Grand Forks resident Karl Lilgert’s appeal has been turned down by the B.C. Court of Appeals. Lilgert was convicted in 2013 of criminal negligence causing death in the sinking of the Queen of the North and was sentenced to four years in prison. In March 2006, Lilgert was in charge of the ferry vessel when it struck an island on the northern coast of B.C. near Prince Rupert and sank, killing two passengers, Gerald Foisy and Shirley Rosette. Lilgert’s lawyer, Glen Orris, argued during the appeal that the trial judge made numerous errors in her instructions to the jury, particularly when she explained the offence of criminal negligence and how Lilgert’s explanation should have factored into their deliberations. Lilgert had been out on bail living in Grand Forks but is now in prison in Abbotsford awaiting classification. “He’s now doing his time—that’s the consequence of the decision of the court of appeal,” Orris told the Gazette in an interview on Dec. 17. “I intend to file a leave application to appeal the Supreme Court of Canada.” Orris said he was surprised by both verdicts in the case. “I believe that this is a very complicated area of the law and I don’t believe the trial judge or the court of appeals has got it right yet. That’s why I’m intending to file a leave application to appeal the Supreme Court of Canada.”

To begin with, we walked everywhere. There were no alternatives unless our parents, busy as they were, drove us somewhere. However, that was unusual so we walked—up to the Donaldson baseball park for our regular practices and at-least-once-a-week games, to the hockey rink in winter, to school and to church. We walked downtown on Saturday afternoon or evenings to the Gem Theatre and home again, or to our after school jobs. And our weekend fun was climbing Rattlesnake Mountain or Observation Mountain, and once Galena Mountain, or walking to City Park for a swim or the CPR bridge so we could jump into the river. No skateboards, no scooters, just legs and feet. And no computer games to keep us at home. No problem; however, we all wanted bikes to speed things up and get to more places. It was wartime though, and bikes were scarce, something we could not easily buy in Grand Forks during the war. We were all very jealous of Peggy Henniger (now Phillips) when her dad came back from the States one day with a brand new brightly coloured Schwinn bike with a comfortable seat and fat tires. We all vied for a chance to ride it and she did let us try it out. Happily, along came my 13th birthday and my first bike—a CCM of course. What freedom! The most fun trips that my best friend Glen Smith and I went on were to bike to Christina Lake on Saturdays so we could swim in the afternoon and attend the dance at night at the Pavilion. Then came the hard part: looking for someone with a light delivery truck with room for us and our bikes that could take us back to Grand Forks after dark. It improved a lot when my parents bought a cottage near Alpine and we could stay there overnight.
Growing Up In Grand Forks The Best Place on Earth
MILTON ORRIS And then were the trips down to Danville, Wash. where we could buy treats you couldn’t get in Grand Forks— special candies and many different ice cream cones. On one trip my mom asked me to buy two jars of peanut butter, also scarce in Grand Forks those days. We did and I wrapped them in my sweater and put them in my handlebars basket. On getting home I found that one of the jar’s lid had come off—my sweater smelled great for weeks. I also got a drop in from the Mounties on Sunday morning. Glen and I had forgotten to check in with the Canadian Customs on the way back (maybe because we were worried about smuggling peanut butter) and had better bicycle back there fast, this morning, and do what was expected or be arrested! The big break though came when Glenn found a 1917 Model T in someone’s barn and he (with some help from me) bought it and got it going. In fact I always helped—I was the one that had to turn the crank on the front of the car to start it while Glen, who was 16 and had a driver’s license, did the driving. It was a light blue and we took off the top so it became a convertible. We thought girls would like that better, and they did! We went everywhere in it: to the Lake, up to Greenwood, and of course all the nice quiet, darker places, for instance out near the cemetery, in the evenings with young ladies that wanted a romantic “ride and park.” The Model T was great fun even though on going to Greenwood we had to back up Spencer Hill because reverse
Pet of the Week
was the lowest gear and otherwise we couldn’t make it up that steep incline. Glen and I still talk about it! Eventually I got my first car, a tiny Austin that would go 60 miles an hour if there were no head winds. It was special as it was the first car with the little signal arms that you could get to swing out the side of the car using a little switch inside—that let people know which way you were turning. I eventually sold it for $400 and bought an MG for a little more—$600 I think—another convertible that was one of my life-long favourite cars. It was so safe in Grand Forks and area. You never worried about being anywhere after dark—unless of course you were quietly parking with a girl friend and would much rather be alone.
This day in automotive history On December 19, 1968, Warner Brothers releases the movie Bullitt, starring Steve McQueen, in Sweden, some two months after its debut in U.S. theaters. Many critics consider Bullitt to be one of the greatest action movies ever made, not because of its script or special effects--the plot is impenetrable, the dialogue is fairly awful, and nothing explodes—but because of one sublime seven-minute car chase through the streets of San Francisco. In poll after poll, moviegoers have named that chase the best in film history.

City to appoint facilitator CRAIG LINDSAY
Grand Forks Gazette
Strategic plan At the regular council meeting on Dec. 15, staff received approval from council to appoint a facilitator for a strategic planning session that would define council’s strategic plan for 2015-18 in accordance with the city’s purchasing policy. “In accordance with our purchasing policy, we will have some verbal quotes to find out what kind of facilitator would best suit us,” said acting chief administrative officer Diane Heinrich. “We have some quotes already. It’s just a matter of determining which one. Quotes are ranging between $5-10,000.” Heinrich told staff that the more expensive options include a survey for residents. The sessions are traditionally held at the end of January or beginning of February, said Heinrich. “I think it’s important that the community has input into our strategic plan,” said Councillor Julia Butler. “But I think when the surveys come out we need to be very pointed. I’m sure the people that do these have experience doing that. The questions need to be specific and not broad and general, and maybe we need to leave room for comments.” Coun. Chris Hammett suggested council use the survey from the AKBLG to aid planning. Powell speaks After a quick vote at the behest of Butler, William Powell spoke to council about his company which uses enzymes and macrobilials to dissolve sludge in sewage lagoons. Powell hopes
that council will consider his product for use in the city’s excess sludge. “He came out to a council meeting maybe about six months ago that I attended when I was a member of the public,” said Butler. “I heard him speak about his company and I found it very interesting. I was hoping the city at that time would have given him an ear considering the amount of money that it was going to cost to do the physical removal (of the sludge at the sewage lagoons) it definitely sounded like an option that needed to be looked at.” Butler said when she saw the sludge removal options come up on the agenda she contacted Powell and asked him to come and speak. “Cost-wise it could save us hundreds of thousands of dollars in savings,” she said. “It’s in the best interest of the taxpayers to look at this option.” Powell’s presentation was accepted by council for information purposes. Sasha Bird, manager of development and engineering, said that the city is currently, in conjunction with their consultants, reviewing various options for sludge removal. Grants
Council approved a recommendation to allow staff to proceed with applying for grant funding for the Small Communities Fund and Strategic Priorities Fund (gas tax) grants. Bird told council that the Small Communities Fund is funded equally by the provincial, federal and municipal governments (1/3 each) and the application deadline is Feb. 18. The Strategic Priorities Fund is gas tax money and is 100 per cent funded by the

province. The deadline for that is April 15. “Through the asset management plan we’ve looked at some of the priority essential projects we’ve had either on the books or recently come up because of regulatory requirements,” she said. “The one project we were looking at for putting an application in for the Small Communities Fund is the sewage effluent disposal and treatment ($500,000). The other project is the roof replacement on the east side reservoir which would go to the Strategic Priorities Fund. We have the ability to apply for two capital projects and one capacity building project as part of that fund.” Bird said that the reservoir roof (unknown cost) and the water main replacement project on Fifth Street ($400,000) would be the two capital projects, and the capacity building project would be the long-term financial planning policy. “All we are asking at this time is for council’s support for applying for the funding,” she said. “It doesn’t mean we’re approving the projects or anything like that. Obviously, if we don’t get the funding we aren’t going to proceed with the projects.” Electrical utility bylaw opt-out
The electrical utility bylaw (Bylaw No. 1975) has been put on the backburner by council. At the Dec. 15 meeting, staff recommended for council to give third reading to the repeal of electrical utility repeal bylaw 1543-R and third reading to its replacement electrical utility regulatory bylaw 1975. Council voted to refer both readings to the Jan. 12 meeting to • See COUNCIL BRIEFS page A10

Lockers broken into
Vehicle runs into ditch
On Dec. 16 at 4:40 p.m., police received a report of locks having been cut off lockers at Boundary Border Self-Storage on 19th Street. “Somebody got into the compound and cut some locks off the lockers,” said Staff Sgt. Jim Harrison. “Apparently, the owners are contacting the people who are renting the units to determine what was stolen.” No other details have been released at this time. Police are still investigating. Anyone with any information on this crime is urged to contact the Grand Forks RCMP at 250-442-8288 or CrimeStoppers.
On Dec. 20 at 10:46 a.m. police responded to a call of a vehicle in the ditch on Highway 3 at the Paulson Detour Road. “A constable attended and located a white 2003 Chevy Avalanche in the ditch,” said Harrison. “The vehicle appeared to have lost control in the recent snow fall on a clockwise corner, started to slide, over-corrected and ran off the road into the ditch and into a rock bluff.” Damage was well over $1,000. There were no injuries. The driver, a 22-year-old male from Fruitvale, was charged with driving too fast for road conditions.

Show Christmas spirit and generosity year-round The Christmas season is a busy time for us here at the paper and for most of the community with parties, school events such as band concerts, parades, appearances by Santa, and so on. Christmas is also a time for giving and there’s no shortage of generosity with residents and businesses digging into their pockets to help those less fortunate through organizations such as the food bank and the shelter. It is great to see that kind of holiday spirit; we also need to remember that hunger, poverty, homelessness and other social issues are year-round problems. Whether through mental health issues, bad luck, bad choices or whatever, many people in our community find themselves relying on the help of strangers. Just because someone uses the shelter or the hampers or the food bank, it doesn’t mean they’re lazy or “abusing the system.” Often it’s good people who find themselves in a tough situation for a variety of reasons. Let’s not forget that those less fortunate need help throughout the whole year and not just at Christmas. Let’s all show that great Christmas spirit and generosity yearround by remembering to give throughout the year, not just during the holidays.

YOUR THOUGHTS?
When I was a child, I always became more and more excited as Christmas approached. The idea that I would soon be receiving presents under the Christmas tree was almost too much to bear. (The religious implications of Christmas were not the first thing on my mind during those early years, though when I was eight, I was extremely concerned about the annual Sunday School Christmas pageant. I was worried that for the third straight year I would be given the role of a shepherd and have to wear the horrible, scratchy burlap costume again. I hoped that Mrs. Anderson would finally realize that I had put in my time and deserved to be Joseph and wear the soft, brown velour Joseph robe. A foolish

hope as it turned out.) I was excited about approaching Christmas as well during my years as a high school teacher: a two week break from explaining the difference between a misplaced modifier and a dangling participle to 15-year-olds seemed like heaven. Today I still look forward to the Christmas season. I festoon the house with lights, play Christmas carols loudly, repeatedly make batches of strong eggnog, buy presents for family and friends, and watch old Christmas movies on TV. After Christmas, I look forward to New Year’s Eve, more celebrating and the gradual lengthening of daylight hours. Through it all, I try to focus on the positive notions of peace on Earth and good will toward men. Unfortunately, that seems to become harder and harder for me every year. One reason no doubt is that the normal processes of aging are making
me crustier and more curmudgeonly year by year. Another is that news stories seem to indicate that peace on earth is becoming more and more difficult to achieve. Reports of wilful death and destruction dominate the news. Islamic State jihadists, Boko Haram extremists, home-grown Canadian terrorists, and Pakistani Taliban suicide bombers seem to take turns as the lead news story. They are closely followed by reports of systematic CIA torture, poorly vetted American drone attacks, unwarranted killing of suspects and prisoners at the hands of Canadian and American police, and the unrepentant politicians, military personnel and police officers responsible for all the damage. Ironically, the horror of the weekly news is partially responsible for my gleeful anticipation of the Christmas holiday season again this year. How nice it is to be able to focus on family and friends,

food, music, celebration, and gift giving for awhile instead of the daily diet of bad news that taints the rest of the year. And while some people say that we should temper our Christmas celebration and remain focussed on the sad state of civilization in order to continue to work toward solutions to the world’s problems, I have to disagree. Joy and celebration and the outpouring of good will are what define us. They reinforce in us the best qualities of our character and assert the truth that we are not merely motivated by baseness and self-interest, but by an irrepressible bounty of spirit that can’t be erased or even repressed for long. I have to admit, though, that once upon a time that spirit was repressed in me. That is, until I was nine and got to play Joseph in the Christmas pageant. There’s nothing like a velour robe to inspire Christmas joy.

Opinion to the editor
Why school board secrecy?
Editor, The Gazette: Once again, a visit to a school board meeting on Dec. 9. The new board is in place, with five of the elected trustees having experience. It is a beautiful remodelled conference room where the board meets. Quite a change from the old days and a good change. I might go to more meetings now that it is a warmer room with the new thick carpeting. I especially like the beautiful conference table. I do appreciate seeing my tax dollars at work. One of the questions I asked Teresa Rezanoff, board chair, was are the closed meeting reports being made available to anybody interested? I was referred back to the agenda which has a brief one-line statement referring to closed meetings or in-camera meetings (closed to public) of previous month stating, “The board discussed issues personnel issues, properties /facilities, business items, as well as the principles of co-governance.” This is the standard line on every agenda dealing with closed meetings.
Excuse me, that is not what the School Act says what the board responsibility is... why the secrecy? Is it too much work to do this or is it just plain arrogance that we the people are too stupid to understand what they are doing? The School Act says a board must prepare a record containing a general statement as to the material of the matters discussed and the general nature of the decisions reached at a meeting from which persons other than trustees or officiers of the board, or both, were excluded, and the record must be open for inspection at all reasonable times by any person who make copies and extracts in payment of a fee set by the board. Notice the reference to general nature of decisions. None of this is available to us the voters, taxpayers, parents etc. Yet they want more public imput. Nothing like building a bureaucratic wall of denial. A private club which we pay for and who we entrust the education of our children. Val Rich, Grand Forks

Looking forward to skiing Editor, The Gazette: On Dec. 16, I took a drive to the Phoenix ski area and hiked some of the runs. Due to the recent mild weather the early snow had settled to a base of approximately six inches. I was most impressed with the brushing job completed this past year. Great work! With the runs brushed out as they are and the snow cats grooming an additional snowfall, we can look forward to another
good year at Phoenix. Short, yes, but sweet. Being one of the original people of the Phoenix ski area, I never imagined the runs of Phoenix to be in such great condition. Thanks to all those involved with the continuous operation of the Phoenix ski area. Dave Doumont, Christina Lake

The year 2014 was a very difficult one for Bill Bevan. His wife, Shirley June Bevan, had died after a very short illness at Boundary Hospital. Very soon after, William Rhys Bevan was himself in need of palliative care at the Boundary Hospital. He expressed a wish to see the chairs and table in the covered outside seating area replaced with a couple of bench seats. Bill suggested it would be a worthwhile project for the Woodworkers Guild to undertake and as secretary of the Boundary Woodworkers Guild it was his intention to approach the guild and ask them for a feasibility study. Sadly he did not survive to do this. Bill and Shirley’s Family and friends felt that in addition to the riverside

From festive parties to the stress of family get-togethers, the holidays are already an overwhelming time. But they can be especially difficult for those dealing with alcoholism. The Alocholics Anonymous preamble states: “Alcoholics Anonymous is a fellowship of men and women who share heir experience, strength and hope with each other that they may solve their common problem and help others to recover from alcoholism. The only requirement for membership is a desire to stop drinking. There are no dues or fees for AA membership; we are self-supporting through our own contributions. Putting a book under every tree Columbia Basin Alliance for Literacy had an amazing response to its 2014 Books Under Every Tree program, said community literacy coordinator Sheila Dobie. Along with the usual donation boxes located at Silver Kettle, the Rec Centre, Perley School, Selkirk College and the Grand Forks library, two school classes held a challenge to see which class could get the most books together. The efforts of Kristen Nicolson and her Christina Lake Elementary school class, and Nicole Fraser and her Grade 11 Chemistry class resulted in a carload of books. Thanks go to these amazing efforts along with the folks that contributed to the various locations throughout the community. Pictured is Elenore Martens showing off some of the amazing books donated this year. Submitted photo

allow for more discussion. At the meeting, Alex Love, the city’s electrical consultant, gave a presentation on the bylaw and answered questions from council. The new bylaw features the addition of solar photovoltaic net metering. It will also add a provision for other IPP (independent power producer) projects at the discretion of electric utility and with the proviso of no negative operating or financial impacts. “Which will make it easier for us to review other applications without having to go back to council while having the guiding principle established,” said Love. Butler brought up concerns about radiation from the hydro meters and how some areas such as Nelson have an opt-out clause. “If council desired we could introduce a radio read meter opt-out program similar to Nelson or maybe a bit different depending on the wishes that would be practical,” said Love. Love said it would not be an analog meter but rather a digital meter without the transmitter. “I think meter opt out programs are not for the masses,” he said. “There is statistically a very small percentage of customers that will take advantage but what they are for is those small number that’s why there are charges like the set up charges so it doesn’t come at a cost for the remaining rate payers.”
Acting CAO Diane Heinrich said that council could add the opt-out clause as an amendment to the bylaw because it’s only at second reading. Butler told the Gazette after the meeting that opt-out options are becoming more popular with cities around the region and with Fortis because of concerns with RF radiation. “It’s something we don’t have at present in our electrical bylaw,” she said. “For legal reasons it could be a protective measure for our city with the law suits that are being brought forward.” She added that it’s also important for people to have freedom of choice. “It’s their homes and their health,” she said. “They should have an option to protect themselves from something they might think is a danger to their health.” Coun. Neil Krog spoke against the referral during discussion of the bylaw. “I don’t want us to be seen us putting up road blocks to people that are trying to get it this far so they can then proceed with their own projects,” he said. “I think the newer members of council need some time to be comfortable,” said Coun. Chris Thompson. “This is the first really big reading we’ve had. Although things have been discussed and perhaps observed in the gallery or on GFTV. ca, I don’t think it’ll have that big of an impact to postpone it to our next reading.”

Junior girls get the win Gazette Staff
After building up a 16-7 lead in the second half over Boundary Central (BCSS) at home two weeks ago, the Grand Forks Secondary (GFSS) junior girls had to rely on a late basket from Grade 10 guard Alaina Condruk to the get the win. The junior Wolves pulled out to the lead using strong pressure defence and some driving lay-ups. However, in the second half the plucky Roadrunners from Midway fought back and managed to tie the score late in the fourth quarter 18-18. GFSS guard Daisy Klassen scored to put the Wolves up 20-18. Condruk then scored to push the Wolves up by
four, 22-18. Nevada Dynesson scored a late hoop to bring the Roadrunners to within a single basket but strong defence sealed the win for GFSS. “It was a good win,” said GFSS coach Craig Lindsay. “The girls really worked hard as a team and showed a lot of determination. It was nice for our Grade 9s and 10s to get a chance to play against players their own age.” Lindsay said that due to small numbers GFSS has had to combine the juniors and seniors and mostly play senior games and tournaments. Leading the way for Grand Forks in the game were Klassen with nine points and Condruk with seven.

There are z GFREC many New Report Year’s resolutions planned at the beginning of the GRAND FORKS year: to eat RECREATION better, get in shape or do things for myself are just a few.
Get in shape in 2015 GFREC can help you with your plan to get in shape in 2015. If you are looking for something new and alternative to tradition, come out and try Bellyfit. This program includes strengthening and cardio using music to motivate you. It includes relaxing yoga and inspired stretching exercises incorporated into a relaxed environment. Classes will be held on Monday and Wednesday morning from 9:30 to 10:30 in the arena viewing room. This is a registered program but Michele welcomes drop-ins. Stretching is one of the most important parts of your exercise program. We do not normally take the time to properly stretch. Gisela Ko has modified her stretching exercises so a chair is used for support. Classes are held in Grand Forks Tuesday afternoons from 1 to 2 p.m. and Friday mornings from 11 to 12 p.m. Drop-in fee of $2 applies. Classes are held at the Christina Lake Community Hall on Wednesday afternoons from 1 to 2 p.m. Swimming is a great form of exercise that offers less impact on your body. Adults can learn the skill of swimming in just four sessions. Adult lessons will be held on Tuesday evenings from 5:15 to 6:15 for four sessions starting Jan. 6 . Preregistration is required by Dec. 30. Countdown to 2015! Take part in our Rotary Club’s New Year’s Eve Day Toonie swim countdown to 2015 celebration on Dec. 31 from 1 to 5 p.m. There will be party favors, snacks and game for all ages. She always remembered their birthdays and special events and kept in touch and track of their lives. Nadine worked in Health care for twenty years and before that worked at the Co-op in the hardware department. Everyone knew and loved Nadine. Nadine was a life-long USCC member and served on many committees and organizations. She was an active community member and volunteered for numerous organizations. Gooe Sun Mark
June 3, 1922 – December 18, 2014 Gooe Sun Mark, best known as Mrs. Mark, sadly left us at age 92. Born in China, June 3, 1922, she passed away Thursday, December 18, 2014, at 10:00 AM, in Vancouver. She immigrated to Grand Forks, BC in 1955 with son, Baun Foon and daughter, Zshu-Zshu in tow to join her husband, Mark Soon, who had started his restaurant and confectionary earlier. Two years later, a son, BunLing was born. Mrs. Mark had a reputation for her generosity and kindness to customers and all people as well as endurance for hard work. Her unfailing work ethic and warm personality contributed much to the success of the Honeydew restaurant for 37 years. In 1992, she retired at age 70 by moving to Vancouver to be closer to her daughter while enjoying her “Chinatown” immensely. She easily made new friends in her new neighbourhood and later at the 7th Day Adventist Church. Mrs. Mark’s life was one of success overcoming adversity, that of poverty and hunger, experiencing wars, traumatic immigration processes and finally making her way to a very new life being the only Chinese family in a foreign little town with a foreign language. In her younger years, she yearned for an education and despite all odds she excelled by acquiring 5 years of schooling in just 2 years. With her knack for learning, she endeared herself to the Russian community of Grand Forks by replying in Russian during conversations and learned to make an awesome borscht for the menu. There can be no doubt she had the fond respect from people of all ages. It has been said that the Honeydew, “famous” for its Chinese food became iconic, as a meeting and greeting place for children who were handed ice-cream cones by Mrs. Mark as well as the locals who ate the cafe’s home made pies during coffee breaks. Always smiling, her sense of survival and strength of character in changing environments during a very different era came through. She is well remembered for her wonderful ability to always engage with people and bring out their smiles as well. She is survived by her 3 children, 13 grand children, 2 daughters-in-law, and a younger brother in China. She was predeceased by her eldest son, Ken and her husband who had passed away earlier in 1975. If you would like to write a tribute or give condolences go to link: http://www.legacy.com/ guestbook/dignitymemorial/guestbook.aspx?n=goomark&pid=173528255 Funeral Services will be held at: Forest Lawn Funeral Home CHAPEL, 1:00 PM Monday, December 29, 2014 3789 Royal Oak Ave., Burnaby, BC 604-299-7720
With deep sadness Opal’s family announces the passing of a great lady. Opal is survived by her sister Viola, sister in law Marjorie, sons Robert (Anneke), Richard (Dorrie), grandchildren; Laura (Joe), Robert Jr. (Kristy) Corey (Terry), Jaime, Kiera (Peter) and great-grandchildren; Brett, Kendra, Emily and Emma. She also leaves behind many nieces and nephews as well as her Brothers and Sisters from local 378 (15) who helped her become the legend she was. Opal has gone to heaven after a long and active life to meet with her life partner Jack, her parents, siblings and loved ones who have predeceased her. We were blessed to see her to her 90th Birthday this year. With a pioneer spirit Opal served in the labour movement for decades, fighting for equality and women’s rights. Along with 15 other women, Opal created and later became Secretary Treasurer of Cope 15 (378) of which she was named an Honorary Lifetime member. Opal was a member of the Labour Relations Board and was also active in her community, she always acted and supported the less fortunate. She lived most of her life in Vancouver, after retirement she decided to put her “rocking chair” in Grand Forks to be with her sons. Nothing was more important to her than her ‘Clan” her family and friends. Opal’s life was lived well and to the fullest, the proof is in the Legacy she has left behind. We’ll keep our memories of you near and pass them on to those who are dear, holding you close to our hearts always, Your Family. We like to thank Opal’s doctor and the staff of Sunshine Manor who took such loving care of Opal during her short stay with them. In lieu of flowers, donations to any education program would be appreciated. No service will be held on Opal’s request, celebration of life will be announced at a later date.
