Appeal begins for man who killed wife

pings in regional parks has led Metro Vancouver to test unusual solutions – including one where it pays contractors to cut open every dog waste bag so the contents can be taken to a sewage treatment plant. That’s the system being tried at Tynehead Regional Park in Surrey and Boundary Bay Regional Park in Tsawwassen and officials say it looks like a promising method that may extend to the rest of the regional park system. Special red bins have been set up at those two parks where dog walkers are directed to deposit poop bags, instead of using regular garbage bins. Metro then pays New Westminster-based Scooby’s Dog Waste Removal Service to take the dog waste bags to their facility and snip open each one with scissors so the poop can be dealt with as sewage and the bags go in the garbage. “Park visitors seem to buy in easier,” said Gudrun Jensen, Metro’s operations services division manager. “It encourages people to pick it up because they know there’s a place for it to go and it will go in the right waste stream.” Diverting dog poop to the sewage system reduces the amount of waste in the garbage stream and keeps it from rotting in a landfill, generating methane Gudrun Jensen that contributes to climate change, Jensen said. “It adds up,” she said. Metro estimates 2.5 million dogs a year are brought to its regional parks, generating 500 tonnes of dog waste annually – equivalent to 50 dump truck loads. “Most people are astounded at the size of the problem when they hear about it,” said Jensen. Other techniques are also being tried. At Aldergrove Lake Regional Park’s dog off-leash area, a special in-ground tank for dog waste has been installed by Metro at a cost of $2,600. Visitors are provided marker flags they can plant in the ground beside where their pet has pooped. They then get a red-handled shovel, return to the flagged deposit, scoop it and drop it in the tank, which is periodically pumped out and taken to a sewage plant.

Mayor Dianne Watts said the hotel and residences will be a good fit for City Centre. “Surrey is very unique, we’re unique in the way we approach things, we’re innovative, we’re open,” Watts said. “We want to make sure that uniqueness is represented in the building of our City Centre.” SCDC President and CEO Jim Cox began discussions with Hodgins just over a year ago. The city wanted a hotel in the area, Cox said, but noted Surrey was open to any project that would “animate” the future plaza. This project, he said, accomplishes that goal. SCDC was created by

About 15 years ago, senior management at city hall considered the notion of reducing development cost charges in Whalley, along with other initiatives, to spark investment in the area. That plan failed to come to fruition (However, the idea was implemented by Watts a few years ago). In the late 1990s, ICBC built the Bing Thom-designed Central City tower, a 25-storey highrise which eventually became home to the Surrey campus of Simon Fraser University. While that was considered to be an impetus for further investment, development was fairly slow to come, and when it did, it was mostly in the form of residential towers.

Surrey helped fund the new library and will invest in the new city hall. – one who’s a goldmedal Olympian and another who is a realtor and tireless volunteer – have been named among the Top 25 Canadian Immigrants of 2011 by Canadian Immigrant Magazine. Daniel Igali, who won gold in wrestling at the 2000 Olympics, was awarded for his athletic endeavours and work building a school in his his native Nigeria. After establishing the Daniel Igali Foundation, he was highly involved in bringing the project to fruition, whether it was through fundraising or swinging a hammer on the construction site. The school opened in 2006. “These children have the right to access computers. I want to make that school a gateway to the Western world,” he

says. “I believe human beings should always reach out to others, especially those less fortunate. And some of us who have voices, we should harness them.” Igali continues to raise funds and hopes to build more schools. Splitting his time between Canada and Africa, he also serves as technical director of the Nigeria Wrestling Federation to help prepare a team for this year’s London Olympics.

“As much as I want my athletes to succeed in Nigeria, I also want the Canadian wrestlers to succeed,” he says. “I hope if we do compete against each other, it’s where both of them will win medals.” Narima Dela Cruz, a realtor who immigrated from the Philippines in 1998, was noted for her numerous hours of volunteer work in the community. “My volunteer activities are my passion. I’d say I spend 40

per cent of my time on volunteering, and 60 per cent on work,” she says, acknowledging her husband’s support in doing so. “It’s part of my love for my motherland, Philippines. I started volunteering in the Philippines community and then ventured into the mainstream.” Dela Cruz is the founding director of and president of the Surrey Philippine Independence Day Society, a volunteer with SUCCESS and is a translator for Options Community Services Society. You might also find her picking up newcomers at the airport. “My heart goes out to them because when we were new, I never had that help,” says Dela Cruz. “I knew how it felt to be a newcomer – confused, lost and homesick. That’s what motivates me to help as much as I can.”

A taxing situation

n June 1, the federal government raised the limit for duty-free goods which can be brought back into Canada from the U.S. While consumers are happy, this is not good news for local businesses. Many are already feeling the pinch from cross-border shopping, and the much higher exemptions take effect just as the summer travel season begins – a time when more people cross the border. Travellers can now bring back $800 worth of goods after a 48-hour stay. While these exemptions will hurt businesses in many parts of Canada, there is no place that will be more impacted than the South Fraser region, where 750,000 people are a 10- or 15-minute drive from the border. Nowhere else in Canada do so many people live so close to the U.S. It is proof once again that Ottawa is badly out of touch with B.C. However, the provincial and local governments also play a big part in driving shoppers out of the country. The ridiculous price of gas, hovering at close to $1.45 a litre despite the fact that oil prices have fallen by 20 per cent in the past few months, is due in part to high taxes. TransLink charges 17 cents per litre on gas – yet its take from fuel tax is starting to fall because more people are going elsewhere to get gas. Elsewhere is either to Abbotsford or Mission, or across the line. If they are going south to save money on gas, chances are they will do some shopping. The provincial government is about to boost the price of gas again. On July 1, the latest carbon tax takes effect, and will add another 1.1 cents to a litre of fuel. At that time, the carbon tax will be 6.67 cents per litre of gasoline, and slightly more for diesel fuel. We pay close to 50 cents a litre in tax on gas. The Canadian Taxpayers’ Federation recently pointed out that fuel taxes alone take $1 billion out of the economy in Metro Vancouver alone. All of this happens as incomes stagnate. The average B.C. income in 2010 was $46,379, almost $18,000 less than the average income in Alberta. Most people have seen little in the way of a wage boost since 2010, yet governments at all levels are digging deeper in our pockets. Property tax, Hydro and ICBC rates and medical premiums all keep climbing. It’s no wonder many people shop across the border. It’s one of the few ways left open to them to save money. Unfortunately, it hurts working people here, as businesses close or reduce staff. It’s high time all levels of government realized that high taxes are driving too many people across the border to shop. – Black Press

n February this column asked the question: “Are B.C.’s greenhouse gas reduction targets history?” The answer is contained in a new draft plan from BC Hydro on how to meet future power demand. And while it’s not explicitly stated, the answer is yes. The draft plan was released in May for discussion purposes, but so far there hasn’t been much discussion. This is surprising given some of the recommendations, such as firing up the Burrard Thermal natural gas power plant more often and buying fossil fuel power from the North American market to keep up to demand. The plan confirms a few things that have been evident for a while. Dreams of exporting B.C. hydroelectric power are gone for the foreseeable future. tries where the price is currently four times higher than in North America. Whatever the domestic price, B.C. gas producers have to show LNG investors such as Mitsubishi and Korea Gas that they can fill a steady procession of LNG tankers at a competitive rate. If LNG doesn’t fly here, B.C.’s gas export market soon evaporates. Currently gas producers pay about $400 million a year in royalties, and that much again to buy up shale gas drilling rights. The industry already employs about 12,000 workers in B.C. The B.C. government has little choice but to redefine its climate targets. Instead of cutting domestic emissions, it will try to take credit for displacing coal power in Asia. Fortunately, B.C.’s main coal exports are for high-grade coal used in steel-making.

B.C. energy policy in place for decades Service

IN THE late 1980s, BC Hydro and the Socred

government of the day faced a challenge they had not previously faced; namely, trying to meet B.C.’s growing energy needs at a time of growing environmental concern and controversy around the construction of large hydro dams. In response, BC Hydro and the Socred government embarked on two important policy initiatives that were designed to delay, for as long as possible, the construction of new hydro dams such as the Site C dam on the Peace River. Energy conservation measures, designed to help reduce energy demand, were one of these key policy initiatives. The other was a policy to

seek out new supplies of energy from independent power producers (IPPs) to help satisfy overall increases in energy demand. For those who’ve been led to believe that IPPs were somehow created by Gordon Campbell and the B.C. Liberals, the fact that IPPs have been a significant part of B.C. energy policy since the late 1980s will probably come as a shock. Nevertheless, it is a fact: IPPs in B.C. predate the B.C. Liberal government by more than a decade. Even more shocking for those who’ve been misled about IPPs in B.C. is the fact that the NDP government of the 1990s continued to encourage and support IPPs as a key part of energy policy.

Nothing has changed today or over the past decade. The people of this province still expect reasonably-priced power, no rate-shocks, low environmental impacts and many other benefits. And as in the past, energy conservation and energy from independent power producers remain among the pillars of B.C. energy policy, and both continue to play a major role in making sure the province meets its energy objectives.

Zones won’t stop suite scofflaws MULTIPLE SUITES in single-family

neighbourhood homes are nothing new here in Surrey, but it is out of control. I really don’t think that allowing multiple suites in designated areas will make any difference to them being built in single-family neighbourhoods. These builders and homeowners have always been ignoring the laws and the tax man and doing as they please, with no worries of bylaw enforcement. Almost all the homes in my area have suites, most having two, some even more. They only have to pay a small fee to the city and only for one suite and that’s only if it’s been reported and verified by the city. If every home on the street and subdivision has suites, who will be reporting them? Even if reported, nothing happens. I only know of one home across from me was ordered to remove one of their multiple suites five years ago, but it was back in the following day without any further action by the city. I realize that thousands of people rely on these suites for affordable housing and just as many homeowners rely on the income to cover and qualify for their mortgages. The city and the province should be supplying enough social and affordable housing, not the homeowners. No extra taxes are collected from these suites for schools, roads, parks etc., but all are used by these tenants. The homeowners aren’t paying income tax on their income from the suites either, adding further strain on the system. Just look at the issues we are having with the budgets for schools, TransLink, health care and the rest of the government-funded shortfalls. It’s the law-abiding single-family homeowner that is stuck with an unfair share of this burden, both in neighbourhood livability and taxes. A. Andersen

Let neighbourhoods vote RE: “TENANTS and landlords speak

out about suites.” I am so glad that you let a landlord that owns a property with illegal multiple suites speak out. I have these questions for her: Do you declare the income you receive on all your rental suites? Do you follow the rules and park the two suites’ vehicles on your property? Are you making the problem worse in your neighbourhood or are you being a good landlord and following the bylaws and paying your fair share of the property tax for these two

suites? I don’t really want to hear about the landlords that have multiple suites and how nice it is for them to provide affordable accommodation for people. I am rolling my eyes as I type this. For example, one multiple-suite landlord in my neighbourhood has a gardener for her tiny non-existent lot, drives a high-end car and employs a nanny. I have witnessed this in the past in the homes that I have lived in with multiple suites. My family rented a suite in a multiple-suite home many years ago as that was what was affordable for us at the time. I totally understand the need. But suites and multiple suites need to be in neighbourhoods that can easily accommodate triple the cars and people – for example, the older neighbourhoods in Guildford, Newton or Fleetwood that have driveways with enough room to park four cars and bigger lots. They should not be allowed in the high-

recent letter, “rental slum looms in Clayton.” I am a new homeowner to this neighbourhood and find it very upsetting to see how a fairly new dynamic familyorientated community is being crumbled down due to Surrey council not stepping up and enforcing secondary suite bylaws. Delta has a grip on the issue by imposing fines on landlords and I can’t seem to figure out what Surrey is waiting for. It’s not the tenants’ fault. The landlords are the ones making extra money for renting out illegal suites without paying secondary suite fees and not providing adequate parking. Mayor Dianne Watts says this is a 30-year-old problem and not an easy one to fix. Actually, Mayor Watts, there were no coach homes being built 30 years ago so enough with the excuses. Take responsibility and take action for this issue. I feel as though myself and others in this situation are being penalized for doing the right thing. I have a secondary suite which I am paying full secondary suite dwelling taxes for. I even took the step of cutting my backyard square footage which is already so minimal to accommodate a parking spot for my tenant. What is going to happen when the new City of Surrey garbage recycling program comes into effect this fall. Let’s see if the city clues in on why larger bins are being requested or why so much garbage from so many people living in a multiple suite residential unit causes overflow of small bins which will lead to an un-environmentally friendly Surrey. There are plenty of people who are registered who could use public transit, and there are others who drive their own cars but they like being picked up at their door and taken to where they are going for the price of a transit ticket. There are quite a few people who don’t really need to use HandyDART, but if their doctor signs the form then there is nothing HandyDART can do. Just being a senior does not automatically qualify a person to use HandyDART. It is not “seniors” transportation. It is transportation for people who cannot get to a bus stop or take transit by themselves. There are many people who are registered who could help HandyDART to help them by using SkyTrain transfers. They could also help by booking rides at non-peak hours for things like shopping and hair appointments. HandyDART has limited resources. That includes buses, hours of service and drivers to drive the buses. Some people get the impression that HandyDART is there for their exclusive use. Given that HandyDART is heavily subsidized and people only have to pay a transit ticket for a ride, many people have skewed expectations. HandyDART is not a limousine service. HandyDART is not a taxi service. HandyDART is and always has been a shared ride service. The registered people are not special people. They are people with special needs. HandyDART can do only so much. Many people who use HandyDART really try to work with the system and policies. But many more treat HandyDART like it should be at their beck and call all day every day. Those kinds of people make it difficult for occasional users to get rides.

Jensen said that system has also worked well, but is best suited to where dog activity is concentrated. Trails can be problematic, even for the contractormaintained waste bins. “People want to drop their dog poo as soon as they can,” she said. “If the bin is too far away they will drop the bag on the ground, throw it in a tree or throw it in the next garbage bin.” Asked how much has been spent on the dog waste trials in total, Jensen estimated $15,000. That includes $75 per week to collect waste from three bins at Tynehead, $150 weekly to maintain another five bins at Boundary Bay’s trail, and about $1,000 a year to pump out the in-ground tank at Aldergrove Lake. Jensen defended the importance of the dog waste initiative, adding it’s being closely watched by parks officials at local cities. Leaving dog waste on the ground isn’t considered an option. “Every piece that isn’t picked up has to be or it degrades the environment,” she said, adding most people don’t understand that dog feces is bacterialaden and doesn’t compost well. Final recommendations of the pilot projects are expected in the next few months.

Surrey eyed DNA testing to bust poop scoop scofflaws IT’S NOT the sort of criminal activity most people

associate with the forensic policing TV show CSI. But the City of Surrey has considered using DNA testing to identify and fine dog owners who fail to pick up after their pets in its civic parks. The concept – in use in some gated communities in the U.S. – has offending dog poop sent away for DNA testing and then matched to a local dog, whose owner can then be punished. The idea was contemplated earlier this year, said Surrey parks manager Owen Croy, adding it’s been shelved for now because the cost is high and it’s unclear how all Surrey’s dog owners could be compelled in advance to provide mouth swab samples of their dogs to develop the required DNA database. “It doesn’t seem practical,” Croy said. “We believe it’s something we should keep in mind but it’s nothing we’re going to be implementing in the near future.” Croy said Surrey is designing a new off-leash dog park near Rosemary Heights in South Surrey and hopes to incorporate best practices for waste disposal. jnagel@surreyleader.com

Panghali’s conviction appeal was heard by a trio of justices in Vancouver on Friday. Tammen told the Appeal Court that Panghali being found guilty of murder versus manslaughter was unreasonable because there

was insufficient evidence to prove there was intent to kill. The defence lawyer disputed the trial judge’s (B.C. Supreme Court Justice Heather Holmes) determination that burning the body pointed to the perpetrator’s intent. There are a number of reasons someone might seek to conceal or destroy a body, Tammen argued, including sheer panic at having killed someone.

The average person, he said, doesn’t know the difference between manslaughter and seconddegree murder and only knows that “killing is wrong.” Tammen also said evidence about the duration and force of the strangulation was insufficient, putting into question whether the death was intended or accidental. Trial testimony from a forensic pathologist pointed to a broken hyoid bone in the neck, but the court heard it was a common injury in manual strangulation. As well, Tammen said, the pathologist was unable to determine the exact duration of the strangulation – only saying it was “more than fleeting” and likely lasted several seconds. Appeal Court Justice David Frankel countered that the doctor testified it would take a “minimum” of 15 seconds to render someone unconscious, which is “not that short a period of time.” Tammen argued 15

to 20 seconds was not a significant amount of time in the context. The trial judge also erred, Tammen said, in admitting evidence from the pathologist about a vaginal hematoma discovered on Manjit’s body. Even though the trial judge chose to give the hematoma evidence no weight, it was “so prejudicial and so lacking” that it should not have been allowed at all, Tammen said. Tammen said Panghali may have, hypothetically, testified in his own defence, but his word would have been pitted against expert evidence. Under those circumstances, said Tammen, the Crown could have crossexamined his Panghali about a possible sexual assault and there was the risk he’d be left open to the more serious charge of first-degree murder. Panghali is currently serving an automatic life sentence with no possibility of parole for another 14 years.

North Delta home burns twice in four days

An early Wednesday morning blaze at a home in the 11300 block of 74 Avenue was the second time the North Delta home had caught fire in four days. The first fire erupted just after noon on Saturday, June 2. Then at almost 3 a.m. Wednesday, the house caught fire again. The fires are considered suspicious and police are investigating.

SURREY HAD a spate of violent attacks over the weekend that saw one man shot, another stabbed in a robbery attempt and two others beaten with bats in three separate instances. Surrey RCMP were kept busy Sunday morning starting at 1 a.m. when they responded to a call and found two men, 20 and 21 years old from Surrey, who had been beaten with baseball bats near 132 Street and 80 Avenue. One of them received a laceration on his head

and the other had a fractured jaw. Both men were taken to hospital and released. Police do not believe the victims knew their attackers and say the motive for the attack is unclear, however, alcohol is believed to be a factor. An hour-and-a-half later, a man was attacked at 104 Avenue and King George Boulevard by six men trying to steal his ring. The 39-year-old man from Surrey suffered stab wounds to the abdomen, and was treated at hospital and released.

Then at 4:30 a.m., a 33-year-old Vancouver man was taken to hospital with gunshot wounds to his leg and arm after attending a party near 92 Avenue and 147A Street. Investigators aren’t sure whether those involved were known to each other, but believe the shooting was the result of an altercation. Several people of interest have been taken into police custody. Police are asking anyone who has information about any of these incidents to call Surrey RCMP at 604-599-0502 or Crime Stoppers at 1-800-222-TIPS (8477).

For fourteen years Surrey Fest Downtown (originally known as Whalley Community Festival) has marked the beginning of community festivities in the downtown area. It began as a celebration of community, and continues to grow and change over the years. This year’s theme, “Past, Present, and Future” reflect the ever changing path of the city’s centre. “There has been a deep-rooted sense of community in Whalley going back decades. But in the last few years, there have been lots of changes, with more planned for the future,” says Bonnie Burnside, Chair of this year’s event. “It’s important that we remember the past and recognize the efforts of those who have gone before us. At the same time, we have a lot of people who are charting ourr future and we wanted to provide a venue for them to share their visions with the community. We thought that adopting the theme “Past – Present – Future” reflected that message.” The talent this year embodies the theme of the festival as performers from all decades take the stage to entertain the crowds. See the glitz and glam of Old Hollywood as The Agency lights up the stage; or rock out to the tunes of the 60s with the Beatles tribute band Fab Fourever. Then, representing our our future, watch the amazing skills of young dancers tackling Breakdance, Hip-Hop and Bhangara. Everyone is invited to this annual free event hosted by the Whalley Community Association. Thanks to Prospera Credit Union’s sponsorship, there will be a new attraction for children at this year’s Surrey Fest Downtown, on Saturday, June 16th. Paddle boats will replace the usual train ride, adding a fun, new element for the kids. Cheryl Christensen, Branch Manager of the Surrey Centre Prospera Credit Union, explained that she was happy to sponsor the boat ride when the opportunity was presented. “Being a part of a credit union, communities are at the heart of what we do, so to be able to provide entertainment for the youth meets with our community focus,” said

Sunday, July 8th, the Gay Pride Festival takes place at Holland Park. This year, Surrey is hosting the BC Summer Games. The Opening Ceremonies take place at Holland Park on Thursday, July 19 from 7 to 8:30pm. In addition to the introduction of the 2800 athletes competing for gold over the four day event, there will be some fantastic entertainment. The 5th Annual Fusion Fest takes place July 21-22 at Holland Park from 11am to 10pm with huge acts including Los Lobos, Delhi 2 Dublin, and Hawksley Workman. The best part of Fusion Fest is the variety of delicious food from all over the world. The BC Summer Games Closing Ceremonies will be part of the Fusion Fest Celebrations at Holland Park on Sunday, July 22 from 1:30-2:30pm. Wishing you could go back in time and listen to the wonderful melodies of the 1940s? At Surrey Fest Downtown, that’s exactly what you can do when The Agency hits the stage with their unique blend of modern meets classic jazz. It all started out as an idea to perform current radio hits with a twist, turning songs into a girl group format with all the glamour, glitz, harmony, and choreography that goes along with it. PraiseTEAM Dance Group Visits Surrey Fest Written by Felicia Rafael Celebrating its fifteenth year, PraiseTEAM has grown from a small group of 9 young dancers, entertaining family and community members, to a massive troupe of 200, recognized worldwide. Founder Mary Elizabeth Reyes created the studio after a friend had requested she formed a dance group for a small community event. As well as competing in competitions, PraiseTEAM, which practices at Don Bosco Youth Centre in Surrey, holds lessons for youth of all ages. Although they focus mostly on hip hop programs, they also hold lessons in other genres. “We make sure that while learning competitive hip

hop, you learn the foundations of dance,” says Missy, Reyes’ daughter and group spokesperson. The large list of classes include contemporary, tap, breaking, popping, locking, and even singing. PraiseTEAM has been recognized globally, winning bronze at the 2011 World Hip Hop competition in Las Vegas. Currently their Senior Showcase is fundraising to go back to Vegas this summer to compete. What’s unique about this dance studio is that they put their own faith into action. “It’s more than just performing, competing and dancing,” Missy says, “Our routines have a story and a positive message to tell people.”

fastpitch tournament will host more than 1,300 athletes from 14 countries later this month at Softball City, Sunnyside Park and Cloverdale Athletic Park. The 2012 Scotiabank Canadian Open Fastpitch International Championship will be contested June 30 to July 9, with seven national teams in the women’s competition highlighting the 10-day competition. The defending world champion United States national team will be in Surrey, favoured to win a Canadian Open title that slipped away on the last day of play in last year’s tournament. Japan defeated the Americans twice in the playoff round a year ago, clinching the win at Softball City with a 7-0 win in the final. Canada, coming off a fourth place finish in the Canadian Open last year, Australia, Venezuela, New Zealand and Puerto Rico are the other national teams competing in the International Division. Canada won a bronze medal at the most recent world championship tournament in 2010, with Venezuela placing fifth and Australia sixth. The tournament will be the last major international competition before the XIII World Championships July 13-20 in Whitehorse, Yukon. The Women’s Elite category will see national club teams from six countries competing, including the host White Rock Renegades Junior and Senior teams. Great Britian, Mexico and Peru will take to the field at the end of the month, as well as the Liaoning team from China, the St. Louis Extreme Elite and the California A’s. National youth teams from Brazil, Ecuador and Venezuela will compete in the Futures (18-andunder) Gold division, along with prominent club teams from California, Nevada, Oklahoma, Oregon, Virginia and Washington.

Local teams in this category include the Delta Heat ’95, Fraser Valley Fusion ’94, the

South Surrey Thunder ’95 and the White Rock Renegades ’94 and ’95 teams.

The Showcase (under-17) Gold tournament will include local teams from the

Surrey Storm, Delta Heat, White Rock Renegades and Fraser Valley Fusion rep
