he gulf stream is 70 miles from Hilton Head Island. Located off the coast of Hilton Head Island, the gulf stream has pushed storms past our coast line, kept our temperatures warmer in the winter and cooler in the summer and protect us from future hurricanes. This “river” or current in the Atlantic Ocean is the super highway. the Gulf stream and weather on Hilton Head The subtropical climate of South Carolina arises from the combination of the state’s relatively low latitude, its generally low elevation, the proximity of the warm Gulf Stream in the Atlantic, and the Appalachian Mountains, which in winter help to screen out cold air from the interior of the United States. the Gulf stream pushes hurricanes north First off, it is never said that it could never happen, however if you look around at the trees on Hilton Head Island, you can feel at ease that storms and hurricanes are turned north or pushed out to sea by our beloved gulf stream. The gulf stream is the pathway that these storms follow and as they wander off this path

the 14-day test for Vacation Properties P

urchasers of 2nd homes and rental properties don’t always factor the financial benefits into their purchase when weighing the purchasing option. Mortgage interest and taxes are standard deductions available to any second home owner, but what about the other deductions that may be available? Before you proceed, the first question, is your second home or villa on Hilton Head classified as residential or rental? the 14-day test: Hilton Head Vacation Properties If you rent your vacation property less than 15 days per year and only use it yourself, you do not need to report the income to the IRS. And as mentioned above, you still get the mortgage interest, real estate taxes and certain casualty loses. If you rent it for more than 14 days per year and use it 14 days or more or 10% of the time it is rented (whichever is greater) then your expenses are deductible. Keep track of your income

and expenses because your expenses are only deductible up to the amount of income. And once again mortgage interest and property taxes are deductible. Vacation Home deductions The expenses in excess of the rental income, mortgage interest and taxes are deductible for properties that are rented more than 15 days and used less than 15 days. If your AGI is under $100k and you actively manage your rental property, you are allowed to deduct up to $25,000 in losses against other income. This is gradually phased out for those that have income over $100k and disappears over $150,000. Of course, any losses not deductible may be carried forward and used against passive income. Expenses that may be deductible can include: mortgage interest, taxes, condo fee, electricity, insurances, community fee, phone, depreciation (structure, furniture and fixtures) and sewer and water.

Charles Fraser & The Alligator By Robbie Bunting he other day a friend called and asked what the story was regarding the man and the alligator on Pope Avenue. I told him the guy with the cap walking with the gator was Charles Fraser the founder of Sea Pines, and more importantly the man who discovered the present day covenant. I further explained that Charles went to Yale and was being groomed for his families lumbering business, but when he first saw the natural beauty of Hilton Head Island, all bets were off in cutting down any trees for his dad. Who is the statue of a guy walking with the gator on Hilton Head Island? Funny how it worked out, but Charles ended up protecting most of the trees on Hilton Head Island. published a story about Sea Pines. It included a picture of Fraser, then only 26, walking beside the alligator. That famous picture helped put Hilton Head on the map, and changed this Island forever. You can hug a tree on Hilton Head because of Charles Fraser! So if you were wondering who the man walking with the alligator is next time you are out, go ahead and hug a tree in honor of Charles Fraser. What is a Regime Fee on Hilton Head? W

e have our own language when it comes to Hilton Head real estate. We say villas, regimes, harbours, plantations and complexes when others would call them condos, condo fees, marinas, PUD’s and projects. We use the word regime for condos in Hilton Head because when a condo is built in South Carolina,a Horizontal Property Regime is formed and recorded. This regime than manages the common property going forward. This blog is about regimes fees on Hilton Head Island. What legally defines a regime on Hilton Head In South Carolina, Apartments, for horizontal property purposes, are defined in S.C. Code Ann. § 27-31-20(a) as a part of the property intended for any type of independent use including one or more rooms or enclosed spaces. Each co-owner, or owner of an apartment in a horizontal property regime, acquires condominium ownership, and owns his or her individual apartment, and has a common right to share, with other co-owners, in the common areas of the property.[ Queen’s Grant II Horizontal Prop. Regime v. Greenwood Dev. Corp., 368 S.C. 342, 628 S.E.2d 902, 2006 S.C. App. LEXIS 79 (S.C. Ct. App. 2006).] Common Ownership on Hilton Head Common property that a Hilton Head regime will take care of can include the pool, landscaping, trash, pest control, wood infestation, roofs, walls, common area electric, common area insurance, roadways, and sometimes working capital. They may also handle common area liability and hazard insurance, administration, and collecting regime fees. The reason we say usually as all regimes do not cover the same things. What’s not common Ownership When you buy a villa you own the inside space of your condo and undivided interest in everything around you. This fee can also include some insurance , cable tv and other amenties. Regime fee allows owners to split the cost (based on unit size) between all the other owners. Golf cart-friendly communities By Robbie Bunting

T

he best Hilton Head Island purchase we ever made was “Ol’ Bessie.” That is what my wife and kids named our 1991 club car golf cart. When we purchased her in 1993, she had already been set out to pasture by a golf course in the north east and we were told because the seasons were shorter up there, she still had a lot of life in her. We paid $1,500 and added the back seat kit and the top and she is still going strong. There are many reasons to own a golf cart and many areas on the Island that allow carts listed below. Places on Hilton Head where you can own a private golf cart The very large golf-cart friendly communities in the area include Sun City Hilton Head and Daufuskie Island. Some of the gated communities that allow private golf carts include Wexford, Palmetto Hall, Spanish Wells, Haig Point, Indigo Run, Colleton River, Berkeley Hall, Belfair, and Leamington. I have also spotted some golf carts in the Folly Field, Forest Beach, Jonesville Road, Spanish Wells Road and other secondary road areas. South Carolina law says licensed drivers can operate golf carts with a special permit on secondary roads or to cross a primary road during daylight hours less than two miles from their residence. Beaufort County Sheriff’s officials also said it is not safe to take a shortcut across a 55 mph highway in an electric cart. Golf carts definitely fit

What is a PoA fee on Hilton Head? By Robbie Bunting

I

f you drive through a security gate on Hilton Head Island, chances are there is an annual POA fee for this community. POA stands for Property Owners Association, which is a group of owners that oversee the roads, the security, the common area maintenance, the insurance, the lighting and landscaping in these common areas.

Private Gated Communities on Hilton Head One of the big benefits that many of these communities offer is the front security gate. While it is always best to lock your doors and be safe not sorry, on the last home we sold in a gated community, I had a hard time finding a key to the doors. This can be a problem if you are a prospective purchaser looking at real estate in the Hilton Head Area. You will probably want to enlist the aid of a local REALTOR to see all the properties the area offers inside and outside the gates.
