A first offence for checking your phone while driving will cost B.C. drivers $543 when new penalties take effect June 1.

The fine for distracted driving goes up from $167 to $368, and drivers will also be assessed four penalty points, triggering another $175 charge. The combination results in a total penalty of $888 for

a second offence within a year of the first. Public Safety Minister Mike Morris said the new penalties put B.C. near the top of distracted driving fines for Canadian provinces.

Water tests show high E. coli levels Locals worry levels could impact fish habitat and local wildlife Tyler OLSEN Abbotsford News

Locals first noted pollution flowing into a pair of Bradner area creeks in late April. level was 9,000/100 mL. The results are not official, and the Ministry of Environment and federal fisheries ministry have also been investigating. The environment ministry hasn’t released results from tests on the water. Lisa Dreves, the stewardship co-ordinator at LEPS, said fish are known to live in the creek and the coliform levels detected in the water could have a significant impact on wildlife and anything else that comes in contact with it. Beyond being potentially harmful to drink,

including for livestock and wildlife downstream, Dreves said the coliform counts could jeopardize the habitat of organisms and animals that live in the water. “It means there’s a lot of nutrients getting into the stream and it could lead to algae blooms, which can then lead to a collapse of oxygen in the system, especially at night,” she said. “If we lose the oxygen then we could lose the bugs, we could lose the fish, we could lose any tadpoles … anything that’s relying on the water and the dissolved oxygen in

the water.” In order to see how the creek was affected by the run-off from the farm, LEPS also tested a section of Brough/ Bradner above the tributary affected by the mushroom site. E.coli results there were significantly lower, at 500/200 mL, but still exceeding many water guidelines. “500 is still too high,” she said. “The water quality in Brough Creek was already being affected by something else that’s upstream, probably due to fecal matter getting into the system.” The City of Abbotsford fined Delfresh in early

April after the first complaint surfaced about dirty water being discharged into a tributary flowing into the creek. Two weeks later, the city fined H.Q. Mushroom Farm, which is owned by the same person and located on the opposite side of 58th Avenue. The owner, Huu Quach, told The News that the issue at Delfresh was fixed the next day and only a “very, very small amount” of effluent entered the creek. He said he was working with “environmental people” to assess how to repair the damage.

Abbotsford motorist caught speeding in Surrey A novice driver from Abbotsford has been curbed after he was seen racing another car on Highway 1 in Surrey last week. On Thursday, at just after 1 a.m., the Port Mann Traffic Services officer spotted a car speeding near 152 Street on Highway 1. It was travelling 142 km/h in a 90-km/h zone. As the officer approached the vehicle – a 2008 grey Infiniti G37 – he saw it was jockeying for position with another car.

Once the vehicles were side by side, both accelerated to a radar reading of 197 km/h in a 100 km/h zone. The second vehicle then darted off the highway at the 176 Street off-ramp, while the Infiniti was pulled over near 192 Street. The driver of the Infiniti is a 22-year-old man from Abbotsford. He was given a $468 ticket for excessive speeding and received a 15-day driving prohibition. His vehicle was also impounded for a week.

“Vehicles travelling at this rate of speed on our highways is certainly not the norm,” said Const. Mike Moore of Port Mann Traffic Services. Police are now looking for witnesses to help identify the second vehicle. Water tests conducted by Bradner area residents on water downstream from a mushroom farm show E. coli and fecal coliform levels thousands of times worse than guidelines allow. Drinking water should contain no E. coli, while beaches are closed in B.C. when levels surpass 200 E. coli per 100 mL. But a test conducted April 24 on a tributary of Brough/Bradner Creek near Delfresh Mushroom Plan – which has already been fined $500 by the city – found 100,000 coliforms per 100 mL. Total coliform levels, including fecal coliform, reached 240,000/100 mL. The sample and test, including two others on Brough/ Bradner Creek was conducted by Langley Environmental Partners Society (LEPS), a local non-profit environmental organization, in conjunction with members of the Glen Valley Watersheds Society. Police, reminded drivers that being at a stop light or stuck in a traffic jam does not mean the distracted driving penalties don’t apply. NDP public safety critic Mike Farnworth said the government didn’t need to take a year to increase one of the lowest distracted driving penalty systems in the country, and giving the superintendent discretion over multiple repeat offenders doesn’t send a clear enough message. “Frankly, I think that if you get more than three in the course of the year, there should be no ‘may’ about it, you will lose your licence,” Farnworth said. Distracted and inattentive driving was a factor in the deaths of 66 people and injuries to 630 in B.C. in 2014. The Abbotsford Police Department said it issued 407 tickets for distracted driving in 2015. Local police have previously said that people were routinely breaking the law and didn’t seem to be getting the message about the dangers of distracted driving.

City’s payments to legal firm increased 50 per cent last year Payouts to law firm that represented city in homeless trial rose to $883,488 in 2015 Tyler OLSEN Abbotsford News

The City of Abbotsford’s legal costs rose substantially last year as it defended its parks bylaws during a lengthy Supreme Court trial, an analysis shows. The city paid its law firm, Murdy & McAllister, nearly $300,000 more than in most previous years, according to a report to be tabled at council next week. The city says that it contracted the firm to handle several files last year, and that the five-

week-long trial wasn’t the sole reason for the increase. The News had requested information about costs related to ongoing action against homeless protesters in 2014 through the Freedom of Information act, but was rebuffed after the city said it was protected under solicitor-client privilege. However, the city is required to disclose amounts paid to various companies – including law firms – in its annual Statement of Financial Information (SOFI)

report. The most recent report came to council’s committee of the whole this week, and will be forwarded to council next Monday. Comparing that document to SOFI reports filed over the previous six years showed the city paid dramatically more to Murdy & McAllister in 2015 than in previous years. Over six years, stretching from the start of 2009 to the end of 2014, the city paid Murdy & McAllister a total of $3.54 million.

The yearly amounts were relatively steady – ranging from a low of $482,418 in 2012 to a high of $678,182 in 2013. The average yearly payment was $589,852, a figure in line with the 2014 payout of $585,914. But last year, the legal costs rose dramatically, to $883,488 – a 50 per cent increase over both the six-year average and the 2014 number. But in a statement, a city spokesperson wrote, “There is not one factor that explains the entire increase.”

Retirements hit city payroll Two dozen employees expected to retire in 2016 Tyler OLSEN Abbotsford News

The number of retiring city workers has tripled over the past five years, costing the city hundreds of thousands of dollars as unused vacation time gets paid out, while creating challenges in terms of the experience and knowledge base at city hall. Twenty-four city workers are expected to retire in 2016, marking the sixth consecutive year the number of retirees has increased. In 2011, just eight workers retired, but the exodus has steadily risen since then; 20 city employees retired last year. The number of retirements has had an effect on payroll costs at the city. The City of Abbotsford paid out nearly five per cent more to employees in 2015 than the previous year, according to the annual Statement of Financial Information (SOFI) report presented to council Monday. The increase is mostly due to the fact that 2015 had an extra pay period, according to a city report, which suggests the pay period shift was responsible for more than two-thirds of the increased payouts. The SOFI report calculates money on the day that it is paid out, meaning that pay delivered in the first few days of January of 2015 for work done in December 2014 would be included in the 2015 report. And part of the increase comes from the fact

that unused vacation time by retirees ends up getting paid out in lump sums. Such payouts cost the city $510,000 more in 2016 than the previous year. City manager George Murray said the retirements are an ongoing issue. “As the boomers are leaving, it is more challenging,” he said. “We’re retiring people with 20, 25 and 30 years experience. The city paid out $51.3 million in renumeration – which includes wages, bonuses, car allowances, and other taxable benefits – in 2015. That figure is up 4.7 per cent, from $48.8 million the previous year. In addition to retirement payouts, contractual salary increases and a rise in payments to auxiliary firefighters also boosted the numbers. The report does not include payroll for the Abbotsford Police Department. Murray said the city tries to pay competitive salaries, while trying not to engage in bidding wards. “It’s not just about attracting staff, it’s also about retaining staff,” he said. “Local government staff are paid fairly and we are in a competitive market for staff. In order to attract the best and the brightest, we have to pay comparable amounts.” Murray said the city has, in the past, lost employees to other local governments that paid better. Total employee expenses paid out rose by 16 per cent, from $525,954 in 2014 to

$628,861 in 2015. A city spokesperson said the reason for the increase was not known, due to the variety of expenses paid out to staff. The number of employees making more than $75,000 increased from 234 in 2014 to 270 in 2015. A city report said much of the increase was due to employees just below the threshold the previous year receiving extra pay or overtime. Overtime by firefighters decreased slightly in 2015, but CUPE employees’ overtime rose sharply, by 38 per cent, from $356,020 in 2014 to $491,767 in 2015. Pull over, or pay up You can’t say there wasn’t fair warning. About six years ago, the B.C. government acknowledged the fact that cell phones are a major distraction to motorists, and that talking and texting while driving is downright dangerous, even deadly. In came extensive public awareness campaigns, along with a $167 fine for “distracted driving,� which actually can mean more than just blabbing or typing on a mobile, although that’s the primary focus. Clearly, that penalty was not near enough to dissaude thousands of drivers to put down their cells, or get a hands-free device, or simply pull over. In 2014, cell phones were a factor in 66 vehicle-related deaths in B.C., and 630 injuries. Last year, Abbotsford Police issued 407 citations for distracted driving. Across the province, that ticket total ran into multiple thousands.

So much for the argument that no one was paying attention because of a lack of enforcement. And please, don’t complain that police should have something better to do – as if this isn’t a serious matter. It seems that legions of drivers just can’t leave their cell phones alone. So, beginning in June, a first-time offence of distracted driving is going to cost $543. That’s $368 for the fine, and $175 for four penalty points. A second offence carries an $888 hit, and an automatic review by the Superintendent of Motor Vehicles that could result in a licence suspension. The government decision comes after public consultation over the past year indicated support for tougher measures. Now, even a few moments of cell phone yakking, or texting, is going to cost plenty. It will interesting to see if this level of financial pain will finally have the desired result.

Asked if that’s a possibility, she said: “I think we’re all thinking it. It’s the thing nobody wants to believe is going to happen, but when you’re a realist you start saying, ‘Where’s the money going to come from?’ ” Pauls said the district has spoken to the ministry about funding challenges, and hopes to be heard. At the same time, the province is headed for a new election next spring, meaning it’s unlikely the province would announce cuts to education funding before voters head to the polls. “It’s always interesting in an election year because people want to say the things that will get them re-elected.” Still, Pauls said districts need to know what their budgets may look like in the years to come, should the present government stay in power. “We would like a heads up,” she said. “All we know is more kids are coming and we don’t know if more money is coming.” Asked about education funding, Abbotsford South MLA Darryl Plecas said: “I am not aware of any expectation by the government that they will be decreasing funding in education.”

Inquest delayed into three mental-health deaths

BC Coroners Service postpones proceedings An inquest has been postponed into the deaths of three mental-health patients who passed away within a few days of leaving Abbotsford Regional Hospital (ARH) in December 2014 and April 2015. The inquest was initially scheduled to begin May 16 at the coroners court in Burnaby, but the BC Coroners Service announced Monday that it will take place at a later date, which has not yet been finalized. The availability of some key witnesses, additional information recently identified and an application for participant status received last week have combined to necessitate the delay, according to the service.

Presiding coroner Donita Kuzma said she has ordered the postponement to ensure that all of the information necessary for a thorough review of the circumstances of these deaths is available to the jury and participants. The inquest will look into the deaths of Brian David Geisheimer, 30; Sebastien Pavit Abdi, 19; and Sarah Louise Charles, 41. Geisheimer, most recently of Maple Ridge, died in Mission on Dec. 28, 2014. Abdi, of Abbotsford, died at the family home on April 26, 2015. Charles died near her Abbotsford apartment building, also on April 26, 2015. Each of the three had been admitted patients at ARH for

mental-health issues within a few days of their deaths, although the BC Coroners Services has not released any other details.

The inquest jury will have the opportunity to make recommendations aimed at preventing deaths under similar circumstances.

Pacific Spirit Choir performs Concert presents German Requiem by Brahms Violinist Calvin Dyck, the Pacific Spirit Choir, a professional orchestra, and soloists from Toronto and Chicago will present German Requiem by Johannes Brahms on Saturday, May 14. The concert begins at 7 p.m. at Central Heights Church, 1661 McCallum Rd. The seven-movement work is the largest that Brahms ever wrote (70 minutes in length), and features a full symphony orchestra, soprano and baritone soloists, and chorus – in this case, the 85-voice Pacific Spirit Choir. The choir, with director Gerald van Wyck, is based at West Vancouver United Church, and is known for presenting the great classic choral works, and for frequent tours. A highlight of their 2015 Europe tour was singing at the famous Gaudi “La Sagrada

Also featured is Ralph Vaughan Williams’ “The Lark Ascending.” The work is inspired by the English poet and novelist George Meredith and derived

from folk tunes. Begun in 1914, The Lark Ascending was disrupted by the First World War in which Vaughan Williams served as an orderly, and was completed in 1921. The Lark will be performed by Dyck accompanied by the orchestra. Tickets are available at King’s Music or House of James.

Slayer joins forces with special guests Anthrax and Death Angel this fall for a performance in Abbotsford as part of their North American tour. The concert takes place at 7 p.m. on Thursday, Oct. 20 at Abbotsford Centre. Tickets go on sale Friday, May 13. Fans will hear their favorite Slayer songs from the band’s 30-year-plus discography, as well as a few of the newer songs from Repentless, named the Metal Album of the Year by Guitar World. The group broke up following 1990’s Act III, but reunited in 2004 on Art of Dying. Conference focuses on family history

The Abbotsford Family History Centre (AFHC) hosts over 20 workshops on Saturday, May 14 in celebration of Family History Day. The objective of the conference is to help teach people ways to use modern technology and internet research to find their ancestors. Experienced volunteers with various levels of expertise, from beginner to advanced, will be on hand.

The Mayday Club Youth Choir for Autism Advocacy hosts a kick-off event on Sunday, May 15. The event runs from 5 to 7 p.m. at the Coast Abbotsford Hotel, 2020 Sumas Way, and includes a free appreciation dinner for sponsors and volunteers. There will be an introduction of the team, announcements and a question-and-answer session. The choir is a rock performance team for children, teens and young adults with autism, ADHD, depression and anxiety that aims to spread the message of diversity through rock music and dancing. The program is organized by local university students. The group plans on rehearsing from September to April and then performing at various venues and events in the Fraser Valley and Lower Mainland. The club will donate proceeds from concerts and merchandise sales to the Music Heals Music Therapy Foundation, to bring music therapy to sick kids across B.C. As well, the choir will offer volunteer hours to high school students and the opportunity to make friends and benefit from free music lessons. Children will be partnered with a high school student, and St. John Ambulance will send a therapy dog and handler to each practice in case any of the young team members feel overwhelmed. The hockey-player-producing factory at Yale Secondary had another banner day at the Western Hockey League Bantam draft on Thursday. A total of 11 student athletes were selected from the school, just one shy of the record set back in 2014. Josh Williams was the highest player taken, as he was selected fifth overall by the Medicine Hat Tigers. The Langley native scored 59 points in 25 games for Yale this season. Williams was the Canadian School Sport Hockey League’s most valuable player and top scorer. Picked 13th overall was defenceman Rhett Rhinehart from Lloydminster, who is now property of the Prince Albert Raiders. Also going in the first round of the draft was Kelowna’s Jackson Van de Leest, who was picked 16th by the Calgary Hitmen. Other Lions selected in the draft included: Harrison Blaisdell (31st, Vancouver Giants), Alex Swtlikoff (62nd, Seattle Thunderbirds), Abbotsford’s Austin Herron (65th, Moose Jaw Warriors), Alex Cotton (99th, Lethbridge Hurricanes), Ethan Leyh (160th, Spokane Chiefs), Blake Wood (169th, Kamloops Blazers), Alex Rolfe (192nd, Calgary) and Holden Kodak (229th, Portland Winterhawks). For the first time ever, the Abbotsford Christian Secondary Knights were tops at the Upper Fraser Valley Track and Field championships on May 4 and 5. ACS earned top spot at the competition, which featured 40 schools and was held at Rotary Stadium, compiling a total of 399 points. The Knights edged out W.J. Mouat, which placed second with

338.5. Abbotsford’s MEI finished fifth with 196 points. Points were given to the top eight finishers in each individual event, with relay teams earning double. The top athlete for ACS at the event was junior girls aggregate winner Cassie Brandsma, who finished first in pole vault and high jump, and finished second in triple jump. Abbotsford BMX is hosting the first race in both the BC Premier Series and the Canada Cup on May 14 and 15 at their track at 32470 Haida Drive. Club representatives are expecting hundreds of riders from the Lower Mainland and some from out of province. Racing will start at 11 a.m. on both days, starting with the half-trackers, then moving

Abbotsford BMX will also be hosting Next Gen training throughout the summer for those riders aiming for the national team and the World Cup. Rhonda Lee Anne Stahl, age 46, of Chilliwack, BC entered eternal life on Saturday, April 30th, 2016. She was born to Robert and Wendy Sen on October 14th, 1969. Rhonda always wanted nothing more in life than to be a mother, and once she became one it was clear to see that it was her true calling and greatest joy in life. She was a courageous, loving, beautiful woman whose greatest concerns were always for others above herself. Rhonda will be remembered for everything that she stood for and for all of her beautiful qualities. Her spirit will live on through her children; in Ashley’s compassion, Kelsie’s thoughtfulness, Jake’s sincerity, and Kyler’s heart. Rhonda is survived by her children Ashley (husband TJ, children Audrey and Theo), Kelsie, Jake and Kyler, her parents Robert and Wendy, her sister Bobbi Jo (husband Donovan, children Emily and Aurora), and her Grandma Madeline Gibson.
