The Supreme Court stayed a hearing on the Petition, a court document filed this summer aimed at ousting four members of Greenwood City Council. The court’s decision was outlined in a letter to the city from Barry Williamson of Young Anderson Barristers and Solicitors. In it, Williamson summarized Justice Peter Rogers ruling that the petition was not in compliance with the Community Charter Section 111, and consequently was inadmissable. However, the petitioners do retain the option of rewriting the petition so that it complies with the charter and submitting the revised document to the court. “The status of the petition following Justice Rogers’ ruling, is that it is stayed until the deficiency in the initial proceeding has been remedied,” Williamson said. “While we understand Mr. Yates is interested in reserving a date for a hearing of the petition grounds, in our view this would be premature until a petition in proper form has been filed by the petitioners.” The letter, which is now on public record at City Hall, also included several paraphrased descriptions of Justice Peter Rogers’ findings during the proceedings. “While Exhibit ‘A’ to the affidavit filed by Mr. (Christopher) Yates is a petition signed by 26 individuals in support of the petition,” Williamson wrote, “they are not named as petitioners in the petition itself. RCMP recover stolen motorcycle Vehicle stop results in charges On Nov. 20 at 1:25 p.m., Midway RCMP were called by a concerned citizen regarding a suspicious vehicle in Greenwood. An older model Chevy truck with an orange motorcycle in the back box of the truck was located and the male driver and female passenger stopped. The driver had no driver’s license and the motorcycle was discovered to have been stolen from Kelowna. The male was arrested and charges are before the court on Jan. 12,

The driver was issued a violation ticket for no driver’s license, no insurance and misuse of plate. The vehicle was impounded. had framed the style of cause as ‘Yates et al.’ As Justice Rogers noted, there is no individual named ‘et al’, although it is a term frequently employed to refer to a number of plaintiffs, petitioners, respondents or defendants. It is not, as pointed out by the court, a substitute, however, for properly naming the required parties in an initiating process, such as a petition. “Justice Rogers identified the alleged lack of compliance as a threshold issue that should be addressed at the outset as the outcome could conceivably result in the dismissal of the proceeding,” continued Williamson. “After hearing brief submissions, the judge ruled orally that the petition, as filed, was deficient for failing to comply with Section 111 of the Community Charter. The significance of the 10 petitioner (minimum) requirement was to ensure, in the judge’s words, that as few as one or two disgruntled individuals could set in motion such an
important process. The Legislature deliberately imposed the 10 petitioner requirement to address that concern.” The letter goes on to describe the allegations of the petition and outlines Rogers’ costs ruling. “Justice Rogers ruled that the respondents were entitled to their costs of the cause in respect of the Nov. 18th hearing. That means that if the respondents are successful in the end result of having the petition dismissed, they have certainty that the costs of this hearing have been awarded in their favour. However the petitioners cannot recover any costs in relation to the court ruling to stay the petition even if they were to succeed later.” When reached for comment regarding the letter, Yates said, “It is defamation, which has led to a complaint being filed with the law society against the lawyer and a copy being sworn into record for the judge to see when we are next before him.” Lawyer Williamson told the
Boundary Creek Times that the letter’s content was derived entirely from Justice Rogers’ Nov. 18 hearing, and that Rogers’ oral ruling would eventually be transcribed. Williamson also stated that his letter was typical of standard practice, whereby such correspondence is designed to summarize court proceedings for those unable to attend a hearing. Mayor Smith declined to comment at this juncture.

The debate over grizzly bear hunting continues in this province, home to the Great Bear Forest that attracts thousands of visitors each year, mostly hauling camera gear though many choosing a rifle as their method of capturing a memory. Trophy hunting of the majestic and iconic creatures continues to be a big attraction for hunters who are becoming increasingly reviled around the globe. The world has long condemned big game trophy hunters, whose quest for the “holy grail” of hunting, primarily the heads of wild game, may not be entirely responsible for the dwindling population of so-called “threatened” African lions, but must certainly be considered a contributing factor. During the last four decades, over-hunting has wiped out much of lions’ prey. This human-caused phenomenon, along with habitat loss, is viewed, by some wildlife scientists, as a major contributor to the dramatidecline in lion populations. The magnificent species has dwindled by more than 80 per cent of its historic range and is extinct in 26 countries that lions once called home. Only 20,000 remain in the wild, compared to a global population of 200,000 in the 1950s. While some agencies, among them the U.S. Fish and Wildlife Service, have stated publicly that they are not opposed to regulated trophy hunting, many others are. Wayne Pacelle, the president of the Humane Society of the United States, suggests that the first rule of protecting a rare species is to limit the human-related killing, while organizations like B.C.’s Raincoast Conservation Foundation refer to the trophy hunting of coastal grizzlies as not so much a sport but, rather, a search and destroy mission by hunters employing aircraft, electronic aids, and transport to arrive on a river, walk up to bears and shoot them while they feed. Raincoast has been at the forefront of the campaign to end the grizzly hunt for nearly two decades and, with public support, has acquired the commercial trophy hunting rights to over 28,000 square kilometres of the Great Bear Forest. The foundation’s goal is to gain control over all such rights on the B.C. coast and in doing so put an end to trophy hunting. Most Canadians would like to see them succeed, including traditional hunters, many of whom would never consider hunting an animal purely for sport.

On Nov. 4, as I did most days, I was walking my two dogs up Boundary Creek Road. Zak and Lea have been like my family for 13 years and we all looked forward to our daily walks, but that all changed on that terrible day. We were walking up the road on the northbound shoulder, and the dogs were crossing the road towards me. All of a sudden a logging truck came flying
around the corner over the centre line onto the straight stretch. Zak made it across in time, and Lea was just crossing the centre line. The driver of the truck made no attempt to slow down or get back in his own lane, but chose to kill Lea instead. After leaving Lea crushed and her body parts spread all over the road, the driver didn’t even stop; in fact, he sped up and carried on down the road. Needless to say, I was horrified, and still have trouble sleeping. That cold-hearted person didn’t seem
to care that he had just killed a family pet. These drivers are supposed to be professionals, but he didn’t even have the decency to stop. I haven’t gone for a walk since, because it would bring back that painful memory and I also fear for my own safety. Every day there are people walking, biking, riding ATVs and even cattle on the road. Drivers need to slow down on that straight stretch so this doesn’t happen again, and speed signs should be erected. Leo Bohn, Greenwood

Over 80 shoppers, mostly dressed in western attire, passed through the doors during the two-hour event. City agrees to discuss tourism tax
Council agrees to discuss MIDWAY tax Cavan Gates from the Christina Gateway Community Development Association (CGCDA) asked for a motion to support the Municipal Regional Tax for Boundary Tourism. The two per cent tax would be added on to all motel and hotel charges, which would be collected by the province and made available to promote tourism in the region. Council agreed to discuss the issue and draft a response by the next regular meet-
ing.

Greenwood Public Library played host to Kaslobased wildlife and landscape photographer Jim Lawrence and documentary filmmaker Miriam Needoba last Wednesday as the pair continued its southern interior tour in promotion of Needoba’s short film entitled Eyes in the Forest: The Portraiture of Jim Lawrence. The 12-minute video showcases the photography of Lawrence as well as featuring Needoba’s cinematographic vision of the largely untouched Selkirk Mountain Range and the creatures that call it home. What’s next for watershed plan?
In the last column I reviewed a few of the main activities and initiatives of 2015 for the Kettle River Watershed Management Plan. Today I want to look ahead to 2016, sharing a few of the priorities in the plan that our steering committee and advisory group are committed to achieving. On Nov. 19 we held a second meeting with a large group representing water suppliers from across the Boundary. There were farmers, municipal councillors, small water utility operators and technical staff, there to talk about how we can better respond to drought. Two main points emerged. First, the group identified that more information sharing and education was needed for water users and ratepayers in how (and why) to reduce water use in different settings. That could include everything from bulletins and columns to hands-on demonstration and door-to-door contact to support compliance with water regulations. This relates to several actions in Strategy 1 in the Plan. Second, the group recommended developing a common approach and terminology in a water conservation and drought response strategy (Action 2.3.1 and 2.4.1).

GRAHAM WATT The B.C. Drought Response Plan clearly articulates a role for local partnerships in responding to drought, providing a good starting point for our discussions. Though as some group members pointed out, our strategy needs to be proactive, not reactive, by instilling widespread water conservation practices that help reduce the impacts of drought before we even get to water restrictions. We will be discussing these points with water suppliers over the coming months in order to develop a sound and well-supported strategy that could be adopted as policy across the region. Another major initiative for 2016 is building an online map-based interface so the public and decision-makers can learn more about their water supplies, discover reports and monitoring infor-
mation, and connect the dots between different issues (Action 1.2.1). Relevant information is currently housed in dozens of different websites and databases, making it difficult to put together a current and coherent picture of issues such as drought, land use impacts or ecosystem stresses. Throughout the planning process, many people have shared their concerns about protecting the headwaters – our ‘water towers’ in the mountains and plateaus – from the impacts of different land uses and activities. While some point the finger at one group or another, the problems are really cumulative and interconnected, so we need to look deeply at the issues (as in the Granby Wilderness Society’s Riparian Threat Assessment) then work together on meaningful solutions (Direction 3.1 and 3.2). To that end, we are planning to work with the Okanagan Nation Alliance Natural Resource Committee to co-host a community forum this winter on protecting the headwaters (Action 1.1.5). We are really excited about learning more about our common interests in the headwaters and about First Nations knowledge and per-

spectives about land and water. Stay tuned for more details. We will be continuing to work with the Boundary Habitat Stewards and other partners to restore habitat around streams, lakes and wetlands, and connecting with planning initiatives by local governments, forestry and agriculture to improve watershed health and function. Of course, there are other priority actions that various stakeholders wish to support or lead as we move forward – I look forward to hearing from you about your priorities and commitments. As the plan indicated, many different organizations share responsibility among their various jurisdictions for protecting and managing water, and we need to work together to ensure policies and practices are connected, consistently and effectively, by the one common thread of healthy, functioning waterways and ecosystems. Awards night wraps up 4-H year
The Boundary C 4H Club held its annual awards dinner and dance at the Bridesville Community Hall last Friday, with numerous badges and certificates being handed out to the hard working club members. Highlights of the club’s year included a combined first place overall in the beef division at the Provincial Winter Fair in Barriere and its first ever sheep division, which also faired well at the fair. The club’s top member overall for 2015 was Marijka van Kuik, who was awarded the Jason Elliot Memorial Trophy by leader Greg MacDonald (bottom left). Boundary Central Secondary School’s production of All Shook Up has been an ambitious undertaking from the outset. Teacher Sarah Tripp acknowledges that
she and her unusually large class took on a big challenge when she selected the Elvis Presley-inspired musical comedy. Made even more daunting by her need to double-cast most of the roles, allowing her to feature all of the nearly thirty students in this year’s drama and music class, the show also features a significant number of costume and set changes, adding another layer to the complex “comedy of errors.” When asked what her greatest challenges have been in staging the musical, Tripp says matter-of-factly, “The number of songs and choreographed dance pieces, which are

doubled due to the production having two casts.” In fact, Tripp had doubts early on in rehearsals that she and the cast would be able to pull everything together and present All Shook Up as she had envisioned. Citing her students’ challenging start as reflective of an extremely steep learning curve, she now sees the production becoming more polished and, just as importantly, enjoyable for the cast and the director. Costuming for the show has been an adventure in of itself, with Tripp scouring every thrift store in both the Boundary and South Okanagan for cost-effective, yet authentic attire. The 1950’s theme has
demanded much attention to detail, but the wardrobe is ready to go, including numerous pairs of “blue suede shoes” and a plethora of black jeans and tee shirts. Also challenging has been compiling some rather unusual props, such as the so-called “tunnel of love.” “If the kids can pull this off, as I know they can,” Tripp said, “All Shook Up will be the funniest and most enjoyable BCSS production I have worked on.” The play runs Dec. 9, 10, 14 and 15 in the school’s theatre beginning at 7 p.m. sharp. Tickets, already more than half sold, are $10 and can be reserved by calling the BCSS office at 250 449 2224.
