Snaw-Naw-As First Nation has initiated a civil lawsuit in B.C. Supreme Court against the Island Corridor Foundation and the Attorney General of Canada over the E&N rail line. The lawsuit asks for the return of Snaw-NawAs land that was taken in the last century to build the railway, which runs through the reserve north of Nanaimo. “The corridor, that was taken out of the reserve for the railway, was expropriated back in the early part of the 20th century and one of the conditions that goes with any expropriation like that for railways is that once it’s no longer needed or used for railway purposes, it goes back to the original owner,” said Robert Janes, Snaw-Naw-As legal counsel. “We are just bringing a claim to ask the court to determine that fundamentally, given where things are with the E&N Railway, that the time has come to return the land to Snaw-Naw-As.” The foundation, a non-profit organization formed in 2003 to manage the railway, is awaiting $7.5 million in federal government funding to restore passenger train service to Vancouver Island. Passenger service was discontinued in 2011 due to unsafe track conditions. Conditions for funding from the federal government include the completion of a federal project review, signing of a contribution agreement and confirmation no more federal money will be needed. “If the E&N can actually prove that they are planning to genuinely run a railway, and have the ability to run a railway, and have the money to run a railway, then that obviously would impact the basic underlying part of our claim,” said Janes. A phone message to the Island Corridor Foundation was not returned. Bill McKay, Nanaimo mayor and chairman of the foundation’s board, said he had no comment as the board hasn’t been briefed on the situation yet. A response to the civil suit has not been filed at Victoria court services. Janes said the attorney general was named because technically the land is owned by the Crown.

Nanaimo and District Hopsital Foundation’s 23rd annual Lotto for Life, which supports Nanaimo Regional General Hospital’s patient, diagnostic equipment and construction programs, has been tallying up tickets sales since early Janu-
ary, offering purchasers chances to win 80 prizes, including a $100,000 grand prize, a new car, a Mexico vacation package and more. “All of the prizes are supplied by local, central Island businesses,” said Brenda Rositano, foundation director of corporate relations. Those local businesses give serious discounts to help the foundation purchase their products for prizes. Minister refuses to cancel logging permit

Residents fighting to save Lantzville forest are looking at partial protection for an active woodlot as B.C.’s forest minister makes it clear he won’t end timber harvests. Organizers of Save Lantzville Forest, a grassroots group, are working on a new proposal to protect Woodlot 1475, a 256-hectare property in upper Lantzville, which is 96 per cent Crown-owned. The District of Lantzville recently released a letter from B.C. Forest Minister Steve Thomson which shows the
community could request a reduction in the annual allowable cut of Woodlot 1475 if it purchased the licence, but the minister is not able to consider canceling requirements to remove timber all together. The purpose of the lot is to manage and harvest timber “as well as manage for other values,� he wrote. Thomson also reiterated his support for the woodlot program and the challenges tied to an alternative use of the area, which includes finding replacement lands for the cur-
rent licensee when Crown land is “very constrained� on southeast Vancouver Island. It’s a response to a meeting held in November between Thomson, Parks ville-Qualicum MLA Michelle Stilwell and Lantzville council on the woodlot, where local politicians expressed concern about watershed health and interest in alternative management opportunities for the area, including designation of the woodlot as park. Lantzville council had previously agreed to support the community efforts to protect the lot, which organizers of Save Lantzville Forest have argued has recreational value and species at risk. Mayor Colin Haime called the govern-
ment’s response a “little disappointing� and said he hoped if a community initiative were put forward, the minister would be open to considering other uses for the property. Coun. Will Geselbracht said an issue council might need to look at in the future is if the woodlot should become a “designated community watershed,� pursuant to the Forest and Range Practices Act, he said.
Ted Gullison, one of the residents behind Save Lantzville Forest, said the minister’s response is another example of how it’s prioritizing business over environmental issues and community concerns. He said a proposal is now being worked on to determine how much it would affect the profitability of the forest for the licensee if partial protection were implemented. news@nanaimobulletin.com

Inbrief Safety upgrades planned Details won’t be made public until after a ratification vote, but the Canadian union of Public employees 401 and the Vancouver island Regional library reached a tentative five-year collective agreement last week. The deal was struck Thursday after a bargaining process involving a mediator, according to a press release from the union. library workers voted 96.1 per cent in favour of striking in December over issues that included benefits and work scheduling. The tentative, five-year collective agreement would cover a term from Jan. 1, 2015 to Dec. 31, 2019. Natasha Bartlett, ViRl spokeswoman, confirmed the ViRl board of directors ratified the agreement at the annual general meeting saturday. CuPe members will vote sunday (Jan. 24).

Plans are in the works to improve Nanaimo’s Estevan Road, but it’s not happening soon enough for the president of the Brechin Hill Community Association. The City of Nanaimo has conceptual designs for changes to Estevan Road, a stretch behind Terminal Park that’s not considered pedestrian friendly. The city is considering putting Estevan on a “road diet,” reducing it from four lanes to two, creating lanes for cyclists, shorter crosswalks and potentially street parking. The philosophy when Estevan was created was to make improvements strictly for vehicles whereas today, the city is taking a more holistic approach to create facilities that work for transit users, pedestrians, cyclists and drivers, according to Poul Rosen, the city’s senior manager of engineering, who doesn’t anticipate this project will carry a big expense. It’s anticipated to get underway in a couple of years. Michael Harrison, president of the Brechin Hill Community
Association said his group would love two lanes, a concept that was included in the associations’ 2011 neighbourhood plan, along with a high street and parking on both sides. But he’d like to see work done immediately. “They were supposed to start something on this two or three years ago and it hasn’t been done,” he said. He said there has been safety concerns for the roadway and a desire for better-lit pedestrian crossings, more narrow lanes to slow traffic and more sidewalks, particularly outside École Océane. Nathan Middleton, a resident, and his son, Caelen, have also expressed concern, after a pedestrian was struck and killed at a marked crosswalk at the Estevan and Larch Street intersection. Caelen said you don’t feel safe crossing the road and flashing lights at crosswalks aren’t enough. Nathan Middleton said cars roar down Estevan like it’s a freeway. “We’ve been concerned about this for some time, but suddenly it’s an in-your-face accident that’s tragic that really brings it home,” he said, later adding it’s great news the city is taking steps to address the road. “It’s the first I’ve heard there’s some process underway.” news@nanaimobulletin.com

Ken Spence was called to evacuate homes in September 1977 as fire engulfed the Shell and Standard Oil plants in Nanaimo. He was put on the hoses instead. “We got called in, it was a gas tank fire and not a big deal and by the time we got there, it was a big deal,” said Spence, who marked 50 years as a volunteer with Lantzville Fire Rescue this month. “Forty-five gallon barrels flying over your head like popcorn, fireballs coming down and burning the backs off of boots of some guys. That was a scary one,” he said.“There were eerie sounds and whistles of fireballs before they took off. They stayed with you for a long time.” Spence, 66, is the longestserving volunteer firefighter at the Lantzville department, joining when he was 15 years old in 1966. He was looking for something to do when a friend asked if he’d be interested in

He was too young, but nobody else wanted it, said Spence, who found a year was enough and became a deputy chief – a position he held for more than 20 years. Volunteerism has been balanced with a career as an explosive technician and his family. It’s fair to say he’s missed a few dinners over the years. He never knew when he was going out or what he was doing, he said, with a quick laugh. When he was first dating his wife, he was supposed to meet her one evening at her place and never showed. He got called to a trailer fire and with no cellphones, she didn’t know what happened to him. “That was just about the end of the whole affair,” he said. “Luckily we got over that part and it’s been almost 39 years now.” After 50 years, Spence still enjoys being a volunteer firefighter. It’s dealing with the unknown more than anything, he said. He plans to continue as long as he has his health and something to offer others.

joining the department. He decided to give it a try. He knew a lot of the volunteers. He lived in the community since he was three years old when his father, a telegraph operator, was transferred from Wellington to Lantzville’s Canadian Pacific Rail station. Thanks to Spence’s job as a paperboy, he also knew everyone from one end of the community to the other. He was the youngest firefighter at the time, he said. The first call he got he couldn’t go to because he didn’t have his driver’s licence yet. It was an altogether different trade in those days. There was little training other than what you learned yourself, although in those days there were more calls to structure fires so you got experience quickly, he said. Today volunteers can go years without seeing a structure fire. Emergency calls would come in to the Lantzville store, across from the fire hall where the district offices are today. Owners Oliver and Edna Costin would set off the siren – volunteers’ only call to action – and Edna would wait on the steps to tell firefighters where to go. “You heard the siren or you didn’t hear the siren,” Spence

Honour women on our currency
Canada’s banknotes are polymer, counterfeit-resistant, holographic and modern. And they’re hopelessly behind the times. Canadian women need to be represented on Canadian currency. It’s a notion that was put forward by a citizens’ movement in Victoria and has now been championed by Nanaimo-Ladysmith MP Sheila Malcolmson, the NDP’s critic for the status of women. The lack of women on our bills wasn’t always this concerning. Our $50 notes used to feature the Famous Five and Thérèse Casgrain, advocates for women’s voting rights. But those ladies have long since been replaced by a decidedly masculine-looking Arctic icebreaker. With the removal of the human-rights heroines, that leaves us with an anonymous clip-art medical researcher on the back of the $100 and Her Majesty Queen Elizabeth II on the $20. The problem won’t solve itself. After the Queen’s passing – long may she live – the monarchy will be headed by king after king after king. And although we fully expect Canada will elect female prime ministers over the coming decades, it takes a long time for partisan politicians to become respected historical figures. It’s only right and it’s only fair that women appear on our money. Our country’s cabinet is 50 per cent women because it’s 2016, and other institutions should be similarly scrutinized. There are countless candidates whom we can honour on our banknotes. If worthy women don’t come to mind, then we aren’t looking hard enough. Their stories are under-represented in history texts, but of course women have always been here, building our country, our culture and our identity right alongside the men. Our polymer bills, however durable, will wear out, and we will need to print new ones, and we should always try to find ways to celebrate different segments of our society. Leaders, pioneers, artists, thinkers and difference-makers. Heroes and heroines.

Strict oversight needed in forests To the Editor,
Re: Avatar sequel bombs in Walbran forest, Opinion, Jan. 14. According to Tom Fletcher, a Sierra Club employee “lurks, apparently co-ordinating media and protesters” in the Walbran Valley. He’s referring to me. Far from lurking, I’m proud to be campaigning with Sierra Club B.C. to save the some of the last significant stands of unprotected old-growth on Vancouver Island. (And, to correct but one of the many misleading or false claims in Fletcher’s piece, Sierra Club B.C. is entirely independent.) Fletcher’s diatribe reveals him as Teal Jones’ willing stenographer, uncritically regurgitating the logging
action to defend endangered old-growth trees, wildlife, a stable climate, clean water and clean air. British Columbians know that these things form the life-support system of our planet and support long-term prosperity and a diverse economy, including sustainable second-growth forestry for current and future generations. It’s long past time for the provincial government to reverse the damage done when it gutted the rules governing logging. Fourteen years of trusting corporate interests to manage our forests with little or no oversight has got to stop.

correct. What some of us taxpaying citizens would like to know is how did this happen? As I understand some of the minister’s response, they are doing the best they can with the resources they have. That is truly rich. The same newscast informed me that last year Premier Christy Clark, the minister responsible, and the cabinet gave $400 million in subsidies to the film industry. These film corporations are mostly American-based.
On Monday, we saw the premier at a photo op ‘giving’ $100 million of our tax dollars away to tech companies. If the cabinet minister and Clark can’t run the business of this province so there is money to look after the children in care, but can give millions to industry, which in many cases aren’t even Canadian, it is suggested the B.C. Liberals find a replacement for both.

Core review key to future of Nanaimo To the Editor,
I was just recognized as a guy who ran for council years ago by a younger family man. He asked me a few questions. I told him I said no to the Port of Nanaimo Centre, but didn’t oppose the ice rinks. I told him how low-handed the mayor and council were to put forth a referendum that only had one check box. Voters thought it was yes to both or no to both. Real slimy. He asked me what I see for the future of Nanaimo. I was stumped for a second and all I could say was ‘core review.’ There’s no direction I can see until a proper core review is reviewed, analyzed, re-reviewed and discussed by heads that aren’t in the pockets of public unions. With about half Nanaimo’s tax base going to pay city wages, no wonder the streets of the south end are a mess.

For the past year we have heard four children died while in care of the ministry. One child had been living on his own in a hotel for over 40 days. If a parent did this, they’d probably be charged with child neglect and endangerment. Now we hear approximately 112 children, in care, were living in hotels. Then we watch the evening TV news and are informed there is a 16-year-old girl living in the homeless tent city in Victoria.
She was interviewed and explained she had spent a goodly portion of her life “in care” and found living in the tent city preferable to living in a group home. How a 16-year-old girl goes from being in a foster home to a group home to tent city is beyond me. I think its also beyond the B.C. Liberal government, the minister responsible and the premier. aintings can inspire music. This was the case when Russian composer Modest Mussorgsky attended an art exhibition in the late 1800s. It inspired him to create Pictures at an Exhibition in 1874. Originally it was created to be performed by a solo piano player, but in 1922 French Composer Maurice Ravel adapted it to be played by an orchestra. The Vancouver Island Symphony is bringing the composition to the Nanaimo stage during its Music and Visual Arts performance at the Port Theatre Saturday (Jan. 23). The show features violinist Calvin Dyck, who is also the symphony’s concert master. “That’s quite a famous work. The arrangement we are doing I have never done,” said Dyck. “It’s a favourite with audiences ... that work is familiar.” Each movement in the composition is linked to one of the drawings, paintings or sculptures in the exhibit Mussorgsky attended. It reminds Dyck of the times he spent studying music in Los Angeles. He had a Russian teacher who always encouraged the students to go and look at art to gain inspiration. “When he played he always chose a picture to relate the music to,” said Dyck. The show also features compositions by Ginastera, Danzas Argentinas; Sibelius, Rakastava; and Piazzolla’s Four Seasons of Buenos Aires. The Four Seasons of Buenos Aires, composed by Brazilian Astor Piazolla, retains components of Vivaldi’s The Four Seasons, written in the 1700s. “He (Piazzolla) is inspired by tango and

other South American influences,” said Dyck. The piece features a violin solo, which Dyck performs, but there’s a twist. The violinist must imitate the sound of a güiro, a Latin American instrument created out of a hollow gourd with notches played with a rubbing stick. “It’s a scrubbing motion. You use very little bow but lots of weight,” said Dyck. “It becomes a non-pitched scratchy sound.” To prepare for the performance, Dyck had to experiment with how to create the güiro sound. He tried behind the bow, on top of it and various other techniques to come as close as possible. It’s a challenge because usually musicians are asked to imitate sounds such as birds or other natural sounds, said Dyck. Imitating a sound of an instrument is a quite different. “The rhythms are unusual,” said Dyck. “It has a very syncopated accent and odd beats, changing metres. He really stretches the player.” Usually symphonies play older works, said Dyck, but for this show the symphony paid for the rights for the new pieces. “New arrangements of music are less accessible. It’s kind of special to get one,” said Dyck. He said Nanaimo audiences are some of the select few who will be able to hear this work. “We live in exciting times where composers are exploring sounds in unusual ways,” said Dyck. “As musicians we always like a newer challenge. We love to try newer creative things.” The show also features a pre-concert talk with Pierre Simard, symphony artistic director, from 6:30-7 p.m. “This show will be colourful and excitedly intense,” said Simard, in a press release. “A show of different worlds that will be like works on a canvas – vast, varied and beautiful.” Music and Visual Arts begins at 7:30 p.m. Tickets range in price from $33 to $59, $18 for students available by calling 250-754-8550 or online at www.port theatre.com.
Nearly a century before Robert Burns was making his Scottish voice known to the world, a Scottish Hibernian bard was practising her poetic craft. Rather then being celebrated, the bard Mary MacLeod, known as Màiri nighean Alasdair Ruaidh in Gaelic, was exiled for her work that criticized the Scottish chiefs submitting to English rule and the destruction of the Gaelic language. MacLeod’s work inspired poet Marilyn Bowering, a former Vancouver Island University professor, and led to the creation of her latest work Threshold. Bowering first encountered remnants of MacLeod’s work when she was living in Scotland in the mid 1970s. She found her way into a bookstore in the highlands of Scotland and stumbled across a book that included MacLeod’s work. “It’s the only book that was in existence. This reprint [from] 1934, that was the only possible way to read her work,” said Bowering. At the time Bowering wanted to purchase the book, but couldn’t. “She stayed in my mind, just the fact that this 17thcentury bard, a woman, was writing,” said Bowering. “It was ticking away in the back of my mind.” In 2010 she stumbled across McLeod’s work again. “I found myself very connected to her and the places she had visited,” she said.

Edgy play hits stage

The dynamic of power, submission and domination, between men and women is explored in Western Edge Theatre’s upcoming play Venus in Fur. The play, written by David Ives, raises questions about people’s view points. “The entire play is a power play. It’s feminist, highly intelligent, extremely sexy and [there are] very interesting observations between men and women and the power struggles we are in,” said Catterson. It is a two-person play, featuring writer-director Thomas Novachek, played by Jeff James Monson, who is looking to cast a lead actress for his adaptation of a classic sadomasochism novel. He’s frustrated. pages,” said Catterson. In the original version of the play Thomas’s character isn’t as fleshed out. Catterson expanded the role. “I wanted them to be on equal footing,” said Catterson. “I was really interested in his psychology and what makes him tick.” Monson said he can relate to some aspects of Thomas because they are both writers and directors and have felt heartbreak. Vanda questions his play and says it’s sexist and depicts women in a bad light. Yet, Thomas “stands his ground” and remains “resistant to her opinion,” said Monson. As a bard, MacLeod, didn’t write down her work. It was an oral tradition passed down through families. “She was living in a period where her culture was basically being erased,” said Bowering. Chiefs were being forced to send their children to learn English in English schools. “It was a very old culture. The culture had tendrils from all over Europe and she was highly regarded for upholding her culture and her values,”
said Bowering. “She was this vibrant voice from a very vibrant culture that was being steamrolled.” Eventually MacLeod was exiled, but the exact reasons for her banishment are unknown. “It was a serious exile with nothing to support her. She writes about being left without anything, without even any shelter and she was forbidden to write,” said Bowering. Bowering was “driven by curiosity” to learn more about
the bard’s life. “ S c h o l a r s t h e re really dismissed her until recently,” said Bowering. The name of herbook comes from a song created about MacLeod that tells the tale of her exile and when she returned to Scotland she couldn’t create her poetry either inside or outside a house. So she stood on the threshold, said Bowering. Bowering created the book in collaboration with her daughter Xan Shian. Shian shot 16 black

and white and five colour photographs for the book. “The photographs are extremely important and really help with the context,” said Bowering. “The images really make that much more concrete.” Bowering said Threshold, the photographs by Shian and work by MacLeod have created a conversation between the three women, each based on their artistic expression. The collaboration wasn’t deliberate, but seemed to evolve because of the women’s connection to the Scottish Highlands, said Bowering. “We both knew this

Spontaneous jazz music and classical pieces will spill into the air at the Nanaimo Conservatory of Music this Friday (Jan. 22). The Black-Lister-McRae Trio, consisting of pianist Miles Black, bassist Ken Lister and drummer James McRae, performs at the conservatory, located at 375 Selby St., at 7:30 p.m. “It will be very spontaneous and very fresh,” said Black. He said the trio often plays new compositions that it’s never performed before together to treat audience members to a new experience. The venue can influence the trio’s vibe. If it’s in a rural town the trio can be inspired by nature or if it’s a city it also changes. Black’s songwriting experience is continually changing. “Every time you put your pen to the page it is different,” said Black, adding it’s “the creative impulse”

t is with great sadness we announce the passing of Emily Leblond (nee Neave). Born and raised in Nanaimo, she had the privilege of serving as May Queen in 1945. She worked for 16 years at Nanaimo Hospital and after retiring, volunteered with Crime Stoppers. She was predeceased by her first husband, Donald Gilmour in 1971, her son, Larry Gilmour in 2007 and brother Butch Neave (2007) and Bill Neave (2008). She is survived by her loving husband, Marcel; daughter, Linda (Doug) Bleiler; step-daughter, Tanja (Jordan) Beveal and family; and numerous nieces and nephews. She will be sorely missed by her family and all whose lives she touched. The would like to thank the staff at Dufferin Place for their kindness. Sheila Jean POULSEN We are saddened to announce that Max passed away suddenly on January 17 in Nanaimo BC. Survived by his two sons, Gene (Nancy) and Geoff (Shannon). His loving wife, Wilma predeceased him in September of 2012. Also left to mourn his passing are his Sisters, Irene, Effie (Frank) as well as his brothers Jerry (Karen) and Ted (Irene). His brother Tom (Sally) also predeceased him. Max also left behind several grandchildren, nieces and nephews. Max was born in Millet, Alberta. He and Wilma lived in Calgary Alberta for many years and later moved to BC and eventually settled in Nanaimo where he enjoyed the Island life fishing, traveling, and meeting new friends. Max worked many years in the trucking industry and later had his own hot tub business in Nanaimo. He touched so many people’s lives and everyone who knew him will have their own special memories to hold on to. Pre-deceased by his parents Emmeline and Sydney and his first wife Olive. He loved gardening, bridge, and his favourite Chelsea soccer/football team. One would think, after all those goals, that the Nanaimo Clippers’ top line would have mastered the art of the goal celebration. Then again, maybe there’s no right or wrong way to celebrate a 50th goal. Clippers forward Sheldon Rempal reached the milestone Sunday afternoon in a road game against the Coquitlam Express, one-timing a pass from linemate Devin Brosseau
into the top corner of the net. When Rempal scored, he actually didn’t get as many hugs as usual, at least not at first. “Three of us went for the puck and kind of left him alone there with Yanni [Kaldis] on the celebration,” said Brosseau. Then came the fly-by of high-fives along the Clippers bench. “I kind of grabbed him by the neck and was talking to him and telling him how proud I am of him, and I kind of toe-picked on the ice and we

A former B.C. champion will be trying to regain that status this week. Kesa Van Osch of the Nanaimo Curling Club began play Tuesday night at the B.C. Scotties women’s curling championships in Coquitlam. “I think it’s going to be great competition,” said Van Osch the day before the first draw. “There’s lots of really strong teams, there’s lots of experience there this year, so I think it’s whoever gets hot this weekend and understands what’s going on on the ice and is able to put a series of games together will do well.” Her rink this year includes Kalia Van Osch at third, Shawna Jensen at second, Carley St. Blaze at lead and Marika Van Osch as fifth. “It seems to be working really well,” Kesa said. “Everybody kind of understands each other, knows what makes each other tick.” The Van Osch rink was among the first teams to qualify for provincials, surviving playdowns despite some inconsistency. “We wanted to do it the really long way, so we like to win a game, lose a game, win a game, lose a game,” Kesa joked. Consistency has been a focus in the team’s preparations. Mike Vandekamp, head coach, said all the players and coaches realize what Rempal has done for the Clippers so far this season. “Sheldon’s been such a big part of our team this year that his teammates were as excited about it as he was…” Vandekamp said. “Everybody was very excited to see him reach that pinnacle.” Before the start of the 201516 season, Rempal told the Bulletin he was targeting 35-40 goals.
