TERRACE - Submissions over how much Rio Tinto Alcan should be fined after being found guilty of killing salmon continued last week in Terrace court. The company was originally charged with one count each of harmful alteration of fish habitat and destruction of fish, two violations of the Federal Fisheries Act, from an event at Kemano where its hydroelectric facilities powering its Kitimat aluminum smelter are located. Those charges stem from an April 14, 2011 incident in which the company decreased the water supply to the Kemano River, a move that followed an emergency request made by BC Hydro regarding repairs the crown corpo-

ration needed to make. Rio Tinto was found guilty by provincial court judge Calvin Struyk a year ago and lawyers for the parties were before him last week regarding the size of a fine and other matters. Penalties imposed on the company could be fines of up to $1,000,000, up to six months in jail for the company’s officials or both. With eulachon and salmon in the Kemano River, and the importance of the eulachon to the Haisla people, Alcan had an agreement with the Haisla to give the eulachon priority. But in focusing on the eulachon, salmon weren’t considered, said Struyk in his March 2015 decision. That decision was released from a trial that took place over

several days in May and October 2014. In its own statement of May 13, 2013, BC Hydro said it asked Rio Tinto Alcan to cut the flow of water into the Kemano River, which would mean less water going through its generators to produce electricity, because of a “hot spot,” a bad connection on a transmission line that had heated up and was in danger of melting the connection. The transmission lines of Rio Tinto Alcan and BC Hydro are connected so that if the connection had melted, it could’ve potentially caused “catastrophic damage to the transmission line and surrounding area and result in a longer outage to repair,” said BC Hydro in that statement. It added that a repair was required as soon as possible.

In court Jan. 27, Crown prosecutor Michelle Ball said the crown wanted a fine of $250,000 and a Water Survey Canada gauge to be installed at a cost of $20,000 and monitored for 10 years with a cost of $20,000 per year. In replying, defence lawyer Robert Hunter said that if the flow had not been cut to the Kemano River, then the work to repair the hydro lines would’ve taken longer. And that would have come with a “catastrophic” loss of the eulachon fishery and “very significant” loss of the salmon fishery, he said. As it happened, there was some loss of the salmon but the eulachon were saved and there’s no evidence of long-term harm on the salmon fishery, said Hunter.

There’s still a lot of work to be done.” He said the town had received a response from the Prime Minister’s Office following the letter that Trudeau’s schedule is being reviewed to possibly fit in a trip to the Northwest. Meanwhile for B.C. specifically, the provincial sales tax (PST) is becoming a hot topic for LNG proponents. “The PST has definitely become an issue to them being able get a final investment decision because of the price of oil,” said Germuth. The companies appear to be seeking some flexibility in the PST rates to make them more competitive. “The PST does actually become one of the considering factors for them. So hopefully there can be something there to be worked out,” added Germuth. Companies are also seeking reassessments from their materials suppliers to provide a better rate due to the low cost of oil, he said.

KITIMAT - The Premier’s B.C. Natural Resources Forum had Mayor Phil Germuth in attendance to hear about the state of the province’s resources industry and he says the overall vibe is still of optimism, even if no final investment decision has been made on local megaprojects. The event ran January 19 to 21. There were certain takeaways that Germuth took from the event, one being there’s a will be the mayors of communities upstream, midstream and downstream of natural gas proposals who see value in potentially putting together a presentation for the federal government out east to underline the important of LNG to the region. Such a mission follows a recent letter from the District of Kitimat and the Haisla Nation Council inviting Prime Minister Justin Trudeau to the area. “The concern is that possibly back east they might be thinking

LNG location protest action takes an unwanted turn By Kevin Campbell

PRINCE RUPERT - As contractors complete work around Lelu Island for a potential LNG facility operated by Pacific NorthWest LNG, protesters that have taken up occupation around the area have escalated their presence, and it’s harming individuals who are in the vicinity. Last Thursday, Prince Rupert RCMP confirmed reports that protestors’ skiffs rammed a vessel called the ‘Glacial Mist’, a shuttle boat for workers going back and forth to the mainland, and they attempted to ram a Port of Prince Rupert vessel, the ‘Charles Hays’, but were unsuccessful. Additionally, one protestor boarded the dock of a working barge illegally. “We did attend that area with one of our patrol vessels and police do have an active investigation going on into those incidents and we continue to investigate as time goes by,” said Prince Rupert RCMP Sgt. Dave Uppal. The police presence had left as of Friday, but Uppal stated that they would return should activity escalate once

again. “If required [and] we receive a call for service, we will definitely look into it,” he said. RCMP already have open files in that area pertaining to theft, vandalism, and threatening behaviour and the sergeant stated that each one is inspected on its own, and no charges have been laid in last week’s confrontations. “Those matters are being investigated independently of everything else. Nobody’s been arrested at this time and we’ll continue to look into the matters,” said Uppal. The Prince Rupert Port Authority was disturbed to hear of the incidents, and have been dealing with protests in the area for months now, but this is the first time that the danger level has reached this high a level, said Michael Gurney, manager of corporate communications at the port. “Since the start of protest activities in Prince Rupert’s outer harbour, the Port Authority has been working with its partners, like the RCMP and Canadian Coast Guard, to ensure that site research activities continue in a respectful and safe en-

Unfortunately the actions by some opponents of the work have escalated from verbal confrontations, threats and vandalism to life-threatening misconduct on the water,

endangering themselves and other users of the harbour. Our focus remains on preserving a safe environment for all parties and we are very concerned by the irresponsibility of recent actions,” Gurney said.

Power project is paying off TERRACE - Three northwestern First Nations First Nations are profiting from a local hydro-electric project. The three, Kitselas and Kitsumkalum here and Lax Kw’alaams on the coast, are receiving modest payments thanks to the Dasque-Middle Creek runof-river hydro-electric project just southwest of Terrace. To date the Kitselas have received $9,200, the Kitsumkalum $12,000 and the Lax Kw’alaams $22,700. All three signed revenue agreements with the province last June, but backdated to 2012 when construction started.

Originally conceived by a small Vancouver company called Swift Power, the 20MW project is now owned by Calgary energy company Veresen which has a longterm contract to sell power to BC Hydro. Of the money paid to the province, half goes into general revenue and half into its First Nations Clean Energy Fund and 75 per cent of that latter revenue is then divided up among affected First Nations based on traditional interests on the land on which a project is located. How much each First Nation receives is based on a provincial

formula taking in the population of a First Nation and its distance from a project. With a larger population, Lax Kw’alaams is receiving just under half of the available revenue with Kitsumkalum receiving nearly 25 per cent and the Kitselas just under 19 per cent. That leaves just under 10 per cent which would be going to another North Coast first nation, Metlakatla, but it has yet to sign a revenue sharing agreement with the province. Commercial power production as of last May Dasque-Middle Creek was later than expected.

PORT EDWARD - The District of Port Edward received a belated update from RCMP Sgt. Dave Uppal at the Jan. 26 council meeting. Uppal delivered a file count from the past six months, as opposed to the regular quarterly updates, which he said he will try to maintain this year. He read off the file counts starting with July that had 30 files generated from Port Edward. The forest fire was noted as the major event that month, as well as erratic driving and one impaired driver who was stopped at a traffic stop and received a 90 day prohibition, a $500 fine, two violation tickets and the vehicle was impounded for 30 days. There were also files with regards to landlord tenant disputes, “which is not uncommon for communities of this size”, Uppal said. He included that there are 30 files but most involve the same people. August had 19 files, involving trespassing at the pulp mill and property-related cases. There were 24 files in September, mainly because of the occupation of Lelu Island, and these files got lumped in with Port Edward. “We have been getting a number of files out there over the last few months just with incidents that happened on the water,” Uppal said pointing out he will try to separate those files in the future as the other files regarding Port Edward were not too serious. However, he noted that there are many concerns about Lelu Island and al-

though he can’t discuss the number of ongoing investigations he said that the RCMP stance has been clear from the start. “You have the right to protest. That’s everybody’s fundamental right, we have no issues with that, but just do it safely,” Uppal said. There were only eight files in October including an impaired operation of a vehicle. Fraud or Internet scams were called in. A small amount of drugs were seized as part of a traffic stop as well. November had 13 files due to erratic drivers and some incidents at the pulp mill. Mayor Dave MacDonald mentioned that the mill is on Rupert land. Uppal made a note, then reported that December only had 10 files, none of which were serious events. The mayor asked Uppal if he finds that the RCMP are getting more files because people are calling in more from Port Edward, and Uppal said yes. “We encourage people to call us,” Uppal said. “We do have the resources to come out here to respond to the calls.” Uppal agreed to return for the next quarterly update. Before he left the meeting the district passed a motion to donate a jacket for a door prize at the Feb. 19 Guns and Hoses charity hockey game to raise money for the special olympics. Support for the fisherman’s union The district responded to a letter from Joy Thorkelson, Northern Representative for the United Fishermen and Allied Workers’ Union regarding the closure of Canfisco’s canning operation at the Oceanside

plant. Thorkelson asked for the district’s support on the union’s position on “adjacency, fleet separation and owner-operator policies” in the hopes that these three policy changes will bring benefits from the fisheries back to the coast. The district passed a motion to put forth a resolution to support the three policies. Rail safety concerns Mayor Dave MacDonald met with Canadian National (CN) Rail and discussed that the company needs to upgrade the crossings to stop the whistling throughout the area. Due to the lack of crossings the trains whistle throughout the Port Edward area, causing noise disruptions. “Hopefully by the fall they’ll be working on it,” the mayor said. CN didn’t give the mayor a specific date but it’s aiming to set up the four crossings in the fall. The district also invited CN to come to Port Edward to speak about propane coming through on the rails. “There’s going to be a lot more propane coming through when they build on Ridley Island,” MacDonald said adding that he thinks that is why CN is coming through with the crossings, “Before it was sound [as the issue] now it’s safety and noise”. On Jan. 20, AtlasGas Ltd. announced an agreement to have its own propane terminal on Ridley Island. The CN rail network will transport the propane to the island. Council is going to have a briefing from AltaGas in February to learn more about the specifics of what having propane railed through the district means.

PRINCE GEORGE Aboriginal leaders and family members of missing and murdered indigenous women met this week in Prince George. The Feb. 1-2 event was held with the support of the provincial government and attended by John Rustad, the provincial aboriginal affairs and reconciliation minister. Access was restricted. The event comes at a time when the newlyelected federal government has begun asking aboriginal groups across the country how they wish a national royal commission to be held. There have been growing calls for an inquiry to also take into account murdered and missing indigenous men.

WestJet cancels flight TERRACE - WestJet has announced the end of its direct Terrace to Calgary service. The service began early last May and the last flight will be March 5, one of a series of flight cuts to and from Alberta announced by the airline Jan. 25. WestJet uses a Dash 8-400 for the two-hour flight under its Encore des-

ignation. Also going is a direct Prince George to Calgary connection as are flights from Edmonton to Kamloops and Nanaimo. Service to Abbotsford and to Penticton is being cut back as well. The introduction of the service was regarded as a sign of a growing northwestern B.C. economy.

Helen Theresa Jackson (nee Ritter) With great sadness we announce Helen’s passing on Thursday, January 28th, 2016.

She is survived by her children, Wilson (Debbie) Jackson, Theresa Jackson, Robert Jackson, David Jackson; grandchildren, Frank (Nicole) Jackson, Jennifer Jackson, Rory (Jennifer Jo) Jackson; great grandchildren, Madison, Tyson, Lochlin, Ireland and Magdelyn; siblings, Freda (Ed) Linstead, Ida (David) Lochrie, Joe (Joan) Ritter, Connie (Fay) Ritter. Helen was predeceased by her husband, Andy in 1989 and siblings Andy Ritter, Rose Innocents, Roy Ritter, and Leo Ritter. Helen was born in Cosine, Saskatchewan to Clement and Bertha Ritter. She attended school in Kerrobert and North Battleford, Saskatchewan. Helen married Andy Jackson in 1949 at Cold Lake Alberta moving to Terrace, BC in 1958 where they resided until 1980. She worked at Terrace Post Office from 1960 to 1972 much of this time serving as a postal union representative. In 1980, Andy and Helen retired to Bowser on Vancouver Island where she was a long-time member of the Ladies Auxiliary Royal Canadian Legion Br. #211. Helen always loved a good debate and to lose herself in a book. Her family was the most important thing to her and she dedicated her life to caring for her children and making a wonderful, and loving home. Helen especially enjoyed her grandchildren & great-grandchildren and was the most amazing Grandma! The family extends special thanks to the Myhres, Smith, Munson and Walsh families for their support. PRINCE RUPERT - The All Native Basketball Tournament (ANBT) kicks off this coming week on Feb. 7. ANBT president Peter Haugan spoke about preparations, the unveiling of the new court, and the parody expected in the Seniors’ Division. “Everything is in order, the basketball portion of the tournament isn’t going to start until Feb. 8 - Monday morning. But on Sunday, we will have the coaches/managers’ meeting at 10

a.m. in the morning. At 2 p.m. we will unveil the brand new court. It will be in the arena, and a blessing of the court will happen. All are welcome to come witness the blessing of the new court,” he said. “At 7 p.m. on Sunday, [that] will be the opening ceremonies,” he added. Hosting the opening ceremonies this year is the Metlakatla Alaska Nation. In terms of competitive play, Haugan thinks that all four division titles are up for grabs with no one powerhouse expected to dominate. “The Seniors’ Division is wide open, there

are about five or six really good teams in there. They should push one another to be the champion. It should be a really level playing field, different than what we’ve seen in the past,” Peter mentioned. It should be a fantastic event, showcasing values and skills from First Nations culture, as well some quality basketball that some teams have been training all year for. KITIMAT - Kitimat’s world renowned racewalking athlete Ben Thorne has been nominated as a finalist for the Sport BC Athlete of the Year. He’s a finalist as Male Senior Athlete of the Year. The final award will be announced March 10. “A significant number of very strong nominations for each of the categories were received this year,” said Sport BC President Rob Newman. “The Athlete of the Year Awards provides a great opportunity to recognize these talented and deserving athletes, coaches and officials. This year’s nominees in all of the award categories are certainly a testament to the strength and depth of sport development in our province over the last 50 years.” Thorne made headlines in 2015 when he earned a bronze medal at the World Athletic Championships in Beijing. He took the medal in the 20 kilomtre race walk event. That event was Thorne’s second Worlds championships, the first in Moscow in 2013 where he placed 20th.

TERRACE - The River Kings return to home ice for their second playoff game this weekend, after crushing the Prince Rupert Rampage 5-2 in the first game of the playoffs last Saturday, Jan. 30. The teams set a quick pace, and Colten Braid from Terrace took a boarding penalty early on, which opened the Rampage to score the first goal. Rupert’s Tyler Halliday got the puck on the hash marks and found Kory Movold back door, who opened his playoff account with an open net. Both teams took penalties, for roughing, holding, interference, and cross checking, which saw some open ice play, including some fouron-four. But goalies played strong and teams couldn’t capitalize on power plays, and Prince Rupert took a 1-0 lead into the first intermission. As the second frame started, Terrace looked like they found another gear, punishing Prince Rupert with physical play and leading to the River Kings’ first goal. Steve Cullis brushed off the Rupert defenceman, checking him behind the net and then centred the puck to Ben Reinbolt who landed it to make it 1-1.

After a Rupert penalty for boarding, tempers were at the boiling point. Then Terrace’s Dawsen LeBlond picked up the puck out of almost thin air on the right hashmarks of the slot, and went to the short side for a 2-1 River Kings’ lead. The visitors kept up the pressure after their leading marker, but Rampage goaltender Devon Gerrits answered the bell. A couple minutes later, Rupert’s Tyler Halliday made a quick pass to Jared Meers who went short side on Terrace goaltender Patrick Leal in a two-on-one rush. They tied up the game again 2-2. But Terrace took full advantage of the minute following that goal, while Rupert’s defenses were down. Cullis landed one in the net on a pass from Josh Murray, making it 3-2 Terrace on a goal from Cullis. Terrace’s Colten Braid put the cap on what would be a period Prince Rupert would want to forget with a fourth goal in the frame. It was a feed from behind the net from Terrace’s Cory DeKelver, which made it 4-2 for the River Kings at the end of two periods. The third was gut-check time for Prince Rupert. The Game 2 of the playoff series is at 8 p.m. on Saturday night at the Terrace Sportsplex and Game 3, if necessary, will be Sunday afternoon at 4:30 p.m. in Terrace. The team that wins the River Kings / Rampage playoff series will advance to play the winner of the

other western playoff series, being battled with Smithers and Kitimat. In their first playoff game, Smithers shellacked the Ice Demons 9-4 in Kitimat. The hockey season will wrap up with the Coy Cup Championship in Terrace March 22-26. The River Kings have a bye into the tournament as the host team.
