The issuance of a certificate of occupancy shall constitute conclusive and indisputable proof that the builder has substantially performed Builders obligations under this agreement. Builder warrants the residence against defects in material or workmanship for the period of one year from the date of issuance of a certificate of occupancy.

This warranty is in lieu of any other warranties expressed or implied. This limited warranty does not include cracks or imperfections that may result from settling , shrinkage or drying out. Ceramic tiles are not warranted against cracking due to settling. Sod and landscaping is not warranted, damaged caused by soil or subsurface conditions from color shading variations, discolorations, mottling, streaks or staining or any pool, conditions from condensation, expansion , contraction or warping material, or which result from negligence or abuse by buyer, or from an act of God. Builders shall not be liable for any consequential damages. This limited warranty shall automatically be canceled if Buyer, Buyer’s agent or any other contractor or other party hired by Buyer makes or attempts to make any repairs or improvements to the Residence during warranty period.

RENTALS - Short Term & Long Term The Englewood area is a stunning area of Florida on the beautiful Gulf of Mexico. The area attracts thousands of tourists each year and is home to tens of thousands of full time residents. Each year more and more tourists discover this area and choose to return year after year. This has led to an undersupply of quality short term rental properties and thanks to this, rental returns are very attractive. The long term rental market demand is also out stripping current supplies as thousands of families lost their homes to foreclosure . These families now require a new home in which to establish their roots. As of July 2012 there were just a handful of single family homes available for long term rental. Our management company receives numerous requests for long term rentals on a daily basis, but due to lack of supply we simply cannot help facilitate these families. These are Families which have lived in the area for years, their children are at local schools and the parents are in full-time employment. The problem is not lack of funds it is purely lack of property.

LEASE OPTIONS WITH THE BRIC GROUP Lease option contracts are a great solution for both investor and tenant The investor gets a solid tenant who will look after the property as though it is their own, as it probably will be. The tenant gets security for the future as they have a guarantee that as long as they pay rent and bills, the owner cannot sell the home and ask them to leave. Whilst the tenant is living in the property our finance experts will assist them in repairing their credit scores (usually 3 years) which will eventually put them in a position to be able to purchase the property from the investor as contracted. According to Florida State Law, a property involved in a lease option contract the rent can increase by a maximum of 10% per year. Should the ‘real market price’ be higher upon appraisal from the bank after the three year period as stated in the lease option contract then this figure can become the actual selling price as long as it is specified in the lease option contact. Example addendum: The tenant agrees to purchase the property at the price specified within this contract OR at the appraisal price, whichever is higher. For the benefit of the example below we have allowed an annual 8% increase for the contract purchase price. This should be ample for the investor to lock in future profit, whilst not appearing to be greedy to the tenants. There is no State or Federal cap on this projected value. Tenants who are in a position to take advantage may have previously lost their home to foreclosure, yet have remained in work and continued to generate a healthy annual income. Many families that lost homes are still earning between $50-100.000 per year, but have been locked out of the buyers’ market due to lack of credit from the banks. The $100.000 ‘bond’ paid by the tenant upon signing the lease option contract is a non-refundable amount that is to be received as and utilized as part payment for the property upon purchase by the tenant. This could be considered a ‘technical cash-back’ for the investor which could be added to year one profits or used to pay off in part the mortgage they may have taken on the property. You will see from the financial example below that for investors in a position to get a lease option contract, the rewards can be very interesting. Please note our local representative will endeavor to locate option prospect whenever possible, however investors should acknowledge that lease option tenants are subject to the natural ebb and flow of the market
