SD5 board votes not to appeal mercury ruling Submitted Following a special meeting of the Board on Friday, December 21, 2012, School District 5 (SD5) has decided not to appeal the decision of Supreme Court Justice A. Saunders to grant a new court-ordered compensation board hearing to six Cranbrook teachers. The teachers claimed they were poisoned by mercury during their teaching time at Mount Baker Secondary School. In 2010 Workers Compensation Appeal Tribunal (WCAT) ruled that the teachers did not suffer mercury poisoning at Mount Baker. Justice Saunders granted a new hearing on December 4th, stating the decision handed down by the Tribunal was “patently unreasonable in failing to weigh all of the relevant evidence and in imposing a requirement that mercury poisoning be proven, as that diagnosis would be made by physicians.” According to SD5 Board Chair Frank Lento the ruling itself does not involve SD5. “Strictly speaking the Judge was dealing with the WCAT decision and how it was made” says SD5 Board Chair, Frank Lento. “The District’s responsibility in this matter was to determine if there was a safety concern and if so to properly address it. The Board of the day did exactly that.” Following the initial BCTF claim in 2006 School District 5 undertook a $200,000 investigation into mercury at Mount Baker and completed the necessary upgrades to ensure the building’s continued safety. No concerns regarding mercury have since been reported.

anyone who may have seen people or activity in or around the condo units in the hours leading up to the fire this morning,” says Chief
Miller. Anyone with any information is asked to contact Chief Miller at the Windermere Fire Hall at 250-342-6214.
“The crew did a great job containing the fire and preventing it from spreading,” adds Miller. Firefighters remained

Note to all parents regarding Provincial exams
The Adapted Technology class has been working on improving recycling at Mount Baker. One of their projects is the Tree-Cycle located outside of the Drafting room. Once students and staff are finished with their paper beverage cups, they can rinse them out and put them on the tree. They will write their name/cell # on a slip of paper and put in the draw box. Once the tree is full of cups, names will be drawn for prizes. Prizes include gift cards for: Tim Horton’s, Starbucks, Hot Shots, Cranbrook Photo, The Choice, and the Kootenay Roasting Company! See Mr. Knipe for details. This project will recycle hundreds of cups! Thanks to the sponsors for their support! Student leaders from all across SD5, members from the District Student Advisory Council (DSAC) and a Board of Education Representative, Trustee Bev Bellina, met in Elkford Secondary School on December 6, 2012 at the annual Regional Student Voice Conference to discuss provincial issues such as bullying and resources for youth.
Students currently enrolled in semester courses will have scheduled government exams from January 28th -January 31st. Students must write the exam at the time and location assigned. If a student misses the exams they will have to write at the next assigned time in April.
