A B.C. Supreme Court judge will give bogus Burnaby dentist Tung Sheng “David” Wu one last chance to show up and respond to the allegations against him before making a sentencing decision Oct. 9. Last month, Associate Chief Justice Austin Cullen found Wu in contempt of a 2003 court order prohibiting him from practising

dentistry, for which he is “neither qualified nor competent,” says the College of Dental Surgeons of B.C., which is seeking the stiffest penalty available—a fine, jail time or both. At the time, Cullen issued a warrant to have Wu appear in court for sentencing. But despite the college’s investigative and legal costs of about $75,000 and another $52,000 in staff and operational costs in the case, Wu is still nowhere to be found. The case began in the spring when a patient of Wu’s complained about

the treatment she received from him. The college’s investigation found he had been operating a cut-rate dental office out of a bedroom of a house on Southwood Street in South Burnaby. (The college stresses that his is not the same Dr. David H. Wu who formerly practised on Hastings Street in Burnaby, nor is he related to Dr. Tung-Yi Wu who currently practises on Cambie Street in Vancouver.) A May 29 search by college and RCMP investigators found about 1,500 client files, which led to Fraser

Health Authority issuing a health alert calling for anyone who had been treated by Wu to get tested for several infectious diseases, such as HIV and hepatitis. Since then, Wu has applied for and been issued a Taiwanese passport and a visa for China, which were found, along with a Canadian passport, among items in his 2013 Acura RDX SUV, which was seized by investigators, according to an affidavit by private investigator Michael Lantz.

WorkSafeBC is investigating after a worker at a Burnaby construction site was found in cardiac arrest Wednesday morning. Burnaby RCMP Staff Sgt. Ghalib Bhayani said police responded to a call of a man having been electrocuted at about 10:15 a.m. He was working at the time at the construction site for the SOLO District development located at the southwest corner of Lougheed Highway and Willingdon Avenue. The man did electrical work, Bhayani said. “They found him passed out and assumed he’d been electrocuted.” The man was taken to hospital in critical condition. “Now it appears he may have had a heart attack,” he said, although it had not yet been confirmed. Bhayani said the man is from outside the Lower Mainland and Burnaby RCMP’s victims services unit is assisting his family. “We are a close-knit team and the thoughts of everyone here are very much with this worker and his family at this time,” said Jim Bosa of the project’s developer, Appia Development.

When Burnaby resident MaryCatherine Kropinski adopted Jesse, their friendly black dog, from a local city shelter, staff there told her it was a border collie-retriever cross. Then as a Christmas gift, her husband gave her a dog DNA analysis kit. “He ended up being a white shepherd-terrier mix, so it really kind of brings into question any legislation that’s based on identifying breeds by sight,” she said. Kropinski wrote to Burnaby council last week raising concerns about proposed changes to the city’s animal control bylaw that would increase penalties and restrictions on pitbulls under its existing breed-specific vicious dog provisions. She is not a pitbull owner, but she is an associate professor of mathematics at Simon Fraser University. After hearing about the proposed bylaw amendments

from the owner of Jesse’s doggie daycare, she looked at the city staff report recommending the changes and was concerned. Kropinski stressed that she is not a statistician. However, “anytime I see numbers and I see conclusions the natural question to ask is do these numbers actually support the conclusions that are being drawn? In this case, basically all I did was answer that question and to me, the answer is no.” For instance, while she doesn’t believe city staff have proven their assertion that dog bites are increasing in Burnaby, if they are on the rise, the data doesn’t rule out that it could simply be due to a growing dog population in the city, she said. And while pitbulls are a category that includes several breeds, they are directly compared to a single breed, German shepherds, when it comes to the number of bites they’ve inflicted. “That’s not really a fair comparison, it kind of exaggerates the number of pitbull bites.” The city also doesn’t seem to have a good handle on how many pitbulls are in the city, she said.

The report states only two per cent of licenced dogs in Burnaby are pitbulls, arguing that they cause more than their share of bite incidents. “Anybody who fills out a dog licence is asked to identify the breed themselves,” Kropinski noted. “I’m not convinced there’s a pitbull problem at all, I’m not even convinced that there’s really a dog bite problem … Overreacting to this issue doesn’t

seem to be warranted.” She also questioned the report’s use of statistics from the U.S.based dog-bite victims group, dogbites.org, on pitbulls being responsible for a high number of fatal American dog attacks. She said the website does not have a scientific advisory board and simply draws its figures from unfiltered media reports about pitbull attacks. “When I’m looking at numbers presented in a study, I expect to

see some sort of scientific weight behind them and in this case there isn’t that.” Kropinski said she has great sympathy for good, responsible owners of pitbulls, or even dogs who happen to look like pitbulls, “because they’re faced with a great deal of prejudice.” Her views were echoed by delegations at Monday’s city council meeting, who all spoke against the bylaw amendments and the existing breed-specific legislation. Burnaby dog trainer Jorge Santa Barbara said he rehabilitates aggressive dogs, an indication that it’s not the breed itself that is at fault. Forcing sociable pitbulls to be muzzled and leashed while in public will only cause them to be less social and more reactive, Santa Barbara said. “Our bylaw is creating dangerous dogs.” Rebeka Breder, a lawyer who specializes in animal law, said focusing on the breed does not ensure public safety. Burnaby is only one of three municipalities in the region, along with Richmond and West Vancouver, to have such a bylaw.

At the court hearing Tuesday, Cullen granted the college permission to return the SUV to its owner, Honda Canada. Also found in the vehicle was dental equipment which investigators learned had gone

missing from a training course in 2008. The college was given permission to return those items to their rightful owner. The court hearing also put in motion potentially more trouble for the fugitive on a new front. Cullen gave permission to the college to communicate with Canada Revenue Agency about financial records seized from Wu. Those records, say court documents, show significant

amounts of money, including deposits this year of more than $12,000 between Jan. 7 and May 14, and records of transfers of more than $30,000 to several accounts in China between Jan. 16 and April 6. Meanwhile, the material includes a copy of Wu’s 2011 income tax return “which indicates only a nominal amount of earnings.” The Oct. 9 court hearing will

proceed whether or not Wu shows up. The college says in court documents that it’s clear that Wu knows he is being sought, noting he was present when the Southwood Street house was searched and was given materials supporting the search warrant. Those materials mentioned the college’s intention to seek a contempt of court application. In addition, there was

significant media attention to the case and the private investigator discovered that Wu moved from his last-known address in August, only a month after signing a lease, without leaving a forwarding address. The proposed project to twin the Trans Mountain pipeline would include an expansion of Kinder Morgan’s tank farm and the Westridge Marine Terminal on Burrard Inlet. Details of what’s being proposed were presented to the public Wednesday evening at an information session held at the Executive Plaza Hotel in Burnaby. The Trans Mountain pipeline runs from Edmonton to Burnaby and currently carries 300,000 barrels per day (bpd) of crude oil. Kinder Morgan is proposing to twin it, expanding capacity to 890,000 bpd largely to export oil sands crude to Asia. Under the plan, the Burnaby Terminal at Shellmont Street and Underhill Avenue would see its capacity more than doubled within the existing site. The existing 13 tanks with a capacity of 1.6 million barrels of oil would be joined by 14 new

tanks, bringing total capacity to 3.9 million barrels, according to the company. A new 36-inch pipeline entering the facility from the southeast would join the existing 24-inch pipeline. Heading northwest from the tank farm to the Westridge terminal would be two new 30-inch lines in addition to the existing 24-inch pipeline. Perhaps the more dramatic change would be on the inlet, where currently the dock at Westridge Marine Terminal is capable of loading one Aframax—whose average cargo capacity is 750,000 barrels—or

smaller-sized vessel. The proposed terminal expansion would comprise one new dock complex with three berths, each capable of loading an Aframax vessel. Once the new berths are put into use the existing one will be deactivated and demolished. The company expects to file its formal expansion application to the National Energy Board late this year. The project is expected to cost $5.4 million and would increase the number of tankers in Burrard Inlet from about 25 a month to 34 a month, or about 400 a year.

Four over three The Union of BC Municipalities has proposed extending terms of office for mayors and city councillors from three years to four. Anyone who has regularly watched municipal politicians in action or has served on such a board knows the avalanche of information the newest members must absorb. On top of learning the background of ongoing issues, rookies must try to memorize the process and learn how best to work within those confines. It takes one to two years for an elected official to reasonably understand all that’s involved in the job. This only leaves about a year of a three-year term to best represent the people who put them into office. Extending a term by another year will give residents a better bang for their tax buck, reduce election costs and council turnover, and put municipalities in sync with provincial elections. This timing would aid in limiting the costs some municipalities have had to accrue once a current mayor or councillor wins a provincial election, which, obviously, triggers costly byelections. The proposal passed at the UBCM with a 60 per cent approval rate. One rural delegate stated the idea came from “professional politicians” in the Lower Mainland, where pay is higher. While that may be true, it doesn’t change the fact that this is an idea whose time has come. If such a plan is enacted, B.C. would fall in step with all the other provinces. The only exceptions are the Yukon, Northwest Territories and Nunavut. Overall, we would be better served by having longer terms, both in terms of effectiveness of politicians and money saved by having fewer elections. —Tri-City News/Black Press

New bridge is good news

remier Christy Clark’s pledge to replace the George Massey Tunnel with a bridge was the biggest news to come out of the annual Union of B.C. Municipalities convention, and the new bridge will have a major impact.

Clark said construction will begin in 2017, which (not by coincidence) is an election year. The Liberals would dearly like to win back the Delta South seat, which independent MLA Vicki Huntington has now won twice. But the bridge is not tied to an election as much as it is the latest in a series of replacements of aging major river and lake crossings by the BC Liberals. The biggest one, of course, is the new Port Mann Bridge, but there is also the Pitt River Bridge, the W.R. Bennett Bridge in Kelowna and the Kicking Horse bridge east of Golden on Highway 1. In doing so, the Liberals have positioned themselves as builders of infrastructure on a scale comparable to that done by premiers W.A.C. Bennett and Bill

Frank Bucholtz Bennett. This has always been popular in B.C. and serves to position the province for future growth. In the case of the Deas Island crossing, a new bridge would serve a number of purposes. It would ease congestion in the tunnel, which cannot be expanded. It would eliminate the need for seismic upgrades. Perhaps most importantly, it would make it possible for larger ships with deeper drafts to come up the Fraser River and use Fraser Surrey Docks, which are underutilized. Ships are getting larger and larger and a deep river channel is vital in attracting new business. There are many legitimate concerns. One is that the bridge will funnel too much traffic onto

crossings further north, such as the Oak Street and Knight Street bridges. The Oak Street bridge was built at the same time as the tunnel, and is also a candidate for replacement. The Knight Street is newer, but both it and the Oak Street are already heavily congested at rush hour. Another is the strong possibility that the bridge will be tolled. While tolls are a legitimate way to pay for new infrastructure, there does need to be a fairer way to levy them. Many mayors, such as Surrey’s Dianne Watts, have suggested regional tolling, with a much smaller fee of 50 cents or $1 to cross all major river crossings. Road pricing has also been mentioned. Some planners are expressing concern that there is little discussion of how transit fits into the new bridge. They also question this announcement, in the light of the fact that there is a stalemate on TransLink funding and expansion of the transit system.

They are ignoring politics. Premiers often make major announcements at the UBCM convention. There will be plenty of discussion about TransLink in the coming months, as there is more dialogue about a referendum that is scheduled to take place next year. Growth will be on a smaller scale in the areas served by Highway 99. The Highway 1 corridor is where the emphasis on transit needs to be—along with expanded rapid transit in Surrey. It is important that farmland in Richmond and Delta is not impacted by the new bridge, but given that it is replacing a tunnel, that should be much easier to achieve than if a second bridge was involved. The premier has identified a need and is working to do something about it. That’s good news for the fast-growing population south of the Fraser River. COMMENT More rigorous analysis needed Re: Bills come due at BC Hydro (BC Views, NewsLeader, Sept. 18) The “news” that BC Hydro is having financial problems that will result in huge rate increases should be no surprise to anyone who has been following the BC Liberals’ performance since 2001. The Liberals have forced BC Hydro to buy $50 billion worth of power from the private sector, which it could have acquired much cheaper by producing it itself. However, what I am concerned with is journalist Tom Fletcher’s astounding lack of critical analysis of why BC Hydro is in the mess that the BC Liberals have put us in. He uncritically quotes energy industry lawyer David Austin who assures us that only a tiny fraction of the proposed rate hike is due to private power contracts. What he doesn’t tell the readers is that Austin is the private industry spokesmen and his role is to protect his corporate clients, who are essentially receiving huge subsidies from BC Hydro and, by extension, the public. On the other hand Fletcher portrays one of the few critics of this massive handout to the private sector, the Canadian Office and Professional Employees local 378, as having

“a history of mostly juvenile attacks on the BC Liberal Government.” If Mr. Fletcher was to actually do some research rather than ideological mud slinging, he would find that COPE 378 has been sounding the alarm on the issue of lucrative private sector handouts for over a decade. B.C. ratepayers are in for large power bill increases in the next decade. The BC Liberals and their corporate power friends are trying to minimize the impact of these lucrative contracts so we won’t be able to connect them to our increased power bills. To help us understand the extent of the problem, we need critical investigate reporting, rather than a lazy opinion piece like the one Tom Fletcher churned out. Murray Martin Burnaby

TIME-OF-DAY BILLING ALL PART OF PLAN Let’s be clear here. The only reason BC Hydro—which was already head-over-heels in debt—spent a further $1 billion to purchase and impose smart meters on the people of B.C. was for the purpose of bringing in timeof-day billing, which without smart meters wasn’t possible. When they were introduced,

both BC Hydro and BC Liberal politicians denied that this type of billing was even being contemplated, but now that the Liberals have again lied their way back into government, they are changing their tune. Problem is, we have far too many people in B.C. willing to swallow whatever the Liberals come up with to quiet the masses. Shame on them, and shame on the Liberals. Now they are attempting to threaten and intimidate those who didn’t surrender willingly. In an effort to save money at BC Hydro, one has to wonder why the salaries and positions of senior executives were not eliminated along with those of numerous front-line workers, and that the Liberals would still continue to syphon money from a Crown corporation that is bleeding financially? I can understand the government taking a cut when a Crown corporation is profitable, but not when they are bleeding money with no way to recover. James McQueen Burnaby

Metro Vancouver’s planned new Lions Gate sewage treatment plant won’t include many bells and whistles like a once-mooted

wedding chapel. And the plant replacement project will stop at secondary treatment – not the more advanced tertiary treatment demanded by environmental groups – in the name of saving money. “There’s no water slides, no wedding chapels,” Metro

utilities committee chair Darrell Mussatto said, but added there may be a very large farmable green roof and some public art. He said the design, picked from three short-listed options, is “basically finalized” –subject to further public input in the weeks ahead.

And all of the region is expected to share to some degree in the $560-million estimated cost, which is up from an initial $400 million but not as costly as planners had feared. It’s the first of two big sewage plants Metro must upgrade from primary treatment – basic

The Metro board must still decide how the costs will be apportioned, but staff are proposing that some of it be spread onto taxpayers outside the North Shore and City of Vancouver benefitting area, where sewage fees would otherwise soar by hundreds of dollars. Mussatto said the proposed design ensures the odour from the new plant will be “totally contained” to protect neighbours in North Vancouver District’s Norgate area. Georgia Strait Alliance executive director Christianne Wilhelmson, who sits on an advisory

committee on behalf of environmental groups, is still pushing for a design that allows future upgrades to more advanced treatment methods and recovery of resources. “Technology is changing,” she said. “What’s most important to us is eliminating emerging endocrine-disrupting chemicals as well as a broad range of pharmaceuticals.” Wilhelmson said secondary treatment recovers at best half of those chemicals, which can change the hormonal development of fish and add to the contamination of marine mammals such as orcas. “When we’re eating those fish it can have human impacts as well.”

But Mussatto said high-end tertiary treatment that would discharge very safe effluent to Burrard Inlet could have driven the Lions Gate price tag over $1 billion. “It’s too costprohibitive at this point to do that,” he said. Even at the lower cost using secondary treatment – which Ottawa now requires – Metro is still counting on large senior government grants. “If we don’t get the federal and provincial cost-sharing we will not be able to build this.” Metro also expects to pay $1 billion to upgrade its Iona wastewater treatment plant, which discharges to the ocean between Richmond and Vancouver.

a year and an expense account for travel and accommodation, MLAs receive a constituency allowance of $119,000 a year, mainly for staff and office space. Juan de Fuca MLA John Horgan told the committee he is “absolutely in favour” of disclosing detailed information, but more time is needed, especially with 32 new MLAs elected in May. That means new constituency staff learning accounting procedures on the job, while also learning to handle day-to-day concerns of constituents, many of whom are “in distress,” he said.

The committee supported Horgan’s motion to make the first detailed report public April 1, covering the period from Jan. 1 to the end of the provincial fiscal year. MLAs are also preparing to begin detailed disclosure of their personal travel and other expenses. During discussion of the legislature’s total budget, clerk Craig James told the committee there would be substantial savings this year because the scheduled fall session was cancelled. The Burnaby Art Gallery hosted a special preview of the Rembrandt exhibit at the gallery earlier this month. The event included opening remarks from the Dutch consulate, and attendance from local dignitaries such as Burnaby City Coun. Colleen Jordan (above). The gallery is currently showing two separate exhibits that highlight Rembrandt and his fellow Dutch Masters. The first, Storms and Bright Skies: Three Centuries of Dutch Landscapes is from the National Gallery of Canada. The second, Inner Realms: Dutch Portraits, is on loan from the Art Gallery of Greater Victoria. Both exhibits run until Nov. 17.

SOLO District soars above Burnaby with Altus By Kerry Vital

Appia Developments is reinforcing its reputation for amazing homes with Altus, the second phase in its SOLO District neighbourhood. Altus will be the tallest building in Burnaby at the equivalent of 55 storeys tall, with office space on the first 14 floors and residential from 200 feet up. “The views start from the bottom (residential) floor,” says Appia Sales and Marketing Manager Lisa Murrell.

North Burnaby is a rapidly growing region, with plenty of opportunities for shopping, dining, education and recreation, from golf courses to rowing to swimming. The area is an exciting place to live and is becoming a major urban centre in its own right. Never boring and always busy, North Burnaby is becoming the place to be. North Burnaby, also known as the Brentwood area, is about 20 minutes from downtown Vancouver via SkyTrain, and about 30 minutes from the Vancouver International

Airport. This contributes to the popularity of the neighbourhood with young professionals; about 39 per cent of the population in the area is between the ages of 20 and 44. Among the notable developers who are building in North Burnaby are Appia Developments, Ledingham McAllister, Bosa Development and Embassy Developments. It is hard to be bored in North Burnaby, with its selection of parks, art galleries, museums and theatres. If it’s a bit of culture you’re looking for, you can start up on Burnaby Mountain at the Simon Fraser University Art Gallery. It’s open to the public free of charge and the displays change every few months. Simon Fraser also houses the Museum of Archaeology and Ethnology, which showcases artifacts from around the world. There are several parks in Burnaby, so outdoor activity is never far away. Burnaby Lake Regional Nature Park surrounds the lake. The park includes a dog off-leash area, the Burnaby Sports Complex,

the Burnaby Equestrian Centre and several walking and cycling trails. However, its biggest draw is the lake itself, which has a rowing course for canoeing, kayaking and rowing training. Confederation Park is also an activity hub, with walking trails, a skate park, a lacrosse box, a running track, a community centre, several picnic sites and playgrounds, baseball diamonds and other playing fields. It’s also home to the McGill branch of the Burnaby Public Library and the Eileen Dailly Leisure Pool and Fitness Centre. North Burnaby is also full of opportunities for all levels of education. The largest institution is Simon Fraser University, just a few minutes from the centre of North Burnaby on Burnaby Mountain. The British Columbia Institute of Technology also has its main campus in Burnaby. North Burnaby is a well-connected city, with several options for public transportation, walking or cycling if you feel like leaving your

car behind. Because it’s nearly the centre of the Metro Vancouver area, it is easy to get on your way, whatever way you choose. Food is a necessity of life, and it’s highly likely that shopping is as well. Luckily, North Burnaby has many options for both. Your first stop for some retail therapy is Brentwood Town Centre, located right in the centre of North Burnaby and well-served by transit, including its own SkyTrain station. With department stores and smaller shops all in one place, you’ll be able to do much of your shopping in one spot. North Burnaby is a chef ’s dream, with stores such as Bosa Foods, famous for amazing Italian imports, and Cioffi’s Meat Market and Deli, which offers an array of fresh cheeses, dried pastas, olive oils, premium meats and homemade sausages, among other products. Grocery stores such as Safeway and Save-On Foods are also in the area. If you’re looking for a night out, there are many options for casual or fine dining as well.
