CN corridor purchase go-ahead from B.C court KATHY MICHAELS The ink should now be dry on the $22-million sale of CN land to local municipalities, meaning area residents are one step closer to having a multi-use pathway linking Kelowna to Vernon. “This is a very important day for the entire Okanagan,” Kelowna Mayor Colin Basran told his council at the end of its weekly public meeting on June 1 upon hearing the Okanagan Indian Band injunction hearing in B.C. Supreme Court had gone in fa-

vour of the municipalities, paving the way for the deal to be made. That said, the actual development of the path is likely years in the offing. First CN will have to remove the tracks, which could be a lengthy process. Then various levels of community engagement will be rolled out before the path is charted out and developed. All this will be set against ongoing efforts from the Okanagan Indian Band to have the land recognized as part of their traditional territory and reverted to re-

serve when it ceased to be used for railway purposes. “The Okanagan Indian Band is our neighbour. We want to work with it,” said Basran. Differences on what lands do fall within traditional territory, however, are cause for some differences of opinion. “Local governments respect and support the Okanagan Indian Band in its claim of reversionary rights on land that falls within IR No. 7 and, as such, those parcels have been excluded from the pending agreement with CN,” said

Doug Gilchrist, divisional director of community planning for the City of Kelowna on behalf of the regional partners. “Our understanding is that the specific claim over the Commonage reserve was concluded,” Gilchrist said. “However, land claims are ongoing across Canada and the City [Kelowna and purchasing partners] will respect any final decisions by Canada or the courts.” Support, said OKIB Chief Byron Louis in a statement, may be the only way forward. “We’re hoping that our neighbours in the

Okanagan can take a page from our friends in Vancouver. Seeking reconciliation with First Nations people is the only way forward without having past injustices continuing to resurface,” Louis said. “Reconciliation means taking the time to listen, hear, acknowledge that you understand what has been told to you and be willing to do more about it than say ‘it happened a long time ago.’ Historical wrongs and historically long held beliefs about First Nations people need to be corrected.”

BACKGROUND

The OKIB’s injunction to stop the sale of the land was rejected June 1 when B.C. Supreme Court Justice Meyers ruled the Okanagan Indian Band claim does not meet the threepart test that merits a legal bid to halt the sale, rejecting it on the grounds that there would be no irreparable harm if the injunction was not granted and that the balance of convenience does not weigh in favour of an injunction.

With June declared Invasive Species Action Month, the Okanagan Basin Water Board (OBWB) has released a statement on zebra and quagga mussels. “Awareness is great, but action is better,” said OBWB chair Doug Findlater. “The water board is doing all it can within its mandate (but) ultimately, it is up to senior levels of government to bring in the appropriate laws and enforce them.” A seven-point OBWB Position Statement includes: “The OBWB will not accept responsibility for the long-term treatment, mitigation or control of zebra or quagga mussels if the province fails to enact appropriate prevention measures, and consequently the species are introduced.” An OBWB staff report outlines 45 years the OBWB has been conducting invasive milfoil control for the Okanagan. The program has cost local taxpayers more than $10 million, while the province has contributed less than $8 million, and none in the last 15 years. OBWB research suggests a mussel invasion in the Okanagan could have direct costs of at least $43 million a year, as well as lost revenue and property values, added maintenance of aquatic infrastructure

and irreparable ecological damage. “In light of the cost of the milfoil program, the OBWB believes the province must accept the costly responsibilities for mitigation and control of this invasive species which we’ve been warning against since 2012, and not pass them to our local property taxpayers,” said Findlater. OBWB called upon the federal government to empower its Canada Border Services agents to inspect all incoming watercraft, something Okanagan MPs announced in December. The boats are already coming, said Findlater. “We’re hoping for good news soon.” In March the province promised $1.3 million for three roving inspection stations and six conservation officers. For a little more funding, Findlater said five permanent, mandatory inspection stations could be installed along the B.C.-Alberta border. Alberta has 10 permanent and four roving inspection stations, with three mussel sniffing dogs due in July. The fine in B.C. for bringing in zebra or quagga mussels goes as high as $100,000. Investors Group shows Lake Country Art Gallery a little love At the end of May, the Lake Country Art Gallery got a great boost from the Investors Group Day of Caring, a community outreach program, where Investors Group staff members go out into the community and volunteer their time. “I wasn’t sure what to expect that day,” said gallery curator Katie Brennan. “I thought we might get the weeds tamed a bit. But instead, I was put to the test to try to think of more things that they could tackle. They weeded everything in sight. Raked the gravel between the gallery and the Art House to an artistic perfection. And went through all the back room storage that had never really been tended to. In the end, all of our bins, garbage, recycling and green bins were full to the brim and our space, in and out, looked spectacular. I can’t thank them enough.” The Lake Country Art Gallery sends out a huge thank you to Sue Hopkins, Nicole Roussel, Diane Townsend, Jenny Price, Richard Erickson,

It was perfectly timed for the second Lake Country Arts Bazaar of the summer— an outdoor bazaar with work by local artists and artisans, collectors of vintage and purveyors of hand crafted curiosities, which took place on June 6. The next Lake Country Arts Bazaar happens on July 4, from 9 a.m. to 2 p.m.

This particular Day of Caring is the second piece of growing the sponsorship relationship between the Lake Country Art Gallery and Investors Group. The first piece is the Investors Group Satellite Gallery of the Lake Country Art Gallery. Brennan has filled the Investors Group Kelowna office with works by 16 local artists including Daniel Dearborn, Fern Helfand, Christina Leinemann Knittel, Maureen Lejbak, River Lewis, Wanda Lock,

CN corridor decision DECISION FROM A1 The municipalities of Kelowna, Lake Country, Coldstream and Vernon, as well as the regional districts of Central Okanagan and North Okanagan, have jointly identified the value the rail line could have as a continuous multi-modal transportation corridor connecting all the communities. “Once the sale is finalized, we look forward to engaging communities about their vision for the

corridor,” said Gilchrist. “We remind residents that while the corridor will be acquired as municipal-owned land it is currently not open for public use.” Designs, public consultation and operating models will be evaluated for developing the corridor but it may be some time before the route is sufficiently developed and the corridor is open to the public. FARMER’S FRUIT & PRODUCE

“It has been a really interesting experience to bring art work of this calibre into a space other than a gallery. I had new variables to contend with that I don’t usually encounter in a gallery,” said Brennan. “But right off the bat, the staff were really keen to see what was coming into their space. It was such fun to try to hang things that staff members particularly liked near their work space, which even eventually led to a sale. “The biggest win for me personally, was running into Kelowna based artist John Hall and having him mention that when he’d been by the offices he had immediately noticed that the artwork on display was a “cut above”. It’s great to know that people are noticing good art when they encounter it.” This project continues the Lake Country Art Gallery’s track record to approach the work of a public art gallery in a way that not only enriches people’s lives with art, but also engages with the community in different, long lasting ways.

Until then, I had never heard of Appreciative Inquiry. But the concept behind it was simple. People find it too easy to find fault. Houses are too big, too expensive. Roads are too narrow. Parking is too limited. Elected representatives are too narrow-minded. Kids are too sassy, too preoccupied with their phones, too obsessed with sex….

▼ PERSONAL INJURY LAW

Inattentive driving becomes the norm

I

back out of my driveway every morning at about 5:15 a.m. Traffic on that quiet street at that time of the morning is rare. This morning, just as my back bumper is meeting the curb, a little red car comes screaming around the slight bend in the street from my right side, the red car almost hugging the curb. The driver is not expecting anyone to be backing out of their driveway so early in the morning on that quiet street. With neither of us expecting to encounter the other, it is a horrible coincidence of vehicle placement and movement: ‘The wrong place at the wrong time.’ What are the odds? When we first learn to drive, a parent or a professional driving instructor teach us to expect the unexpected. Each of us is an anxious hawk, watching out for anything ahead of us to go wrong.

Achieving Justice

Paul Hergott

We drive defensively, eliminating the risk of such a horrible coincidence occurring. We drive at a safe speed down residential streets, watching intently for any sign of a vehicle backing out or a child chasing a ball, even though it’s the early morning. The more we drive without encountering extremely low probability events like a vehicle backing out of their driveway at the exact, coincidental moment that would result in a crash, the less anxious we become. More and more, our minds go to other

things like our upcoming day at work. The lower and lower our anxiety, the lower and lower our attentiveness. Our increasingly inattentive driving is reinforced every time we get behind the wheel and there is no crash. From time to time we are snapped to attention by a ‘close call.’ The coincidence of vehicle placement and movement isn’t quite lined up perfectly like it was for me this morning and we are able to avoid a crash by hard braking swerving. Instead of returning us to being attentive, ‘an anxious hawk,’ though, these close calls do the opposite. Perhaps we have a brief period of hawkish anxiety but we have learned that we are able to brake hard or swerve and avoid a crash, even though we were day dreaming. We are lulled into a deeper sense of complacency. Years of driving without encountering that

horrible, perfect coincidence of vehicle placement and movement that cannot be saved by hard breaking or swerving lead us to that autopilot mode of driving where we get to our destination and can’t really remember the drive. I am very lucky, as is the driver of the red car. Like most others, I got to that same place of autopilot driving over decades of driving. My saving grace has been my exposure, over the 20 years of my legal practice, to the circumstances and aftermaths of an unending series of crashes. I have seen, in vivid Technicolor, that all of those crashes occurred because of inattentiveness that we accept as part of our driving culture because it is totally workable most of the time. The growing realization that inattentiveness is the most prolific cause of crashes has caused me to be a much, much more attentive driver

who once again expects the unexpected. My attentiveness allowed me to easily stop this morning, allowing the red car to scream past the back of my bumper. I am certainly not unique. Many others drive with the requisite level of attentiveness that would eliminate the vast majority of car crashes. How do we change our driving culture to instill that level of attentiveness into all of us? Attentive driving takes work, and doing the ‘10 and 2’ is a tool I have come up with to help with that important job, something I advocate on my driver safety web site which you can find at OneCrash isTooMany.com. If you have other ideas, please let me know.

Paul Hergott is a personal injury lawyer at Hergott Law . paul@hlaw.ca

Lists of that kind can go on and on forever. Appreciative Inquiry tried to reverse the attitude, by learning what people valued and wanted to enhance. Instead of looking at the negatives, it asked them to consider the positives. The process worked amazingly well. Most participants could identify what they liked about living in the community. Only a small number of people seemed hardwired for negatives. I had almost forgotten that experience, until I heard a talk by Wendy Creelman, representing the Canadian Positive Psychology Association. Positive Psychology? Isn’t psychology about diagnosing what’s wrong with you, so that you can be straightened out? That’s certainly the notion behind DSM-

Gov’ts quick to get distance from OKIB claim

I

t was a month ago that I suggested local officials come together behind the Okanagan Indian Band and push for a resolution to the more than century-old Commonage claim. The argument at the time was a collaborative approach would provide certainty for communities wanting to purchase the CN rail corridor and develop a recreational trail. And while there was an initial sense that municipalities may back the OKIB’s land claims bid in Ottawa, that’s clearly not the case. As soon as the B.C. Supreme Court denied the band’s application for an injunction to stop the sale of the rail corridor Monday, representatives from the victorious municipalities and regional districts were distancing themselves from the broader issue of First Nations rights. “It’s a federal and

provincial issue and they need to deal with the band,” said James Baker, Lake Country’s mayor. “We understand that they are trying to finalize claims but it’s out of our jurisdiction,” added Juliette Cunningham, Greater Vernon Advisory Committee chairperson. Technically, the municipalities and regional districts are correct when they say that aboriginal affairs is the responsibility of Ottawa. However, we should all remember that councils and boards have interfered in senior

affairs before. As an example, municipalities pulled behind Cherryville in its fight over logging in a sensitive area and concerns about dangerous highways and meat regulations have been multi-jurisdictional. And while all of those are important issues, nothing is more fundamental than basic human rights and righting past wrongs. The Commonage reserve was formed in 1877 and within a decade, bureaucrats erased the boundary and didn’t provide compensation to the OKIB. Members of the band are not some separate group. We play hockey with them or work beside them. Our kids are in school together or marriages have made us family. They are part of our overall community and we should be concerned about issues that impact them to the very root of who they are.

There are also possible implications for the communities purchasing the rail corridor if the band decides to go to the next level of court. It’s a scenario even hinted at by the consortium putting the purchase deal together. “Our understanding is that the specific claim over the Commonage reserve was concluded. However, land claims are ongoing across Canada and the city will respect any final decisions by Canada or the courts,” said Doug Gilchrist, with the City of Kelowna’s real estate department. “We hope to continue to work with Okanagan Indian Band for the mutual benefit of all our citizens.” And if the jurisdictions are truly genuine in wanting to work with the band and developing the full benefits a rail trail can provide socially and economically, then municipal councils and

regional district boards should be contacting their MPs and MLAs and demanding immediate action over the Commonage claim. The final process to purchase the rail corridor came at the same time that the national Truth and Reconciliation Commission released its report on the impact of residential schools. “We need reconciliation so that a broken country can become whole again,” said commissioner Marie Wilson in a CBC report. One way for that to happen is for rank-andfile citizens, elected officials and civil servants — native and non-native — to move ahead together. That means bringing past wrongs to a close. Let’s hope the jurisdictions involved in purchasing the rail corridor look beyond boundaries or legal limitations and do what is right. Richard Rolke is a Black Press reporter in Vernon.

Judgers can become Learners and Learners, Judgers TAYLOR FROM A4 5—the Diagnostic and Statistical Manual of the American Psychological Association, fifth edition, with almost 1,000 pages listing mental disorders. In 1998, a somewhat controversial psychologist, Dr. Martin Seligman, was elected president of the APA. In his inaugural address, he told the APA that their “psychology was halfbaked, literally halfbaked. We have baked the part about mental illness…The other side’s unbaked, the side of strength, the side of what we’re good at.” Seligman focused his own studies on the strengths that enable individuals and communities to thrive, on what can go right, instead of what can go wrong. Thus was born Positive Psychology. Its theme—like Appreciative Inquiry— is that attitude is everything. We are what and how we think. So if we think we’re helpless, we will be. Seligman’s experiments

on dogs would probably not be allowed today. But his learnings helped military personnel resist torture if captured. His work with severely depressed patients enabled them to break the spiral of sinking into hopelessness. I was intrigued by

Positive Psychology’s division of people into two classes—Judgers and Learners. Judgers, according to these categories, have a fixed mindset; when their views are challenged, they get defensive. They find fault. Blaming someone else

protects them from having to change.

Yet, while they stayed longer and spent more, US visitors represent only about six per cent of all overnight travelers who visit the Okanagan. It’s clear that attracting more US visitors to our region would generate more business for our local economy. To this end, I was pleased to learn that on May 22, Prime Minister Stephen Harper announced $30 million over three years for a ma-

tunities, increase tourism revenues and create jobs in Canada. This includes measures like negotiating new or expanded bilateral air services agreements and visa initiatives like 10year multiple-entry visas and the Can+ visa program for low-risk travelers from some of our highest growth markets, including India and Mexico. Given the changes in market conditions in the U.S. and federal-provincial-territorial and industry support, the time is opportune for the CTC to resume marketing activities in the U.S. The Okanagan is a premier four-season tourism destination with one of the best airports in the country to facilitate travel from the US. I am hopeful that this injection of funding will attract more American visitors to our region and generate more jobs and growth for the many local businesses that rely on tourism in our communities. Learners, by contrast, have an open mindset; when their existing views are challenged, they welcome the chance to learn. When things go wrong, they ask, “What actually happened here? What can we learn from this?” But no one is locked into those categories. People can choose to change. My friends include a Judger who moved (if hesitantly) to being a Learner, and a formerly avid Learner who hardened into a Judger. Don’t think it’s all “in your mind.” Physical, mental, and emotion-

al health work together to create our well-being. But all three fall within our own control. Nutrition, sleep, and avoidance of harmful habits influence physical health. Social relationships shape emotional health. One of the mantras of Positive Psychology is that selfcare is not selfish. Like Appreciative Inquiry, Positive Psychology starts with choosing an attitude. And that attitude determines what we will become. Author Jim Taylor lives in Lake Country. rewrite@shaw.ca

ardening is one of Canada’s most popular forms of leisurely exercise. Here are some tips to avoid injury from yard work. 1 Ease yourself into it. Start with 20-30 minutes, multiple days of the week instead of eight hours straight away. 2 Limit the bending. If you are going to do a lot of ground work, kneel down. 3 Stretch before you begin. This will warm you up to help prevent pulling or straining a muscle. 4 Switch up your activities often. Do 15

groups. 5 Use proper technique when lifting. Bend with your knees, not your back. Also, keep the object you are lifting close to your body. Why do we get sore if we have done too much? Our bodies follow a principle called delay onset muscle soreness. We are sore the day after, but it is not until the second, even third day that the soreness really sets in. Get moving and stay active in those three days because pumping nutrient rich blood through your muscles will help

them heal faster. Sabina Lee is a physio-

SNOW PACK/WATER LEVELS

The 2014/2015 snow pack was below average. On March 1 staff completed the Oyama Lake snow course and the snow pack was 65 per cent of average. Although this number looks poor, in actuality we did receive close to the normal amount of snow fall, but due to the unseasonably warm temperatures a significant amount of the snow pack had already melted. Above normal temperatures in February and March caused both Oyama and Beaver Lake to fill earlier than usual. Oyama Lake reached full pool by late February, and Beaver Lake reached full pool by mid-March. Typically both lakes fill by mid-April, and this may result in drawing from water storage earlier than normal. It is not anticipate there will be any problems with water supply this year. From what I understand, the “global warming profile” for the Okanagan is that there may not be a significant reduction in the amount of precipitation but, like this year, the heat will come sooner and stay longer. So our challenges will lay in both conservation and storage capacity as the season lengthens and the snow pack melts sooner.

Ask The Dentist! by Dr. Lina Jung, DDS

‘Dental Health On A Budget What To Do?’

Q: I'm the stereotypical starving student. My teeth are just 'OK', and I'm worried that even a simple dental emergency is going to blow my living budget out the window. What are the simplest things I can do to get through this period? A:

I suggest you brush after anything except water has passed your lips. We have turned into a nation of 'grazers' who munch on food at our desks, while we drive, and even shop. The gunk that comes out of some people's automobiles could feed a third world village for a week. Ditto for computer keyboards. Besides being a source of untold amounts of bacteria, the food crumbs simply gum up the works. I say brush after anything, because much of the liquid we drink has sugars in it. The energy drinks are probably the worst, and I see those in cup holders in vehicles everywhere. We see patients coming into the waiting room with a 24 ounce pop container. People make an effort to fool their dentist when it came to regular brushing and flossing, by making a herculean effort the morning of the checkup. When gums bleed to the touch of our instruments it is a sure fire guarantee this flossing isn't occurring at home. The role of the floss is to disturb the bacteria so it doesn't turn into plaque and decay.

Petrina Koltun

Q A

How good is the current real estate market?

I am excited to be able to answer this question by using my personal experience in the busy Lake Country real estate market. April 2015 was the busiest April for real estate sales in over decade! I am grateful to have been blessed with amazing clients and I am very thankful for the referrals and home sales business that earned me the #1 ranking in Royal LePage Kelowna! I am finding that we have had an even distribution of buyers ranging from first time home buyers, move-up buyers, and out of province clients, all looking for property. I know that our spectacular standard of living is what so many desire and real estate buyers are purchasing in our community because they all want the Lake Country living experience that we have, and enjoy, every day. Growing consumer confidence, low interest rates and our beautiful Okanagan sunshine are all factors that are allowing many homes owner dreams to come true, while our market continues to offer home and property choices in volumes never experienced before. If you or someone you know is thinking of selling or purchasing in our fantastic community, I am always happy to help. “Your home is where my heart is”!

Some patients have very tight nooks and crannies in their mouth that the regular brush won't clean on its own – hence flossing is mandatory. Your dentist or hygienist isn't scolding you if you miss this step, but they know about it in 2 seconds flat.

Another overlooked issue is your toothbrush. Change it every few months – more often if you have had a cold or the flu. I'm not so concerned about whether you prefer a 'hard' or a 'soft' brush as I am with it being comfortable enough that you use it often. Look at the place you store your brush between uses. Many people have a toothbrush holder that is frequently central in their bathroom. Every time you flush you release millions of bacteria that surge out of that toilet like an invisible waterfall. It coats everything within 6 feet, including the toothbrushes. You use your brush, and place it in the holder while wet – correct? Wet brushes attract bacteria and hold on to it, providing a 'nest' in your toothbrush. An expert in bathroom sanitation (yes, they exist) tells me that wet hands touching a bathroom door knob transmit 87% of bacteria, whereas dry hands transfer only 13% from that same doorknob. Your wet toothbrush behaves similarly. Finally, rinse often. You need to restore the pH balance in your mouth. Don't ever underestimate the healing properties of drinking water.

Q

What question would you like a qualified professional to answer?

Why do we have two eyes?

Seeing that we typically perceive one solid view of the world around us, it’s easy to forget that this single image is actually being viewed at differing angles by our two different eyes. Our brain’s ability to take these two separate views and construct a model of all that is around us has to be one of the most fascinating and complex processes in our entire body! By viewing the world from two slightly different frontward facing angles, our visual cortex is able to combine the information and create a three-dimensional map of the world – a view that is not experienced by a wide variety of other animal species. Isn’t it strange to think that the world our eyes create for us is literally different than the world that other animals experience? Along with this 3-D mapping, two eyes also leave us with a spare should unfortunate injury ever occur. So why not three, or four? Well, given the immense complexity involved with the development of two eyes, it may be that the potential benefits of adding another complex light sensing unit just wasn’t worth the evolutionary effort.

My adult child has just moved back home. What can you suggest to get them back on track?

The number of adult children living with their parents is on the rise. For Boomers, that can be a double whammy because many are being sandwiches between caring for their adult children and their aging parents. There is no doubt that having adult children stay at home creates financial challenges by increasing the cost of living, creating a drag on savings and even causing a loss of freedom. Here are some practical ideas to reduce stress, hard feelings and avoid potential financial disaster: • Talk Openly: Discuss your situation with your adult child and go over the household bills • Pay to Stay: Treat your child as an adult and try to replicate ‘real world’ conditions by having them contribute to household expenses, chores and even pay rent. • Invest in a secure future: Insist your adult child establishes a savings plan to help pay a future down payment on their own home and build an emergency fund • Talk to a professional: Make sure you discuss your situation with a professional advisor to make sure your financial plans stay on track
