Veteran politician wins byelection SHERI REGNIER Trail Times

Mike Walsh, a veteran Montrose politician, will return to council following a landslide win in the village’s byelection on Saturday. The former Montrose mayor garnered 99 votes from 164 total ballots cast, securing the one seat that’s been empty since the October resignation of Coun. Mark Reid. Although he’s the clear winner, Walsh will sit in council chambers only as an observer until the first meeting next month. Chief Election Officer Bryan Teasdale clarified that before the new councillor begins his duties, a period of time must past before the swearing in ceremony. “Until the Oath of Office is taken, you can’t actually sit in,” Teasdale added. “It’s more of an observer status until he is sworn in.” The unofficial results are posted on the village’s Facebook page: Mike Walsh, 99; Linda Bouthillier, 26; Dwayne McDonnell, 23; Don Berriault, 16. Of the total votes, 64 were cast during advanced polling opportunities and 100 on Saturday, which was General Voting Day. “We were definitely pleased with the number of people who came out for our advance polls,” said Teasdale. “And with four people interested in running. Often in smaller municipalities (byelection positions) are filled by acclamation, and not an election, so it was nice to see people interested in pursuing that seat on council.” Montrose Mayor Joe Danchuk says he’s looking forward to working with Walsh, giving a nod to his past experience as well as to those who threw their hat into the ring. “We had great candidates and I want to thank everybody that ran,” he said. “This shows there is interest in politics in Montrose.”

Busy start to 2016 for South Columbia Search and Rescue VALERIE ROSSI Trail Times

Local search and rescue is attributing an increase in calls to the high snowfall, and braces as the forecast calls for more. South Columbia Search and Rescue (SAR) has been on five calls this year in relation to winter activities, with a most recent mutual aid this past weekend near Whitewater Ski Resort in Nelson. Four lost skiers were counting their lucky stars their Personal Locator Beacon signal was received by the Joint Rescue

Coordination Centre in Victoria Saturday night. The distress signal was picked up by the RCMP, who traced the device back to some overdue backcountry skiers, while Nelson Search and Rescue headed a search in the 5 Mile Drainage area. Due to darkness and avalanche danger, a helicopter rescue team and ground crew deployed at first light Sunday. The missing group was found in good health deep in the valley bottom in a snow cave shelter with a camp fire burning. Despite knowing the area well,

the group had become disorientated due to poor visibility and claimed to have skied in a circle before they realized they were in trouble. This weekend marks the third rescue in the 5 Mile Valley this year, which South Columbia SAR has assisted Nelson with. The local group of about 28 members has also responded to a snowmobiler who was having mechanical problems and a snow cat operator who had a medical issue. The handful of calls may not seem like much, but is a drastic climb from

last year where they responded to one call. “Usually, we’ll get three calls, maybe four, and that’s through the winter and we’re just getting started and we’re already at five,” said Mike Hudson, South Columbia SAR president. Six young women vying for top tiara Trail Ambassador Program is bringing popular pageant back this year VALERIE ROSSI Trail Times

The Trail Ambassador Program is hitting the stage with a competitive field of six girls vying for the crown this year. Organizers are happy to bring the program back to its traditional format after last year’s decision to split the responsibility when only three girls signed up. An element of surprise will again be unveiled when Miss Trail and Trail Princess are selected at a pageant in the spring. Keandra Billingsley, Trynity Turnbull, Caïa Gagnon, Naomi Savage, Nicole Johnson and Hannah Flick have met with their sponsors and are ready to represent at an upcoming event scheduled for 7 p.m. Feb. 12 at the KP Hall. The debut will showcase the candidates, who will introduce themselves and share a speech on their sponsor — be it Trail Firefighters (Local 941), Kiwanis, Knights of Pythias, Royal Canadian Legion (Branch 11), Colombo Lodge or Shoppers Drug Mart. The girls will then be adorned with a sash and given the “Miss” title that goes along with representing a local organization or business throughout the program. The Trail Ambassador Program continues to enrich and enhance the lives of young women by teaching life skills and promoting the City of Trail, according to coordinator Michelle Epp. The seven-month program brings together area professionals to train candidates aged 15-17 in topics such as public speaking, resume writing, interview skills, tourism, Trail history, nutrition, hair and skin care, money management, and much more. “The results” keep Epp committed to running the program, with help from Bev Benson.

year’s low enrollment numbers and the decision to simplify the program with the trio acclaimed to the ambassador role. Trail Ambassadors Timberlyn Miles, Gina Oostlander, and Serena Deadmarsh shared the onslaught of volunteer opportunities, pageants and parades throughout B.C. and

Washington to promote the city. “It was neat having them all equal instead of having a queen or princess, where one is viewed in the hierarchy as better,” added Epp. But the community missed the annual Miss Trail Pageant during Silver City Days and so did organizers. Epp is always floored to see each individual’s journey showcased at the Charles Bailey Theatre. Some girls slip on their first pair of heels or formal gown, others break out of their shell and find the confidence in communicating to a large crowd, and some learn the importance of volunteering and how to manage a busy schedule. “We like to open it up to every type of personality because everyone can benefit from it,” she said. “Sometimes we have people who we think, ‘Are you sure you’re going to get enough out of this?’ … and they always do.” She’s pleased to see former ambassadors move onto other competitions like the British Columbia Ambassador Program, which Ashley Horrill is currently vying for. Epp said Horril was crowned princess in 2012 and is a real example of how Miss Trail can help shape young women into confident community leaders. This will be Trail’s third ambassador to go after the higher title with Carley Henniger and Cheyanne Friess winning the provincial title in 2012 and 2014 respectively. “It shows that they enjoyed what they did and they got a lot out of it and they just wanted to keep with it,” said Epp. The B.C. program is open to young men or women between 17 and 24 years old who have held an ambassador or royal title in the province. The program promotes motivation, self-esteem and education with money fundraised awarded to candidates through bursaries. Program organizers also go after postsecondary scholarships at appropriate schools based on studies of interest.

Being prepared is first step to backcountry safety

CONTINUED FROM A1 snow, you think to yourself, ‘Oh boy, I hope today is not the day that we’re going to get a call,’” he said. “As soon as the big snowfall comes down, we know people are going to get out there and play in the powder and hopefully they’re not going to get into trouble.” The big snow brings “considerable” avalanche risk in the Kootenay Boundary, according to Avalanche Canada. The rating is tied to multiple small avalanches in the region and several rounds of snowfalls followed by melting and then

freezing, which creates an unstable snowpack. Add unpredictable weather and even the most seasoned backcountry skier can get turned around. “The first year that Red opened up its runs on Grey, we had multiple people getting lost, and it was all in the same spot, which made things quite a bit easier for us to go in and find them,” he added. Surprisingly, some people who were lost and hunkered down for a cold night were familiar with the mountain but just weren’t prepared. “We have a lot of people,

for instance at Red Mountain, who live really close to the mountain and are only going to go out for a 40-minute trek so they’re not going to take any pack with them, they’re not going to take a beacon with them, because they know they’ve been there before and they feel no issue can arise from it,” said Hudson. “That being said, a weather system can come in, they could get stuck and not being able to see and get off the beaten track, and now they have no equipment, no gear, not nothing, and now they’re in trouble.” South Columbia SAR con-

Kalmikoff ’s lawyer, Blair Suffredine, told Judge Donald Sperry that if Kalmikoff ’s bail is not revoked and she is not taken into custody until sentencing, there would be nowhere for her to go because her grandmother is ill and awaiting surgery and Kalmikoff ’s mother is also unable to supervise her because of her work. Suffredine asked the court for more time to try to find a

living situation for Kalmikoff, and agreed that she should remain in custody until then. Last month a jury found Kalmikoff guilty of five of six charges she faced, including two counts of robbery stepping from hold-ups at the Nelson and District Credit Union and Kootenay Currency Exchange. Her co-accused, Andrew Stevenson, is serving a tenyear prison sentence for his role in the same crimes.

Canadians want electoral reform from new government

oters made clear choices for change in the federal election, and one of those choices was for electoral reform. The Liberals, NDP and Green parties all loudly pledged that the 2015 election would be the last held in Canada under the first-pastthe-post voting system, and those parties collectively received nearly two-thirds of the popular vote in the election. Why did these

promises resonate with most Canadians? Because too many feel that their vote doesn’t count in the present system. The recent federal election resulted in a large Liberal majority, despite the fact that the Liberals only received 39 per cent of the popular vote. Coincidentally, this was the same level of popular vote that gave the Conservatives a strong majority in Ottawa in the 2011 election. The time for an electoral system

Police cellphone snooping has its limits in Canada

An editorial from the Toronto Star Should Canada’s courts routinely rubber-stamp police requests to snoop on thousands of cellphone users, in the hope of tracking down a few miscreants? Well, that would be No. Privacy rights still count for something in this country. The Peel Regional Police overstepped, big time, when they sought wholesale judicial production orders to get telecom giants Rogers and Telus to hand over personal information on no fewer than 40,000 customers in a bid to track down the robbers who carried out a series of jewelry store heists in 2014. The orders were “overly broad” and infringed on the Charter of Rights protection against unreasonable search or seizure, Ontario Superior Court Justice John Sproat has just ruled in a welcome decision that upholds basic privacy rights. At a time when Canada’s security services and the police are trolling as never before through our telecommunications, it’s heartening to see the bench raise a cautionary hand against needlessly intrusive fishing expeditions. Justice Sproat’s ruling, and the guidance it gives to the police, should at least help rein in the worst Wild West impulses. Police should shape their requests to snoop so as to impinge minimally on customer privacy, he stressed. The case at hand involved so-called “tower dump” production orders requiring Rogers and

Telus to hand over call-detail records from specific cellphone towers -- used by tens of thousands of customers -- in the vicinity of the robberies. The police hoped to track down criminals whose mobile devices had pinged the towers. Rightly, the telecoms balked at this overly broad order, which would have forced them to massively violate customer privacy. Typically such orders cover cellphone calls, text messages and email, and require providers to hand over peoples’ names and addresses, who they called, who called them, their location, and the duration of the call. The orders include billing details, including bank and credit card information. Both Rogers and Telus get slapped with thousands of orders a year. It’s a massive intrusion and as the over-the-top Peel Police request (since rescinded) illustrates, it is getting out of hand. “Canadians have a reasonable expectation of privacy in the records of their cellular telephone activity,” Sproat noted. “Whether and when someone chooses to contact a divorce lawyer, a suicide prevention hotline, a business competitor or a rehabilitation clinic obviously implicates privacy concerns.” So does a caller’s location. “Was the person at the Blue Jays game instead of at work?” In an age of widespread computer hacking, data theft, and security leaks, it can’t be taken for granted that such data will be

kept confidential once in police hands. While Sproat acknowledges that “tower dump” production orders are a valuable and legitimate investigative technique, the potential for abuse is obvious. With that in mind, he issued some guidelines for police to narrow their requests. Police should provide the court with assurance that they recognize that any infringement on privacy rights must be minimally, not maximally, intrusive. They should also spell out how their focus on certain cell towers, dates and times, plus the records they seek, are directly relevant to the investigation. They should help the telecoms narrow their search, and generate fewer records, by making requests as specific as possible. Where criminals might be liaising by cellphone during a hot robbery, for example, the police might focus on brief calls, rather than long ones. Or in the case of serial robberies, the police could request information only on the few customers who happened to be near more than one crime scene. If police require details about a customer’s personal information they should justify the request. And the police should confirm that they can make meaningful use of the amounts of data they seek. It’s sound advice. And if it spells an end to fishing expeditions, so be it. Civil rights are not lightly to be thrown away.

I think Canadians have already signalled that the government should move ahead on electoral reform, joining over 90 per cent of the world’s developed countries that have abandoned first-pastthe-post. They want a new system that will make every vote count and fight political cyn-

BY TIMES STAFF The Beaver Valley Nitehawks continue to roll, winning their fourth in a row on Sunday with a 4-1 win over Spokane, after gaining a measure of revenge against Castlegar Friday with a 6-3 victory over the Rebels. Brett Clark had a successful return to the Nitehawks’ net picking up his first win in his first start for B.V. in two seasons. Clark stopped 30 shots in a heated affair that saw over 60 minutes in penalties handed out, and it was Brett Roberts’ power play goal that proved the winner at 4:05 of the first period. The Hawks defenceman scored his eighth of the season on a set up from Michael Pruss and Ryan Terpsma to give B.V. A 2-0 lead. The win is B.V.’s 29th of the year

Eagles co-founder Glen Frey, who sang ‘Take it Easy,’ dies THE ASSOCIATED PRESS NEW YORK – Glenn Frey, who co-founded the Eagles and with Don Henley became one of history’s most successful songwriting teams with such hits as ``Hotel California’’ and ``Life in the Fast Lane,’’ has died. Frey, who was 67, died of complications from rheumatoid arthritis, acute ulcerative colitis and pneumonia, the band said on its website. He died on Monday in New York. He had fought the ailments for the past several weeks, the band said. ``The Frey family would like to thank everyone who joined Glenn to fight this fight and hoped and prayed for his recovery,’’ a statement on the band’s website said. ``Words can neither describe our sorrow, nor our love and respect for all that he has given to us, his family, the music community & millions of fans worldwide.’’ Guitarist Frey and drummer Henley formed the Eagles in Los Angeles in the early 1970s, along with guitarist Bernie Leadon and bassist Randy Meisner. They would become a top act over the next decade, embodying the melodic California sound. An Eagles greatest hits collection from the mid-1970s and ``Hotel California’’ are among the bestselling albums in history. Frey was born in Detroit and was raised in its suburbs. His solo hits include ``The Heat Is On’’ and ``Smuggler’s Blues.’’ Frey was lead vocalist on the Eagles’ breakthrough hit, ``Take It Easy,’’ a song mostly written by Jackson Browne that came out in 1972. His other showcases included ``Peaceful Easy Feeling,’’ ‘’Already Gone`` and ‘’New Kid in Town.`` The Eagles split up in 1980 but reunited in 1994 and were one of the world’s most popular concert acts. The band, which for years was made up of Frey, Henley, Joe Walsh and Timothy B. Schmit,

was supposed to have been honoured at the Kennedy Center last month. But the appearance was postponed because of Frey’s health problems. Frey, known for his oversized jaw, big grin

and blunt personality, loved music, girls and the rock ‘n’ roll life. He would meet up with Henley, Meisner and Leadon while all were trying to catch on in the Los Angeles music scene, and for a time

the four backed Linda Ronstadt. They also befriended such other Los Angeles-based musicians as Browne and J.D. Souther, who would collaborate on ``New Kid in Town’’ and other Eagles songs.

OBITUARIES Blair Coombs Blair was born in Rossland, BC on March 28, 1948 and passed away on January 4, 2016 at Kootenay Boundary Regional Hospital after a courageous battle with cancer. Family members were at his bedside until the end. He is survived by his loving mother Rita Coombs, brother Gordon (Valerie), sister Beverley (Lix), ex-wife Anne, daughters Laura, Sarah, Marielle (Chris), grandchildren Ava, Michael, Max, Bruno, niece Lori, nephews Boyd and Greg (Kris), great-nephews Wyatt and Forest, great-niece Trinity, uncles, aunts, and friends. He is predeceased by his father Wellesley William Coombs, brother Wessy, grandparents Gordon and Alice Coombs, William and Marguerite Pritchard. Blair grew up in Trail and graduated from J. Lloyd Crowe in 1966. His greatest joy was the outdoors, camping and picnicking with his children at Nancy Greene Lake. He loved animals, always had a pet dog or cat, and had a good heart. Blair did not want a funeral service and cremation has already taken place. The family wishes to extend their gratitude to Dr. Houde and the nurses at KBRH who cared for Blair.

Fred is predeceased by his parents Robert and Elizabeth, brother Gary, brother in law Avery and nephew Wesley. He is survived by his loving wife of 51 years, Sandra, children; Leonora, Teresa, Ron (Jenny), Brenda and Maureen (John), 23 grandchildren, 3 greatgrandchildren, his mother, Anne, sisters; Eleanor, Diane (Harvey), Christine (Blair) and numerous other family and friends. Fred worked at Cominco for 30 years and was a chartered member of the Rossland Lion’s Club. He spent numerous hours walking on Main street in Rossland collecting coins to donate to the club. He also was security for the Rossland Warriors hockey games and will be remembered for his loud yell. Not too many people were able to get past Fred without receiving one of his very firm handshakes. In his later years he enjoyed attending the bridges program at Columbia View Lodge and was always excited to go to the casino. The last 5 years were his most enjoyed as he was able to spend quality time with his family watching his grandchildren and great grandchildren grow. A Celebration of Life will be held on Saturday, January 23rd at 1:00pm at the Warfield Hall. Thank you in advance to Jim and Sharon Merritt for officiating the service. During her work career, Marilyn enjoyed engaging with the public and assisting in any way she could at the Phoenix Mine and at Greyhound, both Grand Forks and Trail. Whether at the lake, home in Trail, or at work, Marilyn was always baking for friends and family as an expression of her love. Over the years, Marilyn involved herself in everything her family was interested in: Trail Minor Hockey, Order of the Eastern Star, Job’s Daughters, Boy Scouts, and Highland Dancing. Our mother and grandmother, not only made our house a home, but she made it a special haven for us all giving selflessly and generously. Marilyn was a friend and “Mom” to the many that walked through her door. She will be remembered fondly as a confidant who was never too busy to help you out of a jam or to talk; she would sympathize but advise you with clear directions for your next step. She was the strongest person any of us has ever met. Marilyn’s smile, kindness, and words of wisdom live on forever in our hearts. Our lives and family gatherings will never be the same. THE ASSOCIATED PRESS NEW YORK - Calls for a boycott of the Academy Awards are growing over the Academy of Motion Pictures Arts and Sciences’ second straight year of mostly white nominees, as Spike Lee and Jada Pinkett Smith each said Monday that they will not attend this year’s ceremony. In a lengthy Instagram post, Lee said he “cannot support” the “lily white” Oscars. Noting that he was writing on Martin Luther King Jr. Day, Lee - who in November said he was fed up: “Forty white actors in two years and no flava at all,” he wrote. “We can’t act?!” In a video message on Facebook, Pinkett Smith also said she wouldn’t attend or watch the Oscars in February. Pinkett Smith, whose husband Will Smith wasn’t nominated for his performance in the NFL head trauma drama “Concussion,” said it was time for people of colour to disregard the Academy Awards. “Begging for acknowledgement, or even asking, diminishes dignity and diminishes power,” she said. “And we are a dignified people and we are powerful.” Last year’s all-white acting nominees also drew calls for a boycott, though not from such prominent individuals as Lee and Pinkett Smith. Whether it had any impact or not, the audience for the broadcast, hosted by Neil Patrick Harris, was down 16 per cent from the year prior, a six-year low. This year, academy president Cheryl Boone Isaacs has made a point of presenting a more inclusive show. The Feb. 28 broadcast will be hosted by Chris Rock and produced by “Django Unchained” producer Reginald Hudlin and David Hill. On Saturday, Rock, unveiling a new promotion for the broadcast, called the ceremony “The White BET Awards.” The academy didn’t immediately respond to messages left Monday. In his post, Lee made it clear the Academy Awards is only part of the problem in an industry with deep-rooted diversity issues. “The Academy Awards is not where the ‘real’ battle is,” wrote Lee. “It’s in the executive office of the Hollywood studios and TV and cable networks.”

THE ASSOCIATED PRESS PASADENA, Calif. - Fox is calling this the farewell season of “American Idol,” but the stars involved with the singing contest sound unconvinced. “I think the Eagles had at least three farewell tours,” judge Keith Urban told a TV critics’ meeting Friday. Given the show’s record of success and heritage, “does that mean this is the end?” long-time host Ryan Seacrest said. “I’m not so sure.” Fellow judge Jennifer Lopez said a return is possible, adding later, “I’ll always be there when they call.” Executive producer Trish Kinane declined to address why Fox decided to end “Idol” after 15 seasons. But the expensive-to-produce show’s ratings have steadily eroded in recent years, with the 30 million-plus viewers it attracted at its 2006 peak a distant memory - hence Fox’s announcement last May that this season would be its swan song. “American Idol,” which averaged about 11 million viewers last season, has rebounded somewhat by holding steady at close to that. Viewers appear inclined to take a last look at the show that produced stars including Kelly Clarkson, Carrie Underwood and Jennifer Hudson. Fox didn’t immediately respond to a request for comment on the remarks by Seacrest and the judges. Whatever the show’s future, the network is making the most of the season by bringing in former winners and contestants including Ruben Studdard, David Cook and Jordin Sparks, and with pop stars promised for the typically grand finale. Clarkson, the show’s inaugural winner, isn’t letting her pregnancy keep her from taking part, Kinane said: She will be a guest judge on Feb. 25 and may participate further if possible. Simon Cowell, the acid-tongued Brit who was part of the original judges’ panel that included Paula Abdul and Randy Jackson, is a busy man but is expected to appear on the finale this spring, Kinane said.

‘Music of Vienna’ comes to the Kootenays CHELSEA NOVAK

She also plays with a trio in the area and says that attendance at classical music concerts isn’t always that great. She and Kavanagh are hoping that holding the concerts to benefit community organizations will help convince more people to come out. “I’ve done fundraisers for the KBRH and there a lot of fun and you get a pretty good crowd,” says Cameron. Admission is by donation at the door and donations will benefit the evening’s organization of choice. The other two concerts will benefit the Trail Hospice Society and the West Kootenay Friends of Refugees. Details for the three concerts are as follows: First concert: Friday, Jan. 22, 7:30 p.m. at 910 Earl St., Rossland. Two local musicians are holding a threepart concert series to raise money for local organizations. Violinist Carolyn Cameron and pianist Dawna Kavanagh will be playing three “Music of Vienna,” concerts before midFebruary, the first being held in Rossland at Mayor Kathy Moore’s house on Friday, Jan. 22 to benefit the KBRH Health Foundation. “It’s all the same program; it’s violin and piano music and I titled it “Music of Vienna” because all of the composers of this program have ties in one way or another to Vienna,” says Cameron. The pair will be playing music from Mozart, Fritz Kreisler, an Austrian-born violinist and composer, and Haydn. “Haydn was considered one of the composers who actually put Vienna on the map in the 18th century,” explains Cameron. “So he was pretty key in making Vienna the centre of European music at that time.” Cameron and Dawna Kavanagh haven’t been playing together that long, so this will be a good opportunity for people to hear them play as a duet for the first time. “Dawna taught both of my kids piano and we only started playing together I guess this year, well 2015,” says Cameron.
