A SURREY provincial court judge has ruled that the federal three-year manda-

tory sentence for carrying a loaded, restricted firearm is unconstitutional. Judge James Bahen made the ruling Thursday (Jan. 3) in connection with the sentencing of Glenn Harley Tetsuji Sheck, 31, who was convicted last May of possessing such a gun at a Surrey restaurant two years ago. Bahen adjourned the court proceedings to give Crown prosecutors an opportunity to show the threeyear sentence is reasonable prior to his handing down a sentence. In his Thursday ruling, Bahen said the mandatory minimum sentence legislation breached both sections. However, he added that the three-year minimum is “not cruel and unusual pun-

ishment” for this particular case, but considered it “harsh and excessive” in that it doesn’t address Sheck’s individual circumstances. Sheck has no prior criminal record, is a father of four children, works as an apprentice electrician, and is the sole economic support for his family and is of First Nations descent. He’s been under strict bail conditions since his arrest. “If [Sheck] were sentenced for this offence based on the facts of the offence and his personal circumstances, without the mandatory minimum provision, I would

impose a sentence that is less than three years,” wrote Bahen in his ruling. The mandatory federal firearms sentences were enacted four years ago. Bahen agreed with Sheck’s lawyers that the law causes problems because it demands a three-year sentence when the Crown proceeds on direct indictment and only one year when Crown proceeds summarily on less-serious crimes. It creates an “arbitrary and fundamentally unjust sentencing process,” said Bahen.

Surrey teacher charged with trafficking Alleged drug transaction took place near an elementary school in Vancouver by Kevin Diakiw A SURREY School District teacher

has been charged with trafficking for allegedly conducting a drug transaction near a Vancouver elementary school. On Nov. 7, Richmond RCMP’s Property Crime Unit and Quick Response Team were in Vancouver on another investigation, when a driver approached and allegedly made a drug transaction with a pedestrian. The driver also appeared to be smoking a joint. He drove away and was pulled over in a neighbouring parking lot, where he was arrested. A search of his vehicle allegedly revealed marijuana and evidence of drug trafficking. Forty-one-year old Eugenio Alfonso Bahamonde has been charged with trafficking and possession of a controlled substance for the purposes of trafficking. At the time of the arrest Bahamonde disclosed that he was a school teacher. The Surrey School District confirmed for Black Press that Bahamonde was a teacher on call, and he has been suspended until there has been a resolution in the case. Bahamonde will be returning to court on Jan. 16.

after multiple accidents involving 40 vehicles jammed Highway 1 traffic early Thursday morning. Icy conditions developed along with heavy fog on the morning commute despite the bridge being sprayed with a de-icing solution at 4 a.m. Wednesday. Max Logan, spokesman for the Transportation Investment Corp. that oversees the bridge, said the treatment of the saltwater brine solution should have lasted 48 hours but proved to be “not sufficient” as ice built up between 5 and 6 a.m. Thursday morning, after crews ended their overnight checks. He said contractors will now be directed to apply de-icing solution at least every 24 hours on the Port Mann instead of every 48. “Clearly it was not adequate,” Logan said. “We have told them they need to

apply it more frequently.” Speed was reportedly a contributing factor as some drivers sped past slower traffic on the bridge then lost control or couldn’t stop for other vehicles crashed ahead of them. It was the second major incident since the bridge opened that’s affected numerous motorists and prompted an official apology as well as vows to improve. More than 250 vehicles were damaged Dec. 19 by ice that fell from the bridge’s cables, which cross overtop of traffic lanes. A fix to prevent more overhead ‘ice bombs’ from building up has been promised, at the cost of the bridge’s builder. But unlike that time, tolls charged Thursday morning aren’t being refunded because the bridge did not close that day. Logan said Mainroad Contracting has also been directed to use crystal salt

Police on the hunt for prolific bank robber 32-year-old man sought in thefts in Surrey, Langley, Burnaby and Vancouver

a prolific bank robber, who is believed to have robbed several banks in the region. Robert John Paton is wanted in connection with four robberies in Vancouver and is a suspect in a series of recent robberies in Surrey, Langley, and Burnaby. Police are growing increasingly concerned, as authorities assert Paton may be using disguises, such as wigs and glasses and has allegedly threatened employees with violence. He is described as a 32-year-old Caucasian male, approximately 6 feet tall, 200 lbs, with brown hair and brown

this recent robbery series, this individual is still considered dangerous due to his level of desperation,” said Surrey

RCMP Cpl. Bert Paquet. “We do not expect him to stop committing these crimes.” Paton has not been found guilty of these crimes in a court of law. Police are warning the public not to attempt to contact, approach, or apprehend him. There were no reports of severe icing at other bridges in the region. Logan said there’s nothing unique about the new Port Mann Bridge that makes it more susceptible to icing up – the asphalt surface is the same as the old span. But he said accidents may be more likely because there are now more lanes open and drivers can drive faster in slippery conditions than they usually could over the old, heavily congested bridge. Asked whether Mainroad will also be directed to de-ice other

bridges in the region at least every 24 hours, Logan referred the question to the transportation ministry. A ministry spokesperson would only say de-icing is applied “as and when needed” at other bridges. In an emailed statement, Transportation Minister Mary Polak said there’s no indication the bridge’s design or materials used in it were to blame and urged motorists to drive accordingly in winter conditions. “We’re tremendously proud of the new Port Mann Bridge,” she said. During Thursday’s icy commute, the traffic jam prompted TransLink to redirect its #555 bus service over the Port Mann. One person was taken to hospital with minor injuries, according

to RCMP Sgt. Peter Thiessen. The new bridge is the centrepiece of the $3.3-billion Port Mann/Highway 1 improvement project. SFU political scientist Patrick Smith said the two incidents are a good test of the province’s resolve to make its private partners spend extra money to live up to the terms of their contracts. He said governments usually tend to be lax in enforcing the rules of P3 projects. “We’ll see how quickly the contractor learns and how much the government insists that learning occur very quickly,” Smith said. He said any big new megaproject has a few “teething problems” but he called the Port Mann’s mishaps “dramatic.”

for a dark-coloured pick-up truck that smashed into another vehicle on the weekend and took off. At about 7:20 p.m. on Saturday, a grey Mazda 3 was heading eastbound on 92 Avenue when it was struck in the rear corner by a newer-model darkcoloured pick-up truck, which was turning off 138 Street and heading west on 92 Avenue. The Mazda 3 was sent into a retaining wall in the 13900block of 92 Avenue, causing serious, but non-life threatening injuries to two occupants, both 17 years old. The male driver suffered chest injuries and a male passenger sustained a broken arm. Police say there was a third occupant of the car who wasn’t harmed. While there was an “N” in the back window of the Mazda 3 to indicate he was a new driver, police don’t believe that had anything to do with the accident.

Your pocket picked

t’s a new year, and that means that all levels of government have their hands in your pockets a little more deeply than in 2012. The Canadian Taxpayers Federation sent out a press release last week outlining just how much additional pocket picking is coming our way in 2013. The list is substantial. The most substantial, and perhaps the most unfair, is the boost in Medical Services Plan premiums. These premiums will go up by $60 per family this year, and have now risen 24 per cent ($300 per family) in three years – far more than the rate of inflation. This boost in MSP fees was first brought in by the provincial government to help deal with its deficit, and it has since discovered it’s a tax boost that causes minimal political trouble. It appears this premium will keep rising until enough members of the public start to pay full attention to just how much it is costing them. The federal government doesn’t get off scot-free. As of Jan. 1, premiums for Employment Insurance were hiked, and so were contributions to the Canada Pension Plan. While contributors will get their CPP contributions back eventually if they retire and collect CPP, the same cannot be said for EI. A small portion of the population actually collects it, but all working people and their employers pay dearly for the program. Municipal governments, which are in the midst of giving their employees raises, will boost property taxes by two to five per cent this year. TransLink property taxes are also rising. And TransLink will also take more from people who actually use the transit system, as fares rose on Jan. 1. The province is facing a massive deficit and claims it will bring in a balanced budget, so that adds up to all kinds of tax increases that we have yet to see. But in the meantime, BC Hydro, controlled by the province, is raising rates by almost four per cent on April 1. Taxpayers may get a small break if the PST, due to come back on April 1, isn’t levied on some services, as happened under the HST. We will wait and see what happens on that front. One thing is certain – governments have an insatiable appetite for our money. While much of the money they take goes to useful services, there is plenty of room for better management and for minimal tax increases.

he century-old plight of Canada’s aboriginal people is back in the public eye, thanks to protests dubbed Idle No More. As with Occupy protests last year, the demands are vague. One of the claims, repeated in media coverage of protests, is that the federal government is moving to end the historic Indian Act restriction against selling reserve land. A look at the federal legislation, Bill C-45, shows this is not the case. Amendments ease restrictive provisions for leasing reserve land, which remains property of the Crown held in perpetuity for the aboriginal community. This change was initiated by B.C. aboriginal leaders so they can follow the trail blazed by one of the most entrepreneurial chiefs in Canadian history. His name is Ron Derrickson, and he served six terms as chief of the Westbank First Nation near Kelowna. Racist bullying drove his parents to move him to a residential school in Washington State. He dropped out in Grade 9, toiled on farms, learned to weld, and worked his way into ranching, real estate and politics. He never gave up or backed down, ever. The Hall commission and all previous government probes concluded that he did nothing wrong. Derrickson sued his local accusers and won, and Ottawa began to change its racist, paternalistic ways. Which brings us back to today. Derrickson’s pioneering work is still changing the Indian Act for the better. This effort is under dishonest attack from people whose legacy is mainly incompetence and failure. Protesters demand more unearned public subsidy, and a petulant soup-only strike is celebrated as an act of bravery. Choose your own hero. I’ve chosen mine.

SkyTrain ‘Corporation’ a fitting name for Delta obsolete for years I fInd I must reply to Mr.

Daryl Cruz’s most bizarre letter (“Light rail not right for Surrey or Vancouver,” The Leader, Jan. 1.) The fact of the matter is simple – modern light rail made proprietary light-metro systems obsolete almost two decades ago. That many who support spending billions of dollars on SkyTrain extensions remain ignorant of this fact is telling. LRT made SkyTrain obsolete in North America the early ’80s, when a study by IBI Group for the Toronto Transit Commission found that SkyTrain “could cost anywhere up to ten times more to install than light rail, for about the same capacity.” Why build with SkyTrain when you got a far bigger bang for your buck with LRT? Though only seven SkyTraintype systems have been built since the late 1970s, the proprietary mini-metro has gone through at least four official name changes, starting with Intermediate Capacity Transit System; then to Advanced Light Rail Transit; followed by Automatic Light Metro; and presently Advanced Rapid Transit. During the same period, modern LRT has just remained light rail, and during the same period that SkyTrain has been on the market, over 160 new LRT systems have been built and a further 56 LRT systems are under construction or have been approved. It is also interesting to note that not one of the seven SkyTrain tendering processes allowed light rail to compete. It is this statement by Mr. Cruz that forced me to reply: “building LRT will cost us billions and billions more than building SkyTrain.” The statement is beyond all reality and belongs in a world of fairies and pixie dust. RegaRdIng the application heading for approval by Delta for a 37-storey highrise at Scott Road and 80 Ave. The Corporation of Delta’s mayor and council have unanimously voted in favour of the profit motive and against the interests of its citizens who spoke out overwhelmingly against this monstrosity. It is very fitting that the word “Corporation” is part of the

municipality’s name, as it walks hand in hand with its business partners while it steps all over the little people. Our bylaws and so-called North Delta Area Plan are no match for the shredder at city hall. This result (initial approval of the application) isn’t what we expected from our elected representatives, who were given the task of being responsible administra-

tors. They lack the will to represent the ordinary folk of Delta, therefore they are not deserving of being our administrators. What they really deserve is a healthy dose of civil disobedience. When the next election comes around, they won’t get my vote. Not any of them. Jason Lewko, Delta

While I support the good work of OWL (Orphaned Wildlife Rehabilitation Society), I feel laying the blame for the plight of the snowy owls at the feet of photographers is inaccurate and unfair. While photography might be a billion-dollar industry, few people earn their living taking photos of snowy owls. Wildlife photographers are as concerned about the wellbeing of the snowy owls as OWL’s Ms. Bev Day. A long lens means you don’t need to get close to the subject; in fact you cannot focus a long lens if you are too close – and that’s a good thing for the owls or any wildlife. When I have been down at Boundary Bay photographing the snowy owls from the public foot path, what scared the owls and I away were the hunters with rifles on the foreshore shooting ducks over our heads. Perhaps the hunters firing guns are stressing the snowy owls?

too high,” Letters, The Leader, Jan. 3. Is this really what we have come to here in the Lower Mainland? Around the world, there are young women being raped on public buses and children being murdered in cold blood, and here we are so oblivious to real issues that something like paying a few extra dollars to run in a climate-controlled indoor track warrants the time to sit down and write a letter about it. Every day I am amazed by the comments from all of those “the world owes me everything just because I was born on it” types who feel it is the

duty of the government and society to leap into action at a moment’s notice to answer their every beck and call. There never seems to be any concern for how petty the problem may be or who will cover the funds needed to cater to their needy complaints. In a quick two-minute scan of the area around the Guildford Recreation Centre on a map I found two elementary schools with all-weather fields (gravel soccer fields) and another two city parks with grass soccer fields, all within a five-block radius. If it has become so egregiously expensive for letter writer Ana Fisic to run indoors, then why

not take advantage of the “free” parks in her area and go for a few laps around one of the playing fields? I know they are not climatecontrolled and you might get a little wet some days, but no matter what your “socio-economic” status is, you can always afford “free.” And please, do us all a favour – the next time you get the urge to write a letter, take a second to consider the “real” hardships people are suffering through around the world before you subject everyone to your petty problems. the Cost of exercise is not too high in Surrey. For many years the City of Surrey has offered a yearly recreational pass for the small fee of $6 or so a year to those in our community who provide proof of income. That proof would be a copy of your income tax. A single person would have to earn below a certain amount, a family of two or more below another amount. This pass would allow you to access the gym and also the track. The track is right beside the gym. Our city has provided inclusion for everyone in all their recreational centres. It is up to everyone to take the time to find out what is available. I am surprised the staff at the Guildford Recreation Centre did not advise Ms. Fisic about this service. Many, many Surrey residents on limited income are enjoying most of the great recreational services at all our rec centres. It is true that people living on a limited income could have poorer health outcomes. But our City of Surrey has taken the steps a long, long time ago to ensure that all citizens of Surrey have access to recreation facilities should they pass the criteria for low-income support. The Surrey gatherings are among many worldwide, organized to demand better treatment for women in India, where protestors also continue to rally in the streets to draw attention to the denigration of females and the apparent lax attitude of police. “We are all so fortunate to be in a country where we are respected, we are equals and we have power over our navi Gill own bodies and our own voices,” said Navi Gill of Global Girl Power, organizers of Sunday’s ceremony in Bear Creek Park. “That’s something that should be a right for all women and girls, no matter where they’re from and who they are.” On the weekend, the victim’s father told a British newspaper his daughter’s name was Jyoti Singh Pandey. The 23-year-old and her male companion were brutally attacked and then stripped and thrown off the bus. The woman suffered severe internal injuries. Five men have been arrested and charged with rape and murder in connection with the fatal assault, and a sixth suspect who is under 18 will be tried as a juvenile.

in Surrey are slated to open later this year, and in the meantime, the public is invited to see what’s planned for the buildings and school grounds at each site. Sunnyside Elementary – a replacement school for the current facility near busy 152 Street and King George Boulevard – is the first of the three schools scheduled to open. The district anticipates the new school just blocks away at 2828 159 St. will be ready this September.

By December, it’s expected Goldstone Park and Katzie elementary schools will also be opening their doors to students. Katzie Elementary, in the booming Clayton neighbourhood of Surrey near 68 Avenue and 194A Street, will relieve pressure at Hazelgrove Elementary, which has about a dozen portables on site to accommodate the overflow of students. Vancouver more to use the Cache Creek regional landfill because the dump’s owner is paying royalties to local First Nations and passing along the cost. Belkorp Environmental, the parent firm of landfill operator Wastech, agreed more than three years ago to pay the Ashcroft and Bonaparte Indian bands a royalty on each tonne of garbage dumped at Cache Creek, in order to secure the bands’ support for Belkorp’s planned expansion of the landfill. Metro challenged Wastech’s decision to pass along the royalty costs, arguing the regional district never agreed to the fees and they shouldn’t be counted as part of landfill’s operating costs. An arbitrator ruled in favour of Wastech in November and upheld the payments. Metro won’t disclose exactly how much taxpayers’ money now flows to the two bands via the landfill owners, citing confidentiality of the arbitration process.

Police Car campaign is being hailed as a huge success. More than $15,000 in cash and six tons of food were collected for the Surrey Food Bank during the 12-day campaign that ended on Christmas Eve. “This is a tremendous showing of support from the community,” said Marilyn Herrmann, executive director of the Surrey Food Bank. “Working with great community partners such as the Surrey RCMP helps us raise our profile and donations to ensure that no one goes hungry at this time of year.” Surrey Mounties said the were just a receptacle for public generosity. “We are just the conduit through which the generous citizens of Surrey Marilyn were able to give to this great cause,” herrmann said Surrey RCMP Insp. Garry Begg. “We are happy to initiate this campaign and look forward to doing it again next year.” Surrey RCMP employees were also able to contribute an additional $4,000 through various fundraising initiatives at the detachment, bringing the grand total to more than $18,000. The Devils doubled the Port Moody Panthers 4-2 Thursday night, but fell 4-1 to the Delta Ice Hawks on Saturday. Both games were played at the Sungod Arena. North Delta remains in third place in the Shaw Conference with a 16-14-3-1 (won-lossovertime loss-tied) record, four points up on both the North Vancouver Wolf Pack and the Grandview Steelers. North Delta raced to a 3-0 lead after just five minutes of play, then hung on for the win over the Panthers. Joshua Smith

tallied first after two minutes of play, and Max Fiedler added the second Devils goal 18 seconds later. Landen Matechuk made it 3-0 five minutes into the game, and the goal would prove to be the winner. The Panthers had cut the gap to 3-2 early in the second period, but Tanner Lenting scored while the Devils had a man advantage midway through the second period to close out the scoring. Special teams play was even. Although the Devils did score once in three power play opportunities, they also allowed one shorthanded goal. The Panthers did not go on the power play all night. Eagles move into a tie for first place BCHL team wins in Trail, loses in overtime to Penticton

Surrey Eagles have been busy both on and off

the ice. Between the boards, the team has won three of four on the road – including back-to-back

shutouts over division rivals Chilliwack and Coquitlam – boosting their BC Hockey League record to 21-10-

1-3 (won-loss-overtime loss-tie), which is good for a first-place time with the Chilliwack Chiefs. Last weekend, the Eagles earned a split on their two-game road trip to the Interior, beating the Trail Smoke Eaters 6-3 Friday before falling to the Penticton Vees 3-2 in overtime Saturday night. Against the Vees, the Eagles fell behind 2-0 but got two thirdperiod goals from Brady Shaw to send the game to OT, where Penticton’s Troy Stecher potted the winner at the 55-second mark. The day before in Trail, Shaw again scored twice – boosting his team-leading goal mark to 22 – while captain Brett Mulcahy had a

goal and two assists. Devon Toews chipped in with two helpers as well. The previous week, Surrey netminder Michael Santaguida posted back-to-back shutouts, stopping 41 shots against the Chiefs Dec. 29, before stopping 32 the following night against Coquitlam. While Santaguida was the star in the victory over the Express, Coquitlam goalie Cole Huggins was even busier, as the Eagles peppered him with a season-high 62 shots on net. Craig Wyszomirski and Mason Blacklock each scored for Surrey. Off the the ice, Surrey also swung a pair of trades between Christmas and New Year’s, first acquiring

20-year-old defenceman Troy Paterson – son of former Eagles’ owner and current governor Ronnie Paterson – from the Cowichan Valley Capitals in exchange for future considerations. Then, to make room for Paterson on the blue-line, Surrey coach/ general manager Matt Erhart sent rookie Austen Bietenbeck to his hometown Langley Rivermen, also in exchange for futures. “We think Austen has a great future ahead of him, but we felt we needed to get a little more experience on our roster,” Erhart said. “We think that we get that veteran experience with Troy, but in order to add that to our team, we had to give up a quality young player.”

Meanwhile, two players – Santaguida and Wyszomirski – both inked scholarship deals between Christmas and New Year’s. Santaguida has committed to join the University of Vermont, while Wyszomirski, a New Jersey native, will play next season with the NCAA’s Merrimack College Warriors. “I wanted to go to a place where the team wanted me and really wanted to invest in me as a player,” said Santaguida. “That was the biggest thing for me.” Six Eagles now have NCAA scholarships. Others include Toews (Quinnipiac), Michael Stenerson (Alaska-Anchorage), Dan O’Keefe (Yale) and Shaw (Bentley).

Passed away peacefully on December 30, 2012 at Laurel Place Hospice at the age of 63. Carol was continually surrounded by her loving family and many friends, some of which she met in Surrey Memorial Hospital and at Laurel Place. She was known by the nurses to be very kind and sweet and her friends cared for her as if they had known her forever. Carol and her friend Rosa created an amazing friendship over the 2 months of Carol’s illness. The family will be forever thankful to Rosa for making sure Carol was not alone when she passed away.
