Clean-up begins as rain slows Forecast: Snow melt not considered a threat. By Barb Brouwer OBSERVER STAFF

While a flood watch is still in place in the Shuswap, officials believe it will be all down river from here. David Campbell of the BC River Forecast Centre said yesterday that while rain in the forecast could contribute to a slight rise in Shuswap River, dry sunny weather predicted for the next several days would see water levels dropping again. The same could be said for Shuswap Lake, which also remains on flood watch and will do so until the water level drops by another 15 to 20 centimetres, something Campbell believes will happen on the weekend, or early next week. And while higher temperatures will speed up the melt of higher elevation snowpacks, Campbell says they are now about 40 per cent of what they were before and not expected to cause a problem. He says rapid snow melt becomes an issue when both high-elevation and mid-elevation snowpacks are melting at the same time. John Rosenberg, public works manager for the City of Salmon Arm, says he figures the lake dropped about four inches over the weekend. He says staff have already begun the long, slow process of cleaning up the debris the water leaves behind. Canoe Beach is littered with debris, brought into shore by the same wave action that took normally out-of reach items out into the lake in the first place. “I think a lot of stuff was sitting on shore a metre or metre-and-a-half higher than normal water levels.” One victim of wave action was the large, carved salmon that sat on the breakwater in Salmon Arm Bay. It was knocked off its perch. “It was in Monday’s photos and was found floating near the marina Tuesday morning,” Rosenberg says, noting the salmon is at public works where it will be assessed and repaired or revarnished as necessary. As well, efforts are being made to locate the carver. See Debris on page A2

The implications of the Neskonlith Indian Band’s appeal of a BC Supreme Court decision are attracting widespread attention. The band is appealing the court’s decision to uphold the City of Salmon Arm’s hazardous areas development permit for the proposed SmartCentres shopping centre. and is providing the city with $10,000 towards legal fees. UBCM president Heath Slee said the UBCM has a modest program “to provide support for legal appeals that have broad applications to local government.” He noted that the appeal claims that local governments have a duty to consult First Nations, “but we believe it is the province’s duty and the province agrees with that.” Slee added that “everyone benefits by having this issue

clarified, being that we’re a member-based organization and some members are First Nations… I think our track record in building relationships with members and First Nations is solid.” The band had earlier requested a judicial review of the permit, citing lack of consultation. Its argument included the concern that the property will flood, requiring flood control measures. Those flood control measures could then do damage to the environment and the

interests of the band. The city’s argument, and that of Salmon Arm Shopping Centres Ltd., was that the city has no constitutional duty to consult, according to existing case law. With regard to law governing development permits, the city argued that once an applicant has complied with the guidelines under an official community plan, a council has no discretion to withhold the development permit. It looks like a mini rollercoaster.” What remains hidden underwater is the state of the shoreline and the grass at Canoe Beach, which has been underwater for a couple of weeks. The beach remains closed to the public, as does the federal wharf. Dan Ferguson, assistant director health protection for Interior Health, says in terms of public safety, there are two important pieces of

Appeal set for Aug. 14 Continued from front At the Supreme Court hearing in March, Justice Peter Leask concluded that the duty to consult, when decisions may affect aboriginal rights or title, rests with the province. Neskonlith Chief Judy Wilson noted the appeal is important to all citizens concerned about the environment, particularly in light of recent floods and flood

warnings. She also said this appeal has broad implications for First Nations across the country. “This case will affect First Nations across Canada by addressing the critical issue that municipalities are bound to respect constitutional obligations, such as the duty to consult. Right now municipalities do not respect the constitutionally protected rights of First

Nations, and this appeal, if successful, will force them to meet their constitutional obligations. The reality is that municipalities across the country are making land use decisions that impact on aboriginal title and rights.” Wilson said Neskonlith successfully applied to have the appeal hearing expedited. It will be heard in the BC Court of Appeal in Vancouver on Aug. 14 and 15.

Lake, there is increased turbidity following the two flash floods,” says Ferguson of the level of particulate in the water. “It’s not the turbidity, it’s what the sediment is concealing or bringing with it.” Ferguson says two well-known culprits are crypto sporidium and giardia, both parasites that are destroyed by boiling water. “If we were to sample any surface water body in B.C., we would not be surprised to find two indicator organisms in the water at any time – total coliform and E. coli,” he adds. “Typically with flood events, we have increased potential for E.coli due

to potential flooding of agriculture, septic fields and whatever’s running from the roads – moose or dog feces. Whatever is out there is now in the water.” The same precautions apply – don’t drink without boiling. “The last message is yes, you can expect total coliform and E.coli in water, but the bigger hazard is the large amount of debris on surface and subsurface of the lakes,” he says, noting swimmers just need to avoid swallowing the water to avoid problems with E.coli. “Try to make sure you’re swimming in an area that doesn’t have debris.”

Flood victims want bridge Residents: Remedy proposed in 2004 might have averted disaster. By Lachlan Labere OBSERVER STAFF

This time Swansea Point homeowners Glen and Linda Heming won’t be letting the province off the hook so easily. Last week the Hemings were busy removing truckload upon truckload of sand and debris from their front and back yards. Their Swansea Point Road residence was in the path of destruction left by Hummingbird Creek after it left its channel on June 23 and came rampaging through the residential subdivision. Glen says his home’s foundation was compromised by the flood, which managed to fill his eight-foot-high basement. There is no insurance as it’s “an act of God,” and seasonal residents do not qualify for disaster relief from the province, he says. So the Hemings are

considering a class action suit which, as they explain, would be based on the fact that at one time, the B.C. government had planned to build a bridge over Hummingbird Creek instead of the culverts that were put in after an equally powerful debris flow occurred in 1997. “We said they need a bridge there instead of a culvert,” says Glen. “The culvert is too small, they put steel rods in front of it to stop the trees from going down there – well that just made it dam quicker because nothing could go through it.” Neighbour Dave Flemming wholeheartedly agrees a bridge may have lessened, if not prevented, the damage this time around. “It did exactly what it did in ’97 – it starts like pickup sticks against the culvert. And it starts to come over the road, and as soon as it started to come over the road the

people who were here in ’97 said it’s going to flood again.” According to Columbia Shuswap Regional District Electoral Area E director Rhona Martin, the B.C. government

George Abbott MLA CANDIDATE had $4 million on-hand to build a bridge as well as catch basins. However, Martin says the government wanted to cost-share maintenance of the basins with Swansea Point residents. In a referendum residents voted it down. “The reason the electorate turned it down is

because the other debris basins in the province, the maintenance is paid for by the province. It is protecting the province’s infrastructure and it is protecting the highway,” said Martin. “So the people of Swansea Point questioned, why should we pay for it when other people don’t have to pay for it, and I can understand that is why they voted the way that they did.” Shuswap MLA George Abbott, who worked with Martin to secure funding for the proposed bridge, confirmed it was shelved after the referendum. “My recollection was the Ministry of Transportation was prepared to bear 100 per cent of the cost of the bridge and the debris basin, subject to there being a specified area created for the maintenance of the debris basin, and there was a very minor cost associated with

that but… I know it was turned down in referendum by a local vote.” Ministry of Transportation spokesperson Kate Trotter said the culvert was not damaged and there are no plans to replace it with a bridge.

Summer Stomp gets nod Alcohol: Concerns of RCMP remain. By Barb Brouwer OBSERVER STAFF

The 2012 version of the annual Summer Stomp in Silver Creek is a go – despite RCMP concerns about liquor control and access. Columbia Shuswap Regional District development services assistant Dan Passmore advised directors at the June 21 board meeting that organizers had submitted their plans by the June 1 deadline and, after some revisions, documents were accepted. He added organizers had agreed to erect a six-foot interlock fence around the entire property, with a 25-foot area to be kept free for emergency services personnel and evacuation staff. “Organizers continue to work with the other agencies and hopefully in doing so they meet the terms of agreement and stage a happy, safe event,” Passmore said. “This is just an update to indicate agreements are in place and plans are signed. The onus is on the event organizers to make sure they comply with the agencies.” Area D Falkland/ Silver Creek/Ranchero director René Talbot said he has continued to field emails and phone calls from Silver Creek residents concerned about noise and wanting to know the music would be shut down at midnight. Talbot again complained about 11th-hour planning by stomp organizers and suggested a community meeting be held early next year to give residents an opportunity to air their concerns and have them addressed. Talbot says his only other concern is protection of the Salmon River, which runs along the property. “We spent a lot of money on the Salmon River, I don’t want

garbage thrown in,” he said. “I will be going, but not in leather. I like to go out and see that they’re following the rules and, if they don’t, they won’t be having one next year.” That would suit Sgt. David Evans, Rural Operations NCO at the RCMP’s Vernon/North Okanagan Detachment. In a June 20 followup letter to CSRD, Evans addresses the issue of seeking approval of the RCMP and complying with RCMP recommendations, as set out in the regional district’s proposed use agreement for the stomp. “There seems to be some confusion around the ‘approval’ aspect, and if the CSRD board is still requiring RCMP approval as an aspect of the proposed agreement, I must reiterate that I do not approve of the current security plan and I do not believe steps have been taken to comply with recommendations,” he wrote.

Going ahead: The Summer Stomp in Silver Creek will be taking place July 19-22. Evans says his number-one concern is a failure by stomp organizers to acquire a liquor licence that would have restricted liquor consumption to a designated area. “Security and drink services persons would have been in a position to assess sobriety and restrict sales where applicable,” Evans writes, noting serving intoxicated people is illegal. “I have recommended that organizers clearly mark and identify the camping area and use signs advising that no

alcohol is permitted outside that area.” Evans further recommends organizers use volunteer security to ensure alcohol is not consumed outside of an individual’s camping area. “This is a recommendation that they may attempt to achieve, but with the setting of the event, the volunteer use of security, and camping being on the same site as the event itself, it will not likely be accomplished.” Second on Evans’ list of concerns is the fact

that even if organizers carry out their plans to install fencing, knowing who is entering or leaving will be difficult. The remoteness of the proposed site is also an issue that could result in delayed response time of police or other emergency services, he notes. Also on the sergeant’s list of concerns is the lack of detail in a plan by stomp organizers to offer a shuttle bus service. “...The details of this need to be added to their plan and designed in such a way as to provide a viable option for persons wanting to depart,” he wrote. “The other concern about the shuttle service is that it will be available during the day to transport attendees to an area liquor store to pick up more alcohol if required. While this seems to provide a service that would reduce impaired driving, it also promotes alcohol consumption at the unlicensed site.”

Extra-curricular up in air News that the BC Teachers’ Federation had reached a deal with the government came apparently out of the blue, with even the typically unflappable Education Minister, our own MLA George Abbott, a bit taken aback. Abbott, who often said the government was prepared to legislate a teachers’ contract to prevent further disruptions for the September 2012 school year, said few were optimistic mediation would work. “This has come together, I think, to the surprise of many people,” said Abbott, who joined Premier Clark for a recent press conference in Kelowna. “This was not a babe that was easily born.” The deal came about only after a long and difficult round of negotiations which included teachers’ limited job action from September to March, a three-day full-scale walkout, a provincewide action plan including withdrawal of extra-curricular activities and numerous actions before the Labour Relations Board. Indeed, court action against the government’s Bill 22 is continuing despite the deal and is scheduled to be heard in December. So it’s clear the new pact represents only a brief truce in the BCTF’s decades-long battle with the reigning Liberal government. The two-year deal is retroactive, and will expire on June 30, 2013 — meaning a return to bargaining will begin in only eight short months. But what isn’t clear is whether teachers will continue with their position on withdrawing participation in voluntary extra-curricular activities. The plan sparked significant controversy both in and out of teaching circles, as it waded into the difficult area of what teachers should or should not do with their free time. Many teachers chose to cease volunteer work, saying the government gave them no other way to protest the government’s actions. Other teachers defied their colleagues, saying no one has the right to dictate what a person does with their unpaid time, and if they want to spend time coaching or helping at grad or chaperoning student trips that’s what they are going to do. What is clear is that whether you agree with the teachers’ positions or not, many in the profession feel disrespected and unappreciated. Those wounds are still open and it is hard to conceive that many of the teachers who have withdrawn their voluntary work with students will be motivated to pick it back up with any zest or enthusiasm. If your boss has just given you a dressing down, you’re not exactly likely to be volunteering to organize the company picnic. This is the situation on a larger scale. My prediction is that many teachers will continue to refrain from extra-curricular activities in part out of solidarity and also because of slumping morale. This likely means changes in extracurricular programs for the next school year: parents and community volunteers are going to have to step up if some out-ofschool offerings are to continue. That’s simply a new reality of our education system.

Precautions required as water drops While the threat of flooding is receding for most areas in the Shuswap, precautions still need to be taken as residents carry on or rebuild after nature’s onslaught of moisture. For some the rebuilding will carry on for months, if not years, while for others, the rainfall, freshet and their aftermath were witnessed in a spectator role rather than as a participant directly affected. One warning goes to boaters and to anyone venturing out on area lakes and rivers. Government officials are urging people to stay off the lakes as much as possible, because of the dangers from large amounts of debris. If you must venture out, proceed with caution and go slowly. Wake from marine craft can still have damaging effects on shorelines already ravaged. Along with the obvious dangers of large chunks of floating debris, some of the unseen threats are

microscopic pathogens in the water. Dan Ferguson with Interior Health warns the public to not drink untreated surface water – now or at any time of year. One seemingly simple remedy: if you go swimming, keep your mouth closed. He also notes that flooding brings an increased risk to water supplies, so those people who use well water should make sure, if it has been compromised, to get it tested. Regarding the aftermath of flash floods on water bodies such as Mara Lake, turbidity – or cloudiness – increases. The sediment is not so much the problem, but the pathogens it contains. Unwanted passengers contained within, such as giardia or E. coli, can be remedied by boiling. While water levels may be receding, vigilance following the flooding is still a necessity.

Safety of cell Turtles protected from fishing hooks phone towers challenged At the June 25th city council meeting last Monday, several citizens made their concerns for health and safety known to Salmon Arm Council, despite assurances by Standard Land Company Inc.’s Kiersten Enemark’s (representing Telus) that cellular tower emissions are low and “governed by Health Canada’s Safety Code 6.” Enemark was there to represent Telus regarding the land and location of the proposed tower and she did just that, and only that. No questions were permitted during her presentation. Citizens were later permitted to direct their questions to council members, but only after council had given their approval for the cellular tower to be erected in the location chosen by Telus. The following are some of the thoughtful and informed questions to Council: Does Health Canada’s Safety Code 6 adequately deal with the proliferation of electro-magnetic frequencies from the many and varied wireless sources, including the powerful emissions from a cellular tower? How does Health Canada’s Safety Code 6 compare with other informed countries? Are you aware that several Ontario schools have removed their wi-fi systems and the Catholic teachers’ union there has called for a moratorium on classroom installations? Why could we not locate the cell towers on the hills or mountains around Salmon Arm rather than within city limits? Do Cell Towers not have to have Code approval (either?) (This question because Smart Meters do not have a CSA or a UL approval.) Are the council members and the support staff aware of the information and research put forth by Olle Johansson and Barrie Trower, an expert witness in court cases around the world because of his experience with microwave technology? My thinking, like others present Monday, is that we need a lot more unbiased research as to EMR effects before we permit another major source of emissions into our city. Shelley Corbin

Thanks go to the Fish & Wildlife Branch for picking up the (dropped) ball and ending McGuire Lake fishing. Would that they – and other promoters of this environmentally disruptive folly, including S.A. Council – had proactively never let it begin in the first place; but they did. At least it’s over, so let all supporters of our community’s little lake be vigilant and ensure that this intrusive, turtlethreatening nonsense never happens again! Many of us grounded in the here-andnow – the 21st century – recognize that principle of ecology, which states that in nature, “everything is connected to everything else.” Many others, like pipeline promoters,

climate change deniers, algae bloom contributors, and perpetual economic growth zealots, to name just a few of those outside the 21st century loop – obviously do not. Similarly, not enough of us grasp the corollary of this ecological ‘connectedness’ principle – namely that in tinkering with nature, you can never do only one thing.” Given its name, we might have hoped that the Fish and Wildlife Branch and fish and game groups would have understood this potential for possible collateral harmful impacts of fish-stocking and fishing on the lake and its resident turtles. But they did not, and the risks of stocking and fishing doing more than one thing

at McGuire were overlooked, harming the little lake and its turtles. Todd Hooper’s (Observer) reaction to McGuire’s fishing closure illustrates beautifully the ethically flawed world view in the whole fish-stocking, fishing and disrespect of nature narrative. By stating that “It was only one turtle...” and “I know there were a lot of kids down there having fun,” he really says it all – that our own “fun” totally and exclusively trumps everything in nature, including turtles – and presumably fish, plants, any hunted wildlife and all else. And how disconnected from nature is that ? Tom Crowley

Advocacy integral part of church role Rev. Juanita Austin’s letter, ‘Political advocacy part of church role,’ is a timely reminder of the work of Christian churches in advocating on behalf of the poor and oppressed. Traditionally, churches have responded to human need in two ways: by acts of charity that relieve suffering and want, and by advocating for social justice. Charity means giving to the poor. Justice means asking why the poor are poor, and taking political action to change the systems and policies that perpetuate poverty. For example, why does annual worldwide military spending stand at $1.7 trillion while 1.4 billion people live in poverty, and 30,000 children die each

day from malnutrition or preventable disease? Why is the Canadian government planning to spend $35 billion for jet fighter planes when one in seven Canadian children lives in poverty and many First Nations communities lack clean water and decent housing? Justice for the Earth is another huge issue that cries out for advocacy. The Bible tells us that God gave humankind stewardship over the Earth, but we’re doing a mighty poor job of it. The International Energy Agency warns that we have only five years to reduce carbon emissions sufficiently to avoid runaway climate change that would drastically alter life on Earth as we know it. Canadians need to ask: why is the

Harper government still subsidizing the fossil fuel industry with $1.7 billion taxpayer dollars annually when these funds are urgently needed to promote the transition to an economy based on renewable energy? Why did Canada recently work to block an international commitment to end annual global subsidies of $409 billion to the fossil fuel industry? Churches have both the right and the moral responsibility to criticize government policies and to engage in political advocacy toward social and environmental justice. Indeed, the stakes for doing so have never been higher. Anne Morris

try forward. As usual the media are dismayed that a Conservative government has the reins in Ottawa. Like Mulcair and Rae they would prefer to see endless talk and debate to waste time and money. But there comes a time for action and that is what we got, much to

Among the first issues to be tackled by the new chamber of commerce would be an airport for Salmon Arm, support of a B.C. Alberta highway, a campaign for local road improvement and beautification of many eyesores. Improved lighting and area advertising were also on the list. Several hundred took part in sporting activities and games held at a country fair arranged by the women of the Anglican Church at Blind Bay.

1939

A youthful Salmon Arm lawn bowling rink made it to finals, taking second place in the Provincial Cup Tournament played at Revelstoke. Members were Bob Labron, John Sansum, Alex Labron and skip Don Campbell. The gym hall was filled to capacity this week in 1939 as the pupils of Ms. Evelyn Diamond presented a music recital. J.F. Nicoll was master of ceremonies and Ted Gorse violinist, was guest artist.

1949

The board of School District 20, this week in 1949 called for tenders for construction of Salmon Arm’s new 14 room junior-senior secondary school. Alderman Victor Nancollas said some 1,600 yards of dirt would be removed to lower the grade od Hudson street between Alexander and Shuswap Avenues. R.E. Postill and sons won the job with a bid of $1,200.

1959

Seven Contestants were in the running for the Queen of the Shuswap crown. They were Heather Inglis, Sharon and Shirley Dobrosky, Anne McCall, Beryl Martin, Kay Ogawa and Maureen Weber. Commissioner T.H. Middleton was authorized to buy a streetsweeping machine at a cost of $2427.

one called them, they just came on their own. “They said we have a truck with 40 tons of sand and sandbags, as well as people to help you.” A total of 48 people showed up to help the couple on their wedding night. “They didn’t even ask for anything in return,” said Breckenridge. “They just showed up when we were in need of help. It was truly amazing,” she says. “With their help we had the entire area sand bagged in an hour-and-a-half,” added Jason. “There were children, as well as adults,” said Breckenridge. “Everyone was lending a hand in some way.” The family and friends of the couple could not get over the generosity of the Mennonites. Breckenridge explains that when they were finished sandbagging, the Mennonites gathered together on the dock where the couple had earlier said their vows and, together, sang a song about love and coming together. She tries to describe the strong emotions that hung in the air at that moment. What seemed like a disaster had quickly turned into something much more inspirational. People they had never met, had come together and performed a true act of human kindness.

A wedding disaster turned into a true story of unbelievable kindness, lifelong memories, and inspiration. Tyler Adair and Ayla Ranahan were planning on celebrating their dream wedding at a lake front cabin in Blind Bay on June 23. The Calgary couple made their way to British Columbia in hopes of blue skies and warm weather, but were instead met with persistent rain and floods. Despite the weather, the couple happily said their vows in the rain, under a simple archway on a dock. “It was beautiful,” said Shirley Breckenridge, a longtime family friend. “The bride had mud all over the train of her dress but she didn’t even care. She said she is only wearing it once anyway.” Breckenridge also described the mother of the groom, who wore her finest dress which was accessorized with a pair of gum boots. The continuous rain soon caused water levels to rise and the wedding reception to be replaced by a sandbagging marathon. Wedding guests struggled to save the cabins from disaster. As the water continued to climb towards their cabins, help came from the most unexpected place. “A colony of Mennonites showed up,” said Jason Adair, the groom’s brother. “No

The group of Mennonites took no time to rest before heading out to help even more people in need. Almost directly after they finished helping out at the Blind Bay cabins, the group was called to help out in Enderby. “They left to help them out right away, and they were going to be working straight through the night,” she explained. Jason says that when they woke the next morning, they decided they had to pay forward the extreme generosity that was bestowed upon them. “We went up and down the road helping whoever we could. We helped sandbag for an RCMP officer and his wife, as well as another family just down the road here. We also went and helped Ryan Smyth’s parents move some of the gym equipment and matting out of their house so it didn’t get wrecked.” “They just did such a great thing for us,” said Jason. “We felt we had to do what we could to help others as well.”

The high waters have increased business in many parts of Salmon Arm but for some in Sicamous, it is too soon to tell what kind of damage has been done. The heavy rainfall and flooding that had taken over the month of June have impacted local businesses in a variety of ways. While restaurants in the areas surrounding Salmon Arm, such as the Blind Bay Marina and Grill, have been forced to close their doors, others have been busy. “Yesterday we were busy for grad and the beginning of long weekend, but it was even more than normal, and I am sure a lot of them came from Sicamous due to their restaurants being shut down because of the flood,” explains Kathy Bradford, owner of both the Barley Station and the Wicked Spoon in Salmon Arm. “What has happened is very sad, but we are very thankful we are all right and that both of our businesses have been very busy, like many others in the area. My guess is that much of that must be due to traffic coming from there.” Other businesses, such as local hotels, have been seeing an increase in activity as well.

Dancing to the music: Alatsjia Gurr and daughter Quianna support a local business by dancing to the music of Ken Bell and Friends Friday evening at the Bear Foot Burger House. “It has given us some business from the evacuation,” says Cindy Martynuik, manager of the Prestige Harbourfront Resort in Salmon Arm. While many Sicamous businesses have not seen an increase in customers, others say it is hard to tell if there has actually been a decrease, with it being so early in the tourist season. Corey Sigvaldason with Community Futures Shuswap said he believes the tourist season has not been impacted at all. “It is picking up I think. There was the initial shock and now that more accurate news is getting out, and people know that the town isn’t completely under water,

more people are coming. A few business have been affected by flooding on the waterfront, but most have not.” Sigvaldason says tourists are continuing to do what they normally would this time of year. Many tourists have summer homes in the area, as well as houseboats. “There are places you can still dock once you get out,” explains Sigvaldason. “There are certain pockets of beaches that have been completely flooded, but there is a thousand miles of lakeshore and only a small area which has been directly affected by the floods.” Penny Hoban, manager of Twin Anchors, says there has been lit-

tle effect on operation of the company which specializes in renting houseboats. The only change in routine has come from the need to sandbag around Twin Anchor’s Sicamous office in order to make it accessible to customers. “That took some of our time,” says Hoban. Located in Sicamous and Salmon Arm, Twin Anchors has been endeavouring to get the word out that they are still open for business. The lake levels reached their peak last Wednesday, and have since begun to subside. Whether or not the flooding has had a direct effect, the general consensus is that more sun will bring with it more business.

Robberies to result in prison time By Roger Knox BLACK PRESS

A woman who threatened to rob a Vernon Subway restaurant with a needle will be going to a federal penitentiary. Provincial court judge Mayland McKimm sentenced Amy Rebecca Barbara Young, 27, to two years in jail after she pleaded guilty to robbery in connection with an incident at the Fruit

Union Plaza on May 23 at 2 a.m. She was also placed on two years probation after she serves her term. Young held up the restaurant with a needle that she indicated was infected with either HIV or Hepatitis C. She pushed a clerk to the ground and made off with approximately $90. The sentence to a federal jail, said McKimm, is to help Young

get treatment through better programs for her drug problem. “This file, like many others, is the consequence of drug addiction which has spiralled out of control,” said McKimm in delivering his verdict. Young also pleaded guilty to a prior charge of mischief. McKimm gave her credit for 30 days served in custody on the charge, and sentenced her to one day in jail.

Germany embraces native traditions By Martha Wickett OBSERVER STAFF

The tears of a woman are what stand out for Ernie Philip, famed fancy dancer from the Little Shuswap Band. Philip just returned from a month in Germany where he was invited to perform in schools across the country. This was not his first trip to Europe; in fact he’s been many times where he’s entertained with his skilled dancing and beautiful selection of traditional costumes. But a young woman’s actions there is what he remembers most this time. He was attending a festival in Stuttgart where he danced. “A young lady about 26 – she was crying. I was wondering what the heck she was crying for. This young lady read stories about native people – there are good stories about natives in Germany. That’s why they like native culture.” Soon, he says, the young woman, her mother and another woman were all crying. “I said ‘Let it out, what the heck.’ She said, ‘I wanted to see a real Indian. I’ve finally seen a real Indian…” Which left Philip deeply moved. “I’ll tell you, that made me feel more than dancing, more than other things. That’s a real commitment between people. That’s the way it should be.” Philip explains why people in Germany celebrate and try to emulate native practices so much. A German man who had never been to North America wrote books about natives, he says, describing traditions, practices and history. “It would almost be identical even though he never came over,” says Philips. “All good stories behind it. That’s the way German people, Austrian, Polish – a lot of them read that book.”

He refers to Karl May, who is said to be the best-selling German author of all time. In 1892, May published the first of many books about a fictional Apache warrior and his German blood brother. In the 1960s, films were produced based on the books and hobbyist groups formed, where people imitate First Nations traditional practices. Philip didn’t find his all-expense-paid month of travel and staying in people’s homes tiring – only inspiring. “I’m in very good shape – I’m 82. I’ve never been sick in my life. I used to rodeo,” he says. “I eat any kind of food – they always offer me food. I said give me your traditional food but not spicy.” Now back at home,

him. “That’s a different feeling. It got me going. I almost started (crying) myself. A true

feeling. She was just happy to see a real Indian. Not many people feel that way in Canada.”

Change in name only Despite its recent change of name, customers should not expect any change in the service they have received for years. The Salmon Arm Express Holiday Inn recently changed its name to the Comfort Inn. “Everything is the same,” said manager Jill Power. “We still have the same owner , same everything, just a new name.” The reason for the name change was the owner’s decision, she said, adding that it made economic sense. The hotel, at 1090 - 22nd St. NE, offers guests a free hot breakfast buffet as well as a swimming pool and free wifi.

Green grocer Save-On-Foods is tickled green. The grocery chain has announced it is the first Canadian retailer to be ranked green by Greenpeace, making it number one in the Canadian supermarket sustainability rankings for 2012. Council approves large-lot subdivision By Martha Wickett OBSERVER STAFF

Although a few neighbours objected, a large-lot residential development proposed by Gary and Sharon Arsenault was given the nod by Salmon Arm council. Arsenault applied to rezone a 4.05-hectare parcel at 2100 45 Ave. NE from A3, small holdings, to R-7, large-lot single family residential. The parcel, which lies between the Agricultural Land Reserve and residential properties, was recently included within the urban containment boundary and is designated low-density residential in the city’s new official community plan. Following a public hearing Monday, June 25, council voted unanimously to approve the rezoning. Coun. Debbie Cannon was absent. Arsenault told the hearing that he has been working on the plan for a long time and it would be a good quality subdivision. Concerns of four neighbours were voiced, while four people spoke in favour, including the engineer working with Arsenault. Concerns included: low water pressure on 20th and the potential effect of more homes; lack of a storm sewer and inadequate channeling of run-off; increases in traffic; increased noise from construction and residents; and loss of green space. Civil engineer Tim Dunne said there are three ways to approach the site, so it’s not easy to predict which way traffic will go. Regarding water pressure, he said Arsenault will be putting in a water main of considerable length, and regulations prohibit impacting water pressure. He said Arsenault “has a passion” for recycling stormwater and will be using innovative solutions. Two people spoke of positive economic impacts from the subdivision while one said it would be a good transition from the ALR.

Several councillors brought up the issue of run-off and how it would be handled. City staff told Coun. Chad Eliason that the developer will be re-

quired to extend the storm sewer up to the 25-year standard into an enclosed system. Methods of handling any drainage coming into the site beyond that

would have to be designed by an engineer. Coun. Denise Reimer said she would be diligent when considering any future requests for variances regarding

storm water for the development, as did Coun. Marg Kentel. City staff told Coun. Alan Harrison that water pressure would not be affected. Harrison

added that he thinks a required path separated from the roadway would be an improvement for people walking. In reference to the path, the city’s Green-

ways Strategy identifies a north-south roadside corridor as a future priority along 20th Street NE from Lakeshore Road to 50th Avenue NE.

One of the first people to congratulate national women’s basketball team head coach Allison McNeill on her team’s berth to the Olympics was her coach from her days with the Salmon Arm Jewels. “I received a wonderful congratulations email from Joe Kupkee – my high school coach when I was in Salmon Arm! The connections and lessons from my years in Salmon Arm run deep,” she wrote in an email to the Observer. With a win separating both teams from earning a berth in the 2012 London Olympics, Canada got off to a fast start in Ankara, Turkey, fittingly on Canada Day, and was able to hold on for a 7163 win over Japan. McNeill played with the Salmon Arm Jewels in grades 11 and 12 when they won backto-back provincial championships, and

Jewel) was coaching that team,” she wrote. “I am excited that Canada will have a basketball team to watch in the Olympics and I hope that seeing our incredible players at the Olympics will inspire a whole new generation of little girls wanting to play basketball.” Canada has been placed in Group B in the London Olympics, with; Australia, Brazil, Great Britain, France and Russia. Speedy golfing for ALS Salmon Arm Golf Club’s Doug Herron, Dale Machesney and Ryan Stugis were among the golf pros in the Shuswap who took part in the 2012 PGA of BC Golf A Thon for ALS. It was a busy day. The pros golfed as many holes as possible to raise awareness and funds for ALS. Starting at 6 a.m. and playing to dusk, Stugis played the quickest round at 46 minutes. “It messes them up for weeks,” said marketing manager Re-

Pedal power fu-els music tour By Barb Brouwer OBSERVER STAFF

T

alent and leg power are taking two local musicians on a cross-Canada tour. Mike Shaver and Stephanie Webster of a Million Dollars in Pennies have set out on their (estimated) four-month tour from Victoria to Newfoundland. Along the way, these troubadours on bikes plan to perform house concerts in return for a place to rest their pedal-weary legs. They are hoping that the word-of-mouth system will trumpet the message across the country ahead of them, encouraging people to put their welcome mats out. Touring is not new to Shaver and Webster, who have travelled far by van before, often driving nine hours at a time and wondering what town they’re in. “This is not a race, it’s going to be over four months,” says Shaver. “We plan to get to Newfoundland in late October.” The couple decided to combine their interest in bike-riding with their love of music, after hearing experiences from others, who have engaged in long bike rides. “With music, people are willing to open their homes to you and to support you,” says Shaver. “That’s why we wanted to slow the pace down a bit, connecting with family and friends across the way, harnessing word of mouth to play a show in front of someone’s house.” Shaver likes the closeness and genuine intimacy that often occurs between performer and audience in interactive house concerts, where questions can be asked and answered, discussion can take place about the music and maybe even impromptu jams after the JACLYN TANEMURA PHOTO concert, when anyone with an instrument can join in. History is delicious this year at R.J. Haney Heritage Village. The sun shone on the Canada Day opening of the entertaining Captain Billie Louie and the Pirate of the Shuswap, the annual Villains and Vittles Dinner Theatre. Written and produced by Peter Blacklock, the play is an entertaining snippet of the history of the Shuswap – with a few unexpected and somewhat stretched embellishments. Talented and wellvoiced, Alaura Bibby, Hannah Gomme, Caleb Makortoff and Aidan Sparks bring the production to life in a most delicious way. Also delicious and served in generous portions, the pork roast dinner is a wonderful prelude to the play. Tasty food is also featured in the July 8 Pioneer Day, a celebration of Salmon Arm’s rich history. Old blues for an old soul “As we was drivin’ down, you know, the highway that’s close around Clarksdale... Just before we’s get to Clarksdale... There was all these trees, all these vines. Listen to me real closely, all these vines seemed to cover the trees, the trees looked like they’re dead. They’re like it’s night time, the ghosts all hanging around ya.’ It’s just like old bluesmen from Mississippi all dyin’ out, there’s just a few left...� So says Floyd Lee, the latest addition to the 2012 Roots & Blues Festival slate, and by his own omission, an “old original knock-downdrag out bluesman.� His latest CD, Full Moon Lightnin’, sounds as though it is from the same sound and spirit that still haunts the woods of the Mississippi Delta. Recorded in Clarksdale, MS, in the same studio where greats such as Sonny Boy Williamson, Robert Nighthawk, BB King and Elvis Presley once played live for DJ Early Wright’s blues show on WROX radio, it echoes the spirit of those past masters. “[It’s called] Full Moon Lightnin’ because the moon is shining on those trees, and those are the souls of the dead

Boy, that’s a heartbreaker.� Like his most recent record, Lee is a product of the Mississippi, where he was born in 1933. When he was three-months old, his mother gave him away because she could not provide for him, and he left the Delta region. Growing up in Memphis Lee often got into trouble and eventually the woman who cared for him put him on a train with a sign hanging around his neck reading, “Chicago.� Though he first began singing in a doo-wop group in the 1940s, it was the blues that always attracted him. As a boy, he would watch his father play guitar and witnessed firsthand

the power it had over an audience, especially the ladies. When his father wasn’t around, Lee would venture down to the basement and play his guitars. And although he has been playing the blues his whole life, it was only recently that his music received widespread recognition. Guitarist and Amogla Records founder Joel Poluck saw Lee perform on cable television in the late 1990s, and “roped him in� to record his songs. The two, along with Brad Vickers on bass, now perform and record under the Floyd Lee Band moniker. Whether playing in a juke joint in the middle of a Mississippi cotton field, or performing in the middle of Times

Square in NYC, the Floyd Lee Band delivers the real deal – hard edged blues. They have topped blues radio charts around the world. It has been more than 60 years since Lee left the hill country of Mississippi and, with his exodus, he turned his back on a troubled childhood and a harsh life in the cotton fields. Lee still wrestles with unanswered questions about his mysterious and painful past. Now at the age of 73, he and his band have embarked on a deeply personal journey back home to Mississippi. It is a journey that has been captured in film, one that, like their lives, stretches through heartache, abandonment and racial divide. “This is a true and uplifting story of transcendence,� says Roots and Blues Festival marketing manager Scott Crocker, who invites everyone to an outdoor screening of Full Moon

Big Dogs back to howl Saturday They’re back! Nazareth – the Scottish lads of rock fame will take to the stage at the Shaw Centre Saturday. Just off a European tour, the band, including original members Dan McCafferty and Pete Agnew will take to the stage, at the Shaw Centre. After 43 years of performing, Scottish rockers continue to draw large crowds.

WILLIAMSON, THOMAS P. Thomas P. Williamson, 59, of Kamloops, British Columbia, died Friday, June 22, 2012. Tom was born in Albany, Oregon, the youngest son of Ralph and Dorothy (Scofield) Williamson. He spent his young years on the family farm where he grew into a gifted athlete, pursuing basketball, football and track. He graduated from Albany High School in 1970, went on to University of Oregon and Oregon Health Sciences University, earning his Doctorate in Medical Dentistry in 1980. Tom purchased his brother Jim’s Dental practice in Chase, British Columbia where he served the community for 32 years. He is survived by his wife of 39 years Marcia (Marcy) of Kamloops, BC; his mother Dorothy and step-mother Elvira of Albany, OR; his brother Ron and wife Charlotte of Monmouth, OR; his brother Dennis and wife Svetlana of Corvallis, OR; his daughter Sara and husband James of Burnaby, BC; his son Seth and wife Shelly of Lynnwood, WA; his daughter Rebecca, husband Kevin, and their daughter Honora of Burnaby, BC; his son Ryan and wife Shannon of Kahuku, HI; as well as numerous nieces, nephews, and cousins. He is predeceased by his father Ralph, his son Bruce J. and his brother Jim. Contributions in memory of Tom may be made to the Heart and Stroke Foundation of Canada. LANGSET, PATRICIA MARGARET (nee Mitchell) Patricia passed away at Bastion Place, Salmon Arm, on June 24, 2012. She was born at Oakshela, Saskatchewan, on Nov. 21, 1919 the eighth and youngest child of George and Louisa (nee Randal) Mitchell. She attended and graduated from the Grenfell High School, Grenfell, Sask. She received her Registered Nurse training at the Regina General Hospital. Patricia also graduated from the Moose Jaw Bible School in Moose Jaw, Sask. She worked as a R.N. in Saskatchewan. California and British Columbia for over thirty years. She moved from Fruitvale, B.C. to Salmon Arm in 1984 and was involved in Crossroads Free Methodist Church. Her later years were physically challenging for her. She was a hospitable and generous person having had many people in for a meal and sponsored several children in other countries and donated to many charities around the world to help those in need. Patricia was predeceased, after eight short years of marriage, by her husband John Langset in 1982. She was also predeceased by her brothers, Jack, Fred, Richard and Donald Mitchell and her three sisters Louisa Russell, Dolly Gibson, and Nancy Irwin. Patricia is survived by her stepsons, Roland (Judy) Langset, Glen (Dianna) Langset of Langley, B.C. and their families. One sister-in-law, Lillian Mitchell of Saskatoon, Sask. also numerous nephews, nieces, and friends. Her cremated remains are to be interned in the Mitchell family plot in the Grenfell Cemetery, Grenfell Sask. A memorial service will he held at a later date. In lieu of flowers, contributions in Patricia’s name may be made to the “International Child Care Ministries” at 4315 Village Centre Court, Mississauga, Ontario L4Z 1S2 or a charity of your choice. HANNAH CHRISTINE DUBITZ (NEE AULIN) “A soft and gentle spirit surrounding us”

She is survived by her son, Steven (Mary) Dubitz of Chase and granddaughter, Kristel Dubitz of Kamloops; daughter, Maxine (Dennis) Mucha of Kamloops; sister, Kathleen Drake of Chase; sisters in law, Beth (Matt) Pryhitko of Sorrento, Kay Hutzkal of Willingdon, AB, Ivy (Tim) Aulin-Barron of Kamloops, Lil Aulin of Chase and Mary Cooney of Kamloops; nieces and nephews and extended family. Predeceased by her parents, Alexander and Catherine (Kelly) Aulin; husband of 55 years, Con Dubitz; brothers, George and John Aulin and sister, Ruth Bjornson. Hannah was born Feb. 7, 1920 in the Chase hospital. Her family lived in Chase Creek and she was the eldest of five children. She attended the Chase Superior School grades 1 – 12 and completed senior matriculation (grade 13) by correspondence studies. After leaving school, she worked in the telephone office in Chase, living with her grandmother, Rosanna Bracken, at the time. She married Con Dubitz of Willingdon, AB in 1942. Her son, Steven, was born in April, 1943. During the war years, she and Steven lived with Con’s parents, Tom and Sandra Dubitz in Hairy Hill, AB while Con was in the army and stationed in the east. After the war the family returned to live in Chase Creek and later moved to the newly established VLA Flat in Chase, where Con built their home. A daughter, Maxine, was born in 1947. The family later lived at Adams Lake and started the Indian Point Resort area with camping and trail rides. Hannah loved living on the lake and gloried in having family and friends visit and stay with her there. In 1964, they returned to the Chase home and Hannah worked at the Chase post office. Hannah’s last years were spent at Ponderosa Lodge and Overlander Extended Care Hospital in Kamloops. Hannah was a lifelong member of the Chase branch of the Catholic Women’s League. She had many interests such as gardening, writing and her music. She was always ready to take on new projects and was a great mentor to the young ones who gathered around. Her sense of humor, love of animals and kindness were always evident – (blue food coloring in the mashed potatoes to surprise us – a puppy’s cool nose on your cheek to kiss you awake in the morning, always room for extra at the table and in her heart). She made us know we could accomplish anything we wanted to in life. Her strong faith and courage carried her through her last years with grace and dignity. She passed away June 24, 2012 at the age of 92 years. We will miss her smile and her love so much – but we will always remember her. A special thank you to Dr. D Hamilton, Dr. T. Eccleston, Dr. C. Bantock and the incredible staff of Overlander Extended Care Hospital for their tender care. Prayers were recited on Monday, July 2nd at 7:00 pm in the Church of the Blessed Sacrament, Chase, BC. The funeral mass aws celebrated on Tuesday morning at 11:00 am. Interment followed in the Chase Community Cemetery. TED BACIGALUPO July 2, 1942 - June 13, 2012 Ted was born in Berlin, Germany on July 2, 1942. Despite the difficult times, Ted had many fond memories of his life in Germany. The family moved to Canada in 1954, settling in London, Ontario. There were many youthful tales of fun and mischief Tony and Walt became his cherished lifetime friends, unaffected by time or distance. Following highschool, Ted joined the Canadian National Railway (CNR) in 1961. There he met Bonnie, his wife of 44 years and devoted friend. Ted enjoyed his work as Freight Sales Marketing Officer in Hamilton working closely with the steel industry. With the arrival of son Randall, and daughter Rochelle, the family moved to a rural acreage north of Hamilton and were joined by their youngest son, Jeremy. Intrigued by the function of local government, Ted ran for Puslinch Township Council, serving three successful terms with dedication and energy. Despite his busy schedule, Ted enjoyed the efforts of rural life; ploughing the 600’ drive with his Ferguson tractor, felling hardwood to heat the house, hosting summer gatherings, brewing maple syrup, beekeeping, and caring for an everchanging menagerie of farm critters. In 1990, Ted took early retirement from the CNR to pursue new opportunities. For one year, he served as the United Way fundraiser head for the industrial sector in Hamilton, surpassing targets despite the recession of the time. With Randy and Rochelle pursuing their careers, Ted, Bonnie and Jeremy packed their belongings into a classic Eaton’s delivery truck and headed west to the Shuswap. Returning to municipal politics in 1999, Ted represented Area ‘C’ for 13 years, first as Director and then as Chair of the Columbia Shuswap Regional District. He served on countless boards with honesty, commitment and integrity, and was a dedicated supporter of many committees and volunteer groups. Due to Ted’s foresight, diligence and hard work, Area ‘C’ implemented its Park Plan in 2004, eventually expanding to include the entire CSRD. Ted was instrumental in leading the establishment and funding of the Shuswap Lakes Integrated Planning Process (SLIPP), which received the Premier’s Award for promoting innovation and excellence. In his personal time, Ted spent many hours fishing, hiking, motorcycling and exploring the outdoors. He enjoyed listening to Andrea Bocelli, feeding the wild birds (and occasional uninvited bear), and devouring pound cake, bean salad, tea, and more pound cake. He was a proud member of the Canadian Blood Services ‘100 Club’ with 183 donations to his name. Ted was supported throughout his life by a loving family. He returned this love, and was extremely proud of his three children and adoring of his two grandchildren. Surrounded by his family, he passed away on June 13, 2012 after a brief, but aggressive illness. Ted leaves behind Bonnie, children Randy, Rochelle (Nicolas) and Jeremy, grandchildren Myles and Lily, stepmother Maria, stepfather Horst, siblings Barbara (Wolfgang), Martin (Shirley), Michael, Anita (Marzio) and many nieces, nephews and valued friends and acquaintances. He was predeceased by his parents Giovanni and Helga, and brother Mario. Plans are being made to gather on July 22 at the Blind Bay Hall to share stories and honour Ted for his work and dedication to the community. WHITING, SHEILA DAWN On Tuesday, June 26, 2012 Mrs. Sheila Dawn Whiting passed away peacefully at the Kamloops Hospice Home at the age of 63 years, with family present. She is survived by her loving husband Stacey, her daughter Shelley and son Shane, grandson Zeth; her brothers Tom, Gary and three sisters Debbie, Wendy, Jennifer and mother Betty. She was predeceased by her father Sydney Yates in 2011. Sheila was a very vibrant, loving person who experienced each day with renewed positive energy that effected all around her. Her smile along with a hug was her standard greeting. Sheila had a special place in her heart for her grandson-Zeth. His visits were always a highlight for her as their bond was exceptional. Family was always important to Sheila but she was always interested in other people’s lives and took time to listen. Sheila enjoyed working at the lab at RIH with all her workmates who were a close group. Sheila was very active all her live. Curves became her place of exercise but she also very much enjoyed the social environment it provided for her with all her friends. Sheila retired in Feb 2006 and 2 months later had cancer. Sheila’s relentless battle with ovarian cancer for the last 6 years, which involved over 40 chemo treatments and surgery, it then became my privilege to serve as her caregiver. People around Sheila fed off her positive attitude, which was a delight to watch. Thank you to Dr Ellard and nurse Karen at the Kelowna cancer clinic, 8th floor RIH cancer clinic, Dr Stabler and Dr Montalbetti for their attention to detail that they provided for Sheila. Death leaves a heartache no one can heal, Love leaves a memory no one can steal. A Celebration of Sheila’s life will be held on Saturday, July 14, 2012 at 11am in the Southwest Community Church with Royal Inland Hospital Spiritual Chaplain Viktor Jan Gundel officiating. Should friends desire, donations to the Kamloops Hospice Association or the Royal Inland Hospital, Cancer Services Fund in memory of Sheila would be appreciated. The gardens at Haney Heritage Village …and there are many, are tended by a very dedicated staff gardener, Norm. The hanging baskets, bursting with colour, are in sharp contrast to the various shrubs in every hue of green, that spill all along the walkways. Mulch in the large garden keeps those weeds at bay, and the combination of rock work and the wood fence frame this space beautifully. Peonies, irises, daisies, lilies, hostas, weigelia and hen & chicks are just some of the plantings in this large area. Dianthus, Royal Red Rock Cress, and Creeping Speedwell, are some of the ground covers along with Arctostaphylos uva-ursi. Roses, along with various trees, such as willow and maple, along with lilacs, add balance. The pond by the bridge is a special spot, surrounded by irises, grasses and greenery too numerous to mention, that allows for something different to see at all the different viewing points.
