Most Lake Country residents have probably already adjusted their driving habits for the Lodge Road roundabout construction, but the Kalamalka Lake Interconnect (KLI) project will have a larger transformational effect on the people the project services. The KLI is part of the Water Master Plan for Lake Country. It is a $5.04-million infrastructure upgrade that is designed to end the boil water advisory that has been in place for the Oyama Creek system customers since 2010. Funding for the projects is shared between the district, the province and the federal government. The project was put to tender this spring and construction began in May, with completion expected spring 2013. The KLI has three main componentsâ&#x20AC;&#x201D;a UV water treatment and capacity upgrade to the Kal Lake Pump Station; construction of a booster station at a midpoint

elevation; and the new Oyama Creek Reservoir complete with chlorination systems and intake. The multi-part project addresses several concerns for the area. The first is water quality. The current chlorination facility is located too close to some end users. Chlorine requires a certain amount of contact time with the organisms in water to work effectively. Homes located too close to the chlorine station essentially derived none of the benefits of the chlorine because there was no transit time for the chemical to work. In addition, the chlorine system had reliability issues. It is a routine part of life for farms on the Oyama Bench to register their water usage, but in the event of a miscalculation or sudden spike in demand, the system would run out of water. Such occurrences sent district staff scrambling into the orchards to find shut off valves to decrease consumption immediately and get the system back on track. â&#x20AC;&#x153;We still have to do

The new reservoir, located above Oyama next to Oyama Creek, will solve many of the reliability problems. Tucked into the hillside, the new six-meter high reservoir will be completely covered and has an expected lifespan of about 100 years. Right next to the

new reservoir, a new selfcleaning screen house and chlorination facilities are being installed. The chlorination facility is far enough away from end-users that the chemical will have time to maximize its effectiveness. Built in the 1960s, the current system on Oyama Creek has a passive screening process that filters out the chunky bits that come with water run-off.

There is no storage capacity, so if demand exceeds supply in the creek during the later summer months, arbitrary consumption limits are needed. â&#x20AC;&#x153;Currently we can run the system, but we canâ&#x20AC;&#x2122;t up volume for demand,â&#x20AC;? Buchholz said. As Oyama grows, demand increases. Buchholz said water studies about agriculture consumption show orchardists in Oyama are in line

with regional consumption rates. The new system is meant to compliment the water intake from Kalamalka Lake. The two water sources will work in tandem to meet consumption requirements. To guarantee the water quality from Kalamalka Lake, the district is installing a UV light filtration system at the Kalamalka Lake pump house. During low demand the interconnected system will be able to provide UV and chlorine disinfected water to the entire Oyama service area. When demand spikes, the new reservoir is ready to meet the needs of the community. The new system should be operational next spring. Once construction is complete, Buchholz said residents and water consumers will have a huge bump in their water quality. â&#x20AC;&#x153;We are hoping to eliminate boil water notices for Oyama,â&#x20AC;? Buchholz said.

RCMP report: Alcohol to blame for a lot of bad behaviour BOBBI-SUE MENARD The number of assaults in Lake Country was higher by 130 per cent in the second quarter of 2012 year over year. During the April, May and June of 2011, 10 assaults were recorded. In 2012, 23 assaults were recorded for the same time period. The theme of the increase is alcohol, said Lake Country RCMP Sgt. Scott Rempel. But assaults were only one piece of the picture presented to council last week by Rempel.

Setting aside impaired driving offences where the statistics do not match up historically due to the changes in provincial law, the most significant statistical drop was the 43 per cent drop in drug offenses. The drop in drug offences masks a very busy year for the Lake Country RCMP in dealing with marijuana grow operations. In his report to council, Rempel pointed out that more pot plants were seized in Lake Country than in Richmond and West Kelowna combined. In an interview following the report, Rempel said the pace of grow-op busts has been exhausting for the local force.

The grow-ops have been found in a about a 50/50 mix of home ownership and rental situations. Most have been stealing BC Hydro power and have been growing for export to Alberta and the U.S. â&#x20AC;&#x153;The larger grow-ops are purely a source of tax free cash,â&#x20AC;? Rempel said, noting the RCMP seized plants and thousands of dollars worth of equipment. In other categories, Lake County crime stat totals tend to have such low numbers, a small increase in incidents can have a large percentage increase. Spousal assaults stayed the same in the

second quarter at seven incidents. Domestic disputes were up 50 per cent with nine incidents in 2012â&#x20AC;&#x201D;three more than in 2011. Again, Rempel said alcohol was the theme. For homeowners living on or nearby the water, while the number of boaters on the lakes has increased, the number of calls and complaints to the RCMP were down. A slightly larger presence of volunteers in the community policing program patrolling local beaches helped keep a lid on rowdy behaviour and illegal bonfires, Rempel added.

A Lake Country familyâ&#x20AC;&#x2122;s campaign to save their death row dog is gaining support, and their beloved pet is now being cast in the public eye as an unlikely victim. The perception tilting case played out in a Kelowna courtroom last week. In particular, it dealt with the regional districtâ&#x20AC;&#x2122;s request to euthanize Jennifer and Peter Madsenâ&#x20AC;&#x2122;s malamute, Shadow. It had been taken into the regional districtâ&#x20AC;&#x2122;s custody over a year ago, following an egregious attack on a local woman. Officials contend that Shadow, which was then 13 months old, had approached a woman and her leashed dog during their walk, and viciously attacked. It left the womanâ&#x20AC;&#x2122;s leg ripped apart, with multiple gashes that took months to heal. The Madsens and several witnesses to the injury causing episode, however, believe Shadow may have been unleashed and inappropriately near the womanâ&#x20AC;&#x201D; after burrowing under their fence to freedomâ&#x20AC;&#x201D; but it wasnâ&#x20AC;&#x2122;t the aggressor. In fact, they say the womanâ&#x20AC;&#x2122;s German shepherd, Bella, was sent into a frenzy when Shadow approached, and may have bitten its owner. Itâ&#x20AC;&#x2122;s been a point of view thatâ&#x20AC;&#x2122;s largely fallen on deaf ears in the months that have passed, but last week the Madsens offered a compelling defence in court that caught the attention of CHBC news cameras

and, in turn, the public. Along with Gary Gibson, a renowned dog assessor from the Lower Mainland with 30 years experience, cameras caught Shadow behaving as a subservient puppy, with no aggressive qualities. â&#x20AC;&#x153;He had his hands in her mouth, and was pulling at her, andâ&#x20AC;Śnothing,â&#x20AC;? said Jennifer Madsen, noting sheâ&#x20AC;&#x2122;s been inundated with community support since the footage aired. Itâ&#x20AC;&#x2122;s a nice change of pace, considering Madsen has contended all along that Shadow is a friendly dog. â&#x20AC;&#x153;I had her at showand-tell at an elementary school on Friday, then they seized her on Monday,â&#x20AC;? she said. The friendly characterization of the dog is far from new to the regional district. Theyâ&#x20AC;&#x2122;ve had contrary viewpoints to theirs since day one, said Madsen, however they choose to ignore it. â&#x20AC;&#x153;They had their minds made up when they heard the woman walking Bellaâ&#x20AC;&#x2122;s story,â&#x20AC;? said Madsen. â&#x20AC;&#x153;Nobody is contesting that Shadow was at large, or that the wound was grievous, weâ&#x20AC;&#x2122;re just saying Shadow didnâ&#x20AC;&#x2122;t do it. Theyâ&#x20AC;&#x2122;re aware of that. Theyâ&#x20AC;&#x2122;ve disregardered witness and police statements. Itâ&#x20AC;&#x2122;s meant that Shadow has been in a fiveby-10 foot cell for the last 15 months, with nothing more than two 15-minute breaks per day. Now, Madsen said, itâ&#x20AC;&#x2122;s time for Shadow to

come home. The court case went on hold as of last Wednesday and wonâ&#x20AC;&#x2122;t likely resume until November. But at monthâ&#x20AC;&#x2122;s end, the Madsens will be before a judge again to regain custody of their pet. â&#x20AC;&#x153;We have a strong legal argument because the court case was held over,â&#x20AC;? she said. â&#x20AC;&#x153;Itâ&#x20AC;&#x2122;s a step in the right direction, but weâ&#x20AC;&#x2122;ve been fighting for this for 15 months. Even our court case is going well. Weâ&#x20AC;&#x2122;ve not yet presented our case, and weâ&#x20AC;&#x2122;re winning based on

their own evidence.â&#x20AC;? As they move forward, however, the Madsens want to offer an outlet for community support, so theyâ&#x20AC;&#x2122;re creating a Facebook page. Shadow vs. the RDCO should be up and running shortly, and there people can offer support, she said. For the regional districtâ&#x20AC;&#x2122;s part, theyâ&#x20AC;&#x2122;ve not backed down from their assessment of Shadow. Itâ&#x20AC;&#x2122;s the third case theyâ&#x20AC;&#x2122;ve dealt with in court, as dog owners disagree with assessments.

Release Shadow Open letter to the Regional District of the Central Okanagan: I have seen this community grow and thrive and so far it has been very welcoming to our four legged friends. However, there is one instance, where it has not. And I am afraid this one instance will overshadow much of the good that has been done. I am referring, of course, to the case of Shadow, who has been incarcerated for 15 months. (See story page A3.) I have read the news reports, read the eye witness accounts, read the expert’s testimony on the personality of Shadow the dog—all has been very consistent. I am extremely puzzled as to why this animal is being treated in this manner. I’m not even going to get into the problems with the dog pound facilities and routines, that should also be looked at extremely carefully. You have a good opportunity to do that now, too. But let’s stay focused on Shadow herself.

I understand that the case is before the courts. I am going to refrain from comment on Shadow’s accuser’s actions. I understand that the RDCO has made an of- T fer to Shadow’s owners in order for her to come home; however, I have also read what that offer was, and the terms were completely unacceptable. w The RDCO should be looking to be fair to its citizens. That offer was not fair in the least. I hope that future policy will include that dogs which have been accused of biting, but which have been cleared by eyewitnesses, will not have to go through this again. I hope that Shadow will get released to her family without any of the unfair restrictions. Instead, have her released to her family on the requirements that she not go off property unescorted. By contrast, I might be the smallest independent producer of statistics in all of the Commonwealth, and my statistics are by no means official. I started keeping settlement statistics one year after I started writing this weekly column. I didn’t want to make estimates and assertions that I could not back up with hard data, so I created a spreadsheet to track every insurance company offer through to the settlement of every personal injury claim that I have settled since the beginning of 2008. My spreadsheet also includes a brief description of each crash, so I

One of the key goals of a campaign I launched of “One Crash is Too Many” is raising awareness of the serious consequences of motor vehicle collisions. I am no psychologist, but I figure we behave according to our perception of the consequences of our behaviour. The more serious the consequences we recognize of our driving be-

haviour, the more attention and care we will take when behind the wheel. The media regularly reinforces a perception that collisions don’t come with serious consequences. Big crashes with lots of damage make the headlines. Sometimes people die, but crash deaths are thankfully few and far between. For the vast majority of reported crashes, even crashes resulting in lots of twisted metal and overturned vehicles, the vehicle occupants are reported as having either sustained no injury or that any injury wasn’t serious. Base your driving behaviour on media reports and it is as if we’re driving around in bumper cars with minimal or no consequences at all. What do you think of when you hear that injuries are “not serious.” Do you think of putting a band-aide on a child’s knee? Media reports are

based on what we see at the scene. With seat belts holding our bodies back from flying against dashboards, it is very rare for there to be any visible injuries at the scene of a crash. The tearing and spraining of the connective soft tissues of the spine don’t typically become apparent, even to the injured victims, until hours after the crash when the tissues start to seize up and become painful. The ICBC Community Snapshot for Kelowna indicates that approximately 2,700 people are injured every year in crashes in Kelowna. How many of those injuries make the news? How many of those would you characterize as “serious” if you knew the full extent of what the injured victims have experienced? Here is where my “statistics” come in. I have a small law firm. Of the approxi-

mately 2,700 people injured in Kelowna every year, perhaps 50 come to me. Keep that in mind when I hit you with my statistics. Also keep in mind that insurance companies pay out as little as they can possibly get away with when settling claims. They make no apology for it, nor should they. That’s their business. They are experts in defending claims, with access to private investigators, medical specialists and excellent defence lawyers. Finally, please understand that the size of a settlement represents the size of the loss to the injured victim. If reporting on any of these collisions, the media would have reported either no injuries or no serious injuries. The average settlement amount, including costs, of the 34 rear-end crash claims I have settled since the beginning of 2008 is $135,963.86. Hereâ&#x20AC;&#x2122;s a call out to the media to change the way they report on crash injuries. Until you know, by calling up the vehicle occupants the next morning to find out how hard it is to get out of bed because of the pounding headaches and seized up necks and backs, please donâ&#x20AC;&#x2122;t comment on whether or not there were injuries. Further, unless you follow up with them three years later to find out what their ongoing, permanent symptoms are, please donâ&#x20AC;&#x2122;t comment on the seriousness of those injuries. Instead, please report the fact that someone is injured in a car crash in Kelowna, on average, every 2 hours and 15 minutes (2,700 per year). When reporting on a crash, please report that it is highly likely that the vehicle occupants were injured and that many of

those injured will never, ever recover from those injuries. Incidentally, about one-third of the rearender cases I settled the insurance adjuster had made an offer to settle the claim directly with the injured victim before I was retained. Another question: â&#x20AC;&#x153;What did you do?â&#x20AC;? I explained what a reunion is. â&#x20AC;&#x153;Did you see a lot of people?â&#x20AC;? My grandson is somewhere between five and sixâ&#x20AC;&#x201D;the village he came from in Ethiopia wasnâ&#x20AC;&#x2122;t fussy about recording birthdates. Itâ&#x20AC;&#x2122;s the first time I recall him asking questions about someone else. Usually, his conversations centre entirely on himself. By some coincidence, that same weekend I read a newspaper article about listening. Listening is not a skill that we work to develop, but perhaps we should. Pauline Oliveros, founder of the Deep Listening Institute, claims that itâ&#x20AC;&#x2122;s one thing we should all learn to do well. Too many of us listen for a break where we can take over the conversation. Or where we can correct the speaker. Or where we can toss in a joke that shatters the moment of seriousness and turns talk back into trivialities. It means really listening to what someone else is saying. It means setting aside any desire to argue, to dispute, to convince others of your viewpoint. You can ask questions, of course, but not

Jim Taylor to challenge, only to hear better what this person is saying, and why. It may also mean listening to what theyâ&#x20AC;&#x2122;re not saying. Perhaps to the things that theyâ&#x20AC;&#x2122;re afraid to say, even to themselves. Setting oneâ&#x20AC;&#x2122;s own agenda aside and paying full attention to another is a sign of deep respect. It was then I realized we had practiced deep listening at our class reunion, without knowing it. For three days, formally and informally, we listened to each other. About our careers. Our families. Yes, about the school days we had in common. We heard things some of us never knew before. And maybe some things that we had never risked telling others before. Genuine listening, says Oliveros, may even help us remember ourselves differently. During our time together, no one expressed judgement. Not once did anyone say, â&#x20AC;&#x153;Youâ&#x20AC;&#x2122;re wrong!â&#x20AC;? or, â&#x20AC;&#x153;You shouldnâ&#x20AC;&#x2122;t say that!â&#x20AC;? I sensed that we were

all dealing with the same questions: â&#x20AC;&#x153;Who am I? How did I get to be who I am now?â&#x20AC;? Such questions matter as we draw nearer to the end of life. We want to know, to recognize, to acknowledge the factors that shaped us. Some decisions were made for us; others we made ourselves. They all weave together into a tapestry that is visible only in hindsight. Listening to each other helped to bring the tapestry into focus. The apparently simple act of listening, without judging, affirmed what each of us had become. Sometimes I jest that I donâ&#x20AC;&#x2122;t know what Iâ&#x20AC;&#x2122;m thinking until I hear myself trying to say it. But that implies having someone who cares enough to listen to the thoughts Iâ&#x20AC;&#x2122;m fumbling with. If no one is willing to listen, can I hear myself think? Listening can change us. It may be the deepest

Developing spinal arthritis is a normal part of the aging process

y far the most common type of injury that I treat in the clinic is neck and back pain. For the majority of my patients suffering from neck and back pain it is something that has gradually come on without an actual injury. The pain starts out mild and inconsistent and then it gradually worsens until

it becomes a daily problem. It is usually when the pain gets more severe that people end up seeking treatment. Many of my middle aged patients who are experiencing neck or back pain come to the clinic after having x-rays of their spine. In almost all of these cases their xrays show that they have some amount of arthritis.

As soon as we hear that we have arthritis in our spine, we assume that we have finally found the reason for our pain. The real story however, is that most times the pain that we feel is not coming from the arthritis but is in fact coming from the tight muscles that run along the spine. Confused yet? I’ll explain.

The difference between having arthritis in a peripheral joint, like the ankle, knee and hip, and having arthritis in the spine is that everyone gets some arthritis in their spine. A certain amount of arthritis in the neck and back is a normal process of aging and does not mean you are going to have pain.

likely. But it does mean that with proper treatment it is possible to get a much better handle on your pain in order to make things more manageable day-to-day. The right treatment varies depending on the person. No two spines are the same, so you can never completely predict what type of treatment will be the most effective way of reducing your pain. The key is to get the deep muscles to start loosening up, and this can be done by using

The formula takes into consideration the inputs that each person chooses in regards to how much retirement income they want, how long they expect to need this income, how much retirement funds they have right now, how much they want to leave when they pass away and what rate of return they assume that they will get in the future. This is different than when we have arthritis in some of our other joints. If we do end up having significant arthritis in one of our peripheral joints (ankle, knee, hip, hands) it tends to cause us pain. So, if everyone has arthritis in their spine after a certain age then why are we not all walking around in pain all of the time? This is because a lot of the pain we feel in our necks and backs is actually coming from deep, tight muscles and not actually from the arthritis. These muscles slowly tighten over time in response to the arthritis changes in your spine. If you can get the proper treatment to cause a release of these tight muscles, you can, in a lot of cases, significantly reduce the pain. Does it mean that you will never have any issues in your spine again? Not

Personally, I think that there are three reasons why this boomer demographic age wave will eventually drive up savings rates and reduce consumption. First of all, I believe that Canadians will have to come to grips that they will need to save more than their parents did simply because their pension and medical benefits are likely to be far less generous than what their parents received and will almost certainly have to be cut sharply. In fact, just this year, the federal government announced the increased age requirement to qualify for the CPP payment. Secondly, unlike their parents, I donâ&#x20AC;&#x2122;t think that people can count on their homes being good investments in the future. I agree with those who have postulated that boomers are likely to be bidding against each other as sellers when

they retire and they all downsize en masse. That should put substantial downward pressure on home prices in coming years. Against that back drop, everyone should have a strong incentive to pay down their mortgage in order to reduce the interest expense of home ownership. Thirdly, people will come to realize that they have no assurance that the capital markets will continue to provide the historically high rate of return that they have become accustomed. That means that if they want to retire with the same standard of living, they should count on saving more not less. As I have said before, itâ&#x20AC;&#x2122;s a simple calculation. My dog has had a runny red eye for several days now. What might this be frorn?

It is a common complaint to see a dog with a â&#x20AC;&#x2DC;red eye,â&#x20AC;&#x2122; or eyes that produce clear or yellow-green discharge. The lining of the eye and/or the white part of the eyeball itself may appear inďŹ&#x201A;amed and red. Although common, these signs can be due to a number of underlying causes that vary in severity from mild to very serious. Therefore it is absolutely necessary to differentiate between them as the treatments differ in important ways. Conjunctivitis is a term that describes inďŹ&#x201A;ammation of the lining tissue that covers the globe of the eye (the eyeball) and lines the eyelids and the third eyelid. This is a common source of redness and discharge and can be due to allergy, viral or bacterial infections, and hereditary conditions for example. A corneal ulcer, or erosion on the surface of the eyeball, is another common cause. These are most commonly caused by trauma but can occur for other reasons as well. A corneal ulcer is very painful and dogs will often squint, rub the eye and may show hiding behavior. An ulcer can be deep or shallow but is always an urgent medical condition that should be addressed quickly to prevent it from becoming worse and damaging the eye permanently. Glaucoma, which is the presence of very high pressure within the eyeball, is a very serious and painful cause of red eye that can be due to a hereditary condition or secondary to damage or disease. It can very rapidly lead to blindness if not treated immediately.

SUMMER REMINDERS SHORT TERM VACATION RENTALS Lake Country is a prime destination for visitors, and short term vacation rentals must comply with zoning bylaws. Residential rentals must be no less than one month in duration. Bylaw Enforcement will be responding to complaints with tickets issued to violators. BOATERS – USE THE WATER SAFELY Boaters are asked to be cautious of high water levels, and to be mindful of their boat wake and its effect on lake and river banks. The wake from boats or personal water craft can displace the water levels as much as two feet and could damage homes. Conservation Officers will be actively enforcing the 10 km/hr speed restriction within 30 meters of shore on interior lakes. RESPECT THE ENVIRONMENT With the gorgeous summer weather upon us, more people are getting outdoors to be active and enjoy the beautiful natural environment around Lake Country. Please remember to pack out what you bring in. Leave our parks and trails cleaner than when you arrived.
