The EB-5 VISA - The Immigrant Investor Program What will change on NOV 21ST, 2019 EB-5 is the VISA that many Brazilians and other foreign nationals are looking for as a legal way to stay in the USA. The EB-5 Program is not something new. It has been around since 1992. The EB-5 was created by Congress in 1990 to stimulate the US economy through job creation and capital investment by foreign investors. The EB-5 has two mode. In one of them, it is necessary to invest US $ 1M in its own business with hiring local employees, so that the investor and his family receive the desired green card. In the other modality, the amount is US $ 500,000 for projects in rural or high unemployment, which generates 10 jobs for Americans over a two-year period.

This investment is made through Regional Centers designated by USCIS (US Citizenship and Immigration Services), based on proposals to promote economic growth. Recently, on February 15, 2019, President Trump signed a law extending the Regional Center Program until September 30, 2019. Under EB-5 program, entrepreneurs (and their spouses and unmarried children under 21) are eligible to apply for a Green Card (permanent residence) if they: ďƒź Make the necessary investment in one of these projects in the United States; and ďƒź Plan to create or preserve 10 permanent fulltime jobs for qualified U.S. workers.


NEW RULEMAKING BRINGS SIGNIFICANT CHANGES TO EB-5 PROGRAM Minimum Investments and Targeted Employment Area Designations, among Reforms. U.S. Citizenship and Immigration Services have made significant changes to its EB-5 Immigrant Investor Program. The final rules will become effective on Nov. 21, 2019. They include: • Raising the minimum investment amounts: minimum investment level will increase from US $1 million to US $1.8 million, the first increase since 1990, to account for inflation. The minimum investment in a TEA (Targeted Employment Area) increases from US $500,000 to US $900,000 to account for inflation. (It will automatically adjust for inflation every five years). • Reforming for certain targeted employment area (TEA) designations: Specially designated high-unemployment areas. Some of the changes will help direct investment to areas most in need and increase the consistency of how high-unemployment areas are defined in the program.

• Clarifying procedures for the removal of conditions on permanent residence: Allowing EB-5 petitioners to retain their priority date under certain circumstances: Certain immigrant investors will keep the priority date of a previously approved EB-5 petition when they file a new petition. Has it become more difficult to obtain investment or business visas under the Trump administration? Two and half years into the Trump administration, many ask us whether it has become more difficult to obtain investment and business visas (L1, E2, EB5) or other visas such as EB1 or EB2. Donald Trump made immigration a central theme of his campaign and this focus has carried into his presidency.

Rotarian Meeting

On August 6th, the Rotary Club of Brazil Orlando had the pleasure to have District 6980 Governor Cindi Cioci, and the governor’s assistant Andreas Goyanes, at the meeting. Also, João Calixto, a rotarian from the Rotary Club of Curitiba Ecological City, went to the meeting and shared some of the projects done in his club. Representing the youth, the President of the Rotaract Club of Brazil Orlando, Sarah Maldonado, and the Rotaract District 6980 Chair, Bruna Garbin Paes de Barros, were also present at the meeting. Many topics were discussed throughout the meeting. Emphasis was given to the 2019/20 goals, and the humanitarian work carried out
