Glen Valley residents rally to save forest ‘crown jewel’ Land bearing trees, 80 to 100 years old, put up for sale to pay for Aldergrove school site MIRANDA GATHERCOLE Times Reporter
The corner of 252 Street and 84 Avenue holds one of Glen Valley’s best kept secrets — a pristine forest of large, 80 to 100-year-old conifer trees that some locals compare to old-growth regions in Stanley Park and Vancouver Island’s Cathedral Grove. But residents fear that this gem may soon be gone. The Township, which acquired the land in the 1930s, is now selling the 21-acre parcel — comprised of one five-acre and two eight-acre plots in the Agriculture Land Reserve (ALR) — to raise funds to purchase the empty Aldergrove Elementary School building on Fraser Highway.The school will be turned into a recreation centre for the community. While the Glen Valley residents say they have no intention of halting the purchase of the school and, in fact, support the proposal, they believe the money for the Aldergrove Elementary site should come from somewhere else. “This is about preserving (the forest) for all present and future residents of all areas of Langley, a site that cannot be relocated or purchased elsewhere at any price in the future,” Glen Valley resident Stuart Bucholtz told council on Monday evening. “This treasure belongs to all the people of all of Langley and we respectfully seek a stay of execution of this rare forest,” he said. The decision to sell the land was made at an incamera council meeting in September, 2011. Since then, a new mayor and two new councillors have been elected. The parcels at 252 Street and 84 Avenue are three of eight pieces of land being sold to help pay for the Aldergrove site. The others are five-acre lots, located outside the ALR at 257A Street and 84 Avenue. If all eight parcels are sold at their appraised values, they will generate more money than is needed to purchase Aldergrove Elementary School, Mayor Jack Froese told The Times. The lots were put up for sale on the BC Bid website in May, and the bids will be closed this Friday (June 29) at 2 p.m. However, this does not mean that the properties will necessarily be sold on June 29, Froese said. continued, PAGE 6

'Highest Prices Paid for Gold & Silver'
After a highly combative year of what seemed to be go-nowhere bargaining, the B.C. Teacher’s Federation signed a tentative agreement with the government on Tuesday. Now Langley Teachers Association president Gail Chaddock-Costello is scrambling to book the Coast Hotel for Thursday (today) so local teachers can vote on whether they accept the agreement. “Hopefully, we will have teachers voting on Thursday. We have to get their ballots to the BCTF by Friday,” she said. The BCTF executive is recommending teachers vote in favour of the temporary contract. Chaddock-Costello said she is “pleased for teachers,” but is happy this contract ends June 30, 2013. “The government hasn’t succeeded in destroying our union and we are stronger than ever,” she said. “We can fight another day.” Chaddock-Costello said the B.C. Liberals have tried and failed to strip their contract. “Absolutely no other public sector has been attacked like this.We do feel we have been vilified by the government,” she said. The new agreement does improve benefits like dental coverage for teachers in Langley, something that hasn’t been increased locally in 20 years, said Chaddock-Costello. It also provides teachers with better leave provisions. The agreement kept within the government’s net zero wage increase, which the BCTF said it will be hammering away at again next June. Tip leads to thieves’ capture Roads re-open Two family members arrested stealing from transport truck last week Two men, from the same family, were caught in the act of stealing from a transport truck in Langley on last Wednesday (June 20). One of the men facing charges was the driver of the commercial vehicle, said RCMP. On June 20, members of the Burnaby RCMP detachment’s Prolific Offender Suppression Team arrested two men in the act of stealing merchandise
from a commercial truck while it was in transit from Burnaby to Prince George. The suspects were followed from Burnaby to Langley where they were caught stealing items from the transport truck. “We were acting on information received from Prince George RCMP,� says Sgt. Adam MacNeill of Burnaby RCMP. “Our information was that
over $14,000 in merchandise had disappeared from shipments originating in Burnaby and there was a strong possibility that an additional theft was about to occur. “With the assistance of the Prince George RCMP, our members managed to pull this together very quickly,� said MacNeil. “I’m happy to say that we thwarted the theft and recovered all the property which the thieves had intended to make off with.� The property was owned by a furniture retail chain.
After observing the thieves removing several large boxes containing washing machines from the transport trailer, the prolific offender suppression team moved in and arrested two men without incident before they could remove any further items from the truck. One of the men arrested was the driver of the transport truck. Zdravko Slipac, 31, of Burnaby, and 29-year-old Marinko Slipac of Langley, are both charged with theft. They appeared in Surrey Provincial Court on June 21.
Several roads have been re-opened as the Fraser River water levels appear to be receding. The roads of 264 Street between 84 Avenue and 88 Avenue, 208 Street to Allard Crescent and 88 Avenue, between 256 and 264 Streets, are all open now. The roads were closed last week (Friday) after water began spilling onto them. The Marina Park boat launch remains closed. And the Township is warning boaters and paddlers to stay off the river for now because of all the debris floating down the stream.

Council watcher threatened with ban over bad behaviour MIRANDA GATHERCOLE Times Reporter
Members of the public who attended Township council’s evening session on Monday witnessed an eventful night. Three delegations regarding the sale of Township owned land in Glen Valley stirred up a bit of a brouhaha between members of council and the audience. One audience member may be banned from attending future council meetings. The tension started after Glen Valley resident Stuart Bucholtz went over his fiveminute time limit during his presentation to council on the land sale. (See related story on page 1). When he was about one and a half minutes over the time limit, Councillor Steve Ferguson interrupted him, saying, “Excuse me sir,
we have order in this particular chamber.� At that moment Langley City resident Jacob de Raadt, who regularly attends council meetings in both the City and the Township, began to clap loudly, and was joined by a couple other audience members. Mayor Jack Froese called for order in the room, and all audience members stopped clapping, except de Raadt. Froese asked de Raadt to leave the council chambers, at which point he said,“I applaud this realtor to speak out for his neighbourhood.� He eventually stopped clapping. At the end of the evening meeting, Councillor Charlie Fox suggested that de Raadt be warned about his behaviour or possibly be banned from attending future council meetings. Not naming the individual, Fox said he has “gone beyond on too many occasions.�

Fox asked that letter to be sent requesting that he either retains decorum or further action will be taken. “Quite frankly, I’ve sat in this chamber for seven years now. I’ve sat through three mayors, and all three mayors have had the same challenge. This is not new to this council,� Fox said. “I was previously the principal of an 1,100 student school. I could hold a session in the auditorium, and I never, ever, in all my years, experienced what we are experiencing with that individual. And I think it’s time that we communicated that message.� Councillor David Davis had a more oldschool response in mind. “My first gut impression is why don’t we deal with this out back?� he said, as the chamber burst into laughter. The issue will be discussed with staff, who

will report back to council with a course of action, if one is needed. According to Township administrator Mark Bakken, two people are currently banned from attending council meetings. One has a court-ordered ban and the other has a verbal agreement not to attend. Both have been abiding by those actions, he said. Another person was banned by court order but has since died. From a legal perspective, when a member of the public is causing a disturbance, the mayor has the ability to adjourn the meeting and take it somewhere else or ask the person to leave and reconvene. If there is a physical threat of harm then it becomes a criminal matter and police may be called. “These are the processes that can take place. We aren’t suggesting this is for this particular case,� said Bakken.

I know how things can look on paper when you are trying to sell some land, but have you ever been there?” he asked. According to the Township, signs weren’t put up because the land is located in a rural area, and does not receive enough traffic to warrant signage. Albert Anderson, owner of Alder Acres Farm, disagrees. Popular nearby tourist attractions, including Anderson’s farm, The Fort Wine Company and Barbara Boldt Art Gallery and Studios bring plenty of traffic to the area, Anderson said. He estimates he’s had at least 1,000 cars from across the Lower Mainland at Alder Acres in the past two months. The Glen Valley roadways are also very popular among cyclists and motorcyclists, he added. “Would any of you sell a house without putting up a sign?” Anderson asked council. “I doubt it.” Another issue is clarification of whether the land has been designated as a park. In 1993, the Environmentally Sensitive Area’s report was completed for the Township of Langley by Westwater Research Centre. Overpasses on the way
No simple answer
S
oon, there will be three. Three construction sites, that is, all part of a massive project to build overpasses over the busy rail line through Langley that links Deltaport to the main Canadian railway network. Langley Township council learned on Monday that construction work on the 232 Street overpass will begin in July. Work is well underway on the Mufford Overpass, which will take some (but not all) traffic moving through the heart of Langley’s commercial area over the tracks. Also underway, but very slowly thus far, is work on the triple overpass that will link Willowbrook Drive to 192 Street in Surrey. That will involve an overpass over the Langley Bypass and the tracks on the 196 Street alignment; another on 54 Avenue and a third one on 192 Street. All of these overpasses are partially funded by the federal and provincial governments, TransLink, the railways and Port Metro Vancouver. Thus Langley residents are receiving a benefit that, thankfully, is funded from more than just property taxes. This is as it should be. The port is the busiest in Canada, and as such benefits the entire country. It creates many jobs, not just in the Lower Mainland, but across Canada. The railways and the port benefit tremendously from additional overpasses, as this eliminates much of the risk that is inherent at level crossings. Langley residents will also benefit from an advanced warning system which will involve a series of signs on major streets in the Township and City. These will advise residents that a train is expected soon, and suggest that they use overpasses to avoid getting trapped in a traffic jam. All of these measures will ease the congestion that occurs whenever a train passes through Langley. However, there is still the need for an overpass on the Langley Bypass, so that Highway 10 traffic can get through Langley efficiently. Highway 10 is a provincial highway and serves a lot of visitors to B.C., and people from other parts of the province. Signs along Highway 1 suggest that it is the best route to the Vancouver Airport and the Tsawwassen ferry terminal. Traffic on that highway should not be delayed by trains, and signs telling of approaching trains won’t help too many visitors who are unfamiliar with the local street system. The province needs to make this overpass a high priority.

xpect an appeal of a decision against the law forbidding physician-assisted suicide in Canada. The momentous ruling by B.C. Supreme Court judge Lynn Smith would likely be appealed whichever way it went. As it is, she upheld a challenge by three plaintiffs because the law’s provisions “unjustifiably infringe the equality rights” of one of the trio as well as “the rights to life, liberty and security” of the other two. If law is expected to mirror the values of the people to whom it applies, it’s hard to accept a continuation of the status quo. For example, 21 per cent of respondents in a Forum Research survey of Canadians in December opposed physician-assisted suicide and 12 per cent said they had no opinion. Sixty-seven per cent said they support physician-assisted suicide. Tell that to the B.C. and Canadian governments, whose lawyers vigourously argued for assisted suicide to remain punishable by as much as 14 years in prison. In addition to the religious beliefs that are at the heart of much of the opposition, there are other legitimate considerations. Would legalizing or decriminalizing doctor-assisted suicide result in abuse of the aged and vulnerable? Would the decision cause a “slippery slope” that would lead to other rulings that could undermine the sanctity of life? Those are only two valid concerns. In spite of astounding medical advances, people still die agonizing deaths from afflictions such as Lou Gehrig’s Disease, with no hope of a cure. Should society legally or morally have the right to tell you or a loved one in this frightful predicament that — in spite of being informed, mentally competent and not coerced — that you must continue to suffer against your wishes? The judge wisely gave governments a year before her ruling takes effect. Mayor and council Shooting incident has been sensationalized on occasion working well together Editor: I write to comment on your recent article “Al Wright Calls For Second Look Into Police Shooting” (The Times, May 24.) It is important to start by stating that this was a very tragic set of circumstances, and there is not a single person with any connection to this event who does not wish it had a different outcome. I have at times been very concerned with the coverage the RCMP has received with regard to this matter. The objective has appeared to be to sensationalize this incident and vilify the RCMP’s role in it. This is particularly evident when one discounts or ignores evidence that has been presented, or as in this specific case, blatantly prints a mistruth. The article stated “. . . evidence at the inquest showed that a private conversation between Al Wright and his surviving son Alister, in which Al broke the news of Alvin’s death, was secretly recorded by the Langley RCMP without the family’s consent.” In fact, the investigation of the shooting was conducted by the Vancouver Police Department, not the Langley RCMP. The Vancouver Police witness testi-
fied at the Coroner’s Inquest that the recorder was inadvertently left on when the investigator left the room. The investigator was unaware of this until days later when the recording was transcribed. The VPD witness acknowledged the error and appropriately apologized to the family for the mistake. The assertion that the recording was done “secretly,” suggestive of surreptitious and underhanded behaviour, while dramatic, is not true. There are also other assertions in your article that do not seem to be supported by the evidence identified in the VPD investigation, Office of Police Complaint Commissioner review of the VPD investigation and Coroner’s Inquest. An example is the suggestion that police in some manner committed the offence(s) of “Obstruction of Justice or Criminal Breach of Trust,” when they allegedly “failed to preserve the shooting scene . . . by allowing the weapons to be moved.” There is no basis for this assertion. If a police officer shoots a person threatening him/her with a weapon, the officer must then ensure the weapon is out of the reach of the wounded
person. The reason for this is obvious, the safety of the police officer and anyone coming in to provide medical assistance. As medical assistance arrives, such as the firefighters and paramedics as in this case, the weapon and other objects may be further moved to prevent injury and facilitate medical assistance. The safety of police officers and other emergency personnel, and the preservation of life, take priority over allowing weapons to remain where they fall. Inaccurate or misleading comments reported in this case are not only unfair to those involved, but also to the readers of your paper. I would expect an accurate and balanced view of the evidence that is readily available. Supt. D.R. Some would be pressured into suicide Editor: Assisted suicide should not be legal because older people are at great risk for abuse. In my experience as a Licensed Practical Nurse working with older people in home care, I have come across many situations. I have seen firsthand a family fighting over the will of their parents, while they are still alive. I see that this greatly affects the way the parent feels as they grow older. They feel as if the family wants them to die so The
they can have their money. Some express the pain that they feel when they see loved ones discussing their money, as if they have already passed away. If assisted suicide was legal, some older people would feel the need to say yes — to die — because they are given the message that they are a burden to their family. Some of these older people can be easily convinced and put their trust fully in their caregivers and families.
If assisted suicide were legal, then some would really not make the decision, but let someone else make the decision for them. How is this right? When older people have money or real estate, our laws against assisted suicide are there to protect them. Changing the law to allow assisted suicide would violate their right to be protected in this way. Arlena Vane, Aldergrove
Editor: Harvey D. Schultz (The Times, June 21) seems to have missed what the remainder of the Township see — a mayor and council that is working well together and getting the business of the Township done. There is no petty bickering and no RCMP investigations. I do recall that Schultz was a very strong supporter of former Township mayor Rick Green, and a confirmed member of the Order of the Glass Half Empty gang. Township council has dealt with all business placed on its table and has conducted numerous public hearings and other meetings, as required by law. The fact that it does not have to meet every week is a strong indication to me and others that council is working. Mayor Jack Froese and numerous members of council are out and about in the community attending events and public gatherings. With smiles on their faces and no talk of dissension, order and sanity has been restored. Respectful debates still occur in council and decorum is preserved. Schultz needs to realize that the South Fraser Perimeter Road, Roberts Bank super port and others
are regional issues and are mainly controlled by other levels of government. While many of us may oppose the Regional Growth Strategy (RGS) for its heavy-handed approach to local planning, council did address this and is continuing to do so. Schultz can go back through the Township website’s council archives to see that the RGS was adopted under Mayor Green’s term, and with his blessing. To the writer’s suggestion that Mayor Froese is trying to get work done and is being held up by his council, I don’t see this phenomenon occurring as I attend council meetings. I’ve not seen the writer at very many meetings, save the inaugural. Could it be that such statements made often by the former mayor with regards to council are still floating around in the form of radio waves? I can assure Schultz and others that the circus packed up and left this town with the former mayor in November. The majority of Township residents who voted are happy to see it go, and we view the glass as half full. Joe Zaccaria, Langley
It’s important to preserve fish and wildlife habitat Editor: There has been plenty of evidence that fish and wildlife habitat destruction leads to increased human suffering and our eventual extinction. This point was made clear to world leaders from 169 nations at the Rio+20 Conference. I suggest that readers look at reports from that conference. Given our obvious circumstances, it makes no sense to sell off Langley Township-owned forested properties, including vacant road allowances. To do so for short-term tax relief reasons ignores the greater need to protect our fish and wildlife
habitat to ensure their survival and ours as well. While I was not able to attend Monday’s council meeting about the sale of forested lands in Glen Valley, count me with the Greens. Defining poverty is a challenge from PAGE 10
For what may be the first time in history, we now have a North American society where one of the most reliable indicators of poverty is obesity. This often gets explained away with a popular theory that poor people are somehow forced to eat fast food and drink pop because they can’t afford healthy food.
People who advance this theory presumably don’t do much grocery shopping.There are plenty of processed, sugary, fatladen choices at the supermarket too. But there is also whole wheat bread, rice and fresh or frozen vegetables that are as cheap as anywhere in the world. Given basic cooking skills and some effort, it’s easy to demonstrate which diet is cheaper

Learning disabilities association offers one-to-one help An option is available this summer for parents of children who are struggling in school. Many parents of children aged six to 14, who struggle with acquiring reading, comprehension, spelling and writing or basic math skills, find affordable summer tutoring is a challenge. The Learning Disabilities Association — Fraser South Chapter (LDAFS) is offering
one-to-one tutoring in Langley at the Langley School District administration office, located at 4875 – 222 St. This is the second summer LDAFS has offered the program in Langley, but the program also ran this past spring and will continue this fall at Douglas Park Community School. This program has also been running successfully in Surrey since 1999. Children will be
tutored by a speciallytrained tutor who works under the direction and mentorship of an experienced, certified teacher using strategies developed to help the child with learning disabilities, Attention Deficit Disorder (ADD) or any child who is behind in reading, writing or math. However, a child does not have to be diagnosed as having a learning disability
to attend the tutoring program. At least 10 to 15 per cent of the population has learning disabilities. Many have difficulty learning to read and write but remain undiagnosed and not remediated. LDAFS programs are designed to help these children by providing early intervention at an affordable rate. In addition, some partial subsidies are available courtesy of the CKNW
Orphan’s Fund, for families in financial need. Tutoring is available starting next week (July 3) and will be offered until Aug. 24. Students attend for daily one and one-half hour sessions, Monday to Friday, for two weeks. Session dates are July 3 to 13, July 16 to 27, July 30 to Aug. 10 and Aug.13 to 24. Students can sign up for one or more session dates.

museums includes the One Can Arts Festival. This inaugural event is organized by the Langley Arts Council and will feature an exhibition and sale of original works by area artists and craftspeople. The Langley Arts Council will also hold a fundraising barbeque in support of local arts. There will be an international presence at the festival this year, too, as a Korean-sponsored booth will hand out free food samples throughout the morning in celebration of 50 years of formal relations between Korea and Canada. Korean television, All TV, will be at festival, giving the celebration a cross-Canada exposure that it hasn’t had before. Entertainment-wise there will be plenty going on, including musical acts, a children’s entertainer and traditional Korean drumming. Mayor Jack Froese will welcome visitors to the event. Korean-
born Canadian senator Yonah Martin, along with BC’s Korean Consul General will also provide remarks. There will be arts and crafts demos and workshops at the Langley Centennial Museum and a range of fun activities in the Kids Zone across the street from the Farm Museum. A Canada Day photo booth will be available for those who want to commemorate their visit to Fort Langley. Just down the way from the fort, the Farm Machinery Museum will feature displays of tractors, carriages and antique stationary steam engine. The Langley Heritage Society will also be present with displays and information. The Langley Speedway Historical Association will be out for the first time at the event, with racing cars, photographs and memorabilia. Federal government announces a set of new mortgage rules
CHBA forecasts fewer first-time buyers The federal government announced new rules for mortgages last week, including changing the maximum mortgage amortization period from 30 years to 25. Finance Minister Jim Flaherty also announced that insured mortgages will only be available to buyers purchasing a home for under $1 million. “We want people to make sure that when they purchase the most important purchase they’ll probably ever make in their life, that they do so in a prudent way,” says Flaherty. The government expects that less than five per cent of new home purchasers will be affected
by the changes, but the Canadian Home Builders’ Association sees it having repercussions on a certain demographic. “The shorter maximum mortgage amortization period will reduce housing demand by eroding affordability,” says CHBA President Ron Olson. “For those who would otherwise have selected a 30-year amortization, it will take additional income each month to service new mortgage debt. Some potential new home buyers will no longer qualify, and this will disproportionately affect younger firsttime home buyers.” The changes will take effect on July 9.

Mercedes latest to target Langley City First it was BMW-Mini Cooper. Then Infinity and Audi joined the ranks of luxury automobile dealerships setting up shop in Langley City. Now, a fourth high-end brand is gearing up to join them. Mercedes Benz has unveiled plans for a 4,300 square metre sales centre at the corner of Glover Road and the Langley Bypass. Unlike the other dealerships, however, Mercedes will not become a part of Anthem Properties’ Langley Auto Collection, locating instead on the north side of the Langley Bypass on a parcel of previously undeveloped land. It is the same piece of property where a railway car promoting light rail in the Valley sat until recently. On Monday, council gave first and second reading to a bylaw to rezone the land at 20801 Langley Bypass to accommodate the automotive retail development. According to City staff, Mercedes Benz has entered a long-term lease agreement with the Kwantlen First Nation,

Silver lining for Valley A pair of local ball hockey teams found the podium at the B.C. provincial ball hockey championships. The week-long championships wrapped up on Sunday. The Valley Ball Hockey Association had six teams qualify for provincials, which were held jointly in Langley and Maple Ridge, with three of those squads reaching the medal round and two of those winning the silver medals in their respective divisions. The peanut division Warriors were 3-0-0 in pool play and then beat the Ridge Meadows Earthquakes 3-1 in the semifinals before losing 7-2 to the Delta Thunder in the gold medal game. The junior division Valley team won their pool with a 2-0-0 record and beat Delta 6-1 in the semifinals. But they lost 2-0 in the championship final to Surrey. The peewee division Valley Green Pigs (1-11) were second in their pool but lost 4-0 in the semis to the Surrey Frenzy and 2-1 to the Ridge Meadows Young Guns in the bronze medal game. The Valley Assassins (minor) went 1-2-0 in pool play while the Valley Penguins (pup) were 0-3-0. And the Valley Blazers (minor) went 0-2-0.

During the fall and winter months, Nick Del Bianco and Ben Chow are enemies on the volleyball court: Del Bianco playing for the Trinity Western Spartans while Chow suits up for conference rival UBC Thunderbirds. But in the spring and summer months, the pair are inseparable on the sands of the beach volleyball court. The 20-year-old best friends — they met six years ago playing club volleyball — are off to
Toronto next week where they will look to earn a spot at this summer’s U21 world beach volleyball championships, which will be held in Halifax from Aug. 29 to Sept. 2. “I think we have a pretty good chance,” Del Bianco said. “We obviously have a lot of work ahead of us, but we are getting a lot of international experience with our Mexico and Cuba tournaments, which we have lacked in the past. “It really helps having a few international tournaments under your belt.” He was referring to a pair

In previous years, Del Bianco and Chow have gone to the world championships — they finished ninth in both 2009 and 2011 while Del Bianco played with Toronto’s Garrett May in 2010 and placed fourth. “We are taking this summer more seriously than in the past,” he said. “We are treating it like our

SELLER LOSES; HOUSE BUYER GETS DEPOSIT BACK Buyers of real estate must usually put up a significant deposit. The purpose is partly to show the buyer’s commitment to the deal and also to create a pool of readily available funds for the seller to look to if the buyer walks away. This is especially important where the buyer is a non-resident, or where the buyer’s credit worthiness is unknown. From the buyer’s perspective, he wants to ensure that any deposit he pays is refundable if the conditions inserted for his benefit (like getting a house inspection, obtaining financing or having his lawyer review the title) aren’t satisfied. He also wants to keep the deposit as small as possible to minimize his loss if he can’t complete the purchase. Usually the focus of any discussion about the deposit is the timing and amount. But a 2012 decision of the B.C. Supreme Court suggests that you should also pay attention to the precise wording of the deposit clause, since the addition of a few words can make the difference between the deposit being forfeited to the seller and the purchaser being able to get it back. The deposit in this case was $100,000. The seller sued to have this sum released to him after the buyer refused to complete the purchase. The buyer defended on the basis that the seller had resold the property at a higher price and therefore suffered no loss. The deposit clause in the contract stated: “… unless the balance of the cash payment is paid … on or before the Completion Date, the Seller may, at the Seller’s option, terminate this Contract, and, in such event, the amount paid by the Buyer will be absolutely forfeited to the Seller … on account of damages, without prejudice to the Seller’s other remedies.” On the face of this clause, the seller was entitled to keep the deposit. This view is supported by a previous B.C. Court of Appeal decision which considered similar wording, albeit with the added language that the
deposit was “non-refundable.” Numerous subsequent cases have reached the same result even where the word “non-refundable” was not used. The buyer, however, focused on the words “on account of damages.” He said that if there were no damages (because the seller was able to resell at a higher price), then the deposit had to be refunded. The buyer referred to a different previous B.C. Court of Appeal decision supporting this view. Surprisingly, the 2012 court decided in favour of the buyer and ordered the deposit to be returned. The B.C. Supreme Court placed heavy emphasis on the absence of the word “non-refundable” in the deposit clause in question. (No explanation was given as to why “absolutely forfeited” wasn’t sufficient to convey the same result.) The B.C. Supreme Court noted that the matter was bound to be further appealed, so this issue remains unresolved. In the meantime, sellers and their advisors should make sure their deposit clause expressly says that the deposit is “non-refundable” to avoid problems. Buyers wishing to be able to recover their deposit where the market is rising should seek legal advice about appropriate contract wording to achieve this result. But they shouldn’t expect a favourable reception from sellers, who typically will incur significant delays and commission obligations on an aborted sale. A more realistic strategy for buyers would be to limit the size of their deposit as much as possible and to not waive their conditions until they are confident of being able to complete.

Registration is open for this summer’s Gold Medal Volleyball Camp. The annual camp for male and female players in Grades 6 to 12, is held every July at Walnut Grove Secondary School. Blaze best in Bellingham The Langley Blaze used a come-from-behind victory to capture top spot over the weekend in Bellingham. The U18 baseball team was competing across the border at the Post 7 Bellingham Invite. And after finishing runner-up in 2011, Langley would not be denied this time around. Facing Seattle’s Pacific Tech in the championship game, the Blaze overcame deficits of 2-0 and 4-2 to win 7-4. Langley used a huge fourth inning where they scored five runs to take the lead for good. Justin Geerts picked up the win, while the offence was keyed by Preston Kokatailo’s solo home run and two RBIs apiece from Josh Wray and Tyler O’Neill. Mitchell Robinson and Tanner Shaer also came up with some timely hits. Justin Atkinson nailed down the save by pitching the final two innings. Langley won their semifinal game, 3-0 over Seattle Select, behind a one-hit shutout gem from Tanner Collins. The winning run came in the third inning after Nick Rutckyj led off with a triple and was subsequently cashed in. Other notable performances from the weekend include Aaron Horanski hitting a home run and two doubles, as well as Robinson, Bill Germaine, Mason Cratty and Michael Dagg hitting doubles.
