Biologist blasts District over environmental bylaw confusion Homeowners face steep bill if they wish to be removed from blanket restrictions Daniel Palmer News staff

A local biologist believes an environmental bylaw meant to protect sensitive ecosystems on more than 2,000 properties in the District isn’t following provincial guidelines and wasn’t properly implemented. The Environmental Development Permit Area (EDPA) was approved by council in March 2012 and relies on aerial maps of sensitive ecosystems – created by the federal and provincial governments in the 1990s – that restricts development in certain pockets of the District. “The bylaw is good intent, it’s just not being implemented correctly,” said Ted Lea, a registered professional biologist with over 40 years of experience in ecosystem mapping and inventory. One problem, said Lea, is that Saanich was meant to use the aerial maps as a “flagging tool” to identify sensitive ecosystems and then conduct field work to further refine boundaries. But that field work wasn’t proactively done. Instead, the onus is now on an estimated 2,600 homeowners to hire a biologist at their expense if they wish to have their property considered for removal from the EDPA and have subsequent development restrictions lifted, Lea said. “The guidelines require someone at District to go on the ground and say, ‘Yes, this is a sensitive ecosystem or it’s not.’ If it’s not, it comes out of the inventory,” Lea said. “What Saanich did instead was simply take the government maps and throw the EDPA over it.” Adriane Pollard, Saanich’s manager of environmental services, confirmed in an email that the

tiative. Those areas could also be subject to the EDPA.) Norman Webb, who owns a 1.3-acre property on Christmas Hill, discovered he was subject to EDPA restrictions while planning to sell his home two years ago. Webb’s niece, Anita Bull, hired Lea to determine whether or not an environmentally sensitive ecosystem exists on the property. Lea concluded no such ecosystem was present, but the District said several Garry oak trees on the property meant the land would remain within the EDPA, Bull said. “If a backyard is just lawn and garden, it’s not a sensitive ecosystem,” Lea said. “I agree that maintaining tree corridors is sometimes really important, but this is

about sensitive ecosystems.” Coun. Vicki Sanders, who chaired Saanich’s environmental and natural areas advisory committee when the EDPA was developed, said the bylaw was intended to protect sensitive areas in the face of increasing development pressure. She compared it to a 2006 bylaw restricting development near streamside areas. “The idea it was a benefit for the larger community,” Sanders said. “With the Christmas Hill property, this is part of a contiguous forest that goes right up Christmas Hill. BBB launches 2015 directory The Better Business Bureau of Vancouver Island is set to launch its 2015 directory – celebrating business excellence. The bureau publishes its listings of accredited businesses on Vancouver Island annually. “These are businesses that consumers really need to be using in terms of trust,” said president Rosalind Scott, who is based in Victoria. In order to qualify, a business must have been in operation for at least a year, have no complaints logged against them, have established a positive presence in the marketplace and have a good rating with the BBB, based on specific criteria. “Nobody can walk in the door, write a cheque and say I want to be accredited,” Scott said. One of the ways the BBB celebrates businesses that have gone above and beyond is through the annual Torch Awards. Each year the BBB receive several thousand nominations from across Vancouver Island. The financial reward for stealing a set of unassembled aluminum bleachers and selling them to a local metal shop were too tempting for a 34-year-old Saanich man. Last week, the man pleaded guilty in Victoria Provincial Court to stealing the Lakehill Little League bleachers from Ambassador Park in December of 2013 and January of 2014. The City of Victoria had donated the sections of surplus bleachers to Lakehill Little League in November of 2013 and the league organizers were awaiting the necessary parts to assemble them into a grandstand. In the meantime, the bleacher benches were stored in dugouts at Ambassador Park, next to Lake Hill elementary school. “The first 14 benches were actually crushed by the recycler, so we thought we lost the chance to build the bleachers, we thought it was over,” said Lakehill Little League president Ted Austin.

To purchase an aluminum grandstand of equal size would cost the league $16,000 to $18,000, Austin said. Luckily, a Victoria city employee, who had once played Lakehill baseball, recognized the benches at the metal recycler and tipped off police. Saanich Police was alerted that the suspect had provided an explanation regarding the origin of the aluminum, along with his identification. Speculating the thief would likely return for the rest of the benches, Saanich Const. Mark Pamminger covertly placed small, distinctive Block Watch decals on hidden areas of the benches where they would not be easily viewable. Two days later, the same man showed up at the business with another load of aluminum benches with newly affixed Block Watch decals in place and police were notified. “In the seven years since I became president, I’ve seen this league grow from 140 kids to an expected 350 kids this year,” Aus-

tin said. “This is all volunteer driven. We had two diamonds, and through a lot of hard volunteer work, we now have five diamonds, including a pair of backstops with $5,000 worth of fence posts that we recycled one weekend.” With the remainder of the benchers recovered, Lakehill was able to order the parts and fabricate additional planks to complete the grandstand. The man was arrested by Victoria Police and turned over to Saanich Police. He confessed to having stolen the property over the course of several nights, and he voluntarily turned over a large box of bleacher assembly hardware to police. Dennis Tyler Cox, 34, was sentenced in late January to one count of theft over $5,000. He received a suspended sentence of two years probation, with a number of conditions including the completion of 100 hours of community work and paying restitution of $1,540 to Lakehill Little League. reporter@saanichnews.com

Somewhere between a Shakespearean soliloquy and freestyle rap, spoken word is about being interactive and fun, says Missie Peters, Victoria Spoken Word Festival director. The fifth annual Victoria Spoken Word Festival runs until March 1. This year, 12 favourite poets from previous years are returning to form an allstar ensemble. “[The poets] take workshops every day on something that has nothing to do with spoken word, and then they do a show inspired by what they learned that night,” said Peters. On Feb. 24, the ensemble will have one hour to write and perform poems based on a secret prompt. This year’s theme will have something to do with brewing, Peters hinted. The audience will then judge which poem they liked best. Other events include a metaphors and monologues night on Feb. 25, and poems done in collaboration with dancers from Victoria’s Broken Rhythms on Feb. 26.

Specifics lacking in legislature launch The fanfare of the government’s throne speech on Tuesday produced the usual frantic energy at the B.C. legislature. But as the red carpet was rolled back on the steps leading into the grand building, the resulting media coverage was somewhat Predicting the muted. After all, wasn’t much future can come there to report. Perhaps the back to haunt. most interesting takeaway from the speech was the noticeable softening of the B.C. Liberals’ trumpeting of LNG as the saviour of the province. The speech noted how LNG “could” create 100,000 jobs and eliminate the province’s debt. Predicting the future can come back to haunt, it seems. On the other hand, the items left out of the throne speech are likely more worthy of discussion, as some of our local MLAs (and opposition party members) point out in our Page A7 story. It’s been a tough few years for residents across the province, but until the budget is tabled on Feb. 17, the public won’t have a clear idea about where an anticipated budget surplus will be spent. The surplus is commendable, but it’s come at the expense of painful spending cuts across various ministries. Let’s hope some of that cash is used to help the poorest in the province and for social services. The expiry of a tax hike on the province’s richest is a bit of a head-scratcher as well, as it equates to $230 million annually, according to the B.C. NDP. Perhaps the red carpet was rolled out for a non-event this week, where the only real promises were towards the status quo. And as most of us know: the status quo isn’t working too well when it comes to job creation and affordability in this province. What do you think? Public input reform pace is glacial Re: Council awaits public input report, News (Feb. 11) A motion was forwarded at a Saanich Council meeting on Feb. 2. Coun. Colin Plant asked that Saanich allow an open microphone where the public could address their concerns quickly. During the election we were promised by all, that change would occur. We learned that the earliest date that can allow for the change was March 23. It would have been pleasant if the Councillors had agreed to allow the public to have their say by the very next meeting. The audience left disappointed. I had hoped that an open microphone and interactive webcasting might allow us to remain informed from the comfort of our living room. Perhaps being a politician would be a great job if it wasn’t for the public. There are so many things that have to move forward quickly: Traffic congestion,

sewage treatment sites, universal by-laws, housing affordability and earthquake preparedness to name a few. At this rate, very little will be accomplished. The municipalities are setting themselves up to be swept away by amalgamation by not sharing all of their resources. The voters expect efficiency and the need to move forward. For now, we are spectators watching a race between the tortoise and the snail. It may take the prodding of the sharpened pencil of the B.C. Legislature to move Saanich and the entire Capital Region forward. Art Bickerton Saanich

Wolves cull does more harm than good My objection to the “wolf cull” has nothing to do with the “cuteness” of the wolves. Until the caribou habitat improves, by reducing roads, logging, habitation, the numbers of the caribou will continue to fall, wolves or no wolves. Not only do wolves insure the health of the herd, by removing sick and weak animals, but, being in a predator-prey relationship, the number if wolves rise and fall with the number of caribou, Therefore the “cull” is a cruel and worthless exercise. Local MLAs weigh in on B.C. throne speech

■ Through the throne speech, the government also hinted at new spending aimed at expanding the economy.

The B.C. government presented a cautious preview of the coming year with its speech from the throne Tuesday, announcing the formation of a rural advisory committee while lowering expectations for mining and natural gas exports. Read by Lieutenant Governor Judith Guichon to begin the spring legislature session, the speech stated the appointed rural advisory committee would “provide independent and impartial advice on helping rural B.C. increase opportunities, manage growth and meet its full potential in communities big and small.” The speech also made reference to a five-year action plan for the “agrifoods sector,” which has experienced $1 billion in growth in the past three years. An agrifood advisory committee will continue to work on a fish and seafood strategy as well. Agriculture critic and Saanich South MLA Lana Popham, who is leading an opposition standing committee on agriculture and food, said the government’s reliance on closed-door advisory committees does little to foster public input. “Agriculture is always a piecemeal project in B.C.,” Popham said. “There’s a committee here, some projects there, but it never relates to a longterm agricultural plan. … On the Saanich peninsula alone, the meat regulations haven’t been fixed since they were fiddled with in 2007. Farmers can’t process meat locally. We have the ability and interest to do more here, but that’s something I asked the minister to focus on a few years ago, and it hasn’t been done.” Premier Christy Clark said the government will soon start construction on the $8 billion Site C hydroelectric dam and revamp the education system to fill an anticipated skills gap. “We’re sticking to the plan, and we’ve been successful with that plan,” Clark told reporters. “I know it doesn’t make great headlines in the newspapers, but I don’t think we want to change so we can help you get a news story.” The government is also allowing a temporary tax hike on annual incomes of $150,000 or more to expire, resulting in $230 million less in annual tax revenue, said Rob Fleming, B.C. NDP MLA for Victoria-Swan Lake. “Tax cuts for the top two per cent of B.C. income earners does nothing to help middle class families pay their bills or build prosperity,” Fleming said. “I think what we’re seeing is Christy Clark has done nothing but campaign since 2011, and people are finally seeing this government has no focus.

Their ridiculous 2013 campaign slogan around LNG has come crashing down.” As the government continues to await investment decisions for liquefied natural gas facilities, the speech notes that LNG “could create 100,000 jobs and the revenues to eliminate our debt,” adding that exports are needed to maintain a gas industry that already employs 13,000 people. Much of the speech touted earlier achievements, including the carbon tax on fuels and a settlement with B.C. public school teachers after a bitter strike last year. Fleming, who is also opposition education critic, said the throne speech mentioned opening three new B.C. offshore schools but said nothing about education funding. “Nobody opposes off-shore schools, but to make that a government goal in the throne speech while we have the threat of school closures across B.C. is hard to hear,” Fleming said. “We’re likely going to see another flat funding scenario for the third straight year in education.” Oak Bay-Gordon Head MLA and B.C. Green Andrew Weaver said the government failed to address MSP premium reform, a poverty reduction plan or a housing first strategy in the throne speech. “Without fail, whenever an idea surfaces about how our government could address a pressing social or environmental issue, they trot out rhetoric about how the best way to address it is to grow our economy,” Weaver said in a blog post. “They continue to wait for it to start offering solutions to crises in funding for education, health care and social services.” The speech referred to five new mines opening since 2011, but avoided mention of northeast coal mines that have closed due to low commodity prices that also threaten the operation of metal mines in B.C. NDP leader John Horgan questioned Clark’s intention to keep cutting “red tape,” an obsession of the B.C. Liberals since 2001. “They cut red tape at Mount Polley,” Horgan said of gaps in inspection that predated the collapse of the mine’s tailings dam last summer. Montebello, Quebec – The 2015 Subaru XV Crosstrek, Forester and Outback have no problem showing the snow who is the boss. They don’t even break a sweat if you’re commuting on surfaces that yield minimal traction or when putting the Subaru Symmetrical AWD system through its paces on a winter off-road course. Let’s take a moment to talk about what make’s Subaru’s system so potent in the snow or on slippery surfaces. To start, Subaru designed its AWD system for perfect balance. The boxer engine, transmission, and differentials create a symmetrical layout left to right. This increases stability in every situation, as there is less weight transfer from side to side. Also, unlike the competitors, each vehicle is designed from the ground up to have a symmetrical AWD system as a standard feature. This makes the chassis and powertrain a harmonious match. Other competitors often start with a 2WD system and add AWD to the same chassis. It’s that kind of symmetry and engineering that instills confi-

dence in Subaru owners. More than 96 percent of Subaru vehicles sold in the last 10 years are still on the road today. The symmetry allows for predictable and stable power delivery to each wheel, which was apparent in my test drive. With the traction control (VDC) on, you might experience a little bit of slippage if you go into a corner too hot. But within moments, you’ll have your back end back where it should be. Yes, it’s a little bit of a killjoy if you’re honing your skills to qualify for a driver’s seat in WRC, but for 99.9 percent of the owners, it’s a saving grace. Subaru’s active systems do their best to keep the driver and its passengers feeling relaxed and calm behind the wheel. Such was the case as the temperatures in Quebec plummeted below -15C. The frigid yet abundantly sunny day seemed like a perfect pair for taking the aforementioned Subarus for a test. Starting the day with the XV Crosstrek, which has an MSRP of $24,995, was a treat. This light-on-its-feet crossover has charm and character. Even with the available CVT transmission, it’s pleasant to drive and has the ingredients to make it a desirable all-season kind of vehicle.

Anyone who has purchased a car has faced an overwhelming list of features on the window sticker. Over the years, there have been some imaginative features offered right from the dealership. Here are five of the more ‘interesting” examples.

It’s a wonder that more cars weren’t offered with swivelling seats, seeing as those troublesome stationary seats are always such a bother to get in and out of. While the swivel seat was designed for easy egress, an added benefit is that your vinyl won’t wear out nearly as quickly.

With a 3-1 win over the Kerry Park Islanders last Saturday night (Feb. 7), the Saanich Braves locked themselves into a third place finish in the South Division of the Vancouver Island Junior Hockey League and assured a first round playoff match-up with the second place Westshore Wolves. Fans can get a sneak-peek at this playoff series tonight at 6:30 p.m., as the Braves will host the Wolves in the final regular season game of the season for both teams at Pearkes Arena in Saanich. The Braves win over Kerry Park was their only win in three games played over the past week, including a tough, well-played 3-2 loss to the Campbell River Storm last Friday (Feb. 6) and a disappointing 3-1 loss to the Peninsula Panthers this past Monday (Feb. 9). However, it was the most important game of the bunch, as the two points they earned meant the Islanders could not catch them in the standings. Kerry Park, who also finish their regular season tonight with a game against Peninsula, will now face the first place Victoria Cougars in their first round match-up starting next week.

In the win over Kerry Park, it was Evan Horvath who played the hero, scoring the game winner at 14:51 of the third period to give the Braves a tight 2-1 win. Also strong for the Braves was goaltender Riley Mathieson, who continued his great run, earning his sixth win in his last six starts for the Braves. Dayne Ellison had the other marker for the Braves. The Braves could be a team to watch in the playoffs. Despite the loss to Peninsula on Monday, in their one-goal losses to the Storm last week and to the Victoria Cougars the week before, the Braves showed that they can play with the best of them if they put their mind to it and stick with the game plan. However, the Wolves will be a tough opponent, as heading into tonight's game, Westshore owns a 6-1 record against the Braves this season, including 6-0 and 6-2 victories in their last two meetings. Saanich’s only win came on Nov. 7 when they defeated the Wolves 8-2. They also lost two of the games in overtime and another by a single goal and it will be the type of intensity they showed in those games that they will need to bring if they hope to secure an upset and move on to the second round. In other VIJHL playoff matchups, the Peninsula Panthers, last place finishers in the South, will host the Oceanside Generals, last place finishers in the North, in a sudden death Wild Card game on Monday (Feb. 16)

As Oak Bay residents look toward spring and the peak real estate period, longtime local realtor Mike Boorman expects to see continued market stability in the municipality. While late winter typically “is a planning time of year,” Boorman and many realtors are busy meeting with homeowners who plan to list their homes in the spring, and are using this time to get their homes looking their best. This is the time to tidy the garden, undertake any small repairs or upgrades, paint and declutter, and review marketing plans for spring, he explains. That way, “when spring hits, we can hit the ground running.” When is the best time to list? “Personally, I recommend at the first sign of spring or just before Easter, provided a choice,” Boorman says, explaining that for families, a spring sale results in a summer closing in time to settle and be ready for school in September. “However, with the low inventory in Oak Bay at present, now is a great time to beat the rush.” At mid-January, there were 45 single-family listings in Oak Bay, 17 condominium listings and two townhouses, with three singlefamily sales recorded in the first two weeks of the year. Through the year, “we typically see about twice this number on the market and can expect to see over 100 Oak Bay homes in the peak of the spring season,” Boorman says. Coming off 2014, the Oak Bay market saw: • 256 sales of single-family homes; • an average sale price of $778,000;

Mike Boorman sees the Oak Bay market heading toward a good year of increased demand and low supply. • 63 sales over $1,000,000; • 11 sales under $600,000; • a highest sale of $4.6 million; • a lowest sale of $425,000; • the bulk of sales – 105 – in the $600,000 to $800,000 range. Boorman expects the local market to continue in a similar manner, given the stability of Oak Bay real estate. Homes in the municipality, known for its safety and the quality and consistency of its neighbourhoods and streetscapes,

provide a secure real estate investment, he explains. “When people drive through any area of Oak Bay, they see a consistency.” Residents appreciate the recreation opportunities, the calibre of schools, the shopping and the proximity to both the waterfront and downtown. “A really good day is when you can do everything and stay within the municipal borders. You can feel like you’ve done so much but

you’ve remained in the community, and potentially all on foot.” Who’s buying in Oak Bay? Early retirees from other cities and provinces are among the key demographics Boorman is seeing, plus existing homeowners relocating, either downsizing or up-sizing as their family grows. “The word on the street among my realtor colleagues is it appears to be heading toward a good year of increased demand and low supply,” Boorman says.
