Saturday night wasn’t any normal evening in the life of 17-year Lake Country student Quinn Middleton. Middleton, a Grade 12 student at George Elliot secondary school, joined with thousands of others across the country to take part in the Coldest Night of the Year, a nation-wide walka-thon in support of homeless ministries and to raise awareness and funds for the plight of homeless people across Canada. “I think for me the big thing is seeing all of the people that are going to be out there supporting the homeless,” said Middleton last week, a day before taking part in the walk-athon Saturday evening at the Kelowna Gospel Mission. “Seeing how many people take on the challenge and step out into the cold and experi-

ence what the homeless people experience will be good. It’s not going to be the same but it will give us a taste of what it’s like. I couldn’t really imagine doing what they have to do every day.” So while many people were curled up cozy and warm in the safety of home, Middleton, along with friend Wynden Danylowich, were out taking part in a national movement aimed at helping a problem that affects people right across the country and is a big issue in the Okanagan. Middleton says it’s important for people to take part in community initiatives as opposed to ignoring social problems. “I think it’s really important to get out into the community and show your support and show you care. They are having these walks all around Canada,” he said. “Taking part in something like this definite-

ly opens your eyes and shows what can happen if you don’t stay on the right path.” Middleton is no stranger to being part of the community. During his final year in high school he has been spending one night a month at Lake Country council representing area students as a youth councillor. Middleton and Danylowich share the duties as the pair have learned about how local government works and how decisions are made in a community. A lifelong resident of Lake Country, Middleton says he hopes to attend UBC in Vancouver and study for a business degree next year and says his time as a youth councillor has been a great educational tool. “I think it’s been a really nice experience for me as a student, to get to know what’s going on outside of the high school,” he said. “It’s nice

Costly to comply with new building code fire regulations Lake Country officials are alarmed that new provincial rules could drive up firefighting costs. The revised B.C. Building Code calls for firefighters to respond to a blaze at newly creat-

Lt. Governor visits Lake Country Lake Country Mayor James Baker took the opportunity to pass on some of the history of Lake Country to the Queen’s representative in B.C. last week. Baker presented the Lieutenant Governor of B.C., the Honourable Judith Guichon, with a book about the history of the region during her visit to George Elliot secondary school last Tuesday. Student art work and performances were featured during the presentation and students had an

opportunity to ask questions of the Lieutenant Governor. For her part Guichon highlighted the importance of the three R’s in her address: Respect, relationships and responsibility. GESS principal Derek Lea, along with student leaders, Central Okanagan School Board representatives, teachers, staff and students and Mayor Baker enjoyed the engaging visit from the Lieutenant Governor at the school. The Lieutenant Governor also

spoke about sustainability, healthy communities, the importance of getting involved, and commented on a new program to promote music and community spirit across the province. The Sing me a Song program is an opportunity for musical groups of all ages and in any genre to write and sing an original song in the lead-up to Canada’s 150th birthday celebrations in 2017.

Classic car show returns for sixth year Heading into its sixth year, the Lake Country Custom and Classic Car Show has grown and will be a two day event for the first time ever this summer. The Lake Country Chamber of Commerce has stepped forward to organize a parade of vehicles as well as a night of food and entertainment to kick off the car show on Saturday Aug. 23, the day before the traditional show takes place in Swalwell Park. Car show manager Ron Volk announced the plans for the 2014 edition of the popular event last week. “This will be the sixth year for the car show in Lake Country and each year it gets bigger,” said

Volk. “We are expecting up to 400 cars this year and over 4,000 people to go through the park on Sunday.” The Saturday portion of the show is set up as a parade around Lake Country beginning in early evening as car participants will be able to take in some of the area and people can watch the car parade in different spots around Lake Country. After the parade the cars will come back to Swalwell

in B.C. and are diligently working on attracting some of the nicest cars for the event. “Whether it is a classic, hot rod, muscle car, pro touring car or just a car that you want to show we encourage you to come out,” said Volk. “We believe this will be one of the best car shows you will attend all year.” The Lake Country Customs and Classics is a non-profit organization and all profits will go to charity organizations in Lake Country. Council briefs: Public must stay mum during election run-up The official public comment time at Lake Country council meetings will not be available until after the 2014 municipal elections. A Lake Country bylaw stipulates that the public comment part of Lake Country’s bi-weekly council meeting shall not take place during an election year. Another regular feature of council meetings is also now banned as the few minutes each councillor gets to speak on any issue will also be struck from the agenda until after the election. Residents across B.C. will go to the polls in the next municipal elections Nov. 15, 2014. The public can still be heard and is invited to write to the mayor or council or apply to present as a delega-

Grizzly hunt isn’t going away

A

little-noticed protest tent sprouted up on the rain-soaked B.C. legislature grounds earlier this month. Green Party MLA Andrew Weaver spoke, asking whether B.C. residents would tolerate trophy hunting of killer whales. That would be a federal matter, but the point is vividly made about the onset of B.C.’s traditional spring grizzly bear hunt. It’s bigger this year, with Kootenay and Chilcotin wildlife management regions reopened after closures were enacted to preserve grizzly populations. In all, more than 1,000 grizzly bears are up for grabs. As with limited-entry hunts for deer and other animals, only about a third of those hunts are successful in an average year. The rally was sponsored by the Coastal First Nations Great Bear Initiative, the partnership with U.S.-directed environment groups Sierra Club, Greenpeace and ForestEthics that

Tom Fletcher has become so influential in B.C. affairs. It produced a survey showing that 88 per cent of B.C. residents oppose trophy hunting, and its California experts calculate a 10-fold increase in value when bear hunting gives way to bear watching. The Raincoast Conservation Society has bought up half a dozen guiding territories on the remote B.C. coast. Combined with government restrictions, more than half the coast is now off limits to bear hunting. Naturally, activists want the whole province shut down. Wildlife manage-

ment is the responsibility of Forests, Lands and Natural Resource Operations Minister Steve Thomson. He’s heard plenty from all sides and he maintains that bear watching and bear hunting will continue to coexist in B.C. Thomson has just introduced legislation to permit hunting guide territories to be operated by corporations as well as individuals. This is a long-sought change, allowing First Nations companies and others access to bank loans to expand the industry. Non-resident hunters are required to hire a licensed guide-outfitter. Resident hunters pay $32 for a oneyear hunting licence and $80 for a grizzly bear tag. Non-Canadians pay $180 for the licence and $1,030 for a chance at a grizzly. Hunting in general is making a comeback in B.C. Ministry data show hunting licenses had declined to 85,633 in 2006, but recovered to reach 97,828 by 2013.

Thomson credits the work of the B.C. Wildlife Federation, which runs hunter training courses. Another program, Becoming an Outdoor Woman, has helped revive hunting and camping as a family activity, he said. Growing up hunting in northeastern B.C., I was taught not to shoot anything I’m not prepared to eat. I also remember the struggles to protect caribou and other endangered prey species that at one time had B.C. biologists resorting to shooting wolves from helicopters. The reopening of grizzly bear territories is marketed to urban residents as a horrible crime against nature. In fact, it’s a sign of increasing population. Problems in B.C. wildlife these days include the fragile mountain caribou herds of the Kootenays, which have been subject to intensive management including relocation of animals. The ministry has also begun a five-year study

of declining moose populations across a vast area of the Interior subject to salvage logging in the wake of the pine beetle epidemic. Vancouver media recently highlighted a grizzly hunt by NHL journeyman Clayton Stoner. Typically, U.S. enviros promoted the deceased bear by name, “Cheeky,” and photos showed its carcass stripped to the skeleton by scavengers after Stoner left with the hide, paws and head. They don’t mention that the same fate awaits animals that die of starvation or other natural causes, which increase when animals overpopulate. As with many B.C. issues, there’s a cartoon version sold to impressionable city dwellers, and then there’s the truth.

Someone invented them at some point, in a misguided attempt to impose rigidity on a language as fluid as glycerin. Like a demented vacuum cleaner, English sucks up bits from every other language it encounters. French, German, Latin, Spanish, Italian, Russian, Arabic, Hindi, Chinese, even the pidgin of the Pacific islands—all have given us words and/or ways of organizing those words. Federal Budget 2014 and the New Building Canada Plan Balancing the federal budget has a lot in common with balancing the family budget. We’ve been through some tough times so we’ve had to take out a line of credit to avert emergencies, and we’ve been working diligently to get back to balance by setting clear priorities and taking care of the things that are most important: our children’s education, our family’s health and well-being and protecting the most vulnerable. We’ve found savings in the running of our house and ways to make it more efficient. And we’ve kept an eye on the future to ensure that we continue to be productive. According to Chapter 4.2 of Budget 2014 (budget.gc.ca) here is where your tax dollars go: Elderly benefits: $43.8 billion; Employment Insurance benefits: $17.7 billion; Children’s bene-

balance next year. We’ll be able to pay more down on our debt and we will ensure that Canada is prepared for any economic challenges that might come our way from outside our borders. Our focus on Canada’s labour market will also continue to be of primary importance. As the report, The State of the Canadian Labour Market, released by the Department of Finance(also available at budget.gc.ca) says “Canada’s labour market has generally succeeded in meeting recent challenges and performs relatively well in a number of areas, including job creation and post-secondary educational attainment. Canada’s economy has outperformed other G-7 countries in job creation in the recovery and over the last seven years. Canada’s labour force participation rate is high by international standards and Canada enjoys

a fairly mobile population that responds well to economic opportunities.” Nevertheless, as the report indicates, “there are areas that could be strengthened. In particular, imbalances between unemployment and job vacancies persist in certain regions and occupation groups; a number of groups remain underrepresented in the labour market; relatively fewer Canadians graduate in high-demand fields than in competitor countries; and Canada lags its peers in the development of business skills.” Budget 2014 focuses on addressing these deficiencies. Among the initiatives taken: we are launching the Canada Job Grant and an enhanced Job Matching Service to help connect Canadians with available jobs; we are introducing a new Canada Apprentice Loan to help registered appren-

tices in Red Seal trades with the cost of training; we are investing more in programs to help older workers and persons with disabilities access the labour market; we are creating thousands of new paid internships for young Canadians entering the job market; we are investing more into aboriginal education and training; and we are providing $1.5 billion over the next decade for the Canada First Research Excellence Fund for post-secondary research. The federal government also recognizes that for communities to realize their economic potential they need more funds for infrastructure. Last Thursday, Prime Minister Harper announced the New Building Canada Plan, which will provide $53 billion in support of infrastructure in Canada over

So you can string together “a lovely little old long brown Italian wooden stirring spoon,” and be understood. But if you mess with that word order, you’ll either confuse people or sound silly. Like all the other English rules, this one isn’t carved in stone. Little Red Riding Hood’s “big bad wolf,” for example, violates the rule. So how do English speakers learn to put adjectives in the right order, if they didn’t learn a rule? The same way they learned almost everything else—by absorbing it from their social

settings. No one actually teaches infants how to move their feet for walking. Or how to shape their tongues for talking. Children generally don’t take classes to learn how to play together, how to fall in love, or how peer pressure works. They soak it up unconsciously. That’s why it’s so difficult to change social attitudes. Lieutenant Cable was wrong, in South Pacific—what you’re “carefully taught” can be untaught. But what you’ve absorbed—about the roles of men and women, about racial differences,

We mobilize expensive sand and gravel contingents to attack this insidious problem of snow packing to make ice and water solidifying as it freezes. Black ice is a particularly nasty culprit because you can’t see it. Thank goodness for the help we get from tire manufacturers campaigning for drivers to do the responsible thing and purchase winter tires. Those altruistic, almost charitable organizations promote tires with optimum traction when driving on the stuff over which a curling stone is thrown and hockey is played. Focus on the true problem—those icy surfaces—and solutions can be found.

Those who don’t know me might be looking for a bucket to throw up in, not realizing that the words you have just read are dripping with sarcasm. I grew up on a farm that was nine miles east of Melville, a “city” by Saskatchewan standards with a population of about 5,000. When I was 16, I started driving a vehicle that was not equipped with winter tires. I grew up expecting that ice would form on the roads during the winter months. I didn’t know exactly where it

would form, but I knew enough from the ice cube tray in the freezer that sometimes I wouldn’t be able to see it. Perhaps my daddy taught me a level of responsibility that isn’t taught except on farms near small towns in Saskatchewan. Instead of blaming winter roads for being icy, I was taught to take responsibility for my own driving. I was taught to continually assess the road surface conditions and to adjust my speed accordingly. It takes being attentive. It takes being constantly aware of the surprising scientific discovery that water can freeze in below zero temperatures and that snow can pack to become ice. You leave more room between your vehicle and the next. When coming up to a curve in the road you slow down to a speed that will maintain traction if the invisible slippery stuff happens to

be there. You start slowing for intersections far enough ahead that you can stop, even if a sheet of ice has formed where a multitude of vehicles before you has packed down the snow. We are the problem, not Canadian winters. Recognizing the problem is the first step to recovery. We need to take better responsibility for our driving. News reports that point the blame away from drivers and towards naturally occurring road conditions are part of the problem. Headline after headline reinforces a lack of driver responsibility and accountability. Media outlets, in my view, need to take responsibility for the incredible influence they have. I came upon one headline that was almost helpful, but only almost: “Slow Down! Snowfall Causes Multiple Acci-

Trailer pulled by semi catches fire, burns out by side of Hwy. 97 On Sunday Feb. 23, at approximately 5:13 a.m., Kelowna and Vernon RCMP were called to a report of a fire to a trailer which was being pulled by a semi in the north bound lane of Highway 97 just north of the Pelmewash Parkway in Lake Country.

Police and fire attended and, after a brief delay, single-lane alternating traffic was established around the incident. Except for a short portion of the right hand lane of the north bound lane, the remainder of Hwy. 97 was re-opened

to traffic to proceed around where the burned trailer remained parked. The burned out trailer was due to be removed by Monday, Feb. 24. There were no known injuries associated with the mishap.

What causes bunions?

Bunions are an angular deformity occurring at the big toe joint. They are the result of faulty mechanics and joint motion. They are not caused by shoes. We are born with bunion-prone feet or bunion-proof feet. Bunion-proof feet don’t have to worry. Bunion-prone feet can develop bunions over time, and how much the deformity becomes larger can be dependent on the amount of weight-bearing activity you might enjoy. Despite this fact, it is impossible to predict just how quickly the deformity will progress, if at all. There is no scientific tool to predict how much larger your bunion might be a year from now. It is entirely possible to have a bunion on only one foot. Bunions can sometimes be painful and sometimes not. Bunions that are not painful do not require medical attention. Designated driver left in the lurch when drunk passenger causes crash

A

designated driver is seriously injured when her drunk passenger grabs the steering wheel, causing her to lose control and crash. Fair financial compensation for her injuries and losses is assessed at close to $800,000. ICBC denies the claim and a decision released by the court on Feb. 3 affirms ICBC’s denial. It’s an affront to all that is good and right in the world. If anyone should be fairly compensated for injuries caused in a crash, it’s a designated driver injured by the very drunken behaviour she had tried to protect the rest of us from. The injustice is compelling, and it made headlines. The headlines failed to identify the true source of the problem that got in the way of this lady being fairly compensated—a failure in legislative drafting. ICBC liability insurance doesn’t come from a traditional insurance policy. It is a creature of legislation. When we buy liability insurance from ICBC, we are not purchasing a policy drafted by the insurance company, we are purchasing a set of protections drafted by our provincial government. Had the exact same words been contained within an insurance policy, the result might well have been different because the court follows different rules when interpreting insurance policies than they follow when interpreting legislation. One standard rule of

statutory interpretation is that the court should avoid an interpretation that would render any portion of the legislation to be meaningless. This rule doesn’t apply to insurance policies. The judge quoted from a text book on the point: “It is presumed that the legislature avoids superfluous or meaningless words, that it does not pointlessly repeat itself or speak in vain. Every word in a statute is presumed to make sense and to have a specific role to play in advancing the legislative purpose… every word and provision found in a statute is supposed to have a meaning and a function. “For this reason courts should avoid, as much as possible, adopting interpretations that would render any portion of a statute meaningless or pointless or redundant.” Our “legislated” insurance policy contains a separate provision specifically allowing an innocent victim who is not an occupant of a vehicle to recover against a passenger of the vehicle who causes a crash. Had it been a pedestrian or other person outside this vehicle who had been injured, he or she would

have recovered fair compensation from ICBC. By creating this specific protection for non-occupants, those who drafted the legislation excluded occupants from coverage. Had they simply left that provision out, both occupants as well as non-occupants would be covered if a passenger causes a crash. This injustice would have been avoided. This is one of many, many examples where the courts apply the law that we have created. Except in very particular circumstances, such as when the law offends the Charter of Rights giving the court the power to strike it down, the courts are bound to apply the law however unjust the result. Smooth start to 2014 housing sales

Optimism is the attitude for Okanagan Mainline Real Estate Board members as January sales were up 30 per cent over the same month last year. “Moving into 2014, the housing market in the Okanagan-Shuswap continues to strengthen and maintain a steady upward trend despite sales levels beginning at a cyclical low this time last year,” said Karen Singbeil, OMREB president and a Shuswap area realtor. “All three zones in our board area have seen moderate to strong gains in sales for various property types during relatively slow economic growth and lagging consumer confidence throughout B.C.” Total active listings

continue to trend downward and inventories have declined more than 10 per cent year-overyear for five consecutive months. While slowly moving towards more balanced market conditions, OMREB remains in buyer’s territory which can prove challenging for sellers and buyers alike. “Proper pricing is still critical in our market and is the key to successful home sales,” Singbeil pointed out. “Savvy home sellers who are competitive and market conscious are sharpening their pencils when setting a list price, resulting in more transaction volumes in some zones. This is most evident in the North Okanagan where the jump in home sales was the most

significant during the past month.” In other areas, some potential sellers are holding off listing their properties or have pulled out of the market if they are not willing to set a competitive price, and this has contributed to the decline in inventory. “It is important to look at prices within property types and sale price trends within different price points in order to fully understand the overall picture of the current residential market in our board area,” Singbeil said. “OMREB’s three market areas are diverse so sales activity tends to vary among property types zone-by-zone and month-by-month with ups and downs at different times and locations.”

The weak economy may constrain consumer demand in the beginning of the year but should increase as the BC economy gains momentum during the second half of 2014. Long-term interest rates have trended much lower than was expected to start the year and should be very accommodating to buying activity heading into the spring market. Home sales through OMREB are forecast to rise 1.8 per cent this year. The Okanagan Mainline Real Estate Board is comprised of 1,020 realtor members and 92 real estate offices across B.C.’s Southern Interior of BC, covering an area from Peachland to Revelstoke.

HOORNAERT, DALE LEON 1947-2014 It is with profound regret that we announce the passing of Dale Leon Hoornaert on February 18, 2014 at the Vancouver General Hospital where he was awaiting a lung transplant. Survived by his loving wife of 44 years Diane and daughter Jan (Darren) Lewis and their children, Josiah and Nevaeh, all of Windsor, ON; two sisters, Yvonne (Doug) Waines, Elaine (Dan) Thomas and his mother Jolane Hoornaert. Dale worked for many years as part of the production team at Hiram Walker & Sons Distilleries. A Memorial Service will be held on Friday, February 28, 2014 at 1:00pm at Springfield Funeral Home, 2020 Springfield Road, Kelowna, BC. Sing Me a Song

Be a steward of the foreshore greenspace

At a recent visit to George Elliot Secondary, the Lieutenant Governor of BC, emphasized sustainability, healthy communities, and the importance of getting involved. The Honourable Judith Guichon announced a new program to promote music and community spirit across the province.

Spring cleaning for Okanagan Centre Linear Park greenspace will start again in March to make it safe and tidy for use by residents and visitors. Please remove personal property by March 1, 2014 or these items will be removed by DLC staff. If you have a sailboat on the foreshore and are putting it on a moorage ball, please contact Community & Customer Service

“Sing Me A Song” is an opportunity for musical groups of all ages and genres to write and sing an original song in the lead up to Canada’s 150th birthday celebrations in 2017. Groups are encouraged to write a song about what Canada’s 150th birthday means to them or their community. Each entry will be reviewed by a panel of musicians from around the province and an award of $1,000 will be granted in each of three age categories. Entries will be posted on the Lieutenant Governor’s website and YouTube channel, Sing Me A Song BC, to be viewed by all British Columbians. See more at www.ltgov.bc.ca.

Lake Country Citizens Patrol Needs You! Lake Country Citizens Patrol is looking for volunteers who are concerned about making their community a safer place. Organized programs such as Citizens on Patrol, Speed Watch, Auto Crime and Child I.D. have been running in the community for 26 years. It’s Income Tax Time… Trained community volunteers can help

This is an important final step to define the actions that will help us collectively achieve the goals of Our Sustainable Lake Country. Please RSVP to info@oursustainablelakecountry.ca to let us know if you will be there. The focus of this workshop is different from the previous events. Rather than brainstorming what we want for Lake Country, or coming up with a wide range of ideas on how to achieve those goals, it’s now time to start identifying which groups, agencies or organizations will take the lead on implementing the actions that have been identified. This is particularly true for the more complex, far reaching strategies that require more thought and development. The focus for this Implementation Workshop will be to further develop the complex, multi-faceted actions that result in significant progress towards the goals of the ICSP and that will require various stakeholders to work together. We’ll be working with you to break the actions into manageable tasks and asking you and your organization to support the implementation of the tasks. We’ll talk about the concept of “collective impact” and how those principles could be applied to maintain the momentum of implementing the Integrated Community Sustainability Plan (ICSP).
