Feds give nod to the Kitsault moly project

TERRACE - The federal government has given its approval for Avanti’s Kitsault molybdenum mine project provided the company follows a series of measures to dampen environmental and other effects. “I have determined that the project can reasonably be expected to result in adverse, but not significant, environmental effects on residents of Nisga’a Lands, Nisga’a Lands or Nisga’a interests related to fisheries, wildlife, migratory birds and forest resources,” noted federal environment minister Leona Aglukkaq in an approval document released June 27. She did lay out a number of recommendations identified through earlier studies that Avanti needs to follow. The list includes fish, water and wildlife compensation plans. And the list of Avanti tasks takes in snow clearing and other work along the Nass Forest Service Road (better known as the Cranberry Connector) which would be a key transportation connection for road access into Kitsault. The company would be responsible for measures to minimize vehicle-wildlife collisions and will need to participate in measures to increase the Nass moose population. A further federal condition is to promote Nisga’a business opportunities and develop Nisga’a hiring plans for the mine. Federal approval was bound by sections of the 2000 Nisga’a Final Agreement land claims treaty which states steps must be taken to ease or prevent adverse environmental effects and impacts on Nisga’a citizens from industrial projects. Avanti officials have been anticipating federal approval for some months and the June 27 announcement clears another hurdle for the project. The company received its provincial approval more than a year ago, signed a revenue sharing deal with the Nisga’a Nation last month and, last week, began clearing an access road and area to expand a camp that’s already at the location. It is also working on final financing needed for the $1 billion project, having already secured backing and sales contracts with German and South Korean companies and agencies and anticipates a full construction start next year leading to a 2017 opening. Molybdenum is used in steel alloys and Avanti is forecasting a mine life of at least 14 years employing 300 people. The ore will be trucked down to Vancouver for shipment to overseas processors.

KITIMAT - The District of Kitimat is working to amend their rules to allow giving bylaw tickets out instead of taking people to court. The move will give the town more flexibility in dealing with bylaw infractions without the burden and cost of legal proceedings. On June 23 Council gave three readings to the Penalties and Municipal Ticket Information System bylaw. As it is now for certain infractions people will get a site visit from the District, before possibly escalating to courts. Staff point out in their report to councillors that the process “can consume significant staff time.” The offences one can be ticketed for include things such as parking too many RVs on your property, keeping a prohibited animal or having over-sized commercial vehicles on your property. The tickets are all set at $100. Each day that the infraction hasn’t been handled will be considered a new of-

Rupert port pays city another $2.1 million in lieu of property tax By Shaun Thomas

PRINCE RUPERT The City of Prince Rupert has received another $2.1 million cheque from the Prince Rupert Port Authority as the two organizations continue to debate how much payment-in-lieu of taxes (PILT) the city should receive. The issue surrounding PILT is related to the value of undeveloped port lands – while the city believes payments should be made based on BC Assessment values, the port authority has an third-party assessment done on the federal lands and pays mill rate based on that valuation. “There has been a disagreement about the payment-in-lieu, so the port made two payments in the interim to provide some relief, recognizing the financial situation of the city,” explained port authority manager of
corporate communications Michael Gurney. “We’ve provided these interim payments and look forward to the resolution of the outstanding PILT payments.” Prince Rupert Mayor Jack Mussallem said the cheque itself has been in the hands of the city for some time, but was not deposited until this week. “It came in approximately three weeks ago and was held until senior staff had final discussions with the port authority about the PILT topic ... that money will go into city coffers and the additional funds will be subject to a report from staff and discussion among council about where it should be put,” he said, noting needed infrastructure improvements may be a priority. “There is some appreciation of the fact that this was overdue and the port handled it in an ex-
peditious manner. We had a representative on the port authority board bringing this forward, Maureen Macarenko, and we appreciate her work on behalf of the city.” As for ongoing discussions about PILT payments, Mayor Mussallem said they may be coming to a conclusion. “At this time, we have taken the matter about as far as we can go,” he said. “The values will fluctuate in the years ahead, but in the future there may be opportunity to get more value ... if we get an announcement within the year about two LNG terminals moving ahead, you can imagine what that would mean for the city.” The first cheque was received by city in November, a payment the city referred to as “the port’s partial payment towards their outstanding property taxes based on revised industrial property values”.

PRINCE RUPERT - As a company considers Prince Rupert for an oil refinery project, a city councillor intends to start a conversation about banning oil refineries within the municipal boundary. Coun. Anna Ashley told council members last Monday she will make a motion to change Prince Rupert’s zoning plans to exclude oil refineries from being permitted within the community. “We’ve been hearing a lot about Enbridge in the news lately, and one of the things that has been accompanying this is talks of things like oil refineries in Prince Rupert,” said Ashley, referring to a recent announcement made by Vancouver-based Pacific Future Energy about its plans to build a $10-billion bitumen refinery project near Prince Rupert. Council has asked city staff to report on how the exclusion could be done for an upcoming meeting. Mayor Jack Mussallem said the process might involve a public meeting.

Aboriginal title upsets B.C. gov’t forest policy By Tom Fletcher THE NORTHERN CONNECTOR
VICTORIA - The Supreme Court of Canada’s decision upholding aboriginal title in the Nemiah Valley in B.C.’s Southern Interior has major implications for provincial government policy, and the most immediate may be to forest licences. The ruling comes as the B.C. government considers the results of a province-wide consultation on converting volume-based timber cutting permits to area-based permits, to encourage longerterm forest stewardship by licence holders on Crown land. About 40 per cent of B.C.’s timber is harvested under 180 volume-based forests licences on Crown land. Private land is not subject to these licences, and was also excluded from the Tsilhqot’in Nation aboriginal title case that struck down a forest harvest licence issued in 1983. B.C. Attorney General Su-
zanne Anton said it will take some time for the province to consider amending the Forest Act and other legislation that has been affected by the decision. More than 90% of B.C. is Crown land, and much of that is subject to forest licences as well as unresolved aboriginal land claims. In the Tsilhqot’in territory west of Williams Lake, the high court’s landmark ruling clarified the effect of aboriginal title. “Now that title has been established [in the Tsilhqot’in claim area], the timber on it no longer falls within the definition of ‘Crown timber’ and the Forest Act no longer applies,” wrote Chief Justice Beverley McLachlin in the unanimous judgment released June 26. McLachlin wrote that the B.C. government can still enforce “general regulatory legislation” such as that dealing with pest invasions or forest fire control in areas of proven aboriginal title. But
a timber licence in such an area is “a direct transfer of aboriginal property rights to a third party” that would have to be agreed to by aboriginal title holders or justified as an intrusion of their constitutional rights. The judgment left it open to the B.C. government to amend the Forest Act so it conforms with aboriginal title as it is declared. In recent years the province has begun negotiating resource sharing agreements with aboriginal communities, including forest tenures and shares of provincial royalties from mines. Two weeks before the Tsilhqot’in judgment, the B.C. government announced a threeyear “stewardship agreement” with five Tsilhqot’in member communities. The province is providing $670,000 per year for projects to address forest and wildlife effects from the mountain pine beetle epidemic in the region.

KITIMAT - With a law stating that government employees earning over $75,000 must be disclosed, the list for the District of Kitimat has been released as part of the 2013 annual report. Kitimat’s Chief Administrative Officer tops the salary for employees who are still on the payroll this year. He earned $201,692.16. He was also covered for various expenses throughout the year, those totalling $12,238.41. His Deputy earned $151,800.05 in 2013 with $2,788.35 in ex-
penses. The Director of Engineering for the District of Kitimat earned $141,800.05 and claimed no expenses. The top earner for the District was actually Walter McLellan, who has since retired but was the town’s Municipal Cleark. His remuneration in 2013 was $207,218.95, with $9.50 in expenses claimed. Director of Community Planning and Development earned $118,525.93, and the District treasurer earned $116,409.89. The town’s economic development officer earned $94,102.41.

Firefighters in Kitimat also earn high salaries. Among those listed is the fire chief who took $115,906.51. Forty-eight people were listed as earning over $75,000 in the District. The entire payroll for the town, is $9,916,040.48, not including expenses. As for the District of Kitimat Council, the Mayor in 2013 earned $29,880, while councillors earned $12,285.96, plus expenses.

Massive housing project in the works for Terrace

TERRACE - A housing megacomplex planned for a section of land bounded by Kenney and Park in the Horseshoe will be the largest such development in Terrace since the 1980s. Details have emerged of Calgary-based Coast to Coast Holdings Inc.’s plans for what could be more than 180 apartment and townhouse units to be built by combining nearly 5.5 acres assembled through two private sales and a land purchase from the city. Most of the land was once the home of a provincial government highways maintenance yard but the buildings were taken down more than 20 years ago and the land was subdivided and sold off. Now Coast to Coast owns these two parcels as well as another small parcel immediately north of them. The property that the city sold to Coast to Coast is right on the corner of Kenney and Park and is planned to be a 105-unit apartment complex. Beside it is planned another housing complex with at least 7075 units. North of that, toward the corner of Walsh and Kenney, will
be a six-unit townhouse complex, for which a development permit has already been applied for. The city is selling its 2.4 acre parcel for $951,000, far more than the minimum asking price of $408,000 when it sought bids on the property earlier this year. This means more money than first contemplated for a city-sponsored affordable housing fund policy which it is in the middle of crafting. City development services director David Block is describing the proposed development as a double win for the city’s efforts to increase the amount of affordable housing. Not yet fully fleshed out, the city does want to provide grants to nonprofit groups to build their own affordable housing or to purchase lands upon which future affordable housing developments can be built, he said. And the second win for affordable housing, according to Block, will take the form of allowing more units to be built on the land than normally permitted in return for Coast to Coast providing affordable housing of its own at the location. Affordable, in this case, means 20 per cent below market
value on the sale of a condo, for instance, and rental rates of 20 per cent less than for similar other units in the complex, said Block. The criteria for determining who qualifies will be based on statements of income, he added. “In a tough [housing] market it will provide affordability to workers earning less,” said Block of the deal being reached between the city and Coast to Coast. Despite the affordability plan, Block said that the aim of this project is not for housing that would be affordable to those on social assistance or the unemployed, but that for people for instance working in retail, they can expect the right price. Coast to Coast plans to begin construction of the 102-105 unit development this summer as well as the six townhouses north of that. A Coast to Coast development permit application filed with the city describes its townhouse plans as “an attractive design with varied site setback.” The company has applied for a variance permit to reduce the buffer along the sides by half from six to three metres and also for a modification of the front landscaping buffer to make room for parking spots.

KITIMAT - Luna Zhang said her husband could hear chirping from a dryer vent outside their building and discovered a birds nest stuck inside. Worried it’d be a dangerous location for the baby birds, and not seeing a mother bird around, they thought of ways to get them out. They ended up calling the Kitimat Community Humane Society for help.
Shelter manager Maryann Oullet made the house call to get them out. Zhang volunteered her arm to reach in and pull out the nest which was only barely in reach. Oullet brought the nest of swallows back to the shelter for eventual transportation to the Prince Rupert Wildlife shelter where they will be cared for and released. She said the baby birds didn’t appear as active as they should be, leading her to think no mother bird had been around for awhile to care for them.

Online LNG tool offered VICTORIA - The LNGBuy BC online tool designed to connect local B.C. businesses with international LNG proponents is now available for pre-registration at the LNG-Buy BC web site: http://LNGBuyBC. ca The online tool will allow B.C. businesses to connect with major projects and ensure the province’s LNG-related businesses are in line for the potential of the LNG industry. It will also help support the promotion and marketing of B.C. companies to global businesses for both export opportunities and for foreign direct investment projects. When the entire online platform is launched later this year, it will be a key resource for LNG proponents to network with B.C. businesses. PRINCE RUPERT - Fifty-five racers lined up on Haisla Hill in Kitimat on the weekend for the annual Hill Climb. With threatening rain and showers, it took until almost noon Saturday until the road dried enough to get time trials underway. The rain did hold off long enough to get time trials finished and B class first round eliminations started. The eliminations were then postponed until Sunday as the rain started to fall again. Sunday started out the same way, waiting for the road to dry, but racing resumed around lunch time and the full race was completed. Arron Baverstock dominated in the A class, with Harley Bell and Pierre Amado finishing behind. In the B class, Randy Sarell placed first, with Doug Ribeiro in second and Karri Nelson in third. In the Snobike category it was James Gaidner who came out on top, followed by Peter Walsh and Robin Aurther. In the Junior Speedster section, Delaney Ribeiro finished KELLY EVANS / THE NORTHERN CONNECTOR in first, with Lou Ribeiro right behind, along with Quinn Ama- Top: Pierre Amado and his Challenger placed third in the A Class. The male requested money as he claimed to had been involved in a collision in Mexico and wished money to be sent through the Post Office. The victim did not comply with the request for money and instead confirmed that the grandson was not in Mexico and had not been involved in any kind of collision.

TERRACE - The Terrace Peaks gymnastics club formally wrapped up the 2013/2014 season with year end awards and display June 21. Gymnasts spent the afternoon showing family and friends their progress before breaking for awards, followed by refreshments, a cakewalk fundraiser and activities. During the awards, Maya Ebeling received Competitive Female Gymnast of the Year for her “great dedication, a contagious, positive attitude, significant overall sports improvement and true sportsmanship behaviour within the club and at competition.” Ebeling said she was surprised to hear she’d won. “When I heard I was really excited,” she said, noting that it’s especially motivating because she’s been battling a back injury. And Interclub Gymnast of the Year went to Ameylia Evans. Evans “overcame many obstacles and shows perseverance in her training. She is a great role model and team player.” Evans, who prefers competing on floor and has a background in dance, said she was “shocked” to hear she’d won. And Pyper Testawich took home Recreational Gymnast of the Year. “This award goes to a gymnast who is dedicated and loves gym-

She shows a true love for the sport at a very young age,” said coach Ambra Marak. Testawich, who nodded when asked if she was excited, said this is her first medal ever and she is going
to keep it in her room. And Terrace Peaks’ board member Tawnya Schuster was awarded the Club Spirit award. “We just wanted to recognize her for her years of service. Without the board we’re non-existent, we need the board to stay functional,” said Marak. “To volunteer for seven years it’s an accomplishment for
her and a thank you from us.” Schuster is past vice president of the board, and is now secretary and treasurer. She has watched the club grow over the years to the point where they have wait lists every day. While that is a sign of the club’s success and popularity in the community, for Marak it’s also a re-
minder that the club can’t expand in the way it would like to. “We can grow and we have the capacity to grow, but we can’t because we’ve just outgrown the gym,” she said. The club has a master plan for expansion, but would need a major injection of capital to make it happen. The gym used to get enough money to be fully operational from provincial gaming funds. “That was great, we didn’t have to fundraise, kids got to go to lots of competitions, new rec equipment was being bought... and then over the years they’ve cut back on gaming funds,” she said, noting that this year, after receiving $6,000 in grants, the club needed to fundraise $33,000 in order to break even. The club has been told not to expect any money from the provincial body next year. With all fundraising efforts going into just keeping the gym operational, fundraising for the expansion plans has to take a back seat. And Marak worries about what will happen if someday the gym doesn’t get funding or can’t make ends meet. “Having a gym like this in Terrace is huge for the community, the community needs it,” she said, noting that there aren’t many other drop in recreation groups, especially for young teens. “The gym is a really good way to get that outlet, be active and healthy.”

THORNHILL - Terrace’s Totem Saddle Club’s June 22, 2014 regular Gymkhanas marked a special occasion – the return of the great outdoors in the form of the outdoor arena. A special ceremony, held just after noon, thanked the club’s supporters for spending the last five years ensuring the outdoor arena was once again suitable for riding. “It is a great accomplishment and a delight to be back outdoors,” said the club’s Elaine Rempel. “We do have the indoor arena but it is smaller and harder to hold some of the events. KITIMAT - Well over 300 swimmers from B.C. and Yukon were in attendance at the AA long course (50 meter pool) Provincial championships in Victoria. To attend, swimmers needed to reach the AA Provincial time standard in two swim races and have achieved one or less of the higher AAA Provincial time standard. With this in mind racing at the AA championships is always close and exciting. Five of the seven members of the Kitimat Marlins who had qualified for the AA provincial champs were in attendance. Leah Desousa (11) competing in the girls 11 and under age group took two golds and a bronze medal. She took the gold in the 100 meter and 200 meter butterfly. During her gold medal swim in the 100 fly she achieved her second AAA provincial time standard. This qualifies her for the AAA Provincial champs in
Victoria. Desousa took the bronze medal in the 400 IM as well as a 5th in the 200 meter backstroke. Desousa swam 100 per cent personal best times at the competition. Gabriel Lamarre (12) competing in the boys 12-13 age group achieved 100 per cent personal best times and had his best placings in the 1500 meter freestyle and 200 meter breaststroke. Both events he finished 11th overall. Laurence Boucher (13) competing in the 12-13 girls division had her best placing in the 800 meter freestyle 15th overall. Laurence swam five out of six personal best times. Vanessa Lamarre (14) competing in the 14 and over girls division had her best finish in the 400 IM with a 16th place finish. Vanessa swam 100 per cent personal best times. Charlotte Collier (11) competing in the 11 and under girls division swam to 100 per cent personal best times and had her best placing in the 100 freestyle with a 20th place.

PRINCE RUPERT - Craig Outhet and James Witzke of the Wheelhouse Brewing Company provided Prince Rupert SPCA branch manager Anna Terebka with a $1,350 cheque donated to help with the shelter’s general operating costs, along with a glass of their locally-produced beer last week. The money was raised at the brewery’s beer gardens held on Seafest Saturday, with about 200 people stopping by for a drink throughout the afternoon. Members of the Prince Rupert SPCA were also selling raffle tickets at the event, with more than $1,000 being collected.
