A Scottish family is suing a local family as well as the provincial government, RDKB and City of Grand Forks, after a man drowned while tubing on the Kettle River in 2012. Andrew Barrie, an oil consultant from Scotland, was on holiday in Canada with his wife and son visiting friends in the region. During their visit they joined their friends, the MacNeills and Legares, for tubing down the Kettle. Barrie, along with Christina Lake residents Ronald (74) and Jacqueline Jean (71) Legare died of drowning after being swept down the falls. The three were part of a group that was tubing in the area on July 28 and were seen being swept into Cascade Canyon. At the time, then-Staff Sgt. Jim Harrison told the Gazette, “Apparently, a party of 13 people were tubing on the Kettle River when they were caught up in the current under the Trestle Bridge and three of the party of 13 went over Cascade Falls.” • See FAMILY SUING page A9

RDKB takes stand on health concerns No jurisdiction on smart meters specifically, chair explains

The Regional District of Kootenay Boundary will not be sending a letter calling on the government to put a halt to the installation of smart meters. However, the regional district (RDKB) is going to petition the government to recommend a review of Health Canada’s safety code. Acting on information and reports submitted to the RDKB, discussion about the safety and health concerns of smart meters was added to the agenda at the board’s meeting in Grand Forks Thursday.

A small group of concerned citizens attended. Chair Grace McGregor began by explaining that in regards to smart meters, local government does not have any jurisdiction. A recent resolution by the Regional District of Okangan Similkameen (RDOS) has no teeth, she explained. That district requested the metering project be stopped and that all smart meters already installed be removed. “We need to take a stand on what we can take a stand on,” McGregor added. Roly Russell explained that authorized actions are limited. “There needs to be clarity as to what is, and what is not, the RDKB’s mandate and jurisdiction.” Therefore, “It is resolved that the Regional District of Kootenay Boundary Board of Directors petitions the Premier of British Columbia, the Honourable Christy Clark, the Minister of Health, the Honourable Terry Lake, and the Chief Medical Health Officer for B.C., Dr. Perry Kendall to recommend review of Health Canada’s Safety Code 6 to ensure appropriate protections for our citizens, based on the precautionary principle and a

transparent review of the available research. “Further, that the board also petition the Government of Canada to work in collaboration with the health departments of the provinces and territories, to examine existing cancer data collection methods in order to improve the collection of information relating to wireless device use and cancer.” “The resolution we passed has a way bigger impact [than the RDOS resolution],” McGregor said. The best action for citizens is to take their concerns to their MLAs and to health authorities, both she and Russell stressed.

1975 A second-language pilot program in the Grand Forks School District has been approved by the Department of Education. The program would see the introduction of Russian language in Grades 2 through 10 inclusive. 1980 Pacific Western Airlines representatives told city council and the chamber of commerce Friday that the airline has applied to give up its licence to serve Grand Forks, effective Sept. 8. 1990 A number of cases of Hepatitis A have been reported in the Grand Forks area during July. 1995 Grand Forks kayakers Chris Moslin and Lincoln Ford competed in the Canadian Whitewater Championships on the Slocan River last week. 2000 Round one is over as city council has passed its bylaw to spend a maximum of $850,000 for the purchase of land up the Granby for a value-added industrial area; however, the 400 acres of land, located about four kilometres north of city boundaries, is in Area D and will have to be annexed. 2005 B.C. Day long weekend was busy for police, who were called to break up a house party of predominantly young people at Christina Lake. Someone had used pepper spray at the house where it’s estimated over 300 people had gathered. The back window of a police cruiser was also smashed. 2010 Installation of fibre optic cable commenced this week for a project that will help connect both city facilities and schools in the district. The cost of the project is $1.1 million, $600,000 of which has come through different grants, and the city and school district each contributing $250,000.

Grant helps airport Gazette Staff

Boundary-Similkameen MLA Linda Larson joined city representatives at the Grand Forks Municipal Airport Thursday to announce a $45,000 grant for beacon upgrades. The B.C. government is investing in beacon site upgrades at the airport as part of B.C. on the Move, the province’s new 10-year transportation plan. The funding, awarded through the new B.C. Air Access Program, will be used to replace solar-powered, remote standard beacons and regular-powered beacon sites with LED-powered beacons. The Grand Forks airport is the only airport between Kelowna and Cranbrook capable of providing 24-hour Medevac emergency night flights, Larson pointed out. “These upgrades are anticipated to reduce operating and maintenance costs, and remain in service for the next 15 years.” “Improving and upgrading infrastructure at B.C.’s airports is critical to our economy by facilitating trade, travel and tourism,” Larson said. “This investment in Grand Forks Municipal Airport will provide a boost for the city, the region and its residents.”

Grand Forks Mayor Frank Konrad said the city is pleased about the funding and thanked the province and the Ministry of Transportation and Infrastructure for selecting Grand Forks as a recipient for the funding. “These dollars will be put to good use for the replacement of the Grand Forks Airport beacon site lighting. The current system, which has regular powered lighting, will be replaced with LED lighting, making them more energy efficient and cost effective.” Through the B.C. Air Access Program, the Ministry of Transportation and Infrastructure cost shares with public airports on projects such as lighting and navigational systems, terminal building expansion or upgrades, and runway improvements. These types of projects allow airports to improve safety and accommodate larger aircraft and more frequent flights, supporting the continued growth of local and provincial economies. The program also encourages funding partnerships with the federal government, local and regional governments and agencies, and the private sector. This year’s B.C. Air Access Program funding allocation is $6 million.

The Hardy Mountain Doukhobor Village Historic Site is now in the hands of the Regional District of Kootenay Boundary (RDKB). The Land Conservancy approached the RDKB about buying the site, explained Area D/Rural Grand Forks director Roly Russell. “They were coming to us because they had a property that had specific restrictions on it for its use and they thought they would come to us first,” he said, adding that from his perspective, it’s a fairly low-risk opportunity. Given The Land Conservancy’s filing for bankruptcy and a “Plan of Compromise and Arrangement” with the Supreme Court, the decision to purchase the property was deemed urgent. “We’re now at the point where we can get into the planning of how we are going to move forward with the property; we do not have any concrete plans at this point,” Russell said. The ideal scenario would be to establish partnerships with any groups interested in the site. “That’s a big conversation that we have yet to get to,” the director added. Possible uses of the buildings and lands include educational, historical, cultural and tourist purposes. Costs for the proposal will be covered with Area D gas tax funds. The Hardy Mountain Doukhobor Historic Village Site is a 16.9 acre property containing what remains of the historic Makortoff Doukhobor Village and overlooks the Kettle River and Granby River valleys. It’s located in Area D one kilometre west of the city and is within the Agricultural Land Reserve. The village was acquired by TLC from the previous owner who operated the heritage building as a museum and tourist attraction. The property is significant culturally as it represents the only remaining Doukhobor “great house” in B.C. on its original site and has been designed as a heritage service by the RDKB as well as a historic site by the National Trust for Canada. The site is largely intact and the communal house is still in an exceptionally good state of repair. This acreage was also the site of many other village buildings, of which five are still standing. They too are full of historic implements and tools that were used by the Doukhobor pioneers to farm the land.

River signs needed

Some might see the lawsuit from the Barrie family as frivolous. The family names several defendants including the City of Grand Forks, the community of Christina Lake, RDKB, several provincial government offices, as well as the other families involved in the tragedy. There is no doubt that the drowning deaths of Andrew Barrie, as well as Ron and Jacqueline Legare, were tragic. The lawsuit contends that all the government bodies mentioned above promoted tubing but did not warn of dangers. However, should the city be responsible for signage? What about the regional district? Bodies of water technically are provincial jurisdiction, so should the province place signs at every river throughout B.C. warning of potential dangers? Most local people know about how dangerous the Kettle becomes as it winds its way towards Cascade Canyon. Most reasonable people would see tubing down rapid water as well as jumping off of a bridge into the water as inherently risky. It seems like around here it’s a case of one level of government passing the buck to another. If a sign prevents even one accident, it would be worth the investment.

Didn’t I just go on vacation like yesterday? On The Ball CRAIG LINDSAY While I’m back from another vacation. I had a week off which ended up being 10 days when you add in the weekends and the stat holiday on Monday. Weekends off are never a given when you are a reporter so it was nice to have that extra time. I was able to travel to Vancouver Island and do some camping and exploring. I also got to stay with my mom in Oliver which is always a treat. The lake is beautiful at this time of year—actually, any time of year but you get the point. I’m always amazed at my mom’s ability to nap at any time in front of the TV. Me, I need a nice bed and quiet and darkness before I will succumb to sleep. Mom will be knitting and fall asleep mid-stitch. The TV can be blaring and she has no problem snoozing.

Of course, if I try and open a cupboard in the kitchen and sneak out a bag of chips, she’ll awaken instantly and give me the “what are you doing in there?” scold. Funny how no matter what age we are (am I really almost 50?) when we go home we’re like children once again. I guess that never ends which is the way it should be. So I tried to get my mom hooked up with Netflix. Since Dad passed a few years back she has gotten more interested in computers and electronics. She inherited Dad’s Samsung Tab (iPad type) and has been using it since. She loves to check email and read the latest news about Oliver on the local paper’s website. My father loved to watch sports on the big TV. Golf mostly, but also hockey, curling, baseball, football, and even my beloved basketball. He also liked online pools whether for money or not. I always run basketball pools and he was invariably the first to sign up.

Now that mom has full reign of the living room TV, there’s a lot less sports. She still likes to watch golf but prefers PBS style British murder mysteries usually with some curmudgeonly old detective. For a while now her friends have been talking up Netflix and she is interesting in getting it. So we went out and got a Chromecast device to plug into the TV. The idea is you put Netflix on the tab and it wirelessly projects onto the TV through the Chromecast. While, I couldn’t find the Netflix app on her tab. It said the tab was too old. So I found a work around and downloaded an older Netflix app from a website. While that worked fine and I signed her up. But the “casting” wouldn’t work either because the tab was too old. So the device was basically useless and we’re back to square one. Fortunately, she will be able to watch Netflix through Telus Optiks, which she signed up for. So after all that I headed to

the island for some camping. I’m not much of a camper but after spending $75 on the ferry (each way) I sure the heck couldn’t afford any motel. Last year I borrowed camping gear from my sister. It worked pretty well except for the air mattress which kept deflating. Now I’m a large fellow so I get it but it was still pretty annoying. I would finally get to sleep after an hour of being serenaded by crickets and owls and I would awaken another hour later on a flat mattress. I would then have to flip myself over and push myself up and try to find the opening flap and not trip over the entrance as I basically launch myself out of the tent which is certainly not made for grown men. Then I would take the deflated mattress and pump to the nearby washroom building to pump it up and hopefully not wake everyone up in the campsite. Anyways, the new air mattress worked much better. It has a hand or foot pump and was able to last

the entire four days with no problems. That’s not to say I slept perfectly. I still tend to hear every little peep from every nearby creature. Some people enjoy that aspect of camping but for me not so much. But I’m getting better. The bigger, firmer mattress helped as did the quick assembly pop-up tent. I still remember the time I went camping as a youngster with my cousin Joe. We put our tent up and went to sleep. In the middle of the night we got up and I said, “Joe, look up at the stars and tell me what you see.” Joe replied, “I see millions and millions of stars.” I said, “and what do you deduce from that?” He said, “Well, if there are millions of stars and a few of those have planets, it’s quite likely some of those planets could be like earth. And if there are planets like earth out there, there might also be life.” I then said, “Joe, you moron, it means that somebody stole our tent.”

It’s time to cull the deer herd Editor, The Gazette: I wish the animal activists would come and see the chaos created by the “cute bambis” who roam the streets of Grand Forks. Despite my best efforts: deer fencing, reflective tape, strategically placed lawn furniture and an extension ladder—the “cute bambis” tore down the fence to my vegetable garden and what they didn’t eat they spat out and what they didn’t spit out

they stepped on. On our street (10th Street North), two females gave birth, one to twins and the other to triplets. Now two becomes seven. Two more females gave birth to single babies. Now seven becomes 11. Do you see a pattern here? Lest you think the residents of Jasper and Banff love their “cute bambis,” they don’t. Their park wardens don’t need to beg permission to cull the herd (cull

all the data, to get an idea of how much water may be leaking from the city’s main pipes. The engineers suggested that if the estimated leakage is more than 15 per cent, that the most cost effective approach to water conservation would be to do leak detection and repair. Use meters for data collection Editor, The Gazette: How much would it cost for the City of Grand Forks to test the accuracy of local industries’ water meters? Last year, the CAO told me it would be too expensive. But, as far back as five years ago, expert engineering companies have been recommending this to our city. Why would our city be considering installing more water meters if it can’t afford to properly take care of the ones it already has? As a delegation on July 20 at the Committees of the Whole meeting, I proposed that the first thing our city do towards water conservation is to follow the advice of the engineers and test the city’s existing water meters to make sure they are measuring all the water flowing through them. Once the city can trust the measurements of its water meters, it can collect and examine

The lawsuit specifies that Andrew Barrie’s son saw Ron and Jacqueline Legare get swept away. He escaped and managed to pull his mother to shore with him, and then watched as his father floated downstream rapidly. Andrew Barrie was unable to free himself from the fast-moving waters. The family alleges he “experienced grievous personal injuries, pain and suffering” before he eventually drowned. His body was recovered seven days later approximately one kilometre downstream from Cascade Falls. In the lawsuit, the family of Andrew Barrie state that tubing down the river is an activity that is promoted at local tourist centres and by the province. They also allege that no warning is given anywhere about the dangers of the falls and the approaching rapids. It also claims that the river was particularly high that year, and was therefore especially dangerous. The lawsuit names the Ministry of Forests, Lands and Natural Resource Operations; Ministry of Jobs, Tourism and Skills Training; Destination BC; RDKB; City of Grand Forks; City of Christina Lake; Scott McNeill; Kathy MacNeill; Jacqueline MacNeill; Jamie MacNeill; the estate of Ron Legare; the estate of Jacqueline Legare; and five separate government entities.

We don’t have any jurisdiction.” The City of Grand Forks also responded stating that they had also turned the case over to their liability insurers, Muncipal Insurance Association. An experience where incredible music and stunning nature collide—that’s the vision of the Ponderosa Arts and Music Festival and it’s coming soon to Rock Creek. The creators and organizers of the Ponderosa festival are friends Kris Hargrave and Kia Zahrabi. The two live in Vancouver, but spent most of their years growing up in the South Okanagan. The idea of putting on the festival came to them last summer after a camping party at Zahrabi father’s farm in Oliver. “Kris and I started talking about the festival around this time because we were looking at potentially needing a larger site to host the party,” Zahrabi said. “Kris grew up on a farm in Bridesville and he had suggested it as a potential location for hosting the party.” The pair secured the Rock Creek Fairgrounds and began calling agents to start booking a lineup of independent musicians and bands from a

wide variety of genres. “We both have a love for music and also had a desire to bring more friends out to experience this beautiful part of B.C. We both also have friends in Vancouver that are in bands and thought it would be a sweet idea to get them involved,” Zahrabi said. Ponderosa is a full-on arts and music festival, he added, but their focus has always been on maintaining an intimate and personal environment. “We promote nothing but good vibes.” The Rock Creek Fairgrounds is a great venue for such a festival, held this year from Friday to Sunday, Aug. 21 - 23. The Riverside Campground is “a little slice of paradise” that can be yours for only $25 extra per camper (sorry, no hook-ups available). Washroom facilities at the campgrounds include flush toilets, inks and coin-operated hot showers. There are drinking water taps spread throughout the campgrounds and on the fairgrounds site. Angela Furey-Demas June 11, 1944 – July 25, 2015

Passed away suddenly in Grand Forks, British Columbia, Angela Furey-Demas formerly of Avondale, Conception Bay, Newfoundland. Angela’s brilliant and creative mind earned her highest academic scholarships to pursue teacher education at St. Bride’s College and Memorial University of NL. Angela’s teaching career spanned 37 years throughout Newfoundland, Ontario and Alberta. Although she began her teaching career as a junior high teacher, Angela devoted most of her passion for teaching early childhood and primary children. Angela retired in September 2001 to spend more time with her family and in 2008 she and her husband Kevin Demas moved to Grand Forks, B.C. to enjoy the climate, golfing, and gardening. Angela is predeceased by her father Arthur Furey, infant siblings Mary and William, sister-in-law Jenny Furey and first husband Frank Morgan. She is survived by her husband and soul mate, Kevin Demas, mother (Anastasia Furey), daughter (Michele Nichols), siblings Beth, Edith, Mary (Brian), Art (Karen), Gerard (Pat), Harold (Agnes), Pad (Sharon), and Nick (Bernadette), her special grand children (Anastasia Nichols, Zachary Patterson, Paige Lawson-Demas and Bailey, Montana, Nathaniel and Nick Demas) as well as a large circle of nieces, cousins and friends. Viewing was held in the Chapel of Grand Forks Funeral Home on Tuesday, July 28 at 2:00 p.m., Grand Forks, B.C. A funeral mass will take place at Assumption church, Avondale, Newfoundland in September. Flowers gratefully accepted or donations in Angela’s memory may be made to the Heart & Stroke Foundation or Alzheimer’s Society. Angela was a kind wonderful person who truly loved life. She will be dearly missed and forever in our hearts, thoughts, prayers and memories.

Drinking and boating continues to be a factor in approximately 40 per cent of boating-related fatalities. An IPSOS-REID study commissioned by the Canadian Safe Boating Council and conducted in 2014 cited some disturbing perceptions amongst boaters who drink and boat at least occasionally. These included: 1. It’s not dangerous to drink and boat. 2. Drinking while boating is just part of the overall relaxing experience. 3. The chances of getting caught are extremely remote. With respect to the chances of getting caught drinking and boating being extremely remote, the probabilities in 2015 have increased significantly based on two initiatives that are in full swing this season. The first is called “Operation Dry Water” which was initiated by the Canadian Safe Boating Council in 2013 and has progressively gained momentum to the point where it should be in full swing across Canada this upcoming season. It runs during the August long weekend and involves police agencies making increased vessel checks to both educate boaters on the dangers of drinking and boating and to enforce their local laws relating to the practice. The second is called “Help Us Catch Impaired Boaters – Dial 911. It was introduced in 2014 across most of Canada, again by the Canadian Safe Boating Council, and eagerly received by police and 911 agencies alike. The intent of the initiative is to both act as a preventative influence and to empower everyone on the water to report instances of suspected impaired boating. Make this season one in which you’ll decide to leave your beer on the pier for when you return.
