If you have received a debt collection notice that you believe is in error, you have the legal right to dispute it. With a few simple steps you can enter into debt validation, the process where collectors must verify you owe the debt. Here are the steps you need to take to enter the process of debt validation. You must, in writing, dispute the debt as quickly as possible but in no more than 30 days from when you receive notice from a collections agency. The debt validation letter must state whether or not you are contesting the entire amount of the debt or just a partial amount. You can also request information on the name of the original creditor that the collection agency is now claiming to be collecting for. Before sending the letter, be sure to make a copy. When mailing the letter it is important that you send it certified mail with a request for a return receipt. Your return receipt is your proof that the collection agency received your letter and within the required time frame. If you do not send a letter in dispute within the thirty day time frame, it will be assumed that you are not contesting the debt and you are now legally responsible for it. Just as a side note, the collection agency, until they receive your validation request, will more than likely continue to pursue you for the debt in question. Once they have received your letter asking for debt validation they can no longer contact you until they are able to verify the debt. In order for them to pursue collections they must first show you proof on the debt in contention. The proof must come in the form of writing and contain the contract and statements on the account in question. The statements must show payments and the balance that is due. The collections agency must also show proof that the debt has been given to them to collect on. If the debt collector does not, within thirty days after receiving your dispute respond, then they can no longer continue to pursue your for collections. It is also not legal for them to report to the credit agencies the debt in question. If the debt does turn up on your credit report you can dispute its removal by sending the credit bureaus copies of your debt validation letter and copies of the certified and return receipt mail.
