Fire officials are on high alert and so should the rest of the local population. Wildfire season continues to hold the Salmon Arm Zone of the Kamloops Fire Centre firmly in its grip. “From altitude 1,000 metres and below to valley bottoms, we’re in extreme or high danger class,” said fire protection officer Larry Osachoff. “Campfires are the only thing we’re permitting and we definitely want people to be cautious.” Burning debris piles and industrial

burning are strictly prohibited at this time and the prohibition will not be lifted until the area experiences significant rainfall. “The entire province is just sitting on edge,” he says, noting that while fire season was late in starting, thanks to heavy spring and early summer rains, there has been almost no precipitation in September – just four mm since Sept. 11 and another .6 mm Monday night. “Since Sept. 1, the Salmon Arm station has only seen one day of moderate danger class – all the rest have been extreme.” Osachoff says fire officials are
watching the situation very closely. One fire near Enderby was in mop-up stage Friday, after being spotted and reported the previous day. It was the result of a lightning strike in August. “We’re still picking up the occasional fire from the lightning storm that went through Aug. 28,” says Osachoff. “That’s a fair length of time for fires to hold over and indicates the dryness of the forests.” Luckily, there has been very little wind and, with cooler nights, the fires have failed to grow to a substantial size.”
“We’ve been fortunate, but if we get a wind, different story,” he says. Kamloops Fire Information officer Michaela Swan says the Wildfire Branch of the Ministry of Forests, Lands and Natural Resources has kept additional fire crews and air tankers on hand to deal with the extended fire season. There have been 412 fires in the Kamloops Fire Centre with 32 occurring in the Salmon Arm Zone – 20 were caused by lightning and 12 are believed to have been caused by

Court dismisses Neskonlith claim By Martha Wickett MARKET NEWS STAFF
An appeal launched by the Neskonlith Indian Band regarding the SmartCentres shopping development has been dismissed by the BC Court of Appeal. In a decision rendered Monday at the Vancouver Law Courts, Madam Justice Newbury, Mr. Justice Hall and Madam Justice D. Smith agreed that arguments put forth by the Neskonlith were not sufficient to overturn a decision made in April by Justice Peter Leask in BC Supreme Court. At that time, Justice Leask dismissed the Neskonlith’s request for a judicial review. The band had argued that the City of Salmon Arm had a legal or constitutional obligation to consult with the band before issuing the environmentally hazardous areas development permit for the SmartCentres site. The property is adjacent to the Salmon River, which borders Neskonlith land to the west. Leask concluded that the duty to consult, when decisions may affect aboriginal rights or title, rests with the province. The band had argued that because the province had delegated some land-use decisions to municipalities with no oversight from the province, the duty to consult also transfers to municipalities. Its argument in-
cluded the concern that the property will flood, requiring flood-control measures. Those floodcontrol measures would then do damage to the environment and the interests of the band. Following the decision issued Sept. 24, a SmartCentres’ spokesperson told the Observer the company’s next steps haven’t been decided yet. In an email, Sandra Kaiser, vice-president of corporate affairs for SmartCentres, wrote: “Our lawyers are in the midst of digesting the decision to provide us with a fulsome understanding of the implications of the decision. Once this has happened we will consider the next steps regarding our site.� The Neskonlith band issued a news release Tuesday, stating that the band “views the BC Court of Appeal decision as a narrow ruling on the SmartCentres development, which provided no sound remedies despite our strong constitutional arguments that municipalities should be required to consult on land-use
decisions when First Nations interests are impacted.� Chief Judy Wilson said the band is still considering its next steps regarding the decision. “The court ruled that the city does not have to consult regarding this important land-use decision which will affect lands and the bluelisted species in the sensitive ecosystem of the Salmon River delta and floodplain. Since they are the final decisionmaker, the province has also not consulted First Nations.� “The next logical step following this decision will be a constitutional challenge to the Local Government Act because it does not include a duty to consult regarding land-use decisions that affect First Nations.� Mayor Nancy Cooper said city council will be reviewing the decision with the city’s lawyers, but “it is positive for Salmon Arm and, indeed, for all local governments.� She explained by saying that if the appeal had been upheld, it would have far-reaching rami-

Celebrating man, music This year marks the 100th anniversary of the birth of legendary folk singer, Woody Guthrie. His life and times will be celebrated at Shuswap Theatre, Sept. 29 and 30, with a show that includes stories about Guthrie, photographs and his music. This summer, Jacobson – “instigator� and longtime folk music enthusiast – gathered a handful of writers and performers. Peter Blacklock and Bill Remphrey wrote a script that provides a lively overview of Guthrie’s life and the lives of the people he sang for and about. “Guthrie’s work is as relevant now as when it was written, as we con-

OPINION Political parties can spin but not hide Political spin is an interesting phenomenon. Apparently, no matter what happens there’s some positive aspect that can be mined out of it to offer to voters. Just a few months ago MLA John van Dongen’s leaving the ruling Liberals for the upstart Conservatives was hailed as a breakthrough for the ambitious Tories and gave them a voice in the Legislature. It was also a great opportunity to revisit a few of the Liberals’ bigger mistakes, the BC Rail and B.C. Place fiasco, and offer van Dongen and Tory leader John Cummins as a viable free-enterprise alternative to the ruling party. Fast forward from March to last weekend and suddenly losing van Dongen is OK with the Conservatives and a beleaguered Cummins is carrying on as leader, despite the fact that 28 per cent of the delegates at last weekend’s convention wanted a review. That is, they wanted to see what their options were, other than Cummins of course. The party also lost Jon Martin to the Liberals on Friday, and he had just run in the ChilliwackHope byelection in April as a Conservative. To say it was not a good week for the Conservatives is a huge understatement, no matter what their leader and his followers may say. In fact the Liberals, who are still struggling themselves to gain any kind of traction, can certainly point to the trials and tribulations of the struggling Conservatives as reason enough to proclaim that the Tories aren’t a viable option to the governing party. Meanwhile the NDP continue to lead the polls while watching from the sidelines, enjoying the view from the left side as the right side keeps tripping over itself. - Vernon Morning Star

Catch and release critical to fishing For many anglers, it’s hard to remember a time before catch and release. Where it’s not mandatory, it is still the generally accepted if not common practice. The effects, however, of catch and release on fish are less understood. In Europe and the United Kingdom, catchand-release fishing has been practised for more than a century by anglers fishing for coarse fish in order to prevent their quarry from disappearing from what were already heavily fished waters. In the 1980s and ’90s, many North American salmon and trout waters were similarly designated as catch-and-release fishing only in an attempt to preserve the quality of sport fishing. Countless studies have measured both the effects of various types of fishing tackle and angling techniques on fish mortality and, in pretty well each and every study, the link between the causes of fish mortality, the types of gear used and techniques used to both bring the fish in and subsequently release the fish, all boil down to one

By using the information obtained from these studies, modern catch-and-release educational programs have been designed to effectively minimize the amount of fish mortality caused by sport fishing. And, although catch-and-release mortality data may not necessarily show, statistically, a direct correlation between the degree of physiological stress and fish mortality in the wild, one particular experiment (by Ferguson and Tufts) did examine the effects of artificially induced stress on rainbow trout in a tank. The study concluded that various forms of physi-
ological stress do directly contribute to fish mortality and that, by inference, a minimization of stress would effectively reduce catch and release mortality rates of fish in the wild. To put things in simple terms, the manner in which fish are caught is important. Most fish are caught using either artificial or some form of natural bait. Numerous studies have compared mortality rates and angling methods, and have found that the use of artificial baits such as lures or flies, does significantly reduce both the incidence of fish swallowing bait too deeply in the throat to remove the hook without injury, and the rate of fish mortality. A majority of fish mortality studies would also seem to indicate that the physiological effects of stress (as a result of being caught) are usually pretty well reversed within a 24 hour period. It can be inferred from these studies that the use of heavy tackle is desirable in lowering mortality rates, and conversely, that lighter tackle and lower strength lines may increase
the risk of mortality. Common sense, as well as scientific data show that the longer fish are out of the water, the more they become stressed and that a minimal amount of handling not only reduces the amount of post-catch stress, but also the risk of physical injury due to struggling and loss of body slime. It is best to keep a fish right on the surface, but still in the water, when removing the hook. Prior to release, any fish displaying signs of exhaustion or stress should be resuscitated by holding the fish with its head pointing into the current. (In still waters, fish can be moved back-and-forth in a figureeight pattern to increase the amount of oxygenated water passing through the gills.) When the fish demonstrates a stable equilibrium and strong swimming ability, it can safely be released. Proper catch-and-release practices are important, not only to the survival of fish that are caught, but also to the future of both fish stocks and sport fishing.

Questions abound about food and agriculture I was appalled to discover a few years ago that Sorrento, along with most other rural communities in the Shuswap, has a food bank. I always thought that folk in rural areas would be spared the need to ask for food charity, given that most of us live in housing
that allows at least a small garden with its attendant food security. How on earth can communities which pride themselves on taking care of each other allow the need for food banks? We should be ensuring that we all have food long before the need for charity.
In the recent CSRD all-candidates meetings, there was much talk about development and the environment, but no talk about food and agriculture. There was no recognition of hunger, of loss of farms to golf courses, highways and houses, no discussion of the need

SOUTH SHUSWAP OCP vote deferred to October By Barb Brouwer MARKET NEWS STAFF
It has been a long time coming and it will be even longer by at least one month. After six years of planning by staff and consultants, many committee meetings attended by a broad cross-section of the community, and public hearings, an official community plan for Area C South Shuswap was supposed to get third reading at last week’s Columbia Shuswap Regional District Board meeting. Instead, it was deferred to the October meeting, after interim director Jack McInally made a promise at an Aug. 28 public hearing in Sorrento. In a statement he read to the board at the Sept. 20 meeting, McInally admitted to having mixed feelings about asking the board to defer Bylaw No. 725 but indicated he felt he had to keep his word. This prompted perennial gallery member Jim Leiper to call out, “Why start now?” In response, McInally told Leiper to leave the boardroom, earning himself a “Screw off,” from Leiper, who then responded to chair Dave Raven’s direction to leave the room with “I’m not leaving, call the cops if you want.” Chief administrative officer Charles Hamilton left to call police but cancelled the call when Leiper apologized for his outburst. This interchange is a mild indication of the
Dave Raven Aug. 28 meeting where protest was heated and tempers flared, according to McInally, who told directors he had not been prepared for the dynamics of that meeting. “In the heat of the moment, and with emotions running high, I indicated to those in attendance that I would make a motion that the matter be deferred for a period of time to allow concerns to be addressed,” he read. “Upon reflection, I wish I had not indicated what my intentions were at that meeting…” Despite his change of heart, McInally told directors he felt at this point, it would be just as well to let the new director, who will be elected in a Sept. 29 byelection, to determine an appropriate course of action. “An OCP is a living, dynamic document and can be amended at any time,” he read. “Therefore it is my hope that the board, in October, will move forward with adopting the muchneeded OCP. I feel there should not be any delay after that date.” Longtime Area D Falkland-Silver CreekRanchero director René Talbot said that after all
the years of work invested in the OCP, it should be given third reading immediately. “I don’t know if someone new will know about it,” he said. “I honestly think we need to move along.” But first-term Area F North Shuswap director Larry Morgan supported the protesters. “I heard people in the audience say repeatedly ‘why are we doing it at this time?’” he said. “I concur with Jack’s motion to defer.” Area E Rural Sicamous director Rhona Martin said she was willing to support the one-month deferment because McInally had promised it in a public statement. “If it would have been longer, I would not have supported it,” she said,” noting costly staff time and other resources have gone into creating the document. “This is something if (the late) Director Bacigalupo could muddle in it now, he would push it forward.” Martin indicated she will not support further input on the document. “I acknowledge a new director coming on the board, but if they’ve
lived in the community they’ve had the opportunity to be at the meetings.” Talbot, who still called for third reading, said some of the biggest opponents in his area, where the OCP process took 11 years, turned out to be the happiest when it was finally put in place. “I don’t see why we’re not moving forward, we spent a lot of staff and consultant time.” Just as firm in his insistence to defer the matter, Morgan noted changing the so-called “living document” is not as easy as it seems. “We’ve got an OCP in Area F, yet there are a number of things we’re looking at changing in the document,” he said. “It’s not going to be done immediately. It’s complicated and it’s going to take time.” CSRD Parks and Recreation team leader Marcin Pachcinski also made reference to the long, sometimes arduous process. “We have had six years of public consolation and work, but given the upcoming election…” he said. “I’ll leave it up to the

board.” Before offering thanks to CSRD staff and fellow directors for their support, McInally marked his last day by praising Pachcinski and questioning the behaviour of some participants at the Aug. 28 meeting. “I saw many adults there act in a very childish matter – Marcin should have worn a flak jacket,” he said. “The approximately 70 people in attendance overwhelmingly spoke against the bylaw. However, this is slightly less than one per cent of Area C’s population.” Before calling the question on deferment, Raven took issue with the “totally inappropriate” behaviour of some citizens, who challenge directors’ integrity. “It reflects poorly on the people we serve, it is not fair and it’s not appropriate,” he said.

Columbia Shuswap Regional District directors voted to maintain support for a downtown college campus in Salmon Arm. But the amount they contribute has been reduced from $12,000 last year to $8,500. A total of $6,000 was allocated from the Shuswap Economic Development budget and approved by the board. The remaining $2,500 will come from grant in aid funding from Electoral Area C South Shuswap and Area E rural Sicamous. Area D FalklandSilver Creek-Ranchero director René Talbot chose not to contribute to the project this year. And Area E direc-
tor Rhona Martin lightened her contribution by $500. Reducing funding to Salmon Arm’s Downtown Community Campus project is Martin’s way of saying she’s not pleased with Okanagan College. Martin says that while she supports a downtown campus for Salmon Arm, and she knows it is a separate issue, she has repeatedly, but to no avail, tried to encourage college officials to provide courses in outlying areas.
“There are students right now who need to be educated and they can’t get into Salmon Arm to take courses,” she said, defending her decision to reduce her contribution to $1,000. “At every rural meeting I have brought this to the college but they’ve ignored it and this is the only way I can make a point.” The late Ted Bacigalupo, former South Shuswap director, had in previous discussions, also decided to reduce Area C’s contribution from $3,000

cement truck was taken to hospital on Tuesday, Sept. 18 after rolling over on St. Ives Road about 10 a.m. Sgt. Gary Heebner says the single vehicle collision occurred after the driver took the turn a little too fast, causing the vehicle to tip over. The truck was carrying a full load of cement at the time, but none spilled onto the road. The driver was rushed to hospital by ambulance but did not sustain any lifethreatening injuries.
Help for Seymour Arm wharf At the request of the Seymour Arm Community Association, the Columbia Shuswap Regional District board is taking steps to provide stable and ongoing funding for the Seymour Arm community wharf. The board gave three readings to a bylaw that will establish a financial contribution service area. This bylaw will be
sent to Victoria for approval. Following that, the regional district will hold an alternative approval process where eligible electors will have an opportunity to register their opposition to the establishment of the service, which includes a parcel tax. Kittens abandoned on road The Shuswap Branch of the BC SPCA and a kind-hearted animal lover are caring for a pair of kittens who were found abandoned inside a bag near Chase. A passerby found the bag on a road at Star Lake and, to her horror, discovered two kittens who were barely alive inside, along with four deceased kittens who had been crushed, likely by the wheels of a vehicle. Another deceased kitten was found near the bag. “The Good Samaritan kept one of the kittens and brought the other one to us,” says Barb Gosselin of the Shuswap SPCA. “She is a long-haired tabby, about three to four weeks old. She was
extremely hungry and in rough shape when she came in, but we warmed her up and bottle fed her and she responded well.” Gosselin says the kitten is now being nursed by a shelter cat who had just finished nursing her own litter. “We are very hopeful that the little kitten, now named Rose, will make a full recovery, but we are urging anyone who may know who dumped the kittens at Star Lake to please call the Shuswap SPCA at 250-832-7376.” Abandoning animals is against the law and is punishable by a maximum fine of $75,000, up to two years in jail and up to a lifetime ban on owning animals.

Heat fall flat on weekend after fine start By Scott Koch CONTRIBUTOR
Anyone who has lived through their offspring’s teenage years knows they come with unexpected twists and turns. So imagine if you can, multiplying that experience by 23, going through it with other adults’ offspring and you have the ups and downs of your Chase Heat Junior B Hockey Team. Weekend One saw the team come out charging on all eight cylinders, winning both games and looking great doing it. Weekend Two saw that same team come out flat, needing a serious tuneup, losing both games and not looking good doing it. Friday night saw a
rematch from the previous weekend with the Grizzlies from Revelstoke at the Art Holding Memorial Arena. The Heat scored first with Aiden SilzerHooker getting an unassisted marker halfway through the first period. In the second the teams swapped goals, with Catlin McLeod scoring assisted by Wade Cline and Reece Forman. Four unanswered goals in the third by the visiting Bears sealed it for a 5 – 2 loss in front of 312 fans expecting better. Kaleb Carpenter received the second star based on hard work at both ends of the rink. Sunday the 23rd the Heat travelled to Sicamous for the first meeting of the season
against the Eagles. One hundred and twentyfive fans, many of them supporting the Heat, took in the game and, during the second, it appeared as though the players on the ice also watched the game. The result was a 7 – 3 loss.

She passed away in Shuswap Lake General Hospital, Salmon Arm, BC after a short courageous battle with a liver disease. JEAN MARY MITCHELL Jean was born to Jock & Elsie Rae on January 14, 1920 in Edinburgh, Scotland. Jean spent time in school learning embroidery, knitting and other necessary skills of her time. She was an excellent knitter! During World War II she served as a member of the Royal Air Force in Scotland. She enjoyed going to many dances and other functions held for fellow service members. Jean met and married Ken Mitchell during World War II, making her a war bride amongst many others during that time period. They moved back to British Columbia where Ken was from and raised their three sons, Brian, and twins Allan and John Mitchell in the Marpole area of Vancouver. Jean worked at the Canadian National Institute for the Blind for many years. She was also a long-term member of the Royal Canadian Legion. Jean and Ken retired first to the Cloverdale area where they had a small hobby farm. They then decided to move up to Sicamous where Ken was born and raised. Upon Ken’s death in 1997 Jean moved to Salmon Arm. Jean spent a few years living in Shuswap Lodge and eventually moved to Bastion Place. Jean passed away in the wee hours of Saturday, Sept. 8, 2012. Jean is predeceased by her oldest son, Brian and her husband, Ken. She will be sadly missed by her other two sons, Allan (Sherry), of Salmon Arm, John (Karin) of Ottawa, her grandson Travis (Jenine) of New Westminster and granddaughter, Crystal of Ottawa. We wish to thank all who took care of mom during her times at Shuswap Lodge, Shuswap Lake General Hospital and Bastion Place. By request there will be no formal service. “Instructions for living a life: Pay attention, be astonished, tell about it.” This was the short poem by Mary Oliver that Trail Alliance executive director Phil McIntyre-Paul read to us as we paused during our Sept. 15 hike up to Joss Mountain Lake. We had no trouble paying attention, as one had to in order to stay on the steep, narrow trail and it was easy to be astonished by the magnificent alpine views. Now it is my turn to tell about it! The trail begins along a logging road high above Three Valley Gap near Wap Creek and it is very old. The first section is located in Joss Pass, the ancient route used by the Secwepemc people who travelled between Greenbush Lake at the top of the Shuswap River drainage and the Eagle River drainage. There are still parts of this route that are compacted from centuries of use and plans are in place to restore the trail by the Splatsin Band. We angled off the pass up an avalanche slope on a metre-wide packhorse trail that was built in 1921 to service the fire lookout on top of the mountain. Alders and berry bushes are growing into the switchback trail, so it has required brushing
conflicts, but that is the current situation. While the Trail Alliance works hard to consult with all of the stakeholders, including First Nations, regarding planning and trail design, ad hoc groups have built other trails without approvals. Because logging and roads now extend up to the alpine in many areas, new trails are being built in many areas including a shorter and steeper one on the west side of Joss peak. Even though the alpine is supposed to be off limits to motorized vehicles, we could see the tracks left by motorcycles that somehow have ventured to the top of Joss Mountain. And although the

Unfortunately, there was not enough time to hike to the peak, so we enjoyed a leisurely lunch along the shoreline and watched two of the teenage hikers join one of the Trail Alliance guides take very quick dips into the ice-cold lake. Some of us then climbed up the “bump” to get better views of the alpine plateau and distant peaks, the massive Blanket Glacier, the Shuswap’s highest peak, Mount English to the east and far to the south, a glimpse of Mabel Lake. It is difficult to accept that fabulous hiking trails like the one up to Joss Mountain could result in recreational use

to maintain a walking surface. The fire lookout was one of three built by the Dominion Government in the early 1920s to protect timber in the Railway Belt. Along with the lookout there was a service cabin built in the pass and a telephone line ran all the way from the lookout down to the valley. The Joss lookout was abandoned in 1930, but it is now in excellent condition, as Columbia Helicopters restored it with a new roof and windows in 2005 in conjunction with the B.C. Wildfire Management Branch. An Internet search revealed some information about the origin of the mountain’s name. GeoBC explains that if a mountain name begins with Mount, it is named after a person. The word Joss is derived from the Latin “deus” or god by the Chinese, who also burn incense called Joss Sticks during their religious ceremonies. When the railway was built there was likely a Chinese work camp in the valley below, which likely resulted in the mountain named by them after the gods, as it is truly a majestic peak. There were 21 of us on the hike organized as a fundraiser for the Shuswap Hospice Society in conjunction with the Shuswap Trail Alliance. We ranged in age from 75 to 19 and after three hours we reached our destination, Joss Lake, in two groups with the two oldest hikers in the faster group. Although grizzly bears are common in the alpine and a young one has often been spotted in the Joss area, we felt safe because of the large size of our group.
