders it is of course important for any business to understand the sector in which it operates in order to maximise its commercial opportunities and chances of success. Therefore, suppliers to the bodies named above must understand the constraints this legislation places on their customers and also the opportunities it provides.

It is therefore important to understand how each procedure operates before deciding to submit a bid. Rights to challenge a procurement Any failure to comply with the PCRs can lead to a claim for damages by an aggrieved bidder or, in certain circumstances, the contract being declared “ineffective” (for practical purposes this means the contract is void).

Further points It is important to note that if a contracting authority is procuring a contract whose value is below the thresholds, it must still comply with the general principles of EU law. These require it to conduct a fair and transparent procurement. In practice, this requires the authority to advertise the contract opportunity and conduct some form of competitive tender. s the DSRL PBO competition nears its conclusion and the Magnox / Research Sites Restoration Limited (“RSRL”) PBO competition appears on the horizon, it is interesting to reflect on the PBO competition process. The costs of participating in any competitive dialogue can be fairly eyewatering for both industry and the public sector and the NDA’s PBO competitions are no exception to this. Any company that is contemplating participating in a PBO competition will need to face up to the fact that bid costs are likely to run to several millions of pounds. The bidding process is not therefore for the faint-hearted and will require any potential bidder to have deep pockets and a strong stomach. However, it should be remembered that the prize for winning the DSRL PBO competition is substantial. DSRL’s current life time plan gives an estimate of £3.5 billion for reaching the interim end state and an annual site funding limit of £150m. There are many examples of both good and bad competitive dialogue processes across the UK and the time line for the competitive dialogue process run by the NDA in the DSRL PBO competition compares well with the competitive processes run by the public sector in

other industries; particularly if compared to similarly complex projects in the defence and transport sectors. The dialogue phase in the DSRL PBO competition was relatively short and concentrated (the dialogue phase started in January 2011 and the invitation to submit final tenders was issued at the end of July 2011) and the contracts are expected to complete on schedule.

Having said this, it would of course only be fair to say that the speed of a procurement process is obviously not the sole measure of a successful procurement. No matter how slick the procurement process is, as with any competition, ultimately, the success or otherwise of any procurement can only be measured once the operational phase has commenced and the contractor has to demonstrate that it can deliver on both time and cost. Notwithstanding that the NDA’s record on competitive dialogue compares well with other industries, it cannot be

complacent. Therefore, it continues to encourage industry to make suggestions as to further improvements that can be made in terms of the procurement process, when it competes the Magnox/ RSRL sites. It is in the interest of all parties to a competitive dialogue that the costs of participating are no higher than absolutely necessary. High bid costs risk finding their way back to the NDA; either in a straight pass through of increased costs, or in the form of an absence of competition as market participants are priced out of the industry and are simply not willing to participate in further competitions. It is also important that the NDA clearly identifies and expresses its award criteria and client specification at an early stage of the Magnox and RSRL competition: industry will much prefer to delay the commencement of any competition than to start without a very clear understanding of these elements. t a recent supply chain event, business representatives heard DECC minister of state Charles Hendry highlight the potential of new nuclear to the UK workforce:

Tier 1 contracts will cover civil and building works; mechanical, electrical HVAC and Instrumentation and Controls installation; the Nuclear Steam Supply System (NSSS); and supply of mechanical and electrical equipment.

The breadth of major work packages for the EDF/Centrica project highlights the types of companies that could benefit. The status of these underlines the current involvement of the supply chain; and the opportunity, both now and into the future, for companies to get on board directly with EDF or via other tiers of the supply chain. • The Preliminary Works contract has been let to Kier Bam Nuttall JV, with over 80% of contracts by value being delivered by Somerset-based businesses. • Spoil heap remediation works by Hydrock are due for completion early 2012. • Kier Bam JV is preferred bidder for the site enabling and earthworks contract, part of the Site Preparation Works. Detailed design work has commenced with the main earthworks commencement due in the second half of 2012. • The temporary jetty (500 metres) civil works preferred bidder is to be announced in Spring 2012, with detailed design and construction to commence once permissions are granted. The jetty material handling equipment contracts have been awarded to Fairport Engineering with detailed design phase under way. • The Main Civils contract is at second stage ITT assessment with three JV bidders. A preferred bidder is anticipated in 2012 and an early contractor involvement agreement will be signed under which detailed execution plans will be developed prior to final contract award. • The Marine Works (11km of cooling water tunnels) contract has moved into second stage ITT with three joint venture bidders. A preferred bidder is anticipated to be named later this year, which will be followed by a design stage prior to final contract award.

• The Nuclear Steam Supply System contract for detailed design work was let to Areva in December 2011. Earlier in 2011 contracts to manufacture the main primary circuit forgings were placed with both the Japan Steel Works Company and Areva’s Creusot Forge. • The Turbine Hall ITT issued in 2011 is now under detailed analysis. • The Mechanical Works contracts are at pre-qualification stage, with a number of consortia showing interest. The works involve the supply, fabrication and installation of pipework and the installation of mechanical equipment. • The Electrical Works scope of contracts are anticipated in early 2012, followed by a PQQ process later in the year. • For the Control and Instrumentation phased work, the first stage is a comprehensive design contract to develop requirements arising from the GDA process. • Ancillary Building works covering construction of 16 buildings of various types. These include a public information centre, the simulator and training centre and site access facilities. Design and construction may be in two phases with first phase tenders invited during 2012.

In late February Rolls-Royce and Areva signed a major supply agreement on global civil nuclear projects to support delivery of EPR reactors in the UK and internationally. Rolls-Royce will supply Areva with a range of complex components, engineering and technical services for the first of the 2 reactors at Hinkley C. Once contracted, the work could be worth a total of £400 million in revenue to Rolls-Royce for the four UK EPR’s currently planned by EDF. Much of the value will feed down the UK supply chain and initially support several hundred highly skilled jobs. The work is likely to be based at its new facility on the Advanced Manufacturing Park in Rotherham, Yorkshire alongside

Nuttall and URS. The contract, subject to clearance of planning conditions, includes excavation, earthworks, terracing, installation of construction site infrastructure and formation of roads and networks to allow main construction to begin. It creates around 350 jobs, many of which will be via companies local to the site, while the main construction works will involve up to 25,000 people over the course of the project. Later in 2012 the major £1.2bn Main Civils contract will be awarded. Three consortia of major supply chain companies awaiting the outcome are led by Balfour Beatty, Laing O’Rourke and Costain. Balfour is working with Vinci, O’Rourke alongside Bouygues and Costain with Sir Robert McAlpine and Hochtief. The contract will employ at least 1,500 construction workers for more than three years from early 2013 and is a major opportunity for supply chain engagement with the Hinkley C project.
