OFFICIAL RULES THIRTY-ONE GIFTS CUSTOMER APPRECIATION CELEBRATION – VIDEO SUBMISSION CONTEST (NO PURCHASE NECESSARY TO ENTER OR WIN; VOID WHERE PROHIBITED)
ELIGIBILITY The Customer Appreciation Celebration – Video Submission Contest (“Video Contest”) is open to legal residents of those jurisdictions in which Thirty-One Gifts currently supports Consultant sign-ups (the United States, Puerto Rico, Guam, Virgin Islands, parts of Canada, and United States Military base residences APO/FPO) who have reached the age of majority in their jurisdiction of residence at the time of entry. Trustees, board members, employees, interns or Consultants of Thirty One Gifts, as well as their immediate families (including spouse, parents, siblings, and children) and their respective household members, are not eligible to enter. By submitting an entry to the Video Contest, entrants certify that their participation in this Video Contest is not illegal or in violation of any law, regulation, treaty or administrative act, and that the laws of their governing jurisdiction of residence at the time of entry do not prohibit or restrict the receipt of any prize under this Video Contest. Thirty-One Gifts reserves the right to reject any entry if, in its sole discretion, the laws of an applicable jurisdiction, including but not limited to the entrant’s jurisdiction of residence at the time of entry, would prohibit or limit Thirty-One Gifts from proceeding with the Video Contest as intended or the consideration, or the awarding of any prize would impose additional administrative, tax, operational or legal obligations on Thirty-One Gifts. Thirty-One Gifts reserves the right to disqualify any person that violates these Official Rules or tampers with or abuses any aspect of this Video Contest as solely determined by Thirty-One Gifts. All decisions made by Thirty-One Gifts in connection with this Video Contest, including without limitation, decisions related to eligibility requirements, are final and binding.
CONTEST SPONSOR The Video Contest is sponsored by Thirty-One Gifts, 3425 Morse Crossing Road, Columbus Ohio 43219 (“Thirty-One Gifts”).
ENTRY PERIOD The Video Contest begins at 12:00 a.m. EST on December 12, 2017 and ends at 11:59 p.m. EST on January 14, 2018 (the “Entry Period”). Entries submitted before or after the Entry Period will not be eligible. Thirty-One Gifts’ computer (Eastern Time Zone) is the official time-keeping device for the Video Contest.
WHAT TO ENTER Celebrate, Encourage, & Reward is not simply a tagline that Thirty-One Gifts practices, but a way of being. During our Customer Appreciation Celebration, we are extending our gratitude to many of our Customers in a variety of ways: great products, great offers, a good bit of surprise and delight, simple reach-outs and good wishes. But Thirty-One Gifts is also extending our gratitude into the world to simply extend general gratitude. Love, however it shows up, begets more love. For our Video Contest, and while we are extending our love and gratitude into the world, we’d like to know: “Why do you love 31?” An acceptable submission is a video expressing your answer, “Why I love 31,” which is approximately 31 seconds in duration. There is no minimum time for the video, but videos longer than 45 seconds will be disqualified. The following submissions are ineligible: • Submission emails in which the link to the video does not function or fails to directly open the Entrant’s video. • Submissions that include copyrighted music. • Submissions that include sexually explicit, nude, obscene, violent or other objectionable or inappropriate content. 1
• Videos that involve putting any individual in danger. • Videos that violate or infringe upon another person’s rights, including, but not limited to, copyrights and videos of persons without the necessary consent required by law. Thirty-One Gifts reserves the right to require entrants to submit evidence of the subject’s legal consent to be videotaped for the submitted video, which may include a signed waiver from the subject. NOTE: Waiver requirements vary by jurisdiction, and the entrant is responsible for obtaining a legally enforceable waiver from all of the videographed subjects. • Submissions for which Thirty-One Gifts is required to input a password or other criteria.
HOW TO ENTER 1. Post your video to social media, tagged with the hashtag #31appreciatesme; and 2. Make the video post publically viewable; and 3. Submit the following items and information via email to videocontest@thirtyonegifts.com: - A link to the Entrant’s video. - Entrant’s name - Entrant’s email address - Entrant’s primary phone number - Entrant’s primary consultant (if you have one) Upon submission of the email, the Entrant will receive an auto reply confirmation. Limited to one entry per person, per household. Entrants may be asked to supplement their submission on or after January 14, 2018. Failure to supplement the submission with the information requested might result in disqualification.
JUDGING Videos submission will be judged based on two (2) criteria: (1) emotional or entertainment value and (2) creativity. Judging will be conducted by a panel of three (3) Thirty-One Home Office employees to be selected by Thirty-One Gifts in its sole discretion (the “Panel”). The Panel will evaluate all valid entries and select the winners from all eligible entries. A total of 31 winners will be selected (the “Winners”). All judging decisions are final. Please do not contact Thirty-One Gifts about the status of entries or judging.
POTENTIAL WINNER REQUIREMENTS Except where prohibited, a potential Winner may be required to complete and return an affidavit of eligibility, including proof of age, and liability/publicity release within 14 days. If a potential winner fails to return these requested documents on time, an alternate potential winner may be selected in his/her place.
PRIZES Thirty-One Gifts will select and award prizes to 31 Winners. Each Winner will receive a $500 Thirty-One Gifts gift certificate to be used at Thirty-One Gifts (the “Prize”). The Prize will be placed, and can be redeemed, with the winner’s Thirty-One Gifts Consultant of Choice (the “Consultant of Choice”). Once placed with a Thirty-One Gifts Consultant of Choice, the Winner may not transfer the gift certificate to another Consultant. The Prize must be redeemed on or before December 31, 2018 at 11:59 p.m. EST. The remainder of the unused Prize will expire at that time.

Winners are responsible for paying any taxes and any and all other costs and expenses not listed above, including, but not limited to, customs fees, if applicable. A Prize may not be transferred and must be accepted as awarded. A Winner may not request cash or a substitute prize. The Thirty-One Gifts standard gift certificate terms and conditions will apply to the Prize.
RESULTS Winners will be contacted and notified directly by Thirty-One Gifts via phone. These phone calls will initiate on or after March 1, 2018. Thirty-One Gifts will use the contact information provided by Winner in his/her email submission. In the event Winner has provided faulty contact information, an alternate Winner may be selected. As part of the notification process, Thirty-One Gifts will explain the Prize, the prize redemption process, and request that the Winner name a Consultant of Choice. Thirty-One Gifts will subsequently contact the Consultant of Choice directly, will notify him/her of their Customer having won the Prize, and will explain the Prize and the prize redemption process. The Prize will be placed with the Consultant of Choice only after both the Winner and Consultant of Choice have been contacted via phone by Thirty-One Gifts and notified of the Prize. Upon placement of the Prize with the Consultant of Choice, Thirty-One Gifts will send a confirmation via email notifying both Winner and Consultant of Choice that the Prize has been placed and is ready for redemption. A Winners list will also be posted to www.mythirtyone.com/info/contest (www.mythirtyone.ca/info/ contest in Canada) on or after March 1, 2018.

YOUR RIGHTS Your video helps Thirty-One Gifts continue our cause to Celebrate, Encourage & Reward. You will retain all rights to any video you submit – including ownership, if applicable. By submitting a video to enter the Video Contest, you grant Thirty-One Gifts a royalty-free, nonexclusive right to: • Use the video for Thirty-One Gifts own promotional and/or commercial purposes, as well as for approved use by third-parties with whom Thirty-One Gifts may engage in joint marketing, all without remuneration to you. • Use the video in Thirty-One Gifts internal and external communications, including, but not limited to, websites and web publications, fact sheets, fundraising publications, advertising, multimedia, presentation, membership services, and magazines. • Use the video on the Internet and in Social Media. • Use, in connection with the Video Contest, your name and likeness. • Retain a digital copy of your video that will be archived in Thirty-One Gifts asset library and remain accessible to Thirty-One Gifts indefinitely. • Allow third-parties to share the video on social media.
GENERAL CONDITIONS In the event that the operation, security, or administration of the Video Contest is impaired in any way, Thirty-One Gifts may, in its sole discretion, either: (a) suspend the Video Contest to address the impairment and then resume the Video Contest; or (b) award the Prize(s) from among the eligible entries received up to the time of the impairment. Thirty-One Gifts reserves the right, in its sole discretion, to 3
disqualify and seek damages from any individual who tampers with the operation of the Video Contest, violates these Official Rules, or acts in a disruptive, unethical or unsportsmanlike manner. Thirty-One Gifts’ failure to enforce any provision of these Official Rules shall not constitute a waiver of that provision. Proof of sending any communication to Thirty-One Gifts by mail shall not be deemed proof of receipt of that communication by Thirty-One Gifts. In the event of a dispute as to the owner of an online entry, the authorized account holder of the email address used to enter will be deemed to be the owner. The Video Contest is subject to all federal, state, and local laws and regulations and is void where prohibited.
RELEASE AND LIMITATIONS OF LIABILITY By entering the Video Contest, you agree to release and hold harmless Thirty-One Gifts, its respective parents, subsidiaries, affiliates, and each of their respective officers, directors, employees, and agents (the “Released Parties”) from and against any claim or cause of action arising out of participation in the Video Contest or receipt or use of any Prize, including, but not limited to: (a) unauthorized human intervention in the Video Contest; (b) technical errors; (c) printing errors; (d) late or undelivered mail or notice; (e) errors in the administration of the Video Contest; or (f) injury or damage to persons or property. You waive the right to claim any attorneys’ fees and any damages whatsoever, including, but not limited to, punitive, consequential, direct, or indirect damages.
EMAIL SUBSCRIPTION When you enter the Video Contest, you may automatically be enrolled as an email subscriber of Thirty-One Gifts (if you are not already). This includes monthly special notifications and digital messages. You may cancel and unsubscribe from receiving emails at any time by following the unsubscribe instructions in the emails received.
PRIVACY Any information you submit as part of the Video Contest will be used in accordance with Thirty-One Gifts’ Privacy Policy which can be found at https://www.mythirtyone.com/jenny/info/privacypolicy in the U.S., or https://www.mythirtyone.ca/info/privacypolicy in Canada. The information you provide when you enter is provided to Thirty-One Gifts. Except where prohibited, you consent to Thirty-One Gifts’ use of your name and likeness in any list of winners (if applicable) and for promotional purposes in any media without further payment or consideration.
DISPUTES You agree that any and all disputes, claims and causes of action arising out of, or connected with, the Video Contest or any Prize awarded shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in Columbus, Ohio. All issues and questions concerning the construction, validity, interpretation and enforceability of these Official Rules, your rights and obligations, or the rights and obligations of Thirty-One Gifts in connection with the Video Contest, shall be governed by, and construed in accordance with, the laws of the State of Ohio, without giving effect to any choice of law or conflict of law rules (whether of Ohio or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than Ohio.
