Officials with the City of Kelowna say there is no back-up plan to find more money and purchase the CN Rail corridor, should the April 25 referendum in Lake Country fail. With less than two weeks to go before Lake Country residents cast ballots on whether to allow the district to borrow $2.6 million, completing the final part of a tentative $22-million deal with CN Rail, the lead negotiator with the inter-jurisdictional team says securing the corridor is increasingly sitting with residents of Lake Country. “It’s a very important piece of the puzzle and we’re hopeful the right decision is made,” said Doug Gilchrist, the City of Kelowna’s director of community planning and real estate. “There is no other funding plan. The plan is for Lake

Country to secure their portion of the money.” Gilchrist said if the referendum fails, the group would be $2.6 million short of the amount needed to purchase the trail. He added a provincial government financial commitment of $7.2 million is not dependent on the referendum passing, despite government wording in its announcement that said the money was contingent on a yes vote in Lake Country’s referendum. “We’ve had further communications with
the province,” said Gilchrist, noting they have said the money will be available even with a no vote, but they won’t be providing more funding for the purchase. “The provincial contribution is maxed. If there is a funding gap,” more money wouldn’t be coming from the province, according to Gilchrist. As more and more eyes are watching Lake Country, with the referendum approaching, two official campaigns are now pushing the noside while the yes campaign held the first of
two public open houses this week, hosting an information session on Monday night at George Elliot School as well as planning a rally at Beasley Park coming up on Sunday. Trust appears to be one of the main issues of the no campaigns as residents question whether they are being given the entire story by the District of Lake Country. “We don’t think costs will be kept as low as they are saying,” said SEE CORRIDOR A3
The District of Lake Country is going after a $1.2 million grant it would use to improve safety along several routes to Lake Country schools. The district is planning to improve safety at four key places around Lake Country in what is a potential $2.5-million project, depending on the grant application under the UBCM Federal Gas Tax Fund. “These are four distinct road projects we have been working on for some time,” said Greg Bucholz, Lake Country director of infrastructure services. “This grant application is really focused on safe routes to schools which…are vital to our community.” Among the projects are improvements to Sherman Road, valued at $450,000, where it leads up to Peter Greer school. Teachers at the school have voiced concern about safety issues for students either walking or riding to school on a busy route, according to Coun. Matt Vader.

More condos, less parking raises questions for Winterra KEVIN PARNELL Lake Country council has sent a developer back to the drawing board to find a solution to parking issues along Shoreline Drive before a half-completed condo project is able to continue. Known as Winterra at the Lakes, the project began in 2007 and was expected to feature two separate multi-family buildings, but the original developer only completed one of the two buildings before declaring bankruptcy. That left the completed 73-unit building sitting next to an undeveloped lot and minus promised amenities such as a swimming pool and hot tub. Now a new developer has stepped forward and taken over the project and is hoping to complete the second building, construct the pool and finish landscaping at the project. Due to some changes in the plans
however, the developer requested a variance from council for permission to move ahead with nine fewer parking spots than what is called for in Lake Country bylaws. “We are delighted that after all these years of looking out at an empty lot and living next to a dust bowl that construction (could) go ahead,” said Connie Baker, president of the strata council for the completed building. “But with the project comes some apprehension. We are concerned with a 50 per cent increase in the number of units in the second building and with parking.” With the new developer proposing an increase in units in the second building, council heard complaints about the resulting increase in traffic on Shoreline Road, a road council heard is packed with cars parked on both sides of the street already.

Staff have had some challenges to try and see the objectives that everyone wants put in place, put in place.” For now the second building at Winterra at the Lakes is on hold until the developer can figure out the parking issue and appear back at Lake Country council.

Long-time resident and former Lake Country Calendar owner Jack McCarthy says council has come up short when it comes to giving residents confidence purchasing the corridor is the right move. “I think the first vote (AAP) proved council has lost the confidence of the community,” said McCarthy, whose family was one of the original homesteaders in the Lake Country area. “I’d say they have lost the confidence of a significant number of people in the community, partly due to the fact we are a fairly young municipality and we are pretty-well financed up to our eyebrows.”
Meanwhile, Lake Country Mayor James Baker (see letter page A6) is defending council’s actions in the matter saying it’s been difficult because property negotiations are done in-camera and the main purchase discussions are done by the CN Rail acquisition team being led by Kelowna. Baker said if the community votes no to the rail corridor the municipality will miss out on a major opportunity to acquire land. “If we don’t look at this as an opportunity and say no to it, what (other) opportunities are we going to have?” he said. “People are coming to us saying we didn’t spend money to save the
golf course but very few municipal golf courses make any money. People are upset we aren’t spending money on a swimming pool but the taxes for that would be phenomenal. This (rail corridor) is an asset with potential to be a revenue generator and people are saying we don’t know what it will cost. We’re saying it will cost very little given the experience with other jurisdictions with rail trails going through their communities. That’s why we need a yes vote, to look at a visionary Lake Country.” The referendum is April 25. Check the district web site for information on advance polling stations.

Treaty cash cow may dry up T he B.C. Treaty Commission and its federal and provincial financiers put on a brave show last week, celebrating a “milestone” in negotiations for a modern treaty with five Vancouver Island First Nations. A regional group representing the Songhees, Beecher Bay, T’Souke, Malahat and Snaw-Naw-As (Nanoose) First Nations have reached the “agreement in principle” stage of negotiations with Canada and B.C., after 20 years of treaty talks. This is similar to the treaty finalized in 2007 with another five-member Vancouver Island group called MaaNulth First Nations. The Te’mexw Treaty Association agreed to accept 1,565 hectares of provincial Crown land and $142 million in federal cash to settle its historic aboriginal title. Alas, agreement in principle is but the fourth of sixth stages.

Tom Fletcher Now a platoon of lawyers takes over from the roomful of negotiators to produce the final legal text. It will be years before this treaty can be presented to the B.C. legislature and the House of Commons in Ottawa, if it ever is. These elaborate ceremonies will never be viewed the same again after the release of federal treaty advisor Doug Eyford’s report last month. The Te’mexw event seemed to have an extra urgency after Eyford’s observation that much of this costly activity has become a job cre-
ation program for those involved. These Vancouver Island communities deserve credit for setting aside their own territorial disputes. It’s more than most have done. Eyford concluded after a long summer of meetings last year that many treaty negotiation teams in this province and across the country show no such inclination. In B.C. and elsewhere in Canada, there is a “conspicuous lack of urgency in negotiations” and “sharp divisions” between parties, most of which have been at the table for a decade or more, Eyford found. This is what has come to be known as the “aboriginal industry,” where lawyers and consultants have a seemingly endless supply of lucrative work, much of it of questionable value. For some aboriginal participants, attending treaty meetings year after year is the best paying job they have ever had.
Indeed, a common feature of the province’s dealings with aboriginal communities is that their leaders demand meetings, and then demand to be paid to attend them. This latest Vancouver Island treaty, assuming it is ever finalized, would at least in part replace the Douglas Treaties, signed by B.C.’s colonial governor James Douglas in the 1850s. These treaties around Fort Victoria were quickly concluded if nothing else. The Beecher Bay Band was paid 45 pounds, 10 shillings for most of Sooke and another 43 pounds and change for its Metchosin territory. One of the biggest missing pieces in the latest agreement in principle is the share of federally-regulated fisheries. This has been a theme of B.C. Treaty Commission reports in recent years, as Ottawa holds up treaties for years because it is unable or unwilling to offer
shares of salmon in particular. Hunting and fishing rights are acknowledged even in historic treaties, and reaffirmed by the Charter of Rights and Freedoms. Sharing these rights while maintaining conservation of fish stocks has been more than Ottawa, and in some cases neighbouring aboriginal communities, have been able to manage. Eyford’s findings, and the B.C. government’s sudden refusal to keep staffing a B.C. Treaty Commission that shows so little progress, have sent one overdue message. If participants aren’t prepared to make real compromises and show a willingness to conclude agreements rather than drag them out, they should leave and come back when they are ready to do so. Some know it without a doubt, others refuse communal thinking TAYLOR FROM A4 don’t think that’s necessarily true. When philosopher Rene Descartes coined his famous aphorism: “I think, therefore I am,” he gave us both a truth and a truism. The truth is that thinking makes us aware of ourselves. Sapiens author Yuval Noah Harari argues that no other species is capable of thinking about itself. Certainly, dogs can reason. Even worms can react. But nothing suggests that a dog, a worm, or a magpie, can anticipate its own life expectancy. Or can think of itself as an abstract entity—from outside itself, as it were. But as a truism, Descartes’ famous statement actually proves nothing.

A consumer might argue equally validly, “I buy, therefore I am.” Or, turning the equation around, “I am, therefore I buy.” It’s a circular argument—a pre-smartphone “selfie”. Does a selfie prove that I exist? Is that why tourists take pictures of themselves blocking the view of Niagara Falls, the Statue of Liberty, the Eiffel Tower? We humans seem able
to reflect on, even analyze, what’s going on inside our heads. The late Val Anderson once challenged an executive meeting: “We’re doing a lot of thinking here. And we’re thinking about how we’re doing that thinking. But are we thinking about how we’re thinking about our thinking?” Another philosopher, Ken Wilber, argues that we all have a desire for
transcendence. We want to belong to something bigger than ourselves. It’s a universal pattern, he says. Atoms bind together into molecules, molecules into proteins, proteins into cells, cells into living bodies.
And bodies want to belong to groups. But must a universal principle apply only to physical objects? Why not also to thoughts? Can my thoughts be part of a larger thought? Some people vigor-
ously resist that concept. They like to see themselves as ruggedly independent. They don’t like to have their thinking indebted in any way to a larger entity—a congregation, a political party, a corporation, a so-

To the editor: Numerous letters have been published both for and against the decision of the District of Lake Country council to seek elector assent to borrow to purchase 50 per cent of the 16 km of the CN Rail corridor that is in our jurisdiction. Council’s decision is unanimous, fiscally responsible, socially responsible and environmentally responsible. We see the purchase of this corridor as an investment and a long term benefit for Lake Country. We recognize that there are a number of constituents who have some concerns about our priorities and would rather not invest in our future at this time. Others have concerns that future costs for development and maintenance of the corridor are not being disclosed by the mayor and council. We made what we consider a prudent business decision based on our knowledge and ex-

Rails to trails initiatives are a worldwide trend that many progressive communities have benefitted from greatly and we want Lake Country to be one of those communities. The tax increase of $27 for the average Lake Country residence is based on a general tax requisition of $0.057 per thousand dollars of assessment, $0.14 per thousand for commercial properties, which will make the annual payment for 20 years on the loan of $2.6 million for which we seek assent. We have a memorandum of understanding with the City of Kelowna which allows for a three-year, interest-free opportunity to buy their 50 per cent interest of the corridor in Lake Country for $2.5 million. Our assessment base will have increased in three years with the growth we see occurring now in our community and there is certainly potential for more business to locate here because of
new business opportunities generated by ownership of the rail corridor. In three years we will be in a better position to determine if we wish to exercise our option to purchase Kelowna’s 50 per cent investment in Lake Country’s corridor. We will continue our current level of taxes for our current level of services so there is no change in council priorities. Most of our long term debt is for water and sewer improvement which is paid for from the user fees for those services. With long term plans in place for all infrastructure upgrades we are well positioned to apply for provincial and federal grants as programs become available. We have an excellent working relationship with our MLA Norm Letnick and our MP Ron Cannan who have always provided strong support for our grant applications and we have every expectation that they will continue to do so. The rail corridor will become a public asset that can benefit not just Lake Country but will
be an asset for the entire valley. Mayor and council will not be the sole planners for the corridor; we do not have any hidden agendas or any agenda other than to acquire this valuable, wonderful, mostly lakeshore corridor. The entire community will be involved in the subsequent planning when the purchase is made. There will have to be considerable community consultation to identify lands that may be surplus to park and trail functions. Development of a trail in the corridor can be funded by non-government development grants and willing volunteers as has been done in many other jurisdictions. The long term operations and maintenance may be conducted as an interregional service or with a memorandum of understanding among the different jurisdictions. Maintenance would not be done solely by Lake Country. CN bought the corridor lands, it did not have the same type of grants that CP had from the federal government.
The Okanagan Indian Band has a long standing specific claim with the provincial and federal governments over the Commonage lands that were opened for non-Native settlement in 1893. Current federal and provincial land claim settlement policy is for no impact to third-party private property, which includes the CN rail corridor. CN is responsible for the track and tie removal and remediation to all lands to meet current environmental standards. We will continue with due diligence to ensure safe use of this magnificent current and enduring asset for our community. Acknowledging both the concerns and support expressed by some, we hope the majority of the residents of Lake Country see the value of acquiring and protecting the corridor for use as a public right of way that will benefit our community for generations.

Visionaries see the bigger picture

hile we welcome the skepticism Lake Country residents may register about how their tax dollars are spent, focusing that apparent lack of trust right now on the CN Rail corridor project is short-sighted.

The proposed Okanagan Rail Trail project, a one-time long-term visionary opportunity, has the fiscal participation support of the Central Okanagan region and deserves to proceed. There are many questions filling the letters to the editor, social media and on the airwaves raising questions about this project, most harping on the unanswerable cynical questions of the moment: Who will pay to uproot the existing rails? Who will pay for maintenance? Who will pay for washrooms? While the ‘how much’ aspect to get the trail operational for local recreation users and tourists is admittedly an unknown entity, the “who” aspect of how it gets paid for isn’t hard to figure out. It lies significantly in the creation of the Okanagan Rail Trail Initiative, a group of volunteers committed to engaging the community in fiscal and volunteer terms, to help raise $5 million and leverage that money to raise a further $5 million in various available government grants towards the trail project. Lake County residents need to think about the Greenway project in Kelowna and the Kettle Valley Railway restoration as visionary ideas that certainly raised financial questions and concerns at their outsets, but they succeeded because people rallied behind those projects, not because municipal governments, or federal or provincial governments for that matter, were endlessly cutting cheques

Referendum inflames discord Every park benefits Lake Country To the editor: I have never been one to voice my opinion about matters concerning my community publicly. However, I feel compelled to do so with regards to the upcoming rail trail referendum in Lake Country. Let me state upfront that I believe the acquisition of land for the rail trail is a good thing and am really excited about the possibility. Yet, as a result of this issue, I find the polarization of our commun-
ity quite troubling. Referendums tend to simplify issues and force people to either side with the Yes team or the No team. Having picked a side, we then focus solely on our point of view. At best, we do not listen to each other. At worst, we attack and direct accusations at the other. The lasting legacy is animosity and distrust towards one another. In Lake Country, we have people who see the unique opportunity that this rail trail will
bring to our community. They have worked tirelessly to try to make it a reality and in their enthusiasm, they are plowing full steam ahead even though many of the details are not known. Also in Lake Country, we have people who see the details and the ongoing financial demands of a growing community. They too are concerned about leaving a healthy, sustainable community for the generations to come. Both groups should be
valued and supported. We need the visionaries to seize the possibilities and the realists to take those ideas and help make them viable. Together we can create a community which is amazing to live in, fiscally responsible and harmonious. Nevertheless, whatever the outcome of the referendum, I hope we can respect each other’s choices and continue to build on what we have. Anne Ing, Lake Country

To the editor: We have one of those rare opportunities for direct democracy in our local government with the upcoming referendum on the rail trail—so get out and vote. I am so thankful for the people who helped spearhead the purchase of Beasley Park. Their initiative eventually led to community groups building a field house, soccer fields, gazebo, playground and picnic area. The same can be said for all our parks and recreation facilities. For many years, our local community group Walk Around Lake Country has been building trails on small road rights-of-way and public land. These trails are being used every day by our residents. Thankfully WALC did not get bogged down on studies and cost estimates—they had vision, enthusiasm and energy to get the job done one piece at a time. Have faith that community groups, business and government will come to
the table to help develop the rail trail. I spent 35 years in local government and I can tell you that every parcel of land ever purchased for Parks and Recreation benefited the community. The purchase of land is the first step. I can also tell you that I never thought I would see the day when the railway would become available to us—and what a bargain for so much lakefront, never mind the opportunities that will arise in the future. Our roads, water and sewer services will get improved over time whether we purchase the railway or not. I do appreciate the people who voted no on the petition—it has helped us to get better information and now more funding partners. Ignore bleatings of Flat Earth Society To the editor: When I hear arguments against the Lake Country rail trail from residents, I must respond to their negativity. Infrastructure projects are line items in every municipal budget. To think infrastructure would not happen be-

The reality is that never have there been better options out there to restore almost anyone's teeth than right now. That partial denture can be replaced by either a fixed bridge restoration that acts and looks like the teeth it replaced – and if he wants a truly first class result dental implants may be in store for him. One of the biggest factors that prevent adults from finally seeking dental help is fear of the unknown. Dentalphobia is the term for the 30% of the population who would rather pay more income tax than visit a dentist. This is a deep seated fear that usually is rooted in unpleasant dental experiences with an 'old school' practitioner who may have retired decades ago!

My eyes have started to feel irritated this past month – it must just be allergies right?
That’s a good question, and you may very well be right. However, it does require a little bit of investigation. Allergies and dry eye syndrome are the two most common causes for seasonal discomfort and to distinguish between the two takes some further probing and often times an in-office evaluation. You might understandably think that it doesn’t really matter, but the most effective treatment for these conditions actually varies quite considerably. While the hallmark differential is that allergies typically create “itchy” eyes and dry eyes create “gritty” eyes, the true differential actually comes from evaluation of your eye under a high-powered microscope (that annoying bright light we shine in your eyes). Dry eyes typically present with a reduced tear height and areas of focal corneal damage, while allergic conditions typically have a standard tear height and subtle swelling underneath the eyelids. By opening an RESP account, not only is the child entitled to $1,200 from the Province of British Columbia, they can also access similar education savings grants from the Government of Canada. Big finale for Lake Country open mic contestants Well into its fourth year, the annual Lake Country Open Mic Has Talent contest will hear from its top five finalists tonight (April 15) as the contest selects its winner at the Creekside Theatre in Winfield. Construction is moving along near the Winfield Seniors Centre where a new home for the Lake Country Food Bank is progressing quickly. Okanagan College trades students are working on the construction phase of the building as the foundation has now been laid at the site. Inspire Health: Beyond medical care

Patients battling cancer in the Central Okanagan can now access follow-up care for free as a non-profit group known as Inspire Health will now provide its services free of charge for the first time in its 18 year history. The organization, with offices in Kelowna, Vancouver and Victoria, as well as online, began a year-long trial to do away with a previous annual fee and offer services from health care providers for free for patients who are diagnosed with cancer. “We support patients and their families and encourage them to take an active part in their care,” said Terry Heidt, clinical director at Inspire Health, in the Towne Centre Mall. “We have a team of family physicians, a nutritionist, excercise therapist, counsellors and other staff to provide an
individualized health and wellness approach to people living with cancer.” Previoulsy Inspire Health charged people a $450 annual fee but thanks to funding through the Ministry fo Health, private donations, and grants, the organization has been able to drop the annual fee and help cancer patients deal with their diagnosis and put a plan in place to help them. “A diagnosis of cancer can be very shattering for somebody but it can also offer the opportunity for re-evaluation, a better look at their life and what things are really important in terms of wellness and lifestyle factors,” said Heidt. “Our emphasis is on lifestyle factors such as nutrition, exercise, emotioanl and spiritual well-being and also education. Lifestyle and wellness do have a profound influence on patients. We have seen this
with heart disease for the past 30 years but for reason it has lagged behind with cancer.” However Heidt says now being able to provide the services for free should have a major impact on cancer patients and their willingness to access health and well-being servies in the wake of a cancer diagnosis or even years after the disease may be in remission. Inspire Health opened in Kelowna in September of 2012. “We were quite busy when we opened our doors but the membership fee was a huge barrier for a lot of patients,” said Heidt. There are a lot of things that make finances really challenging...if they are not able to work or if they have loans. Now that we have been able to remove the final barrier it’s becoming quite busy. there is a huge need for this kind of care in B.C.” SEE HEALTH A12

Obituaries JANZ, MARIE
Went to be with the Lord and passed away suddenly of a brain aneurysm on Friday, April 3, 2015. Marie is survived by her loving husband of 68 years, James L. Janz; two children Grant (Bonnie) Janz of Lake Country, BC, Glenda (Bryan) Jackson of Kelowna, BC; grandchildren: Jeff (Jade) Janz of Vancouver, BC, Dayton Janz of Lake Country, Jillian Jackson of Kelowna, BC, Michael Jackson (Lori Ann) of Lake Country, Cory Jackson (Kristi) of Kelowna, BC; great grandchildren: Will Bailey, Jaden and Logan. Marie has one surviving sibling, her sister Jean Prokopetz of Larkin Crossing, Armstrong, BC, who celebrated her 100th Birthday with Marie last October. Marie was born in Watson, SK and at an early age, her family moved to Armstrong, BC. She travelled to Souris, Manitoba for work, where she met the love of her life, James Janz. They were married and moved to Kelowna. In 1951 they bought an orchard in Oyama where they raised their family and farmed an orchard for 45 years. Upon retirement, they moved to Glen Meadows in Kelowna and have resided there since. Jim and Marie travelled the world together and enjoyed great pleasure in wintering in Yuma, Arizona. This year they ventured to Yuma once more where they shared much friendship and laughs along the way. A wonderful memory for all. A Funeral Mass and celebration of Marie’s life was held on Saturday, April 11th at 10:30 am at St. Pius X, 1077 Fuller Avenue, Kelowna, BC. She is survived by her husband Ted, her daughters Carolyn (Tim), and Louise (Richard); her grandchildren Leah (Kellen), Travis, Jesse, Brantley (Darcie), and Alex; and her great-grandson Xander. She was predeceased by her granddaughter Abby in 2006.

Carol was a school teacher, and began her teaching career in Ontario in the late 1950’s. She and her husband Ted moved to the Okanagan in 1964 and she taught for the Central Okanagan School District until her retirement in 1998. She loved to quilt, knit, play the piano, and cook. Carol will be remembered for her loving and generous heart, and her love for her family. She will be sadly missed.
