Thursday’s Supreme Court of Canada decision expanding medical marijuana access to edible products may also influence another pending court challenge by patients who want to be allowed to continue growing their own pot rather than buy only from new commercial producers. by Jeff Nagel Medical marijuana patients have a right to possess and use cannabis in the form of cookies and products other than dried bud, the Supreme Court of Canada ruled Thursday. The unanimous decision is a major victory for cannabis crusaders who argued they should not be forced only to smoke or vaporize the drug when edible or topical products are safer and provide benefits such as delayed delivery. “Inhaling marihuana can present health risks and is less effective for some conditions than administration of cannabis derivatives,” the country’s high court ruled. It found the federal drug law exemption allowing medical pot patients access only to dried marijuana violated their constitutional right to life, liberty and security of the person. Approved patients who illegally baked cookies, brewed pot tea or turned it into oil had faced the threat of criminal prosecution, but not any longer. “This denial is not trivial,” the court ruled. “It subjects the person to the risk of cancer and bronchial infections associated with smoking dry marihuana, and precludes the possibility of

choosing a more effective treatment.” The ruling upholds the decision by B.C. courts that dismissed drug trafficking charges against Owen Smith, a Victoria man caught baking pot cookies for a local compassion club. “It’s a great decision from the point of view of all medically approved patients,” said Abbotsford lawyer John Conroy, one of the lawyers who defended Smith before the Supreme Court. He said the government’s dried-only restriction was unreasonable. “It forced people to choose between a legal but inadequate treatment and an illegal but more effective one.” Conroy is optimistic the Supreme Court’s ruling will also guide another pending case in which medical marijuana patients have argued before a Federal Court judge that they should be allowed to continue growing their own pot at home, instead of buying only from new commercial producers authorized by Ottawa. In that case as well, Conroy and co-counsel Kirk Tousaw argued similar constitutional rights are in play – that medical marijuana users are deprived reasonable access if they can’t afford to buy from commercial producers and that they then risk jail if

they grow it themselves or buy on the black market. That trial took place this spring and the judge has reserved decision. Conroy predicts Thursday’s ruling will also allow commercial producers to start offering cannabis edibles and topicals, rather than just dried pot. The Supreme Court did not give the federal government time to pass new regulations and instead issued an immediate order that the old restriction was no longer in force. It’s not yet clear how Ottawa will respond, but it could regulate pot derivatives through a different mechanism. Federal Health Minister Rona Ambrose told reporters marijuana is not an approved medicine and criticized the ruling for contributing to the normalization of marijuana use. “I’m outraged by the message that judges are sending that they think that they can approve a drug into a medicine without clear medical scientific evidence and without safety reviews,” Ambrose said. She cited 36 cases of people being hospitalized after becoming ill from ingesting marijuana edibles at Vancouver’s recent 4/20 pot celebration.

Opinion: A new definition of terrorism by Brian Coombs English is an everchanging language and it has always been so. Because of this, the Oxford English Dictionary adds new words nearly every year. Some examples from this year include: Earwigger (noun), HaveyCavey (adjective) and Lookie-Likie (noun). What nearly never happens is that a word changes its definition— unless, it appears, the Canadian Government is doing the defining. Here is the Oxford English Dictionary’s definition of terrorism: “The unofficial or unauthorized use of violence and intimidation in the pursuit of political aims.” Bill C-51, known to those in government as “The Anti-Terrorist Act”, was rubberstamped by the Senate this past week and is awaiting Royal Assent before becoming law. For the remainder of this article, it will be referred to as The Anti-Terrorist Act, because that is how it was sold to Canadians. Looking at what the act covers, there will need to be a broad re-defining of the word terrorism. Let’s look at how possible threats outlined in this anti-terrorist act are defined. The bill defines them as “interference with the economic or financial stability of the country or with “critical infrastructure.” While the bill notes that does not include lawful advocacy or protest, it leaves the door wide open to vague interpretations of what that means. by saying that when the new bill becomes law, “whenever you’re attacking the Canadian economy you could be branded a terrorist.” The protest was peaceful and in a public place and the protesters right to demonstrate is protected by law. However, a law enforcement officer felt that the demonstration could fall within the anti-terrorism act. So the definition of terrorism may need to be amended with the words “peaceful protester.” Then there is the privacy incursions, and yes, there are many. Terrorism-related incursions are listed in the act, but so are many other items that aren’t even remotely related. And the government can share any information gained with 17 government institutions with more to be added at its discretion. Here’s how it’s worded: “For greater certainty, nothing in this Act prevents a head, or their delegate, who receives information under subsection 5(1) from, in accordance with the law, using that information, or further disclosing it to any person, for any purpose.” That’s pretty plain language. It means that the people who receive the information can share it with anyone they want to, and those people can use the information for any reason they want. Again, the definition of terrorism may need to include those who want to keep their private information out of the hands of “any person, for any purpose.” Daniel Therrien, Canada’s privacy commissioner, in his submission to the government

wrote, “I have repeatedly heard that Canadians understand the need to share their information with the government, but that they have concerns about how this information is going to be used. They are particularly concerned with the issue of government surveillance. Bill C-51 does nothing to assuage those fears.” There are a number of other concerns with the act. Remember, terrorist activities are already illegal in this country. There are laws already in place to prevent people from buying explosives, plotting to overthrow the government or to kill innocents. The items mentioned above are the most unsettling for their vagueness, their potential to be abused by government and corporations and their ability to morph into something else in the future—like the definition of terrorism. The new definition of terrorism, in relation to the Anti-terrorism Act should read: “The unofficial or unauthorized use of violence and intimidation in the pursuit of political aims, and demonstrations (if they could possibly result in a drop in revenue) or the desire to maintain your privacy.” So if you protest what you consider unfair, CSIS (Canadian Security Intelligence Service) can lock you up for days without charge while they try to get information out of you. Possible employers may eventually be able to look you up in a database and deny you employment because of something you said on an email once, or a minor medical condition. None of that may happen, but the Act certainly does not rule it out. Feel safer?

Letter: A thank you to honest people In an unusual departure of my bringing out things and people that ‘tick me off’, today I have something tipping the other end of the scales, and it shows the honesty of the people of canada and in particular the people of Cranbrook. Saturday afternoon my daughter brought the grand kids in from Wasa. It was time to pick up some groceries and the grandkids wanted to play in the Spray Park for a bit. Us adults sat back and enjoyed the beginning of the current heat wave and the kids, along with a flock of other kids, enjoyed the numbing and cardiac inducing (to adults anyway) cold wa-

ter of the spray park. After they were so numb they couldn’t really tell just how hot it was getting, it was time to pack up and get back to life. So the kids got wrapped up, strapped in to their car seats, they went their way and my wife and I headed home. Given an appropriate amount of time for my daughter to get home and the phone rings. “dad, do you guys have my cell phone”? Well, we didn’t so she was now officially in a panic. Not only her cell phone, but her ID, some cash and some cards were not where they were supposed to be. So I told her I would run back down and see if I could find it. When I

got there, a whole group of people were in the throws of setting something up, families having picnics and a lot of people running and sitting around. I checked first where she had parked, maybe she dropped it there. Nope, not there. Then I headed for where we had been sitting and judging by the amount of people running about I wasn’t holding my breath. Other picnic tables now full of people and people of all ages milling about. There, all by itself sitting on top of the table we had been at, was a lone cell phone. What a surprise. All the other tables were in use, families setting up and the grass, and because of one lonely cell phone, sitting there by itself no one moved in and claimed that table.

We had to wonder how long would it have taken for someone to clean out her bank account, had we been in the States? Even being here, in Cranbrook, in Canada, I hadn’t really expected it to be there. Bad me, doubting the nice people of Cranbrook. So, a big thank you to the honesty of the people of this great little city, and a big hug for everyone who could have very easily grabbed that phone and no one would have been the wiser. Chronic pain is the most common cause of health care visits and, sadly, we are doing a terrible job of managing this debilitating health problem. The Canadian Pain Society published a review document in 2013 outlining the effectiveness of chronic pain management. According to this review study, chronic pain management is just over 23% effective. For every 100 patients with chronic pain, 77 do not respond to conventional treatment. By any account, this is a dismal track record. Over the last 15 years an effective and safe pain treatment modality called neural prolotherapy (NPT) has been gaining growing attention from doctors interested in treating pain. This treatment works on the principle of Hilton's Law. Hilton's Law states that the nerve supplying a joint also supplies the muscles, tendons and ligaments that move the joint and the skin over the joint. This means that by treating cutaneous nerves (nerves just under the skin) you are also affecting the joint surfaces, ligaments, tendons and muscles connected to that nerve. This is very exciting news! It means

that deep structures in the body can be treated using non-invasive, superficial treatments. Relying on Hilton's Law, NPT uses targeted nerve treatment to safely and effectively manage pain. How is this done? It turns out that nerves are very sensitive to a 5% solution of dextrose. On the surface of every nerve cell there are millions of proteins that allow the cell to function. Some of these proteins, called transient receptor potential proteins (TRP), are sensitive to dextrose. Dextrose sensitive TRP's, when bathed in dextrose 5%, cause the nerve cell to relax and heal. NPT bathes the irritated, pain causing nerve with this solution giving immediate relief and stimulating the nerve to start healing. Athletic injuries, fibromyalgia, CRPS, back, shoulder, wrist, hip and elbow pain all respond to this safe and effective therapy. In most cases the pain is completely gone before leaving the treatment room. Over time, hours to days, the pain will slowly return but at a less intense level. Over the course of 2 to 8 treatments the nerve gradually heals.

MLA Bill Bennett met with Trustees of School District 5 (SD5), Southeast Kootenay last Friday, June 5th as part of the Board’s initiative to both keep the MLA up to date on some of the positive things taking place in the District, like trades-based Project Heavy Duty, as well as to discuss some of the challenges faced by the Board. Project Heavy Duty is a partnership between SD5, College of the Rockies, WorkSafe BC and the local heavy equipment industry that provides grade 12 students hands on experience with various types of heavy equipment under the supervision of qualified operators. This project has been offered for a number of years in SD5 and complements the province’s focus on trades training. According to Board Chair Frank Lento, the meeting was just under two hours in length and was very productive, saying the MLA was up to speed on the agenda items, which allowed for a very frank discussion on priority issues for the Board. “It’s not about always agreeing with one another. It’s about listening to one another and building upon the common ground we share and that’s what this meeting was about.” Trustee Chris Johns, chair of the SD5 MBSS Replacement Committee, agrees. “I believe we have a good working relationship with our MLA that goes back to my early days on the Board when the replacement of Mount Baker Secondary School (MBSS) first became our District’s top replacement priority.” According to Johns, Bennett has had an active role in pushing for replacement of MBSS since the Board first approached him in early 2009. Since that time, MLA Bennett has been responsible for bringing a number of Education Ministers to the District to tour the ageing facility. Also on the agenda was the ongoing issue of education funding and the newly legislated Bill 11. Bill 11 was carried into legislation on May

Golf tournament fundraiser brings in over $5,000 for hospital They may be a small group but for members of the Windermere Health Care Auxiliary (WHCA) thinking big for their latest fund-

raiser turned out to be a huge success. The Auxiliary held its first ever golf tournament on May 30 at the Windermere Golf Club.

The weather was a bit on the erratic side but the spirit of the organizing committee was brightened with a full turn out of registered

golfers taking their place on the tee to join in the Auxiliary’s fundraising efforts for Columbia House and the Invermere Hospital. “We were simply overwhelmed by the response from our community with hole sponsorships, auction items and prizes and we are so grateful to those who showed up to golf. It was all so exciting,” explains WHCA President Margaret Bashnick. Thanks to some very generous individuals and businesses the auction tables were overflowing with some very enticing items and the golfers showed their commitment by making some very welcoming bids. It was a beautiful day out on the course with the sounds of laughter

College student reflects on semester in Dominican Republic When College of the Rockies’ Bachelor of Business Administration (BBA) student Kyler Robertson departed for his semester in the Dominican Republic, a blizzard was approaching the Calgary airport. Twelve hours later he was in the hot, humid city of Santo Domingo and ready to continue his business studies. Robertson’s study abroad opportunity was made possible through a partnership between the College’s Business program and International department. A relationship between the College and La Universidad Iberoamericana (UNIBE) in Santo Domingo already existed with the College hosting UNIBE students in the past, opening the door for the College to reciprocate by sending Robertson to study there. “International opportunities like this, combined with the business

courses delivered at the College, provide our students with the opportunity to prepare for the increased globalization and diversity that business is faced with today,” says Business program coordinator Greg McCallum. “We are thrilled to have been able to facilitate this opportunity for Kyler.” Robertson, a thirdyear BBA student, applied for the College’s new BBA Semester Abroad Scholarship as well as the Irving K. Barber One World Scholarship to fund his trip abroad. While in Santo Domingo, he lived with a Dominican home-stay family and had the opportunity to take Business courses at UNIBE while also continuing his College BBA studies online. Overall, Robertson found his experience a very worthwhile one. “Having College of the Rockies offer international experiences

like this to students is very valuable and I would recommend other students take the opportunity to experience living outside of their comfort zone and be exposed to different cultures,” he says. “I gained tremendous knowledge and experience that I will be able to take with me for the rest of my life. I hope this program continues to grow.” Robertson graduated from the Business Administration Marketing diploma program this year and was the re-

cipient of the Governor General’s Bronze Medal, considered to be the greatest honour bestowed upon a graduate of a two-year program. The medal is presented to the student who has achieved the highest academic standing in a two-year or associate degree program. Father’s Day originated in the United States and was inaugurated in 1910. We owe the idea to Sonora Louise Smart Dodd. Day, Sonora had the idea of asking that a special day be established in honour of fathers. It was a way for her to pay homage to hers, whose birthday was June 19. The third Sunday in June The following year, Sonora’s request was granted. The first celebration of Father’s Day took place on June 19, 1910, in several states, including Wash­ ington, where Sonora lived.

In 1924, the president of the time, Calvin Coolidge, suggested turning it into a national celebration. However, it was only in 1966 that President Lyndon Johnson signed a declaration officially declaring the third Sunday in June as Father’s Day. Today, Father’s Day is celebrated in many countries around the world.

She will be giving talks and presentations throughout the Kootenays to commemorate what the community lost and to help all British Columbians learn how to read the signs of an oncoming natural disaster. Disaster in Paradise is the first book about the 2012 Johnson’s Landing landslides—two natural disasters that devastated the picturesque Kootenay Lake community. The landslides made national headlines. Author

Amanda Bath’s house was flattened by the first slide only an hour after she left the area, and when she returned less than twenty-four hours later to try to rescue her cat, she had less than a minute of warning before a second landslide completely buried what remained of her home. Amanda’s escape from the second landslide was caught on video by a news crew who had left the same beach minutes earlier and the footage went viral on YouTube. The process of writing Disaster in Paradise was like therapy for Bath, carrying her through the painful months that followed. Disaster in Paradise is the story of Bath’s trauma and healing, but it is also the story of a community as it joined together to mourn and gradually rebuild in the wake of tragedy. In total, the landslides destroyed six homes and killed four people: Valentine Webber, aged 60, his daughters, 22-year-old Diana and 17-year-old Rachel, as well as 64-year-old Petra Frehse. The book is both a chronicle of a BC tragedy and a warning for the future. Amanda Bath was born and raised in England, and lived in London before moving to the tiny community of Johnson’s Landing in 1993. She holds a PhD in Catalan Literature and worked in human rights research for Amnesty International for a decade. She now lives in Kaslo, BC, with her husband Christopher Klassen.
