he Soroptimist Chapter of Artesia-Cerritos held its 18th Monte Carlo fundraising event Feb. 26 in the Sierra Room at the Cerritos Center for the Performing Arts. Theme for the event was “An Evening in Casablanca”, taking those in attendance back to the year 1942. ATTENTION CERRITOS VOTERS Just say NO to GRACE HU in the Cerritos City Council Election After completing her term on the Cerritos City Council, Grace Hu was indicted by the California Department of Corporations on a conflict of interest charge. Grace, while a councilwoman, had used her escrow company to personally profit from her vote on a senior housing project, and subsequently ran several of those escrows through her own escrow company and purposely attempted to hide that fact. To avoid prosecution, she agreed to a “plea deal” that resulted in her paying a $40,000 fine and having to give up her escrow business. This is clearly documented in the California Department of Corporations official web site. If you go to

it will take you directly to the legal documents regarding Grace Hu’s indictment and settlement with the state of California. After what recently happened in Bell and in other cities in Los Angeles County, we certainly don’t want to elect any people with a checkered past to our City Council. Clearly, Grace has violated the public trust. Therefore, we believe the people of Cerritos should not vote for Grace Hu. Grace Hu does not deserve to return to the Cerritos City Council!

On Mar. 8 Cerritos voters will be going to the polls to fill three city council seats. Incumbents Mayor Joseph Cho and Councilmember Bruce Barrows are seeking a second four-year term on the council. Five other candidates are seeking to fill the position being vacated by Mayor Pro Tem Laura Lee who is leaving the council because of term limits. The five are former Mayor Grace Hu, Chris Fuentes, School Board member Mark Pulido, Harshad Mody and Kiran Rami. All are upstanding residents of the city. However, listening to some of them campaigning, one can’t help but wonder if they are seeking a seat on the Cerritos Council or another city. Apparently our neighborhoods are in disrepair with the streets crumbling making it almost impossible to drive on them without hitting a pothole. Our neighborhood sidewalks are being uprooted by tree roots making it almost impossible to walk on them. One of the candidates accuses the Council of being a rubber stamp body that does everything the city manager allegedly dictates to them and is leading the city down to an abyss of “Bell” corruption. The Performing Arts Theater has been described as a financial albatross around the city’s neck, ignoring the benefits it brings to the city in the way of theatergoers who frequent the city’s restaurants and shop at Cerritos stores, providing much needed sales tax to the city. While Cerritos is not perfect, each of
the candidates state they are proud of the city, its schools, its parks, and programs for both seniors and its children. However, the way some of them describe it, Cerritos sounds like a shantyville in a bad novel. Cerritos is not perfect, but its imperfections need to be looked at in perspective. If you attend or watch the city council on television, you know its members are listening to you when you come before them with a grievance. If an item is not on the council agenda the members can’t take any action on the matter, but it can and does ask the staff about it and if necessary instructs them to report back to them. The council can also recommend the matter be referred to one of the city’s commissions or put on the agenda for its next meeting when it can be discussed. During this time of economic duress, resulting in job loss throughout California and the nation, Cerritos has managed to maintain its fiscal integrity, bringing new businesses into the city. The Cerritos Center is a good example with the new Nordstrom Department Store, Forever 21, Apple, and a new “Lazy Dog” restaurant scheduled to open March 9. The Cerritos Auto Square is once again vibrant, having climbed out of the recession doldrums. It’s true the city is not immune to the recession and loss of revenue but Cerritos is solvent. The Council is aware of some of the needs in the neighborhoods and tries to address them, but they don’t ignore them. They are aware of the city walls that need to be repaired if not replaced, but unlike Merlin in King Arthur’s Court, it can’t wave a wand and new walls appear. The council has had to reduce the city’s budget that has slowed the city’s response to neighborhood concerns, but they are being addressed, if not as fast as some residents would want.

: Since on paper the CCPA is losing money, would you be in favor of adding performances so it is year round? If not, why not? Any other ideas to address the deficit?

uring my first election, in 1994, there were two candidates who supported selling the Theater as a way to eliminate Bruce Barrows the operating subsidies. Although there wasn’t a good answer to how do we sell a building at a price that would recoup the money invested by the City, it was just lets sell it and ignore the potential loss. The major question that no one has been able to answer is; if someone were to buy/invest in the theater, they would need a return on their investment – where would it come from, when we, with no debt to pay, like all theaters, aren’t able to generate a profit. Although I wasn’t on the City Council at the time of the building, I was involved during my 6 years on the Planning Commission. What stands out, to me, wasn’t the risk nor the boldness to build our award winning theater, but the way it fit into the plan for the town center. This City Council initiated project considered the whole of the Town Center (once referred to as the Golden Triangle). After considerable analysis, the City’s consultant confirmed the Council’s vision that buying the whole center and leasing the ground to owners of the office and retail buildings would generate significant income. The ground rent, the sales tax income and the property taxes all generate enough
income for Cerritos to not only cover the operating expenses of the theater each year, but to generate a profit for the City. The Theater was used to induce other businesses to come to Cerritos and the Town Center. It should also be noted, the more shows the Theater schedules, the better the businesses perform and the greater the value of the Town Center becomes. In closing, we paid cash for the Theater, which means there is no debt. Our Theater, when looked at as part of the whole Town Center is a successful money making project. Please vote for Bruce Barrows, third on your ballot.

his being the last column before election day, most candidates view this as a final opportunity to make promises to you, the voters, hoping Joseph Cho to get your vote. I'm not going to do that. I'm just going to recap my record on the council for the last four years. If you think I did a good job, you should vote to re-elect me. If you don't think I did a good job, you should vote for someone else, as this election is not about me, but about the future of Cerritos. I tirelessly worked to keep Cerritos' money in Cerritos. I gathered hundreds of signatures to place Proposition 22 on the ballot in November 2010 to keep Sacramento's hands off our money. Thankfully, Prop 22 passed with a very large margin. I worked to make city hall more transparent and open to residents. I pushed to make city council agendas and reports available on the city's web site almost a week before the meeting, effectively doubling the amount of time they have been available for the public to see.

I pioneered innovative constituent services programs to better inform Cerritos residents about what is happening in the City as well as to give them more opportunities to relay to me any concerns they may have. I have hosted a dozen Neighborhood Park Meet and Greets throughout the City. I also hosted Community Round Table meetings and written monthly newsletters to keep Cerritos residents up to date on happenings with the City. I am the first councilmember to make his cell phone number public. It is listed on the City's web site, and repeated here for reference (562)-547-4434. Cerritos is widely recognized as a wonderful city to live, work, and do business. During my tenure on the council, Cerritos won numerous awards including the All American City Award and the Eddy Award for being a Business Friendly City. Although I cannot take sole credit for all of those awards, as the credit goes to the entire city council, staff, as well as previous generations of city councils who helped us get where we are today. I can take credit for my contribution to what we have collectively achieved. I would like to thank all Cerritos residents for giving me the opportunity to serve you during the last four years. Methuselah reportedly lived to the ripe old age of 969 (is that doggie years?). Conveniently he missed the great flood by a week and probably didnâ&#x20AC;&#x2122;t brush and floss every day because he lost his teeth 800 years earlier. I am sure that if he had cared for his teeth and seen his dentist he could have held on to them much longer. As we all know aging takes its toll on our physical attributes. The mouth and our dentition are not immune to the march of time. Let me briefly review some of the most common changes that can occur. Saliva output usually diminishes as we get older. It makes sense considering other glands in our bodies start slowing down as well as the salivary glands. Eventually a â&#x20AC;&#x153;dry mouthâ&#x20AC;? condition develops and teeth lose their lubricating and protective film. Oral bacteria flourish and destructive decay and gum disease that had been in remission for our â&#x20AC;&#x153;mid-lifeâ&#x20AC;? years returns. There are several over the counter products that can promote salivary
output to ease the feeling of dry mouth. Prescription formulations are available for more severe types of dry mouth. As teeth wear against each other there is microscopic loss of the hard tooth enamel. Through the years this enamel wears thin or entirely disappears until the softer dentin core of the tooth is exposed. Gahr, which fell to Harvard-Westlake two seasons ago in the Division III-A title game, will face fifth ranked Mayfair, Saturday night at the Anaheim Arena. Potts scored a game-high 32 points, was 12 of 15 from the field and five of six from the free throw line. Potts, senior Javonte Sales and junior Anthony Martinez, are the only members from that Gahr team two seasons ago. “We had to pull something out of us,” Potts said. “I told them at halftime we can’t say, ‘would have, could have, should have’ to get to the championship. Coach told me to play the one and if they crash, then dish it off. I have trust in my teammates to knock down shots early. Cerritos Little League Baseball hopes to bounce back By Loren Kopff If it seems as if the Cerritos Little League Baseball organization is brand new, there’s a good reason to believe that. However, the only things that will look different when the season begins later this month will be a new board of directors, a new attitude and of course, new players to mix in with the old ones. Despite the Cerritos Little League going through some disarray which ended with the defection of the previous board a few months ago, a new board was put together in January when former parents received an e-mail that the league was being terminated due to a low turnout, said President Jason Tani. “This year was the first year that there was a little bit of disarray in the league,” Tani said. “The former president and the former board of directors basically got discouraged with the turnout of the kids. It’s unacceptable to cancel a season. It’s unacceptable to terminate a league that has been here three, four, five decades.

The parents who came back are truly the parents who have, to a certain point, a commitment or loyalty to the league.” Lately, the Cerritos Little League has seen a drop off in the number of players but despite that, Tani, who played little league baseball in Cerritos in 1980, says there has always been a Cerritos Little League. But he added that he has noticed less involvement in the past 15-20 years, not just in Cerritos, but also across the country. “Specifically in the city of Cerritos, we are incredibly fortunate because we have an incredible city that runs many different types of recreational leagues,” Tani said. “Cerritos, at this time, literally has three baseball leagues-The City of Cerritos recreational league, Frontier Youth Baseball League and now the Cerritos Little League. When you put all of those together, there are definitely enough platforms for kids to come out to have a good time, play and make friendships.” With two weeks to go before the opening day ceremonies and the first games, between 100-125 youngsters ranging from four to 14 years old have signed up for this upcoming season. Last season, there were approximately 200 players spread out over five age divisions: 4-5, 6-7, 8-9, 10-12 and 13-14. Tani said he believes this season will be stronger in the younger divisions. He also stated that at least one team will represent each of the age divisions. “It’s absolutely a low starting point but I guess to me, one child was a starting point,” Tani said. “Anything above one, to me, is advancement. It’s definitely a low turnout number but ultimately, what we have to remember, is we want to be able to provide an incredible experience whether it’s one or 60 or 90 or 2,000.” Tani said that since January, so many parents have become more involved. to cover the $3-$10 million deficit the District faces, depending on the education cuts coming down from Sacramento. “We have to have a balance budget.” Superintendent Dr. Gary Smuts said the Board must submit two balanced budgets to the Los Angeles County Board of Education. He said Budget “A” would be based on a continuance of the existing taxes the governor is seeking. This will result in an estimated District deficit of $3.5 million. Budget “B” will be predicated on the tax extension being defeated. That will leave the District with an estimated $10 million deficit if the governor carries out the cuts he has said will be necessary to balance the state budget. Dr. Smuts said at the next board meeting he would submit the two budgets. The board may adopt them or they may make changes. “However they still must adopt two plans so they can be submitted to the County Board of Education. Nothing will be done after they are submitted.” He said the Board would not take up the budget again until June 1. At that time they will know which budget to adopt. He reminded those present this was the fifth time the Board has had to do this. He said the state has already cut $28 million during the last few years from ABC’s budget. He said there isn’t any fat left to cut. From now on we have to start cutting the meat. Four graduating high school seniors in attendance said they were present because they care. “We want the kids coming up behind us to have the same opportunities we had.” One student said when he joined the band at his elementary school; he was so bad they other kids gave him a nickname. But as the year went on, he became a better player. He said the band taught him he could reach out and communi-
cate with the other kids. Other students asked the board to retain the elementary school [band] music program, saying the programs gave them confidence. It also teaches the importance of teamwork. One mother said Band [music] classes help the kids their entire life. Music makes the brain work. One parent said the music programs helps the students become adults as they progress in the school program. Another said 84 percent of the elementary school in the country has dropped music education. “Are we going to be part of the 16 percent that has music programs or join the 84th percent? Those enrolled in the District Adult Education School warned the board members if deeper cuts were made into the Adult Education program the school would not be able to offer quality education. They said just because many of the students are seniors, they should not be discarded. Other, who have children in elementary school but whose first language is not English said the ESL classes have not only helped them communicate with their children but their teachers too. Others said it has helped them on the job, with one gentleman saying because he can speak English better he has been promoted at work. Seniors in the water aerobics program said it was one of the few program seniors with back problems or arthritis can participate in without pain. “It’s good for our health.” One teacher, who has taught for 41 years inquired about the proposed District Foundation. She said people will make donations to such a foundation if they know the money will be used for things they like such as the elementary school music programs, adult education classes etc. It was later explained the District has filed to make the foundation non-profit.

In 2009 Congresswoman Linda Sanchez assisted Cerritos in garnering funding for the construction and installation of a proposed photovoltaic system to be incorporated into the Costa Villas Affordable Senior Housing Project. He said the proposed solar energy project would provide approximately 150,000 kilowatt hours of affordable renewable energy to the housing facility at a cost of $761,200. The Department of Energy [DOE] would provide a 50 percent fund match in the amount of $380,600 to help offset the cost of the installation with the city expected to contribute the balance of $380,600. In addition the project must be implemented by April 1, 2012. Extensions of the latter are available for a maximum of two additional years. Vancheswaran said due to delays implementing the housing project, staff sought potential options to utilize the grant within the time frame rather than risk losing the funding. The Corporate Yard was selected as a potential candidate. He said the Yard is the site of a recently completed Energy Block Grant project that installed 748 photovoltaic energy modules atop the Water Division’s six million gallon west reservoir and is capable of producing approximately 150,000 kilowatt hours annually, which is more than 50 percent of the total energy consumed at the Corporate Yard building. The cost of this initial System was $520,000, which was entirely funded through a grant from the
Department of Energy. Staff estimates this second system will be capable of producing an additional 225,000 kilowatt-hours annually for a total annual production of approximately 375,000-kilowatt hours. Combined the two renewable projects with a value of $1.3 million of which $900,000 in federal grants, will provide all the energy needs of the 25,000 sq. ft. Corporate Yard main building as well as a significant proportion of the power needed to operate the city’s C-2 water well located in the Corporate Yard. Because the project will be located at a Water facility and provide energy to directly serve the water utility, staff has proposed to utilize funds from the City’s Water Utility Fund for the necessary matching funds. It was noted that design plans for the Cuesta Villas Senior Housing Project would continue to provide for the installation of a photovoltaic project to serve the residents of the project. The renewable energy project is intended to be funded by the Redevelopment Agency’s Low-and-Moderate Set Aside Fund.

he CCPA’s ineffectiveness to bring the city revenue is obviously a big concern to all of us. We need to review the current state of the Grace Hu entire operation such as scheduling, managing, maintenance, advertising, etc… But what is more important is that we have to review all the past events and performances the CCPA hosted and evaluate the types of events that generated in the positives and the negatives. A big misconception is that if the CCPA is booked year round, that it will generate revenue. That is not true. There have been events in the past that ended up costing the city money rather than positive net gain. Each performances or events have to be staffed, pay talents, etc… So, rather than trying over ambitiously schedule CCPA year round, we should looked into booking not only performances but trying to lure in private parties that could use our beautiful facility as an event venue. Look into hosting events that are privately staffed and willing to rent out the center, so that we have a positive net income. Whatever the method is for generating revenue, we have to be creative in our efforts, whether that means giving out group discounts or last minute seat filler discounts. We have to seek out every possible way to turn the CCPA into a revenue generator that we all envisioned.

It helps our local economy by increasing business for local restaurants and hotels, and raises our regional profile. However, I would like to focus this final column on why I am running for City Council - it is to put the focus back on our neighborhoods. Cerritos is a world-class city, with world-class facilities, such as the Performing Arts Center, and our library. Cerritos is a wonderful place to live. I am proud to say that I am a product of Cerritos, growing up in these neighborhoods, enjoying our parks, and learning in our local schools. My wife, Gloria, and I are very happy to now be raising our children here. But our streets, sidewalks, parks and city trees have been neglected for too long, many falling into disrepair. It negatively affects our quality of life, property values, and sense of pride in our city.That is why I will make fixing our neighborhoods and re-investing in our infrastructure a priority. During these difficult economic times, it is important that we get back to the basics and focus on ensuring the safety of our neighborhoods and preserving the quality of life for all residents, whether you are still in school, just starting your career, raising a family, or enjoying retirement. I have a proven record of leadership in my nine years of service on the ABC School Board. By asking the tough questions and finding ways to do more with less, we have been able to maintain the high quality of our schools despite budget cuts. Test scores are at an alltime high and we have modernized all 29 school campuses. I am honored to have the support of community leaders from throughout this city, including Mayor Pro Tem Laura Lee and Councilmember Jim Edwards, as well as Congresswoman Linda Sanchez, State Controller John Chiang, State Senator Alan Lowenthal, Assemblymember Tony Mendoza, five former
mayors and five of my colleagues on the ABC School Board. My name is Mark Pulido, and I respectfully ask for your vote this Tuesday, March 8th to bring new leadership to the City Council that will put the focus back on our neighborhoods.

s I have said on many instances during the campaign CPAC is way underutilized. It is a first class facility, Kiran Rami accessible by 3 major freeways, and with ample parking. Barring the economic downturn of year or two, CPAC should have been making money all along. But it is not the case. It must at least break even and not drain the city funds, year after year. If elected, I would set up a task force of 3 citizens with some background in entertainment industry. The task will be: (1) Study of the current CPAC management (2) Explore Private-public partnership (3) Recommend performances that are attractive and affordable to the multi-culture residents of Cerritos, as well as nearby cities. (4) Broader reach marketing of the facility Please vote on March 8, 2011 for KIran Rami # 1 on the ballot.

The Norwalk Tank Farm was constructed in the 1920s by private oil companies before being purchased by the Air Force in the 1950s. It was used to store jet fuel, which was distributed to military installations in western United States. The military ended fuel operations at the site in 2001. Environmental cleanup operations began in 1995 and are continuing on the site. Mary Jane McIntosh, Co-Chair of the Tank Farm Restoration Advisory Board remarked, “This has been a win-win for the community. Removal of the tanks will help further the cleanup efforts and will be beneficial in the eventual development of the site.” Removal of the concrete pads that were underneath several

tanks is scheduled to begin in March 2011. The tank farm, formally known as the Norwalk Defense Fuel Supply Point, is located on the corner of Norwalk Boulevard and Excelsior Drive. The Tank Farm goes back to the 1920’s. Since then a school, park and several residential areas have been built around it. Sitting on 58 acres, it has been a city concern since the late 1980’s when contamination of the soil and groundwater were found. Since then the city and representatives in Congress have been calling on the Defense Department to find alternatives to the Tank Farm. In 1999, 800 gallons of fuel seeped into the soil after leaking from rusty pipes. The closing of the Tank Farm has been described as a milestone for the city and a victory for the city council. City officials praised Congresswoman Grace Napolitano who they said has worked diligently with the city in its efforts not only to close the site but have it cleaned up.

CITY OF CERRITOS STATE OF CALIFORNIA NOTICE TO BIDDERS OF THE ROSEWOOD PARK FENCE RELOCATION AT ARTESIA CEMETERY BID NO. 1111-11 Sealed bids will be received at the Office of the City Clerk of the CITY OF CERRITOS, First Floor, 18125 Bloomfield Avenue, Bloomfield Avenue at 183rd Street, Cerritos, California 90703 until 11:00 a.m. on March 15, 2011, 2011, for furnishing all labor, materials, and equipment for “ROSEWOOD PARK FENCE RELOCATION AT ARTESIA CEMETERY, BID NO. 1111-11.” Bids will be publicly opened at the Cerritos City Hall at 11:00 a.m. on the above date. Any contractor who elects to receive interest on moneys withheld in retention by the City of Cerritos shall, at the request of any subcontractor performing more than five percent of the contractor’s total bid, make that option available to the subcontractor regarding any moneys withheld in retention by the contractor from the subcontractor. If the contractor elects to receive interest on any moneys withheld in retention by the City of Cerritos, then the subcontractor shall receive the identical rate of interest received by the contractor on any retention moneys withheld from the subcontractor by the contractor, less any actual prorata costs associated with administering and calculating that interest. In the event that the interest rate is a fluctuating rate, the rate for the subcontractor shall be determined by calculating the interest rate paid during the time that retentions were withheld from the subcontractor. If the contractor elects to substitute securities in lieu of retention, then, by mutual consent of the contractor and subcontractor, the subcontractor may substitute securities in exchange for the release of moneys held in retention by the contractor. The contractor shall pay each subcontractor, not later than seven days after receipt of escrow moneys, the amount owed to each subcontractor from the moneys plus the respective amount of interest earned, net of costs attributed to the retention held from each subcontractor, on the amount of retention withheld to insure performance of the subcontractor. Requests for substitution of retentions or payment of retentions earned to an escrow agent must be made in writing and delivered to the City Engineer prior to the issuance of a notice to proceed and are subject to the approval of the City of Cerritos. The amount of retention shall remain at ten percent (10%) for the entire duration of the contract and reduction in retention percentage will not be allowed. Section 7107 of the Public Contract Code shall govern payment of the retention. The City of Cerritos reserves the right to reject any and all bids, or portions of any and all bids, or waive any informality or irregularity in a bid to the extent allowed by law. All bids are to be compared on the basis of the estimate of the quantities of work to be done. No bid will be accepted from a contractor who has not been licensed in accordance with the provisions of Chapter 9, Division III of the Business and Professions Code of the State of California. The contractor must possess a license of the following classification at the time the contract is awarded (and must maintain this license classification through completion of the project): “A” and/or “C13” is required. The City, its officers, officials, employees, agents and volunteers are included as additional insureds but only insofar as operations under the contract are concerned. 2. The Insurer shall furnish the City of Cerritos a certified copy of the policy within five (5) days of the City requesting a copy. The successful bidder shall maintain during the life of the contract the above specified insurance with the above-referenced special endorsement. Pursuant to the provisions of Section 1776, et al. of the Labor Code of the State of California, the Director of Industrial Relations for the State of California has determined the general prevailing rate of wages and employer payments for health and welfare, vacations, pensions and similar purposes applicable to the work to be done. If the bidder is found to be in violation of this Section on this work, the bidder shall be subject to all penalties imposed in Part 7, Chapter 1 of the California Labor Code. The successful bidder will be required to comply with all requirements of the Immigration Reform and Control Act of 1986 ("Act"). The successful bidder agrees to defend, indemnify and hold the City of Cerritos harmless from any penalties imposed as a result of non-compliance with the Act. By submitting a bid, the bidder offers and agrees that if the bid is accepted, it will assign to the City of Cerritos all rights, titles, and interest in and to all causes of action it may have under §4 of the Clayton Act (15 U.S.C. §15) or under the Cartwright Act (Chapter 2 commencing with §16700) of Part 2 of Division 7 of the Business and Professions Code, arising from purchases of goods, materials or services by the bidder for sale to the City of Cerritos pursuant to the bid. Such assignment shall be made and become effective at the time the City of Cerritos tenders final payment to the bidder. The successful bidder will be required to furnish a labor and material payment bond in an amount equal to one hundred percent (100%) of the contract price, a faithful performance bond in an amount equal to one hundred percent (100%) of the contract price and a warranty bond in an amount equal to ten percent (10%) of the contract price. The bidder is required to give written notice of the bonding requirements of subcontractors to potential and actual subcontractors and the bidder's attention is directed to Section 4108 of the California Public Contract Code. Any subcontractor bonds shall be secured from a surety company satisfactory to the City of Cerritos. As a substitute for retention of ten percent (10%) from each progress payment to the contractor, the contractor may, on his or her request and at his or her expense, deposit securities approved as eligible for deposit and in an amount equivalent to the amount retained by the City of Cerritos, with a state or federally-chartered bank in California as the escrow agent (“escrow agent”) or the City of Cerritos. Securities eligible for deposit shall be bank or savings and loan certificates of deposit, or such securities as are set forth in Government Code Section 16430 and which are approved by the City of Cerritos. Upon the deposit of such securities, the City of Cerritos shall pay the retained sum to the contractor and, upon satisfactory completion of all work required to be performed, shall return the deposited securities to the contractor. Alternatively, the contractor may request that the City of Cerritos make payment of retentions earned directly to the escrow agent established by the contractor, at his or her expense as provided under Section 22300 of the Public Contract Code. At the expense of the contractor, the contractor may direct the investment of the payments into securities and the contractor shall receive the interest earned on the investment upon the same terms provided for in Section 22300 of the Public Contract Code for securities deposited by the contractor. Upon satisfactory completion of the contract, the contractor shall receive from the escrow agent all securities, interest, and payments received by the escrow agent from the City of Cerritos pursuant to Section 22300 of the Public Contract Code. The contractor shall be the beneficial owner of any securities substituted for moneys withheld and shall receive any interest thereon.

The application of coatings, such as epoxy coating, galvanizing, painting, and any other coating that protects or enhances the value of such steel or iron materials shall be considered a manufacturing process subject to the “Buy America” requirements. A Certificate of Compliance, conforming to the provisions in Section 6-1.07, Certificates of Compliance, of the Standard Specifications, shall be furnished for steel and iron materials. The certificates, in addition to certifying that the materials comply with the specifications, shall also specifically certify that all manufacturing processes for the materials occurred in the United States, except for the exceptions allowed herein. The requirements imposed by said law and regulations do not prevent a minimal use of foreign steel and iron materials if the total combined cost of such materials used does not exceed one-tenth of one percent (0.1%) of the total contract cost or $2,500, whichever is greater. The Contractor shall furnish the Engineer acceptable documentation of the quantity and value of any foreign steel and iron prior to incorporating such materials into the work. Alternatively, the contractor may request that the City of Cerritos make payment of retentions earned directly to the escrow agent established by the contractor, at his or her expense as provided under Section 22300 of the Public Contract Code. At the expense of the contractor, the contractor may direct the investment of the payments into securities and the contractor shall receive the interest earned on the investment upon the same terms provided for in Section 22300 of the Public Contract Code for securities deposited by the contractor. In the event that the interest rate is a fluctuating rate, the rate for the subcontractor shall be determined by calculating the interest rate paid during the time that retentions were withheld from the subcontractor. After Our Lady of Fatima School captured 1st Place for the Southland division championship with an undefeated season, the girls were headed to the playoffs for the second consecutive year.
