Judge asked to rule mandatory sentence unconstitutional BY KARL YU THE NEWS BULLETIN

A B.C. Supreme Court judge will decide if a mandatory sentence for a Nanaimo man convicted in a July 2012 shooting is constitutional. Jeffrey Ryan Oud, 38, was charged with mischief endangering life and unlawfully discharging a firearm at a house in downtown Nanaimo. Bert King, Oud’s legal counsel, said his client faces a mandatory

sentence of four years. Crown counsel is seeking five to seven years imprisonment and King is seeking a prison term of approximately two years. At the time of the incident, Oud was a severe drug addict and went to the house to buy drugs. He was ripped off of his money and bluntly told to leave or he would be beaten. Thereafter, on all of the evidence, Oud fired a gun at the house, King said.

The bullet grazed the cheek of a person in the house but there were no other injuries, according to King. He said his client is asking Judge Robin Baird to consider declaring the related section of the Criminal Code unconstitutional as it is harsh in this case, contrary to Section 12 of the Charter of Rights and Freedoms, which states no one shall be subjected to cruel and unusual punishment. Two of Lantzville’s highest vote getters have resigned from political office. Councillors Rod Negrave and Jennifer Millbank handed in resignation letters Monday that will see them step down immediately, leaving the community short two representatives just five months after the civic election. The announcements bring the tally of resignations to four in the district this month, following chief administrative officer Twyla Graff and director of financial services Jedha Holmes. The two politicians called their decisions difficult and in their resignation letters pointed to issues concerning the new council as reasons behind their departure. Negrave said established procedures and rules are being ignored, resulting in lack of fair dealing and that council is micromanaging district affairs when it should be focusing on strategic and policy matters. He also is “truly disturbed at the undermining of democracy” that he has seen in Lantzville. “Taken with the scenes of angry red-faced men shouting unrestrained abuse at staff and others that we have witnessed at recent council meetings and one is reminded of how democracy formerly fell in cultured nations

such as Italy and Germany,” he wrote. Negrave told the News Bulletin he doesn’t feel he can properly represent the interests of residents and deal with the issues facing the community in the current environment at council and couldn’t in good conscience remain there. Millbank, a second-term councillor, did not provide further comment, but in her letter stated that she was honoured to be part of the previous council and appreciated the opportunity to be the chairwoman of the Village Core Committee. “Unfortunately it has become apparent to me that this new council has been unable to move forward on issues in a productive fashion that respects the role of council and the democratic process. I do not see that the situation will improve,” she said. “The underlying issues are sufficiently concerning to me that this is a council that I feel I can no longer be a part of.” Mayor Colin Haime called the resignations disappointing. He said each council member has a vote and the departing councilors had the same abilities as anybody else. “I do believe they didn’t give it a fair shake and going back to some of the comments right at the beginning of the term, I don’t believe they had any intention of doing so,” he said. Haime considers statements made in Negrave’s letter as unsubstantiated. It is unknown when a byelection will be held. news@nanaimobulletin.com

While the Nanaimo school district no longer has the highest high school class size in the province, the teachers’ union leader says that there are still issues. The school district is tied for 10th spot among the province’s 60 school districts with an average size of about 24 students and is above the provincial average of 23, according to numbers in the Overview of Class Size and Composition in B.C. Public Schools report for 2014-15, a provincial government document. Students aren’t receiving proper instruction, according to Mike Ball, president of the Nanaimo District Teachers’ Association.

“The effect on the classroom, class size isn’t the only issue, but when class compositions are as complex as they are now, the larger class sizes compound the issues and make it more and more complicated for teachers to be able to succeed with every student,” said Ball. The district is facing a $4-million budget deficit for 2015-16 and Ball said class size is tied to a decision by a former B.C. Liberal government – when Premier Christy Clark was education minister – to strip class size and composition language from the collective agreement in 2002. Ball said if the school district was still being funded at 2002 contract numbers, there would be an estimated $7 million more in the budget. The school district is also at or above provincial averages for kindergarten, Grades 1-3 and 4-7 with class sizes totalling more than 19, 21 and approximately 26, respectively. reporter@nanaimobulletin.com

Council approves spending on dams City council will spend up to $400,000 to help decide a remediation route for the Colliery dams. At an open meeting Monday, council opted to spend up to $400,000 for work leading up to a remediation decision and to hire engineering consultants to prepare designs, costs and timelines that that will help compare three possible solutions. They also agreed to ask for a 30-day extension to deadlines laid out in an order by the B.C. comptroller of water rights so they can explore an option of dam-hardening and beautification – a proposed third solution which isn’t considered to be as well-developed as options of an $8.1-million labyrinth spillway

solution or $3-million to $6-million auxiliary spillway already on the table. Deadline extensions will give council another month to decide on remediation, although a staff report warns the new timeline will make it “extremely difficult or impossible” to complete remediation in 2015. Engineering work will focus on the third option, but there will also be an effort to get good comparisons on cost and invasiveness for all choices for council to review, according to Toby Seward, the city’s acting general manager of social and protective services. To date the city has spent $2.35 million on the dams.

A ceremony commemorating 70 years since the end of the Battle of the Atlantic will be held in lantzville this weekend. Military veterans from Royal Canadian legion branches in Nanaimo, lantzville, Qualicum Beach and Parksville will gather at the lantzville Cenotaph sunday (May 3) to commemorate the end of the battle that lasted from 1939-45 and the lives, ships and aircraft lost in the conflict waged in the Atlantic Ocean to ferry personnel and materials to supply the war in europe. Observances will include two minutes of silence, hymns, prayer, a roll call of the ships, motor torpedo boats and aircraft lost at sea, laying of wreaths and an honour flypast by aircraft from CFB Comox. Lesley Ruzicka and Basil McCormick, Crown counsellors, said they couldn’t comment as the case is still before the court. The date for Baird to hand down his judgment is June 9.

Bikes win commuter challenge

A commuter challenge pitted cyclists and drivers against one another to see if cars or bikes were faster getting from Bowen Park to Terminal Park mall and back. The race kicked off events leading up to Bike to Work Week from May 25-31. Bikes beat the cars with Dee Montie, Nanaimo Mountain Bike Club board director, first back to Bowen Park. With three weeks until Bike to Work Week, people pondering pedalling have time to dust off bikes, pump tires and get in practice riding to workplaces. This year Bike to Work Week includes Bike and Walk to School Week. Students and teachers from Pauline Haarer Elementary School and Woodlands

Secondary School joined the commuter challenge for lunch and to compete in relay bike races. Deborah Beck, city recreation and Bike to Work Week coordinator, tallied eight elementary and two secondary schools that have registered for Bike and Walk to School Week. Michelle Stilwell, ParksvilleQualicum MLA, and Doug Routley, MLA for NanaimoNorth Cowichan, promoted cycling at the commuter challenge. “It’s important, I think, for all of us to maintain our fitness, but also our outlook on life and to appreciate the environment that we all enjoy,” said Routley. Stilwell, a Paralympic multiple gold medallist in wheelchair racing, said biking is something her family can do together. “Another passion of mine is riding my bike and to be outside and have an activity I can do with my family – something T:5” I can do with my son and my husband and

an activity that we can do together,” said Stilwell. To boost registration, Arrowsmith Bikes and Oak Bay Bikes have each donated a bike be drawn as grand prizes at the Bike to Work Week wrap-up party on May 29. Cycling promotional events will happen throughout May, including the Heritage Bike Ride on May 24. The Rhodo Ride on May 30 meanders through Naniamo’s parks and neighbourhoods to view rhododendrons in bloom. John Barsby Secondary School students had an opportunity to prepare for their futures at the Living Professional Library last week. The networking and information event saw students talking with professionals in fields of interest. For Grade 10 students Delaney Bandell and Rachel Price, their legal profession inquiries were answered by Greg Phillips, a lawyer with Johnston Franklin Bishop law firm. Both students’ interest in being called to the bar stems from television shows, such as The Closer and CSI. Their conversation with Phillips

was informative and he didn’t sugar-coat anything, they said. “Law school’s very intimidating,” said Bandell. “Everybody thinks with eight years of schooling and the price, it’s office work and paper work, but he just explained how it’s really simple and you just take it year-by-year. If you’re interested, then it’s not really a job or schooling.” Price said discussion about finances was realistic. “You’re not going to be a millionaire in two days,” she said. Phillips attended the event at the behest of trustee Bill Robinson and said students needn’t fret if they don’t know what career path they will take. He completed a significant portion of a heavy-duty mechanic apprenticeship and said it took a long time for him to figure out his calling. “You don’t always know what you’re going to be ... You can always change your mind.

Resignations aren’t helpful

Lantzville’s ex-councillors aren’t really taking a stand – what they’re doing is standing up and walking away. The District of Lantzville’s municipal hall fell into further turmoil this week as two councillors, Jennifer Millbank and Rod Negrave, resigned from their elected positions. Neither was willing to crystallize reasons for quitting. Their letters of resignation list their grievances, but vaguely; Negrave didn’t elaborate much to the media; Millbank, not at all. It can be assumed that the resignations come from frustration with the district’s governance and Mayor Colin Haime’s leadership. Certainly two councillors quitting, in concert, draws attention to the district’s obvious dysfunction, but unfortunately, that’s about all it accomplishes. It could possibly compel the mayor and remaining councillors and staff toward co-operation and compromise, but it could also have the opposite effect – the loss of two dissenting views might only further centralize power on the other side of the table. The ex-councillors no longer have the same ability to bring their voices and their views to council chambers. Opposition views do have value in a democracy, however the vote goes. Just because the ex-councillors didn’t like the workings of council doesn’t mean they were helpless and that the situation was hopeless. They, if anyone, had the power, as elected officials, to hold their peers accountable and speak up for what they felt was right. Instead of carrying on an important conversation, in a way, they’ve ended the conversation. Taxpayers in Lantzville will be left to foot the bill for byelections and might not be any better off in the end. But it will be up to those taxpayers to have their say, and it’s important that the people speak up, because there are two fewer councillors, now, to speak for the people.

Experts like anti-terrorism bill Councillors lazy To the Editor,

Re: Bill C-51 intrudes on Canadians’ rights, Letters, April 23. Anti-terrorism Bill C-51 protects Canada against real threats. This month the director of the Canadian Security Intelligence Service Michael Coulombe testified that currently, “the terrorist threat to Canada’s national security interests has never been as direct or immediate.” The first chairman of Canada’s Security Intelligence Review Committee in 1984 was Ron Atkey. He remains a distinguished

retired Parliamentarian who teaches national security law. His opinion of Bill C-51 is that, “accountability for the dangerous but important new powers for the Canadian Security Intelligence Service has been enhanced.” Bill C-51 includes more judges’ control, stronger security monitoring, and consultation with Parliamentary opposition parties. Allegations that Bill C-51 creates a ‘secret police’ state are demonstrably false.

Re: Forest’s future uncertain, March 17. I am upset that The Land Conservancy is selling Merv Wilkinson’s Wildwood Ecoforest. To sell Wildwood to a private party would be a terrible precedent for a property that was bought and paid for with public donations. Hundreds of people helped to raise over $1 million with the understanding that the conservancy would hold Wildwood in trust to protect this legacy forever. Wildwood should never be sold to a private party, not even in part.

Childhood memories remain strong for author

Respected poet remembered I I PETER CULLEY died on April 10.

Warm, generous, kind and intelligent are just some of the words that describe longtime Nanaimo resident and artist Peter Culley. “He was very funny,” said his wife of more than 20 years, Daphne Culley. “He was a gentle guy.” Earlier this month, Peter Culley, 57, died from a heart attack at his home in South Wellington. “I was amazed the day after he died, when people on Facebook started putting up tributes,” Daphne Culley said. On Friday (May 1) the Cascadia Poetry Festival will pay tribute to Culley, who was scheduled to speak at the event, with a short ceremony at 7:30 p.m. “So many people at the festival were close to Peter,” longtime friend, poet and festival organizer, Kim Goldberg said. Culley was born in Sudbury, Ont., in 1953 and moved to Nanaimo in early 1970s. He became known for his Hammertown book series as well as his photography. Culley met his wife Daphne more than 30 years ago a book

store in Nanaimo. “As I recall I invited him over for dinner and he never left,” she said. “We were together from that time.” In his earlier years, Peter Culley heavily involved with the Kootenay School of Writing in Vancouver. Goldberg, who met Culley when he was a young adult in the late 1970s, says he was a great guy. “He was very funny and very smart,” she recalled. “We would get into these intense intellectual debates about Latin American authors and surrealism and post-modernism.” While Culley was connected with the Nanaimo poetry scene, he was also involved in poetry circles throughout North America, often trav-

elling to the United States for readings. “At a larger level Peter was very connected to, involved in and important to the literary scene,” Goldberg said. Shortly after his death, Adrian Dix, MLA for VancouverKingsway, paid tribute to Culley in a speach to the provincial legislature. “Culley’s work evoked the lives of working people and communities, both full of heart and social and political context,” Dix said in a statement. “He was an innovator in form and unafraid to challenge conventional norms.” Most of Culley’s photography, which was exhibited at the Nanaimo Art Gallery last year, was taken on his walks through South Wellington and

Nanaimo. His photos would often include the family dog, Shasta. “He would often just set up the camera and wait for her [Shasta] to walk into the frame,” Daphne Culley said. At home, Peter Culley was a funny guy, who loved to read books, including the dictionary, watch movies and cook. “He was such a good cook,” Daphne Culley said. “I think I miss that more than anything. PETER KISTLER Surrounded by his Swiss and Canadian family, Peter slipped away peacefully on April 20 after a brief illness. Born in Aarau, Switzerland in 1943, Peter loved skiing, hiking, travelling and spending time with good friends and family. When he was 18, he spent a year in Portland, Oregon as an exchange student, where he developed a love for the West Coast. After a long career as a Swissair pilot, Peter retired and fulfilled his boyhood dream of touring the United States. He travelled for 14 months with his wife, Cindy, in a fifth wheel which they named “Roadrunner�. (They called the truck “Coyote.�) In 2000, they settled down in Cindy’s home town of Nanaimo where Peter became active in Harbour Watch, Power Squadron, Retired Airline Pilots of Canada, Probus and helping out people in various ways. In recent years he enjoyed captaining his boat, April Lady, in local waters. He especially enjoyed taking friends for outings. Peter was known as being kind, gracious, and genuinely interested in others. He always had a twinkle in his eye. He is survived by his wife, Cindy, and their blended family—Peter’s children: Lukas, Myriam and Beatrice; Cindy’s children: Tonya, Andrea and Greg; and their grandchildren Chenoa, Araya, Chaka and Leyla. Peter’s favourite travelling song was “On the Road Again.� We wish you happy travels, Peter. A celebration of Peter’s life will be held at the Cottonwood Golf Course on May 3, at 2:30 p.m. Flowers are gratefully declined. ean Evelyn - 87, passed away on April 14, 2015 at home in Nanaimo, BC. Born, August 31, 1927 in Plymouth, MA, she was the daughter of the late William (Bill) and Pearl (Priest) Thibodeau and was the last surviving member of her immediate family. Jean spent many years working in the Weymouth area of Steadman’s and Amirault’s Riteway before moving to Ontario and then to the west coast, where she spent her retirement years. Jean was fearless, had a great sense of humour and a wonderful, giving spirit. She met many challenges along the way, including learning to ski in her 50’s. Being an avid golfer well into her 60’s and 70’s, she was on the fairways every day. She was even brave enough to take a solo return trip across Canada from B.C. to Nova Scotia in her late 60’s. Jean is survived by her son, Bernard Lewis ( Joy), Nanaimo BC, stepson Danny Ozerkevich (Margaret), Thunder Bay ON, daughters-in-law Sandy Lewis (Allen), Oshawa ON and Joy Lewis ( Jerry), Sarnia ON, and Travis, Troy, Kory, Kolby and Kayeigh Ozerkevich, all of Thunder Bay ON plus 1 great-grandchild Andrew, along with many nieces and nephews. She was predeceased by her sisters, Marion (Kinney), Vivian (Cohoon-Lake) and Kathleen in infancy along with sons, Allen Lewis (Sandy) and Jerry Lewis (Joy) plus foster brother Vernon Thibodeau, her first husband, Fred Lewis and second husband Ed Ozerkevich. There will be a graveside burial planned for a later date at the Riverside Baptist Cemetery in Weymouth North.

Qualls Sandra (Sandy) Jean (nee Krall) It is with profound sorrow that we announce the passing of a beloved mother and sister/sister-in-law, and aunt, Sandra (Sandy) Jean Qualls (nee Krall) on April 27, 2015. Sandy passed away peacefully in Dufferin Place in Nanaimo. She had a number of illnesses over the last 10 years but fought them valiantly. Sandra was born September 04, 1941 in Nanaimo B.C. Sandy was recently predeceased by her older brother Jim Krall in December and leaves behind her loving son Stephen (Steve) and partner Holly in Surrey, B.C., her younger brother Randall (Randy) Krall and caring sister-in-law Janaya and two nieces, Diana Krall, and Michelle Wigmore. Sandy started working at B.C. Telephone Co. at the age of 16 and also worked for Bell Telephone in Bremerton Washington when married to Donald Qualls. Sandy and Don eventually moved to Victoria for a small period where they worked for B.C. Tel. They eventually transferred back to Nanaimo where Sandy remained and worked for Telus for a short period of time. Sandy retired to Protection Island and took part in many crib tournaments held by her relatives on the “North End� of the island. Fifteen years ago Sandy moved back to town and settled in a condominium in South Nanaimo. There she would sit out on her deck every day looking out over “The Gap� between Protection Island and Newcastle Island. Sandy was also a great dart player winning many awards. Sandy was extremely fond of dogs, in particular “Desi�. She was very sociable, liked by everybody and had a great sense of humour. Lacrosse fans can get their first look of the new-look junior A Nanaimo Timbermen. The city’s B.C. Junior A Lacrosse League team holds its home opener Saturday (May 2) against the Delta Islanders. The T-men, led by a new coaching staff and an influx of rookies, were doubled up 10-5 in the season opener last weekend against the defending-champion Coquitlam Adanacs, but were competitive in that game, said general manager Jon Nicholson. “We showed well and it was promising,” he said. “We were pretty happy with the effort.” The T-men have a tough schedule to start, but they think they can pick up some points and stay in the thick of things. “This group is definitely keen and definitely ready to win, I think,” Nicholson said. “We’ve got a lot of guys that are really looking forward to having a good year.” Kyle Couling, T-men coach, said last week that to win games early in the season, his team

will need to commit to the systems and play a strong team game. In the season opener, Cody Short and Tarrin Davies scored two goals apiece and Alec Molander had one. The return of sniper Brett Hawrys to the lineup on Saturday will make a difference, and Dane Sorenson should join the team by the following weekend. The back end has been led by Devan Smith and Jeremy Roe will be a key stay-at-home defender. Nanaimo sports fans can look forward to Jordan Kuziek’s return to

The Nanaimo Clippers came close to capturing the cup that they wanted, and no matter what, hockey season still ends with trophy presentations. The city’s B.C. Hockey League club handed out its team awards at a year-end banquet earlier this week. Goaltender Guillaume Decelles was chosen as the Clippers’ Most Valuable Player for 2014-15 after being chosen earlier this spring as a BCHL all-star and a finalist for league MVP. Decelles also won the Most Popular Player plaque. Nick Gushue was selected as the Top Defenceman, blueliner Yanni Kaldis won Rookie of the Year and Nicolas Carrier won the other major honour, the Lisa McPherson Award for heart, courage and dedication, as well as the Most Improved Player award. Brendan Taylor won the Leading Scorer trophy for a secondstraight season after amassing 59 points in 58 games.

Goaltender Guillaume Decelles is the Nanaimo Clippers’ MVP for 2014-15.

Brett Roulston took home the Coaches’ Award and Jake Jackson won the Jason Gow Memorial Award as most exciting player. Kale Bennett was chosen as Most Inspirational Player, Spencer Hewson is Unsung Hero, Cole Maier earned the Best Two-Way Player award and Austin Dick received the Scholastic Award. Hewson was also announced as the BCHL’s Energy Player of the Year for the playoffs.

Erdman has gotten a chance to become familiar with many players during the throw-around practices in recent months and sees a lot of talent in the skill positions. “We’ve had quite a few young kids come out and I’ve loved what I see, I love our energy, I love our intensity, the skill set’s pretty good,” he said. He will tailor his coaching philosophies to fit the player personnel, he said, but in general he likes guys who bring high tempo to the gridiron and who are willing to ‘get after it’ in practice. He mentioned that as a newcomer to the staff, he doesn’t have any preconceived notions about the players and so the new season is a new start for everyone. Erdman will remain the team’s defensive coordinator. The Raiders will hold spring camp May 15-17 at Merle Logan Field and Caledonia Park and the season starts July 25.
