to stop us from going in there,” said McGowan, a retired provincial highways engineer who worked on the road. “There is more information to say that this portion is a public road than any [darn] road in British Columbia.” He said the Ministry is claiming Stoney Lake Road doesn’t exist so that they don’t have to challenge the many corporations throughout the province that are blocking public access to Crown roads. “This is just one of many

Crown roads that the public is blocked out of,” McGowan said. “We just took this road as an example because we have so much information to say that it is public.” The debate has escalated since local and national media watchdogs and the public have approached the Ministry with pointed questions over the last several months. According to the Ministry, Stoney Lake Road, which is the source of much confusion, has

since been replaced by Pennask Lake Road, the Ministry stated after reviewing documents dating back to the 1880s. “Ministry staff and legal counsel from the attorney general have concluded a review of records on Stoney Lake Road ... that determined no substantive legal grounds to pursue public road status,” the spokesperson said in an email, noting Stoney was replaced by

Fly-in attracts nearly 40 planes to the Merritt Airport Flying club lands biggest turnout ever By Jade Swartzberg

Nearly 40 pilots landed at the Merritt Airport on Sept. 2 for the Merritt Flying Club’s fourth pancake breakfast and fly-in, and volunteers served up over 80 breakfasts to hungry visitors. “This was the biggest one we’ve ever had, and everyone was tickled pink with the product,” said flying club Secretary Treasurer Herb Graham. “We had a lot of great compliments and it just keeps getting bigger every time we do it.” Guests started arriving just after 8 a.m. and by mid-morning 40 various planes were parked at the airport. Though Graham said the flying club focused their invitations on other flying clubs, sending them to Williams Lake,

Mike Goetz and Harry Kroeker were there all morning flipping pancakes and selling tickets. “The city councillors just dove right in,” said Graham. “We are delighted to be a part of the airport.” The Merritt Flying Club has about 20 members, but Graham says locals are starting to show more interest than there has been for many years. Besides planning more pancake breakfast fly-ins, Graham says the club is still trying to facilitate a flight school,

which will include independent ground school studies by correspondence and weekend lessons with a flight instructor. The flying club is also trying to facilitate the purchase of a multi-pilot owned aircraft that local pilots could buy in to. “This would help people get enough flight hours to get their license,” said Graham. “If 10 people buy in, it might cost $5,000 each; if we only get five people, then it will cost more.”

road access dilemmas, also hasn’t returned the Herald’s phone calls. Fraser-Nicola NDP MLA Harry Lali, who served as the Minister of Highways from 1998 to 2001, said he doesn’t blame the bureaucrats. “There is a huge fear in ministries and government agencies and boards of this government because of their gag orders,� he said. “I know people in the ministries who are afraid to come out publicly and say anything because there is no protection for them in terms of whistleblower legislation.� He said the Liberal government is too friendly with corporations and landowners. “The government isn’t willing to take them on, for

political reasons,� he said. The current government will set up safeguards to protect important information about the roads, as a precaution in case the NDP is elected during the next provincial election on May 14, he said. Access to Minnie Lake is just one example of the many access rights throughout the province that are blocked, Lali said. Douglas Lake Cattle Co. Ranch Manager Joe Gardner didn’t return phone calls by press time, but he is on record as saying the roads existing after 1884 didn’t provide access to the lakes. He also said that ranch management won’t charge people for “trespassing� because it’s such a small fine — $115.

Political maneuvering caused the B.C. Wildlife Federation to put off creating a fund to fight the Douglas Lake Cattle Co.’s claim to Pennask Lake Road, says Fraser-Nicola NDP MLA Harry Lali. “The government has run the province with a dictatorial approach for the last 11 years and that’s no different here,� he said, noting a friend at the vote told him about

the alleged corruption. “The vote was set up and then the Liberal troops were there to defeat the resolution.� The road has been the subject of intense debate since the mid1990s when Douglas Lake Cattle Co. installed and locked a gate on the road, blocking anglers from fishing Minnie Lake. Tensions escalated when local anglers protested at the locked gate in March 2011. The fight continues to grow, the gate remains locked and members of the same angling group even cut the lock to fish the lake this spring. Now the anglers want to take the Douglas Lake Cattle Co. to court, but lack funding. That’s where the BCWF comes in, and in the spring a resolution was drafted that

would have called for a fund to be established by the Federation to pay for court costs for establishing public ownership of roads that are claimed to be private throughout B.C. “There was a quiet campaign that went on to make sure the resolution was defeated, and the campaign was very well organized,� Lali said. According to Rick McGowan, BCWF member and the man charging the fight for public access, several Liberal politicians were at the April 28 vote to influence members to vote against the resolution. He said Premier Christy Clark, Forests, Lands and Natural Resource Operations Minister Steve Thomson, and several MLA’s held private meetings just prior to

the vote to convince members to vote in opposition of a resolution to set up a fund to take the access dispute to court. An initial vote tallied 54 in support of the resolution and 52 against it, McGowan said. “Then immediately after that vote, a member of [Kootenay East MLA Bill Bennett’s] riding stood up and asked for a recount and a delegate card recount,� he said. “When they counted the cards, it somehow came out to 110.� That revote resulted in 55 for the resolution and 55 against. But according to McGowan, two members didn’t vote, “so the most it could have been was 54-54.� “After a whole bunch of whispering on the podium, they announced that

it was a tie,� he said. “I’m finding this is completely politically motivated, and it’s supposed to be a conservation-based organization.� The vote would have resulted in a $2 increase in each member’s fees to provide a fund to fight public access throughout the province, something McGowan said the Liberals don’t want because their financial contributors consist of many landowners, including the Douglas Lake Cattle Co. But BCWF President Bill Bosch said he doubts politicians swayed any of the members to vote against the resolution to create the fund. “We don’t give politicians a venue to speak on our resolutions,� he said. Since the vote, the BCWF executive cre-

ated an access plan on July 15. Membership dues were tabled to slightly increase for the establishment of a fund to settle access disputes on public land, possibly in court. “This will encompass everything,� Bosch said. “If it’s an access issue for our membership, it’s an access issue for anywhere in the province, including Douglas Lake.� A final copy of the access plan is slated for release within the next six months.

HERALD OPINION Tackling modern problems TOM FLETCHER B.C. VIEWS Local politicians are preparing for their annual convention, to be held Sept. 25-28 here in the provincial capital. One of the first orders of business this year will be a vote to raise the dues paid by local governments to the Union of B.C. Municipalities, to cover rising travel costs for staff to serve on provincial committees. The plan is also to change the name to Union of B.C. Local Governments, to reflect the participation of regional districts and aboriginal communities. So what do these committees and conferences accomplish? The UBCLG, as it will soon be known, is mainly a lobby group for local politicians to seek changes to federal and provincial laws to keep up with changing times. The resolutions offer a snapshot of modern problems facing local governments. A major theme is public safety, and this year it is the Columbia Shuswap

Regional District renewing a long-standing plea for more provincial policing money for rural communities. Surrey has a resolution seeking better notice and control of a growing number of medical marijuana licences issued by Ottawa. Local fire and police departments end up dealing with licensed grow-ops that spring up quietly and create electrical hazards, or expand production beyond their licences as this stealth legalization continues. Pitt Meadows, home to a Hells Angels club-

house and drug-related crime familiar to most urban communities, wants B.C. to follow Alberta’s lead and give police authority to remove known gang members from bars and clubs. Gangs tend to adopt certain establishments, and there isn’t much the owners or police can do about it. This year, the debate may go further. Metchosin is seeking support to call on Ottawa to decriminalize marijuana, ending a “failed policy which has cost millions of dollars in police, court, jail

and social costs.” No chance of that under the Stephen Harper government, but it’s worthwhile to send the message. Another long-shot demand, sparked by the abduction of three-year-old Kienan Hebert of Sparwood last year, is for Ottawa to make its sex offender registry public for convicted repeat offenders. Ashcroft councillors want to give emergency services authority to deal with another modern hazard: hoarding. Yes folks, it’s more than just a show on TV that exposes a

creepy side effect of our bloated North American consumer culture. The Ashcroft resolution notes that obsessively piling stuff to the rafters is a growing problem. And as with marijuana grow ops, “local governments have little or no authority to enforce compliance with health and safety standards when a building is owner occupied.” Another First-World problem is the “pocket dialing” of 9-1-1 by cell phones. This is more than just a nuisance, because local emergency services are

obliged to respond to every call they get. And mobile phones can’t be traced to their location with any precision, creating time-consuming searches that weaken response to real emergencies. Other resolutions tackle complex and important issues, such as the effect of hydro development on municipal water supplies. But alas, most will be lost in the convention noise, overshadowed by political posturing over matters best left alone. Last year’s convention featured the low comedy of delegates

voting with wireless devices to condemn smart meters, after displaying their ignorance of the subject. This year, in addition to factually challenged railing about oil tankers, there will be a tough stance taken against shark’s fin soup, which will no doubt strike fear into the Chinese fishing fleet. Too bad MLA’s passion not directed at landowners Dear Editor: So you can raise the dead ... you just have to give them bad press. Harry Lali’s Sept. 4th letter to the editor was passionate; too bad we’re not seeing such passion directed at large landowners who illegally prevent access to public

roads and lands. I was surprised, though, that Lali admitted that this issue was brought to his attention March 19, 2010. A person with an ounce of pride would be embarrassed to point out that in two-and-a-half years he has been unable to force the Douglas Lake Cattle Co. to rightfully open

roads and locked gates, even though there is a wealth of documentation supporting such an action. Imagine what he would be like handling a meatier issue, like the controversial Northern Gateway Pipeline Project. As for stating that I’m an unwitting victim of a co-ordinated BC

Calgary mom concerned with Merritt RCMP’s actions Dear Editor: My name is Johanne and I am a very concerned mom. My daughter and her friend drove to B.C. to see their grandmother on the long weekend. On their way back, one of your officers pulled them over for speeding 40 kilometres over the speed limit. I don’t have a problem with that. My probem is

what the heck was he thinking impounding her car for a week? Oh that’s right, must be quota time. He drops them off at the bus stop and tells them to find their way home. Two young girls who are 21, crying their eyes out. Don’t get me wrong. I don’t have a probem with the speeding ticket of $300 plus, but my daughter is a young girl trying

to go to school and she’s never been in trouble with the law before. Now she is stuck without a vehicle for a week and who the heck is going to pay for the airfare back and the impound? I can’t drive; I am blind in one eye. To leave two young girls stranded in the middle of no where is crazy. Had something happened to them what I would get?

“Oh, we are very sorry for your loss.” This doesn’t sit well. It cost over $500 to get the two of them home, not to mention now we have to somehow get back to get the car a week later and pay for impound. She needs her car to drive me to doctors appointments and what-not, as well as get herself to work.

We cannot afford this. We need her car back now. She’s never even had a speeding ticket before, and she said the officer was rude and ignorant. I am thankful they are home but never ever would we go to Merritt. Is this the way the police department runs in Merritt? Johanne Larkin Calgary, Alta.

MERRITT’S MOST WANTED

Take care of the land, it will take care of you JEANETTE MCMASTER In FRIENDSHIP When I was young, my father used to tell us stories from his childhood. He began his work at the Douglas Lake Ranch as a water boy. He was low on the totem pole, but he did not mind. He said he learned from older cowboys just by watching and listening to them. He gradually worked himself up to be a young cowboy. He worked for the ranch for a short while, then decided to move on. He liked to work on the land, he said. He liked the feel of fresh earth, still warm from the sun, as he sifted the

dirt through his fingers. He settled down, bought several horses, then a head or two of cattle. He gradually built up his property. He worked hard and built fences around his land. Then he made irrigation ditches and plowed his fields. I used to go with him and watch him work. At that time, there was no automatic water sprinklers; he did his irrigation by manual labor. He used to carry a shovel with him. He would walk and check each piece of field; then he would direct the water to flow through — he loved the land. He said when you look after your land and take good care of it, it will look after you too. I often rode with my dad to the mountain range hay fields — he owned about 80 acres of land there. Our neighbours were Caroline Tom and her

mother. They owned the property across the creek from us. We would often stop at their place and visit with them. Caroline was a close relative to my dad. Their home was about a two-hour ride on horseback from our home. A beautiful place, which overlooked the valley below. I remember Caroline used to have a radio, on which she would listen to her soap opera. In those days, tripe was considered a delicacy to our people. My mom used to clean the tripe, roll it in seasoned flour and deep-fry it . The tripe that had many pages just like a book, she cooked in a pot. I enjoyed the way my mom prepared the tripe. I actually have not had tripe since she passed away. So, tripe was a gourmet food for our peo-

ple, just like bannock . I hope you all enjoy this walk on memory lane. I enjoy writing about my memories. Thank you to the many people who have said to me, “You are the lady that writes stories; we love to read them. Please continue with your writing.” I stopped writing for a short while, but now I feel I am ready to write again. My mom and dad were great teachers for me. They taught me so much. Truly, God our Creator chose my parents for me very well indeed. Surely, He chose my life’s path too. Psalm 139:16: “Your eyes saw my unformed substance, and in your book all the days of my life were written before ever they took shape, even when as yet there was none of them.” As Always in Friendship.

The playground at Diamond Vale Elementary underwent groundwork over the summer and is nearing completion. Principal Val Edgell said she anticipates the playground will be finished by the end of the month. “The part that has been started, in the ground, you can’t really see,� she explained. The anchors for the climbing structure are installed, new footing for the playground was dug out and fresh gravel was laid. “We’re waiting for the craziness of the first week of school to settle for the maintenance department, and then [this] week the concrete should have cured enough for the anchors and then they can start putting up the rest of the structure,� she said. In addition to money that was donated by the community, NicolaSimilkameen School District 58 contributed several thousand dollars from a Play Possible program, Edgell said. The grant matches up to 15 per cent of costs for new playground, to a maximum of $50,000, the program’s website

STRENGTHS: Head coach Luke Pierce’s squad surprised quite a few pundits and prognosticators last year with a second-place finish in the tough Interior Division. The Centennials were the only team in the BCHL to beat the juggernaut Vees at the SOEC in the regular season. Half of that impressive Cents’ team is back, led by last seasons’ leading scorer Soquila, outstanding netminder Steel, newly-named captain Fletcher, and heart-andsoul d-man Sabourin. The off-season acquisition of points-producer Derek Huisman (30-35-65) from the Chilliwack Chiefs and vastly underrated Sebastien Pare (6-8-14) from the Langley Rivermen gives Merritt the kind of depth in the forward ranks that could be the envy of the league. Pierce has made it no secret that he wants this, the 40th anniversary of the longest continuously-run BCHL franchise, to be THE year for his team. ROOKIE SENSATIONS: F Craig Martin finished third in KIJHL scoring as a 16-year-old with the Beaver Valley Nitehawks, recording 48-48-96 in 50 games; D Michael Statchuk was the Prince Albert Mintos’ captain and top scoring d-man, posting 13-26-29 in 44 games. The 5-foot-11, 190-pound Wadena, Sask. native was also named Top Defenceman at the Macs Midget AAA Tournament in Calgary. F Mitchell McAllister was captain of the Strathmore, Alta.’s UFA Bisons, racking up 14-25-39, along with 100 penalty minutes, in 34 games. He will bring energy to the Viper lineup. STRENGTHS: With a balanced crop of returning d-men – including Corkey, Renz, Marc Hetnik and Geoff Crisfield – augmented by several promising recruits, the Vipers boast one of the league’s most formidable bluelines. Up front, Tambellini, Pearce Eviston, Martin and Braedan Russell will provide some scoring touch, while veterans Colton Sparrow and Hadley can play in all situations and make life miserable for the opposition. ROOKIE SENSATIONS: Warriors’ head coach Rylan Ferster had a solid year of recruiting, bringing in players from Western Canada and starts the year with just six rookies. On defence, Penticton native Adam Plant joins the Warriors from the Okanagan Hockey Academy and is already committed to Harvard University. Jetlan Houcher and Ambrose Firkus were top players in Saskatchewan while Matt Anholt joins the Warriors from Lloydminster and Lake Country’s Brent Lashuk arrives from the Kelowna Chiefs of the KIJHL. STRENGTHS: With a dozen returning

players and four newcomers with junior A experience, the Warriors will ice a veteran squad this year, including in net where newcomer Tyler Briggs was acquired in a trade deadline deal with Lloydminster of the AJHL. Briggs led Canada West to a World Junior A Challenge gold medal and had four shutouts with the Bobcats. With support from Garrett Rockafellow, the Warriors will have a solid tandem in net, something they lacked in Ferster’s first year with the Warriors. COACH’S QUOTE: Rylan Ferster – “We really like our group. Our returning guys are solid character guys. We addressed our biggest need in goaltending with Tyler Briggs and Garret Rockafellow. We like our depth down the middle and I really like our recruiting class.” 4. ROOKIE SENSATIONS: This year’s 16-year-old will be Kamloops minor hockey product Ryan Gropp. This sixth overall pick by the Seattle Thunderbirds in the 2011 Western Hockey League draft starred with the Okanagan Hockey Academy Midget prep team, scoring 21 goals for 51 points in 41 games. He appeared in two games as a call-up with the Vees, scoring once. Louie Nanne, grandson of former Minnesota North Stars’ general manager Louis Nanne, played with the Minnesota’s Edina Hornets high school team, the same school that produced former Vee Steven Fogarty. Nanne, a seventhround pick of the Minnesota Wild in the 2012 NHL Entry Draft, had 12 goals and 20 points in 24 games. He also played for Team Southwest and tallied seven goals and 20 points in as many games. Dexter Dancs is a familiar name for Vees fans. With his ticket booked to the University of Michigan, Dancs played 15 games for the Vees as an affiliate collecting one helper. The North Vancouver product had a strong season with the KIJHL’s Osoyoos Coyotes, scoring 29 times and adding 38 helpers in 42 games. STRENGTHS: Goaltending is expected to be a strength again. Katunar earned invaluable experience during the playoffs when Michael Garteig was injured, and helped push the Vees to the 2012 Doyle Cup against the Brooks Bandits. He is confident and eager to lead the Vees in defending their RBC Cup championship. Vees’ head coach/GM Fred Harbinson believes his defensive core will be strong and deep and feels he has four solid lines. COACH’S QUOTE: Fred

The Anchorage, Alaska product spent the last three years at renowned prep program Shattuck St. Mary’s in Minnesota and will attend college in the land of 10,000 lakes at Mankato. Hometown boy Bryden Marsh and his 6-foot-2 frameshould get a good look up front after a pair of productive seasons with Golden of the KIJHL. Originating in the Soo and another Shattuck product, Carter Lukenda joins the fold and adds a playmaker’s eyes to the lineup. STRENGTHS: Usually turning a lineup over almost completely means a year of growing pains but for the SilverBacks, it represents a breath of fresh air. Head coach Troy Mick takes the reins, returning to the BCHL after six years away and brings in a new No. 1 goalie in Colin Dzijacky, who posted a 0.65 goals-against average in two 2012 RBC Cup appearances with host Humboldt. On the blueline, four returners bring stability in Hanna, Hambrook, Flanagan and Brendan Kennedy. COACH’S QUOTE: Troy Mick – “We’ve brought in a whole new attitude, a whole new commitment level. I would have liked to play one or two more (exhibition games) to

get an eye on the returning guys; there’s the want factor – they have to show me how badly they want it.” 6. TRAIL SMOKE EATERS KEY RETURNEES: G Lyndon Stanwood (4.06 GAA, .886 SV%), F Garret McMullen (17-19-36), F Tanner Clarkson (15-11-26), F Brent Baltus (14-16-30), D Brandon Egli (2-9-11), F Adam Wheeldon (3-710). ROOKIE SENSATIONS: 17-year-old Trail product Scott Davidson was injured most of last season and saw little ice time with KIJHL Beaver Valley Nitehawks. But if preseason is any indicator, the skilled forward will be one to watch in the coming year. The Major Midget Kootenay Ice’s 16-year-old forward Mitchell Foyle and 17-yearold Trail native Jake Lucchini are also impressive additions, while goalie Braeden Krogfoss, 17, of Cloverdale was an MVP goalie with the Vancouver Giants in the B.C. Major Midget League last season. His size and mobility should prove a dependable counterpart to the Smokies’ starter Stanwood. STRENGTHS: The Smoke Eaters will be solid in goal. The lightning-quick Stanwood and sixfoot rookie Krogfoss provide stability in the crease, shoring up a veteran defence. Talented returnees like McMullen, Clarkson and Baltus, along with recent acquisition Alex Holland from the Victoria Grizzlies should give the Smokies some scoring touch up front, and former Alberni Bulldog’s Tyler Berkholtz will add size and toughness. COACH’S QUOTE: Assistant coach Brent Heaven – “I think we’re looking pretty strong. We definitely have two strong goaltenders and we’ve got a pretty solid D-core with a lot of veterans back there, and I think our top couple lines will be able to put some pucks in the net. We’ve got a lot of good role players, so things are starting to cometogether pretty well.”

CENTS CAN’T GET NO RESPECT! Despite a tremendous 2011-12 season in which the Merritt Centennials finished second in the highly-competitive, eight-team Interior Division of the BCHL, and made it to the Final Four in league play-offs, the majority of sports writers from the region are regarding last year’s Cents’ success as a “one off ”. Below left are my predictions for the coming season restated, while on the right is the consensus opinion from around the Interior. Hopefully, they (and not me) will be the ones forced to eat crow come next April.

Joe (Joseph Nickolaus) Benzer We are sad to announce the passing of Joe (Joseph Nickolaus) Benzer in Merritt, on September 5, 2012, at the age of 82 years. Joe was born and took all his schooling in Kelowna. He moved with his parents to Merritt in 1951. He was trained as an Electrician by his Dad and later joined the IBEW where he worked for the rest of his career. He thoroughly enjoyed his work and travelled much of the Province working at different B.C. sites. He retired to Kamloops, and returned to Merritt when he needed more care. Joe enjoyed swimming and paddling in the war canoe races at the Kelowna Regatta. He was one of the first people to swim across Okanagan Lake, a distance of over a kilometre. He enjoyed the outdoors, participating in hunting and fishing. He was involved in Boy Scouting, rising to a Troop Leader. Although Joe never married, he was very much a part of our families. He was especially loved by his nieces and nephews, who he used to take out for breakfast whenever they were all together. They would stop to have a visit with him anytime they went through Merritt. He was predeceased by his parents Nick and Liz, and brother Bill. He is survived by his brothers, Ernie (Kaye) in Kelowna, Art (Gail) in Montrose, sister-in-law Sybil in Terrace, and his eleven nieces and nephews and their families, also three great, great nieces. He will be missed by all the family. A special thank you to Maurice Mathieu for being a wonderful friend to Joe, visiting often, taking him out, and doing any shopping for him. You were a huge part of his life the last few years that he lived in Merritt. Also thank you to the staff at Nicola Meadows, where he lived until he needed more care. You were awesome to him, teasing and helping him and practicing “Tough Love”. The last few months at Gillis House were made so much easier because of the very caring staff there. A special thanks to Dr. Van Der Merwe. Merritt Funeral Chapel is in charge of the arrangements. Joe’s ashes will be put in his father’s grave in Merritt, B.C. A marker will be added to match his mother’s and dad’s. There was a service at Gillis House on Sunday, September 9, at 1:30 pm. Nicola Meadows is having a Celebration of Life tea in memory of Joe on Saturday, September 15, from 2 to 4 pm. All are welcome. Come and bring your stories about Joe.
